> No. Unlike EB-5 and other types of Green Cards, the quota on the number of EB-1 Green Cards has never been applied. So there are no processing delays because visas are not available or because of « visa retrogression »

– Example: in 2015 we expect that Chinese EB-5 cases will have 1 year wait to file for Green Cards

– Example: in 2014 Indian EB-3 cases now have 10 year wait to file for Green Cards

– These types of quotas do not apply to EB-1: Multinational Executive/Manager Visas are #1, favored by U.S. Immigration laws

Does the EB-1 Chinese Manager or Executive have to work only in the USA?No. Once the Green Card is issued, the Manager or Executive can go to the USA and then return to China. After that he need only come to the USA when required for business, but at least 2-3 times per year. He should maintain ties with USA, own or rent real estate in the USA, file taxes in the USA, earn a salary in the USA. He must show that the USA is his country of permanent residence/ or that he intends to permanently reside in the U.S.
