CONSTRUCTION EVALUATiON RESOLUTION

WHEREAS, Iowa Code section 459.304(3) seta out the procedure if a board of supervisors wishes to adopt a "construction evaluation resolution" relating to the construction of a confinement fooding operation structure: end

WHEREAS, only counties LhsL have adopted u construction evaluation resolution can submit to the Department of Natural Resources (ONE) an adopted recommendation to approve or disapprove a construction normit•applipition regarding a proposed confinement feeding operation structure; and

WDEMAS, only counties that have adopted a construction evaluation resolution and submitted and adopted recommendation may contest the ON's decision regarding a specific application; and

WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every constroction DP -F-Mir application for rt proposed confinement fending operation structure received by the board of supervisors between February 1, 201 ❑ and January 31, 2011 and submit en adopted recommendation regarding that application to the ➢ IR; and

WHEREAS, the hoard of sttpervisors mint conduct an evaluation of every contructiou permit application us5irg the plaster mstria created in Iowa Code section 459.305, but the• board's recommendation to the DNR nay be based on the final score on the mastei• malulx or may be hosed on reasons other than the final score on the master matris;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF 14ONROE COUNTY that the Dord of Supervisors hereby adopts thin construction evaluation resolution purcuant.to Iowa Code section 459.304(3).

RESOLUTION PROVIDING FOR SERVICE SUPPORT WITH CHARITON VALLEY PLANNING & DEVELOPMENT COUNCIL OF GOVERNMENTS

WHEREAS, Chapters 28E and 473A of the State Code of Iowa, as amended, authorized the govern-ing bodies of governmental units to corporate in the operation of a regional planning commission; and

WHEREAS, Chapter 28H of the State Code of Iowa establishes Chariton Valley Planning & Development Council of Governments serving Appanoose, Lucas, Monroe and Wayne Counties as your council of governments. In 2007 the Iowa Legislature amended the Iowa Code 28H with this approval.

WHEREAS, by the Notification from the Economic Development Administration (EDA) has modified the boundaries of the Economic Development District (EDD) served by Area 15 Regional Planning Commission (Area 15 RPC). Concurrent with the approval of the Chariton Valley Planning & Development Council of Governments' (CVPD) request to be disignated as EDD, the counties of Appanoose, Lucas, Monroe and Wayne Counties have been removed from Area 15 RPC's district boundaries and included in the newly designated EDD.

WHEREAS, the governing body of Monroe County, Iowa is a part of the Chariton Valley Planning & Development Council of Governments and has agreed to a contribution of $0 at this time for annual fees.

BE IT FURTHER RESOLVED, that Monroe County has designated:

Dennis J. Ryan Official Representative John Hughes Alternate

to be a contact for the area.

BE IT RESOLVED, by the Board of Supervisors of Monroe County, Iowa, that:

1. Monroe County and Albia Industrial Development Corporation have in past years recognized the importance of actively being engaged in industrial and economic development for the welfare of the citizens and businesses in Monroe County and, since developing this partnership in 1984, have created well over 1,000 high paying jobs at 23 new plants that have invested over $1.1 billion in new plant and equipment.

2. Without continued emphasis on growing our industrial base, Monroe County's economy is not sufficiently diversified to provide a stable economic base if in large part it once again becomes dependent on agriculture and agribusiness.

While the current economic problems in agriculture, agribusiness industries, and in other industries are serious in other areas of the state, Monroe County's industries have fared much better but are still at risk to suffer the same fate if we do not continue to work to create and retain jobs for our residents.

4. It is therefore in the best interest of the citizens of Monroe County, Iowa, to take steps reasonably calculated to lead to diversified industrial and economic development in the county of Monroe, Iowa,

5. Monroe County does not have sufficient resources to hire a Director of Economic Develop-ment as a county employee and lacks sufficient resources to effectively operate an economic development program on its own.

6. Other cities and counties in the state of Iowa have found it necessary to engage in industrial and economic development efforts.

7. Therefore, Monroe County, Iowa, finds that it is in the best interests of its citizens to cooperate with the cities in Monroe County, Iowa, and the Albia Industrial Development Corporation, a non-profit corporation, as well as other organizations which may arise in order to promote diversified industrial and economic deVelopment in Monroe County, Iowa.

THEREFORE, BE IT RESOLVED that the Monroe County, Iowa, has and will continue to support in efforts to enhance industrial and economic development by its financial contribution to Albia Industrial Development Corporation to be approved by the Board of Supervisors of Monroe County, Iowa.

Motion by Hughes and seconded by Beary to accept Jerry Findley's bid of $19,100 for the lease of the Monroe County Farm for 2010/2011. Lease begins March 2, 2010 to March 1, 2011. County Attorney Steve Goodlow will prepare the contract.

Discussion held on purchasing recycling trailer. Currenly recycling is held from 8:00 a.m. to 12:00 noon on the first and 3rd Saturdays of the month. Recycling is held in Lovilia on the 2nd Saturday of the month for two hours. Recycling is held on the 4th Satur-day of the month in Melrose for two hours.

Motion by Beary and seconded by Hughes to authorize Chairman Ryan to purchase a recycling trailer. (72' x 14' - 45" sides - $7,191.00)

Sheriff Dan Johnson present to discuss purchase of new vehicle for Sheriff's department. Johnson presented two quotes. The Chevy vehicle's quote was $28,306 and the Ford vehicle's quote was $27,857. Johnson recommended taking the lower quote.

Motion by Beary and seconded by Hughes to approve Sheriff Johnson's request to purchase sheriff vehicle from Albia Motor in the amount of $27,857.

Chairman opened public hearing at 10:00 a.m. to take public comment on the Final Report made by the Monroe County Planning and Zoning Commission on March 10, 2010, concerning an application for rezoning made by Cargill, Inc., Eddyville, Iowa, for approximately 25 acres located in Sections 14 and 15 of Pleasant Township from "A-1" Prime Agriculture Land to "I-2" Heavy Industrial. Notice of intended action were publi'sfi6d in both official newspapers.

Persos present for the public hearing were Brian Chambers, John Goode, Juanita Murphy, Richard Mosher and Cargill's representative Rick Davidson.

There were no oral or written objections filed.

Zoning Administrator Murphy stated that her office has received a consent letter from the Eddyville Fire Department and recommended that the Board approve the Planning and Zoning Commission's recommendation.

Motion by Beary and seconded by Hughes to close the public hearing at 10:20 a.m.

Motion by Beary and seconded by Hughes to accept the recommendation of the Monroe County Planning and Zoning Commission and approve the rezoning application of Cargill, Inc. of Eddyville, Iowa, to rezone approximately 25 acres located in Sections 14 and 15 of Pleasant Township from "A-1" Prime Agriculture Land to "I-2" Heavy Industrial. Details concerning said application and the Planning and Zoning Commission's final report are available in the office of the Monroe County Zoning Administrator at the County Courthouse.

Conservation Board member Mike Runyan and Conservation Board Secretary Peggy VandenBerg present to discuss the annual review of Ajinomoto Heartland, LLC wetland area. The project description states that the applicant (Aginomoto Heartland, LLC) proposes to adversely impact 0.9 acres of wetland and 1,180 feet of stream while expanding a lysine and threonine production facility at Eddyville, Iowa. Besides construction of new building pads and buildings, the expansion will include the construction of a new entrance road, construction of new wastewater treatment facilities, demolition of the existing entrance road, stream and wetland impacts, and mitigation for natural resources. Ajinomoto Heartland needs a third party holder for the conservation easement to complete the permitting for the project. The easement holder (Monroe County Conservation) is responsible to make sure the permit conditions are being upheld, but no active management is anticipated outside of annual field evaluation. Runyan stated that they are requesting permission to enter into a contract with Ajinomoto Heartland, LLC, and U.S. Corps of Engineers. Runyan also stated that County Attorney Steve Goodlow has reviewed the contract.

Motion by Hughes and seconded by Beary to authorize the Monroe County Conservation Board to sign contract with Aninomoto .Heartland, LLC, and U.S. Corps of Engineers.

TEMPORARY ROAD CLOSURE RESOLUTION

WHEREAS: Section 306.41 of the Code of Iowa provides that "The agency having jurisdiction and control over any highway in the state, or the chief engineer of said agency when delegated by such agency, may temporarily close sections of a highway by formal resolution entered upon the minutes of such agency when reasonable and necessary because of construction, reconstruction, maintenance or natural disaster and shall cause to be erected ROAD CLOSED signs and partial or total barricades in the roadway at each end of the closed highway section and on the closed highway where that highway is intersected by other highways if such intersection remains open. Any numbered road closed for over forty-eight hours shall have a designated detour route. The agency having jurisdiction over a section of highway closed in accordance with the provisions of this section, or the persons or contractors employed to carry out the construction, recon-struction, or maintenance of the closed section of highway, shall not be liable for any damages to any vehicle that enters the closed section of highway or the contents of such vehicle or for any injuries to any person that enters the closed section of highway, unless the damages are caused by gross negligence of the agency or contractor."

NOW THEREFORE, BE IT RESOLVED: by the Monro6 County-BOard of Supervisors that the County Engineer be authorized to close Monroe County Secondary Roads as necessary with the actual dates of closure to be determined by the County Engineer as follows:

1. For Construction: Any project as described in the approved Monroe County Secondary Road Construction Program for the current fiscal year and any approved supplements thereto.

2. For Emergency Closure of any road for maintenance purposes: Any route deemed necessary by the County Engineer.

WHEREAS: Iowa Code Section 306.41 provides for the temporary closing of sections of roadway when necessary because of construction and maintenance, and

WHEREAS: the Monroe County Engineer has been authorized by a previous Resolution of the Monroe County Board of Supervisors to execute the above requirements of Iowa Code Section 306.41 regarding temporary road closure; and

WHEREAS: P.C.I. is under contract to construct multiple rail crossings at the crossing of their rail line and T-55 (720th Ave) approximately one (1) mile South of Iowa Highway 137; and

WHEREAS: Cargill Inc. has requested a portion of Route T-55 (720th Ave) between Highway 137 and Route H-21 (140th Ave) be closed for up to six and one half (q) months to allow their contractor to complete the project.

NOW, THEREFORE, BE IT RESOLVED by the Monroe County Board of Supervisors that Route T-55 (720th Ave) between Highway 137 and Route H-21 (140th Ave) more specifically described as beginning at a point approximately 1200 feet South of the junction of Towa Highway 137 and T-55 (720th Ave) continuing Southerly approximately one (1) mile on T-55 (720th Ave) and 117th Lane from T-55 (720th Ave) East 2 mile to the termination of 117th Lane, be closed and the following roads be designated as a detour route:

From the junction of Iowa Highway 137 and T-55 (720th Ave); thence East to the junction of Iowa Highway 137 and T-61 (Monroe-Wapello Road); thence South on T-61 (Monroe-Wapello Road) to the junction of T-61 (Monroe-Wapello Road) and H-21 (140th St) thence West on H-21 (140th Street) to the Junction of H-21 (140th Street) and T-55 (720th Ave).

BE IT FURTHER RESOLVED that the traffic control devices for the aforementioned road closure and detour route will be established and maintained by Monroe County for the duration of said project as determined by the Monroe County Engineer.

Central Iowa Juvenile Detention Center's Executirve Director Tony Reed met with the Board to discuss services they offer juveniles in need of detention services. Their current rate is $100.00 per day which includes transportation. The County currently pays $185.00 per day which does not include costs for transportation. Chairman Ryan stated that he would have the County Attorney look at the agreement and get back to Mr. Reed.

Motion by Hughes and seconded by Beary to approve agreement with Monroe County Hospital and Monroe County Secondary Road Department for costs involved to provide random drug_and alcohol services effective immediately.

Goode stated that he has not been able to contact all the adjoining land owners. Goode stated that the next step is to send out letters to all adjoining landowners. The landowners then h6Ve fourteen days to respond and then the Board may take action.

Motion by Beary and seconded by Hughes to request the County Engineer to contact the adjoining landowners to see if they would all be in agreement. to making the County road a "C" level in Section 10 of Urbana Township.

Engineer John Goode present to discuss proposed release and settlement agreement between Monroe County BNSF Railway Company and Hulcher Services Inc. This agreement is concerning bridge damages in Guilford Township on August 21, 2008. BNSF Railway derailed leaving debris that had to be cleaned. Hulcher was used to clean up the debris and subsequently causing damage to the wooden bridge on 210th Trail {Halpin Road. Goode stated that County Attorney Steve Goodlow was instrumental in reaching this agreement pending Board of Supervisors approval.

Motion by Beary and seconded by Hughes to approve release and settlement agreement between Monroe County, BNSF Railway Company and Hulcher Services Inc, for property damage claim to bridge in Guilford Township in the amount of $43,184.12.

The Monroe County Board of Supervisors met pursuant to adjournment on April 14, 2010, with Dennis J. Ryan and John Hughes present. Michael R. Beary absent.

Minutes of April 13, 2010, read and approved.

Board met with Marc Baty and Ed Hermann to discuss the part-time status of the Monroe County Department of Human Services. Others present were Sheriff Dan Johnson, State Representative Richard Arnold and Albia Newspaper representative Brian Chambers. Baty stated that due to State re-organization, early retirement issues, budget deficits and the reduction in force plan by the State of Iowa that Monroe County's Department of Human Services Office will be one of twenty-three full time County offices going to less than full time. Mr. Baty stated that it is a continuous process because State employees have until April 15, 2010, at 4:30 p.m. to meet the paperwork deadline for early retirement. Baty also stated that he currently doesn't know what he has for staff. The less than full time offices would no longer take incoming calls and would have only outgoing calling capabilty. They are proposing a Call Center at the State level to take calls from all counties. Clients would start the application process by phone (Des Moines) and that everybody loves it because they don't have to take time off work. Baty also stated that the call to Des Moines that there would be a decision on the intake in five minutes. Sheriff Johnson stated that he did not believe that would be happening. Representativp,Arfidid inquired if they were reducing in the Des Moines area or just the rural areas. Baty continued to state that this is a continuous process and that until he gets the budget information for fiscal year 2011 that he can't say. Baty also stated that the State would no longer share the clerical position with the County. Baty hopes to have more answers for the Board before July 1st. The Board requested Baty meet with them in person again.

A Resolution to Support the Formation of a Local Housing Trust Fund

WHEREAS, the incidence for substandard housing exists to some degree in every incorporated town and the rural areas in Monroe County as well as our partner counties in the Chariton Valley Housing Trust Fund area, including Wayne, Lucas, Monroe and Appanoose and this is witnessed particularly among homes owned and occupied by low and very low income indiViduals; and

WHEREAS, despite the efforts of other housing initiatives, additional funding and tools are needed to continue to address the need, and there is now affability to form and receive funding for a Local Housing Trust Fund (LHTF) , Lhrough-tWrowa Finance Authority as well as other sources; and

WHEREAS, Chariton Valley Housing Trust has worked with counties and communities on region-wide housing initiatives for over a decade, Monroe County is in the Chariton Valley Housing Trust service delivery area and will specifically address the housing needs of the region; and

WHEREAS, Chariton Valley Housing Trust is preparing for submission to be recognized for the Chariton Valley Housing Trust area as the designated housing trust fund, and will be staffed by the Chariton Valley Planning & Development Council of Governments.

NOW THEREFORE BE IT RESOLVED by the Monroe County Board of Supervisors that:

It designates Chariton Valley Housing Trust Fund as the official housing trust fund for the county and endorses the efforts of Chariton Valley Housing Trust Fund to establish and operate a local housing trust fund for the region.

FURTHER BE IT RESOLVED by the Monroe County Board of Supervisors that:

This resolution of support for the establishment of a Housing Trust Fund does not include a request or obligate Monroe County for funds to assist Chariton Valley Housing Trust at this time to complete its proposed activity of establishment of a regional Housing Trust Fund.

Supervisor Hughes physically present at 10:00 a.m. when Engineer John Goode opened four sealed rock bids for the Secondary Road Department. Bids were received from Douds, L & W Quarries, Bruening Rock and Martin Marietta. Goode requested that the Board give his staff time to evaluate the bids for the 48 line items on spread sheets. At approxi-mately 10:50 a.m. Goode presented spreadsheets for the Board and recommended that the Board accept the low bids on all 48 items.

Department of Human Services representative Jane Johnson present to discuss the renewal of the contract for Targeted Case Managment Services.

Motion by Beary and seconded by Hughes approve the renewal of contract for Targeted Case Management Services between Monroe County and the Iowa Department of Human Services. The Department of Human Services has received a waiver from the United States Department of Health and Human Services to provide coverage under the Medicaid program for a limited number of children needing behavioral health care services. This waiver is known as the Children's Mental Health waiver. Contract is effective July 1, 2010, through June 30, 2013.

Section 1. The sum of $215,630.25 is ordered to be transferred from the Rural Services Fund to the Secondary Road Fund, effective April 27, 2010. The sum of $15,385.25 is ordered to be transferred from the General Basic Fund to the Secondary Road Fund effective April 27, 2010.

FOR PARTICIPATION IN THE HIGH QUALITY JOB CREATION ACT AS SET OUT IN CHAPTER 15, CODE OF IOWA, AS AMENDED

WHEREAS, the general assembly of the State of Iowa has declared that the use of direct economic development incentives by state and local governments are necessary in order to continue to attract economic investment; and

WHEREAS, the general assembly has made a finding that the public and private sectors should undertake cooperative efforts in order to encourage economic investment thereby enhancing the general economic climate in the State of Iowa; and

WHEREAS, the general assembly has set forth certain general principles to govern the relationship between government and business and the Monroe County Board of Supervisors hereby adopts such governing principles; and

WHEREAS, the Board of Supervisors has been advised that Ajinomoto U.S.A., Inc. desires to explore acquisition of funding under the High Quality Job Creation Act as set forth in Chapter 15, Code of Iowa; and

WHEREAS, in order to be eligible to receive benefits under the High Quality Job Creation Act, a business shall comply with certain criteria as set forth in Chapter 15, Code of Iowa; and

WHEREAS, the Board of Supervisors has been fully informed of the reasons the business seek to take advantage of the High Quality Job Creation Act and believes that Ajinomoto U.S.A., Inc will meet the requirements of Chapter 15 to receive funding, and

WHEREAS, the Board of Supervisors hereby approves the expansion in Monroe County of Ajinomoto U.S.A., Inc. for purposes of receiving the benefits of Chapter 15, Code of Iowa; and

WHEREAS, Ajinomoto U.S.A., Inc. has agreed to advertise for all positions of employment in the local Monroe County newspapers and hire Monroe County residents when they have the qualifications required for the positions available; and

WHEREAS, the Board of Supervisors contemplates providing Ajinomoto U.S.A., Inc. with a partial, five (5) year ad valorem tax exemption under Section 15.332, Code of Iowa on all real property improvements directly related to Ajinomoto U.S.A., Inc.'s project under the High Quality Job Creation Act, which is estimated to have a total value over the five (5) year period of $156,600 as follows:

Chairman opened public hearing at 10:00 a.m. to consider establishing an Area Service "C" Level road in Section 10 of Urbana Township. Persons present were Brian Chambers, Bob McDowell and Jack Hennings.

There were no written or oral objections filed.

Motion by Beary and seconded by Hughes to adopt the following resolution:

WHEREAS, Monroe County desires to classify certain roads on the area service system in the County to provide for a minimal level of maintenance and access by means of a gate or barrier; and

WHEREAS, the County, after consultation with the County Engineer, has the authority to specify certain roads within the County as Area Service "C" roads pursuant to Iowa Code Section 309.57; and

WHEREAS on the 11th day of May, 2010 and the 13th day of May, 2010 a Notice of Public Hearing for the proposed intended action was published in the Albia Union Republic and Monroe County News, newspapers of general circulation in the County where said road is located; and

WHEREAS, the County has received a request, attached to this resolution, signed by land owner(s) adjoining the road requesting that the following road be classified as an Area Service "C" road: Legal Description

All of the road commending approximately 700 feet West of the center of Section 10-71-16 at the North right-of-way line of 235th Street, North 1389 feet to the South line of the NE NW of Section 10-71-16. All of said road being in urbana Township, a total length of 0.26 miles.

1. Blading. Blading or dragging will not be performed on a regular basis. Blading will be performed when informed of the need by one or more of the adjacent landowners.

2. Snow and Ice Removal. Snow and ice removal will not be performed on a regular basis. Sanding and salting will not be performed on a regular basis.

3. Bridges. Bridges on Area Service "C" roads may not be maintained to carry legal loads but will be posted as appropriate to advise of any load limitations.

4. Weeds, Brush and Trees. Nowing or spraying weeds, cutting brush and tree removal will not be performed on a regular basis. Adequate sight distances will not be maintained on a regular road.

5. Structures. Bridges and culverts may not be maintained on a regular basis to carry legal loads. Upon failure or loss, the replacement structure will be for traffic theron.

THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MONROE COUNTY that this County does hereby establish the road described as an Area'Service "C" road, with restricted access and a minimal level of maintenance.

All voted "AYE". — Motion Carried. Discussion held between Mr. McDowell and Mr. Hinnings concerning rock on the road with the Board of Supervisors and Engineer John Goode. They stated that they would pay $1000 total between the landowners if the County would also pay $1000 as long as they could get a decent amount (of rock) right now and then they (landowners) would take care of it (road) from now on. The Board of Supervisors stated that this wo 4 be a one time only thing.

The Monroe County Board of Supervisors met pursuant to adjournment on May 25, 2010, with Dennis J. Ryan, Michael R. Beary and John Hughes present.

Minutes of May 18, 2010, read and approved.

Board met with Sara Bixby of South Central Iowa Solid Waste Agency. Bixby . informed the Board that effective July 1, 2010 some fees will be lowered. Monroe County currently has $3,091 in funds remaining for the current fiscal year for projects related to illegal disposal, education and outreach, and the promotion of desired waste management techniques. For fiscal year 2011 Monroe County will have $4,500 in funds available for such projects.

Motion by Hughes and seconded by Beary to approve EMC National Life Company's policy amendment effective January 1, 2010 as follows: The policy renewal will occur as of each July 1st annually. Age recalculations for bracketed supplemental Employee life will also occur as of July 1st each year.

Board reconvened at approximately 2:30 p.m. with Dennis J. Ryan and John Hughes present. Michael R. Beary absent. Others present were Sheriff Dan Johnson, General Relief Director Pat Hoelzel, Department of Human Services representatives Marc Baty and Ed Hermann.

Monroe County's Department of Human Services office is scheduled to go less than full time effective July 1, 2010. The office will need two to three office spaces according to Mr. Baty, desks, chairs and phones. The office will keep the same phone number but it will be directed to the Mahaska County office. The two social workers will work three to four days in Monroe County. The Income Maintenance side will be by appointment only on set days. The Income Maintenance workers have been re-domiciled to Jefferson County. Baty states that he hopes to have average workload of thirty-five to forty case load per worker. Baty also stated that Violet in Mahaska County will prepare the claims for Monroe County. The Counties will have to work out a cost-sharing plan for the local administration expenses. The DHS office will still need a copy machine and fax machine. Baty wants to get back in touch with all the County's Board of Supervisors again because it all still sounds kind of "iffy".

The Board assessed that they would be able to rent two-thirds of the office space.

Supervisor Ryan said he was told by Ed Hermann, Iowa Dept. of Human Services that it is the county's responsibility to move the files from the Monroe County office to the Mahaska County office. Hermann said the county could hire it done at the county's expense, but Ryan told him the county would not be paying someone to move the files. The Board decided the best plan would be t&move the files themselves with a Dept. of Human Services employee present.

General Relief Director Pat Hoelzel present to discuss with the board the recent changes in the in the restructuring of the Iowa Dept. of Human Services Offices and the effect it will have on her duties. The status of the Monroe County Dept. of Human Services Office will go from a full time office to a less than full time office effective July 1, 2010. Chairman Ryan offered Ms. Hoelzel the option to go into closed session and at Ms. Hoelzel's request the Board proceeded with the following:

Motion by Hughes and seconded by Beary to enter into closed session at 9:54 a.m. pursuant to Chapter 21.5 (1)i of the Code of Iowa.

The board reviewed their options with the current General Relief position and felt the need to keep Director Pat Hoelzel at a full time status until August 1, 2010 in order to be able to transition duties and responsibilities of the General Relief Director.

Motion by Beary and seconded by Hughes to approve a layoff of General Relief Director Pat Hoelzel effective August 1, 2010 due to the reorganization the of the Iowa Dept. of Human Services Monroe County Office transition to less than full time office effective July 1, 2010.

Motion by Hughes and seconded by Beary to approve the following resolution:

APPROPRIATIONS RESOLUTION

Whereas, it is desired to make appropriations for each of the different officers and departments for the fiscal year beginning July 1, 2010, in. accordance with Section 331.434, subsection 6, Code of Iowa. " '

Now therefore, be it resolved by the Board of Supervisors of Monroe County, Iowa, as follows:

Section 1. The amounts itemized by fund and by department or office on the attached schedule are appropriated from the resources of each fund so itemized, to the department or office listed in the first column on the same line of the attached schedule.

Section 2. Subject to the provisions of other county procedures and regulations, and applicable state law, the appropriations 'authorized under Section 1 shall constitute obligations from the itemized fund effective July 1, 2010.

Section 3. In accordance with Section 331.437., Code of Iowa, no department or officer shall expend or contract to expend any money or incur any liability, or enter into any contract which by its terms involves the expenditure of money for any purpose in excess of the amounts appropriated pursuant to this resolution.

Section 4. If any any time during the 2010/2011 budget year the auditor shall ascertain that the available resources of a fund for that year will be less than said fund's total appropriations, she shall immediately so inform the Board and recommend appropriate corrective action.

Section 5. The auditor shall establish separate accounts for the appropriations authorized in Section 1, each of which account shall indicate the amount of the appropriation, the amounts charged thereto, and the unencumbered balance. The auditor shall report the status of such accounts to the applicable departments and officers (monthly) during the 2010/2011 budget year.

Section 6. All appropriations authorized pursuant to this resolution lapse at the close of business June 30, 2011.

WHEREAS, Monroe County is a member county of the Southeast Iowa Case Management (SICM) Consortium of Counties created by a 28E Agreement for the purposes of uniting to create a single entity that will combine effOrts and share resources to provide Case Management services to each member county currently comprised of the counties of Appanoose, Davis, Des Moines, Henry, Iowa, Jefferson, Keokuk, Lucas, Monroe, Van Buren, Wapello, Washington, Wayne:

AND WHEREAS, each member county will appoint one Board member who shall represent the County for voting purposes in the decision making process who shall be a County Supervisor or County Supervisor Designee.

AND WHEREAS, the Monroe County Board of Supervisor's desire to appoint a Designee in lieu of a County Supervisor;

BE IT HEREBY RESOLVED, that Katie Fisher, Monroe County CPC, is appointed effective immediately upon passage and to continue indefinitely unless otherwise terminated upon the desire to do so by the Board of Supervisors.

Project A : A public roadway located in the N of Section 12, T73N,R16W, Pleasant Township, Monroe County Iowa, more particularly described as follows: A public roadway commencing near the center of Section 12, T73N, R16W, said point is approximately 265 feet west, thence N5d52'40"E 301 feet to the point of beginning. Thence northerly 1726 feet to the south shoulder line of Highway 137. Length of road vacation is 1726 feet or 0.33 mile.

WHEREAS: on the 22nd day of June, 2010 notice of said hearing was sent by certifed mail to the affected property owners, all utility companies whose facilities are on the road right-of-way and the Iowa Department of Transportation; and

WHEREAS: on the 22nd day of June, 2010 and the 24th day of June, 2010 a Notice of Public Hearing for the proposed road vacation was published in the Albia Union Republican and Monroe County News, newspapers of general circulation in the county where said road is located; and

The starting salary will be $31,000 per year, with a possibility of raising to $32,000 after a 6 month review.

Minutes of July 27, 2010, read and approved.

Motion by Beary and seconded by Hughes to approve the hiring of Steve Kosman as a mechanic at the Monroe County Secondary Road Department as requested by Engineer John Goode. Kosman will start employment approximately a week from Monday (8-23-10) at 95 percent of the union scale for the mechanice position wage.

Motion by Hughes and seconded by Beary to approve the fiscal year 2010/11 appropriation of $50,000 to Albia Industrial Development Corporation as approved by resolution adopted on February 15, 2010. Payment to be in two equal payments.

Engineer John Goode discussed a request for reclassification of a county road in Section 14 of Troy. Township, from a Class "B" Level Road to a Class "C" Level Road. The request was made by Dick VanLoon and the engineer presented a petition supporting the request from all surrounding land owners, except Union PaCiYie*ailroad. Goode said he would be sending a. letter to Union Pacific, notifying them of the request:for:_: reclassification.,

Discussibn held concerning Welcome Home Soldier Committee Board becoming a Board under the County's jurisdiction with Jim Keller. Kellar brought copy of the by-laws of the Welcome Home Soldier adopted on May 18, 2006. Chairman Ryan stated that it is on. County grounds and that may be it should be covered by the County's liability umbrella. Kellar stated that the Welcome Home Soldier committee would still appoint their board members. Supervisor Beary requested it be run by the County Attorney. Ryan stated that he would get in touch with County attorney and put this issue back on the agenda at a later date.

ADLM Environmental representative Donnie Herteen discussed - withthe Boardsewet - •• project thapinclUdesportion pf ,,Montoe:County,_(Halley!s Park). The project is called the Davis County Sewer Project.

RESOLUTION

WHEREAS, the Boards of Supervisors of Appanoose, Davis, Lucas and Monroe Counties (collectively hereinafter the "Counties") in the State of Iowa have authorized and executed a certain A.D.L.M. Management Systems Intergovernmental Agreement (the "28E Agreement") pursuant to Chapter 28E of the Code of Iowa; and

WHEREAS, the terms of the 28E Agreement provide for the creation of the A.D.L.M. Facilities Management Systems Commission ("ADLM") for the purpose of undertaking the development and operation of essential governmental facilities and services, such as sanitary sewer and water systems, in the Counties; and

WHEREAS, ADLM has authority pursuant to the 28E Agreement and Chapter 28F of the Code of Iowa to issue revenue bonds and interim financing notes to pay the costs of the project undertaken, but prior to the issuance of such bonds or notes each of the Counties must adopt a resolution authorizing their issuance; and

WHEREAS, ADLM has undertaken the design and construction of a sanitary system project (the "Davis County Sewer Project") in and near Davis County, Iowa, and has proposed the issuance of sewer revenue bonds (the "BOnds") and corresponding sewer revenue bond anticipation notes (the "Project Notes") to pay the costs of the Davis County Sewer Project; and

WHEREAS, it is now necessary for the Board of Supervisors of Monroe County to approve and authorize the issuance of the Bonds and the Project Notes;

NOW, THEREFORE, It is hereby resolved by the Board of Supervisors of Monroe County, as follows:

Section 1. The County hereby approves and authorizes ADLM to issue the Bonds in an amount not exceeding $3,500,000 and to issue the Project Notes anticipating the issuance of such Bonds in order to finance the Davis County Sewer Project.

Section 2. The issuance of the Bonds and the Project Notes and construction of the Davis County Sewer Project will benefit the Counties equally and the County agrees with the other Counties that the total principal amount of the Bonds allocated to the County for purposes of Section 265(b)(3)(c)(iii) of the Internal Revenue Code of 1986 (the "Code") shall be $875,500. The County hereby designates (and authorizes the Commission to designate on its behalf) Bonds in the principal amount of $875,000 as "qualified tax exempt obligations" as that term is defined in Section 265(b)(3)(B) of the Code, and the County agrees to comply with all requirements of the Code in order that such Bonds be and continue to be qualified tax exempt obligations.

Section 3. All resolutions or parts thereof in conflict herewith be and the same are hereby repealed to the extent of such conflict.

Engineer Goode discussed the study completed concerning the intersection of 110th Street and 640th Avenue with the Board. Goode stated that there had been a couple of accidents and severallclose calls at this intersection and requested that the Board adopt

STOP AT INTERSECTION RESOLUTION

WHEREAS: The Board of Supervisors is empowered under authority of Sections 321.236 and 321.255 of the Code of Iowa to designate any secondary road intersection under their jurisdiction as a STOP intersection and to erect STOP signs at one or more entrances to such intersection, and

WHEREAS: Based upon an engineering study, sight distance east of the intersection of 110th Street and 630th Avenue (located at the corners of Sections 5, 6, 7 and 8 of Bluff Creek Township, T73N, R17W) is limited and trees at the southeast corner of the intersection additionally limits visibility to the east.

NOW, THEREFORE, BE IT RESOLVED by the Monroe County Board of Supervisors that the secondary road approaches from the east and from the west be designated as "STOP approaches" to the above described intersection and that STOP signs shall b • _10cted accordingly.

The Monroe County Board of Supervisors met pursuant to adjournment on September 14, 2010, with Dennis J. Ryan, Michael R. Beary and John Hughes present.

Minutes of September 8, 2010, read and approved.

Albia City Clerk Linda Heller representing the Housing. Trust Committee discussed the possibility of getting a commitment of $5,000 of matching funds for the budget year of 2011/2012 from the County.for the rehabilitation of houses in the County. Heller stated that the City of Albia made a commitment of $5,000 at their last Board meeting for the same fiscal year for the City of Albia. The Iowa Finance Authority obtains low interest loans. Other counties participating are Wayne, Lucas and Appanoose. Supervisor Hughes stated that as long as the funds go to Monroe County residents that he would agree to the commitment of funds. Supervisor Beary stated that it would cost the County that much to clean up a dilapidated residence.

Motion by Beary and seconded by Hughes to budget $5,000 for the Housing Trust Committee for the rehabilitation of Monroe County houses in the fiscal. year 2011/2012.

All voted "AYE". - Motion Carried.

Motion by Beary and seconded by Hughes to accept the Treasurer's monthly investment report for August, 2010.

All voted "AYE". - Motion Carried.

Sheriff Dan Johnson discussed the possibility of swapping the telephone system of the Monroe County Law Center with the Monroe County Department of Human Services office. Johnson stated that he would cover the installation costs from his budget. Due to the recent cutbacks by the State of Iowa that Monroe County's Human Services office is less than full time and no longer allowed to have incoming phone calls.

Motion by Hughes and seconded by Beary to authorize the Chairman to contact Curt Ander-son of ATS Communications to see if it is cost effective to switch the telephone system from the Monroe County Department of Human Services office to the Monroe County Law Center.

All voted "AYE". - Motion Carried.

Discussion held with department heads concerning reimbursement policy for employees on County Business.

Motion by Beary and seconded by Hughes to approve reimbursement of lodging for out-of-town meetings not to exceed $125.00 per day plus the required local taxes and parking fees. Meals and mileage did not change.

All voted "AYE". - Motion Carried.

Motion by Hughes and seconded by Beary to approve utility permit applications to Windstream Communications in Section 6 of Mantua Township and in Sections 7 and 8 of Troy Township.

All voted "AYE". - Motion Carried.

Chairman opened the public hearing to consider the vacation of a portion of County Road in Section 36 of Urbana Township at 10:00 a.m. Persons present were Steve Townsend, Floyd Proctor, Warren Proctor and Albia Newspaper representative Tony Humeston.

Steve Townsend, Floyd Proctor and Warren Procter stated their objections to the closing of the county road. Richard H. Johnson faxed a written objection the Board of Supervisors. The Board received two telephone calls from Don Stephenson and Bill Wilson stating that they were not in favor of closing the County road in Section 36 of Urbana.

Motion by Beary and seconded by Hughes to close the public hearing at 10:10 a.m.

All voted "AYE". - Motion Carried.

Motion by Hughes and seconded by Beary to adopt the following resolution:

RESOLUTION

WHEREAS: A request has been made by Leffler Acres, Inc. and has been filed with the Monroe County Board of Supervisors asking that action be taken to vacate and close sections of Monroe County Secondary Roads described as follows:

County Attorney Steve Coodlow present to review pending litigation concerning Monroe County and Soap Creek Watershed.

Motion by Hughes and seconded by Beary to go into closed session under Iowa Code Section 21.5(c) to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would likely to prejudice or disadvantage the position of the Governmental body in that litigation.

Monroe County CPC Katie Fisher present to discuss agreement between Monroe County and Community Health Centers of Southern Iowa (MH/DD) effective July 1, 2010, to June 30, 2011.

Motion by Beary and seconded by Hughes to approve agreement between Monroe County and Community Health Centers of Southern Iowa (1H/DD) effective July 1, 2010, through June 30, 2010.

Chairman opened the public hearing at 10:00 a.m. to consider reclassifying 117th Lane in Sections 11 and 12 of Pleasant Township. Persons present were Steve Coodlow, Ann Stocker, Don Stephenson, Tony Humeston, Ed Heriford, Peggy VandenBerg and John Goode. Notices have been published in both official newspapers.

No oral or written objections have been filed.

Motion by Beary and seconded by Hughes to approve the following resolution:

RESOLUTION

WHEREAS, Monroe County desires to classify certain roads on the area service system in the County to provide for a minimal level of maintenance and access by means of a gate or barrier: and

WHEREAS, the County, after consultation with the County Engineer, has the authority to specify certain roads within the County as Area Service "C" roads pursuant to Iowa Code Section 309.57; and

WHEREAS, the County has received a request, signed by landowner(s) adjoining the road requesting that the following road be classified as an Area Service "C" road:

Legal Description: All of the road commencing approximately 130 feet east of the intersection of T-55 (720th Avenue) and 117th Lane (near the SE Corner of the NW SE of Section 11, T73N, R16W) thence east 2,533 feet, ending in the SE SW of Section 12, T73N, R16W. All of said road being in Pleasant Township, a total length of a 0.48 mile.

1. Blading. Blading or dragging will not be performed bn a regular basis. Blading will be performed when informed of the need by one or more of the adjacent landowners.

2.. Snow and Ice Removal. Snow and ice removal will not be performed on a regular basis. Sanding and salting will not be performed on a regular basis.

3. Bridges. Bridges on Area Service "C" roads may not be maintained to carry legal loads but will be posted as appropriate to advise of any load limitations.

4. Weeds, Brush and Trees. Mowing or spraying weeds, cutting brush and tree removal will not be performed on a regular basis. Adequate sight distances will not be maintained on a regular road.

5. Structures. Bridges and culverts may not be maintained on a regular basis to carry legal loads. Upon failure or loss, the replacement structure will be for traffic thereon.

6. Road Surfacing. There will be no survacing materials applied to Area Service "C" roads by the county.

7. Shoulders. Shoulders will not be maintained.

8. Crown. A crown will not be maintained.

9. Repairs. There will be no road repairs on a regular basis.

10. Uniform Width. Uniform width for the traveled portion of the road will not be maintained.

11. Inspections. Regular inspections will not be conducted.

12. Gate. The gate, corner post, brace, and brace post shall be purchased and installed by the County and maintained by the adjoining landowners. Any fence between the gate and ROW fence shall be the adjacent landowners responsibility. If not so maintained, the County may remove the gate; and

WHEREAS, the only persons who will have access rights to the road shall be

1. The owner, lessee or person in lawful possession of any adjoining land, 2. The agent or employee of the owner, lessee or person in lawful possession of any adjoining land, 3. Any peace officer, 4. Any magistrate, 5. Any public employee whose duty it is to supervise the use or perform maintenance of the road, 6. Any agent or employee of any utility located upon the road.

THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MONROE COUNTY that this County does hereby establish the road described as an Area Service "C" road, with restricted access and a minimal level of maintenance.

Motion by Hughes and seconded by Beary to adopt the following resolution:

RESOLUTION

WHEREAS, the County of Monroe is a participant in the South Central Iowa Solid Waste Agency, a 28E intergovernmental agency formed by Lucas, Marion, Monroe and Poweshiek counties, Iowa;

WHEREAS, the County is required to comply with Chapter 101 Solid Waste Comprehensive Planning Requirements of the Iowa Administrative Code (IAC 567-101);

WHEREAS, the County is committed to development and implementation of an effective and efficient integrated solid waste management system;

WHEREAS, officials, waste haulers, and individuals working and residing within the County haVe had the opportunity to participate in the development of the 6th round Comprehensive Plan Update;

WHEREAS, County representatives have reviewed the plan and, as needed, provided corrections and comments;

WHEREAS, Monroe County concurs with the implementation plan and schedule contained in the Comprehensive Plan Update;

NOW THEREFORE, the Monroe County Board of Supervisors adopts the 2010 Comprehensive Solid Waste Management Plan Update, its findings, implementation plan, and schedule; and resolves to work toward its completion.

Ed Heriford present with two quotes for the purchase of two pickup trucks for the Secondary Road Department. Denny Amoss also present at this time.

Motion by Hughes and seconded by Beary to approve the quote from Albia Motor Company in the amount of $29,868 and the quote from Duea Motor Company in the amount of $35,260, for the purchase of two vhhicles for the Secondary Road Department.

Be it resolved by Monroe County that Nichole L. Moore, Executive Director, and Julie Pribyl, Assistant Director, are hereby authorized to execute on behalf of Monroe County, this mitigation project and to file it with Iowa Homeland Security and Emergency Management (HSEMD) for the purpose of obtaining financial assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance. Act (PL 93-288, as amended) and the Code of Iowa, Chapter 29c.

The Monroe County Board of Supervisors met pursuant to adjournment on October 26, 2010, with Dennis J. Ryan, Michael R. Beary and John Hughes present.

Motion by Beary and seconded by Hughes to adopt the following resolution:

RESOLUTION FOR INTERFUND OPERATING TRANSFER

WHEREAS, it is desired to transfer monies from the Rural Services Fund to the Secondary Road Fund and transfer monies from the General Basic Fund to the Secondary Road Fund.

WHEREAS, said operating transfers are in accordance with Section 331.432, Code of Iowa.

NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Monroe County, Iowa, as follows:

Section 1. The sum of $213,215.25 is ordered to be transferred from the Rural Services Fund to the Secondary Road Fund effective October 26, 2010. The sum of $15,463.00 is ordered to be transferred from the General Basic Fund to the Secondary Road Fund effective October 26, 2010.

Section 2. The Auditor is directed to correct her books accordingly and to notify the Treasurer of the operating transfer, accompanying the notification with a copy of this resolution and the record of its adoption.

Sheriff Dan Johnson present to discuss phone system and other equipment at the Law Center. Supervisor Ryan stated that he received a quote from ATS Communications Curt Anderson to relocate the county-owned phone system from the Department of Human Services Office to the Law Center. The quote is for $525.00 which includes $175 card for caller ID services that the Sheriff requested. Sheriff Johnson stated that the Albia Mayor requested tb have the old phones from the law center. Discussion held concerning swapping the city's phones to the Department of Human Services Office so the County would not have to purchase that office new phones.

Motion by Hughes and seconded by Beary to authorize the Sheriff to accept the quote from ATS Communications and to authorize the transfer of the old phones to the City of Albia.

All voted "AYE". - Motion Carried.

Sheriff Johnson also discussed donating to the City of Albia the old monitor/camera system from the jail for the Aquatic Center. There has been incidents of people getting into cars in the parking lot.

Motion by Beary and seconded by Hughes to authorize the Sheriff to dontate the old monitor/camera system from the jail to the City of Albia for the Aquatic Center.

Sheriff Dan Johnson present to discuss the STEP (Safety Traffic Enforcement Program) prpgnam-Withthe Board. Johnson stated that his office has received the contract for the program in the amount of $4,800 of which $4,500 is designated for camera equipment for a squad car and $300 is designated for overtime costs associated with the program. Johnson stated that he will put theseifunds and expenditures in next years budget.

Motion by Hughes and seconded by Beary to approve utility permit application to Windstream Communications in Section 29 of Mantua Township.

The public hearing set for 10:00 a.m. to. county road in Section 14 of Troy Township was cancelled and will be rescheduled at a later date.

In compliance with Section 50.24 of the Code of Iowa, the Board of Supervisors canvassed the votes cast at the General Election held November 2, 2010, in Monroe County, Iowa. The Special Precinct Board met on Friday, November 5, 2010, to examine one provisional ballot and the three absentee ballots received after Election Day. Results of the canvass are on file for public review in the County Auditor's office.

There being no oral or written objections a motion was made by Hughes and seconded by Beary to close the public hearing at 10:08 a.m.

Chairman opened the public hearing at 10:00 a.m. to receive public comment on the commencement of a project to replace a bridge and make road improvements and to author-ize the acquisition of property and property interests in Section 20-72-16.

Monroe County intends to replace a 90 plus year old bridge with a twin box culvert. The bridge is on the end of a sharp curve and the curve will be lengthened to reduce the sharpness of the curve. This project is to be known as the "Hindman Bridge Project."

Person present were as follows: John Goode, Bethany Caskey, Betty Hindman, Charles Hindman, Brian Hindman, Rich Mosher and Justin Kamerick.

After due consideration and much discussion, motion by Beary and seconded by Hughes to close the public hearing at 11:05 a.m.

RESOLUTION

WHEREAS, Monroe County desires to classify certain roads on the area service system in the County to provide for a minimal level of maintenance and access by means of a gate or barrier; and

WHEREAS, the County, after consultation with the County Engineer, has the authority to specify certain roads within the County as Area Service "C" roads pursuant to Iowa Code Section 309.57; and

WHEREAS, the County has received a request, by a landowner(s) adjoining the road requesting that the following road be classified as an Area Service "C" road:

Legal Description: All of the road commencing at a point approximately 330 feet north of the SE corner of the NW NE of Section 14, T72N, R17W; running southerly, near the SE corner of the NW NE of Section 14, T72N, R17W; thence easterly to a point approximately 700 feet east of the SE corner of the NW NE of Section 14, T72N, R17W; thence southerly 140 feet. Total length of reclassification 0.22 mile.

WHEREAS, on the 23rd day of November, 2010, notice of said hearing was sent by certified mail to the affected property owners; and

WHEREAS, a public hearing was held on the 7th day of December, 2010; and

WHEREAS, the County does hereby establish the road described above as an Area Service "C" road, with restrict access and a minimal level of maintenance as follows:

1. Blading. Blading or dragging will not be performed on a regular basis. Blading will be performed when informed of the need by one or more of the adjacent landowners.

2. Snow and Ice Removal. Snow and ice removal will not be performed on a regular basis. Sanding and salting will not be performed on a regular basis.

3. Bridges. Bridges on Area Service "C" roads may not be maintained to carry legal loads but will be posted as appropriate to advise of any load limitations.

4. Weeds, Brush and Trees. Mowing or spraying weeds, cutting brush and tree removal will not be performed on a regular basis. Adequate sight distances will not be maintained on a regular road.

5. Structures. Bridges and culverts may not be maintained on a regular basis to Barry legal loads. Upon failure or loss, the replacement structure will be for traffic thereon.

6. Road Surfacing. There will be no surfacing materials applied to Area Service "C" roads, by the County.

7. Shoulders. Shoulders will not be maintained.

8. Crown. A crown will not be maintained.

9. Repairs. There will be no road repairs on a regular basis.

10. Uniform width. Uniform width for the traveled portion will not be maintained.

11. Inspections. Regular inspections will not be conducted.

12. Gate. The gate, corner post, brace, and brace post shall be purchased and installed by the County, and maintained by the adjoining landowners. Any fence between the gate and ROW fence shall be the adjacent landowners responsibility. If not so maintained, the County may remove the gate; and

WHEREAS, the only persons who will have access rights to the road shall be:

(1) The owner, lessee, or person in lawful possession of any adjoining land, (2) The agent or employee of the owner, lessee or person in lawful possession of

any adjoining land, (3) Any peace officer, (4) Any magistrate, (5) Any public employee whose duty it is to supervise the use or perform

maintenance of the road, (6) Any agent or employee of any utility located upon the road.

THEREFORE, BE TT RESOLVED BY THE BOARD OF SUPERVISORS OF MONROE COUNTY that this County does hereby establish the road described as an Area Service "C" road, with restricted access and a minimal level of maintenance.

Motion by Hughes to renew the agreement for office space between Monroe County and Indian Hills Community College at the Monroe County Community Services building for the period of July 1, 2010, through December 31, 2010. Building will no longer be needed after the December 31, 2010, date.

DiscusSion held with Pioneer Cemetery Commission members, Rosalie Mullinex, Merrill Baker and Ron Peterson concerning burial rights for a pioneer cemeteries. A Pioneer Cemetery is one where there have been twelve or fewer burials on its grounds in the last fifty years. County Supervisors have the authority to appoint the cemetery commission and delegate all or part of the related duties and powers to that Commission. Rosalie Mullinex stated that according the State the Pioneer Cemetery Commission can refuse over twelve burials to keep the pioneer cemtery status. There has been an issue of persons burying without notifying the Commission or the Township Trustees. There is no perpetual care for these graves. Another issues is the up keep of roads and getting back to where some of these cemeteries are located on private property. Rosalie Mullinex is going to check with the township clerks and see if they charge for plots and if so how much. The Commission will get back to the Supervisors after they check with the townships and have another pioneer cemetery meeting of all their members.

Chairman Ryan opened the one fuel quote that the County received for the Secondary•Road Department for a time period of January 1, 2011 to December 11, 2011. The quote was submitted by Agriland FS, inc., 421 North 10th Street, Winterset, Iowa. Their represent-ative, Mark W. Crozier was present.

The quote for Item number one is .079 cents over daily rack average (IDOT) and the quote for Item Option A (Provide B-5 (5% Blended Bio-Diesel) is 0.89 cents over daily rack average (IDOT).

Discussion was held concerning a firm price to the calendar year. The County currently is paying $2.65 per gallon which just ran out of the budgeted amount of 75,000 gallons of fuel. Engineer Goode stated that for the new year he was going to budget for 80,000 gallons of fuel. Supervisor Hughes stated that he likes to lock in on the firm price so we can budget better. Mr. Crazier offered a firm price verbally of $2.82 per gallon for the time period of 12-14-10 through 12-31-11.

Motion by Hughes and seconded by Beary to accept the verbal quote of $2.82 per gallon of fuel for the Secondary Road Department for the time period of December 14, 2010 through December 31, 2011. Mr. Crozier will bring it in written form to the County on Friday. •

Pursuant to Chapter 21, 2009 Code of Iowa, you are hereby notified of the following meeting of the below-named body in open session.

The Monroe County Board of Supervisors will meet in their office, Monroe County Courthouse on Tuesday, Dec. 21, 2010 at 9:30 a.m.

The Monroe County Board of Supervisors met pursuant to adjournment on December 21, 2010, with Dennis J. Ryan, Michael R. Beary and John Hughes present.

Minutes of December 14, 2010, read and approved.

Motion by Beary and seconded by Hughes to approve contract with French Reneker and Associates for ER projects: ER-0068(68)-58-68 and ER-0068(64)-58-68.

All voted "AYE". - Motion Carried.

Discussion held concerning the Welcome Home Soldier Committee. Supervisor Ryan stated that he had discussed with County Attorney Steve Goodlow about bringing the Welcome Home Soldier Committee under the County's "umbrella" of committees after the first of the year. Goodlow didn't see any problems with it according to Supervisor Ryan. The Welcome Home Soldier Committee is a non-profit organization.

Motion by Hughes and seconded by Beary to bring the Welcome Home Soldier Committee under the County's "umbrella" of committees after the first of the year.

All voted "AYE". - Motion Carried.

Dien Judge of Emergency Management discussed the Iowa Helping Iowans Program. The program is designed to help with paper work to get assistance after an emergency or disaster. SCICAP has volunteered to administer this program.

Motion by Beary and seconded by Hughes to adopt the following resolution:

BE IT RESOLVED by the Board of Supervisors of Monroe County, Iowa, that SCICAP, the Iowans Helping Iowans Unmet Needs Disaster Assistance Program Administrator of Monroe County, Iowa, be and is hereby designated, authorized, and empowered on behalf of the Board of Supervisors of said County to execute the certification of application by households with disaster-related unmet needs in accordance with the eligibility rules and program policies of the Iowans Helping Iowans Unmet Needs Disaster Assistance Program in this County.

All voted "AYE". - Motion Carried.

Discussion held concerning the full time General Relief Director's position. This position's employment status has been "laid off" since August 1, 2010. Attorney Joni Keith suggested at Supervisor Ryan's request that we send a letter terminating the full time position.

Motion by Hughes and seconded by Beary to send certified letter to the full time General Relief Director that her employment status will be changed to terminated as of December 31, 2010. The Board of Supervisors deeply regret having to make this decision.

All voted "AYE". - Motion Carried.

Zoning Administrator Juanita Murphy, Planning and Zoning members Dien Judge and Richard Mosher, Sheriff Dan Johnson and Bethany Caskey present for the first reading and consideration of Proposed Amendment Number 3 to Ordianance No. 29 - Monroe County Unified Development Code.

Board member Beary moved and seconded by board member Hughes that the Proposed Amendment Number 3 to Ordinance Number 29 "The Monroe County Unified Development Code" be given its first reading. Upon roll being called the vote on the foregoing motion was:

AYES: Beary "AYE". - Hughes - "AYE". - Ryan - "AYE". NAYS: none

Subsequent to the first reading board member Beary then moved and seconded by board member Hughes that the first reading of Proposed Amendment Number 3 to Ordinance Number 29 "The Monroe County Unified Development Code" be approved as read. Upon roll being called the vote on the foregoing motion was:

AYES: Beary - "AYE". - Hughes - "AYE". - Ryan - "AYE". NAYS: none

Board member Hughes then moved and seconded by board member Beary that the rule requiring an ordinance to be fully and distinctly read on three different days be dispensed with, in accordance with Iowa Code Section 331.302(5) and 331.305. Upon roll being called the vote on the foregoing motion was:

AYES: Beary - "AYE". - Hughes - "AYE". - Ryan - "AYE:. NAYS: none

Thereupon board member Hughes moved and seconded by board member Beary that Amendment Number 3 to Ordinance Number 29 "The Monroe County Unified Development Code is to amend Exhibit 3.4 Use Matrix Chart, page 3.19; to amend Chapter 4, Section 4.2 Continuation of Non-Conformities and 4.8 Abandonment and Discontinuance of Non-Conforming Rights; to amend Chapter 5, Supplementary Conditions for Specific Uses, Section 5.19 Telecommunication Towers and Antennas, 5.19D 3, 7, 8 & 9 Applicable Conditions and add New Sections 5.22 Personal Wind Energy System(s) (PWES); 5.23 Commercial Wind Energy System(s) (CWES) and 5.24 Definitions for Wind Energy Systems; and amend Chapter 10 Definitions, Section 10.2 to include Wind Energy System (Wind Turbines). Upon roll being called the vote on the foregoing motion was:

AYES: Beary - "AYE". - Hughes - "AYE". - Ryan - "AYE". NAYS: none

Thereupon the Chairman declared that Amendment Number 3 to Ordinance Number 29 "The Monroe County Unified Development Code" was passed and adopted.
