1. Introduction

The EM LawShare consortium began in 2006, and since that time has offered legal advice on topics of the law to a variety of local authorities, on a wide range of issues affecting those in the public sector.

There are six firms who have been chosen to provide legal advice namely; Bevan Brittan, Browne Jacobson, Freeths, Geldards, Sharpe Pritchard and Weightmans.

The seminars are presented by lawyers from the six firms who are specialists in their field, offering locations in the East Midlands; Leicester, Nottingham and Derby, with some courses repeated in Birmingham and Sheffield.

We also offer a number of courses at Freeths’ offices in Leicester, Milton Keynes, Birmingham, Manchester and Sheffield via video conferencing. Where available, this is indicated.

Lunch is provided by the hosting firm at the end of each course.

Peter Ware is a partner and head of the government and infrastructure team at Browne Jacobson. He specialises in public procurement and local authority law; advises both public and private sectors in relation to European procurement regime, projects and complex commercial contracts.

Rachel Murray is a solicitor at Sharpe Pritchard and specialises in advising public sector bodies on contract law and all aspects of the procurement process, including procurement strategy, the application of EU legislation, negotiation and evaluation. Rachel has particular experience of advising Local Authorities on collaborative delivery methods and has herself spent several years working within a shared legal service for a number of Local Authorities.

Seminar overview

In July 2014, the government issued its Technical Consultation on Planning. This highlighted 6 areas for improvement:- neighbourhood planning; reducing planning regulation to support housing, high streets and growth; improving the use of planning conditions; improvements to the planning application process; amending environmental impact assessment thresholds; and improving the development consent order process. The government has recently responded to the consultations. This seminar will discuss the outcomes.

There have also been a number of important decisions from the Courts, covering a range of matters including the interpretation of the requirements of the National Planning Policy Framework on housing and heritage issues. This seminar will discuss these decisions and their implications for the work of local planning authorities.

This seminar will also discuss the implications for planning of the election portfolios of the main political parties.

Brian Hurwitz is a partner at Sharpe Pritchard and heads the planning law team. He has many years’ experience, both in the public sector and in private practice.  He has advised local authorities on plan-making and development management and has negotiated and prepared section 106 agreements on developments involving important strategic and/or regional sites. He has frequently spoken at seminars and client training events and has written articles in the Journal of Planning and Environmental Law and Planning magazine and in Westlaw Insight .  Brian is described

in Chambers & Partners 2015 edition as a "very good lawyer," who "protects his clients’ interests very well and it's always done with good humour”.  He was part of the Sharpe Pritchard team which was a finalist in the law firm of the year category in the Planning Awards 2014.  

Lorna Bowry is a senior solicitor at Sharpe Pritchard.  She has considerable experience, including as an in-house local authority lawyer. She deals with a wide range of planning matters, including negotiating and preparing section 106 agreements on developments of strategic and/or regional importance, preparing agreements under section 278 of the Highways Act 1980 and advising on planning enforcement and related policy issues. She has frequently spoken at seminars and client training events.   Lorna is an integral part of the Sharpe Pritchard planning team, which  is ranked in Planning Magazine’ s list of top planning solicitors,  the Legal 500 and Chambers  & Partners. She was part of the Sharpe Pritchard team which was a finalist in the law firm of the year category in the Planning Awards 2014.  

Huw Williams, Lead Partner, Public Law at Geldards has over 30 years’ experience of advising on compulsory purchase and highways schemes for local authorities both as an in-house lawyer and in private practice. Huw advised Derbyshire County Council on the Markham Vale scheme and Wrexham on the new access rods to the Wrexham Industrial Estate.

Charles Felgate, Partner, Planning at Geldards worked for a period in local government before joining Geldards over ten years ago. He has advised both local authorities, public bodies and developers on section 38 and section 278 agreements. He is currently revising the section agreements for the Porth Teigr media village scheme in Cardiff Bay – home of BBC’s “Dr Who”.

This seminar will provide an overview of homelessness and allocations, areas which are principally governed by Part VI and Part VII of the Housing Act 1996. The speakers will break down important legal and procedural principles and provide practical guidance.

This seminar will be at an introductory/intermediate level and would be suited to local authority housing officers and those making homelessness decisions, as well as others with an interest in homelessness and allocations.

Topics to be covered include:

An outline of the key provisions of Part VI and Part VII Housing Act 1996, including various sub-topics such as priority need and intentional homelessness;

Joe Walker is a Solicitor in the Litigation Department at Sharpe Pritchard LLP. He regularly advises on homelessness matters and acts for local authorities in homelessness appeals under s.204/s.204A of the Housing Act 1996 and judicial reviews. He has been involved in several reported Court of Appeal cases.

Greg Carson at Lambeth Council has over 20 years working in housing law, specialising in housing management agreements, and right to manage.

“The community infrastructure levy is a new levy that local authorities in England and Wales can choose to charge on new developments in their area....The levy is designed to be fairer, faster and more transparent than the previous system of agreeing planning obligations between local councils and developers under section 106 of the Town and Country Planning Act 1990.” The The Rt Hon Eric Pickles MP, Minister of State for Housing and Neighbourhood planning team, DCLG, November 2012

Five years on since the introduction of the Community Infrastructure Levy a large number of local authorities across the UK are still grappling with the implications and the effectiveness of the Levy. The governments of the day have, in turn had their difficulties with it and the Coalition government have committed to continuing it’s review the CIL Regulations again this year, which has been amended four times since its implementation. What was supposed to be a method of simplifying the delivery of infrastructure within a local authority area has resulted in a lengthy and complex process in terms of preparation and implementation. There is also a question as to whether CIL is effectively delivering the infrastructure required as a large number of authorities still rely on Section 106 planning obligations to bridge the gap (and will continue to do so in certain circumstances). The ability to do this however will be severely curtailed with the restrictions on the use of pooled contributions coming into force in April this year, meaning local authorities have no choice but to adopt CIL.

This seminar will explore how effective CIL has been in delivering infrastructure, how the forthcoming changes affect local authorities who have yet to adopt their charging schedules and the implications of the outcomes of recent CIL examinations, where local authorities have been told to set their CIL rates at nil or a lower rate due to viability issues.

The second part will focus on how best to approach regeneration projects identifying the ten key legal issues that you need to be aware of.

Whether it's overage provisions; when to transfer your land; how to ensure that viability provisions achieve a fair balance between landowner and developer; avoiding title problems; dealing with CPO issues; whether to dispose of a freehold or leasehold interest; how to ensure you can impose long term restrictions; incorporating the planning process; or appropriation, we can help you avoid the bear traps and guide you through the legal complexities.

Denise Stephenson is a partner within the planning law team at Sharpe Pritchard. Prior to coming to Sharpe’s Denise worked in local government and private practice. Denise has extensive experience of major regeneration projects advising public sector clients on complex aspects of planning and highway law. She has advised public sector clients on their statutory duties with regards to planning law including advising on challenge risk and mitigation. Denise has also negotiated many section 106 agreements and highway agreements for large redevelopment projects, wind farms and infrastructure projects. Denise has always had a ‘hands-on’ approach and works hard at developing and maintaining good client relationships. She is credited as being “exceptionally hardworking” Legal 500, 2015.

Brian Hurwitz is a partner at Sharpe Pritchard and heads the planning law team. Mark Calverley is Head of Property at Bevan Brittan LLP, having advised on regeneration schemes for both the public and private sector for almost 20 years. He's worked on projects across the country with a particular interest in corporate joint ventures (public/public or public/private). Legal 500 describe him as a "real market leader".

Sandy Munroe is a property partner based in Bevan Brittan's Birmingham office. She has over 15 years' experience and acts on large redevelopment projects and disposals for the firm's many public sector clients. Clients are full of praise for Sandy's superb

Olwen Dutton is a Partner at Bevan Brittan and the firm's lead in local government law. She is a former Corporate Director and Monitoring Officer, Head of Legal Services and has also served as a Chief Executive with a regional local government organisation. Currently she holds office as a Non-Executive Director of an Acute NHS Health Trust where she is Vice Chair and chairs the Quality and Safety Committee. During her many years of practical experience; she has advised senior officers and members on complex strategic as well as legal matters, therefore combining legal knowledge with the awareness of strategic decision making. Due to her senior local government experience and her involvement with the NHS, she is leading on the Integration agenda between health and social care as this experience has given her an inside view on the matters involved. Finally she has been named Partner of the Year by the Birmingham Law Society in 2013

Emmett Maginn, Solicitor at Browne Jacobson, specialises in health and social care law, including Court of Protection litigation, Mental Capacity Act issues and disputes involving the Mental Health Act. Emmett is also an experienced Adult Community Care lawyer with particular experience in dealing with Judicial Review claims alongside contentious public law Children Act matters.

The TUPE and equal pay case of Glasgow City Council and others v Unison claimants and another [2014] where the Inner House of the Court of Session considered whether employees who had transferred under TUPE from a council to LLPs could compare themselves with council employees for equal pay purposes.

The recent developments in the meaning of establishment in the redundancy cases of USDAW v Ethel Austin Ltd (in administration) and another (2014) and Renfrewshire Council v Educational Institute of Scotland (2012); and

Case law relevant to the introduction of Shared Parental Leave including Shuter v Ford Motor Company Ltd (2013) considering whether additional paternity leave policy was discriminatory, and the preferential treatment afforded to those returning from family leave in Sefton Borough Council v Wainwright (2014).

Holiday pay

We will review the recent decision of the EAT in Bear Scotland & Others v Fulton and others (2013) in relation holiday pay and overtime and consider the impact of this decision on the other local government pay elements and their inclusion in holiday pay calculations; what the appropriate reference periods should be; and what approach should be taken going forward to minimise liability.

TUPE Update developments

Where are we with TUPE?  Staff transfers are increasingly in the spotlight given the financial pressures on local government to look at new models for service delivery. For those involved dealing with TUPE it is essential to be up to date with this fast moving

Ros Foster became a partner at Browne Jacobson from 1st May 2013. Having started her career in local government, Ros continues to act for local authority clients on a range of vires and judicial review matters. Ros has acted on a variety of threatened judicial reviews against the Parliamentary and Health Service Ombudsman and the

Holiday pay

Tomos Phillips – Associate, Planning at Geldards LLP advises local planning authorities and private clients on a wide range of development control and enforcement matters as well as related aspects such as compulsory purchase and town and village greens. Much of Tomos’ work relates to sensitive landscape areas, such as National Parks.

Tim Morgan, is a retired Planning Inspector. After qualifying as a solicitor in private practice, he worked as a solicitor in local government, specialising in planning eventually heading the legal team in a city authority. He joined the Planning Inspectorate in 1989 where he initially dealt with general planning appeals and local plans. Tim moved to enforcement appeal work, firstly in England and latterly in Wales where he became the specialist advisor on enforcement and gypsy appeals. Tim has been a member of the Law Society Planning and Environmental Law Committee for 7 years.

Charles Felgate, Partner, Planning at Geldards worked for a period in local government before joining Geldards over ten years ago. He has advised both local authorities, public bodies and developers on section 38 and section 278 agreements. He is currently revising the section agreements for the Porth Teigr media village scheme in Cardiff Bay – home of BBC’s “Dr Who”.

Craig Elder, Browne Jacobson specialises in major projects and high-value contracts, and focusses on advising local and central government. Recently, he has worked with the Crown Commercial Service on procurement of major energy frameworks for gas and electricity and is working with Cheshire East Council on its innovative procurement of a partner to deliver a deep geo-thermal scheme. In addition to recent experience of energy schemes, Craig has also advised on a number of waste PFIs and other environmental projects (including some of the highest value schemes in the UK to date), the Ministry of Defence on a £500 million defence procurement and the Cabinet Office on the outsourcing of the UK’s resilience training function. In addition he has experience in the education, leisure and health sectors. Stephen Matthew, Browne Jacobson specialises in complex procurements for public and private sector clients. He is currently acting on a number of regeneration projects including social housing schemes, joint ventures and infrastructure investments. He has advised a number of local authorities on major outsourcing deals, including acting for Kent County Council on the outsourcing of its estate-wide facilities management requirements. He is also currently acting for London Borough of Enfield on the Lee Valley Heat Network, a city-scale district heating scheme. This project involves advice on procurement, state aid, and governance (including the setting up of wholly owned companies to deliver the project). Stephen has wide experience in the education sector, advising on capital programmes and development agreements. Stephen has also acted for major corporate clients on large outsourcing and capital projects.

Nathan Holden at Freeths has over 18 years experience of working in-house (5 years as a solicitor/senior solicitor) and in private practice for local authority clients on a range of different types of work. In particular he worked on the first of its type shared services arrangement between a local authority and two health bodies as well advising on commercial arrangements relating to the outsourcing of care homes, the provision of domiciliary care, leisure facilities and a project to facilitate the provision of high speed broadband to schools across the City of Coventry.

Nathan brings a mix of technical acumen and experience of what makes local authorities tick. This means that he is able to ‘hit the ground’ running in identifying the key issues and help anticipate key sticking points and potential problems so that these can either be avoided or their effects limited.

an update on the EU Data Protection Regulation and what it will mean for Local Authorities;

Ros also leads the firm’s Information Law practice and advises a range of public sector clients on information governance (including the Data Protection Act 1998 and the common law duty of confidentiality), the Freedom of Information Act 2000 and the Environmental Information Regulations. Craig Elder, Browne Jacobson specialises in major projects and high-value contracts, and focusses on advising local and central government. Recently, he has worked with the Crown Commercial Service on procurement of major energy frameworks for gas and electricity and is working with Cheshire East Council on its innovative procurement of a partner to deliver a deep geo-thermal scheme. In addition to recent experience of energy schemes, Craig has also advised on a number of waste PFIs and other environmental projects (including some of the highest value schemes in the UK to date), the Ministry of Defence on a £500 million defence procurement and the Cabinet Office on the outsourcing of the UK’s resilience training function. In addition he has experience in the education, leisure and health sectors. Craig speaks regularly on the issues flowing from major projects, and leads Browne Jacobson’s popular Engaging with Public Service seminars for public sector clients.

Stephen Matthew, Browne Jacobson specialises in complex procurements for public and private sector clients. He is currently acting on a number of regeneration projects including social housing schemes, joint ventures and infrastructure investments. He has advised a number of local authorities on major outsourcing deals, including acting for Kent County Council on the outsourcing of its estate-wide facilities management requirements. He is also currently acting for London Borough of Enfield on the Lee Valley Heat Network, a city-scale district heating scheme. This project involves advice on procurement, state aid, and governance (including the setting up of wholly owned companies to deliver the project). Stephen has wide experience in the education sector, advising on capital programmes and development agreements. Stephen has also acted for major corporate clients on large outsourcing and capital projects.

Nathan Holden at Freeths has over 18 years experience of working in-house (5 years as a solicitor/senior solicitor) and in private practice for local authority clients on a range of different types of work. In particular he worked on the first of its type shared services arrangement between a local authority and two health bodies as well advising on commercial arrangements relating to the outsourcing of care homes, the provision of domiciliary care, leisure facilities and a project to facilitate the provision of high speed broadband to schools across the City of Coventry.

Nathan brings a mix of technical acumen and experience of what makes local authorities tick. This means that he is able to ‘hit the ground’ running in identifying the key issues and help anticipate key sticking points and potential problems so that these can either be avoided or their effects limited.  

Stephen Pearson, Partner at Freeths, holds The Law Society Diploma in Local Government Law and acts predominantly in the public sector.  Stephen is an expert in EU Procurement law, advising on the procurement aspects of many schemes.  He gives advice on a daily basis to over 50 Council, Education and NHS clients on issues including negotiation of contracts, choice of procedures, contract variations, framework contracts, legal challenges and other issues following the Public Contracts Regulations 2006.  He has recently advised on and created a number of corporate entities such as companies and LLPs for local authority clients including Derby City Council, Milton Keynes Council and Allerdale Borough Council, Cumbria and has recently advised on several major State Aid issues.

An exploration of common, and potentially, complex issues associated with Academy conversions and ongoing relationships between the local authority and Academies. This will be an intermediate course. It is not a guide to the whole conversion process itself and will therefore be useful for those who already have some experience of Academy conversion.

Topics to be covered include:

Land Transfers – examples of complex issues and how to resolve them; Extension and re-fit of Academies at the point of conversion, and thereafter,

and the respective roles of the Academy, the local authority and the EFA. Governance arrangements within different forms of multi Academy trusts.

Speaker profiles:

Catherine Newman, Senior Solicitor at Sharpe Pritchard LLP joined Sharpe Pritchard in 2010. She specialises in contract and procurement matters. Prior to this she acquired extensive experience of local government legal matters, gained over fifteen years working as an in-house solicitor.

Catherine has particular experience in the field of education. She has provided advice and assistance to local government officers and members, head teachers, school governors and academy trustees on a wide range of education issues, with particular emphasis on whole school structural and governance issues. Whilst working as a senior solicitor, at Cambridgeshire County Council, Catherine provided legal support on the establishment of a number of trust schools, and to achieve tailor made, local solutions for schools in an OfSTED category. She also provided in-house legal support on the Council’s BSF programme.

Since joining Sharpe Pritchard Catherine has worked with a number of local authorities to complete the commercial aspects of multiple academy conversions; including sponsored and PFI projects. Catherine has also provided extensive legal support on a number of complex procurement projects including the outsourcing of education services by Slough BC. Recent work has also included advice on the joint procurement of schools meals by three London boroughs and the ongoing procurement of special education needs and mainstream transport services by a large county council.

Tanya Solomons, Solicitor at Sharpe Pritchard LLP qualified into the Real Estate team in 2011. She advises public sector and commercial clients on their commercial portfolios including property disposals and acquisitions, leases, licences, and dealing with a wide range of site-assembly and landlord and tenant issues. Tanya regularly provides advice on property issues associated with procured service contracts and offers extensive legal support on complex regeneration and infrastructure projects.

Tanya has a particular interest in providing advice on the property issues arising out of education projects and works closely with Sharpe Pritchard’s commercial team on instructions relating to academy conversions and PSBP/PFI projects. Tanya has advised local authorities, academy trusts and school governors on a broad spectrum of land issues relating to school sites, including complex land ownership arrangements, the rectification of title defects, effecting statutory transfers and co-ordinating disposal applications for the redevelopment of playing-field. Chris Holwell, Partner at Freeths advises education sector clients in relation to construction, refurbishment and maintenance projects.  His clients include Education Authorities, Schools, Universities and Colleges.  He has also acted for contractors and consultants working in the education sector and so has experience on “both sides of the fence”, which enables him to avoid wasting time by asking for unrealistic clauses in contracts.  His experience on the Authority/Client side in the education sector includes new primary and secondary schools under PFI, BSF, Academies Framework and DfE direct funded ones.  Also new buildings for Colleges and Universities and a variety of education sector facilities management contracts.
