1.2 Driver Responsibilities

TheHealth&SafetyatWorkAct1974requiresyou,asanindividual,andadriver,toensurethatsofarasreasonablypracticableyouensurethatthehealth,safetyandwelfareofyourself,otheremployeesandmembersofthepublicarenotputatriskbyyourworkrelatedactivitiesandactionswhendriving.Itistherefore,anessentialrequirementthatyoudriveandoperateyourvehiclewithintheparametersoftheLaw,HighwayCodeandApprovedCodesofPractice,astheCouncilwillnotcondoneemployeesbreakingthelaworputtingpeopleatriskofinjuryunderanycircumstances.

WhendrivinganyCouncilvehicleoranyvehiclehired,youmustensurethatyoupossessanappropriatecurrentdrivinglicenceand/orcertificateofcompetence.

Youshouldalwayskeepwithinthelaw,e.g.itisanoffencetouseadefectiveorexcessivelydirtyvehicle.Youmustkeepwithinthespeedlimits,donotoverloadvehicles,alwaysparksafelyandensurethatyoudonotexceedyouralloweddrivinghours(furtherdetailsonthesetopicsarelistedundertherelevantparagraphs).

Ifyoutransportfuelincans,youmustensurethecansareofanapproveddesignandareproperlysecuredandthatyoudonotexceedthevolumeyoushouldbetransporting.Ifyouareunsureofthemaximumallowedamount,contactyourlinemanager or FTS.

Thislistisdesignedtomakeyouthinkaboutyourdrivingresponsibilitiesandisnotexhaustive.However,ifyouareindoubtaboutyourlegalobligations,pleasedonothesitatetocontactanFTSmemberofstaff,whowillgladlyhelp.

Management Responsibilities

Departmentalmanagersareresponsiblefortakingallnecessaryactionstoensurethesafetyofdriversandvehicleswithintheirdepartment,aswellasthesafetyoftheroad going public. Supervisors / Team leaders with driver/vehicle responsibilities are also included.

Infringementofanydriving,vehicleoroperatingrequirementwhilstatworkcouldresultinaprosecution(includingendorsementanddisqualificationfordrivers)orfineforthedriver,andtheirresponsiblemanager.FordriversofvehicleswhichoperateundertheCouncil’sOperator’sLicence(“OLicence”)thiscouldalsoresultinsuspension or revocation of the Councils O Licence which would prevent the Council fromdeliveringitsservices.Inallcases,thedriverand/ormanagermaybesubjecttodisciplinaryactionforcontraveningdriving,vehicleorsafetyrequirements.

TheHealth&SafetyatWorkAct1974andtheManagementofHealthandSafetyatWorkRegulations1999placealegaldutyonemployerstoensure,asfarasisreasonablypracticable,thehealthandsafetyofallemployeeswhileatwork.Bothpiecesoflegislationrequireriskassessmentsandriskmanagementpriortocarryingoutaworkactivity.Suchriskassessmentsshouldincludereferencetodrivingasahazardifitformspartoftheworkingactivity.Controlmeasuresthatareapplicabletodriving are covered within this document.

1.3 Driving Licence Categories

Driversmustensurethedrivinglicencecategoryentitlementtheyholdallowsthemtooperateanylegalvehicleandtrailercombinationthatmaybeusedtocarryouttheirduties.

All licences issued after April 1991 show entitlement in the categories and sub categories listed below. Equivalent entitlements issued before that date are listed in thethirdcolumn.MaximumAuthorisedMass(mam)isthesameas,MaximumGrossWeight(mgw)andmeansthemaximumthevehicle/trailercanlegallyweighwhenfullyloaded,regardlessoftheactualweightofthevehicle/trailer.

Themaincategoriesofentitlementaresetoutasbelow:

Light Vehicles and Quad Bikes

Category B1Youcandrivemotorvehicleswith4wheelsupto400kgunladenor550kgifthey’redesignedforcarryinggoods.

CarsCategory BYoucandrivevehiclesupto3,500kgMaximumAuthorisedMass(MAM)withupto8passengerseats(withatrailerupto750kg).Youcanalsotowheaviertrailersifthetotalweightofvehicleandtrailerisn’tmorethan3,500kg.Youcandrivemotortricycleswithapoweroutputhigherthan15kWifyouareover21yearsold.

1.4 Driver CPC

On27thMarch2006,thememberstatesoftheEuropeanUnionagreedonthenewrules for driving licences in Europe. European legislation requiring a Driver CPC qualificationinadditiontoadrivinglicence,appliestonewdriversacquiringaPCV(PassengerCarryingVehicle)licencefrom10September2008andforthosedriversacquiringaLGV(LargeGoodsVehicle)licencefrom10September2009.

Thosewhoalreadyholdavocationallicencebeforethesedateswillbegivenacquired‘grandfather’rightsfor5years;however,alldriversmustcomplete35hoursperiodictrainingeveryfiveyears.

What is the purpose of Driver CPC?

● Aims to maintain high driving standards

● Improveroadsafety–accidentreduction

● Increasefuelefficiency

● Reduction in maintenance costs

● Improve image of the authorities

Drivers who do not complete the Driver CPC training throughout their career and/ordonotcarrytheirqualificationcardwiththematalltimesonceissuedriskfixedpenaltyfinesandupto2yearsimprisonmentintheeventoffraud.

1.5 Operator Licensing

● TheOperatorsLicenceisgovernedbyGoodsVehicles(LicensingofOperators)Regulations 1995.

● Operators of most good vehicles over 3.5 tonnes maximum permissible weight mustholdanOperator’sLicencetocoverthesevehicles.

The3typesoflicencesare: 1.RestrictedLicence(OrangeDisc) 2. Standard Licence (Blue Disc) – The Council operates under this licence 3.StandardInternationalLicence(GreenDisc)

The colour of the O Licence disc indicates the class of licence under which a vehicle isoperating.BeforeanOLicenceisgrantedtheTrafficCommissionermustbesatisfiedthatthevehicleswillbeoperatedandmaintainedsafelyandlegally.

Whenvehiclesarenotinuse,thepremiseswheretheyarenormallykeptarereferredto as an Operating Centre. Applications to use one or more Operating Centres have tobesubmittedtothelocalTrafficAreaforapproval.

Environmental factors are considered upon submission and conditions to limit environmentalimpactmaybeimposed.Wemustgiveassurancesandhaveproceduresinplacetoensurethat:

● Thereisanominatedpersonresponsibleforthetransportoperations,whowillbeprofessionallycompetent(i.e.CPCholder)andbeofgoodrepute.

● Wehaveoperatingcentressuitableforthenumberofvehicles,bearinginmindsize,locationandaccessofthesites.

● Wehaveproperarrangementstoensurewemeetalllegalobligationswhichincludedrivers’hour’srules/speedlimits.

● Wehavepropermaintenancefacilitiesofourownwithsufficientfundstokeepvehiclesfitandserviceable.

Penalties

● TheTrafficCommissioners(TC)maytakeactionagainstthelicenceholdersifobligationsarenotfulfilled.

● TCwillconsidertheoperators/driversconvictionsinrelationto:

— Drivers’hours. — Records. — Overloading. — Trafficoffences. — AnyspotcheckstakenplacebyDriver&VehicleStandardsAgency(DVSA)

Ultimatelythiscanleadtodisciplinaryactionintheformof:

— AformalwarningresultingintheOLicencebeentemporarilysuspended. — Complete withdrawal of the O Licence. — Impounding vehicles used without an operators licence. — Imprisonment of both driver and operator.

2. Operating Your Vehicle

2.1 Driver Awareness Training

Beforeanemployeemaybeauthorisedtodriveavehicleorplantequipmenttheymustundergoformal vehicle familiarisation training and assessmentonthevehicle(s)theyarerequiredtodrive.

Theinstructionandassessmentistobecarriedoutandrecordedbyanappropriatelyqualifiedorexperiencedmanagerorperson.Postfamiliarisationtraining,aspartofacommitmenttodevelopasafedrivingculturewithintheCouncil,managersarerequiredtomonitordriveractivitiesandinvestigateanyincidentsandtakeappropriateactionwherenecessary.WhereconcernsareraisedmanagementmayrequestafurtherassessmentconductedbyFTSassessors.Safe&FuelEfficientDriving(SAFED)isalsoavailable.

2.2 Collecting Vehicles from FTS

AsanemployeeoftheCouncilwhocollectsavehicle,eitherneworreplacement,itisimportantthatyouarefamiliarwiththevehiclecontrolsandareawarehowtocarryoutdailyandweeklychecks.Therefore,amemberofFTSwillundertakea‘commissioningexercise’andprovidedocumentationtoconfirmthatyouhavebeenshownandarefamiliarwiththevehicleequipmentandnecessarychecksbeforeavehicleisreleasedintoyourcare.Thecontentsofthisexercisewillinclude:-

— Howtochecklubricantandfluidlevels — Checkingofsafetycriticalitemse.g.lightsandtyres — Vehiclemaximumloadcapacities,heightandwidths — Vehicle fuelling and locations — Provisionofvehicleandindividualfuelkey(whereapplicable).

2.3 Fuel Efficiency

Fuelisamajorcostwhenoperatingalargefleet.Asoperatorsweneedtoimproveconsumptionthiscanbedonebyeffectiverouteingandhavingplannedmaintenanceregimes in place.

As a driver beingfuelefficientincludes:

● Alwayscarryoutdefectschecks,whichincludesuchitemsastyrepressuresandfuelleaksthatcanadverselyaffectthe fuel consumption.

● Know the characteristics of the engine inyourvehicleandemploy driving techniques to get the most out of it.

● Accelerateandbrakesmoothly,readingthe road ahead.

● Use the correct gear for the given situation and block change as appropriate.

● Use engine/exhaust brake where possible.

● Adhere to speed limit.

● Stop engine when parked or loading/unloading if possible.

2.4 Recording of Drivers Hours

2.4.1 Applicable Vehicles

It is a legal requirement that vehicles over 3,500kgsandcertainPassengerCarryingVehicle(PCV),driversmustkeeprecordsoftheirdrivinghour’sinlinewithcurrentEuropeanand Domestic Driving Hours Regulations. Consequentlydriverswillberequiredtousedigital and analogue tachograph recording equipment,orcompleteamanuallog.FTSwillneedtobesatisfiedthatdriversarecompetentto use this equipment and are able to complete thedrivers’log.Wherenecessary,trainingand advice will be provided at driver induction or onset of vehicle hire and as a continuous process as legislation changes.

2.4.2 EU Drivers Hours Regulations – Tachographs / Digital Driver Card

ForGoodsandPCVvehiclesunderthiscategory,tachographrecordingchartsordigitaldrivercardinformationmustbekeptinlinewithEUDriversHoursRegulations,regardlessifavehicleisonlyusedinfrequentlyandforshortdistances,(trainingwillbeprovidedbyFTS).

2.4.3 Domestic Drivers Hours Regulations – Drivers Log Book

CertainlocalCouncilGoodsVehiclesareexemptfromEUDriversHoursRegulationsinthattheyareclassed‘underexemption’asDomesticDriversHoursRegulations.Inthisinstance,driversarelegallyrequiredtocompleteadriverslogbook(trainingwillbeprovidedbyFTS).

2.4.4 Breaks from Driving

ThedrivingandrestlimitsfordriversworkingunderEuropeanUnion(EU),UKDomesticandWorkingTimearecoveredbyvariousdirectivesandlegislation.ThesearecomplexandthereforemonitoredcarefullybybothoperationaldepartmentsandFleet&TransportServices(FTS)toensurecomplianceandtosafeguardtheCouncil’sOperatorsLicenceandgoodrepute.

ToprovideflexibleandresponsiveservicestheCouncilutilisesderogationsfromEUdrivers’rulestooperateunderUKDomesticrulesinsomedepartments.Ananomalyofthisisthatitcomplicatesadriver’srestrequirementfordutyperiod’sexceeding9hours.TheCouncilthereforeprovidesapolicyonthematterwhichstipulatesminimum compliance requirements for Council departments/drivers.

Toprotectdrivers,operationaldepartmentsandtheCouncil’sOLicenceandtoensureconsistency,alldepartmentsoperatingunderUKDomesticrulesaretorefreshorcreateadocumented“DriverSafetyPolicy”whichincorporatesCouncilpolicyandthefollowing:

1. The minimum drivers rest period when driving under UK Domestic Rules is 30 minuteswhendutytimereaches6hours,45minutesbetween6hoursand9hoursand60minutesforover9hourswithamaximum11hourdutyperiod.Breaksaretobesplitevenlyovertheworkingdaywiththelastperiodtakenbefore the 10th hour. Breaksarenotincludedintotaldutytime.

2. Ascheduleofwork/breaksinaccordancewiththeirspecificorlikely serviceoperation(s).

3. Thehours,breaksandrestdaysofdriverswhoworkovertime,provide emergencycalloutprovisionand/orworkoutsidetheAuthoritymustbe recorded and accounted for.

4. Forserviceswhichprovideanemergencyprovision(e.g.gritting),tobeconsideredanemergencyaneventshouldbeboth“unforeseeableandunforeseen”.Evenifutilisingemergencyprovisionmanagersmustprovidesufficientbreaksandrestbetweenshiftstoensuresafety.

2.4.5 On the Spot Fines and Penalty Points given by DVSA

DVSAexaminersarenowissuingfixedpenaltiestodriversforinfringementsdetectedduringroadsideenforcementchecksandofficialscannowissuepenaltiesto unsafe vehicles at the roadside. Thisfurtherenforcestheneedtocarryoutdailydefectchecksbeforedrivingavehicle.

Previously,onlypoliceofficerswereabletoissuefixedpenaltiestodriversforroadtrafficoffences.ThesepowershavebeenextendedtoDVSAexaminersandfixedpenaltieshavethemselvesbeenextendedtoapplytomoreoffences,suchasdrivers’hoursanddrivercertificationinfringements.

2.5 Driving Controls

Itisimportantthatyouareawareandarefamiliarwiththecontrolsandcomponentsofyournewvehiclesothatyoucandrivesafelyandensurethatyouknowhowtoundertakeroutinedailyandweeklydriverchecks.ThereforewhencollectinganewCouncilvehiclefromFTS,amemberofstaffwillprovideyouwith:-

● Basic control and component familiarisation

● A comprehensive vehicle handbook

Onreceiptoftheabove,youwillbeaskedtosignappropriatedocumentationconfirmingthistraininghastakenplacebeforethevehicleisreleased.

Whenchangingavehiclefromyourexistingfleetvehicletoanewreplacementyouwillreceiveavehiclehandbookandavehiclefuelkey.Youwillberequiredtoreturnthehandbookandrelevantvehiclefuelkeyfromyouroriginalvehicle.

2.6 In – House Vehicle Fuelling

TheCouncil’scomputerisedfuellingsystemismanagedbyFTS.Thisalsoincludesdispensingandmonitoringof‘Adblue’fueladditiveusedtolowerexhaustemissioninline with current & forthcoming legislation.

2.7 External Fuelling Procedures

DepartmentsthatdonotusetheCouncil’sin-housefuellingprovisionmaybeabletonegotiate external fuelling arrangements via FTS.

3. Driver Responsibilities

3.1 Daily/Weekly Vehicle Checks

Beforecommencingyourdailyworkrelatedactivities,asthedriver,itisyourlegalresponsibilitytoundertakedailyandweeklychecksonyourvehicletoensurethatitemsareserviceableandoperatingwithinthelawanddefectsareimmediatelyreported to FTS vehicle workshop reception (see 3.7 for reporting of defects).Belowisasampleofitemstobechecked,refertodefectrecordbookforcomprehensive itemised checklist.

3.1.1 Daily Checks

— Check audible and visual warning devices — Checkengineoil,topupifnecessary — Checkenginecoolantlevel(water),topupifnecessary — Checkobligatorylightsareworking — Check windscreen wipers and washers are working — Checkconditionofwheelsandtyres,wheelnutsforsecurity(visually) — Ensureidentificationnumberplateandfleetnumbersarecleanandvisible — Checkbrakefluidlevel — Checkentrances,emergencyexitsandpassengerstepsarefunctional — Checkfireprotectionequipment(iffitted) — Check auto gearbox oil level where accessible — Visuallylookaroundthevehicleforanyobviousdamageorprotrusions

3.1.2 Weekly Checks

3.1.3 Consumables/Levels – Tyre Information

Youcanobtainallvehicleconsumables,e.g.oils,antifreezeandbulbs,etc.fromFTSvehicleworkshop:ShearbridgeRoad,Bradford.

Minimum legal tyre tread depths:

1. VehiclesandPCVsconstructedtocarrynomorethan8passengers,uptoandincluding3500kgs–tyretreadshallbeminimumof1.6mmdepthinacontinuousbandaroundthetyrecircumferenceoverthecentral¾ofthetreadbreadth

3.2 Vehicle and Load Security

Adequatesecurityandimmobilisersarefittedwhenvehiclesareinitiallysupplied.However,ifyouconsiderextrasecurityisneededduetoloadcarried,pleasespeaktoyourlinemanager/supervisorandifagreed,FTSwillgladlyfitadditionalsecurity.

ItisaconditionoftheCouncil’svehicleinsurancepolicyandgoodriskmanagementpracticethatbeforedriversleavetheirvehiclesunattended,theyarerequiredtolockvehiclesandensurethesecurityofloadsandequipment.Undernocircumstancesshouldyouleavekeysinyourvehiclesignitionwhilstunattended.(Unlessoperationallyrequired)

Theinsurancepolicydoesnotcoverthelossofpersonalbelongingsthereforepersonalitemsarecarriedatyourownrisk.

3.2.1 Use of Trailers

Beforetowingatrailercheckthatthetowingattachmentissuitable,andthatthetrailerlights,breakawaycableandbrakesareoperatingcorrectly.Ensurethetrailerdisplaysthenumberplateofthetowingvehicle.Driversshouldensurethatthetrailer is capable of being towed and that the laden weight does not exceed 80% ofthetowingvehicle.TheMaximumAuthorisedMass(MAM)ofthevehicleandtrailercombination,includingthemaximumloadthatcanbecarriedsafelywhenit’sbeingusedontheroad,mustnotbeexceeded(detailswillbefoundinthevehiclehandbookandonthevehicledataplate).

3.3 Stolen/Vandalised Vehicles

Intheunfortunateeventofyourvehiclebeingstolenorbrokeninto,youmustadvisethePoliceandyourlinemanager/supervisorimmediatelyfollowedbyreportingtheincident to FTS and completing the appropriate insurance report forms.

3.4 Passengers/Load Capacity

TheCouncilwillnotunderanycircumstancecondonevehiclesbeingusedillegallywithregardstooverloading/carryingpassengers.Regardlessofthetypeofvehicleusedandtheloads/passengersyoucarry,itisyourlegalresponsibility,asthedriver,toensurethatpassengersaresafeandsecureandloadsarenotprotrudingbeyondthelegalmaximumandatalltimestheloadsyoucarrydonotexceedthemaximumlegallimitforthedesignandconstructionofyourvehicle.Iftheenforcementauthoritiesstopyouanddiscoverthatyourvehicleiscarryingexcessiveorinsecureloads,youwillbepersonallyliableforprosecutionwithfinesupto£5,000foreachoffence.

ForGoodsVehiclesthemaximumcarryingcapacityofvehiclesislistedonthevehicle’smanufacturersplateor‘platingcertificate’.PassengerCarryingVehicleswillshowmaximumcapacityinsidethevehiclesaloon,howeverifindoubt,yourfirstpointofcontactshouldbeFTSvehicleworkshopreception,whowillgladlyprovidethis information.

AdditionallyindividualtrainingmaybeprovidedbyFTS,whereyourlinemanagerorFTSfeelsitisnecessary.

3.5 Producing Legal Documents to the Police

ThePolicemayaskyoutoproducethenecessarylegaldocuments,i.e.vehicleMOT,insurancepolicyandyourdrivinglicence.YoucanobtaindocumentationforyourvehiclefromFTSvehicleworkshopreceptionatShearbridgeRoad,Bradford.AlldocumentsmustbereturnedimmediatelyonceyouhaveproducedthemtothePolice.

3.6 Cleaning Vehicles

InordertoreflectagoodvisualimageofBradfordMetropolitanDistrictCounciltothecommunityweserveandalsoforhealthandsafetyreasons,itisimportantthatyoukeepboththeinteriorandexteriorofyourvehiclecleanandfreeofclutteratall times. Particularattentionshouldbepaidtocabglass,drivingmirrors,numberplatesandroadlighting.

FTS provide facilities for vehicle cleaning. Please contact the vehicle workshop reception atShearbridgeRoad,BradfordorspeaktoyourLinemanager/Supervisorwhowilladviseyouonequipmentavailabletomaintainyourvehiclekeeping it in a clean condition.

3.7 Reporting Vehicle Defects

Whenyoudiscoveravehicledefect,eitherwhenundertakingyourvehiclechecksorduringyourworkrelatedactivities,youmustrecordthedefectsimmediatelyinthevehiclesdefectreportbookandinformyourlinemanager/supervisororFTSvehicleworkshopreceptionforthenecessaryrepair.Ifavehicledefectbookisnotcarriedinyourvehicle,youmustreportthedefecttothevehicleworkshopreceptionwhereyouwillbeaskedtocompleteadefectreportformforrecordingpurposes.Ifyouhavedifficultyincompletingadefectreport,thereceptionstaffwillbeonlytoopleasedtoassistyou.

3.8 Driving Standards

3.8.1 Authorised User of Vehicles An authorised user of a vehicle is a driver who has been allocated a Council vehicle orundertermsofemploymentconsideredtobeacasualcaruser.Employeesusingtheirowncaronthisbasistoundertakeworkrelatedactivities(classedasGreyFleet)willbeaskedtoconfirmthatyourvehicleisappropriatelyinsuredforbusinessuseandifsoamileagepaymentwillbemadebasedonmileagetravelled.(withinthecarmileageclaimconditions).Youwillfindsupportingdocumentationbyvisitinghttp://www.bradford.gov.uk/handsandselectingDrivingatWorkoutliningtherequirementsofdriversandmanagerswhenoperatingGreyFleet.Imageofactualwebpage is shown below containing other useful documents.

3.8.2 Legal Operation

FTSisresponsibleformanagingtheCouncil’stransportpolicyandprocedures.Asgoodmanagementpractice,anemployeewhodrivesaspartofworkrelatedactivitieswill be asked to participate in a bi-annual driving licence audit. Your licence details (includingoffences)willbetakenbyFTSforrecordpurposes.Departmentswillberesponsible for facilitating audits on behalf of FTS.

Whenundertakingworkrelatedactivitiesyoushallatalltimesoperatewithintheparametersofthelaw.TheCouncilwillnotcondoneyoubreakingthelawunderanycircumstances(e.g.speeding,overloading,etc).

3.8.3 Compliance Audits

Departmentcomplianceauditswillbecarriedoutperiodicallyandconsistof2sections – A and B. The Audits are designed to ensure vehicle and driver compliance information is consistent across all departments.

Part A (Basic)This section focuses on the requirement to ensure all vehicle related paperwork and information(Tachos/Logsheets)iskeptinthesamemanner,iseasilyaccessibleandthatdriverlicencechecksaredocumentedandfiled.PartorallofthisinformationcouldberequestedbyDVSAatanytime.

Part B (Advanced)ThissectionismoreindepthandlooksathowRTCsand08(unreporteddamage)reports have been investigated and acted upon and subsequent paperwork kept from these. It also looks at drivers hours infringements and documentation of how these were dealt with.

Departmentswillbescoredandthefrequencyofauditswillbedependentonscoreswithaminimumof2peryearforhighscoringdepartmentsthenprorataforlowerscoreswithasmanyasneededtomaintaincompliance.

3.8.4 Driving Offences

Drivingundertheinfluenceofalcoholand/orillegalsubstancesisprohibitedandifyouaresuspectedofdoingsoyouwillbesuspendedfromdrivingdutieswithimmediateeffectandinconsultationwiththeindividualemployee,HumanResourcesandline-managers,themostappropriatecourseofactiondetermined.

Ifyouarereceivingprescribedmedicationitisyourresponsibilitytoensurethatyouarecapableofdriving,howeverifindoubt,pleasespeaktoyourlinemanager/supervisor who will offer help and support.

Ifyouhavecommittedanyformofdrivingoffenceaffectingworkrelatedactivities,youarerequiredtoinformyourlinemanager/supervisor.Arecordofyouroffencewillbe taken for management purposes.

AllworkrelatedroadtrafficoffenceswillbeviewedasabreachofdisciplineandconsequentlybeconsideredbymanagementundertheCouncil’sdisciplinaryprocedures.Roadtrafficoffencescommittedoutsideworkwillbeviewedinlinewithyourabilityandsuitabilitytocarryoutyourworkrelatedduties.

Youareresponsibleforpayingalldriverrelatedfinesforanytrafficoffencescommitted. Itistheresponsibilityofdriverstoinformtheirlinemanagersimmediatelyifforanyreasontheyhavetheirlicenceremoved.

3.8.5 Smoking

Smokingisnotpermittedinanyvehicleeitherasapassengeroradriver.Anenforcementofficercaninspectyourworkareaandvehicleandifevidenceofsmoking is found then this illegal behaviour will be considered as misconduct under theCouncil’sdisciplinaryprocedure.

3.8.6 Seatbelts

Seatbeltsmustbefittedandwornincars,lightvansandasfromOctober2001,inLGVs.Exemptionstotherulesinclude:

● Carryingoutamanoeuvrewhichincludesreversing

● Holdingavalidmedicalexemptioncertificate

● Using a vehicle constructed or adapted for deliver or collection of goods or mail to make deliveries or collections which are no more than 50m apart.

3.8.7 Mobile / Smart Phone Use

● Do not use a mobile phone in amovingvehicleifyouarethedriver.

● Ifyoumustreceivecallswhilstyouaredrivingthevehicle,usea mobile phone with voicemail or call divert facilities. This wayyourphoneisswitchedoffand not a distraction. You can thencheckanddealwithyourcallswhenthevehicleissafelyparked up.

● Obeyanyspecificruleson phone restrictions e.g. when refuelling at petrol stations.

The use of mobile phones or adjusting / programming smart phones with satellite navigationapplicationsbydriverswhenavehicleisinmotionnotonlypresentsasignificanthazardtothewellbeingofthedriverandanypassengers;italsopresentsa hazard to other road users including pedestrians.

Employershaveagenerallegaldutytoensurethehealthandsafety,sofarasisreasonablypracticable,ofemployeesandotherpeopleaffectedbywhattheydo.Theymustcarryoutriskassessmentsandintroducemethodstoeliminateorcontrolsignificantrisks.Thisgeneraldutywillapplytomobile/smartphones.

TheHighwayCodecontainsthefollowingrequirement.ThisformspartoftheRoadTrafficActthereforeitisalegalrequirementandacriminaloffencetodisobeyit:

“YouMUSTexercisepropercontrolofyourvehicleatalltimes.Neveruseahandheldmobilephoneormicrophonewhendriving.Usinghandsfreeequipmentisalsolikelytodistractyourattentionfromtheroad.Itisfarsafernottouseanytelephonewhileyouaredriving–findasafeplacetostopfirst”.

From1December2003,itisanoffencetouseahandheldphonewhendriving,evenwhenstoppedattrafficlights.Don’t forget, in the event of an accident the Police will automatically check your mobile phone usage.

3.8.8 Speed Limits

Speedlimitsaresetforthesafetyofallroadusersandtheyvaryaccordingtotheclassofvehicleandthetypeofroad.Thesimplewaytoavoidspeedingpenaltiesistoknowyourlimitsanddrivesafelywithinthem.Pleaserememberthatthespeedlimitisnotatargetandyoushoulddriveatanappropriate speed for the road and weather conditions.Belowarethenationalspeedlimitswhichapplytoallroadsunlesssignsshowotherwise.

4. Vehicle Maintenance And Repairs

4.1 Scheduled Maintenance

VehicleservicingandplannedmaintenancewillbecarriedoutbyFTSvehicleworkshopatShearbridgeRoad,Bradfordunlessotherwiseagreed.UndernocircumstancesshouldyoutakeaCouncilvehicletoanunauthorisedvehiclerepairer.

Whenyourvehicleisscheduledtobeserviced,youwillbenotifiedthroughyourlinemanager/supervisor.Vehiclesnotattendingunlessbypriorarrangementwillbeissuedwitha‘prohibitionnotice’wherebythevehiclecannotbeusedotherthantoattendtheworkshopforthenecessaryworktobecarriedout.

Employeeswhousetheirownvehicleforworkrelatedactivitiesshallberequiredtoensurethattheirvehicleisproperlymaintainedandinroadworthycondition.

4.2 Unscheduled Repairs

AllunscheduledrepairswillbecarriedoutbyFTSvehicleworkshopatShearbridgeRoad,Bradfordunlessotherwiseagreed.UndernocircumstancesshouldyoutakeaCouncil vehicle to an unauthorised vehicle repairer.

Intheeventofanunscheduledrepairyouwillbeaskedtofollowthe‘ReportingVehicleDefects’procedureoutlinedatparagraph3.7 when reporting an unscheduled repair/defect.

4.3 Replacement Vehicles

Ifareplacementvehicleisrequiredwhilstyourvehicleisundergoingscheduledorunscheduledwork,youwillbeprovidedwithasuitablereplacementvehiclebyFTS.

4.4 Unreported Damage

Anydamagefoundonvehiclesthathasnotbeenreportedwillbecodedas08work(unreporteddamage)andwillbesenttodepartmentmanagerstogetherwithotherfleetinformationtohelpmonitorandmanagebudgets.Managersareexpectedtoinvestigateanyinstancesandtakeappropriateactionwherenecessary.AsmentionedpreviouslythiswillalsoformpartofthedepotcomplianceauditscarriedoutbytheFleetEnforcementOfficers.Vehiclespresentedforplannedroutinemaintenancewith08workwillmeananextendedperiodofunavailabilitytotheuserdepartment.

5. Vehicle Breakdowns

5.1 In the event of a vehicle breakdown please follow these common sense guidelines:

● Ensure where possible that the vehicle comes to a rest in a suitable place at the nearsideorawayfromthecarriageway.Thiswillminimisethedisruptiontootherroadusers.

● Ifyourvehiclebreaksdowninanoparkingareaandyouneedtoleaveittogethelp,speaktoaPoliceOfficer,TrafficWardenorParkingAttendantwherepossible,orleaveanoticeonyourwindscreen

● Dowearyourhighvisibilityclothingifavailable

5.2 Reporting Vehicle Breakdown (including tyre punctures)

AllvehiclebreakdownsandtyrepuncturesmustbereportedtoFTSvehicleworkshopreceptiondependinguponwhetheryourvehiclebreaksdownduringoroutsideworkinghours(seeworkinghourslistedatparagraph1.1ofthishandbook).

5.2.1 During Normal Working Hours

Ifyourvehiclebreaksdownoryouexperienceatyrepunctureduringnormalworkinghours,youmustnotifyyourlinemanager/supervisorandFTSvehicleworkshopreception unless otherwise instructed.

5.2.2 Outside Working Hours

Ifyourvehiclebreaksdownoryouexperienceatyrepunctureoutsideworkinghours,pleasecontacttheoutofhour’sbreakdownfacilitieslistedatparagraph1.1ofthishandbook.

5.3 Replacement Vehicles

Ifareplacementvehicleisrequiredwhilstyourvehicleisbrokendown,youwillbeprovidedwithasuitablereplacementbyFTS.

6. In case of emergency

6.1 Scene of Accident/Incident

Ifyouareinvolvedinanaccident/incident,itisimportantthatyoustayatthesceneandcooperatefullywithallconcerned.TheCouncilwouldexpectyoutodealwiththesituationascalmlyandhelpfulaspossible,andofferanyassistanceasnecessary.Noadmissionofliabilityshouldbemadeatthesceneoftheaccident.

6.1.1 Personal Injury

Wherethereisinjurytopeopleand/orlivestock,immediatelycontactthePoliceandAmbulances services if required and await their arrival.

6.1.2 Exchange Details

Notethevehicleregistrationnumberofanyothervehicle(s)involved,togetherwithnamesandaddressesofthedriver(s)andalsodetailsofanywitnesses.Usingthe2part form attached to the inside of the back cover of this handbook.

Provideyourdetailsonthelowersectionofthe2partform,whichwillthenlistsufficientinformationregardingrelevantdetailsoftheCouncil.

6.2 Reporting Accidents to Management

Informyourlinemanager/supervisoroftheaccident/incidentassoonaspracticablebutduringthesameday.InformFTSvehicleworkshopreceptionwithin1dayoftheaccident/incident.Youwillbe asked to complete an accident/incident report form for insurance purposes. Ifyouhavedifficultyincompletinganaccident/incidentreportform,Fleetvehicleworkshopreceptionstaffwillbeonlytoopleasedtoassistyouandinspectyourvehicle.

7. Specialised Vehicle/Equipment

7.1 Fork Lift Truck Driving

Asadesignatedforklifttruckdriver,youwillberequiredtoundergoinitialmandatoryand ongoing comprehensive driver training and competence assessment/certificationbeforebeingallowedtodriveaforklifttruck.FTSisresponsibleforfacilitatingandmanagingtrainingandassessmentcertification. Your line manager/supervisor will arrange with FTS this training and assessment/certification.

7.2 Winter Maintenance Vehicles

InlinewiththeCouncil’sHealthandSafetyresponsibilities,DrivingProcedures,goodmanagement practice along with the nature of the service(layingroadsalt)andthecomplexityoftheequipment,driverfamiliarisationtrainingand

assessment/certificationwillbefacilitatedbyFTStrainingsection.Thistrainingwilltakeplacepriortoyoubeingallowedtodriveandoperatewintermaintenancevehicles. Your line manager/supervisor will arrange with FTS this training and assessment/certification.

7.3 Loaders and Shovels

InlinewiththeCouncil’sHealthandSafetyresponsibilities,DrivingProcedures,goodmanagementpracticeandthecomplexityoftheequipment,driverfamiliarisationtrainingandassessment/certificationwillbefacilitatedbyFTS.Thistrainingwilltakeplacepriortoyoubeing allowed to drive and operate loaders and shovels. Your line manager/supervisor will arrange with FTS this training and assessment/certification.

8. Returning Vehicles And Specialised Equipment To FTS

8.1 Vehicle/Equipment Cleanliness

Whenyourvehicle/equipmentisduetobereturnedtoFTS,eitherforreplacementordisposal,youwillbeinformedbyyourlinemanager/supervisor.

You are required to deliver vehicles/equipment to FTS vehicle workshop reception at ShearbridgeRoad,BradfordInacleanconditionwithallrubbishandpersonalitemsremovedfromthecabandpayloadarea.
