It relates to a product that had previously been recalled in 2012 and sent for destruction through a licensed waste contractor.

NEW BUSINESS CHECK LISTAs a council we are keen to support new businesses and growth in the district. We have various services that can be of use to starting up a new business whether you are making cakes or grooming dogs.

To help guide you along we have put together a checklist; this includes matters you will need to discussion with us (i.e. planning, food hygiene, licensing) and matters that other organisation can help you with. ADVICE ON FOODALLERGEN LABELLINGIn December 2014 new European regulations will come in to force in order to help consumers choose the right food when you or someone you care for has a food intolerance or allergy. The new regulation is known as Food Information for Consumers Regulation.

The law will bring general and nutrition labelling together into a single regulation to simplify and consolidate existing labelling legislation.

These changes will provide allergen information in a clearer and more consistent way; making it easier for consumers to make safer food choices when buying food.

There are 14 major allergens:

Information for consumers:

• Until all labels have changed, you will continue to see old and new labels on food products. To make sure you have the correct information, always check the ingredients list of a product to find out what allergens it contains.

• When eating out, let the person serving you know your dietary requirements, including how severe your food allergy or intolerance is.

• Always check what allergens are in the dish even if you have eaten it before, as recipes and ingredients can change.

• If you are not sure about a dish or about the information you have been provided, don’t risk it! Don’t order the dish or eat at the premises.

• Enjoy a varied diet. Choose foods to replace the ones you must avoid. See a dietitian for advice if you are concerned about your diet.

• Always carry your prescribed allergy rescue medication with you and ensure family and friends know how to use it on you, if necessary.

• Someone having a severe allergic reaction should not be moved. Make sure your family or friends know they have to call 999 for an ambulance and a paramedic, if needed. Tell the emergency operator that the patient has anaphylaxis (pronounced ana-fill-axis).

All allergens will have to be emphasised on the label, this may be in bold or italic or in different colours.

Foods without packaging currently don’t have to provide ingredients lists, however this will no longer be the case. The ingredients will need to be listed either using a blackboard or a chart or provided by staff.

When eating out you should tell the chef if you have any allergies. There is a ‘chef card’ available to download at: food.gov.uk/multimedia/pdfs/ chefcard.pdf

PROTECTING TENANTS FROM RIP OFF AGENTSTenants and leaseholders in East Northamptonshire will receive stronger protection from unscrupulous letting agents under new plans announced by central government.

Letting and property management agents will be required to join one of three approved ‘redress schemes’, which are designed to ensure tenants and leaseholders have a straightforward option to hold their agents to account. Although the majority of agents are registered with one of these schemes, 40% of the industry has yet to join.

The three compulsory redress schemes – the Property Ombudsman, Ombudsman Services Property and the Property Redress Scheme – will offer independent investigation of complaints about hidden fees or poor service. Where a complaint is upheld, tenants and leaseholders could receive compensation.

Cllr Steven North, Leader of the Council, commented: “By joining one of these schemes, agents are committing to treating tenants in a fair and transparent way. This should be a given but that isn’t always the case so we’re glad the regulations are being tightened up giving more people the confidence to rent properties in East Northamptonshire.”

The government also plans to bring in other measures to protect tenants including extra guidance for councils on rogue landlords and illegal eviction.

subsidised food safety training opportunities“Skills Support for the Work force” is a new funded** initiative delivering accredited training to the hospitality sector.

Who is it for?Training may be provided free of charge to small and medium size (SME) businesses based in Northamptonshire that wish to improve the skills of both new and long serving employees.

What training is available?For businesses in the hospitality sector opportunities exist to undertake fully funded NVQ Level 2 Qualifications in Food & Beverage Service, Food Production and Cooking, Hospitality Services and Professional Cookery.

How long will it take?Depending on the qualification chosen and the ability of the individual, the NVQ will take between 6 and 10 months. Workplace visits will be undertaken throughout the duration of the course.

Which of my employees will qualify?Anyone aged 19 years or over who has not achieved 5 GCSE’s at grades A-C may be eligible to complete the training. There may also be flexibility around other staff members who already have a qualification at Level 2 or higher.

THE SALE OF ALCOHOL BELOW THE COST OF DUTY PLUS VAT BANNED WITH EFFECT FROM THE 28 MAY 2014 New legislation that introduces new mandatory conditions came into force on 28 May 2014 banning the sale of alcohol below the cost of duty plus VAT for all suppliers of alcohol.

The ban will take the form of a new licensing condition of the Mandatory Code of Practice established under the Licensing Act 2003. The Mandatory Code of Practice applies to all licensed premises, including those with club premises certificates, in England and Wales.

The ban is aimed at the prevention of businesses selling alcohol at heavily discounted prices and aims to reduce excessive alcohol consumption and its associated impact on alcohol related crime and health issues.

Anyone involved in the sale or supply of alcohol should make sure they are aware of the new condition.

COFFEE MACHINESHAVE YOU HAD YOURS EXAMINED?A significant number of coffee machines have exploded over the last few years, including one in a Sainsbury’s supermarket that injured 7 people. Coffee machines are commonly used and operated in many places of work and are generally exposed to greater usage than would be expected of similar items of plant.

Coffee machines are often considered to be pressurised systems if they contain a relevant fluid over 0.5 bar. Pressurised systems need taking care of to ensure they are safe, there are certain legal requirements that have to be met if you sue one of these machines. You must ensure that:-

• The boiler is ‘suitable for its intended purpose so as to prevent danger’ and adequate information relating to the boiler is ‘made available to the user’

• The boiler installation ‘does not give rise to danger’ and a safe operating limit has been established

• An appropriate Written Scheme of Examination (WSE) has been drawn up and certified by a competent person (as defined in PSSR). The boiler is periodically prepared, examined and tested in accordance with the WSE, usually every 12 months.

• The boiler is not operated beyond the date specified in the WSE report and repairs are addressed.

• Users are supplied with suitable operating and emergency instructions, and the boiler is suitably maintained and relevant records are retained

But most coffee machines incorporate a steam boiler that presents other specific risks. For instance, they can explode, causing potential business interruption, brand and reputation damage, property damage, loss of revenue and personal injuries such as burns.

NOISE COMPLAINTSWHAT HAPPENS?As a Council we receive hundreds of complaints a year about noise and we have a duty to investigate complaints. If you are in receipt of a letter from us stating that a complaint has been made or worry that your neighbours may complain here are 5 key points you should be aware of.

contact us straight awayIf you have received a letter from the council stating a noise complaint has been made, the best thing to do is to contact us to see if there is any additional information that can be provided to you about the complaint.

complainants details are confidentialWe will never divulge who the complainant is, nor will we confirm or deny if you think you have an idea of who it might be

consider the complaintThe letter and or the officer will advise you of the information we have received stating the type of noise that is the source of the complaint and when it is causing a problem. Consider this information and whether there is potentially any issue relating to the complaint that you can think of. For example did you have a live band on and forget to keep your doors and windows closed? If you are using noisy equipment were doors left open or has it not been maintained recently?

take actionIf you think there is a problem and you can rectify it, take the action. However, if you don’t feel there is a problem ask for us to contact you upon receipt of completed diary sheets from the complainant. These diary sheets should highlight dates and times that the noise was causing them a problem.

work with usIf the diary sheets are returned and we contact you to advise that there is a potential issue in our opinion please work with us. Our aim is to always resolve issues jointly with businesses; we are reasonable and want to find sustainable solutions for all. If any issue is identified don’t try and forget about it, it won’t go away and may leave us no choice but to take legal action against you.

FOOD SAFETY WEEK 16-22 JUNE 2014DON’T WASH RAW CHICKEN, COOK ITPROPERLY AND ENJOY IT SAFELYOfficers from East Northamptonshire Council visited some local supermarkets in East Northamptonshire during Food Safety week in order to talk to the public about the dangers of washing raw chicken.

The officers gave out information to the public about Campylobacter the most common food poisoning bacteria associated with poultry.

Each year around 250,000 people in the UK are struck down by food poisoning caused by Campylobacter.

THE OLD HEALTH & SAFETY LAW POSTEREXPIRED ON 5 APRIL 2014The life of the previous health and safety law poster came to an end on 5 April 2014. Employers must either give all their staff a copy of a leaflet – free to download from HSE’s website OR display the newer version of the poster, launched back in 2009.

The changes mean that you no longer have to add contact details of your enforcing authority and the HSE’s Employment Medical Advisory Service on the new poster. You can add details of any employee safety representatives or other health and safety contacts, but this is not compulsory.

You can find out more, including how to download the free leaflet, or buy the poster at HSE’s websitewww.hse.gov.uk/contact/faqs/lawposter.

The leaflet is available in various formats, including easy read, large print and MP3 versions.

ASSISTED AREA STATUS FOR ENC KINGS FOREST WARDThe European Commission has now approved the following 22 wards in Corby, Kettering, Wellingborough and East Northamptonshire for Assisted Area status:• Corby: Central, East, Rowlett, Shire Lodge, Stanion and Corby Village, Weldon and Gretton• Kettering: Barton, Burton Latimer, St. Michael's and Wicksteed, St. Peter's, William Knibb, Queen Eleanor and

Buccleuch, Northfield• Wellingborough : Castle, North, Hemmingwell, Irchester, Redwell West, Wollaston, Queensway, Swanspool• East Northamptonshire: King’s Forest (to check refer to our website for ward areas http://www.east-

Assisted Area status means that local businesses eligible to bid for additional levels of funding and support that can help them to create jobs, invest in new premises and equipment, develop and grow. It is also anticipated that firms would be more attracted to move to those locations because of the aid they could receive. Assisted Area status runs from 1st July, 2014 and will run throughout the period 2014-2020, subject to a mid-term review in 2016.

There is no separate or new funding linked with the designation. However, assisted area status mean that higher grant ratios are permissible for those funds which are available. So for example much of the Kings Forest Ward falls within the proposed new Leader grant-area and this could mean that instead of the previous offer level of up to 50% of project costs in grant aid, higher % grants could be offered for businesses in the ward.

In an assisted area, investments in green technologies, research, development & innovation, or encouraging a low carbon economy, can also receive higher levels of aid through a regional bonus. Also certain tax allowances are only available in assisted areas such as Business Premises Renovation Allowance. This is a tax incentive to bring derelict or unused commercial properties back into use, gives an initial allowance of 100% for expenditure on converting or renovating the premises. THE SALE OF ALCOHOL BELOW THE COST OF DUTY PLUS VAT BANNED WITH EFFECT FROM THE 28 MAY 2014 New legislation that introduces new mandatory conditions came into force on 28 May 2014 banning the sale of alcohol below the cost of duty plus VAT for all suppliers of alcohol.

The ban will take the form of a new licensing condition of the Mandatory Code of Practice established under the Licensing Act 2003. The Mandatory Code of Practice applies to all licensed premises, including those with club premises certificates, in England and Wales.

The ban is aimed at the prevention of businesses selling alcohol at heavily discounted prices and aims to reduce excessive alcohol consumption and its associated impact on alcohol related crime and health issues.

Anyone involved in the sale or supply of alcohol should make sure they are aware of the new condition.

COFFEE MACHINESHAVE YOU HAD YOURS EXAMINED?A significant number of coffee machines have exploded over the last few years, including one in a Sainsbury’s supermarket that injured 7 people. Coffee machines are commonly used and operated in many places of work and are generally exposed to greater usage than would be expected of similar items of plant.

Coffee machines are often considered to be pressurised systems if they contain a relevant fluid over 0.5 bar. Pressurised systems need taking care of to ensure they are safe, there are certain legal requirements that have to be met if you sue one of these machines. You must ensure that:-

• The boiler is ‘suitable for its intended purpose so as to prevent danger’ and adequate information relating to the boiler is ‘made available to the user’

• The boiler installation ‘does not give rise to danger’ and a safe operating limit has been established

• An appropriate Written Scheme of Examination (WSE) has been drawn up and certified by a competent person (as defined in PSSR). The boiler is periodically prepared, examined and tested in accordance with the WSE, usually every 12 months.

• The boiler is not operated beyond the date specified in the WSE report and repairs are addressed.

• Users are supplied with suitable operating and emergency instructions, and the boiler is suitably maintained and relevant records are retained

But most coffee machines incorporate a steam boiler that presents other specific risks. For instance, they can explode, causing potential business interruption, brand and reputation damage, property damage, loss of revenue and personal injuries such as burns.

NOISE COMPLAINTSWHAT HAPPENS?As a Council we receive hundreds of complaints a year about noise and we have a duty to investigate complaints. If you are in receipt of a letter from us stating that a complaint has been made or worry that your neighbours may complain here are 5 key points you should be aware of.

contact us straight awayIf you have received a letter from the council stating a noise complaint has been made, the best thing to do is to contact us to see if there is any additional information that can be provided to you about the complaint.

complainants details are confidentialWe will never divulge who the complainant is, nor will we confirm or deny if you think you have an idea of who it might be

consider the complaintThe letter and or the officer will advise you of the information we have received stating the type of noise that is the source of the complaint and when it is causing a problem. Consider this information and whether there is potentially any issue relating to the complaint that you can think of. For example did you have a live band on and forget to keep your doors and windows closed? If you are using noisy equipment were doors left open or has it not been maintained recently?

take actionIf you think there is a problem and you can rectify it, take the action. However, if you don’t feel there is a problem ask for us to contact you upon receipt of completed diary sheets from the complainant. These diary sheets should highlight dates and times that the noise was causing them a problem.

work with usIf the diary sheets are returned and we contact you to advise that there is a potential issue in our opinion please work with us. Our aim is to always resolve issues jointly with businesses; we are reasonable and want to find sustainable solutions for all. If any issue is identified don’t try and forget about it, it won’t go away and may leave us no choice but to take legal action against you.

ADVICE ON FOODALLERGEN LABELLINGIn December 2014 new European regulations will come in to force in order to help consumers choose the right food when you or someone you care for has a food intolerance or allergy. The new regulation is known as Food Information for Consumers Regulation.

The law will bring general and nutrition labelling together into a single regulation to simplify and consolidate existing labelling legislation.

These changes will provide allergen information in a clearer and more consistent way; making it easier for consumers to make safer food choices when buying food.

There are 14 major allergens:

Information for consumers:

• Until all labels have changed, you will continue to see old and new labels on food products. To make sure you have the correct information, always check the ingredients list of a product to find out what allergens it contains.

• When eating out, let the person serving you know your dietary requirements, including how severe your food allergy or intolerance is.

• Always check what allergens are in the dish even if you have eaten it before, as recipes and ingredients can change.

• If you are not sure about a dish or about the information you have been provided, don’t risk it! Don’t order the dish or eat at the premises.

• Enjoy a varied diet. Choose foods to replace the ones you must avoid. See a dietitian for advice if you are concerned about your diet.

• Always carry your prescribed allergy rescue medication with you and ensure family and friends know how to use it on you, if necessary.

• Someone having a severe allergic reaction should not be moved. Make sure your family or friends know they have to call 999 for an ambulance and a paramedic, if needed. Tell the emergency operator that the patient has anaphylaxis (pronounced ana-fill-axis).

All allergens will have to be emphasised on the label, this may be in bold or italic or in different colours.

Foods without packaging currently don’t have to provide ingredients lists, however this will no longer be the case. The ingredients will need to be listed either using a blackboard or a chart or provided by staff.

PROTECTING TENANTS FROM RIP OFF AGENTSTenants and leaseholders in East Northamptonshire will receive stronger protection from unscrupulous letting agents under new plans announced by central government.

Letting and property management agents will be required to join one of three approved ‘redress schemes’, which are designed to ensure tenants and leaseholders have a straightforward option to hold their agents to account. Although the majority of agents are registered with one of these schemes, 40% of the industry has yet to join.

The three compulsory redress schemes – the Property Ombudsman, Ombudsman Services Property and the Property Redress Scheme – will offer independent investigation of complaints about hidden fees or poor service. Where a complaint is upheld, tenants and leaseholders could receive compensation.

Cllr Steven North, Leader of the Council, commented: “By joining one of these schemes, agents are committing to treating tenants in a fair and transparent way. This should be a given but that isn’t always the case so we’re glad the regulations are being tightened up giving more people the confidence to rent properties in East Northamptonshire.”

The government also plans to bring in other measures to protect tenants including extra guidance for councils on rogue landlords and illegal eviction.

subsidised food safety training opportunities“Skills Support for the Work force” is a new funded** initiative delivering accredited training to the hospitality sector.

Who is it for?Training may be provided free of charge to small and medium size (SME) businesses based in Northamptonshire that wish to improve the skills of both new and long serving employees.

What training is available?For businesses in the hospitality sector opportunities exist to undertake fully funded NVQ Level 2 Qualifications in Food & Beverage Service, Food Production and Cooking, Hospitality Services and Professional Cookery.

How long will it take?Depending on the qualification chosen and the ability of the individual, the NVQ will take between 6 and 10 months. Workplace visits will be undertaken throughout the duration of the course.

Which of my employees will qualify?Anyone aged 19 years or over who has not achieved 5 GCSE’s at grades A-C may be eligible to complete the training. There may also be flexibility around other staff members who already have a qualification at Level 2 or higher.

A SAFETY NOTICE HAS BEEN DISTRIBUTED REGARDING OVEN PRIDE & BBQ PRIDE CLEANERSThe manufacturers issued a national recall of unofficial products which have been found on sale to the public. It relates to a product that had previously been recalled in 2012 and sent for destruction through a licensed waste contractor.

It has unfortunately found its way back on to the market through unofficial means and so is not the Oven Pride product that was officially offered for sale.
