1.2. Project Overview

This IEE will be implemented in support of USAID/Moldova’s Country Development Cooperation Strategy (CDCS) Goal Statement: A Better-Governed Moldova with Improved Living Standards for its Citizens. This activity is in support of Development Objective 2, Increased Investment and Trade in Targeted Sectors - specifically, IR 2.1: Improved Economic Foundation for Growth and Sub-IR 2.1.2: Increased Access to Finance and IR 2.2: Improved Private Sector Competitiveness in Selected Industries.

Starnet, an information technology and electronic communications company, wishes to secure funding for the development of the first IT Park in Moldova. The IT Park will serve as a hub for IT companies and technology entrepreneurs and startups. Located in downtown Chisinau, Moldova, the park is envisioned to create an ecosystem and community for technology companies, which will host over 2,500 people/workplaces. The DCA guarantee will serve as the additional collateral needed to enable the bank to approve the loan(s) to Starnet for the development and construction of the IT Park.  The DCA guarantee will ensure private sector investment into Moldova’s ICT sector. 

1.3. Project Description

Starnet is a privately-owned information technology and telecommunications company and is one of the leading providers of fiber optic internet in Moldova. With more than 500 employees and more than 120,000 customers, Starnet provides internet services to 16 cities and towns in Moldova, generating approximately EUR 15 million in profit annually. Over the course of seven years, Starnet has managed to become one of the most popular and respected brands in Moldova, with high marks from both experts and clients for their ability to meet the needs of its customers and implement new technologies.

With the support of a DCA loan guarantee, Starnet will access credit to build the first IT Park in Moldova, called Digital City, that will serve as a hub for IT companies and technology entrepreneurs and startups. Aiming to replicate the “Silicon Valley feel”, this IT Park will provide affordable and modern office infrastructure and support the creation of an ecosystem and community for technology companies.

The DCA loan guarantee, which will cover 30 percent of the loan(s) in the value of US$8,919,747, will connect a local commercial bank with Starnet, to develop the IT park. Located in downtown Chisinau, Moldova, the park is envisioned to create an ecosystem and community for technology companies, which will host over 2,500 people/workplaces. The guarantee will serve as the additional collateral needed to enable the bank to disburse the loan(s) to Starnet for the construction of the IT Park. The loan will be secured and the source of repayments will be the revenue from the IT Park. Starnet has already contracted an initial EUR 3.5 million loan from Agroindbank to initiate the development of the first phase of the IT Park project, i.e. Towers A and B (see architectural concepts below), expected to be finalized in 2018. The DCA-guarantee will ensure funding for the subsequent phases of the IT Park development. USAID/Moldova will utilize the DCA mechanism as a means to complement its ongoing technical assistance that it currently provides to the IT sector, which has supported a comprehensive needs assessment for the growth of the IT segment. The DCA guarantee will ensure the sustainability and long-term impacts of its technical assistance investments by ensuring private sector investment into the sector.

ICT is one of the fastest growing industries in Moldova with IT exports having increased 10x in the past 10 years reaching approximately $79 million per year (2016). Overall, there are over 14,000 IT professionals in Moldova (which is expected to grow to 20,000 by 2020) and over 300 IT companies, of which approximately 280 are start-ups and SMEs. While there are still necessary improvements in IT and technical education, the pipeline for the Moldovan IT ecosystem is strong, with roughly 6% of all university graduates majoring in computer science or math. Nevertheless, the sector faces several challenges, including a reported lack of access to financing along with a dearth of affordable workspaces for burgeoning IT start-ups and small-sized companies. The development of an IT park will provide affordable and accessible workspaces that will enhance the development of IT entrepreneurs.

The IT Park will host approximately 50 IT companies “under one roof”, that currently struggle with their low-quality offices scattered around the capital city of Chisinau, and lack of business

cooperation. The access to high quality park facilities such as datacenter, affordable and modern office spaces and conference rooms, reliable and fast internet connectivity and attractive working conditions will increase the productivity of the companies and will increase their competitiveness regionally and internationally.

The DCA loan guarantee for Starnet is designed to cover expenses related to the construction of the first IT Park in Moldova that will provide 23,000 square meters of office space, outdoors green area, parking spaces, conference rooms, and events area. The following diagram and associated text highlight the key features of the activity, including the institutional structure and anticipated impacts.

USAID Moldova Competitiveness Project (MCP) is assisting four Moldovan Industries with key economic and social significance, namely wine production clustered with tourism, light industry (clustered textiles and apparel with footwear manufacturing), and information and communication technology clustered with precision engineering and creative services. These are all export oriented industries and collectively account for 15% of GDP and 50% of Moldovan exports. USAID MCP supports these industries so that they reach a maturity level that promotes sustainable advances in sector competitiveness and that provides desirable, well-paying jobs, hereby increasing incomes, alleviating poverty and reducing emigration.

MCP focuses on improving the quality of Moldovan products and services as the key to preparing Moldova’s private sector to compete on EU and other higher-value markets. To achieve this objective, the project is:

• Investing in workforce development initiatives to promote the development of skills Moldovan businesses need.

• Promoting the adoption of new technologies, manufacturing processes, and other innovations to increase the quality of Moldovan products and services.

• Building demand for Moldovan products both domestically and internationally by promoting market linkages and supporting Moldovan brands.

• Facilitating collaboration between the public and private sectors to increase investment and improve the business environment.

In relation to this DCA, MCP will provide technical assistance to support the development of Starnet’s IT Park project called Starnet Digital City. To date, MCP has financed an independent market analysis to assess the demand of IT Park services, supported Starnet in developing the investment project and business plan of the IT Park. This facilitated the contracting by Starnet of a EUR 3.5 million loan from Agroindbank to initiate the development of the first phase of the IT Park project, i.e. Towers A and B (See architectural plans above). Moreover, MCP is providing legal support for conforming with the new legislation on IT Parks. The IT Parks law presents the completely new concept of a single tax (7% of a company’s turnover) to replace all other business

taxes (up to 10 different taxes and fees), and introduces the concept of a ‘Virtual Park’, which allows any IT company to become a resident without physically moving to a new location. As a result, talented entrepreneurs from every region of Moldova will be able to benefit from being residents of the new IT parks. The new law also limits the number of state inspections of park residents, and minimizes the interaction between state institutions and IT companies. As significant progress is recorded in completion of the infrastructure, MCP will provide support to Starnet in promoting the IT Park and attracting domestic and foreign IT companies to become residents of the Park.

In addition, MCP provides support for implementing Starnet’s education program called AcademyPlus Moldova that will serve as a skilled labor force supply unit of the IT Park. AcademyPlus Moldova is an alternative technology education and quick win disruptive solution to produce coders that industry needs. During its first year of operation, the Academy selected 520 students from 5,000 applicants for the initial 4-week coding bootcamp with practical project based programming modules, developing coding skills and teamwork capabilities. A total of 316 students successfully graduated this introductory stage and 120 entered the main program, which lasts up to two years or until the student is employed.

2. Baseline Environmental Information

2.1. Locations Affected and Environmental Context – address str. Columna 170, Chisinau, Moldova

The IT Park will be located in downtown Chisinau, the capital city, on the site of a former tractor factory, now converted into the industrial park ‘Tracom’ hosting a range of business buildings. The IT Park site has direct access to a main street, Mihai Viteazul street, and is directly connected to the public transportation system and is only 15 km from Chisinau airport.

Below follows country-level background information. Moldova has an area of 33,843 square km and a population of 3,559,500 people (2012 estimate). It is located at the intersection of three bio-geographic zones: the Central-European zone, the Euro-Asiatic zone, and the Mediterranean zone. Many species typical for each of these zones are at the limit of their natural range in Moldova. The country has a rich biota relative to its size, considering that the highest elevation point is only 430 m above the sea level.

Today, natural ecosystems occupy approximately 10 percent of Moldova. A significant proportion of this area is highly degraded. Agricultural land cover 75 percent of the county. Native steppe and steppe associated wet meadows have been systematically converted to cropland and pasture. The extent of loss of steppe is not thoroughly documented, but less than one percent remains of some types of grassland and wet meadow ecosystems that were once common in Moldova. Forests cover about 10 percent of the country and, moreover, 86 percent are planted forests (Economic Commission for Europe, 1998).

2.2. Description of Applicable Environmental and Natural Resource Legal Requirements Policies, Laws, and Regulations

The Government of Moldova (GOM) has passed over 50 laws and regulations related to environmental protection, provided below. Starnet will be responsible to ensure their activities are in compliance with applicable host country policies, laws, and regulations.

It is anticipated that Moldova’s laws and regulations related to waste management and construction could apply to the activities of the Starnet IT Park project. For instance, the Law on Waste 2014

requires that private companies plan their production facilities accordingly to the waste management rules, and they should monitor strictly the storage and transportation of their waste. The Contravention Code and the Criminal Code of Moldova prescribes a list of transgressions that are subject to penalties and criminal prosecution. Construction legislation, especially the Law on the authorization of construction no.119/2010 expressly indicates that no construction permit will be granted without a prior authorization from the Ecological State Inspectorate, which is required to verify and ensure compliance with state norms related to environmental regulations.

The Republic of Moldova seeks to align its national environmental policy with regional and international best practices and the Law on Environmental Protection confirms that international conventions and agreements take precedence over national legislation if the provisions in the international agreements are more stringent. A National Commission was established by a presidential decree (November, 1996) to oversee the implementation of the provisions of different international agreements. Additionally, Moldova signed a number of agreements with other countries in the region to ensure mutual cooperation in the management of natural resources.

2.3. Country/Ministry/Municipality Environmental Capacity Analysis

The Ministry of Environment, now under merger into a new Ministry of Regional Development, Agriculture and Environment (www.mediu.gov.md), is the national environmental authority that develops and defines governmental policies related to the environmental protection, rational use of natural resources, waste management, biodiversity conservation and state control of ecological activities. The MOE assesses and monitors biodiversity, manages some protected areas, coordinates research, ensures cross-sectorial cooperation, monitors compliance, and develops reports on the state of the environment in Moldova. At the same time, the MOE (together with its subordinated divisions and institutions) is the main governmental body responsible for ecological expertise and environmental impact assessment.

One of the main scopes of the ecological expertise, according to the Law on Ecological Expertise and Environmental Impact Assessment (1996) is to maintain the ecological equilibrium, genetic fund, biodiversity and to create the optimum conditions for human life. The ecological expertise is compulsory to all legislative acts, methodologies, regulations and standards referencing to environment and that could impact the environment during their application, and to all new projects design documents. A series of project design documents may require the Environmental Impact Assessment (EIA). The EIA process in Moldova considers the physical and biological impacts of proposed developments on the environment: air, land, water, biodiversity and people. Its scope includes a review of the effects that could bring adverse changes to the natural environment and the resulting short- and long-term effects that these changes could have on people and biodiversity. Environmental permitting and enforcement in the Republic of Moldova are performed by the State Ecological Inspectorate (SEI), which is subordinated to the Ministry of Regional Development, Agriculture and Environment. Other governmental agencies such as “Apele Moldovei” Agency, State Services for Public Health, and Agency for Geology and Mineral Resources are also involved in permitting procedure.

According to the 1993 Law on Environmental Protection, SEI performs State control regarding compliance with environmental legislation requirements. SEI also performs State ecological expertise and issues permits of emissions into the air and for the special use of water. The total staff of SEI is 310 persons, from which 59 are in the central body of the institution and 251 are assigned to the territorial units which include 4 ecological agencies located in Chisinau, Balti, Cahul, and Autonomous Territory of Gagauzia and 32 ecological inspections in districts. The structure of SEI is presented on figure 2.1. The cutback of SEI staff has been continuous from 1998 when it had 521 employees. In 2005, the staff number was 411.

The procedure of State ecological expertise is described in the 2003 Instruction No.188, on the order of organizing and conducting State ecological expertise. It determines the scope, tasks, principles, objects and subjects of ecological expertise, order of ecological expertise organization and undertaking, requested urban and spatial planning documents and the procedure for their presentation for review. The Instruction was not amended since 2003.

2.4. Financial Institution Policies, Procedures or Regulations:

Financial institutions in Moldova are becoming more aware of environmental guidelines and a number have environmental review procedures. The Mission will provide environmental awareness sessions for both Starnet and the commercial bank that will provide funding to Starnet.

Starnet will be designing and constructing the first IT Park in Moldova that will serve as a hub for IT companies and technology entrepreneurs and startups. Aiming to replicate the “Silicon Valley feel”, this IT Park will provide affordable and modern office infrastructure and support the creation of an ecosystem and community for technology companies. Starnet aims to develop Class A rated buildings, that in addition to the good location, good access and professional management, will also possess high quality building infrastructure, including quality building materials, energy efficient and insulated buildings, independent voltage power transformation station (for quality energy supply), high capacity drinking water supply, central point of national and international fiber optic cables and direct international data connectivity, modern security and building access systems, and last but not least large green area.

Developing the physical infrastructure of the IT Park may have impact on the social and biophysical environment. In this regard, it is important that the Starnet and the commercial bank funding this investment project thoroughly understand the USAID and Government of Moldova environmental guidelines and procedures, and the Mission will help strengthen their procedures as appropriate. It is expected that Starnet will coordinate its efforts and consider both positive and negative outcomes of their activities (including the possible impact on the environment and human health) at the activity design stage.

The Mission expects that Starnet will: (1) engage all relevant stakeholders in designing and/or implementing USAID-funded interventions, (2) ensure application of local legislation dealing with construction, safety, and environmental issues, and (3) promote the pertinent best international standards and practices in Moldova dealing with environmental issues. The lending bank as part of their due diligence will ensure that Starnet complies with local construction legislation and presents all pertinent authorizations and permits. In addition, the Mission has identified conditions/mitigation measures (discussed below) that need to be fulfilled/taken by the IT Park involved in the implementation of the listed activities.

2.6. Climate Change Vulnerability Analysis

Some of the proposed Starnet activities – primarily, construction and then endowing with equipment of the IT Park – may have an impact on the environment. Therefore, the Mission has identified conditions/mitigation measures (discussed below) that need to be fulfilled/taken by Starnet as part of this activity. Any additional Starnet activities (and their anticipated effects) will be discussed with the Mission prior to being funded by the USG. This approach will allow avoiding any significant impact on the environment associated with USAID assistance. Activities will further screen for climate change impacts – such as possible soil contamination, floods, increased temperatures in ERC/EMMPs.

The lender will provide USAID with their environmental due diligence processes for loans, as part of the DCA approval process. Under the approved DCA agreement the bank will use their environmental procedures as part of the environmental due diligence process. It is not anticipated to fund any activities listed in Section 4 “Limitations of this IEE”.

Likewise, Starnet will provide USAID with their environmental due diligence process for ensuring environmental compliance during construction and endowment. USAID may request additional documentation, during project monitoring, such as construction authorizations, soil contamination expertise, etc.

Activity 1.1 under §216.2(c)(2)(iii) Analyses, studies, academic or research workshops and meetings.

Negative Determination with ConditionsUnder §216.3(a)(2)(iii), a negative determination with conditions is recommended for activities 1.2 and 1.3. Specific terms and conditions are presented below in Section 3.3.

3.3. Terms and Conditions:

3.3.1. For Activities 1.2 and 1.3. the lender shall submit for review to USAID its environmental due diligence process for the DCA-supported loan that (i) excludes activities listed in Section 4 from DCA credit support, and (ii) reliably identifies activities that involve support for environmentally sensitive and contaminated areas, including those requiring environmental review, licensing or permits under Moldovan environmental regulations.

3.3.2. The substance of all conditions will be included in the DCA agreement, as appropriate.3.3.3. The USAID activity manager must be notified, and in concurrence with the MEO and

BEO, give specific written prior approval to any DCA-guaranteed loan(s) that is likely to have a significant adverse effect on the environment. Approval of loans to finance such activities will require an environmental assessment that meets or exceeds provisions of 22 CFR 216 of such assessments which must be approved by the BEO prior to loan approval.

3.4. USAID Monitoring and Reporting

3.4.1. The overall responsibility for the environmental monitoring of and reporting of lending activities rests with Starnet and the lending institution, as might be the case, and shall be clearly stated in the DCA agreement.

3.4.2. USAID activity manager will meet annually with Starnet and the partner bank, and monitor the achievement of utilization targets and other development indicators.

4. Limitations of the IEE: This IEE does not cover activities (and therefore should changes in scope implicate any of the issues/activities listed below, a BEO-approved amendment shall be required), that: 4.1. Normally have a significant effect on the environment under §216.2(d)(1) [See

http://www.usaid.gov/our_work/environment/compliance/regulations.html]4.2. Affect endangered species;4.3. Result in wetland or biodiversity degradation or loss;4.4. Support extractive industries (e.g. mining and quarrying);4.5. Promote timber harvesting;4.6. Provide support for regulatory permitting;4.7. Result in privatization of industrial or infrastructure facilities;4.8. Assist the procurement (including payment in kind, donations, guarantees of credit) or use

(including handling, transport, fuel for transport, storage, mixing, loading, application, cleanup of spray equipment, and disposal) of pesticides or activities involving procurement, transport, use, storage, or disposal of toxic materials and /or pesticides (cover all insecticides, fungicides, rodenticides, etc. covered under the Federal Insecticide, Fungicide, and Rodenticide Act); and

4.9. Procure or use genetically modified organisms.

5. Mandatory Inclusion of Environmental Compliance Requirements in Solicitations, Awards, Budgets and Work Plans

5.1. Appropriate environmental compliance language shall be included in the award for this activity and related DCA agreements with Starnet and the financial institution. The MEO will review the language with the COR to ensure it is consistent and appropriate with the requirements in this IEE.

6. Revisions6.1. Under §216.3(a)(9), if new information becomes available that indicates that activities covered by

the IEE might be considered major and their effect significant, or if additional activities are proposed that might be considered major and their adverse effect significant, this environmental threshold decision will be reviewed and, if necessary, revised by the Mission with concurrence by the BEO. It is the responsibility of the USAID COR/AOR to keep the MEO and BEO informed of any new information or changes in the activity that might require revision of this IEE.
