$TRIT Fntqr sil+r qHflsq SECRETARIAT OF THB ELECTION COMMISSION OF INDIA No.437lKT-HP 12014 ORDER Whereas, the schedule for holding tEGn-erat Election to Lok Sabha from Karnataka State was announced by the Commission vide its Press Note No.ECI/PN/10t2014 dated Sth March, 2014', and Whereas, the Model Code of Conduct for political parties and candidates came into operation from the date of the said press note; and Whereas, the Commission received a report that while addressing an election meeting at H.D.Kote Taluka of Mysore district, on the 23'd March,2014, you stated that "At the time of election to previous assembly when I had come for election campaign I had told that I would adopt Heggada Devankote, even now I am committed to that word' ...........Actually he is not Narendra Modi, he is a Narahantaka" (copy of the cD containing your speech was enclosed); and Whereas, the Commission observed that aforesaid statements and announcements prima facie violate provisions of Model code of conduct(MCC) for the guidance of political parties and candidates, ie. para ('1)GeneralGonduct, which inter-alia, provides as under:- ,,,1.General Gonduct-No party or candidate shall indulge in any activity which may aggravate existing differences or create mutual hatred or cause tension between different castes, communities, religion or linguistic (2) Crlticism of other political parties, when made, shall be confined to their policies and programme, past record and work. Parties and candidates shall refrain from criticism of all aspects of private life, not connected with the public activities of the leaders or workers of other parties. Criticism of other parties or their workers based on unverified allegations or distortion shall be avoided"; and Whereas, before proceeding further in the matter, the Commission decided to afford you an opportunity to explain your position in the matter within 2(two) days from receipt of the notice and directed to explain as to why action should not be taken against you for aforesaid violation of Model Code of Conduct; and Whereas, your reply in the matter was received vide your letter No.PSCM/30212014 dated Sth April,2014 stating that the statement regarding adoption of Heggada Kote is only recollection of a statement made earlier by you and as such does not constitute violatlon of MCC; and you further stated that the statement of Narahantika(homicide) about Mr. Narendra Nirvachan Sadan, Ashoka Road, New Delhi 110001 Dated: 1Oth APril, 2014

Modi has to be seen in the context of policy of Govt. of Shri Mody and in that sense you are

said to have criticized the Govt. and that does not attract any of the provisions of MCC; and

Whereas, your reply was considered by the Commission and it has accepted the

explanation about the adoption of the village Heggada Kote by you; but your explanation

relating to the use of the word against the leader of a major political party has not been

accepted, as that explanation has been specifically used to criticize Sh. Narendra Modi

personally and not by way of criticizing his Government policies'

Now, therefore, the Commission has decided to admonish you for the derogatory

word used by you against Sh. Narendra Modi and has further advised you to be extremely

careful in future.
