Page 1 of 39 Dubai First Titanium Life Credit Card Terms & Conditions These Terms and Conditions relate to the Titanium Life credit card from Dubai First. The provisions contained in this document will govern the usage of the credit card (as defined below) issued by Dubai First. In consideration of Dubai First agreeing to make available or continue to make available, the Titanium Life credit card from Dubai First, the Cardmembers agree to be bound by the following Terms and Conditions: 1. DEFINITIONS In these Terms and Conditions where the context so admits the following expressions shall have the meanings herein designated unless otherwise distinguished "ATM" means an automated teller machine or any credit card operated machine, which accepts the Card for the purpose of issuing cash to the credit Cardmember "Bill Payment Centre" (BPC) means any machine designated by Dubai First for the purpose of depositing cash or cheque payments. "Card" means the MasterCard Titanium Life credit card issued by Dubai First to the Cardmember and includes any Primary Card, Supplementary Card and Replacement Card; or "Card Account" means the Card account opened by Dubai First for the purpose of entering all credits and debits received or incurred by the Primary Cardmember and the Supplementary Cardmember, if any, under these Terms and Conditions; or "Cardmember" means the person for whose use the Card issued by Dubai First which includes the Primary as well as the Supplementary Cardmembers. "Card number" means the unique 16-digit number embossed on the face of the Card, which uniquely identifies the Card Account. "Cash Advance" means any cash obtained by the Cardmember obtained from an ATM or otherwise using a Card. "Cash Advance Fee" means the charge detailed in Clause 5.3. "Charges" means any amount payable by the Cardmember arising from the issue or use of the Card (s) or the Card number or the Personal Identification Number (PIN) or otherwise under these Terms and Conditions and includes without limitation, all Transactions, fees, charges, interest, expenses, damages and legal costs and disbursements. "Cheque Deposit Box" (CDB) means any secure box designated by Dubai First for the purpose of depositing cheque payments. "Credit Limit" means the maximum debit balance permitted by Dubai First for the Card Account for the Primary Card and the Supplementary Card, if any, and as notified to the Primary Cardmember from time to time for any Month. "Current Balance" means the total debit balance outstanding on the Card Account payable to Dubai First according to Dubai First‘s records on the date the Statement of Account is issued. "Dubai First" means Dubai First Private Joint Stock Company. "Finance Charge" means the charge referred to in Clause 4.9. "Merchant" means any institution or person supplying goods and/or services who accepts the Card of the Cardmember as a means of payment or reservation by the Cardmember. "Minimum Payment Due" means the payment required to be made by the Cardmember under clause 4.6 hereof. "Month" means Gregorian calendar month.

Dubai First Titanium Life Credit Card Terms & Conditions

These Terms and Conditions relate to the Titanium Life credit card from Dubai First. The provisions contained in

this document will govern the usage of the credit card (as defined below) issued by Dubai First.

In consideration of Dubai First agreeing to make available or continue to make available, the Titanium Life credit

card from Dubai First, the Cardmembers agree to be bound by the following Terms and Conditions:

1. DEFINITIONS In these Terms and Conditions where the context so admits the following expressions shall have the

meanings herein designated unless otherwise distinguished

"ATM" means an automated teller machine or any credit card operated machine, which accepts the Card for

the purpose of issuing cash to the credit Cardmember "Bill Payment Centre" (BPC) means any machine designated by Dubai First for the purpose of depositing

cash or cheque payments. "Card" means the MasterCard Titanium Life credit card issued by Dubai First to the Cardmember and

includes any Primary Card, Supplementary Card and Replacement Card; or "Card Account" means the Card account opened by Dubai First for the purpose of entering all credits and

debits received or incurred by the Primary Cardmember and the Supplementary Cardmember, if any, under these Terms and Conditions; or "Cardmember" means the person for whose use the Card issued by Dubai First which includes the Primary

as well as the Supplementary Cardmembers. "Card number" means the unique 16-digit number embossed on the face of the Card, which uniquely

identifies the Card Account. "Cash Advance" means any cash obtained by the Cardmember obtained from an ATM or otherwise using a

Card. "Cash Advance Fee" means the charge detailed in Clause 5.3.

"Charges" means any amount payable by the Cardmember arising from the issue or use of the Card (s) or

the Card number or the Personal Identification Number (PIN) or otherwise under these Terms and Conditions and includes without limitation, all Transactions, fees, charges, interest, expenses, damages and legal costs and disbursements. "Cheque Deposit Box" (CDB) means any secure box designated by Dubai First for the purpose of

depositing cheque payments. "Credit Limit" means the maximum debit balance permitted by Dubai First for the Card Account for the

Primary Card and the Supplementary Card, if any, and as notified to the Primary Cardmember from time to time for any Month. "Current Balance" means the total debit balance outstanding on the Card Account payable to Dubai First

according to Dubai First‘s records on the date the Statement of Account is issued. "Dubai First" means Dubai First Private Joint Stock Company.

"Finance Charge" means the charge referred to in Clause 4.9.

"Merchant" means any institution or person supplying goods and/or services who accepts the Card of the

Cardmember as a means of payment or reservation by the Cardmember. "Minimum Payment Due" means the payment required to be made by the Cardmember under clause 4.6

hereof. "Month" means Gregorian calendar month.

"Payment Due Date" means the date specified in the Statement of Account by which date payment of the

Current Balance or any part thereof or the Minimum Payment Due is to be made to Dubai First. "Primary Cardmember" means the person to whom Dubai First has issued the Primary Card and for whom

the Card Account is first opened by Dubai First; "Primary Card" means the Card belonging to a Primary Cardmember.

"PIN" means the Personal Identification Number issued to the Cardmember by Dubai First or selected by the

Cardmember by calling Dubai First and using the Interactive Voice Response system (hereinafter referred to as IVR) to enable the Card to be used at an ATM for a Cash Advance or to access any other service through the ATM. "Replacement Card" means a further Card issued to an existing Cardmember to replace an existing Card.

"Statement of Account" means Dubai First‘s monthly or other periodic statement of account sent to the

Primary Cardmember showing particulars of the Current Balance incurred by the Primary Cardmember and the Supplementary Cardmember(s), if any, and payable to Dubai First. "Supplementary Cardmember" means any person to whom a Supplementary Card is issued.

"Supplementary Card" means a Card belonging to a Supplementary Cardmember.

"Transaction" means any Cash Advance or retail transaction of whatsoever nature entered into by the

Cardmember using the Card.

These Terms and Conditions will also include the specific terms and conditions related to

the benefits and services offered to our Cardmembers which are part of the Annexure to

these Terms and Conditions.

Words importing only the singular number shall include the plural and vice versa.

Words importing any gender shall include all genders.

Words importing person shall include a sole proprietor, partnership firm, company,

corporation or other entity.

The headings to the clauses herein shall not be taken into consideration on the

interpretation or instruction of the Terms and Conditions.

2 COLLECTION OF THE CARD

2.1 The Card may be collected by the Cardmember at such location as may be notified to the Cardmember by

Dubai First from time to time or sent by post or sent by courier to the address notified to Dubai First by the

Cardmember at the risk of the Cardmember.

2.2 Upon receipt of the Card, the Cardmember shall call Dubai First on the number specified in order to

activate the Card. The Cardmember shall identify himself and upon request advice of his account number

and any other confidential information that Dubai First may require. The Cardmember consents to the

recording of his telephone call with Dubai First and accepts that such record may be used by Dubai First as

evidence in a court of law or any legal proceeding. The Cardmember‘s signature is proof of delivery and

shall constitute receipt of the Card(s) and such signature and/or activation of the Card shall constitute

binding and conclusive evidence of the confirmation of the Cardmembers to be bound by these Terms and

Conditions notwithstanding that Dubai First is not notified of the Cardmember‘s receipt of the Card.

2.3 Upon receipt of the Card, the Cardmember shall sign the Card immediately and such signature and/or the

use of the Card shall constitute binding and conclusive evidence of the confirmation by the Cardmember to

be bound by these Terms and conditions notwithstanding that Dubai First is not notified of the

Cardmember‘s receipt of the Card. In the event that the Cardmember does not wish to be bound by these

terms and conditions, the Cardmember shall cut the Card in half and return both halves to Dubai First and

Clause 8 hereof shall thenceforth be operative.

2.4 The Card is and will be, at all times, the property of Dubai First and shall be surrendered to Dubai First

immediately upon request by Dubai First or its duly authorized agent. Dubai First reserves the right to

withdraw the Card at its absolute discretion and/or terminate the Card with or without prior notice and in

whatever circumstances it deems fit.

2.5 The Card is not transferable. The Card may not be pledged by the Cardmember as security for any

purpose whatsoever.

3 USE OF THE CARD

3.1 The Card is issued for use in connection with the facilities made available by Dubai First from time to time

at Dubai First’s absolute discretion including, but not limited to the following:

(a) The payment for any purchase of goods and/or services, which payment may be charged to the Card

Account;

(b) Any ATM Transaction effected through the Cardmember‘s other accounts;

(c) Cash Advance, as set out under Clause 5 hereof; and/or

(d) Other facilities, subject to prearrangement with Dubai First, if applicable.

3.2 Where an ATM facility has been incorporated in the Card the Cardmember shall be responsible for all

transactions whether processed with the Cardmember‘s knowledge or by his express or implied authority.

The Cardmember hereby authorises Dubai First to debit his account with the amount of any withdrawal in

accordance with the record of transaction. The Cardmember accepts the record of transaction as

conclusive and binding for all purposes.

3.3 Any BPC/CDB deposits effected through the use of the Card on any BPC/CDB installed by Dubai First,

whether by cheque or by cash, shall be subjected to verification by two Dubai First employees or staff of

outsourced agents whom Dubai First may in its absolute discretion appoint and authorise. The amount so

verified by the said two employees of Dubai First shall be deemed to be the correct amount of the deposits

so affected. Cheque deposits will be accepted for collection only and the proceeds there of shall not be

available for use until the cheque has been collected and cleared.

3.4 Notwithstanding that the Cardmember‘s Credit Limit has not been exhausted, Dubai First shall be entitled

to, at any time and without prior notice and without giving any reason and without liability towards the

Cardmember, withdraw and restrict the Cardmember‘s right to use the Card or to refuse to authorise any

Transaction.

4 PAYMENT

4.1 The Cardmember agrees to pay to Dubai First upon the request of Dubai First the annual membership fee

as prescribed by Dubai First for the Card from time to time and the annual membership fee as prescribed

by Dubai First for each Supplementary Card when issued or renewed. A handling charge, as prescribed by

Dubai First from time to time is payable by the Cardmember to Dubai First immediately upon the request of

Dubai First for the issue of a Replacement Card. Additional charges, as prescribed by Dubai First, are

payable by the Cardmember to Dubai First immediately upon the request of Dubai First for the provision of

copies of sales/cash advance drafts and any further services Dubai First may provide from time to time.

Dubai First may, from time to time, by giving prior written notice to the Cardmember, change the amount of

fees or charges payable by the Cardmember under these Terms and Conditions and the period of time

within which the fees or charges are payable by the Cardmember under these Terms and Conditions. Such

changes shall apply from the effective date specified by Dubai First.

4.2 The Cardmember undertakes to stay within the prescribed Credit Limit assigned/established by Dubai First

for the Cardmember unless prior approval to exceed this Credit Limit is obtained by the Cardmember from

Dubai First and the Cardmember further undertakes to effect no purchases or transactions which may

cause the aggregate outstanding balance of the Cardmember‘s obligations to Dubai First under all such

purchases and transactions along with charges to exceed such Credit Limit. If, in contravention of this

provision, the Cardmember exceeds the Credit Limit, the Cardmember shall, in addition to the amounts

payable under Clause 4.7 hereof, forthwith pay to Dubai First, upon demand by Dubai First, the full sum by

which the Credit Limit is exceeded. In the event of a failure by the Cardmember to pay to Dubai First the

full sum demanded as aforesaid the whole outstanding balance on the Cardmember‘s Card Account shall

become immediately due and payable and the provisions of Clause 8.8 shall be applicable.

4.3 All payments to be made by the Cardmember shall be in the billing currency of the Card Account. If

payment is made in any other currency, the Cardmember shall pay Dubai First all exchange, commission

and other charges or losses charged or incurred by Dubai First in converting such payment to the billing

currency. Such conversion shall be effected at such rate of exchange as may be conclusively determined

by Dubai First as at the date that it is recorded in the Account. Any payment made to Dubai First by the

Cardmember in the billing currency of the Card Account will be credited to the Card Account only on the

date of Dubai First‘s posting of the funds to the Card Account in Dubai and where payment is made in any

currency other than the billing currency, such payment shall be credited after the date when such payment

is converted into the billing currency or when the relevant funds have been received for value by Dubai

First in Dubai and assigned to the Card Account.

4.4 Dubai First shall be entitled to treat the following as evidence of a debt properly incurred by the

Cardmember to be debited to the Card Account:

(a) Any sales draft, transaction record, credit voucher, cash disbursement draft and/or other charge

record bearing the imprint or other reproduction of embossed information printed on the Card and

duly completed; and/or

(b) Dubai First‘s record of Cash Advances or of any other transactions effected by the use of the Card

including but not limited to Transactions effected via mail order or via the telephone or via the

internet.

4.5 Payment of the Current Balance as specified on the Statement of Account in FULL is due and payable not

later than the Payment Due Date and the Cardmember shall incur no Finance Charge if Dubai First

receives payment of the Current Balance in FULL on or before the Payment Due Date. In case

Cardmember makes payment by cheque, the payment is considered as received after the cheque is

cleared and posted to the Card Account on receipt of the cleared proceeds.

4.6 The Cardmember may choose not to settle the Current Balance in full, in which case the Cardmember

must, on or before the Payment Due Date, pay the Minimum Payment Due specified in the statement. The

Minimum Payment Due is calculated as follows:

(a) If the Current Balance does not exceed the Credit Limit the Minimum Payment Due will be an amount

of 10% of the Current Balance plus any unpaid Minimum Payment Due from the previous statement

or AED 100.00 whichever is the greater (hereinafter referred to as "the Minimum Payment Due"); or

(b) If the Current Balance exceeds the Credit Limit, the Minimum Payment Due is calculated as an

amount equal to 10% of the Current Balance plus the excess amount over the Credit Limit, plus any

unpaid Minimum Due from any previous statement; or

(c) If the Cardmember has availed of Easy Purchase Plan then the Minimum Payment Due is as outlined

in clause 20.12.

The Minimum Payment Due shall be subject to the terms of clause 8.7 hereof.

4.7 If the Current Balance at any point of time exceeds the Credit Limit, then the Cardmember will be charged

an Overlimit Fee. The Overlimit Fee will be debited to the Card Account.

4.8 In the event any cheque payment does not clear for whatever reason a Cheque Return Fee will be charged

to the Cardmember Account.

4.9 If the Cardmember pays to Dubai First, by the Payment Due Date, an amount less than the Minimum

Payment Due or equal to or more than the Minimum Payment Due but less than the Current Balance or if

no payment is made then a Finance Charge at the prevailing rate will be calculated on a daily basis and

will be applied to the Current Balance from the date of the last statement until any repayments are credited

to the Card Account or till the next statement whichever is earlier. If in the above instance a payment is

made then for the period till the next statement, additionally a Finance Charge at the prevailing rate will be

calculated on the Current Balance less the payment made from payment date till the next statement date.

4.10 If the Cardmember pays to Dubai First any amount which is in excess of the Credit limit of the Card or the

Current Balance, whichever is higher, then Dubai First retains the right not to process such payments and

to return the payments to the Cardmember. Dubai First also retains the right, in such cases as it deems

necessary, to call such Cardmember to verify reason for such excess payments and to ascertain a

bonafide reason thereof.

4.11 If the Cardmember fails to pay the Minimum Payment Due by the Payment Due Date, a late payment fee,

to be determined by Dubai First from time to time, shall be debited to the Card Account.

4.12 All payments for purchases of goods and/or services and cash advances effected by the use of the Card

and all Charges shall be debited to the Card Account in the billing currency and shall be reflected in the

Statement of Account. Dubai First shall be entitled, at its sole discretion, from time to time to vary the rate

or method of calculation of the Charges. All payments and credits may, unless otherwise decided by Dubai

First, be applied first in payment of any amount which the Cardmember owes to Dubai First, including any

cost, loss or expense or any other amount for which the Cardmember has agreed to indemnify Dubai First

under these Terms and Conditions, secondly towards interest then due and payable under these Terms

and Conditions and finally towards payment of the Current Balance notwithstanding any instructions

regarding application of payments received from the Cardmember.

4.13 Without prejudice to Dubai First‘s rights at any time to take the appropriate legal action, Dubai First will

charge a service fee for any returned unpaid cheques drawn by the Cardmember in full or partial payment

of the Current Balance.

4.14 If a Transaction disputed by the Cardmember is subsequently proven to have been originated by him,

Dubai First retains the right to charge-back, as from the date when the Transaction took place, the

Transaction amount along with a Finance Charge and any additional fees and expenses incurred by Dubai

First in the investigation thereof.

4.15 Dubai First‘s acceptance of late payments or partial payments or cheques or money orders marked as

constituting payment in full or otherwise of the Current Balance or any indulgence granted by Dubai First in

the failure to collect the amounts due from the Cardmember as and when they are so entitled under these

Terms and Conditions shall not operate as a waiver by Dubai First nor modify these Terms and Conditions

in any respect nor prevent Dubai First from later enforcing any of its rights under these Terms and

Conditions to collect the amounts due hereunder.

4.16 The Cardmember hereby expressly agrees that if any sums shall be due from the Cardmember to Dubai

First at anytime under the Card Account or if the Cardmember shall be liable to Dubai First on any Dubai

First account or any other account, current or otherwise, in any manner whatsoever, or if default is made

by the Cardmember in relation to such accounts or any other Dubai First facilities granted by Dubai First to

the Cardmember, then and in such event the whole Current Balance of the Cardmember‘s Card Account

shall become immediately due and payable and the provisions of Clause 8.8 hereof shall be applicable.

4.17 Notwithstanding the exercise by Dubai First of any of its rights hereunder, interest, Finance Charges and

payment charges at the rates stipulated in clauses 4.6, 4.9 and 5.3 hereof shall continue to be chargeable

on any of the sums of money which remain due and unpaid after the exercise of any of Dubai First‘s rights

and in the event that a judgment is obtained in relationship to any sum wherein it is adjudged that any sum

of money be paid to Dubai First, then interest, Finance Charges and late payment charges shall be payable

on such sum of money so adjudged to be payable to Dubai First from the date of such judgment until the

date of full payment thereof.

4.18 Dubai First may in its absolute discretion, demand as a condition for the approval of any application to

obtain a Card, that the applicant deposits an undated cheque, promissory note and/or pledges cash

collateral in favour of Dubai First for any amount which Dubai First may require. Dubai First may, at any

time, demand that the Cardmember deposits an undated cheque and/or promissory note in favour of Dubai

First for the amount which Dubai First may require even where such a cheque, promissory note and/or

pledge of cash collateral was not demanded when the Card was issued to be Cardmember. The

Cardmember has authorised Dubai First to insert the date of the said cheque and to present it for payment

on the inserted date against any amount due to Dubai First. Any cash deposits may only be regarded as

received by Dubai First upon the same being credited to the Card Account.

4.19 Any cheque deposits shall be accepted for collection and the proceeds shall not be available until the

cheque has been cleared and the proceeds paid to Dubai First by the paying bank or financial institution.

4.20 A Cardmember may choose to effect payment by depositing cash or cheques in any of the BPC/ATM

and/or CDB designated by Dubai First. Dubai First shall not be liable for any loss or delay caused by the

use of the BPC/ATM and/or CDB. Cheques deposited at a BPC/ATM and/or CDB shall only be credited to

the Card Account after verification by Dubai First (which verification shall be conclusive and binding against

the Cardmember) and any statement issued on making a deposit shall only represent what the

Cardmember purports to have deposited and shall in no way bind Dubai First as to its correctness.

4.21 The Cardmember agrees that the records of Dubai First of any Transaction effected by the use of the Card

shall be conclusive and binding on the Cardmember for all purposes.

4.22 A Cardmember will not be allowed to transfer funds from one card account to another in settlement of the

dues of a card account.

5. CASH ADVANCES

5.1 The Cardmember may obtain Cash Advances in such amount as may be acceptable to Dubai First, from

time to time at its absolute discretion, by the following means:

(a) Presenting the Card at any member institution of MasterCard, which offers such facility together with

evidence of his identity and signing the necessary transaction record; or

(b) use of the Card at any bank or institution with whom Dubai First has an arrangement for the use of

the ATM (in which case the amount of each advance will be further subject to the applicable daily

withdrawal limit of the ATM). The use of the Card by the Cardmember to obtain a Cash advance

shall be deemed to constitute the agreement of the Cardmember to pay interest on each Cash

Advance and a Cash Advance Fee, as detailed in Clauses 5.2 and 5.3.

5.2 Cash Advance Finance Charge shall accrue on each Cash Advance from the date of the Cash Advance

until repayment or the next Statement of Account whichever is earlier at the prevailing rate. In case a

payment is made prior to the next statement an additional amount of Cash Advance Finance Charge on

the Cash Advance less payment made per month will be applied from the date of the payment till the next

statement date.

5.3 A Cash Advance Fee (as per the applicable schedule of charges) expressed as a percentage of the

amount of each Cash Advance shall be debited to the Card Account for each Cash Advance. Dubai First

may, at its discretion from time to time, vary the amount of the Cash Advance Fee and Cash Advance

Finance Charge payable by the Cardmember to Dubai First.

6 SUPPLEMENTARY CARD/JOINT AND SEVERAL LIABILITIES

6.1 Dubai First may in its absolute discretion issue a Supplementary Card to a person nominated by the

Cardmember and approved by Dubai First. The issue of Supplementary Card(s) shall be subject to such

terms and conditions, which Dubai First may deem necessary.

6.2 All the terms and conditions applicable herein to the Cardmember shall apply mutatis mutandis (that is,

with the necessary changes to the Supplementary Cardmember and for such purpose the terms

"Cardmember" and the term "Card” shall be read and construed as if the terms "Supplementary

Cardmember" and "Supplementary Card", respectively were substituted therefore). Every Supplementary

Cardmember shall be jointly and severally liable with the Primary Cardmember, as defined herein. Both the

Supplementary Cardmember and the Primary Cardmember shall be liable jointly and severally for costs,

for all goods and services and Cash Advances obtained and all Transactions generated by the use of the

Card as well as the Supplementary Card(s). Dubai First may in its absolute discretion commence an action

or proceedings under this subclass against the Primary Cardmember or the Supplementary Cardmember

or both.

6.3 The undertakings, liabilities and obligations of the Primary Cardmember and Supplementary Cardmember

shall not be affected in any way by any dispute or counterclaim or right of set off which the Primary

Cardmember and the Supplementary Cardmember may have against each other. In addition to the

aforesaid, and as a separate undertaking, the Primary Cardmember shall be fully liable to Dubai First for all

Charges and other liabilities incurred by the Primary Cardmember and the Supplementary Cardmember

notwithstanding any legal disability or incapacity of the Supplementary Cardmember, and the Primary

Cardmember shall indemnify Dubai First against any loss, damage, liability, costs and expenses, whether

legal or otherwise, incurred or suffered by Dubai First by reason of any breach of these Terms and

Conditions by the Supplementary Cardmember.

6.4 The Credit Limit assigned to the Cardmember is inclusive of the Credit Limit of the Supplementary

Cardmember and the Primary Cardmember and the Supplementary Cardmember shall not permit the total

of the Charges incurred under or through their respective Cards to exceed the said Credit Limit. In case a

Supplementary Cardmember has been assigned a specific limit that shall constitute the maximum

spending limit on the Supplementary Card. However, this in no way absolves the Primary Cardmember

from being fully liable to Dubai First for all debts incurred by the Supplementary Cardmember.

6.5 The validity of the Supplementary Card is dependent upon the validity of the Primary Card. Upon

termination of the use of the Primary Card or the Primary Cardmember‘s agreement with Dubai First, for

whatever reason, the Supplementary Card(s) issued there under shall also be terminated. Termination of

the Supplementary Card or the Supplementary Cardmember‘s agreement with Dubai First, for whatever

reason, shall terminate the Supplementary Card and Supplementary Card agreement only and shall not

terminate the Primary Card or the Primary Cardmember‘s agreement with Dubai First.

6.6 In the event that the Primary Cardmember requests a maximum Credit Limit on the Supplementary Card,

any such request shall be treated as a preference only and should, for whatever reason the Supplementary

Cardmember exceed such limit, the Primary Cardmember shall remain liable for the additional spending to

the full extent of the outstanding balance.

6.7 Dubai First may disclose Primary Cardmember‘s account or additional information to Supplementary

Cardmember(s) without approval from the Primary Cardmember.

7 LOSS OF CARD/DISCLOSURE OF PIN

7.1 Dubai First may issue a PIN to the Cardmember or the Cardmember may select a PIN via the phone by

calling the Contact Centre (means the Dubai First contact centre) and/or IVR for use at any ATM, which will

accept the Card.

7.2 The Cardmember agrees that the PIN may be sent by post to him at his own risk.

7.3 The Cardmember shall be fully liable to Dubai First for all Transactions made with the PIN whether with or

without the knowledge of the Cardmember.

7.4 The Cardmember shall take all reasonable precautions to prevent the loss or theft of the Card and shall not

disclose the PIN to any party.

7.5 In the event that the Card is lost or stolen or that the PIN is disclosed to any other party, the Cardmember

shall immediately, thereafter, report the said loss, theft or disclosure, together with the particulars of the

Card, to Dubai First and the Police of the country where such loss or theft or disclosure occurred.

7.6 The Cardmember shall be and shall remain to be fully liable for any use of the Card by any person

whether with or without the knowledge of the Cardmember and irrespective of whether they were

authorised by the Cardmember or not.

7.7 Dubai First may at its absolute discretion issue a Replacement Card for any lost or stolen Card or new PIN

on these Terms and Conditions or such other Terms and Conditions as Dubai First may deem fit.

7.8 In the event that the Cardmember recovers the lost or stolen Card, he shall return the same cut in half

immediately to Dubai First without using it. The Cardmember shall not use the PIN after reporting the

disclosure thereof to Dubai First.

7.9 All PIN-based transactions will carry the government or Central Bank Cardmember liability limits, which

Dubai First must comply with and may affect use of the Card. Any Cards and PINs issued will remain the

property of Dubai First.

8 TERMINATION/CONVERSION

8.1 The Cardmember may at any time notify Dubai First of his intention to close the Card Account and

terminate the use of all Cards by giving notice in writing and returning all the Cards, cut in half, to Dubai

First. The Card Account shall be closed only after the receipt by Dubai First of all Cards, cut in half, and the

full payment of the outstanding balance of the Card Account.

8.2 The Primary Cardmember or any Supplementary Cardmember may at any time terminate the use of the

Supplementary Card by giving notice in writing and by returning the Supplementary Card, cut in half to

Dubai First. In such event, all Cardmembers, including the Supplementary Cardmember whose use of the

Card has been terminated, shall be and shall continue to be jointly and severally liable to Dubai First for the

outstanding balance of the Card Account in accordance with these Terms and Conditions, save that the

Supplementary Cardmember, whose use of the Card has been terminated, shall not be liable for Charges

and other liabilities incurred by the Primary Cardmember and any other Supplementary Cardmembers (if

any) after Dubai First‘s receipt of the cut Supplementary Card.

8.3 Dubai First may at any time recall all or any of the Card(s) with or without giving prior notice to the

Cardmember. The Cardmember shall immediately after such recall return such Card(s) cut in half to Dubai

First and make full repayment of the outstanding balance of the Card Account to Dubai First.

8.4 Dubai First shall terminate the use of the Card without notice upon the death, bankruptcy or insolvency of

the Cardmember or when the whereabouts of the Cardmember becomes unknown to Dubai First due to

any cause not attributed to Dubai First. In the event of the Cardmember‘s bankruptcy, death, or insolvency,

the holder(s) of Supplementary Card(s) will immediately cease the use of the Card(s) and return them to

Dubai First.

8.5 The whole of the Current Balance on the Cardmember‘s Card Account together with any outstanding

amount incurred by the use of the Card but not charged to the Cardmember‘s Card Account shall become

due and payable to Dubai First on the termination of these Terms and Conditions by either Dubai First or

the Cardmember or on the death, bankruptcy or insolvency of the Cardmember or (at Dubai First‘s

discretion) if the Cardmember is in breach of these conditions. The Cardmember and/or his estate will be

responsible for the settling of outstanding balances on the Card Account and shall keep Dubai First

indemnified for all costs (including legal fees) and expense incurred in recovering such outstanding

balances.

8.6 Dubai First shall not be liable to refund the annual membership fee or any part thereof in the event of the

termination of the Card Account or the use of any or all of the Card(s).

8.7 Notwithstanding the due dates specified in the Cardmember‘s Statement of Account the whole of the

outstanding balance on the Cardmember‘s Card Account shall become due and payable upon the

occurrence of the following events:

(a) Termination of use of the Card under Clauses 2.4, 8.1, 8.2, 8.3, 8.4, 8.5 and 13.3 hereof; or

(b) Termination of use of the Card by the Cardmember under Clauses 2.3, 8.1 and 15.2 hereof; upon

the termination of the Card, as aforesaid, all Charges, as applicable shall be immediately due and payable

to Dubai First. It is hereby expressly agreed by the Cardmember and Dubai First that all the provisions

contained herein shall continue in full force and effect notwithstanding the termination of the use of the

Card in accordance with the terms of these Terms and Conditions. All further monies debited to the

Cardmember‘s Card Account after termination of the use of the Card aforesaid shall become immediately

due and payable upon their entry into the Cardmember‘s Card Account and all Charges, as applicable shall

also be immediately payable.

8.8 In the event that any security is held by Dubai First as collateral for the issuance of the Card, Dubai First

reserves the right to retain such security for a period of at least seventy five days following the Card being

cancelled and being returned to Dubai First, whether cancelled by the Cardmember or Dubai First, or

following this agreement being terminated for whatever reason.

8.9 Notwithstanding the provisions of Clause 8.8, in the event that the Cardmember does not make any

payments due under the terms of theses Terms and Conditions, Dubai First shall have the right to take

necessary legal action in respect of any security held by it including assigning such security in the name of

Dubai First, of offsetting any outstanding payments with the said security or liquidating the said security.

9 EXEMPTIONS AND EXCLUSIONS

9.1 Dubai First shall not be liable for any loss or damage howsoever incurred or suffered by the Cardmember

by reason of Dubai First or a Merchant or other bank or financial institution or any ATM or other party

refusing to allow a Transaction or accept the Card or the Card number or the PIN or to provide Cash

Advances up to the Credit Limit or at all.

9.2 Dubai First shall not be responsible for the refusal of any Merchant or member institution of MasterCard

Worldwide to honour or accept the Card or for any defect or deficiency in the goods or service supplied to

the Cardmember by any Merchant or, where applicable, for any breach or non performance by a Merchant

of Transactions.

9.3 In the event of any dispute between the Cardmember and any Merchant or bank or financial institution or

any other person, the Cardmember‘s liability to Dubai First shall not in any way be affected by such dispute

or any counterclaim or right of set off which the Cardmember may have against such Merchant or bank or

financial institution or person.

9.4 Dubai First will credit the Card Account with the amount of any refund only upon receipt of a properly

issued credit voucher from the Merchant establishment.

9.5 Dubai First shall not be liable in any way to a Cardmember for any loss or damage of whatever nature due

to or arising from the use of a Card or entry into a Transaction or any disruption or failure or defect in any

ATM or other machine or communication system or facilities or data processing system or transmission link

or any industrial or other dispute or any thing or cause, whether beyond the control of Dubai First or

otherwise.

10 CONFIDENTIALITY AND DISCLOSURE OF INFORMATION

10.1 Dubai First agrees and confirms that all information received from the Cardmember including information

pertaining to Card Account(s) and transactions shall be treated as confidential information. No financial

information pertaining to the Cardmember shall be released to any person, entity or business without the

written consent of the Cardmember.

10.2 The Cardmember, however, irrevocably authorizes and permits Dubai First, as it deems fit, and without any

written consent whatsoever, to disclose and furnish such information, including financial information,

concerning the Cardmember and its affairs, including, but not limited to, the account of the Cardmember

under these Terms and Conditions to Dubai First‘s subsidiaries, affiliates, associates, branches,

assignees, agents or other parties authorized by Dubai First to enable Dubai First to enforce the

Cardmembers obligations under these Terms and Conditions, both in the UAE and outside the UAE. The

Cardmember also irrevocably authorizes and permits Dubai First to disclose and furnish such information,

without any prior consent in case there are any proceedings brought by Dubai First against the

Cardmember, or by any third party against the Cardmember in respect of the Cardmember‘s Card

Account(s) or transactions with Dubai First or in case of any proceedings by third party against Dubai First

in relation to the Cardmember‘s Card Account(s) or transactions with Dubai First. The Cardmember also

irrevocably authorizes and permits Dubai First to disclose and furnish such information, without any prior

consent when a court or other government or official entity demands financial information pursuant to any

proceedings or in compliance with any law or order being validly passed by such authority. The

Cardmember authorizes the release of information in the cases mentioned above without the need for prior

consent or approval or notification in any manner whatsoever.

10.3 Dubai First shall have the right to check the credit standing of an applicant for the Card and/or the

Cardmember under any circumstances whatsoever, whether or not such circumstances relate to or arise

out of these Terms and Conditions, including, but not limited to, the non acceptance, for any reason

whatsoever, of the Card by any Merchant, person, body, bank or any member institution of MasterCard

Worldwide, rejection of the Card by any ATM, non-renewal, restriction or cancellation of Credit Limits or

facilities, the listing of such Card number or Cardmember in any cancellation list, the failure of the

Cardmember to receive the Statement of Account at the time elected by the Cardmember in the relevant

application form executed prior to or simultaneously with these Terms and Conditions or under any

circumstances where-in Dubai First shall be obliged to act reasonably to protect its rights under the

provisions of these Terms and Conditions.

10.4 The Cardmember consents to the disclosure of the last known address of the Cardmember to any bank or

MasterCard Worldwide or its successors and the disclosure of the Card numbers of the new, renewed or

replaced Cards to Merchants and other interested persons.

11 INDEMNITY

The Cardmember undertakes and agrees to indemnify Dubai First and hold it harmless against any loss,

damage, liability, costs and expenses, whether legal or otherwise, which Dubai First may incur by reason

of these Terms and Conditions or any breach thereof or the enforcement of Dubai First‘s rights as herein

provided. All costs and expenses, including legal costs and disbursements on a solicitor and clients basis

incurred by Dubai First in enforcing and seeking to enforce these Terms and Conditions or otherwise, may

be debited to the Card Account and shall be paid by the Cardmember.

12 RIGHT OF SET OFF

12.1 In addition to any general right of set off or other rights conferred by the law to Dubai First, the

Cardmember agrees that Dubai First may in its absolute discretion at any time and without notice, combine

or consolidate all or any account(s) of the Cardmember with Dubai First of whatsoever description and

wheresoever located and whether in Dirham or in any other currency or set off or transfer any sum

standing to the credit of any such account(s) including a joint account with a Supplementary Cardmember

in or toward discharge of all sums due to Dubai First under any account(s) of the Cardmember with Dubai

First of whatsoever description and wheresoever located and whether in Dirhams or in any other currency

and may do so notwithstanding that the balances on such account(s) and the sums due may not be

expressed in the same currency and the Cardmember hereby authorises Dubai First to offset any such

combination, consolidation setoff or transfer with the necessary conversion at Dubai First‘s prevailing

exchange rates which shall be determined by Dubai First at its sole discretion.

12.2 For the purpose of enabling Dubai First to preserve the liability of any party, including the Cardmember,

once a writ or summons or proceedings have been issued to prove the bankruptcy or insolvency of the

Cardmember or, for such other reasons as Dubai First thinks fit, Dubai First may at any time deposit and

retain for such time as Dubai First may think prudent any monies received, recovered or realized thereof

under any other security or guarantee to the credit of the Cardmember, as Dubai First may think fit, and

without any obligation on the part of Dubai First to apply the same or any part thereof in or towards the

sums due and owing.

13 NOTICES

13.1 The Cardmember must promptly notify Dubai First in writing of any changes in employment or business or

address (office or residential) or if the Cardmember intends to be absent from the United Arab Emirates for

more than thirty days.

13.2 If the Cardmember should be absent from the United Arab Emirates for more than thirty days the Card

Account shall be settled within seven (7) days prior to his/her departure.

13.3 If the Cardmember leaves the United Arab Emirates to take up residence elsewhere, any Primary Card

and Supplementary Card(s) shall be returned to Dubai First fourteen (14) days prior to the Cardmember‘s

departure and the use of the Primary Card and Supplementary Card(s) shall be deemed to be terminated

and Clause 8.8 shall henceforth be operative.

13.4 All Cards, PIN, Notices, Statements of Account, demands or any other communication under these Terms

and Conditions (hereinafter collectively called "Communications") may be delivered personally or sent by

ordinary post to the last known billing or other address of the Cardmember and such Communications shall

be deemed to be served on the Cardmember on the day of delivery, if delivered by hand, and on the third

business day after posting if sent by post. All Communications under these Terms and Conditions sent to

the Primary Cardmember or to the Supplementary Cardmember shall be deemed to be Communications

sent to both.

13.5 A Telephone Identification Number (TIN) may be selected by the Cardmember upon proper verification of

the Cardmember by Dubai First. TIN may be used to verify the Cardmember when the Cardmember calls

the Dubai First Contact Centre, IVR or other contact points of Dubai First. The Cardmember will not

disclose the TIN to any person. Dubai First will not be liable for acting in good faith on the Cardmember‘s

instructions and Dubai First is indemnified against any consequences, claims, proceedings or losses that

may arise or incur by reason of carrying out the Cardmember‘s instructions or purporting to be from the

Cardmember.

13.6 Any instructions conveyed by the Cardmember through the Contact Centre and/or the IVR and/or any of

Dubai First branches or contact points shall be deemed valid. Dubai First has the right to record all such

telephonic instructions and may act upon and use such records as evidence in the case of

disputes/complaints or in a court of law or other legal proceedings. The Cardmember consents to such

recording and use of the same by Dubai First. The Cardmember understands that the range of services

provided through the Contact Centre may change from time to time.

13.7 Instructions sent by the Cardmember to Dubai First through facsimile communication shall be considered

valid and binding on the Cardmember and Dubai First may act upon instructions conveyed through this

method. Dubai First may use copies of facsimile transmissions in any Court of Law.

14 GENERAL

14.1 The Cardmember undertakes to sign such further documents as may be requested by the Bank from time

to time with respect to the Card Account. All fees and charges pursuant to or in connection with these

Terms and Conditions are non-refundable.

14.2 Dubai First may from time to time, use the Cardmember‘s contact details and non-financial account

information for internal or external marketing campaigns.

14.3 Dubai First may verify and confirm the applicant‘s credit history with credit bureaux, (if available), as well

as with other institutions that grant credit. Dubai First may inform other credit institutions or credit

information offices regarding the repayment history of the account.

14.4 Time shall be of the essence in these Terms and Conditions but no failure and/or delay in Dubai First‘s

exercise of any right, power or privilege under these Terms and Conditions shall operate as a waiver

thereof, nor shall any single or partial exercise of any right, power or privilege preclude any other or further

exercise thereof of the exercise of any other right, power or privilege. The rights and remedies herein

provided are cumulative and not exclusive of any rights and remedies provided by law.

14.5 Dubai First shall be entitled at any time without the consent of the Cardmember to assign the whole or any

part of its rights, or obligations under these Terms and Conditions with or without notice to the

Cardmember.

14.6 These Terms and Conditions shall be binding upon and inure to the benefit of the respective successors in

title and assigns of the Cardmember and Dubai First provided that the Cardmember shall not assign his

rights and obligation hereunder.

14.7 Dubai First may appoint an agent to collect all sums due to Dubai First from the Cardmember under these

Terms and Conditions.

14.8 From time to time and at its sole discretion Dubai First may offer additional benefits and services relating to

the Card(s) such as travel insurance, purchase protection, travel assistance etc. Such services are offered

on a best effort basis and Dubai First shall have no responsibility for direct, indirect, special, incidental or

consequential damages in the event that they are not provided. Dubai First may modify or discontinue,

and/or impose such charges for these services, as Dubai First shall determine from time to time at its sole

discretion.

15 VARIATION OF TERMS

15.1 Dubai First may from time to time, by giving prior written notice to the Cardmember, change these Terms

and Conditions including, but not limited to, the terms of payment by the Cardmember by way of annual

fees, handling charges, additional charges, Finance Charges, the specified Minimum Payment Due, late

payment fee and over limit fee. Such charges shall apply on the effective date specified by Dubai First and

shall apply to all unpaid interest, fees, Cash Advances, Charges and Transactions.

15.2 Retention or use of the Card after the effective date of any change of Terms and Conditions pursuant to

Clause 15.1 hereof shall be deemed to constitute acceptance of such changes without reservation by the

Cardmember. If the Cardmember does not accept the proposed change, the Cardmember must terminate

the use of the Card by giving prior written notice to Dubai First and return the Card cut in half to Dubai First

prior to the effective date of any such changes and Clause 8.7 hereof shall henceforth be operative. Upon

such termination the annual fee paid is not refundable.

16 WAIVER

No condoning, excusing, neglecting or forbearing on the part of Dubai First of any default or breach of any

of these Terms and Conditions by the Cardmember shall operate as a waiver of Dubai First‘s rights and

powers and no waiver shall be inferred from or implied by anything done or not done by Dubai First unless

expressed in writing by Dubai First. Any waiver shall operate only as a waiver of the particular matter to

which it relates and shall not operate as a waiver or release from any of these Terms and Conditions.

17 SEVERANCE

Each of these Terms and Conditions shall be severally distinct from one another and if at any time any one

or more of such Terms and Conditions is or becomes invalid, illegal or unenforceable, the validity, legality

or enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

18 INTERNATIONAL SERVICE

18.1 From time to time and at its sole discretion Dubai First may offer additional benefits and services relating to

the Card(s), such as a replacement service for Cardmembers travelling abroad. Such services are offered

on a best efforts basis and Dubai First shall have no responsibility for direct, indirect, special incidental or

consequential damages in the event that they are not provided. Dubai First may modify or discontinue,

and/or impose such charges for these services, as it shall determine from time to time and at its sole

discretion.

18.2 The Cardmember consents to Dubai First‘s disclosure, to any of its branches world wide or to any third

party, any information relating in any way whatsoever to the Cardmember or to his Card Account as it

deems fit in its absolute discretion.

18.3 The Cardmember agrees that if he requests the issuance of Dubai First Card from Dubai First branch

located in another country or MasterCard Worldwide (hereinafter known as the "Outside Location"), such

an application is subject to the approval of the Outside Location and the issuance of the Card is an offer,

only, for the Cardmember to accept upon reading and accepting the Terms and Conditions enclosed

therewith and that his signing, activation or usage of the Card shall be his acceptance of such an offer and

that he shall be bound by the said Terms and Conditions.

18.4 The Cardmember authorizes Dubai First to obtain and disclose to the Outside Location all and any

information relating to him or to any of his accounts, that the Outside Location shall, at its sole discretion,

deem necessary for the consideration of such an application by him.

19 GOVERNING LAW

19.1 These Terms and Conditions are governed by and shall be construed in accordance with the laws of the

United Arab Emirates.

19.2 The Cardmember irrevocably and unconditionally submits to the jurisdiction of the courts of the UAE. The

submission to such jurisdiction shall not (and shall not be construed so as to) limit Dubai First’s right to take

proceedings against you in the courts of any other competent jurisdiction nor shall the taking of

proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdiction,

whether concurrently or not.

19.3 Any admissions or acknowledgment in writing by the Cardmember or any person authorised by the

Cardmember of the amount of indebtedness of the Cardmember to Dubai First and any judgment

recovered by Dubai First against the Cardmember in respect of such indebtedness shall be binding and

conclusive in all courts of law in the United Arab Emirates and elsewhere. A certificate issued by an officer

of Dubai First as to the amount for the time being due and owing to Dubai First from or by the Cardmember

shall be conclusive evidence against the Cardmember in any legal proceedings.

20 EASY PURCHASE PLAN

20.1 "Easy Purchase Plan" (EPP) means any payment plan offered by Dubai First as a benefit to a

Cardmember for extended payment of any retail purchase.

20.2 The purpose of EPP is to enable the Cardmember to purchase selected goods and services offered by

specific merchants determined by Dubai First from time to time using the limit available on his/her Card

and repay the amount of the purchase in equal monthly instalments with these Terms & Conditions.

20.3 The EPP is offered exclusively to the Cardmember, as long as his/her Card is in good standing as per

Dubai First‘s regulations. Any Cardmember who meets the Dubai First Cards General Terms &

Conditions will be automatically eligible for EPP. EPP is available for transactions performed by both

Primary and Supplementary Cardmembers however can be availed on request by the Primary

Cardmember.

20.4 When availing of the EPP for selected goods and services, the Cardmember will have to pay deferred

payment charges for the facility of paying in equal monthly instalments. The total amount of EPP (the

"Total EPP Price") will be the sum of the purchase price of the goods and services and the deferred

payment charges.

20.5 The selected goods and services offered by the selected merchants, the deferred payment charges

applicable and the number of monthly instalments to be paid (the "EPP Term" for each good and service

shall be determined by Dubai First from time to time and communicated to the Cardmember accordingly

(hereinafter referred to as the "Offer").

20.6 The deferred payment charges and the EPP Term will vary from one Offer to another.

20.7 Dubai First will authorize an EPP transaction provided that the Total EPP Price is within the

Cardmember‘s available total credit limit available on his/her Card and the Cardmember‘s Card is in

good standing as per Dubai First‘s rules and regulations adopted by Dubai First at the time of conducting

the transaction.

20.8 If the Cardmember is interested in availing of any Offer under the EPP he/she has to call up Dubai First

or send a specific form providing relevant details duly signed and authorised to Dubai First. Dubai First

will then convert the transaction into an EPP transaction in accordance with these Terms & Conditions

and the provisions applicable to that specific Offer in respect of the deferred payment charges and the

number of instalments.

20.9 The amount to be paid every month "EPP Monthly Instalment" will be computed by dividing the Total

EPP Price by the EPP Term. (The Total EPP Price is arrived by adding the Purchase Price of the goods

or services and the deferred payment charges).

20.10 The EPP Monthly Instalment shall be billed to the Cardmember starting from the immediately following

statement date after the date of purchase and every month thereafter until the Total EPP Price is billed

in full.

20.11 When a Cardmember makes a purchase under the EPP, the Minimum Payment Due on the statement

will be the sum of the EPP Monthly Instalments plus 10% of Current Balance less the EPP Monthly

Instalments plus the amount by which the Current Balance is in excess of the Credit Limit plus all past

Minimum Amounts Due, if any.

20.12 If the Cardmember pays less than the Minimum Payment Due on the due date specified in the

Cardmember‘s Card monthly statement then charges as per the existing Cards Terms & Conditions

governing the issue and use of the Dubai First Card will become applicable.

20.13 If the Cardmember does not make a payment equal to or more than the Minimum Payment Due

specified for two consecutive statements or if the Card Account is closed then Dubai First will at its sole

discretion cancel the EPP and an amount equal to the total EPP Price less the EPP monthly instalments

already billed to the Cardmember will be immediately billed to the Card Account in one lump sum. Dubai

First will also charge an EPP early settlement Fee (as per the applicable schedule of charges) for the

above.

20.14 The Cardmember may request for reducing or increasing the EPP Term i.e. the number of EPP

instalments. Dubai First may review the request and may agree to the Cardmember‘s request and

charge a nominal fee (hereinafter called the "EPP Rescheduling Fee") to the Cardmember‘s Card

account for processing the same.

20.15 The Cardmember will be allowed the option of prepaying the Total EPP Instalment Price in one lump

sum prepayment. There will be a nominal fee (hereinafter called the "EPP Early Settlement Fee") to

process this request for the Cardmember.

20.16 The good(s) including any and all replacements, accessions & accessories thereto purchased by the

Cardmember under EPP shall remain Dubai First‘s absolute property until the Total EPP Price is paid in

full and all of these Terms & Conditions are completely complied with. The Cardmember shall not be the

owner of the good(s) until such date and he/she will not make any prior statement or allegations in this

respect. The Cardmember shall not sell or rent mortgage or assign the good(s) or encumber it to waive

its acquisitions or in any other way deal in the good(s) or any interest therein or any person or party. The

Cardmember shall exercise proper diligence in the use and maintenance of the good(s).

20.17 Dubai First will not be liable for any damages or loss incurred by the Cardmember arising out of the

purchase, installation, and use or otherwise of the good(s) and/or service(s) under EPP. Any complaint

as to the quality of the good(s) purchased or service(s) rendered through EPP shall be referred to the

supplier or merchant and shall not affect Cardmember‘s obligation to continue paying the EPP Monthly

Instalments to Dubai First.

20.18 Dubai First is entitled at any time and without prior notice or liability to Cardmember in any manner

whatsoever to terminate EPP or cancel or vary its benefits or features, or vary or add or delete any of

these Terms & Conditions. However, such termination shall not affect transactions concluded by the

Cardmember and accepted by Dubai First under EPP before the termination decision. Dubai First is also

entitled to determine a floor limit for the minimum amount of purchase allowable under EPP for each

particular offer.

20.19 Dubai First reserves the right to disqualify any Cardmember from further participation in EPP, if in its

judgment, that Cardmember has in any way violated the rules and conditions herein, or has violated

Dubai First Cards Terms & Conditions. Suspension and disqualification shall not lead to termination of

transactions already concluded by the Cardmember and accepted by Dubai First before such decision.

20.20 Dubai First shall be entitled to disallow/refuse any transaction submitted by the Cardmember to it under

EPP without assigning any reason whatsoever.

20.21 Dubai First shall not be liable if it is to perform its obligations under these Terms & Conditions, due

directly or indirectly to the failure of any machinery or communication system, industrial dispute, war or

act of God, or any thing outside the control of Dubai First. Nor shall Dubai First be responsible for any

delay in transmission to Dubai First of evidence of EPP by the specified merchants or any other third

party.

20.22 The Terms & Conditions herein shall be without prejudice to the existing Cards Terms & Conditions of

Dubai First, governing the issue of the use of Dubai First‘s Card and shall apply to the EPP.

20.23 If at any time dispute arises in connection with either the EPP or these Terms & Conditions, Dubai First‘s decision in connection with the same shall be final and binding. Dubai First reserves the right to terminate the EPP without prior notice.

21. LOAN ON PHONE

21.1. The Cardmember agrees that the granting of a Financial Product to the Cardmember establishes the

Cardmember’s consent to these Terms and Conditions. A Financial Product means a Loan on Phone

(LOP), Balance Transfer (BT), Dial-a-Cheque or any other facility or service offered by Dubai First from

time to time.

21.2. The Financial Products are only made available to Cardmembers who meet the criteria determined by

Dubai First from time to time for these products. For a BT the Cardmember’s name on the other bank

cards should be the same as Primary Cardmember’s name.

21.3. Dubai First shall grant the Financial Product as requested by the Cardmember at its sole discretion and

reserves the right to refuse to grant a Financial Product to any Cardmember without revealing the

reasons for such refusal. Dubai First may by notice to the Cardmember cancel Dubai First’s commitment

to make available a Financial Product or reduce the amount of the Financial Product.

21.4. The amount of any Financial Product shall be determined by Dubai First at its sole discretion and the

Financial Product shall not in any case exceed the Cardmember’s unutilised Credit Limit. Dubai First

shall have the right to determine the amount of any Financial Product it grants at its sole discretion.

21.5. In consideration of Dubai First agreeing to make available to the Cardmember the Financial Product, the

Cardmember agrees to repay the principal amount of the Financial Product plus all interest, charges and

fees payable hereunder.

21.6. The Cardmember shall repay the Financial Product to Dubai First in monthly instalments over the term of

the Financial Product booked. The amount of each monthly instalment shall be computed by dividing the

total Financial Product amount by the number of months in the term that was decided upon. The total

Financial Product amount shall be computed by adding the principal amount of the Financial Product

and the interest during the term of the Financial Product.

21.7. Interest at the rate determined by Dubai First shall be charged on the Financial Product. Each monthly

instalment will include amounts for the repayment of principal and interest charges.

21.8. The monthly instalments shall be billed to the Cardmember in the Statement of Account. Billing shall

commence from the first Statement of Account sent to the Cardmember following the disbursement of

the Financial Product. The Financial Product’s outstanding amounts will be added to the Current

Balance of the Card will abide by these Terms and Conditions as detailed in Clause 4. The Financial

Product’s monthly instalment amount will be part of Minimum Payment Due.

21.9. The Cardmember shall be liable to pay the Financial Product’s monthly instalment billed to the

Statement of Account regardless of the Cardmember’s utilisation or non-utilisation of the Financial

Product. If the Cardmember returns the original manager’s cheque or returns the full amount of the

Financial Product to Dubai First leaving the Financial Product unused, any principal repayments charged

to the Card Account will be credited to the Card Account. Any interest payments and fees charged to the

Card Account as determined by Dubai First will not be refunded to the Customer and will be considered

as charges for the cancellation of the Financial Product.

21.10. If the Cardmember pays less than the Minimum Payment Due by the Payment Due Date specified in the

Statement of Account, all Charges as per these Terms and Conditions will be applicable.

21.11. The Cardmember may repay the total Financial Product amount to Dubai First in one lump sum. A

termination fee at Dubai First’s prevailing rate shall be charged to the Cardmember in this case.

21.12. If the Cardmember fails to make payment in full of two consecutive Financial Product’s monthly instalments, the entire outstanding balance of the total Financial Product’s amount shall immediately become due and payable by the Cardmember, and the Dubai First shall have the right to demand the immediate payment thereof.

21.13. The Cardmember certifies that the information provided to the Dubai First in connection with the

Financial Product’s are true and correct.

21.14. Allowing the Cardmember to re-borrow any part of the principal amount of a LOP that has been repaid is

at the Dubai First’s sole discretion. Dubai First reserves the right to terminate any Financial Product’s

service without prior notice.

22. Dial a Cheque

22.1. Dial-a-Cheque is issued subject to sufficient balance on the Cardmember’s Dubai First Credit Card being available.

22.2. Dial-a-Cheque is only payable to a third party. Dial-a-Cheque will not be made favouring the Cardmember’s name.

22.3. Dial-a-Cheque is subject to a processing fee as per the current Dubai First Schedule of Charges.

22.4. Dial-a-Cheque will be treated as a retail transaction and is subject to the current finance charges.

22.5. If a Dial-a-Cheque requires cancellation, the original Dial-a-Cheque must be returned to Dubai First and applicable cancellation charges, if any, will apply.

22.6. In the event that a Dial-a-Cheque is lost or stolen, the Cardmember must notify Dubai First immediately.

22.7. Dial-a-Cheque is made available on a best-effort basis and at the sole discretion of Dubai First. Dubai First may reject a Dial-a-Cheque instruction for any reason.

22.8. Dubai First makes no warranties and assumes no liability or responsibility in respect to the products and services provided by third parties.

22.9. Dubai First will not be liable for, and the Cardmember hereby irrevocably releases Dubai First from any liability for excess, insufficient, late or incorrect payment to third parties or any consequence thereof (including, but not limited to, termination of service and penalties) or any other loss, damage, claims or proceedings that may arise as a result of the Cardmember's failure to correctly inform Dubai First of the Dial-a-Cheque details.

23. E Statement

23.1. Dubai First may in its sole discretion, opt to send Cardmember’s Statements of Account through e-mail

(e-Statement) unless specifically requested otherwise by the Cardmember in writing. Dubai First shall

email the e-Statement(s) at the email address provided by the Cardmember. Should the Cardmember

request Dubai First for paper based Statements of Account, the same shall be provided upon payment of

fees stated in the Schedule of Fees and Charges.

23.2. The e-Statement shall be deemed to be delivered to the Cardmember upon receipt by the Cardmember

of the e-mail from Dubai First containing an e-Statement.

23.3. The Cardmember shall be deemed to have accepted and agreed to be bound by these Terms and

Conditions, as amended by Dubai First from time to time, on receipt of the e-mail containing an e-

Statement by the Cardmember.

23.4. The Cardmember will notify Dubai First, within twenty-four (24) hours from the receipt of the e-email

containing the e-Statement, if the Cardmember is unable to get access to the e-Statement. Upon expiry

of such period, the Cardmember shall be deemed to have received and accessed the e-Statement.

23.5. The Cardmember confirms that the email address(es) provided in the application, given to the Contact

Centre or through any other channel of communication with Dubai First, belongs to the Cardmember

personally and hereby have secure, full and complete access to this email address. The Cardmember

understands that it will be their responsibility to update Dubai First in case of any change in their email

address(es).

23.6. The Cardmember hereby agrees to receive an e-Statement only and via this service.

23.7. This e-Statement service is provided entirely at the Cardmember’s sole risk and in case of any

unauthorised disclosure of the released statement, Dubai First, which includes its successors and

assigns, shall not be liable for any direct, indirect, special, incidental or consequential loss or damage

which may arise in respect of this disclosure and/or due to delivery and/or mail over quota and/or

provision of this e-Statement Service using the email address(es) as referred to above.

23.8. If no dispute is received on the contents or transactions listed on the e-Statement by Dubai First within

14 days from the date of receipt of e-Statement at the email address provided by the Cardmember,

Dubai First’s records shall be considered final and conclusive evidence of the correctness of all entries in

the Card(s) account

23.9. In the event of any discrepancy between the e-Statement and Dubai First’s records, the latter shall

prevail.

23.10. Dubai First has the right, at its sole discretion, to refuse any requests for e-Statement application(s) and

to stop the e-Statement Service at any time without any prior notice to the Cardmember.

23.11. The Cardmember understands that the e-Statement service is free of charge; however Dubai First

reserves the right at its sole discretion to charge for the Service in the future upon prior notification.

23.12. Dubai First will not be liable for delay and/or non-delivery of complete or partial e-statements due to the

suppression, disruption, blocking, filtering of the Cardmember’s email or due to any other technical

reasons beyond the Dubai First’s control. Any amounts which are or will become outstanding on the

Cardmember Card Account(s) including late fee, interest and charges shall be repaid in full by the

Cardmember irrespective of whether the e-Statement or paper Statement was delivered accurately or

timely.

23.13. In addition to the above, the Cardmember acknowledges the risk that data received/delivered through

the internet/e-mail including any confidential information may be accessed/seen by third parties. The

Cardmember releases and discharges Dubai First, its employees, officers, representatives from and

waives any right that accrues to the Cardmember at law against Dubai First, its employees, officers,

representatives with regard to damages suffered by the Cardmember, directly or indirectly, due to such

unauthorized access by or disclosure of confidential information to third parties.

23.14. The Cardmember understands and agrees that the storage of information including without limitation, the

password, Dubai First account information, transaction activity, Dubai First account balances and any

other information stored on the Cardmember’s personal computer shall be stored at the Cardmember’s

risk and liability and Dubai First shall not be responsible for any unauthorized access by or disclosure of

such information to third parties.

23.15. Dubai First or its related entities may from time to time provide or obtain information about the

Cardmember, its account and transactions to or from Dubai First, its related entities, contractors, data

carriers, outsource agents or to the third parties around the world for the purpose of transaction and

payment processing and for the purposes directly related to the services which Dubai First or its related

entities may provide (including other financial products and services) to the Cardmember.

23.16. Dubai First or its related entities shall also be entitled to disclose information as permitted or required by

any applicable law, legal process, regulation or by an order, judgment or decree of a court or for the

purpose of any legal process which concerns Dubai First or its related entities. Disclosure may also be

made to government and regulatory agencies and authorities and to credit rating agencies

23.17. The permission to transfer and disclose information shall continue notwithstanding any termination of

any agreement or discontinuing of any service to the Cardmember.

24. ACCEPTANCE OF TELEPHONIC INSTRUCTIONS

24.1. The Cardmember authorises Dubai First to accept telephonic instructions and instructions via any

electronic form including but not limited to; internet, fax, Short Message Service (SMS) given by the

Cardmember to Dubai First regarding a Card, Financial Product or any other Facility offered by Dubai

First to the Cardmember.

24.2. The Cardmember agrees that confirmation of the Cardmember’s identity, by the Cardmember’s provision

of the personal details required by Dubai First, will be sufficient evidence for Dubai First to identify the

Cardmember and to act upon the Cardmember’s instructions.

24.3. The Cardmember hereby consents to the recording of all electronic communication (e.g. telephone calls,

electronic mail, SMS message or other) and storage of electronic media by Dubai First and accepts such

recordings and electronic media as evidence before the U.A.E. courts or any other legal or arbitral

proceedings with regard to all the terms of the Card or Financial Product including, but not limited to, the

grant of the Card or Financial Product, the amount of the Dubai First credit card or financial product and

the number of instalments. The Cardmember consents to such use of the recordings by Dubai First.

25. CASH BACK PROGRAM

25.1. Cash back Program is offered to all Cardmembers. No special enrolment or fees are required,

although Dubai First solely reserves the right to introduce an enrolment fee at any time.

25.2. Cardmembers wherever used in this clause shall mean Dubai First Titanium Life credit card

Cardmembers who are enrolled in the Dubai Cash back program.

25.3. The Cardmember shall be eligible for Cash back Program subject to these Terms and Conditions.

25.4. Cash back program Feature

25.4.1. Cash back is defined as ‘a cash denominated loyalty reward’ accrued vide transactions performed on the Card, that are categorized as eligible by Dubai First from time to time.

25.4.2. Dubai First may vary the fee and charges applicable to the Cash back program at its sole

discretion from time to time.

25.4.3. The Cash back shall be paid by crediting the Cardmember’s Card with an amount equal to the

amount that is requested by the Cardmember to be redeemed as part of this Cash back program.

No cheques or cash will be issued by Dubai First as part of this Cash back program.

25.5. Eligibility

25.5.1. In order to qualify for a Cash back accrual, the Cardmember will have paid the annual

maintenance fee (if applicable) and their minimum monthly spend should be AED 1000. These

amounts are subject to change from time to time in Dubai First’s sole discretion.

25.5.2. Cash back program allows the Cardmember to be eligible for Cash back on all purchases and

cash Transactions incurred.

25.5.3. However, a particular Transaction shall not be deemed to be termed as a Cash back Transaction,

if the same is accrued as a result of the following:

a) All/Any penalty fees

b) Annual fees, membership fees or renewal fees

c) Balance transfer commission (if charged)

d) loan on phone enrollment fee (if charged)

e) Finance charges

f) All/Any other fees and charges that are levied by Dubai First and or specified as ineligible

transactions by Dubai First at its sole discretion.

Dubai First may, at its sole discretion and without prior notice to the Cardmember add to or remove from the above list of ineligible transactions and charges. Dubai First’s decision will be final and conclusive.

25.5.4. The Cardmember should accrue minimum Cash back of AED 100 at any point in time to become

eligible for Cash back redemption.

25.5.5. In the event of the Cardmember not falling within the eligibility criteria stipulated by Dubai First in

respect of a particular month, then the Cardmember cannot claim for Cash back redemption in

respect of that month.

25.5.6. Accrual of Cash back

25.5.6.1. A Cardmember becomes eligible for Cash back as per the promotional schemes

offered by Dubai First from time to time.

25.5.6.2. Dubai First reserves the right to alter, amend and change the Cash back levels of

eligibility (slabs) at any time without prior notification to the Cardmember.

25.5.6.3. The maximum Cash back accrual that a Cardmember can avail during a particular month

shall not exceed AED 1,000.

25.5.6.4. Dubai First reserves the right, at any time and without prior notice to the Cardmember, to

change the the ratio between a) the Cash back to be awarded and b) the specified amount

charged to the Cardmember’s credit card.

25.5.7 Bonus Cash back

25.5.7.1. Bonus Cash back can be awarded to a Cardmember on a ‘Balance Transfer ‘or a Loan on

Phone for a minimum amount and tenure specified by Dubai First from time to time.

25.5.7.2. Bonus Cash back can be awarded to Cardmember on minimum monthly cumulative cash

withdrawals specified by Dubai First from time to time.

25.5.7.3. Bonus Cash back can be awarded to the Cardmember on international transactions fulfilling

minimum Transaction size criteria as specified by Dubai First from time to time. The said

bonus Cash back will be calculated basis Transactions billed to the Card statement for a

particular billing month.

25.5.7.4. Dubai First shall also award additional bonus Cash back to Cardmembers at its discretion,

the inception and commencement of which shall be intimated by prior notification to the

Cardmembers vide accepted modes of communication that shall be decided by Dubai First

from time to time.

25.5.8. Redemption

25.5.8.1. The Cash back shall be paid by crediting the Cardmember’s credit card with an amount equal

to the amount that is requested by the Cardmember to be redeemed. The amount requested

by the Cardmember is to be within the amount of Cash back the Cardmember has already

accumulated as part of this Cash back program. No cheques or cash will be issued by Dubai

First as part of this Cash back program.

25.5.8.2. A Cardmember can redeem the Cash back facility at any time by lodging a request at the

phone banking services of Dubai First. Redemptions cannot be amended, cancelled or

revoked upon acceptance of redemptions by Dubai First.

25.5.8.3. The Cardmember should have accrued a minimum of AED 100 of Cash back to be eligible for

a successive redemption.

25.5.8.4. The Cardmember may only redeem those Cash back registered and credited to the

Cardmember’s credit card account at the time of making the redemption. The records of

Dubai First shall be conclusive evidence in respect of the number of Cash back registered

and credited the Cardmember’s credit card account.

25.5.8.5. All redeemed Cash back - shall be deemed as a payment made by Dubai First to the

Cardmember. However, such payment is made exclusively as part of the Cash back program

offered by Dubai First in accordance with these Terms and Conditions, and the same does

not in any way create a monetary liability or obligation on Dubai First in that regard.

25.5.8.6. The Cash back feature is valid for a period of 24 months from the date of accrual. The Cash

back -so accrued will have to be redeemed within the first 24 months of such accrual. In case

the Cardmember does not redeem the Cash back - so accrued, the Cash back - accrued so

far shall expire and Dubai First reserves the right to retrieve such monies without prior

notification to the Cardmember.

25.5.8.7. The amounts accrued/redeemed by way of Cash back shall be narrated in the Statement of

Account for a particular billing month (during which time the Cardmember may have availed

of the Cash back program).

25.5.8.8. The Cash back feature cannot be transferred, assigned or carried on to any other Card of

Dubai First or to any other person or a corporate entity either by operation of law or

otherwise.

25.5.9. General Exclusions

25.5.9.1 The Cardmember shall participate in the Cash back program in good faith with genuine

intentions. Any fraud, misuse, illegal use or abuse of the Cash back program may result in

the forfeiture of the program. Dubai First reserves the right to cancel the Card and cancel

and nullify all the Cash back accumulated in case of such an eventuality of fraud, illegal use

or abuse of the Cash back program.

25.5.9.2 Dubai First may from time to time alter, change or modify the Terms and Conditions, and the

basis of computation of Cash back without prior intimation to the Cardmember.

25.5.9.3. The Cardmember should maintain a proper and good credit history with Dubai First in order

to be eligible for redemption of facility. All the Cardmember’s accounts must be valid

(meaning not cancelled or terminated) and current (meaning there are no past due balances

on any of the Cardmember’s Card accounts) to be eligible for redemption of the Cash back.

In the event of any of the Cardmember’s accounts being blocked/suspended/overdue for

any reasons whatsoever or if the Cardmember breaches these Terms and Conditions Dubai

First reserves the right to suspend the operation of the Cash back program or cancel and

nullify all the Cash back accumulated at its sole discretion.

25.5.9.4. The Cash back program is not available for Transactions intended for business or

commercial use or on Transactions conducted at establishments owned by the Cardmember

either wholly or in part. Any such Transactions shall automatically disqualify the

Cardmember from the Cash back program and Dubai First reserves the right to recover

such monies obtained by the Cardmember as a result of the Cardmember engaging in such

Transactions.

25.5.9.5. The Cash back that is accrued as a result of the Transactions shall be redeemed only when

the same is billed to a Cardmember’s monthly statement (the word redemption wherever

used has the meaning assigned to it and does not by itself provide/vest any right on the

Cardmember to lodge a claim against Dubai First in connection with the said expression).

25.5.9.6. The Cash back program cannot be exchanged/ swapped/ bartered with any of the

rewards/loyalty schemes that Dubai First may or might have offered from time to time.

26. FIRST CONCIERGE SERVICES

26.1. The Cardmembers are also entitled to avail First Concierge services provided by Dubai First’s concierge

partner. Dubai First reserves the right to withdraw these services at its sole discretion without notification.

26.2. Upon activation of the Card, the Cardmember will be eligible for First Concierge services subject to the

provisions set out below.

26.3. The Cardmembers acknowledge that Dubai First’s concierge partner is responsible for the concierge

services provided. Any claims relating to loss or damage suffered by the Cardmembers resulting from the

utilisation of First Concierge services shall be made against Dubai First’s concierge partner directly and

that Dubai First shall not be liable or responsible for such claims.

26.4. The Cardmembers also acknowledge that Dubai First does not provide any warranty in respect of the First

Concierge services provided by Dubai First’s concierge partner

26.5. The terms and conditions relating to Dubai First’s concierge partner shall be available on request.

27. FIRST PRIVILEGES PROGRAM

27.1. First Privilege program benefits are being offered on the Card at the sole discretion of Dubai First

27.2. Dubai First reserves the right to withdraw and/or alter any of the offers without prior notice.

27.3. The First Privileges are applicable only if the payment is made using the Card. Please present your Card

before asking for the bill to avail the discount.

27.4. The participation in the First Privileges program is optional and at the absolute choice of the Cardmember.

27.5. Dubai First is neither responsible nor guarantees the quality of the goods/ services at the participating

establishments. All the participating establishments are independently liable/ responsible for the quality of

goods/ services or otherwise provided by them under this program.

27.6. All claims/contestations/disputes that the Cardmember may have in respect of the above mentioned

services shall be directly addressed to the participating outlets from where the Cardmember has availed of

the services.

27.7. The offers made by the participating establishments cannot avail in conjunction with any other offer or

during a sale period that is in force at the participating establishments.

28. WELCOME GIFT

28.1. Cardmembers will be entitled to choose a welcome gift on enrolment. Dubai First will have the discretion to

change the welcome gift options provided to the Cardmember from time to time.

28.2. Cardmembers will be entitled to choose one out of five welcome gifts at time of completing the Card

application form. The Cardmember will become eligible to receive their chosen welcome gift on fulfilling the

criteria as will be determined solely by Dubai First.

28.3. On fulfilling the required criteria, the Cardmember will receive a welcome gift voucher for redemption at

specified Merchant partners. Dubai First reserves the right to alter the fulfilment and redemption criteria

based on its discretion.

28.4. The Cardmember will not have the option to change their welcome gift once they have given their

preference in the application form at the time of enrolment.

29. FIRST INSURANCE

1. DEFINITIONS

For the purpose of Noor Takaful Coverage, unless otherwise specifically defined in the Takaful Certificate, the

following terms, words and expressions shall be interpreted according to the meanings hereunder;

NTF means Noor Takaful Family PJSC.

Takaful means an Islamic insurance concept that is based on Islamic principles and in

accordance with Sharia’a rules.

Certificate means the Takaful Certificate (or normally known as policy) provided by NTF to the

eligible card member

Participant means Dubai First, acting in the name and on behalf of Persons Covered whose

application has been accepted by NTF.

Person Covered means all eligible card members who has been granted takaful cover under the

scheme

Accident means any sudden and unforeseen event, occurring to a victim beyond his/her control

and resulting in a Bodily Injury, the cause of which, is violent and external to the

victim’s own body

Active at Work means the work situation of any Person Covered reporting regularly and on a

permanent and full time basis to his work place and performing the usual and normal

duties of his occupation in conformity with the employment conditions.

Any one period of means all claims arising from the same cause including any and all

hospitalization complications there from, except that after thirty (30) days following the latest

discharge from hospital, any subsequent hospitalization shall be considered a new

claim.

Benefit means the indemnity payable under the scope of this Cover in respect of Death or

Permanent Total Disablement or Hospital Cash Benefit or Involuntary Loss of

Employment of the Person Covered

Bodily Injury means bodily injury effected directly and independently of all other causes by external,

violent and accidental means of which, except in the case of drowning or of internal

injury revealed by autopsy, there is evidence of a visible contusion or wound on the

exterior of the body.

Card Facility means Dubai First’s Card Facility which has been nominated as the facilities

to which the benefits under this Cover are to apply.

Credit means the credit or other form of financial accommodation provided by Dubai First to

the Person Covered under the Card Facility.

Cover means the takaful coverage offered by Dubai First in association with NTF.

Cover Period means the period after Commencement Date during which the benefits under this

cover shall apply.

Date of Event means any one of the following:

In respect of Death the date of death resulting from an accident or illness

happening/manifesting after the Commencement Date and during the Cover

Period.

In respect of Permanent Total Disablement the date of recognition of

Permanent Total Disablement by a Competent Authority resulting from an

accident or illness happening/manifesting after the Commencement Date and during

the Cover Period.

In respect of Hospitalisation Cash Benefit the date of admission in the hospital after

the Commencement Date and during the cover period.

In respect of Involuntary Loss of Employment, the date of notice of termination

served to the Person Covered after the Commencement Date and during the Cover

Period.

Death means death resulting from any causes, either accident or illness.

Enrollment Date means the day (at 12:00-noon local time) month and year, from when the Takaful Certificate first became effective for a particular Person Covered.

Hospital means any medical institution, public or private, which is legally licensed to provide

medical t r e a t m e n t t o s i c k a n d /or i n j u r e d p e r s o n s . The fac i l i t y mus t

c o n s i s t o f organized premises, possess the necessary technical and scientific

equipment for diagnosis and surgical operations, and provide healthcare services 24

hours a day by a staff comprising at least one resident Physician and qualified

nurses. The term "Hospital" shall not be construed to include an outpatient

clinic, sanatoria, physiotherapy centre, health club, rest home, nursing home,

convalescent home, place for custodial care, home for the aged, or a place used

primarily for the confinement or treatment of drug addicts or alcoholics

Illness means a disease or sickness first occurring after the Commencement Date. Indebtedness means the total amount outstanding in the Card Facility as on the Date of Event but

excluding any Credit facility availed after the Date of Event subject to a maximum of the

Person Covered’s credit limit.

Injury means bodily injury resulting from an Accident occurring after the

Commencement Date.

Involuntary Loss of means unemployment of the Person Covered arising out of the unilateral

Employment (ILOE) decision of the employer to terminate his employment contract without citing

any reason or for any reason other than those excluded.

Maximum Coverage means the following age(s) upon attainment of which the Cover ceases in

Age respect of the Person Covered :

Death, PTD and Hospital Cash Benefit : 65 years Involuntary Loss of Employment : 60 years

Permanent Total means disability, whether caused by bodily injury or disease, which wholly

Disability (PTD) prevents the Person Covered from engaging in any business, or occupation

or performing any work, for compensation or profit, provided, however,

that to determine if the total disability has become a permanent one, it must continue

uninterruptedly for a period of at least six (6) months.

Total loss of both arms, or both legs, or of one arm and one leg, or both eyes shall be

considered permanent total disability, without prejudice to other causes of permanent

total disability. Loss shall mean with regard to arms and legs, dismemberment by

physical separation, at or above the wrist and ankle or loss of use of both hands, both

feet or one hand and one foot; with regard to eyes, total and irrevocable loss of sight.

The word 'disability' whenever it hereinafter appears, means permanent total disability

as above defined and limited.

Pre-existing Condition means any condition which existed either known or unknown to the Person

Covered and/or to the Participant which exhibited symptoms or was a consequence of

injury or illness for which medical, surgical, and/or pharmaceutical treatment,

medical diagnosis or advice was provided or should have provided prior to the

Person’s Covered Enrollment Date.

Re-employment means accepting and starting work for a new employer or the same employer under a

new employment contract within 10 (ten) months from the date of actual

unemployment.

Scope of Coverage means the scope of coverage as set out in the Takaful Certificate Schedule.

Takaful Contribution means the periodic payment required for providing coverage and to keep the Takaful Certificate in force.

Travel Takaful means takaful coverage while travelling which include medical emergency, personal

accident, personal liability and travel inconvenience up to the maximum limit as per

the benefit table.

2. TAKAFUL CONDITIONS

a. Noor Takaful Coverage include Death, Permanent Total Disablement, Hospital Cash Benefit,

Involuntary Loss of Employment and Travel Takaful.

b. Noor Takaful Coverage is free for the first month and thereafter a nominal charge will be applied on

the total outstanding amount for the month subject to minimum monthly takaful contribution.

c. Cover automatically starts from the date of activation of the Card and or the date of inception of the takaful certificate, whichever is later.

d. The Person Covered has the option to opt out of the scheme at any time. However, once

opted out, the Person Covered will not be allowed to re-join the scheme.

e. Cover will be applicable only for Primary card holders and shall exclude Corporate and Lodged Cards. However the outstanding balance under the supplementary Card is also covered.

f. The Person Covered shall be of age between 18 to 65 but 18 to 60 years in respect of Involuntary

Loss of Employment Cover.

g. Dubai First retains the right to vary, alter or amend these terms and conditions at any time without notice.

h. The cover is subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates.

i. Dubai First reserves the right, at any time, to reject, discontinue or cancel the cover applicable without

assigning any reason thereof

j. Dubai First is not at any time considered as an agent of Noor Takaful Company, the takaful Provider. Any claims or contestations or any takaful related cover shall be negotiated directly with Noor Takaful Company, Dubai.

k. These terms and conditions are extracted from the Master Certificate issued to Dubai First

by NTF. These terms and conditions are not the certificate wording.

l. The territorial limit is worldwide except in respect of Hospital Cash Benefit and

Involuntary Loss of Employment cover for which the territorial limit is within UAE.

m. Death or Disablement shall be due to bodily injury or illness but excluding the reasons mentioned in the

exclusions.

n. Benefit payable in respect of Death, Permanent Total Disablement and Involuntary Loss of

Employment shall be written off against the Person Covered’s total amount outstanding with Dubai

First. Benefit written off against the Person Covered’s outstanding balance shall be deemed to be

Benefit paid to the Person Covered. However Hospitalisation Cash Benefit and Travel Takaful will be

settled directly to the Person Covered.

o. The Person Covered shall notify NTF immediately upon Re-employment but not later than 15 days

from the date of Re-employment. Failure to notify NTF shall render the benefits provided under this

cover fully recoverable without contestation.

3. GENERAL TERMS AND CONDITIONS

a. The Person Covered shall furnish Dubai First with any information Dubai First may require (including details of the state of health) in respect of the Person Covered for the benefits hereunder. Dubai First may, at its sole discretion, require the Person Covered to undergo a medical examination by a legally qualified medical practitioner in the manner Dubai First deems required or fit.

b. The benefits under this Cover shall be extended only to Primary card holders and not to an additional

or supplementary card holders.

c. No Benefits shall be paid in respect of a Person Covered who attains the Maximum Coverage

Age specified.

d. The benefits under this Cover shall terminate upon the happening of any one or more of the

following:

Cancellation of the Person Covered’s Card Facility;

Person Covered having attained the Maximum Coverage Age;

Upon payment of Benefit for Death or Disablement;

The Person Covered’s Card Account becomes overdue for a period of 90 days.

However, this cover will automatically reinstated once Person Covered has paid his dues;

Person Covered becoming unemployed either voluntarily or involuntarily. However,

the termination shall be only in respect of Involuntary Loss of Employment;

6 months prior to the Person Covered’s normal retirement date depending upon

the age of the Person Covered and the law of the land where he is employed.

However, the termination shall be only in respect of Involuntary Loss of Employment;

Cancellation of the benefits under this Cover by Dubai First or the Person Covered

at any time in accordance with the terms and conditions of this Cover.

e. The observance by the Person Covered of the terms of this Cover and the truth of the statements and the answers by the Person Covered in the proposal and other material information provided by the Person Covered shall be condition precedent to benefits applicable under this

Cover. If t h e circumstances in which this Cover was extended to the Person Covered are materially altered without the written consent of Dubai First, the Cover shall become null and void;

f. If any claim under this Cover is in any way fraudulent or unfounded, all benefits under this Cover

shall be forfeited;

g. The maximum cumulative amount of Benefits payable under this Certificate for any one person shall not exceed the amount stated in the herein irrespective of the number of certificates in force or the number of Card Facilities in respect of which the Person Covered has obtained a similar benefit as provided under this certificate;

h. Disappearance Clause - If a Person Covered disappears during the currency of the Certificate and their body is not found within one year after their disappearance and sufficient evidence is produced satisfactory to NTF that leads them inevitably to the conclusion that they sustained accidental bodily injury and that such injury caused their death, NTF shall forthwith pay the death benefit as provided herein and the person to whom such sum is paid shall sign on undertaking to refund such sum to NTF if the Person Covered is subsequently found to be living

4. BENEFIT DETAILS

SECTION 1: DEATH

a. Scope of Cover

In the event of the Person Covered’s Death during the Cover Period due to injury or illness arising out of a cause not specifically excluded herein, NTF shall pay the Person Covered’s Indebtedness as on the Date of Event subject to a maximum of AED 100,000.

b. Exclusions

No Benefit under this Cover shall be applicable in respect of a Person Covered where the Event

giving rise to a claim under this Cover occurs as a result of:

Death resulting directly or indirectly from suicide, while sane or insane, within one year from the

Effective Date in the Schedule.

A Person Covered dies, becomes disabled or suffers critical illness from as a direct or

indirect consequence of war, hostilities or warlike operations (whether war be declared or not),

invasion, act of an enemy foreign to the nationality of the Person Covered or the country in, or

over, which the act occurs, civil war, riot, rebellion, insurrection, revolution, overthrow of the

legally constituted government, conspiracy, martial law, state of siege, civil commotion assuming

the proportions of, or amounting to an uprising, military or usurped.

A Person Covered dies, becomes disabled or incurs medical expenses due to an event directly

or indirectly caused by, contributed to by, resulting from or arising out of or in connection

with biological, chemical, or nuclear explosion, pollution, contamination and/or fire following

thereon.

A Person Covered dies, becomes disabled or incurs medical expenses as a direct or

indirect consequence of terrorist activity. For the purpose of this exclusion terrorist activity means

an act, or acts, of any person, or group(s) of persons, committed for political, religious,

ideological or similar purposes with the intention to influence any government and/or to put the

public, or any section of the public, in fear. Terrorist activity can include, but not be limited to,

the use of force or violence and/or the threat thereof. Furthermore, the perpetrators of terrorist

activity can either be acting alone, or on behalf of, or in connection with any organizations(s) or

government(s).

The benefits under this Cover shall not be applicable to the Person Covered where the Person Covered

has received or have applied to receive a similar benefit covering the same interest under any other

product or takaful/insurance in respect of the period for which the indemnity under this Cover shall apply.

SECTION 2: PERMANENT TOTAL DISABILITY

a. Scope of Cover

In the event of the Person Covered’s Permanent Total Disability during the Cover Period due to injury

or illness arising out of a cause not specifically excluded herein, NTF shall pay the Person

Covered’s Indebtedness as on the Date of Event subject to a maximum of AED 100,000/-.

b. Exclusions

No Benefit under this Cover shall be applicable in respect of a Person Covered where the Event

giving rise to a claim under this Cover occurs directly or indirectly as a result of:

(1) Intentional self-injury, attempted suicide (whether felonious or not), injuries contracted

or sustained while violating or attempting to violate the law, or committing an assault, or

resisting arrest; provoked assault, intoxication, influence or misuse of alcohol or drugs,

intemperance or insanity.

(2) The Person Covered engaging in or taking part or engaging in or training for any dangerous

or hazardous sports or competition; or riding or driving in any form of race or competition.

(3) The Person Covered being in or upon or entering into or alighting from or descending or

falling from aircraft of any kind other than a fully licensed standard type fixed transport

organisation providing regular air services between duly established airports in which he is

travelling as a pilot, cabin crew or fare-paying passenger.

(4) Anthrax, blood-poisoning, erysipelas, ptomaine poisoning, pyaemia, septicaemia and/or

tetanus.

(5) HIV/AIDS: No benefits shall be paid under this supplementary benefit in the event of

disability and/or incurred medical expenses caused by an opportunistic infection, a malignant

neoplasm or suicide, if at the time of such disability and/or incurred medical expenses there is

present in the Participant an acquired immune deficiency syndrome.

I. For the purpose of this exclusion, the terms "Acquired Immune Deficiency Syndrome"

shall have the meanings assigned to it by the World Health Organization.

II. Opportunistic infection includes but is not limited to pneumocystis carina

pneumonia, organism of chronic enteritis, virus and/or disseminated fungi infection.

III. Malignant neoplasm shall include but not be limited to Kaposi’s sarcoma, central nervous system lymphoma, hairy-cell leukemia and/or other malignancies now known or which become known as immediate cause of death disability and the incurring of medicalexpenses in the presence of acquired immune deficiency.

IV. Acquired Immune Deficiency Syndrome shall include HIV (Human Immune

Deficiency Virus), encephalopathy (dementia), and HIV (Human Immune Deficiency

Virus) Wasting Syndrome.

Subject always to the general exclusions and other terms and conditions of the Takaful Certificate

SECTION 3: HOSPITAL CASH BENEFIT

a. Scope of Cover

In the event of hospitalisation for a minimum period of 24 hours consequent upon the Person

Covered falling ill or sustaining injury arising out of a cause not specifically excluded under this

certificate after the Commencement Date and during the certificate period, NTF shall pay a daily

indemnity of AED 200 per person subject to a maximum of 60 days

b. Exclusions

No Benefit under this Cover shall be applicable in respect of a Person Covered where the Event

giving rise to a claim under this Cover occurs directly or indirectly as a result of:

(1) bodily injuries or medical conditions relating to accidents which occurred prior to the effective date

of this Rider with respect to the Person Covered;

(2) intentional self-injury, suicide, attempted suicide (whether felonious or not), injuries contracted or sustained while violating or attempting to violate the law, or committing an assault, or resisting arrest; provoked assault, intoxication, influence or misuse of alcohol or drugs, intemperance or insanity, venereal disease, or any physical defect or infirmity, childbirth, abortion or miscarriage, pregnancy;

(3) The Person Covered engaging in or taking part or engaging in or training for any dangerous or

hazardous sports or competition; or riding or driving in any form of race or competition;

(4) The Person Covered being in or upon or entering into or alighting from or descending or falling

from aircraft of any kind other than a fully licensed standard type fixed transport organization

providing regular air services between duly established airports in which he is travelling as a pilot,

cabin crew or fare-paying passenger;

(5) Anthrax, blood-poisoning, erysipelas, ptomaine poisoning, pyaemia, septicaemia and/or tetanus;

(6) Sunstroke, frostbite or any other effects of temperature or lowering atmospheric pressure;

Subject always to the general exclusions and other terms and conditions of Takaful certificate.

SECTION 4: INVOLUNTARY LOSS OF EMPLOYMENT

a. Scope of Cover

In the event of the Person Covered’s Involuntary Loss of Employment during the Cover Period due

to reasons not specifically excluded herein, NTF shall pay 10% of the Indebtedness as on the

Date of Event for that month subject to a maximum of AED 4,000/- or every month of

unemployment up to a maximum of 12 months.

Provided that:

No Benefit is payable for the first 30 days and if the Date of Event falls within a period

of 90 days after the Commencement Date.

Person Covered remains unemployed during the period for which the benefit

under this certificate is paid and shall provide all necessary proofs as may be called upon

by NTF in order to substantiate his unemployment.

Person Covered shall inform NTF as soon as Person Covered accepts an alternative job

within ten months period from the date of his actual unemployment. In case, it is

found that the Person Covered has been re-employed during the period he has

been taking the monthly benefits, the entire claim will be void and NTF reserves the right

to recover the full amount paid to the Person Covered as monthly benefit since the

beginning of his unemployment.

Person Covered is eligible as per the eligibility conditions provided hereunder.

b. Exclusions

No Benefit under this Cover shall be applicable in respect of a Person Covered where the event

giving rise to a claim under this Cover occurs directly or indirectly as a result of:

1. Employees of firms not approved by the Dubai First PJSC for granting of credit cards;

2. Employees who have not been continuously employed with the same employer for a minimum of

6 months;

3. Employees who are on probation;

4. Self employed person;

5. Resignation or leaving by mutual agreement or voluntary unemployment or redundancy

after voluntary breaks from employment in excess of normal holiday entitlement;

6. Disability, sickness or accident or any other medical reasons (mental and /or physical);

7. Involuntary Loss of Employment which starts within 90 days of the Commencement date;

8. Where the credit card customer was aware of pending unemployment on or before the Commencement Date;

9. Where the unemployment is a normal seasonal part of the employment or due to nonrenewal

of employment contract by the authorities;

10. Where the customer has neither been terminated nor become redundant but his/her salary

or allowances is being withheld in part or in full for any reason.

11. Unemployment due to any of the following :

a. Misconduct;

b. Refusal to accept orders from the superiors;

c. Criminal Conviction.

12. The period for which payment from the employer is received instead of working notice;

13. Payment after the customer reaches the maximum coverage Age;

14. Termination of employment due to voluntary retirement;

15. Company failure where a contributing cause was a natural catastrophic peril, war, or warlike event;

16. Emiratization.

ANNEXURE 2 – ADDITIONAL BENEFITS

1. COVERAGE

In the event of the death of a Person Covered due to any cause (accident or sickness) while covered, NTF

will, subject to the terms and conditions of the certificate, pay to the beneficiary a flat sum covered AED 75,000 2. SPECIAL CONDITIONS

a. A Person Covered is covered under the certificate if he is holding a valid primary Card issued by

Dubai First on or after the Commencement Date. A supplementary card holder i.e. Person Covered having a supplementary Card in his or her name, will not be eligible for cover under the certificate.

b. In case a primary card holder who has more than one Dubai First Card the cover will apply on the

basis of one Card only. The Person Covered will get the highest sum covered among the cards in

force.

c. In case the Person Covered withdraws from Basic Takaful Coverage, then he is not eligible for

this benefit.

d. All other terms and conditions would be similar to the Basic Takaful Coverage.

ANNEXURE 3 – TRAVEL TAKAFUL

1. DEFINITIONS

For the purpose of Travel Takaful Coverage, unless otherwise specifically defined in the Takaful Certificate,

the following terms, words and expressions shall be interpreted according to the meanings hereunder;

Checked Baggage means a piece of baggage, which was checked in and in the custody of a common

carrier and for which a claim check has been issued to the Person Covered Common

Carrier

Common Carrier means any land, water air conveyance operated under a valid license for the

transportation of passengers

Covered Medical means expenses incurred overseas due to hospitalization by the Person

Expenses Covered for services and supplies which are recommended by the

attending Physician. The coverage of medical expenses shall include the

following benefits.

(1) The services of a physician (2) Hospital confinement and use of operating room (3) Anaesthetics (including administration), X-ray examinations or treatments, and

laboratory tests,

(4) Ambulance service, and

(5) Drugs, medicines, and therapeutic services and supplies

Equipment Failure means any sudden, unforeseen breakdown in the Common Carrier’s equipment that caused a delay or interruption or normal trips

Inclement Weather means any severe weather condition, which delays the scheduled arrival or departure

of a Common Carrier

Medical Necessary means, at NTF’s sole discretion when the Physician’s recommendation is:

(1) consistent with the symptoms, diagnosis and treatment of the Person

Covered;

(2) appropriate with regard to standards of good medical practice; (3) not primarily for the convenience of the Person Covered.

Occurrence means an accident, including continuous or repeated exposure to substantially the

same general harmful condition, which results, during the certificate period in Bodily

Injury or Property Damage.

Physician means a licensed practitioner of the healing arts acting within the scope of their

license. The attending physician may not be:

(a) the Person Covered;

(b) the Person Covered’s spouse or

(c) a person who is related to Person Covered or Person Covered’s spouse, in any of the following child, parent or sibling.

Pre-existing means any condition which existed either known or unknown to the Person

condition Covered and/or to the Participant which exhibited symptoms or was a

consequence of injury or illness for which medical, surgical, and/or

pharmaceutical treatment, medical diagnosis or advice was provided or should

have provided prior to the Person’s Covered Enrollment Date.

Property Damage means Physical injury to, destruction of or loss or use of tangible property

Reasonable and means a charge which: Customary (a) i s charged for treatment, supplies or medical services medically

Charges necessary to treat the Person Covered condition

(b) does not exceed the usual level of charges for similar treatment, supplies or medical services in the locality where the expense is incurred and

(c) does not include charges that would not have been made if no takaful

coverage existed.

Residence means the dwelling where Person Covered resides

Premises .

Schedule means the schedule of benefits attached to and forming part of these terms and

conditions

Serious Injury means injury or sickness certified as being dangerous to life by a qualified

Or Sickness medical practitioner.

Sickness means an illness or disease, which first manifests itself and is contracted

while the Certificate is in effect requiring treatment by a physician.

Strike means any labor disagreement, which interferes with the normal departure and arrival

of a Common carrier.

Terrorism means the use or threatened use of force or violence against person or property, or

commission of on act dangerous to human life or property or commission of an act

that interferes with a disrupts on electronic or communication system undertaken by

any person or group, whether or not acting on behalf of or in any connection with any

organization, government, power authority or military force, when the effect is to

intimidate, coerce or harm a government, the civilian population or any segment

thereof, or to disrupt any segment of the economy

Valid means those Person Covered to whom the benefit of the certificate shall apply

as determined by Dubai First from time to time.

War means war whether declared or not, or any warlike activities including use of military

force by any sovereign nation to achieve economic, geographic, nationalistic political

racial religious or other ends.

2. TAKAFUL CONDITIONS

a. When a Person Covered buys a ticket for overseas travel using the Card, the Person Covered

is automatically covered under travel takaful benefits.

b. If the Person Covered has paid for a portion of the cost of a ticket (subject to a minimum of 50%) using the Card, the benefit payable shall be limited to the same.

c. The travel takaful benefits detailed in the Certificate are applicable for a maximum period of 60

days from the date of departure from UAE.

d. The travel takaful benefits are applicable on international travel, outside United Arab Emirates.

e. In case the Person Covered withdraws from the basic takaful coverage, then he is not eligible for

this benefit. 3. GENERAL EXCLUSIONS

The Certificate does not provide benefits for any loss resulting in whole or in part from or expenses incurred for:

a. Suicide, attempted suicide or intentionally self-infected injury or sexually transmitted

conditions, Acquired Immune Deficiency Syndrome (AIDS) Human Immune deficiency Virus(HIV)

b. Service in any armed forces or units auxiliary thereto (any takaful contribution paid to NTF for any period not covered by the Certificate while the Person Covered is in the service will be returned pro-rata)

c. Participation in any professional, semi-professional, or interscholastic team sports or any bodily

contact sport, being under the influence of drugs, alcohol intoxicants unless prescribed by a Physician

and taken as prescribed.

d. Participation in a felony, riot, crime, misdemeanour or civil commotion.

e. Participation in a contest of speed using a motorized vehicle or bicycle.

f. Operating or learning to operate any aircraft; or performing duties as a member of the crew on

the aircraft.

g. Participation in skydiving/parachuting, hang gliding, bungee jumping, scuba diving, mountain climbing,potholing or while riding on a motorcycle.

h. War, civil war, invasion, insurrection, revolution, use of military power or usurpation of government

or military power.

i. While piloting any aircraft; driving or riding as a passenger in or on (a) any vehicle engaged in any race, speed test or endurance test (b) any vehicle being used for acrobatic or stunt diving. j. Congenital anomalies k. Terrorism, including any action taken in hindering or defending against an actual or expected incident of Terrorism l. The use, release or escape of nuclear materials that directly or indirectly results in nuclear reaction

or radiation or radioactive materials.

m. The dispersal or application of pathogenic or poisonous biological or chemical materials; or

n. The release of pathogenic or poisonous biological or chemical materials. 4. BENEFIT DETAILS

SECTION 1: COMMON CARRIER ACCIDENTAL DEATH AND DISABILITY

NTF will pay the principal sum shown in the Schedule if injury to the Person Covered results in loss of

life, permanent total disability, loss of limb or loss of sight, and injury must occur while the Person

Covered is riding as a passenger in or on boarding or alighting from a Common Carrier whilst an

international travel and the ticket must be purchased using a Card. The loss of life must occur within

180 days of the date of the accident which caused injury.

SECTION 2: FLIGHT DELAY

NTF will pay benefits for flight delay, subject to the maximum shown in the schedule, if the Person Covered’s flight is delayed for four or more hours due to a covered hazard. Benefits are subject to per hour maximum shown in the Schedule up to a maximum of eight hours of delay.

a. Covered hazards

Delay of a Common Carrier caused by Inclement Weather.

Delay due to Strike or other job action by employees of a Common Carrier scheduled to be used

by the Person Covered; or

Delay caused by Equipment Failure of a Common Carrier.

b. Exclusions

Any delay due to a Covered Hazard, which was made public or known to the Person Covered prior

to the purchase of the ticket.

SECTION 3: BAGGAGE DELAY

NTF will pay the Person Covered, up to the maximum stated in the Schedule, if the Person Covered’s Checked Baggage is delayed or misdirected by a Common Carrier for more than 4 hours from the time Person Covered arrives or the destination as per the ticket, other than the final destination, until the time it arrives.

The Person Covered must be a ticked passenger on a Common Carrier. Additionally all claims must

be verified by the Common Carrier who must certify the delay or misdirection.

a. Limitation

If upon further investigation it is later determined that Person Covered’s baggage checked with the Common Carrier has been lost, any amount claimed and paid to Person Covered under his baggage delay certificate section will be deducted from any payment due to the Person Covered under the baggage loss certificate section.

SECTION 4: COMMON CARRIER BAGGAGE LOSS

NTF will pay benefits if the Person Covered’s baggage which is in the care, custody and control of a Common Carrier, is lost due to theft or due to misdirection by a Common Carrier while the Person Covered is a ticketed passenger on the Common Carrier during the flight.

NTF will pay the Person Covered, up to the maximum shown in the schedule. All claims must be verified

by the Common Carrier.

The maximum amount to be reimbursed per bag is 50%. A combined maximum limit of 10% of the

amount stated in the schedule is applicable for the following: jewellery, articles consisting in whole or in

part of silver, gold or furs, articles, trimmed with or made mostly of fur, and cameras, including

camera equipment, computers and electronic equipment.

a. Limitation

Benefits for baggage and personal effects will be in excess of any amount paid or payable by the Common Carrier responsible for the loss.

Benefits for baggage and personal effects will be in excess of all other valid and collectible

takaful/insurance.

If at the time of the occurrence of any loss there is other valid and collectible takaful/insurance in

place, NTF will be liable only for the excess of the amount of loss, over the amount of

such other takaful/insurance, and any applicable deductible.

b. Exclusions

Benefits will not be provided to any loss of :

i. Animals, birds, or fish;

ii. Automobiles or automobile equipment, boats, motor, trailers, motorcycles or other

with a Common Carrier

iii. Household furniture

iv. Eyeglasses or contact lenses

v. Artificial teeth or dental bridges

vi. Hearing aids

vii. Prosthetic limbs,

viii. Musical Instruments

ix. Money or Securities

x. Tickets or documents

xi. Perishables and consumables.

Benefits will not be provided for any loss resulting (in whole or in part) from

i. Wear and tear or gradual deterioration

ii. Insects or vermin iii. Inherent vice or damage

iv. Confiscation or expropriation by order of any Government or Public Authority

v. Seizure or destruction under quarantine or custom regulation

vi. Radioactive contamination

vii. Usurped power or action taken by governmental authority in hindering combating or

defending against such an occurrence

viii. Transporting control band or illegal trade

ix. Mysterious disappearances

x. Breakage of brittle or fragile articles, cameras, musical instruments radios, and similar

property

SECTION 5: EMERGENCY MEDICAL ACCIDENT AND SICKNESS EXPENSES

NTF will reimburse expenses arising out of hospitalization as per terms in the schedule of benefits subject to any deductible for covered medical expenses incurred overseas by the Person Covered which are not due to a pre-existing condition up to the maximum stated in the Schedule of Benefits for the treatment of an Injury or Sickness sustained by the Person Covered while this certificate is in effect. All expenses must be incurred within 26 weeks of the date the Person Covered’s coverage terminates as determined by Dubai First from time to time.

a. Limitations

Benefits will not be provided for any loss or expense incurred after or upon return to the Person Covered’s country of residence.

b. Medical Cover Exclusions

Services, supplies or treatment, including any period of Hospital confinement, which were

not recommended, approved and certified as Medically Necessary by a Physician;

Routine physicals or other examinations where are no objective indications or impairment in

normal heath and laboratory diagnostic or X-ray examinations except in the course of a

disability established by the prior call or attendance of physician;

i. Elective, cosmetic or plastic surgery, except as a result of an accident;

ii. Dental care, except as a result of injury to sound natural teeth caused by accident while

the Certificate is in effect ;

iii. Congenital anomalies and conditions arising out of or resulting there from;

iv. Expenses incurred in connection with weak, strained or flat feet; corns, calluses or toenails;

v. The diagnosis and treatment of acne;

vi. Deviated septum, including sub mucous resection and /or other surgical correction thereof

vii. Organ transplants that competent medical professionals consider experimental;

viii. Everyday child care including exams and immunizations;

ix. Expenses which are not exclusively medical in nature;

x. Eyeglasses, contact lenses, hearing aids, and examination for the prescription or fitting

thereof, unless or Sickness has caused impairment of vision or hearing;

xi. Treatment provided in a government Hospital or services for which no charge is normally made

xii. Mental nervous or emotional disorders or rest cures;

xiii. Pregnancy and all related conditions, including services and supplies related to the diagnosis

or treatment of infertility or other problems related to inability to conceive a child; birth

control, including surgical procedures and devices;

xiv. Pre-existing Condition for which medical care, treatment, or advice was recommended by or received from a Physician within a two-year period preceding the effective date of cover or a condition for which hospitalization or surgery was required within a five-year period preceding the effective date of cover;

xv. Medical expenses covered under any workers compensation certificate;

xvi. Medical expenses incurred as the result of alcohol and/or drug abuse, addiction or overdose.

SECTION 6: PERSONAL LIABILITY

a. Property Damage

If a claim is made or a suit is brought against the Person Covered for Property Damage caused by an

Occurrence to which this cover applies, NTF will pay to the amount stated in the Schedule towards

the damages for which the Person Covered is legally liable

b. Medical Payment to Others

NTF will pay the necessary medical expenses that are incurred or medically ascertained within one year from the date of accident causing Bodily Injury. Medical expenses reasonable charges for medical, surgical, X-ray, dental, ambulance, hospital, professional nursing, prosthetic devices and funeral services. This cover does not apply to the Person Covered or regular residents of the Person Covered’s household. As to others, this cover applies only if the Bodily Injury is caused by an act of or omission of a Person Covered.

c. Exclusions

i. Liability which is expected by or intended for the Person Covered

ii. Liability arising out of or in connection with a Business (includes trade, profession or

occupation) engaged in by the Person Covered. This exclusion applies but is not limited to an

act or omission, regardless of its nature or circumstance, involving a service or duty rendered,

promised, owned or implied to be provided because of the nature of the Business

iii. Liability arising out of the rental or holding for rental of any part of any premises by the Person

Covered

iv. Liability arising out of the rendering of or failure to render professional services

v. Liability arising out of a premises, water craft or aircraft that is owned by, rented to or rented

by Person Covered

vi. Liability arising out of the ownership maintenance use loading or unloading of motor vehicles,

all other motorized land conveyances, water craft or aircraft

vii. Liability arising out of the transmission of a communicable disease by the Person

Covered.

viii. Liability arising out of sexual molestation, corporal punishment, or physical or mental

abuse

ix. Liability arising out of the use, sale, manufacture, delivery, transfer or possession by any person

of a controlled substance or control band as defined by any appropriate authority

x. Liability under any contract or agreement.

xi. Property Damage to Property owned by the Person Covered.

xii. Property Damage to property rented to occupied or used by or in the care of the Person

Covered.

xiii. Bodily Injury to any person eligible to receive any benefits voluntarily provided or required to

be provided by the Person Covered eligible to receive any benefits voluntarily provided or

required to be provided by the Person Covered under any Workmen’s Compensation law,

non-occupational disability law or occupational diseases law; or Legal actions raised by any

family member or travelling companion or family member of a travelling companion against the

Person Covered.

SECTION 7: EMERGENCY ASSISTANCE AND EVACUATION

The Emergency Assistance Service will provide the following Services as described below.

a. Medical Assistance

As soon as the Assistance Service is notified of a medical emergency resulting from accident or sickness to the Person Covered, the Emergency Assistance Service will contact the medical facility or location where the Person Covered is located and confer with the Physician at the location to determine the best course of action to be taken. If possible and if appropriate, Person Covered’s family Physician will be contacted to help arrive at a decision as to the best course of action to be taken. The Emergency Assistance Service will then organize a response to the medical emergency, doing whatever is appropriate, including, but not limited to, recommending or securing the availability of services of a local physician and arranging hospital confinement of the Person Covered where, in its discretion, the Emergency Assistance Service deems such confinement appropriate.

b. Medical Evacuation

When in the opinion of the Emergency Assistance Services medical panel, it is judged medically appropriate to move the Person Covered to another location for treatment or return the Person Covered to the Person Covered’s residence or country of citizenship, the Emergency Assistance Service will arrange the evacuation, utilizing the means best suited to be so, based on the medical evaluation of the seriousness of the Person Covered’s condition, and these means may include air ambulance, surface ambulance, regular airplane, railroad or other appropriate means. All decision as to the means of transportation and final destination will be made by the Emergency Assistance Service.

c. Repatriation

The Emergency Assistance Service agrees to make the necessary arrangements for the return of Person Covered’s remains to the Person Covered’s country of citizenship in the event Person Covered dies while this service agreement is in effect as to the Person Covered.

d. Legal Assistance

If the Person Covered is arrested or is in danger of being arrested as the result of any non-

criminal action resulting from responsibilities attributed to the Person Covered, the Emergency

Assistance Service will, if required, provide the Person Covered with the name of an attorney who can

represent the Person Covered in any necessary legal matters.

e. Lost Luggage or Lost Passport

If the Person Covered, outside the Person Covered’s country of residence, notify the

Emergency Assistance service that Person Covered’s luggage or passport has been lost,

the Emergency Assistance Service will endeavor to assist the Person Covered by contacting the

appropriate authorities involved and providing direction for replacement.

f. General Assistance

The Emergency Assistance Service will serve as a central point for translation and communication for the Person Covered during emergencies. The Emergency Assistance Service agrees to provide to the Person Covered advice on the contacting and using services available from consulates, government agencies, translators and other service providers that can help with travel problems. In addition, the Emergency Assistance Service will provide takaful/insurance coordination, verifying coverage of Person Covered, guaranteeing payment to the medical provider based on the confirmation of benefits, a charge to Card (s) and coordinating the payments, documentation and translation to ease claim filing when Person Covered returns to place of residence.

g. Pre-Departure Services

Prior to the Person Covered departure, the Emergency Assistance Service will provide hazard information about foreign locations, information about immunization requirements and passport or visa requirements, general information about whether and State Department and Private Service warnings about travel to certain locations. The Emergency Assistance Service will also arrange for special medical care en-route (i.e. dialysis, wheelchairs etc.).

h. Emergency Travel Agency

The Emergency Assistance Service agrees to provide the Person Covered with 24-hour travel agency service for airline and hotel reservations. The Emergency Assistance Service will also arrange payment to the Person Covered’s airline tickets and other travel services, using Person Covered’s Cards. Prepaid ticket pickup at airline counters or ticket delivery by mail or courier will also be arranged by Emergency Assistance Service for the Person Covered.

i. Emergency Cash Transfers and Advances

The Emergency Assistance Service will arrange for cash payments to the Person Covered through a

variety of sources, including Cards, hotels, banks, consulates and Western Union. The

Emergency Assistance Service provides this service to supplement the facilities to the Person

Covered’s Cards. Card transactions performed by the Emergency Assistance Service are subject to

confirmed credit.

j. Disclaimer of Liability

In all the cases the medical profession or any attorney suggested by the Emergency Assistance Service shall act in a medical or legal capacity on behalf of the Person Covered only. The Emergency Assistance Service assumes no responsibility for any medical advice or legal counsel given by the medical professional or attorney. The Person Covered shall not have any recourse to the Emergency Assistance Service by reason of its suggestion of a medical professional or attorney or due to any legal or other determination resulting there from

The Person Covered is responsible for the cost of services arranged by the Emergency Assistance Service on behalf of the Person Covered or a covered family member. The Emergency Assistance Service will access this certificate and/or other takaful/insurance certificate benefits, to which the Person Covered may be entitled, and/or Person Covered’s Cards or other forms of financial guarantees provided by the Person Covered, in order to facilitate payment of such services.

This takaful coverage has been underwritten by Noor Takaful and is subject to Terms and Conditions which may change from time to time with immediate effect.

5. TRAVEL TAKAFUL – SCHEDULE OF BENEFITS

a. The Schedule of Benefits below is applicable along with detailed cover in the brochure which is

available at (any branch or office at Dubai First)

b. Family in this section means more than one Person Covered, i.e. two members or more of immediate family whose ticket has been purchased by using a Dubai First Titanium Life credit card. c. Benefit for Family under covers (b), (c) and (d) are applicable when the family members are traveling

expense incurred.

ANNEXURE 4 – CLAIMS

1. CLAIMS PROCEDURE AND SETTLEMENT

Notice of Claim

Written notice of an occurrence upon which a claim under this Takaful Certificate may be based must be given

to NTF within ninety (90) days of such occurrence. Notice given by or behalf of the Person Covered t o NTF

with particulars sufficient to identify the Person Covered, shall be deemed to be notice to NTF.

Proof of Loss

NTF, upon receipt of such notice, will furnish forms for filling proof of loss. The forms must be completed and

returned to NTF within ninety (90) days after the date of the loss for which claim is made. Failure to

furnish notice or proof of loss within the time limits required above shall not invalidate or reduce any claim if

it shall be shown not to have been reasonably possible to give such notice or proof and that notice and proof

were given as soon as was reasonably possible.

Examinations

NTF shall have the right and opportunity through its medical representative to examine the Person

Covered when and so often as it may reasonably require during the pendency of a claim hereunder and, in

case of death, to investigate the circumstances of death, to examine the body and unless prohibited by law,

to request or order an autopsy either before or after burial.

Payment of Claim

Any payment of claim under this Takaful Certificate shall be paid to the Dubai First as Participant,

unless specifically mentioned by Dubai First to pay directly to the Person Covered or beneficiaries.

2. CLAIMS DOCUMENTATION

SECTION 1: DEATH BENEFIT

The Person Covered or the Person Covered’s legal personal representative shall submit the

following documents:

a. NTF Claim Form

b. Certified Death Certificate issued by a competent authority in the relevant jurisdiction.

c. Certified copy of ID / Passport for proof of identity and age of the Person Covered

d. Medical Report (*) issued by attending medical officer confirming the cause of death

e. Police report will be required if death is due to an accident

f. Post mortem report (wherever legally required)

g. Claim Discharge Form.

All papers as indicated above (*) may be required to be produced in original other than those surrendered to the authorities or Employer for verification before the final settlement of claim.

SECTION 2: PERMANENT TOTAL DISABILITY AND HOSPITAL CASH BENEFIT

The Person Covered or the Person Covered’s legal personal representative shall submit the

following documents:

a. NTF Claim Form

b. Certified copy of ID / Passport for proof of identity and age of the Person Covered

c. Medical Report (*) issued by attending medical officer confirming the cause of Disability, the nature

and extent of the disability

d. Police report will be required if disability is due to an accident e. Discharge summary for

Hospitalization Benefit

f. Claim Discharge Form. All papers as indicated above (*) may be required to be produced in original other than those surrendered to

the authorities or Employer for verification before the final settlement of claim.

SECTION 3: INVOLUNTARY LOSS OF EMPLOYMENT (ILOE)

The Person Covered or the Person Covered’s legal personal representative shall submit the

following documents:

a. NTF Claim Form

b. Certified copy of ID / Passport for proof of identity and age of the Person Covered

c. Notice of termination from Person Covered’s Employer d. Salary slips for the 3 months preceding date of notice of termination

e. NTF may also request for a copy of the labour contract from Employer if it is required to verify the

period of employment contract

f. Claim Discharge Form.

SECTION 4: TRAVEL TAKAFUL

The Person Covered or the Person Covered’s legal personal representative shall submit the

following documents:

a. NTF Claim Form: the Claim form that the Person Covered needs to complete shall be furnished to the Card Holder by NTF on notification of a potential claim

b. Certified copy of ID / Passport for proof of identity and age of the Person Covered

c. Supporting Documents: Original copies of the supporting documents as mentioned in each

takaful benefit section must be submitted along with the claim form

d. Claim Discharge Form.
