DIWALI – NEW YEAR SNEH MILAN AT CHAMBER

As per our tradition, Diwali – New Year Sneh Milan was held on 31st October, 2016 at Chamber Bhavan.

Large number of members, representatives of the various Associations affiliated with the Chamber,

prominent political leaders, senior officers etc. attended the Sneh Milan and exchanged good wishes for the

New Year.

The Gandhidham Chamber of Commerce & Industry organised a seminar on “GST – A Regime Ahead” on 22nd October,

2016 from 11:00 am onward at Chamber Bhavan wherein experts Mr. Sumit Dutt Majumder, Former Chairman,

Central Board of Excise and Customs & Mr. Shailendra Kumar, Founder & CEO, TaxIndiaonline.com.Pvt.Ltd. (TIOL)

addressed the seminar.

At the outset, Mr. Murlidhar B. Jagani, Hon. Secretary of Chamber welcomed all and Mr. Dinesh Gupta - President &

Mr. Babubhai B. Humbal, Vice President welcomed the guest by presenting bouquet & book.

Mr. Majmuder highlighted importance of GST in Indian economy and narrated its historical journey & development.

The introduction of GST in India has taken more than expected times as broad based consensus has been arrived after

prolonged deliberation among politician, bureaucrats & business fraternity. He explained about four business process

of GST namely (1) Registration (2) Payment (3) Return (4) Refund and its three components i.e. CGST, SGST & IGST.

He said that the whole system of GST is based on operation through electronic portal and it will be essential to punch

all transaction details alongwith uploading of relevant documents mainly, Invoice etc. He stressed the need to accept

and adopt the system with free mind so that least problems will arise. He highlighted the importance of role of

Accountant and specifically professionally qualified CA as well as commerce graduated persons. At the end, he insisted

for mass campaign movements for the awareness of GST.

Mr. Shailendra Kumar narrated about various tax systems adopted from time to time during journey from India’s

independence till to date and briefed the audience about GST’s origin and up & down while creating its road-map for

the implementation in Indian under federal structure of Indian constitution. He highlighted the role of computer and

information technology in implementation of GST regime. He explained about tax compliance and input tax credit

matters. He reminded all that GST council is very much active for final shape up of GST regime and Central Govt. too

is preparing itself for the scheduled implementation of GST w.e.f. 1st April, 2017.

Therefore, an interesting session of Q & A started and both of them gave convincing & satisfactory replies. Due to time

constraints, Mr. Shailendra Kumar expressed his readiness to send reply to remaining questions to be routed through

GCCI. In this connection, Mr. Dinesh Gupta, President of Chamber requested all to send their questions to the

Chamber at the earliest to compile and arrange answers accordingly.

Short News

Global shipping crisis deepens as cargo line NYK

takes multi-billion yen hit

The storm in the global shipping market is showing no

signs of abating with a major Japanese cargo line

warning it will take a multi-billion yen hit. Nippon

Yusen Kabushiki Kaisha (NYK) has warned its half-

year results will take a 195bn yen (£1.5bn) impairment

because of write downs on the value of its ships, and

that it would take a 35bn yen provision for losses on

contracts. NYK is Japan’s largest cargo shipping line by

revenue and said the “prolonged slump in the shipping

market” was to blame for the impairments.

Shipping ministry moves to scrap monopoly policy

for major ports

The shipping ministry is weighing a plan to scrap a

policy that was designed to check the emergence of

private monopoly in terminal operations at state-owned

ports, holding that it was no longer relevant and

continuing with it may deter private investors from

bidding for cargo terminals. READ MORE

GST Hurdles

The third meeting of the GST Council ended last week

without making much headway. After the first two

meetings of the Council, things had appeared to be on

track. Even the opening day of the third meeting looked

promising, but differences soon started cropping up and

the Council had to end its meeting abruptly on the

second day, a day earlier than scheduled, without

reaching a decision on the rates structure. This

development is worrisome. The Centre has set an April

1, 2017 target for the launch of a nationwide GST, and

Benami Transactions (Prohibition) Amendment Act,

2016 (BTP Amendment Act)

Benami Property Transactions Act, 1988 has been

amended by the Benami Transactions (Prohibition)

Amendment Act, 2016 (BTP Amendment Act). The rules

and all the provisions of the BTP Amendment Act shall

come into force on 1st November, 2016. After coming into

effect of the BTP Amendment Act, the existing Benami

Transactions (Prohibition) Act, 1988 shall be renamed as

Prohibition of Benami Property Transactions Act, 1988

The Gazette of India

Stresses the need to continuously move towards

higher standards of excellence

The Cabinet Secretary and the Chairman of the

National Committee on Trade Facilitation (NCTF),

Mr.P.K.Sinha stressed the need to continuously move

towards higher standards of excellence so that the trade

eco system becomes more growth oriented. Shri Sinha

was delivering the Keynote Address in the First

Meeting of NCTF here today. The Meeting was held

pursuant to the establishment of the National

Committee on Trade Facilitation (NCTF) vide order

dated 11thAugust, 2016. NCTF is a mandatory

requirement under Article 23.2 of the WTO Agreement

on Trade Facilitation. Its Secretariat is housed in

Central Board of Excise and Customs (CBEC) in the

Ministry of Finance in the national capital.

Assocham opposes cess in GST

Industry body Assocham has opposed a proposal within

the GST Council to levy an additional cess to make a

corpus for compensation to States for any revenue loss

from GST implementation. Additional cess should not be

made applicable as this would lead to “distortion and

cascading of taxes”, Assocham Secretary-General

D.S.Rawat said in a letter to Finance Minister Arun

GST: A contest of competing truths

often beset with the dilemma of competing truths. In

most cases, policy cannot be easily formulated by

exercising a choice between the “right” policy and the

THE PORTER’S FIVE FORCES TOOL

For the small and big business, managing business effectively is difficult. One of the most essential skills needed

is the ability to assess the competitive environment. The Porter’s five forces tool is a simple but powerful tool for

understanding where power lies in a business situation. This is useful because it helps you understand both the

strength of your current competitive position and the strength of a position you are considering moving into. It is

a simple but excellent for judging exactly where power lies.

There are five important forces that determine competitive power in a business situation:

Supplier Power: One can assess how easy it is for supplies to drive up price of inputs. This is driven by

the number of suppliers of each key input, the uniqueness of their products or service, their strength and

control over you, the cost of switching from one to another and so on. The fewer the suppliers choices you

have and the more you need suppliers’ help, the more powerful your suppliers are.

Buyer Power: One can ask yourself how easy it is for buyers to drive prices down. This is driven by the

number of buyers, the importance each individual buyer to your business, the cost of them of switching from

your products and services to those of someone else and so on. If one has to deal with few powerful buyers

then they are often able to dictate terms. This is the power of customers to drive down the prices.

Competitive Rivalry: This reflects the strength of competition in the industry by the number and

capability of the competitors. If many competitors, have little power to manoeuvre the situation and vice

versa. You will be very powerful if your product or service is unique. If competitors cannot offer what you

provide, you will have immense strength.

Threat of Substitution: The extent to which different products and services can be used in place of your

own. If substitution is easy and substitution is viable, then this weakness your power. This is the degree to

which different products and services can be used instead of your officering.

Threat of New Entry: If one has strong and durable barriers to new entry, then one can preserve a

favourable position and take fair advantage of it else the threat of new entry is how easily new competitors

can enter the market.

A frame work that models on industry / business as being influenced by five forces. One who is seeking to develop

and edge over rival firms can use this model to better understand the industry context in which the firm

operates. It draws upon industrial organisation economies to derive five forces that determine the competitive

intensity and therefore overall industry profitability.

These five forces brought neatly together in a diagram like the below:

Steps To Follow When Performing Analysis Gather information on each forces

Analyze results and display in a diagram

Formulate strategy based on conclusions

Mark the key factor on the diagram and summarize the size and scale of the force on the diagram. An easy way

of doing this is to use, for example, a single ‘+’ sign for a force moderately in your favour, or ‘-’ for a force

strongly against you. Then look at the situation you find using this analysis and think through how it affects you.

Looking at things in this way helps you think through what could change to increase your power with respect to

each force. If you find yourself in a structurally weak position, thus tool helps you think about what you can do to

move in to a stronger one.

The analysis entails thinking about how each of these forces affects your business. You are expected to indentify

the strength of each of the forces. By doing so, you can swiftly assess the strength of your business position. The

analysis of these forces also increases your chances to earn more profit in the industry. After assessing the forces,

you have to find ways to affect the forces with the aim to move the balance of power more in your favours.

Awareness of the five forces can help a company understand the structure of its industry and stake out a position

that is more profitable and less vulnerable to attack.

To sum up, Porter’s Five Forces Model has some major limitation in today’s environment. It is not able to take

into account new business models and the dynamics of markets. The value of Porters model is more that it

enables businessmen to think about the current situation of their industry in a structured, easy to understand

way as a starting point for further analysis.
