Ehab Samuel

Ehab Samuel is an associate in Dickstein Shapiro’s Intellectual Property Practice. Mr. Samuel, who splits his time between the firm’s Orange County and Los Angeles offices, focuses on patent and trademark procurement, litigation, counseling, and licensing.

AREAS OF CONCENTRATION

Mr. Samuel’s patent experience encompasses a wide range of industries, including biomedical devices, electronics, computer architecture, computer networks, wireless and satellite communications, semiconductor devices, software, and chemical processes/compositions.

Mr. Samuel’s trademark experience includes first chairing a number of trademark opposition and petition for cancellation cases and enforcing trademarks in federal court and with the World Intellectual Property Organization (WIPO) Arbitration and Mediation Center under the Uniform Domain-Name Dispute-Resolution Policy (UDRP).

● Bird-B-Gone, Inc. v. Bird Barrier America, Inc., Central District of California: Mr. Samuel represents Bird Barrier America, accused of infringing a patent directed to devices for deterring birds from landing or perching on a surface.

● In the matter of Certain Electronic Devices Having a Retractable USB Connector, United States International Trade Commission: Mr. Samuel represents Olympus Corporation and Olympus Corporation of the Americas, accused of infringing a patent directed to retractable USB connectors.

● Synthes (USA) et al. v. Spinal Kinetics, Inc., Northern District of California: Mr. Samuel represented Spinal Kinetics, which was accused of infringing a patent directed to intervertebral spinal implants, and obtained a jury verdict that the patent was invalid and not infringed.

● Ultimax Cement Mfg. v. CTS Cement Mfg. Corp. et al., Central District of California:Mr. Samuel represented CTS Cement in a patent infringement case involving rapid-hardening, high-strength cement.

● Suomen Colorize Oy v. DISH Network LLC et al., Middle District of Florida: Mr. Samuel represented DISH Network in a patent infringement case involving electronic program guides.

● PMC v. DirecTV, U.S.D.C., District of Delaware: Mr. Samuel represented DirecTV in a patent infringement case involving satellite broadcast technology.

● The Economist Newspaper Ltd. v. Deborah Morales, Trademark Trial and Appeals Board: Mr. Samuel represented Deborah Morales before the Trademark Trial and Appeals Board during a dispute with a newspaper company over the ICONOMY and ICONOMIST marks.

● Cosco Management Inc. v. Kids Safety First, Trademark Trial and Appeals Board: Mr. Samuel represented Kids Safety First in a trademark opposition before the Trademark Trial and Appeals Board. The case reached a settlement valued at $435,000 for the client, including 25,000 child seats and $60,000 for distribution of the seats.

● HepaHope, Inc. v. Biotest AG, Trademark Trial and Appeals Board: Mr. Samuel represented client HepaHope, Inc. in a cancellation proceeding against a registrant’s U.S. trademark for BIOTEST to facilitate registration of client’s community trademark for BIOTESTER in Europe.

Mr. Samuel earned his J.D. from the Chicago-Kent College of Law at the Illinois Institute of Technology (2002); his LL.M. in intellectual property (2005) and his M.S. in electrical engineering (2005) from The George Washington University (2005); his M.S. in chemical engineering, specializing in semiconductor technology, from the University of Illinois at Chicago (2002); and his B.S. in civil engineering from the University of Windsor (1999).
