INTRODUCTION DUII Control System Performance Measures for Oregon counties has been compiled for your use by the staff of the Transportation Safety Division, Oregon Department of Transportation (TSD-ODOT). It is hoped that the document will aid you in assessing the severity of Driving Under the Influence of Intoxicants (DUII) related problems in your jurisdiction, as well as focusing on components of the DUII system that may need attention. Crashes involving alcohol and/or other drugs account for nearly half of the fatal and serious injury crashes occurring in Oregon each year. Many of these crashes involved youth who were inexperienced both as drinkers and drivers. Though these problems are not unique to the state of Oregon, Oregonians are taking a “hard line” on alcohol and/or other drug-related fatal and injury traffic crashes. Legalized recreational marijuana has further complicated the DUII landscape in Oregon. It has led to new questions about legal limits, identifying impairment and increased access to an intoxicating substance, especially concerning subjects for youth and young drivers. The following page addresses some of these issues in more depth. Additionally, legalized marijuana and DUII have revealed that Oregon’s methods of collecting, sharing and analyzing data between public entities need improvement. Driving Under the Influence of Intoxicants (DUII) is a complex social problem that has origins in both internal and external system factors. Oregon communities and involved agencies must continue to seek improved means of addressing system processes and the public’s knowledge, attitudes and behavior relating to impaired driving. DUII Control System Performance Measures for Oregon counties seeks to present data compiled from a number of state agency sources that may be used in conjunction with alternative sources, such as attitude and perception surveys, to analyze and identify DUII-related problems. With this information, plus input from involved agencies and groups, it is hoped that specific problems may be pinpointed that should be targets for special countermeasure efforts. IMPAIRMENT - ALCOHOL, MARIJUANA AND OTHER DRUGS Impairment from alcohol in Oregon and across the nation has seen a slow steady decline over the years, thanks in part to targeted enforcement; media campaigns; community partnerships; education and awareness, and overwhelming social unacceptability. Alcohol remains the most common impairing substance found in Oregon DUII arrests and fatal and injury crashes. In November of 2014, Oregonians voted to legalize recreational marijuana. Impacts to traffic safety are a serious concern, as DUII crimes from marijuana increased in other states that previously legalized it. Historical data specific to marijuana-impaired driving is in short supply, although preliminary data collected by the Oregon State Police showed a sharp increase (163%) of marijuana DUII’s in the six months following legalization. There was also a 111% increase in DUII’s in the same time where marijuana was shown to be a contributing factor, indicating other impairing substances were also being used. Oregon does not track DUII crimes by the impairing substance, only if a diversion or conviction is related to alcohol or drugs in general. This makes it difficult to understand the problem, recognize patterns and support thoughtful changes when necessary. Especially since historical data does not include marijuana-specific information, it’s hard to predict where the state may go, if we cannot identify where the state was, and compare. Impairment from Alcohol is established two different ways in Oregon. First, impairment can be proved through a series of scientifically validated roadside tests, known as Standardized Field Sobriety Tests (SFST’s). These include the Walk and Turn, the One Leg Stand, and an eye test that shows Horizontal Gaze Nystagmus. Oregon statutes refer to “impairment to a noticeable or perceptible degree,” which can be demonstrated through these tests. Oregon statute has also set a per se limit on Blood Alcohol Content (BAC), meaning that a person can be proven to be impaired if their BAC is 0.08g/ml or higher. This per se number alone is enough to convict a person of impaired driving, even without conclusive evidence from the roadside tests. Both the per se limit of 0.08 and the SFST’s are the result of decades of science, research and validated tests and studies to determine levels of alcohol impairment. Traditionally, a DUII conviction results from a combination of these pieces of evidence in tandem, but a conviction could occur with either one separately. Impairment from drugs can be more challenging to prove. Oregon does not have a per se limit for legalized impairing drugs, specifically marijuana. Some states like Washington and Colorado, that have legalized marijuana, have established a per se limit of 5ng/ml of THC in the blood. This number was not the result of any scientific study and does not account for a myriad of factors unique to marijuana. Marijuana impairment is very different from alcohol impairment, and much more complex. Unlike alcohol impairment, there is no scientifically conclusive number that consistently indicates marijuana impairment from person to person. To that end, marijuana impairment in Oregon is currently determined by establishing presence of the substance in the driver, and by demonstrating impairment through the SFST’s and other studies and observations that can show impairment. Marijuana legalization will undoubtedly lead to more studies and tests that will explore the issues of impairment and the relationship to a scientifically valid per se limit. Currently, the State of Oregon will rely on proving presence, and establishing impairment to a noticeable or perceptible degree.

SYSTEM HIGHLIGHTS · Nighttime fatal and injury impaired crashes have increased by 14.9% from 2,908 in 1998 to 3,415 in

2013. · The percentage of fatalities that were determined to be alcohol-related has decreased from 41.5% in

1998 to 32.2% in 2013. · DUII arrests have decreased 22.9% from 22,485 in 1998 to 17,342 in 2013, while Oregon’s population

increased 14.7% during the same time period. · DUII arrests for drugs (other than alcohol) have increased from 583 in 1998 to 906 in 2013. · DRE evaluations for drug impairment have increased from 840 in 1998 to 1,381 in 2013. · The percentage of implied consent breath test refusals increased from 12.1% in 1998 to 17.1% in

2013. · The average Blood Alcohol Content (BAC) recorded on Intoxilyzers monitored by the Oregon State

Police is 0.15 BAC. The per se limit for impairment in Oregon is 0.08 BAC. · In 2013, Oregon courts and Oregon DMV ordered 15,513 Ignition Interlock Devices (IIDs) to be

installed for drivers convicted of DUII (6,876) or, those participating in a diversion agreement (8,637). However; only 5,436 IIDs were reported installed, totaling 35% of those legally required.

· The number of diversion agreements has decreased from 10,993 in 1998 to 8,632 in 2013. · Thirty percent of first time DUII offenders, who enrolled in diversion from 1998 to 2000, received a

subsequent and separate conviction in the 15 year period following diversion. Of those repeat offenders; 22% are two time offenders; 7% are three time offenders and 1% commit an additional offence four or more times.

· DUII convictions have decreased from 9,630 in 1998 to 8,345 in 2013. The percent of convictions that

were for a third or subsequent DUII has declined slightly from 6% in 1998 to 5.5% in 2013. · The number of treatment enrollments for persons convicted of DUII has decreased from 6,518 in

1998 to 4,937 in 2013. In total for 2013, 11,221 people were enrolled in treatment for DUII, either for a conviction or diversion. This represents 66% of all convictions and diversion agreements.

· Fatalities of youth under 21 years of age have decreased from 121 in 1988 to 38 in 2013. Of those

2013 youth fatalities, 17 (44.7%) were because of impairment. · In 1998, 2,255 juveniles subject to the impaired driving juvenile denial law were denied their driving

privileges. Of the 2,255 juveniles, 79.9% were first denials. In 2013, 2,442 were denied licensing privileges, with 1,778 (72.8%) being first denial.

DUII CONTROL SYSTEM PERFORMANCE MEASURES DUII Control System Performance Measures for Oregon counties is designed to be used by persons familiar with the DUII control system in Oregon. The information presented in this document is intended to provide comparative data on Oregon counties for assessment of DUII-related problems and countermeasure activities. It can also be useful in obtaining support for county traffic safety programs by providing a comparison of the severity of the major traffic safety problems from county to county and with the state as a whole. The seven DUII system areas considered are:

A series of data tables has been constructed to summarize data representative of the DUII system for each county in Oregon. Use the data cautiously and only after you have reviewed the “Document Citations and Notations” contained in the Appendix. Data from different sources and/or different time periods may not necessarily be comparable. In some instances, data tables are missing one or two system elements because the data elements were unknown, unreported, not applicable, or not available. Data can be the basis for a complete analysis of the DUII control system in your county. It can be used to answer such questions as:

· Are fatal and injury crashes increasing or decreasing? · Is the change significantly different than for other similar sized counties or the state as a whole?

Simple statistical techniques such as normalizing data from two different sized populations and performing chi square analysis can make such analyses more meaningful. Chi square analysis is used to determine if the difference between two different occurrences over time, or between one area or another or two or more different data elements, is significant. Other questions might call for relating two or more different kinds of data, such as arrests and convictions. You will find that the data will not only help you answer questions about how the DUII system is operating in your county, but will lead you to raise additional questions. It may encourage you to do additional research. If more detailed data is needed, contact either the source cited or TSD-ODOT. TSD-ODOT staff will assist in helping you secure additional information.
