"AN ORDER CREATING THE OFFICE OF THE SENIOR CITIZENS AFFAIRS (OSCA) COMPLAINT BOARD, ITS COMPOSITION AND FUNCTIONS "
WHEREAS, Article XIII, Section II of the Constitution provides that the state shall adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost. There shall be priority for the needs of the underprivileged, sick, elderly, disabled, women and children. Article XV, Section 4, of the Constitution further declares that it is the duty of family to take care of its elderly members while
state may design programs of social security for them;
WHEREAS, Republic Act 9994 " An Act Granting Additional Benefits and Privileges to Senior Citizens, Further Amending Republic Act No. 7432, as amended, otherwise known as "An Act to Maximize the Contribution of Senior Citizens to Nation Building, Grant Benefits and Social Privileges and to other Purposes mandates the grant of benefits and privileges to senior
citizens in this country;
WHEREAS, there are persons, natural or juridical who refuse to honor the Senior Citizens Card and to comply with the grant of special disbursement privileges under RA 7432 as amended;
WHEREAS, there is a need to create the Office of Senior Citizens Affairs (OSCA) Complaint Board to address all concerns pertaining to the aforesaid violators and to provide additional services to Senior Citizens;
WHEREAS, DILG Memorandum Circular No. 2006-77 provides the guidelines for the procedure on handling Senior Citizens complaint by the Office of Senior Citizens Affairs;
NOW THEREFORE, I RODRIGO R. DUTERTE, Mayor of Davao City, by virtue of the powers vested in me by law, do hereby order the creation of OSCA Complaint Board with composition and functions as follows,
SECTION 1. The OSCA Complaint Board shall have the following membership:

OSCA Head City Legal Officer City Social Services & Development Officer or his/her authorized/designated representative City Health Officer or his/her authorized/designated
rep. Federation of Senior Citizens Asso., President or
his/her duly designated/authorized representative
SECTION 2. The complaint Board shall have the following functions:

SECTION 3. Secretariat
The OSCA shall act as the secretariat of the Board and shall provide the necessary support of the Complaint Board to effectively and efficiently perform its functions.
SECTION 4. Funding
All incidental and necessary expenses for the effective implementation of this order shall be taken from the Office of the City Mayor or from other available resources.
SECTION 5. Effectivity
This order shall take effect immediately, and shall continue to be in force until revoke.
