EXECUTIVE SUMMARY Opening and closing of the polling stations (PS). According to the Promo-LEX OM, of 2094 monitored polling stations, 202 (9.6%) delayed their operations by up to 15 minutes. In addition, in the case of 12 PSs, the video recording cameras were not functional at the beginning of electoral operations. 34 PSs (1.6%) closed after 21.00. In the case of 38 PSs (1.8%), the video recording cameras did not film the entire counting process.

A number of electoral officials have not complied with the requirements for the vote counting process, in particular, the neglected requirements are: presentation of ballot papers to all participants in the counting process by one member (24.1%) and initial drawing up of a special form for vote counting results (1.3%).

Incidents observed during the election day. Having organized and held 16 observation missions, Promo-LEX noted that the parliamentary elections of February 24, 2019 are characterized by the biggest number of incidents that occurred in the polling stations and by mobile teams, reported by the STOs on the election day. Having processed the information reported by STOs, Promo-LEX OM informs that 1118 of the reported cases have been qualified as incidents on the election day. For comparison, in the last national elections, namely the presidential elections of 30 October 2016, the number of incidents identified in the first round was 267 and in the second - 467 (see Annex 2).

Promo-LEX OM points out that in the case of at least 51 PSs (2.4%), the Mission observers had limited access to the minutes on vote counting process. We qualify these deviations from the legal norm as incidents that seriously affect the integrity and transparency of the process of counting and totalizing of voting results. In addition, these deviations have a negative impact on the parallel vote counting carried out by the Mission.

We also highlight 24 other cases of obstruction of observers' activity during the voting process, especially reports about the tracking of at least one Promo-LEX mobile team by unknown people, as well as the obstruction of the right to observe freely within the PS.

In quantitative terms, the most frequently reported incidents were: deficiencies in electoral rolls (129), organized transportation of voters to polling stations (123), photographing of ballot papers and other cases of non-observance of the secret of voting (107).

In these elections, Promo-LEX OM informs of the large number of rumors, attempts, or even material or monetary rewards offered to voters - 59 cases. For comparisons, in the presidential elections of 2016, the cumulative number of incidents of this kind for both rounds was 17 cases.

In addition, we draw the reader’s attention to the incidents specific of this particular poll, which include interrupted filming of the voting process and counting of ballot papers - 79 cases and deterioration of ballot papers or other incidents related to their non-compliant use - 56 cases.

Final results of vote counting carried out by Promo-LEX OM. Promo-LEX OM analyzed the completion of 2093 minutes on the results of the vote counting process in 2094 polling stations received by the Mission; it was not possible to receive the minutes from one PS in any way. In terms of quality of minutes’ completion in the national constituency, Promo-LEX OM identified 142 minutes (6.8%) filled in with errors, revealed based on the verification formulas established by the CEC, in the single member constituency - 160 minutes (7.6%). We draw the reader’s attention to the large number of errors in the formula H = G1 + G2 + G3 + G4 + Gn, 69 for the NC and 60 for the SMC, respectively. This error in the verification formula reveals that the sum of votes cast for competitors does not coincide with the total number of valid votes cast.

In comparative terms, Promo-LEX OM points out that the proportion of erroneous minutes filled in the parliamentary elections is higher than that in the last elections held in 2016 and 2018.

The analysis of the results of parallel vote counting in the national constituency and in the 51 single member constituencies indicates that the the final data provided by Promo-LEX confirms the positioning of all competitors on the basis of preliminary data, announced by the CEC.

The constituencies in Chisinau that have the highest percentage of voters included in the supplementary lists are: no. 25 (11.33%), no. 32 (6.60%) and no. 26 (5.06%), while such constituencies outside the capital are: no. 17 Nisporeni (4.30%), no.7 Soroca (4.25%) and no. 43 Cahul (4.21%).

INTRODUCTION Report no. 6 is part of the activities carried out by the Promo-LEX Observation Mission (OM) for the monitoring of the parliamentary elections of February 24, 2019 and contains the main findings and trends of the incidents reported on the election day, as well as the analysis of the results of parallel vote counting carried out by Promo-LEX OM.

The report was developed based on the findings reported by the short term observers (STOs) in 2094 polling stations out of a total of 2141 open for the parliamentary elections, covering all the polling stations situated on the territory of Moldova and 76 out of 123 stations opened outside of the Republic of Moldova. Additionally, on the election day, voting procedures were monitored by 84 Promo-LEX mobile teams.

All the observers involved in the monitoring process have been trained in the seminars organized by the Promo-LEX Mission and signed the Code of Conduct1 of the Promo-LEX Independent National Observatory, committing to act in good faith and in a non-partisan way. The activity of all observers is coordinated by the central team of the Association.

The Promo-LEX OM of the parliamentary elections of February 24, 2019 is a project of the Promo-LEX Association carried out within the Civic Coalition for Free and Fair Elections. The Promo-LEX OM is not a political opponent of the competitors involved in the electoral race, it is not an investigative body and does not assume the express obligation to prove the observed findings. However, the observers' reports are accompanied, as far as possible, by photo and video evidence, which can only be made available to law enforcement bodies on the basis of appropriate requests, and in no case, shall it be provided to electoral competitors. At the same time, the violations, including the alleged ones, which are found in this report, must be considered by the electoral authorities in the light of the provisions of art. 22 paragraph 1 lit q) and 68 par. 5 Electoral Code, including as observers' observations, to be examined by the competent authorities.

The international standards referred to in this report are those developed by the UN, OSCE, the European Commission for Democracy through Law, the European Union and the Council of Europe. At the end of this report, we formulated preliminary recommendations for public authorities, electoral bodies, electoral candidates / participants in the referendums and other stakeholders to ensure the optimization of the electoral process.

I. OPENING AND CLOSING OF THE POLLIGNS STATIONS According to art. 55 of the Electoral Code, voting on the election day is carried out from 07.00 until 21.00. Pursuant to the CEC Regulation on the operation of the Video Recording System in the polling stations, video recording aims at fixing the processes of voting, counting and totalization of voting results.

According to the Promo-LEX OM, of 2094 monitored polling stations, 202 (9.6%) delayed their operations by up to 15 minutes. In addition, in the case of 12 PSs, the video recording cameras were not functional at the beginning of electoral operations. 34 PSs (1.6%) closed after 21.00. In the case of 38 PSs (1.8%), the video recording cameras did not film the entire counting process.

Monitoring of the opening of the PSs was based on the findings of 2094 Promo-LEX observers. According to their reports, Promo-LEX OM found the following:

INCIDENTS CONCLUDED ON THE DAY OF THE ELECTION Having processed the information reported by STOs, Promo-LEX OM informs that 1118 of the reported cases have been qualified as incidents on the election day. 2.1. Refusal / difficulties in obtaining copies of minutes in polling stations and constituency councils

According to art. 63 par. (4) of the Electoral Code, the minutes on the results of voting shall be drawn up in several copies, one copy of the minutes shall be kept by the EBPS, one copy shall be submitted to the CC, one copy shall be displayed immediately upon entry into the the PS and the others, must be handed over to representatives of electoral candidates and observers.

Contrary to the legal provisions quoted above, Promo-LEX observers were refused the minutes in the case of 51 PSs (2.4%), in some cases being given the permission to transcribe the results from the minutes into the STO’s form, being provided with special forms of vote counting instead of minutes. With full conviction, we emphasize that this phenomenon seriously affects the integrity and transparency of counting and totalizing of the voting results. The large number of refusals points to a systemic problem in the electoral bodies' approach to the role of observers and transparency of procedures for counting and totalizing of voting results.

Receiving the minutes from the EBPS was doubled by photographing the copies received by constituency councils. In this regard, we note that in the case of 10 SMCs (19.6%), Promo-LEX observers experienced difficulties in accessing and making copies of the minutes: SMC no.1, 2, 5, 7, 8, 9, 22, 24, 34, 41.

2.2. Restricted access or obstruction of free observation process in the polling station

According to art. 68 par. (5) of the Electoral Code, observers accredited by the CEC can monitor the electoral process throughout the country and in all polling stations, while observers accredited by CCs – can do it only on the territory of the respective constituency. Accredited observers have the right to attend all election operations, all electoral sittings, including on the election day, without interfering in the electoral process or other electoral operations, as well as to inform the president of electoral body about the irregularities observed.

According to the Promo-LEX observers' reports, there were at least 24 cases, in which observers were restricted or refused free observation in the polling station. We draw the reader’s attention to the reported tracking of the Promo-LEX Mobile Team in the SMC no. 36.

2.3. The ballot boxes were not sealed according to the legal procedures / broken / damaged or missing seals on ballot boxes

According to art. 60 par. (1) of the Electoral Code, on the election day, at 7:00, the President of the EBPS, in the presence of at least half of the members of the Bureau, checks the ballot boxes and seals them. In accordance with p. 26 and 27 of the CEC Instruction on the provision of PS infrastructure, the securing of ballot boxes is achieved by sealing. Stationary ballot boxes are sealed by means of 4 self-locking seals and mobile ballot boxes by 1 (one) seal.

2.4. Absence / deterioration of the necessary materials in the polling station.

Point 55 of the Regulation on the activity of the electoral bureaus of the polling stations determines that during the elections, the electoral bureau of the polling station shall verify the availability of documents and materials received: electoral rolls, ballot papers, special forms, minutes on vote counting results, the stamp of the electoral bureau.

According to the Promo-LEX observers' reports, there were at least 5 cases, in which absence or deterioration of the materials needed for the activity of the PS was reported.

According to art. 60 par. (8) of the Electoral Code, the activity of electoral bodies can be assisted by: members / representatives of hierarchically superior electoral bodies; representatives of electoral competitors in electoral bodies; national / international observers accredited by the respective bodies and their interpreters, as the case may be; representatives of mass media.

Promo-LEX observers found at least 50 cases, where certain categories of unauthorized persons were present in the PS for a period longer than the permissible limit according to the legal provisions.

2.6. Ballot papers that have not been distributed to EBPS members are not securely kept in the polling station

According to art. 60, par. (2) of the Electoral Code, ballot papers shall be kept in a safe place inside the polling station, in packages of 100 pieces.

Promo-LEX observers reported only 2 cases that can be described as acts of compromising the security of the voting process. Such cases were detected in the SMC no. 50 – PSs 33 and 63.

2.7. Rumors, attempts, or even material or monetary rewards offered to voters

According to art. 41 par. (5) - (6) of the Electoral Code, electoral competitors are prohibited from offering money to voters, from distributing free of charge, any material goods, including humanitarian aid or other charitable actions, except for symbolic gifts, representing electoral or political publicity, made out of declared funds from the "Electoral Fund" account, bearing the symbol of the electoral competitor and whose market value does not exceed 2 conventional units.

2.8. Electoral campaigning at the entrance to or within the polling station

According to the Electoral Code, art. 50, par. (10) on the election day, no election campaign is allowed in the polling station or at the entrance to the polling station.

Promo-LEX observers reported at least 64 cases that can be classified as electoral campaigning or publicity at the entrance to or within the polling station to influence the voters' choice. Thus, 30 cases were identified with the involvement of the PPS representatives, the PDM - 13 cases, the PSRM - 12 cases, the PN - 3 cases, ACUM Bloc - 2 cases, unidentified candidates - 2 cases. In two other cases of campaigning within the premises of the PS, EBPS members were involved – for the PSRM (1 case), unidentified - 1 case.

2.9. Organized transportation of voters (buses, minibuses, or other transport units that would normally not be in the vicinity of the PS)

Despite the fact that organized transportation of voters is not foreseen as a violation of the provisions of the Electoral Code, Promo-LEX OM monitored these cases as actions with sufficient potential to corrupt voters and to influence the voting results.

Promo-LEX observers identified at least 56 PSs, or more than 123 cases, that can be interpreted as organized transportation of voters. 60 of them (about 49% of the total) refer to the PSs from the 2 SMCs set up for the Transnistrian region. In terms of number of transport units involved, PSs in the SMCs no.47 and 48 clearly stand out from other polling stations.

2.10. Unjustified cessation of voting in the polling station

According to art. 56 par. (1) of the Electoral Code, during the time assigned for voting, it is forbidden to close the polling station and to suspend the voting process, except for cases of mass disorder, natural disasters, other unforeseen circumstances, which put voters at risk or make the voting impossible.

2.11. Acts of violence or intimidation of voters or other people

According to art. 60, par. 7) and 9) of the Electoral Code, on the election day, the president of the EBPS shall be responsible for ensuring the security of the voting process and order in the polling station and in the surrounding area within 100 meters of the polling place. The decisions taken for this purpose are enforceable for all. The law enforcement officers may enter the PS only if they are invited by the EBPS president to help restore the legal order.

Promo-LEX observers reported at least 39 cases that can be described as acts of violence or intimidation of voters, EBPS members, observers or other persons. The reasons for the violence identified by the observers were as follows: 5 cases - refusal of the EBPS to allow them to vote although this was not the PS, to which they were assigned, 9 cases - alcoholic intoxication of voters and of an EBPS member whose authorization was later withdrawn; 2 cases - faulty activity of the EBPS, two cases - mayors attempting to influence voters, one case - voters from the Transnistrian region that were brought in an organized way into insufficiently spacious PS, in 15 cases - disputes between observers representing different competitors, and 5 cases – the reason was not identified.

2.12. Deficiencies in the operation of the SIAS Elections System

Point 61 of the Regulation on the activity of the EBPS establishes that a member of the Bureau shall hand the ballot to the voter only after the voter has been screened by the SIAS Elections System and it has been found that all the conditions for voter participation in the polling station have been met.

2.13. Deficiencies in electoral rolls

Electoral rolls drawn up on the basis of the State Electoral Register are lists of all citizens holding voting rights who are domiciled or have their residence visa within the territory of a polling station. The voter can only be registered on a single electoral roll and in a single polling station.

According to the Promo-LEX observers, deficiencies in electoral rolls remain the most reported incident. This is also true from a comparative perspective with the previous polls.

A total of 129 problematic situations has been reported, including: presence of deceased persons on the list (47 cases), non-inclusion in the main electoral rolls of voters that through their identity documents prove that they have been assigned to the respective PS (37 cases); foreign persons registered at voter’s addresse or former owners (25 cases), errors in address / personal data (18 cases).

Pursuant to point 68 of the Regulation on the activity of the electoral bureau of the polling station, it is forbidden to photograph the completed ballot. Pursuant to point 19 of the Instruction on the provision of PS infrastructure, the location of the voting booths shall be such that their uncovered part be oriented towards the unobstructed wall of the PS at a distance of not more than 1 m.

According to the Promo-LEX observers' reports, there have been reported at least 107 cases of photographing of ballot papers, as well as cases of violation of secret of voting.

2.16. Unjustified group voting (there are 2 and more people in the voting booth)

Articles 5 and 6 of the Electoral Code stipulate the universal principles underlying democratic elections, namely direct and secret voting, that is, the voter shall elect secretly and in person, thus excluding the possibility of influencing the will of the voter. Voting in place of another person is forbidden. The voter, who is not able to fill the ballot individually, has the right to invite another person into the voting booth, except for EBPS members, representatives of electoral candidates/ participants in the referendum and persons authorized to assist in the electoral operations.

Promo-LEX observers reported at least 94 cases that could be categorized as violation of direct and secret voting or unjustified group voting during the election day. There was not a single case involving visually impaired voters. We can assume that the large number of voting in group could be due to voters' uncertainties about the new electoral system and the holding of the referendum on the same day with the parliamentary elections.

2.17. Damaging of ballot papers or other incidents related to their non-compliant use

According to art. 59 of the Electoral Code, the ballot shall be filled in by the voter only in the secret voting booth. The voter applies the stamp with the inscription "Voted" inside the circle of a single quadrilateral in the ballot, which means that s/he has voted for the corresponding electoral competitor and subsequently the voter inserts the ballot with the "Voted" stamp into the ballot box. If the voter has filled out the ballot incorrectly, at his / her request, the EBPS cancels this ballot and immediately issues a new ballot. It is forbidden to remove the ballot from the polling station.

Pursuant to point 42 a) of the Regulation on the activity of the electoral bureau of the polling station, during its period of activity, the electoral bureau of the polling station ensures the integrity of ballot papers;

According to the Promo-LEX observers' reports, a phenomenon that was frequently used in this election was the deterioration of ballot papers by tearing, removing ballot papers from the PS and / or abandoning them in the voting booth, most of them, according to the observers, being referendum ballots. 2.20. Cancellation of ballots before closing the polling stations

According to art. 61. par. (2) of the Electoral Code, before opening the ballot boxes, all the remaining unused ballot papers shall be counted and canceled by the EBPS, stamped with the mention "Canceled".

Promo-LEX observers have reported 4 cases that can be classified as cancellation of ballots before the polling stations were closed. Cases refer to PS 26/21, PS 27/20, PS 30/15, PS 9/1. The reason invoked in all the cases was speeding up the process of vote counting.

Among other incidents, we shall specify (see the full list in Annex 1): power outages in the PS (5 PSs); the mobile ballot box returned to the PS after 21.00 (2 PSs); non-assurance of the PS with heating (2 PSs) and so on.

III. FINAL RESULTS OF VOTES COUNTING BY PROMO-LEX OM Promo-LEX OM analyzed the completion of 2093 minutes on the results of the vote counting process in 2094 polling stations received by the Mission; it was not possible to receive the minutes from one PS in any way. In terms of quality of minutes’ completion in the national constituency, Promo-LEX OM identified 142 minutes (6.8%) filled in with errors, revealed based on the verification formulas established by the CEC, in the single member constituency - 160 minutes (7.6%). We draw the reader’s attention to the large number of errors in the formula H = G1 + G2 + G3 + G4 + Gn, 69 for the NC and 60 for the SMC, respectively. This error in the verification formula reveals that the sum of votes cast for competitors does not coincide with the total number of valid votes cast.

In comparative terms, Promo-LEX OM points out that the proportion of erroneous minutes filled in the parliamentary elections is higher than that in the last elections held in 2016 and 2018.

The analysis of the results of parallel vote counting in the national constituency and in the 51 single member constituencies indicates that the the final data provided by Promo-LEX confirms the positioning of all competitors on the basis of preliminary data, announced by the CEC.

The constituencies in Chisinau that have the highest percentage of voters included on the supplementary lists are: no. 25 (11.33%), no. 32 (6.60%) and no. 26 (5.06%), while such constituencies outside the capital are: no. 17 Nisporeni (4.30%), no.7 Soroca (4.25%) and no. 43 Cahul (4.21%).

3.1. The accuracy of drafting minutes on the results of vote counting

In the course of the observation of the parliamentary elections of February 24, 2019, the Promo-LEX OM analyzed the completion of 2093 minutes drawn up in 2094 polling stations, given that it was not possible to receive the minutes from one PS in any way6. The minutes on vote counting in the national constituency and the single member constituencies were verified manually by the operators.

Concerning the minutes on totalizing the voting results in the parliamentary elections for the national constituency, Promo-LEX OM identified 142 minutes (6.8%) filled in with errors, based on verification formulas (see Annex 2)7.

As for the minutes on totalizing the voting results in the parliamentary elections for the single member constituencies, Promo-LEX OM identified 160 minutes (7.6%) filled in with errors, based on verification formulas (see Annex 3).

From a comparative perspective, Promo-LEX OM points out that the proportion of erroneous minutes filled in the parliamentary elections is higher than in the last elections held in 2016 and 2018.

obtaining a copy thereof from the CC. 7 The final data of the Promo-LEX OM on the number of erroneous minutes differ from the preliminary ones presented

by the Mission on 25.02.2019 on the grounds that the preliminary analysis of the content of the minutes was done on the

basis of the SMS transmitted by the observers, while the final analysis of the correctness of completion is based on the

copies received by the Mission. The difference between them accounts for the human error of Promo-LEX observers in

filling in the message forms.

In terms of types of errors, the situation is described by the data presented in Table 2.

We draw the reader’s attention to the large number of errors in the formula H = G1 + G2 + G3 + G4 + Gn, 69 for the NC and 60 for the SMCs, respectively. It is assumed that the sum of votes cast for competitors does not coincide with the total number of valid votes cast.

The correctness of the minutes’ completion was verified based on the formulas inserted in them: c ≤ a + b; c ≥ d; d = f + h; e = cd; f = d-h; g1 + g2 + h = g3 + g4 + ... + g n; i = c + j; j = i-c.

The formula d = f + h was not respected in 57 and 76 minutes, respectively. In these cases, it was failed to demonstrate that the number of ballot papers extracted from the ballot box coincides with the amount of invalid and valid ballot papers. Doubts may arise the correctness of counting of validly cast votes and of the results obtained by the competitors.

The formula e = c-d was not correct in the case of 20 and 29 minutes, respectively. Thus, the number of signatures in electoral rolls does not coincide with the number of ballots extracted from the ballot box.

The formula i = c + j could not be applied correctly in the case of 53 and 76 minutes, respectively. The same situation is attested in the case of the verification according to the formula j = i-c. In this way, the

EBPS failed to correctly count either unused and canceled ballots or the signatures in electoral rolls. In fact, we find that the phrase "unused and canceled" can mislead EBPS members, as it can be can associated with two distinct ballots.

The formula h = g1 + g2 + g3 + g4 + ... + gn was not respected in 69 and 60 cases, respectively. We draw particular attention to this formula: the sum of votes cast for competitors does not coincide with the total number of votes validly cast and registered in those minutes. There are questions about the fairness of the results obtained by electoral competitors.

The formula f = d - h verifies the number of invalidated ballots by subtracting them from the total number of ballots validly cast. Errors are reported in the application of this verification formula in 57 and 76 minutes, respectively. The conclusions drawn by the verification of the formula d = f + h are

valid.

Formula c ≥ d indicates that the number of voters who have received ballot papers (deduced on the basis of number of signatures on electoral rolls) must be equal to or greater than the number of ballot papers extracted from the ballot box. There have been identified 8 and 12 minutes, in which this formula is not respected, a finding that implies that more ballots have been extracted from the ballot boxes than the number of ballots issued by the electoral body.

3.2. Comparative analysis of data on parallel vote counting carried out by Promo-LEX OM and

preliminary data announced by the CEC

The final results, presented by Promo-LEX OM, on the number of valid votes cast for each electoral competitors participating in the parliamentary elections was calculated on the basis of data transmitted from 2093 PSs. The minutes on vote counting results in the national constituency, as well as those in the single member constituencies handed over to Promo-LEX OM were manually verified by the Mission.

3.2.3 Exercise of voting rights by voters included in supplementary lists

At this stage, Promo-LEX OM considered it necessary to identify the percentage of voters who voted on supplementary lists in single member constituencies. In this respect, the number of voters included in supplementary lists was deduced from the total number of voters who have received ballots for the respective single member constituencies. The data of the following constituencies have not been analyzed: 47, 48, 49, 50 and 51 due to the fact that most voters voted on supplementary lists.

The constituencies in Chisinau that have the highest percentage of voters included in the supplementary lists are: 25 (11.33%)19, 32 (6.60%) and 26 (5.06%); constituencies outside the capital: no.17 Nisporeni (4.30%), no.7 Soroca (4.25%) and no. 43 Cahul (4.21%).
