21. Eligibility Criterion

The tenderer should possess all requisite licenses, registrations etc., and the same should be obtained invariably before transacting business with TTD.

The tenderer should inform TTD, the correct address from where the supplies are going to be

made to TTD. The tenderer should possess an experience certificate and other Certificates like Registration of Firm if applicable, CST/VAT,

registration, Latest Income Tax returns, In case of non-submission of these certificates, the TTD

authorities reserve the right to take any appropriate action including the cancellation of tender of the respective tenderer. In this regard the decision of

the Tender Opening Authority / The Executive

Officer is final and binding on the tenderers

without any recourse.

Procedure for Bid Submission

1. Bids shall be submitted online .

2. The participating bidders in the tender should register themselves on e-procurement platform in

the website www.eprocurement.gov.in (OR) https://tender.eprocurement.gov.in

3. The bidders who are desirous of participating in

e-procurement shall submit their technical bids, financial bids as per the standard formats

available at the e-market place. The bidders should scan and upload the below mentioned documents.

a. EMD in the form of Demand Draft payable in favour of the Executive Officer, TTD, Tirupati at any of the scheduled bank branches for the

amounts indicated in tender document and it should be scanned and uploaded at the time of

Tendering. b. Copy of CST registration. c. Copy of PAN card and Income Tax returns

d. Letter towards authorized signatory to sign and submit bid in the case of Dealers etc,

e. COPY OF Registrations of the Agency / traders /

Distributors / manufacturers. f. Copy of VAT Registration.

g. Declaration to the extent that they have not been black listed in any of the organizations

4. Transaction fee on eProcurement Platform: All the participating bidders shall pay a transaction fee (non-refundable) as mentioned in

the NIT(Notice inviting tender) payable to A.P.T.S, Hyderabad and through on line. (0.03%

of estimate contract value + 14.5% service tax).It is mandatory for all the participant bidders from 1st January 2006 to pay a Non-refundable

Transaction fee electronically to A.P.T.S, Hyderabad., the service provider through

"Payment Gateway Service on e-Procurement platform".

The Electronic Payment Gateway accepts all

Master and Visa Credit Cards issued by any bank and Direct Debit facility/Net Banking

of ICICI Bank, HDFC, Axis Bank to facilitate the transaction. This is in compliance as per G.O.Ms. 13 dated

07.05.2006. A service tax of 14.5% + Bank Charges for Credit Card Transaction of

2.09%(inclusive of service tax) on the transaction amount payable to A.P.T.S, Hyderabad shall be applicable.

5. Corpus Fund: As per GO MS No.4 User

departments shall collect 0.04% of ECV (estimated contract value) with a cap of

Rs.10,000 (Rupees ten thousand only) for

all works with ECV upto Rs.50 crores, and Rs.25,000/- (Rupees twenty five thousand

only) for works with ECV above Rs.50 crores, from successful bidders on e-Procurement platform before entering

into agreement / issue of purchase orders, towards e-procurement fund in favour of

Managing Director, A.P.T.S,YDERABAD.

PROCEDURE FOR BID SUBMISSION ON e-Procurement PLATFORM (e-Tendering):

1. The bidder shall submit his response through Bid submission to the tender on e-Procurement platform at “www.eprocurement.gov.in” by following the procedure

given below. The bidder would be required to register on the e-procurement market place www.eprocurement.gov.in (or) https://tender.eprocurement.gov.in and

submit their bids online. Offline bids shall not be entertained by the Tender Inviting Authority for the tenders published in e-procurement platform.

2. The bidders shall submit their eligibility and qualification details, Technical bid, Financial bid etc., in the online standard formats displayed in e-Procurement web

site. The bidders shall upload the scanned copies of all the relevant certificates, documents etc., in support of their eligibility criteria/technical bids and other certificate/documents in the e-Procurement web site. The bidder shall sign on the

statements, documents, certificates, uploaded by him, owning responsibility for their correctness/authenticity. The bidder shall attach all the required documents for the

specific tender after uploading the same during the bid submission as per the tender notice and bid document.

Hard copies:

scheduled date and time of the opening of the Technical bid, otherwise the tender will be rejected on online.

ii) All the bidders shall invariably upload the scanned copies of Demand Draft

in e-Procurement system and this will be the primary requirement to consider the bid responsive.

iii) The department shall carry out the technical evaluation solely based on the

uploaded certificates/documents, Demand Draft towards EMD in the

e-Procurement system and open the price bids of the responsive bidders after evaluation of technical bids and results of the samples.

iv) The department will notify the successful bidder for submission of original

hardcopies of all the uploaded documents Demand Draft towards EMD prior

to entering into agreement.

v) The successful bidder shall invariably furnish the original Demand

Draft towards EMD, Certificates/Documents of the uploaded scan copies to the Tender Inviting Authority before entering into agreement, either personally (or)

through courier (or) post and the receipt of the same within the stipulated date shall be the responsibility of the successful bidder. The department will not take any responsibility for any delay in receipt/non- receipt of original

Demand Draft towards EMD, Certificates/Documents from the successful bidder before the stipulated time. On receipt of documents, the department shall

ensure the genunity of the Demand Draft towards EMD and all other certificates/documents uploaded by the bidder in e-procurement system. In support of the qualification criteria before concluding the agreement.

6. The G.O. Ms. No. 174 –I & CAD dated: 1-9-2008 Deactivation of Bidders If any

successful bidder fails to submit the original hard copies of uploaded certificates/documents, Demand Draft towards EMD within stipulated time (or) if any

variation is noticed between the uploaded documents and the hardcopies submitted by the bidder, as the successful bidder will be suspended from participating in the tenders

on e-Procurement platform for a period of 3 years. The e-Procurement system would deactivate the user ID of such defaulting bidder based on the trigger/recommendation by the Tender Inviting Authority in the system. Besides this, the department shall invoke

all processes of law including criminal prosecution of such defaulting bidder as an act of extreme deterrence to avoid delays in the tender process for execution of the

development schemes taken up by the government. Other conditions as per tender document are applicable.

7. The bidder is requested to get a confirmed acknowledgement from the Tender Inviting

Authority a proof of Hardcopies submission to avoid any discrepancy. 8. Payment of Transaction Fee:

It is mandatory for all the participant bidders from 1st January 2006 to electronically pay a Non- refundable Transaction fee to “APTS, Hyderabad”, the service provider through "Payment Gateway Service on E-Procurement platform". The

Electronic Payment Gateway accepts all Master and Visa Credit Cards issued by any bank and Direct Debit facility/Net Banking of ICICI Bank, HDFC, Axis Bank to facilitate the transaction. This is in compliance as per G.O.Ms. 13 dated 07.05.2006. A service

tax of 14.5% + Bank Charges for Credit Card Transaction of 2.09%(inclusive of service tax) on the transaction amount payable to A.P.T.S, Hyderabad shall be applicable.

9. Corpus Fund:

10.Tender Document:

The bidder is requested to download the tender document and read all the terms and conditions mentioned in the tender Document and seek clarification if any from the Tender Inviting Authority. Any offline bid submission clause in the tender document could be neglected.

The bidder has to keep track of any changes by viewing the Addendum/Corrigenda issued by the Tender Inviting Authority on time-to- time basis in

the E-Procurement platform. The Department calling for tenders shall not be responsible for any claims/problems arising out of this.

11. Bid Submission Acknowledgement:

The bidder shall complete all the processes and steps required for Bid submission. The system will generate an acknowledgement with a unique bid submission number,

after completing all the prescribed steps and processes by the bidder. Users may also note that the bids for which an acknowledgement is not generated by the e-procurement

system are treated as invalid or not saved in the system. Such invalid bids are not made available to the Tender Inviting Authority for processing the bids. The T.T.Devasthanams and A.P.T.S, HYDERABAD are not responsible for incomplete bid

submission by users.

for a period of one year to S.V. Gosamrakshana shala, TTD, TIRUPATI-517 502.

ANDHRA PRADESH, INDIA.

1. Online (e-Tendering) tenders are invited for procurement of Veterinary Drugs & Medicines to S.V. Gosamrakshana Shala, TTD for a period of one year w.e.f. 01-04-2016 to 31-03-2017. The T.T.D. is desirous to have this tender in two bids i.e., (1) Technical bid and (2) Financial bid and also desirous to procure the same from more

than one tenderer if needed. The tenderer should have been in this trade for not less than One year during the last three years and should have supplied bulk quantities to

any reputed institution or institutions as the case may be. A copy of the certificate issued by the authorities under Shops and Establishments Act and a copy of the supply / purchase order for having supplied bulk quantities, have to be scanned and uploaded

for technical bid evaluation by TTD. All Tenderers should submit the attested copies of all scanned and uploaded certificates on online including ORIGINAL EMD to the Tender

Inviting Authority on or before scheduled date and time of opening of the Technical bid as mentioned in NIT. The decision of competent authority is final and binding on the Tenderers without any recourse. The financial bids of those tenderers who are

technically qualified will be opened on the date and time as mentioned in the NIT by the Director, S.V. Gosamrakshana Shala, TTD or any other officer authorized by the

Executive Officer, T.T.D., Tirupati. Tenderers, may choose to be present during online bid opening or they may view the status of bid opening online. The T.T.D. may extend the last date by issuing an amendment in which case all rights and obligations of the

T.T.D. and the tenderers previously subject to the original deadline will then be subjected to the new deadline. SUBMISSION OF TENDER DOCUMENTS OFFLINE

WILL NOT BE CONSIDERED.

2. The technical bid evaluation will be done by the committee of officers from TTD.

3. The tenderers has to keep the EMD in a separate cover duly mentioning tender for Veterinary Drugs and Medicines separately on the tender date as per NIT. Only one rate shall be quoted in the Tender on online.

4. Items and Quantity mentioned as per the NIT Document is tentative only and is Subject

to changes as per the requirement of the Director, S.V.Gosamrakshana Shala, TTD, Tirupati.

5. a) An amount of Rs. 75,000/- is to be drawn, towards Earnest Money Deposit(EMD) by

way of an Demand draft drawn in favour of “the Executive Officer, T.T.Devasthanams, Tirupati”, payable at Tirupati on any scheduled bank. Security

Deposit @ 2.5% of will be deducted in each and every supply bill. The EMD and Security Deposit will be released only after successful completion of the supply in all

respects. The EMD and S.D. will not carry any interest.

b) The EMD will be returned to the unsuccessful tenderers only after the finalization of tenders.

c) After finalization, if a tenderer qualifies for only some of the drugs and if the total EMD

falls below the EMD submitted by the tenderer, then a fresh EMD will be accepted from the tenderer and the EMD submitted at the time of tender will be returned. The new EMD will be returned only after the completion of the supply period / tender

period.

6. The items i.e. Veterinary Drugs and Medicines should be supplied as mentioned in unit

packages. TTD, reserves the right to reject the material stock if the supplies are not made strictly as per the mentioned unit quantities (see Annexure).

8. GENERAL INFORMATION:

Tenderer is required to sign the declaration on tender forms in duplicate indicating date and affixing the rubber stamp with the designation or status enjoyed by the

signatory in the firm, and the same signatory shall be required to execute agreement under his signature only. The signatory should produce documentary evidence of

empowering him to do so, if called upon at any time during the contract period. In case of change of the person of the signatory it is bound on the Tenderer to inform the changes to the Director, S.V. Gosamrakshana Shala, TTD, Tirupati.

a) Tenders which are not in accordance with the eligibilities and procedures

mentioned shall be rejected.

b) Tenderers submitting tenders shall be considered only on acceptance of all the

terms and conditions defined by the department. No enquiries, verbal or in written, shall be entertained in respect of acceptance or rejection of the tender.

c) Any action on the part of the Tenderer to influence anybody in the said institute, will be taken as an offence, and they will not be allowed to participate in the tender

enquiry and their offer will not be considered.

d) The Tenderer’s must quote only to the specifications.

9. TENDER PRICES:

I. ONLY ONE RATE SHOULD BE QUOTED AND The Rate should be inclusive of

all applicable Taxes. AND Frieght on ROAD(F.O.R) DELIVERY TO Director, S.V.Gosamrakshana Shala, TTD, Tirupati in good quality.

II. Rates quoted in the tender (s) should be valid for acceptance for a period of THREE

(03) months from the last date fixed for the receipt of tenders (or) for the extended

period as desired by TTD in addition to the period of 90 days in the event of his offer

being accepted. Once the rate is accepted the successful Tenderer shall not withdraw from the contract. The request of the supplier will not be entertained for increase of rates if any tax structure changes after the tender.

10. SUPPLY:

a) Supply and delivery should strictly comply / confirm to the schedule given by the Director, S.V.Gosamrakshana Shala, TTD, Tirupati.

b) The supply is meant for the sacred animals in S.V. Gosamrakshana Shala and S.V. Gosamrakshana Trust, TTD, Tirupati.

c) In the event of delay or default in supply and the supplies not adhering to the schedule given, the T.T.D. reserves the right to procure the requirement from the other sources and recover the excess cost, if any incurred by T.T.D., from the

approved tenderer. However, if the rate is cheaper, the benefit will not accrue to the respective approved tenderer. The T.T.D. reserves the right to either reject the

entire lot or impose cut or forfeit the E.M.D. and Security Deposit at its discretion, if inferior quality goods or broken goods are supplied. In this regard, the decision of Executive Officer, TTD or the Director, S.V. Gosamrakshana Shala, TTD, Tirupati

shall be final and binding on the supplier. The quantum of cuts imposed shall be final binding on the supplier. The cuts will be imposed on the physical verification of the

supply received.

11. T.T. Devasthanams reserves the right to cancel the tender at any stage without

assigning any reason thereof. 12. OPENING OF TENDERS:

Tenders will be opened online at the defined time and date as mentioned in the NIT. The financial bid will be opened after evaluation of Technical bid.

13. The S.D.@ 2.5% will be recovered from the payment , which will be released after the

successful completion of the supply in all respects. The EMD & SD will not carry any

interest.

14. Rates quoted should be F.O.R. delivery as per schedule of supply by the Director S.V.Gosamrakshana Shala and should be inclusive of taxes such as Excise duty,

Sales tax, VAT etc., and charges for packing, forwarding, fright, etc., Central sales tax applicable if any. ‘C’ or ‘D’ form will not be issued by T.T.Devasthanams.

15. The tender deciding authority reserves the right to accept or reject any Tender or all the

tenders or part thereof without assigning any reasons therefore and also to split the tender into parts or increase or decrease the quantities at the time of issue of final

orders.

16. The materials should be supplied in conformity with the unit packages mentioned. The

materials not in accordance will be rejected.

17. The price quoted shall be valid for a period of 3 months from the date of opening of

tender.

18. The materials should be supplied as per schedule mentioned by the Director, S.V. Gosamrakshana Shala, TTD, Tirupati.

19. The Medicines supplied should have minimum of 12 months shelf life / expiry date from the date of supply of drugs to TTD except for vaccines. The Medicines supplied should

be with out adulteration. If adulteration is noticed in the Medicines the supplier will be prosecuted besides blacklisting the firm and forfeiting the EMD and SD.

20. The drugs are indented based on forecast for future needs. If the drugs are under utilized and / or nearing to expiry, the supplier must replace the same drug with fresh

stock or any other approved needy drugs for the approved price without adhering to the total quantity.

21. The Drugs will be indented 15% excess or less quantity or stop indenting as the

situations warrants, on the same terms & conditions even after the tender period completed and it is binding on the supplier without any recourse.

22. The rate contract may be renewed at the discretion of TTD depending upon the quality and prices etc., and in this regard the decision of the Director, S.V. Gosamrakshana

Shala, TTD and Executive Officer, TTD, shall be final and binding on the supplier. The supplier as a matter of right cannot ask for the renewal of the contract.

23. Penal clauses of the supplier whatsoever like payment of interest on late payment of

bills etc. shall not be acceptable to TTD.

24. If at any time, during the period of contract the price of quoted items is reduced or

brought down by any law or by an act of the central or State Government or by the supplier himself, the supplier shall be morally bound to inform the Executive Officer/ Director, S.V. Gosamrakshana Shala, TTD, immediately about such reduction in the

contract price or prices.

25. Each supply should be accompanied by a claim / bill in triplicate, advance stamped

receipt for arranging payment. The standard payment terms of TTD are applicable. No advance shall be paid by TTD against the order. The payment to suppliers shall be made by TTD only through online / cheques.

26. The tender accepting Authority ie., the Executive Officer, TTD., reserves the right either to reject any or all tenders without assigning any reason. In this regard the decision of

TTD., is final and binding on the tenderer without any recourse. Further, it is understood by both the parties to the tender and is specifically accepted by the tenderer when the tenderer files the tender before TTD, the acceptance or rejection of the tender

by TTD., or methodology adopted by TTD., in short listing the companies for the supply of material/materials etc., shall not become a cause of action or ground to initiate any

legal action before any Court or Courts of Law for obtaining any order, Injection, Direction etc., from the Hon’ble court or Courts to stall the proceedings in TTD.

27. The VAT/CST payable where enviable and intended to be claimed from TTD should be

distinctly shown along with the price quoted. Since the rate quoted is inclusive of VAT/CST payable. No claim for VAT/CST payable will be admitted at a later stage and

on any ground whatsoever, irrespective of the supplier mentioning and recording anything contrary to the above in the Tender.

28. After the implementation of VAT and even after any changes contemplated in the tax structure and the rate of taxes to be levied by the State Government, the rates quoted to

T.T.D., should be constant and it should be applicable to all supply orders placed by TTD, throughout the Tender period.

29. The successful tenderer should furnish copies of registration of firm if applicable, C.S.T./VAT registration, Sales Tax registration and Latest Income Tax Assessment order along with the invoice of the first supply, if not enclosed along with the tender and

if TTD has consciously accepted the non- submission of documents along with the tender.

30. T.T.D. reserves the right to charge penalty as decided by the Executive Officer / Director, S.V. Gosamrakshana Shala, TTD., or withhold payment for any unsatisfactory material supplied by the supplier without prejudice to its other rights. In this regard, the

decision of Executive Officer / Director, S.V. Gosamrakshana Shala, TTD., is final. The supplier is further liable to reimburse / compensate the TTD or to third party for any loss,

damage, injury, harm etc., caused or arising out of the negligence in supply of low quality materials, or any other act or breach of contract.

31. Not withstanding anything contained in the terms and conditions of this Tender the

Director, S.V. Gosamrakshana Shala, TTD is the ultimate authority in deciding the recovery of percentage of penalty from the supplier taking in to account the stock

position and future requirement of the supply in the larger interest of the organization. The reasons for such non recovery of percentage of penalty if any has to be recorded in writing by the Director, S.V. Gosamrakshana Shala, TTD and has to be duly got

approved by the appropriate authority before releasing payment to the Contractor /Supplier.

32. The tenderer whose tender has been accepted will be informed about the award of the contract by the authorities prior to the expiration of the validity period by e-mail / facsimile and will also be confirmed by a registered letter.

33. Shortage and breakages will be intimated to the suppliers and the equivalent amount will be deducted from the bill amount, if they are not replaced by the supplier.

34. The prices quoted shall be firm and fixed from the date of submission of tender to the date of completion of the contract of supply in all respects. ANY REQUESTS FOR REVISION IN THE RATE OR RATES BY THE SUPPLIER SHALL NOT BE

ENTERTAINED DURING THE TENDER PERIOD.

35. The successful Tenderer has to enter into an agreement agreeing to all the conditions

of the contract with the T.T.Devasthanams on Non-judicial stamp paper of value of Rs.100/- within 15 days from the date of receipt of the intimation to him that his TENDER has been accepted. The format of agreement shall be supplied to the approved supplier

along with the communication of accepting the rates quoted.

36. If the successful tenderer fails to execute the agreement within the time specified or

withdraw the tender after the intimation of the acceptance of his tender by TTD or he is unable to undertake the contract due to any other reason, his contract will be cancelled and his E.M.D. shall be forfeited and he will also be liable for all damages sustained by

the TTD. by reason of breach such as failure to supply/delayed supply including the liabilities to pay differences between the prices accepted by him and those ultimately

paid for the procurement of the commodity. Such damages shall be assessed by the Director/E.O., TTD., whose decision shall be final and shall be binding on the supplier.

37. The supplied material should be without deviation from the parameters. If any deviation

is noticed in the material supplied, the supplier will be prosecuted besides blacklisting the firm and forfeiting the Earnest Money Deposit and Security Deposit. The TTD., also

reserves the right to levy additional “Composite penality” at 5% on the total value of the material supplied to TTD by the supplier in case of what so ever quality problems encountered by TTD in supply of the material and if the decision is taken to return /

reject the material to the supplier. In this regard the decision of TTD is final. In case of failure to remove the rejected goods from the TTD Godowns, TTD., reserves the right to

charge ground rent from the supplier as per the situation & Warranty.

38. For breach of any of the above Tender Conditions, the E.M.D. and Security Deposit are

liable to be forfeited duly blacklisting the Firm. Further, Non-performance of any of the contract provisions to the satisfaction of TTD will disqualify the supplier to participate in

the tenders for the next three years.

39. Penalty as may be decided by the tender approving Authority/ Director, S.V. Gosamrakshana Shala will be imposed when the supply is rejected in physical

verification.

40. The TTD reserves the right to add/delete/change/modify any or all the conditions mentioned in the tender schedule and the said addition/ deletion / changes /

modifications can be incorporated in the agreement to be entered into with the supplier irrespective of tender conditions mentioned in the notice inviting tender or in the tender schedule or the same can be incorporated in a form of codicil as the case may be and

the same will be binding on the supplier without any recourse.

41. If any commodity/materials etc. supplied by the supplier have been partially or wholly

used or consumed after supply and are subsequently found to be in bad order, unsound, inferior in quality or description or otherwise faulty or unfit for animal consumption, then the contract price or prices of such items / materials etc., will be

recovered from the supplier, if payment had already been made to him. Otherwise the supplier will not be entitled to any payment what so ever for such supply. For

infringement of the stipulations of the contract or other justified reasons, the contract would be terminated by the Executive officer, T.T.D. and the supplier shall be liable to pay for all losses sustained by the T.T.Devasthanams. In the consequence of the

termination, the loss would be recovered personally from the supplier or other money due or may become due to him. In the event of such amounts being insufficient, the

balance would be recovered personally from the supplier or from his properties.

42. All the materials supplied against the supply order shall be of best quality and shall confirm to the specifications if any given in the supply order or informed to the supplier

as the case may be. Where any commodity is rejected on account of not of best quality or due to non compliance to any other clause of the contract the supplier should

promptly replace the rejected material at the discretion and satisfaction of TTD. All expenditure incurred on account of such replacement shall be entirely borne by the supplier. In case of failure to remove the goods TTD reserves the right to charge

ground rent from the supplier.

43. SUB-CONTRACTING: The contract supply awarded should be executed by the

successful Tenderer only and sub-contract of supply is not permitted.

44. INDEMNITY: The tenderer shall at all times indemnify TTD., against all claims which

may arise in respect of supply of low quality of commodities/material/ items etc., not confirming to the specifications.

45. If the tenderer, in the opinion of TTD, fails or neglects to be complied with any of the terms and conditions of the contract or with any order issued there under then, in such a

case, the TTD shall without prejudice to any other right or remedies under this contract as a right and be entitled to cancel the contract by giving a notice in writing to the supplier without being liable to pay any compensation for such cancellation.

46. The Supplier who apply for this tender has to furnish the declaration that “They have not been black listed in any of the organizations”. Any wrong declaration in this regard

which comes to the notice at a later date will disqualify them from tendering in future in TTD and the tenders so received shall be automatically rejected.

47. No supplier shall be allowed at any time on any ground what so ever to claim revision of

or modification in the rates quoted by him. Clerical error, typographical error etc., committed by the company in the tender schedule form shall not be considered after

opening the tenders. Conditions such as “Subject to Availability” “Supplies will be made as and when supplies are received etc” will not be considered under any circumstances.

48. In the event of any dispute arising out of the tenders such dispute would be subject to

the jurisdiction of the civil courts at Tirupati, A.P.,

49. Tenders, which are not in accordance with the stipulations mentioned, are liable for rejection. Offer with insufficient information and offer, which do not strictly comply with

the stipulations given above, are liable to be rejected. Any tenderer not accepting the conditions mentioned herewith or providing wrong information will be summarily

rejected.

50. Any central or state Sales taxes and other taxes on supplied item of this contract as

may be levied and paid by the tenderer are to be borne by himself.

51. Any conditional tender will be liable for rejection.

52. The bidders are requested to quote their best competitive price, as there are no

negotiations.
