Eligibility Criteria of intending bidders for Supply of Books/ e-Books /Journals / e-Journals reading material: (Proof/supporting Documents to be enclosed for the pointsmentioned below:

1. e-tender invited from the reputed/registered publishers/ book suppliers/vendors/dealers/distributors having valid registration with Federation of Publishers and BooksellersAssociations in India (FPBAI)/ Good Office Committee (GOC) or any other recognizedNational body for supply of Indian and Foreign Books/journals/reading material related toagricultural and allied fields.

2. No person or firm shall submit more than one tender for the same item.

3. The price of the tender document for supply of Books/Journals/ e-Books/ e-Journalsreading material is Rs.1,000.00 (Rupees one thousand only) to be paid online on portalwww.mpeproc.gov.in. The tender document is available on https://mptenders.gov.in andinformation on www.jnkvv.org .

4. The e-tender is liable to be rejected if complete information is not given therein or if theparticulars and date (if any) asked for in the tender are not duly & fully filled in. e-Tendermust be submitted on-line as per ‘Important Dates’ mentioned in e-tender document.

5. The tenderer should have a valid Trade licence, GST/PAN / TIN No. and produce attestedcopies of such certificates along with the tender document, failing which the tender isliable to be rejected.

6. e-Tender shall be submitted within the stipulated date and time. In the event of thestipulated date of opening of the tender being declared a closed holiday for Govt. Offices,the date of opening of the tender (s) will be the next working day. Tender can be purchased on-line from https://mptenders.gov.in – Start Date:

11. Earnest Money Deposit (EMD):

a.EMD of required amount as specified in the tender document to be submitted on-lineon portal. Receipt generated on-line should be submitted with mandatory document.

b. Exemption terms: EMD can be exempted only for those bidders who are registeredwith the SSIC, National Small Industries Corporation (NSIC), MSEs or firms

registered under DGS & D for the items quoted. The firm should submit in supportthe valid Permanent Enlistment Certificate of SSIC, NSIC or valid DGS & D RateContract copy for the quoted item only.

The above security deposit/EMD will be refunded to the approved publishers/ bookBidders/vendors/ dealers/distributors only on successful completion of the supplies andafter the duration of tenure. Any default on the part of the vendor will lead to forfeiture ofsecurity to Jawaharlal Nehru Krishi Vishwa Vidyalaya, Jabalpur and the publishers/ bookBidders/vendors/ dealers/distributors will have no claim on it. The Security Depositamount will not carry any interest.

12. Mandatory Submission (Envelope A) containing all original documents as required fortechnical bid including original EMD Receipt (submitted online on portal) must besubmitted in sealed cover to the Director Instruction, JNKVV, Adhartal, Jabalpur482004 so as to reach on or before dt.26.12.2019, 3:30 pm.

13. Opening of e- Tender:The tender shall be opened on the date and time mentioned here in the document. Technical Bids (Mandatory Submission (Envelope A) will be opened on

27.12.2019, 3.00 pm Financial Bids of qualified bidders will be opened on announced date (kindly visit

our website www.jnkvv.org ).

14. Right to accept / reject:

The Director Instruction, Jabalpur reserves the right to reject any or all tender withoutassigning any reason whatsoever. Also, the Director Instruction reserves the right toaward any or part or full contract to any successful agency at its discretion and this will bebinding on the tendrer.

15. Full Postal Address, Telephone / Mobile / Fax / E-mail address, etc. should be provided,while submitting the completed tender form.

16. The publishers/stockist /vendors/ dealers/distributors shall provide a list of Institutes(Government/Statutory bodies/Professional, educational institutions/State /CentralUniversities).

17. The annual turnover of the publishers/ book Bidders/vendors/ dealers/distributors/aggregators for the last 3 financial years must be at least Rs. 50.00 Lakhs (Rupees FiftyLakhs) per annum. Submission of Name and address of bankers with satisfactory banker’sreport regarding Bidders /vendors financial capability for doing business worth Rs. 50.00Lakhs (Rupees Fifty Lakhs) in last 3 years should be attached.

18. All pages of the tender should be duly signed by authorized signatory of the applicant firm.

19. DELIVERY TERMS :1. The rate is to be quoted on FOR destination. Maximum discount as may be

admissible may be shown in Part -B ( Financial bid format) against each items.

2. The Vendors registration may be terminated/ dropped/ black- listed from the list ofregistered suppliers if the vendor fails to deliver 90% of the supply order.

3. The books shall be supplied within 30 days of receipt of Supply Orders. In case ofdelay supply liquidity damage @ 5% of value of Supply Orders for every 15 daysdelay will be imposed, maximum up to 10% of the total Value of Supply Order.

4. The vendor/supplier must ensure that all the supplies are strictly in accordance withAuthor/Publication/Edition etc. mentioned in Supply Order. The change inAuthor/Publication/Edition after the release of Supply Orders may not beentertained by the JNKVV Jabalpur in any circumstances except under specificconditions like Discontinuation/ Takeover/ Subsidiary company /Bankruptcy etc.for which written prior intimation is to be given to the JNKVV Jabalpur Authoritiesand necessary approval from the Supply Orders Issuing Authority of JNKVVJabalpur has to be obtained and enclosed a copy along with Supply Orders of suchitems/goods supplied under this effect.

5. It is must for Vendors to ensure that the Books/Journals/Publications dispatchingfor supply to Central Library JNKVV Jabalpur and it’s concern units are properlypacked in strong packaging for protecting the consignment, so as to avoiddamage/pilferage in transit to destination under normal handling. The clear markingin the outer surface of packaging must contain the Supply Orders Number and theaddress of the Consignee in 2-3 sides through permanent marker/affix through goodquality of glue.

6. Part supply will be accepted only if valid justification is being provided by supplierfor not able to meet the full supply.

7. The “Supply Order” consists of supply of publications as per the bibliographicdetails mentioned there in and all other components (CD’s etc.), those which comebundled with should automatically be provided by vendor.

8. After the order is placed and Book Seller is unable to supply the booksellerscondition will be accepted only if valid justification is being provided by thesupplier for not being able to meet the full order.

9. Supplies shall be accepted subject to the complete satisfaction of CompetentAuthority. Any defect found in the Books supplied will invite rejection and decisionof the Competent Authorities, will be final and legally binding. The rejected booksshall have to be taken back at their own cost and risk.

10. Rates should be quoted for only latest and paperback edition, if available in market.

11. On the basis of actual acceptance of the supply, the supplier will raise the bill intriplicate in favour of “The Director Instruction, JNKVV Jabalpur and Dean ofconcern college/ units of University”. The bill should also contain the reference ofour order, besides full name authors/ editors, ISBN, Title, Subtitle, edition,National or International, publisher, Year of Publication, Place of Publication,Volume no., Currency, Cost per copy, Conversion rate, Total Price in Rs.

if applicable. The billing should be done only on discounted % prices given bythe bidder/supplier and variation in discounted % shall not be entertained.

13. It is imperative to mention specifically whether the title is Original, International,Student, Indian or Low price edition.

14. The Competent authority may allow additional time under special circumstancessuch as strikes, lockouts, fire accidents, riots etc.

15. The final rates should be quoted in Indian Rupees, both in figure and words alongwith currency adopted and conversion.

16. The publishers/ book Bidders/vendors/ dealers/distributors/aggregators shortlistedfor supply of books/ e-books /journals /e-journals reading material are required tostrictly agree to supply as per the Jawaharlal Nehru Krishi Vishwa Vidyalaya,Jabalpur Terms and Conditions.

17. Only flat discount rate must be quoted. Quoting of discount rates in any other waywill disqualify the tender for Supply of print books/journals/ reading material.

21. Only Paperback and Latest Editions are to be supplied. Hardbound editions are notto be supplied. In case where paperback editions are not available, hardboundeditions may be supplied (certificate of non availability of paperback edition frompublisher must be attached).

22. Purchase orders will be placed by individual college/ units of JNKVV dependingupon the availability of funds for the purpose. Bills will be raised to individualcollege /units and payment will be release by the corresponding college/ units.

23. The publishers/ Bidders/vendors/ dealers/distributors/ aggregators shall supply theBooks/Journals to Central Library and constituent units, Jawaharlal Nehru KrishiVishwa Vidyalaya by hand or by registered post/courier at his own cost.

24. By filling the tender for Supply of print Books/Journals/ reading materials it impliesthat all terms and conditions are fully acceptable to the publishers/ bookBidders/vendors/ dealers/distributors/ aggregators.

20. The Jawaharlal Nehru Krishi Vishwa Vidyalaya reserves the right to:

Cancel an order at any time without assigning any reason there off.

Change or modify the supply order. Reserves the right to issue supply order to any of the approved vendors.

Change or modify or amend or substitute any clause in the terms and conditionslisted above.

Give supply order of any or some of the titles as mentioned in the list and to addnew titles as and when required.

21. Client List/ List of Users:List of institutes/ organizations, where the same quoted item has supplied should begiven. Copy of the work order & completion certificate duly signed by the competentauthority of the institute should be enclosed. The detailed list mentioning the user name,department name, date/year of supply, installation, satisfactory working certificate fromuser and contact number including e-mail should be supplied with tender.

22. Submission of Important Documents:

a. Acceptance of Terms & Conditions:

On approval of the tender, the supplier should submit acceptance certificate

stating that the aforesaid "Terms and Conditions" are agreeable to the tenderer.

b. Never Blacklisted Notarized Document

The supplier shall also undertake that the firm never being blacklisted/

banned/declared having delivered dissatisfactory performance by any government/

semi‐government authority in India for supply of materials/ carrying out operations

and maintenance work/ application development. An undertaking by an authorized

signatory of the company needs to be submitted in this regard as a preliminary

undertaking. This Affidavit should be submitted duly notarized on Rs. 200/- non

judicial stamp.

c. Submit the Last 3 (three) years income tax return.

d. Submit the Audited balance sheet along with Profit & Loss Account for last threefinancial years. Submit CA Certified Statement for the last three financial yearon the Net worth.

e. Duly signed photocopy of PAN card

f. Duly signed photocopy of GSTIN

g. Firms/ Business Registration documents/Copy of valid Registration Certificateunder State/ Central/ Commercial Sales Act.

23. Jurisdiction

The disputes, legal matters, court matters, if any shall be subject to Jabalpur (MP), Indiajurisdiction only.

a. Force Majeure:

JNKVV may consider relaxing the penalty and delivery requirements, as specified in

this document, if and to the extent that, the delay in performance or other failure to

perform its obligations under the contract is the result of an Force Majeure. Force

Majeure is defined as an event of effect that cannot reasonably be anticipated such as

acts of God (like earthquakes, floods, storms etc.), acts of states / state agencies, the

direct and indirect consequences of wars (declared or undeclared), hostilities,

national emergencies, civil commotion and strikes at successful Bidder’s premises orany other act beyond control of the bidder.

b. Arbitration:

All disputes/ claims of any kind arising out of supply, implementation,

commissioning, acceptance, warranty maintenance etc under this Contract, shall be

referred by either party (JNKVV or the bidder) after issuance of 30 days’ notice in

writing to the other party clearly mentioning the nature of dispute to the Sole

Arbitrator appointed by JNKVV. The arbitration proceedings shall be conducted in

English and as per the provisions of Indian Arbitration and Conciliation Act. The

decision of the Arbitrator shall be final and binding on both the parties.

24. Legal Dispute Settlement:While the Jawaharlal Nehru Krishi Vishwa Vidyalaya, Jabalpur 482004 and thepublishers/ book Bidders/vendors/ dealers/distributor/aggregators shall make everyeffort to resolve any conflict amicably by direct informal negotiation, even then in anycase of any disagreement or dispute arising between them under or in connection withthe contract/supply shall be settled under the Court of Law within its Jurisdiction atJABALPUR, Madhya Pradesh only.

Terms and conditions for Supply of Indian / Foreign Print Journals to CentralLibrary and Constituent College/ Units of Jawaharlal Nehru Krishi Vishwa

Vidyalaya, Jabalpur, Madhya Pradesh

1. Order must be complied within the 30 days of the form the date of issue of orders. Anydelay in supply of the above journals between 31days to 40 days from the date of issuethe penalty 2% will be imposed for late delay and will be adjusted from the securityperformance submitted by the supplier Advance payment should be made by the Supplierto the publisher on behalf of Central Library and constituent units, Jawaharlal NehruKrishi Vishwa Vidyalaya (as Subscriber) and invoice / bill should be raised for paymentalong with remittance proof, publisher’s price proof and order placed to publishers.Central Library and constituent units, Jawaharlal Nehru Krishi Vishwa Vidyalaya willpay invoice / bill raised by the supplier as per Vishwa Vidyalaya rules.

2. The publishers/ book suppliers/vendors/ dealers/distributor/ aggregators will have toenter with an agreement with Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) asmentioned in Annexure I & II.

3. Rates quoted should include all taxes.

4. Subscription Period: All journals are to be procured for the calendar year January toDecember or a complete volume as specified in the order. Supply of the periodicalsshould commence from the issue no. starting January of the volume or unless as specifiedotherwise.

5. The Supplier must have permission from the Reserve Bank of India to remit foreignexchange for the purpose of subscription of journals. The attested photo copy of suchpermission should be attached.

6. The publishers/ book suppliers/vendors/ dealers/distributor/ aggregators will provide allthe facilities of subscription model/license agreement with the publishers where everapplicable.

7. The successful publishers/ book suppliers/vendors/ dealers/distributor/ aggregators willbe required to submit bank guarantee bond as mentioned in annexure II of the supplyorder amount.

8. Upon submission of publishers/ book suppliers/vendors/ dealers/distributor/ aggregators -invoices along with Remittance Proofs, Subscription, Name, Number and Date,Publishers Price Proof, Bank Conversion Certificate, Jawaharlal Nehru Krishi VishwaVidyalaya shall release payment against the invoice amount. No interest will be payableon amount paid by the subscription publishers/ book suppliers/vendors/dealers/distributor on account of delay in payment by the institute.

9. The publishers/ book suppliers/vendors/ dealers/distributor/ aggregators has to inform theCentral Library, Jawaharlal Nehru Krishi Vishwa Vidyalaya about the availability of freeonline access and perpetual access to the ordered journals at the time of submission of

tender . The access to journals which are available online should be provided to theUniversity by the Agent/Vendor without charging any additional service charges.

10. The publishers/ book suppliers/vendors/ dealers/distributor/ aggregators shall supply thejournals to Central Library and constituent college/ units, if ordered Jawaharlal NehruKrishi Vishwa Vidyalaya by hand or by registered post/courier at his own cost.

11. The publishers/ book suppliers/vendors/ dealers/distributor/ aggregators shall monitorclaims for missing issues of journals, if any and arrange to provide the same withinreasonable period. All missing issues should be supplied or otherwise subscription cost ofmissing issues must be refunded. All legitimate claims to be settled by the vendors withinone and half years from the date of receipt of payment.

12. On successful approval, the publishers/ book suppliers/vendors/ dealers/distributor/aggregators will have to enter into an agreement with Jawaharlal Nehru Krishi VishwaVidyalaya or any other officer authorized on his behalf on a non- judicial stamp paper ofRs. 100=00 (Rupees One Hundred only), the cost of which has to be borne by theAgent/vendor/supplier himself.

13. Preference will be given to the Supplier who can provide online access to the printjournals subscribed, if it is available to subscribers free of cost.

14. Proof of payment, made for each journal to the actual publisher (not by intermediary) isnecessary for verification.

15. The supplier should enclose the copies of, Appreciation Letters and Letters of timely andcent percent supply of the journals from institutes where supplies have been made.

16. The Supplier’s representative shall visit to reconcile supply status at least once in amonth.

17. Advance payment will be admissible only against the 100% bank guarantee ofamount required payment is in the validity period of two months extra, issued bythe Nationalize Bank.

18. Wrongly supplied journals will be returned at the cost of supplier/s.

19. All correspondence along with invoice in triplicate should be addressed to The DirectorInstructions, JNKVV Jabalpur and constituent college/units of JNKVV whose addresswill be found in Purchase order.

20. JNKVV Jabalpur reserves the right to make any amendment in the above terms andconditions in the interest of library and the same will be binding on suppliers.

21. If there is any discrepancy or inability to complete orders in time the same should beintimated immediately to the Central Library and constituent college/ units of JNKVVJabalpur.

22. It would be obligatory on the supplier to ask the publisher of the journal to provide onlineaccess to the journal free of charge on following IP addresses, if it is available tosubscribers, against the print copy.

The Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) shall be entitled to terminatethis agreement on one month’s notice in writing to the Bidder without assigning anyreason whatsoever and so on such termination the Bidder shall refund to the JawaharlalNehru Krishi Vishwa Vidyalaya (JNKVV) all the proportionate amounts of thesubscription for the period which may remain unexpired;

Terms and Conditions for e-Books and e- Journals.

1. RBI Conversation rate should be applicable on the date of billing.

2. One time purchase of e-books / e- journals will be done.

3. No annual processing charges/Maintenance charges will be paid by the University.

4. e-Books/ e- Journals should be free from DRM restriction.

5. Selections on the basis of pick and chose model.

6. Access shall be provided through IP Authentication and ID- Password based

7. Access should be unlimited, concurrent, unlimited downloads and content should be

perpetual access within the institutions campus should be provided.

8. The firm should provide Publisher authorization certificate in the name of the

University.

9. Activation should be made within 2 days after the contract sign.

10. Only latest/revised edition of the e-books have to be supplied unless otherwise

mentioned.

11. E-books/ e- journals available through CeRA should not be quoted. Also the firm

should provide the same on the company letter head.

12. The firm is requested to ensure the compliance of the order for the subscription of e-

books/e-journals in electronic format immediately. The subscription should be

registered in the name of Director Instructions, JNKVV Jabalpur.

13. Soon after sending the aforesaid documents, you are requested to inform us about our

subscription/activation. Please take immediate necessary action to get the accessibility

of aforesaid electronic package activated at above mentioned static IPs.

14. The publishers/ Aggregator /vendors/ dealers/distributor will have to enter with anagreement with Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) as mentioned inAnnexure I & submit bank guarantee bond as mentioned in Annexure II.

Form of Agreement to be executed in case where Advance Payments are made to Biddersfor supply of Indian/Foreign Journals/ e-books/ e-journals etc.

THIS AGREEMENT made this on date ------------------------------------ between JawaharlalNehru Krishi Vishwa Vidyalaya (JNKVV) of one part and the ----------------------------------------- ---------------------------------(Name and address of the publishers/ book Bidders/vendors/dealers/distributor (hereinafter called the Bidder) of the other part.

WHEREAS the Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) have appointed theBidder to supply the Journals fully mentioned in this agreement to be supplied to theJawaharlal Nehru Krishi Vishwavidyalaya (JNKVV) for a period of ONE YEAR w.e.f. fromthe -------------.

AND WHEREAS the Bidder have agreed to supply to the Jawaharlal Nehru Krishi VishwaVidyalaya (JNKVV) such Journals; now it is hereby agreed and declared by and made betweenthe parties herein to as follows :-

1. The publishers/ book Bidders/vendors/ dealers/distributor shall supply to the JawaharlalNehru Krishi Vishwa Vidyalaya, Jabalpur (Copies of all issues, of Journals full detailsof which are given in the list annexed hereto as Annexure-III within a reasonable timeof the publication thereof by the respective publishers.

2. The Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) shall pay to the publishers/book Bidders/vendors/ dealers/distributor in advance of the annual subscription of thesaid Journals;

3. In the event of any of the copies of the said Journals being lost in transit or in the eventof the Bidder failing to supply any such copies after their publication for any reasonwhatsoever, the publishers/ book Bidders/vendors/ dealers/distributor shall replace allsuch copies as may have been lost in transit or, as the case may be, supply to theJawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) any copies which they havefailed to supply to the Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) withoutany extra charge on receipt of the intimation in this behalf;

4. If the Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) decides not to subscribeany one or more of the aforesaid Journals, the Jawaharlal Nehru Krishi VishwaVidyalaya (JNKVV) shall give to the Bidder one month’s notice in writing intimatingto the Bidder such identification of the Jawaharlal Nehru Krishi Vishwa Vidyalaya(JNKVV) and the Bidder shall on the expiry of the said notice refund to the JawaharlalNehru Krishi Vishwa Vidyalaya (JNKVV) proportionate amount of the unexpiredperiod;

5. The Jawaharlal Nehru Krishi Vishwa Vidyalaya (JNKVV) shall be entitled to terminatethis agreement on one month’s notice in writing to the Bidder without assigning anyreason whatsoever and so on such termination the Bidder shall refund to the Jawaharlal

In the event of any question, dispute or difference arising under or out of or inconnection with these presents or touching or concerning the construction, meaning,operation, or effect thereof any matter contained therein or as to the rights, duties orliabilities of the parties here to respectively however in connection with these presents(except as to matters the decision of which is herein before specially provided for ) thesame shall be referred to the sole arbitration of any person appointed by the JawaharlalNehru Krishi Vishwa Vidyalaya (JNKVV) of India administratively dealing with thecontract at the time of such appointment, of if there by no secretary the AdministrativeHead of such Department at the time of such appointment. It will be no objection to anysuch appointment that the person appointed is a Jawaharlal Nehru Krishi VishwaVidyalaya (JNKVV) Servant that he had to deal with the matters to which thesepersonts relate, and that in the course of his duties as such Jawaharlal Nehru KrishiVishwa Vidyalaya (JNKVV) Servant he has expressed views on all or any of thematters in dispute or difference. The award of the arbitrator so appointed shall be finaland binding on the parties to these parents.

7. It is a term of these presents that in the event of such arbitrator to whom the matter isoriginally referred being transferred or vacating his office or unable to act for anyreason, such Administrating head as aforesaid at the time of such transfer, vacation ofoffice or inability to act, shall appoint an another person to act as arbitrator inaccordance with the terms of these parents. Such person will be entitled to proceed withthe reference from the stage at which it was left by his predecessor. It is also a term ofthese presents that no person other than a person appointed by the Jawaharlal NehruKrishi Vishwa Vidyalaya (JNKVV) as aforesaid should act as arbitrator and if for anyreason that is not possible, that the matter is not to be referred to arbitration at all.

Subject as aforesaid of the Indian Arbitration Act, 1940 shall apply to the arbitrationproceeding under this clause. The venue of the arbitration proceeding will be such place as thesole arbitrator may decide.
