3. This RFP is divided into five Parts as follows: -

(a) Part I – Contains General Information and Instructions for the Bidders about the RFP such as the time, place of submission and opening of tenders, Validity period of tenders, etc. (b) Part II – Contains essential details of the items/services required, such as the Schedule of Requirements (SOR), Technical Specifications, Delivery Period, Mode of Delivery and Consignee details. (c) Part III – Contains Standard Conditions of RFP, which will form part of the Contract with the successful Bidder. (d) Part IV – Contains Special Conditions applicable to this RFP and which will also form part of the contract with the successful Bidder.

(e) Part V – Contains Evaluation Criteria and Format for Price Bids.

4. Pre-Bid Vendor Conference. A pre-bid conference will be held at the office of the Command IT Officer at 1000 hrs on 21 Dec 15. Issues pertaining to the tender, specifications and any other queries sought by vendors will be discussed in detail to avoid any ambiguity. In order to obtain the requisite security clearance, the vendors are to forward the following information with regard to the participants (maximum 01 representatives per vendor). Following information is to be forwarded by email at least one day prior to the Pre-Bid Conference date:- (a) Name, Age, Address and Contact Nos. (b) Any other information relevant to the subject. 5. This RFP is being issued with no financial commitment and the Buyer reserves the right to change or vary any part thereof at any stage. Buyer also reserves the right to withdraw the RFP, should it become necessary at any stage.

Annexures to RFP

Part I- General Information

1. Last Date And Time For Depositing The Bids. The Technical and Commercial offers, in separately sealed envelopes are to be submitted to this office on or before 1230hrs on 04 Jan 16. The responsibility to ensure this lies with the Bidder. 2. Manner of Depositing the Bids. Tenders are to be submitted as two separate sealed bids viz. the Technical bid (T Bid) and the Quotation bid (Q Bid). The tenders are to be submitted in the tender box (Location mentioned below). Tenders may be submitted through Speed Post/Registered post, but will not be accepted through private couriers / fax / e-mail or by hand. This Unit will not be responsible for offers, which are not received in time or lost due to postal negligence. Tenders received late shall be out rightly rejected. The Technical and Commercial offer should be submitted on the due dates on the firm’s letter head in separate double sealed envelopes super scribing T bid/ Q bid and clearly marked “Conduct of IT Specialization Courses for Officers”. 3. Time and Date for opening of Bids. The ‘T’ bids will be opened on 04 Jan 16 at 1500 Hrs. If due to any exigency, the due date for opening of the bids is declared a closed holiday, the bids will be opened on the next working day at the same time or on any other day/time, as intimated by this office. 4. Location of the Tender Box.

(Tender box marked as ‘HQWNC/CITO’) 5. Place of Opening the Bids. The T bids will be opened in the office of Command IT Officer, Headquarters Western Naval Command, Mumbai. The bidders may depute their representatives duly authorized in writing, to attend the opening of bids on the due date and time. The Q bid will be considered on assessment of compliance/suitability after Technical evaluation of the T-bids is done by the Technical Evaluation Committee. A Technical Committee will be constituted to scrutinize/finalize the Contract. The Committee reserves the right to reject any or all the tenders without assigning any reason thereof. The ‘Q’ bid should be inclusive of all tax and levies applicable and should be submitted only as per the format given in Enclosure 4. The firm is to give an undertaking that the contract will not be subcontracted. 6. Forwarding of Bids. Bids should be forwarded by the bidders under their original memo/letter pad, furnishing details like TIN number, VAT/CST number, bank address with EFT account if applicable, etc. and complete postal & e-mail address of their office. The ‘T’ bid should conform to the following: - (a) EMD is to be enclosed.

(b) The firm should be in existence for over 3 years in the trade and should be in the business of providing IT training to PSUs/Government bodies during the last three years.

(c) The firm should have at least one training contract of Rs. 30 Lakhs or two training contracts of Rs. 15 Lakhs each in the last three years for IT training.

(d) The firm should have service business turnover of more than Rs. 70 Lakhs.

(e) The firm must have its own full-fledged training classroom in Mumbai and Goa with PCs/Laptops and Certified Trainers at both the locations.

(f) The firm must have an office in Mumbai and the firm should be ISO certified.

(g) All the firms participating in the Tender must submit a Certificate of Undertaking to the effect that the firm is neither blacklisted by any Government Department nor any criminal case is registered against the firm.

(h) Duly completed compliance grid as per Enclosure 3. Note: - Firm is to submit documentary proof of eligibility criteria viz. photocopies of registration certificates, proof of annual turnover, and copies of orders or any other documentary evidence are to be provided. In absence of these documents, the tender will not be entertained. 7. Clarifications regarding Content of TE/Modification/Withdrawal of bids. Due to paucity of time, any clarifications on the TE should be obtained by email [email protected]. The firm may modify or withdraw his bid after submission provided that the written notice of modification or withdrawal is received by the Client prior to deadline prescribed for submission of bids. A withdrawal notice may be sent by email but it should be followed by a signed confirmation copy to be sent by post and such signed confirmation should reach the purchaser not later than the deadline for submission of bids. No bid can be modified after the deadline for submission of bids. No bid can be withdrawn in the interval between the deadline for submission of bids and expiration of the period of bid validity specified. Withdrawal of a bid during this period will result in Firm’s forfeiture of bid security. However the Buyer may at its discretion ask the firm for clarification on the T bids during the technical evaluation. 8. Right of Acceptance or Rejection of Tender. Canvassing by the firm in any form, unsolicited letter, conditional tender and post tender correction may invoke summary rejection. The Competent Financial Authority i.e. Flag Officer Commanding-in-Chief, Western Naval Command, Mumbai reserves the right to accept or reject any or all tenders without assigning any reasons whatsoever. 9. Unwillingness to quote. Firms unwilling to quote should ensure that intimation to this effect reaches before the due date and time of opening of the Bid, failing which the firm may be delisted for the given range of items as mentioned in this tender Enquiry.

10. Validity of Offer. The firm’s offer should be valid for a period of 180 days from the date of opening of tender. 11. Earnest Money Deposit. Bidders are required to submit Earnest Money Deposit (EMD) of Rs 79000/- in favor of PCDA (Navy), Mumbai along with their bids. The EMD may be submitted in the form of an Account Payee Demand Draft, Fixed Deposit Receipt, Banker's Cheque or Bank Guarantee from any of the public sector banks or a private sector bank authorized to conduct government business as per Form-16 of DPM 09 (Available in MoD website and can be provided on request). EMD is to remain valid for a period of forty-five days beyond the final bid validity period. EMD of the unsuccessful bidders will be returned to them at the earliest after expiry of the final bid validity and latest on or before the 30th day after the award of the contract. The Bid Security of the successful bidder would be returned, without any interest whatsoever, after the receipt of Performance Security from them as called for in the contract. EMD is not required to be submitted by those Bidders who are registered with the Central Purchase Organization (e.g. DGS&D), National Small Industries Corporation (NSIC) or any Department of MoD or MoD itself. The EMD will be forfeited if the bidder withdraws or amends impairs or derogates from the tender in any respect within the validity period of their tender.

Part II- ESSENTIAL DETAILS OF ITEMS/ SERVICE REQUIRED

Courses to be conducted 12. The IT specialization courses have to be conducted for the no. of officer trainees at locations as indicated in the table below. The detailed course syllabus is placed at Enclosure 1. S.No. Course Name No. of

Duration of the Courses 13. The timings of the classes will be as per the discretion of the firm. The duration of the course is as indicated in the Para 12 above and the same may be extended as per the discretion of the firm. However, the certification course and exam is to be completed on or before 31 Dec 15. Mode of Conduct 14. The firm has to cater for arranging transport for the officer trainees from a common pick up point in the Naval premises to the training center. In addition, the firm has to provide training and study material for all the officer trainees prior commencement of the courses. The training/study material shall include but not limited to training software, compiled printed notes, reference material and self-explanatory tutorials. 15. The firm should have a well setup lab with networked PCs/Laptops installed with all required software for the conduct of practical sessions. The ratio of PC/Laptop to officer trainee will be 1:1. It will be the responsibility of the firm to provide workstations projector, projector screen, white board, duster and all necessary items and equipment required for the setting up of training classroom. The courses of the officer trainees will be conducted separately and will not be conjoined with any other trainees.

16. Alternatively, the firm may even opt to setup a temporary classroom in the estate/space provided by the Indian Navy for the conduct of courses for the officer trainees. Qualification of the Trainers 17. The vendor will have to depute well - experienced and certified trainers only for the conduct of the courses. The portfolio of the trainers will be screened prior commencement of the courses. The firm is required to submit the CVs of the trainers for shortlisting within 02 days of placement of Supply Order. The contract will be concluded only post shortlisting of trainers for the courses. Certification Exam 18. At the end of the course, a certification exam has to be conducted by the firm for all the officer trainees. It will be the responsibility of the firm that the officer trainees are exposed to regular mock certification exams and to ensure that the officer trainees clear the certification exam on completion of the course. The certificates are to be issued within 02 weeks of successful completion of the course. Duration of Contract 19. The contract shall come into effect on the date of signatures of both the parties on the contract (Effective Date) and shall remain valid until the completion of the obligations of the parties under the contract. The supply of the deliverables and performance of the services shall commence from the effective date of the contract. 20. The Buyer reserves its right to terminate the contract at any time without assigning any reason after giving a notice of two months. The Seller will not be entitled to claim any compensation against such termination. However, while terminating the contract, if any payment is due to the Seller for services already performed in terms of the contract, the same would be paid to it as per the contract terms. Compliance to Tender Enquiry 21. The Bidders are required to furnish clause by clause compliance of specifications bringing out clearly the deviations from specification, if any. The Bidders are advised to submit the compliance statement in the following format along with Technical Bid – Para 48 of RFP specifications, Compliance to RFP specification – whether Yes / No, In case of noncompliance, deviation from RFP to be specified in unambiguous terms. 22. Delivery Period. Delivery period for the contract would be till completion of the obligations of the parties under the contract. Contract can be cancelled unilaterally by the Buyer in case services are not received within the contracted delivery period. Extension of contracted delivery period will be at the sole discretion of the Buyer, with applicability of LD clause. 23. Consignee details –

PART III – Standard Conditions

The Bidder is required to give confirmation of their acceptance of the Standard Conditions of the Request for Proposal mentioned below which will automatically be considered as part of the Contract concluded with the successful Bidder (i.e Seller in the Contract) as selected by the Buyer. Failure to do so may result in rejection of the Bid submitted by the Bidder. 25. Law. The Contract shall be considered and made in accordance with the laws of the Republic of India. The contract shall be governed by and interpreted in accordance with the laws of the Republic of India. 26. Effective Date of the Contract. The contract shall come into effect on the date of signatures of both the parties on the contract (Effective Date) and shall remain valid until the completion of the obligations of the parties under the contract. The deliveries and supplies and performance of services shall commence from the effective date of the contract. The Firm is required to give confirmation of their acceptance of the Standard Conditions of the contracts which will automatically be considered as part of the Contract concluded with the successful Firm (i.e. Seller in the Contract) as selected by the Client. Failure to do so may result in rejection of the Bid submitted by the Firm. The standard conditions of the contract may be perused in the office of tenderer prior to submission of quotation. 27. Arbitration. All disputes or differences arising out of or in connection with the tender shall be settled by bilateral discussions. Any dispute, disagreement or question arising out of or relating to the Supply/Installation/performance, which cannot be settled amicably, may be resolved through arbitration. In case of arbitration with the firm and this unit on any issue the final decision would be of The Flag Officer Commanding-in-Chief, Western Naval Command. 28. Penalty for use of Undue influence. The Firm undertakes by bidding for the Tender Enquiry, that it has not given, offered or promised to give, directly or indirectly, any gift, consideration, reward, commission, fees, brokerage or inducement to any person in service of the BUYER or otherwise in procuring the Contracts or forbearing to do or for having done or forborne to do any act in relation to the obtaining or execution of the present Contract or any other Contract with the Government of India for showing or forbearing to show favour or disfavour to any person in relation to the present Contract or any other Contract with the Government of India. Any breach of the aforesaid undertaking by the Firm or any one employed by him or acting on his behalf (whether with or without the knowledge of the Firm) or the commission of any offers by the Firm or anyone employed by him or acting on his behalf, as defined in Chapter IX of the Indian Penal Code, 1860 or the Prevention of Corruption Act, 1986 or any other Act enacted for the prevention of corruption shall entitle the Client to cancel the contract and all or any other contracts with the Firm and recover from the Firm the amount of any loss arising from such cancellation. A decision of the Client or his nominee to the effect that a breach of the undertaking had been committed shall be final and binding on the Firm. Giving or offering of any gift, bribe or inducement or any attempt at any such act on behalf of the Firm towards any officer/employee of the Client or to any other person in a position to influence any officer/employee of the Client for showing any favour in relation to this or any other contract, shall render the Firm to such liability/ penalty as the Client may deem proper, including but not limited to termination of the contract, imposition of penal

damages, forfeiture of the Bank Guarantee and refund of the amounts paid by the Client. 29. Agents/Agency Commission. The SELLER confirms and declares to the BUYER that the SELLER is the original manufacturer of the stores/provider of the services referred to in this Contract and has not engaged any individual or firm, whether Indian or foreign whatsoever, to intercede, facilitate or in any way to recommend to the Government of India or any of its functionaries, whether officially or unofficially, to the award of the contract to the SELLER; nor has any amount been paid, promised or intended to be paid to any such individual or firm in respect of any such intercession, facilitation or recommendation. The SELLER agrees that if it is established at any time to the satisfaction of the BUYER that the present declaration is in any way incorrect or if at a later stage it is discovered by the BUYER that the SELLER has engaged any such individual/firm, and paid or intended to pay any amount, gift, reward, fees, commission or consideration to such person, party, firm or institution, whether before or after the signing of this contract, the SELLER will be liable to refund that amount to the BUYER. The SELLER will also be debarred from entering into any supply Contract with the Government of India for a minimum period of five years. The BUYER will also have a right to consider cancellation of the Contract either wholly or in part, without any entitlement or compensation to the SELLER who shall in such an event is liable to refund all payments made by the BUYER in terms of the Contract along with interest at the rate of 2% per annum above LIBOR rate. The BUYER will also have the right to recover any such amount from any contracts concluded earlier with the Government of India. Liquidated Damages and Penalty Clause 30. In the event of the Seller's failure to submit the Bonds, Guarantees and Documents, supply the stores/goods and conduct trials, installation of equipment, training, etc as specified in this contract, the Buyer may, at his discretion, withhold any payment until the completion of the contract. The BUYER may also deduct from the SELLER as agreed, liquidated damages to the sum of 0.5% of the contract price of the delayed/undelivered stores/services mentioned above for every week of delay or part of a week, subject to the maximum value of the Liquidated Damages being not higher than 10% of the value of delayed stores. Termination of Contract 31. The maintenance contract shall stand terminated if either party gives two month notice in writing with reasons for the termination thereof. The user can also terminate the contract if the firm is found not to be abiding by the guidelines laid above and there is specific complaint against the performance of the firm. Besides the above the contract can be terminated under the following conditions: -

(a) The delivery of the material is delayed for causes not attributable to Force Majeure for more than (six months) after the scheduled date of delivery.

(b) The Seller is declared bankrupt or becomes insolvent.

(c) The delivery of material is delayed due to causes of Force Majeure by more than (six months) provided Force Majeure clause is included in contract.

(d) The Buyer has noticed that the Seller has utilized the services of any Indian/Foreign agent in getting this contract and paid any commission to such

individual/company etc.

(e) As per decision of the Arbitration Tribunal. 32. Notices. Any notice required or permitted by the contract shall be written in the English language and may be delivered personally or may be sent by FAX or email or registered pre-paid mail/airmail, addressed to the last known address of the party to whom it is sent. 33. Taxes and Duties.

(a) If Firm desires to ask for excise duty or Sales Tax / VAT extra, the same must be specifically stated. In the absence of any such stipulation, it will be presumed that the prices include all such charges and no claim for the same will be entertained (b) If the Firm chooses to quote a price inclusive of any duty/tax and does not confirm inclusive of such duty/tax so included is firm and final, he should clearly indicate the rate of such duty/tax and quantum of such duty/tax included in the price. Failure to do so may result in ignoring of such offers summarily. (c) If the Firm is exempted from payment of any duty/tax upto any value of supplies from them, he should clearly state that no such duty/tax will be charged by him up to the limit of exemption which he may have. If any concession is available in regard to rate/quantum of any Duty/tax, it should be brought out clearly. Stipulations like, the said duty/tax was presently not applicable but the same will be charged if it becomes leviable later on, will not be accepted unless in such cases it is clearly stated by a Firm that such duty/tax will not be charged by him even if the same becomes applicable later on. In respect of the Firms, who fail to comply with this requirement, their quoted prices shall be loaded with the quantum of such duty/tax which is normally applicable on the item in question for the purpose of comparing their prices with other Firms. (d) Any change in any duty/tax upward/downward as a result of any statutory variation in excise taking place within contract terms shall be allowed to the extent of actual quantum of such duty/tax paid by the supplier. Similarly, in case of downward revision in any duty/tax, the actual quantum of reduction of such duty/tax shall be reimbursed to the Client by the Firm. All such adjustments shall include all relief’s, exemptions, rebates, concession etc. if any obtained by the Firm.

PART IV – Special Conditions The Bidder is required to give confirmation of their acceptance of Special Conditions of the RFP mentioned below which will automatically be considered as part of the Contract concluded with the successful Bidder (i.e. Seller in the Contract) as selected by the Buyer. Failure to do so may result in rejection of Bid submitted by the Bidder. 34. Performance Bond/ Bank Guarantee/ Security Deposit. The firm shall submit a Performance Bank Guarantee (PBG) for 10 % of the total estimated value of the contract in favor of The Principal Controller of Defence Accounts, (Navy), Mumbai issued by a public sector bank or a private sector bank authorized to conduct government business in the prescribed format within 10 days from the date of contract/issue of work order. The PBG should remain valid for a period of sixty days beyond the date of completion of contractual obligations/warranty. The BG will be returned to the firm on successful completion of all his obligations under the contract/work order. In case the execution of the contract/work order is delayed beyond the contracted period and the Client grants extension of delivery period, with or without LD, the supplier must get the BG revalidated, if not already valid. 35. Payment Terms. It will be mandatory for the Bidders to indicate their bank account numbers and other relevant e-payment details so that payments could be made through ECS/EFT mechanism instead of payment through cheques, wherever feasible. A copy of the model mandate form prescribed by RBI to be submitted by Bidders for receiving payments through ECS is at Form DPM-11 (Available in MoD website and can be given on request). The payment will be made only on the completion of all the requisite courses and on issue of course completion certificates. 36. The training cost will remain fixed at the value decided at the time of signing the contract and shall not be changed for the entire period of contract. 37. No advance payment will be made. The payment will be made through PCDA (Navy) either on quarterly basis or on completion of the contract as desired by the firm. Bank details including bank A/C No., MICR Code may please be indicated to enable e-payment by PCDA (N) Mumbai. 38. Paying Authority. Payment will be made by PCDA (Navy) on submission of the following documents by the Firm to the Paying Authority.

(a) 02 Ink-signed copy of Commercial invoice / Firm’s bill. (b) A work completion certificate / User Satisfaction certificate from Oi/C MANAG. (c) Performance Bank guarantee. (d) Details for electronic payment viz Account holder’s name, Bank name, Branch name and address, Account type, Account number, IFSC code, MICR code (if these details are not incorporated in contract).

39. Risk & Expense clause. In event of the firm failing to honor contractual obligation within stipulated period, risk offloading will be invoked by the Navy at the expense to the firm. Whenever, the risk off-loading is resorted to the firm is liable to pay the additional amount spent by the Navy. 40. Force Majeure. Should any Force Majeure circumstances arise, each of the contracting party shall be excused for the non-fulfillment or for the delayed fulfillment

of any of its contractual obligations, if the affected party within 48 hours of its occurrence informs the other party in writing. Force Majeure shall mean fire, flood, natural disaster or other acts, that are unanticipated or unforeseeable, and not brought about at the instance of the party claiming to be affected by such event, or which, if anticipated or foreseeable, could not be avoided or provided for, and which has caused the non-performance or delay in performance, such as war, turmoil, strikes, sabotage, explosions, quarantine restriction beyond the control of either party. A party claiming Force Majeure shall exercise reasonable diligence to seek to overcome the Force Majeure event and to mitigate the effects thereof on the performance of its obligations under this contract. 41. Fall clause.

(a) The price charged for the material/services supplied under the contract by the Seller shall in no event exceed the lowest prices at which the Seller sells the stores or offer to sell stores of identical description to any persons/Organization including the purchaser or any department of the Central government or any Department of state government or any statutory undertaking the central or state government as the case may be during the period till performance of all supply Orders placed during the currency of the annual contract is completed. (b) If at any time, during the said period the Seller reduces the sale price, sells or offer to sell such material/services to any person/organisation including the Buyer or any Dept, of central Govt. or any Department of the State Government or any Statutory undertaking of the Central or state Government as the case may be at a price lower than the price chargeable under the contract, he shall forthwith notify such reduction or sale or offer of sale to the Director general of Supplies & Disposals and the price payable under the contract for the stores of such reduction of sale or offer of the sale shall stand correspondingly reduced.

42. Premature Termination of Contract. The Navy reserves the right to terminate the contract prematurely if the firm fails to provide services in a stipulated time frame or if the services are found to be of inferior quality on account of poor material / workmanship or without assigning any reasons. 43. Quality Assurance. Assurance of quality is the responsibility of the firm and firms are to indicate exclusively and submit proofs of quality assurance norms being followed. 44. Inspection. The inspection of training material and quality of training being imparted would be carried out by the consignee. Feedback for the training will be forwarded to Oi/C MANAG/CITO on weekly basis. 45. Security Guidelines For Trainers. Mentioned below are certain security guidelines to be followed by all the representatives of the firms contracted by this unit for conduct of IT Training. Detailed security instructions of the Navy to the contractors may be perused from this office:-

(a) Cameras. Cameras are not allowed to be brought inside Lion Gate. This restriction also applies to mobile phones with inbuilt cameras. Visitors

can carry cell phones without camera in switched off mode & use it is presence of the escort for official purpose only as per existing orders.

(b) Laptop/Computers. Computers are not allowed to be brought inside Naval Premises. In case of an inescapable requirement, explicit approval of concerned Security Officers needs to be obtained.

(c) Storage Media. Storage media like pen/USB drive, portable HDD are not allowed to be brought inside Naval premises. Naval Storage Media will be provided if needed.

(d) Personnel Driving Private Vehicles Inside Naval Premises. Firms should ensure that their representatives driving private vehicles inside Naval premises are holding valid passes/driving licenses and are in possession of valid registration, insurance and PUC papers of the subject vehicle. (f) Police Verification of AMC Personnel. It is mandatory to obtain police verification for trainers visiting Naval premises for the conduct of training. Firm is to compulsorily arrange the same for their trainers within 10 days of signing the contract.

46. Confidentiality. (a) Non-disclosure and Non-use. Each party receiving Confidential Information shall treat such information as strictly confidential, and shall use the same care to prevent disclosure of such information as such party uses with respect to its own confidential and proprietary information, which shall not be less than the care a reasonable person would use under similar circumstances. The firm will abide by the ‘Non-Disclosure Clause” and the Official Secret Act and DPM-09. In any event, each party receiving Confidential Information shall (a) disclose such Confidential Information to (i) only those authorized employees and directors of such party whose duties justify their need to know such information and who have been clearly informed of their obligation to maintain the confidential and/or proprietary status of such Confidential Information; or (ii) only those third parties required for the performance of the receiving party’s obligations under this Agreement pursuant to a written confidentiality agreement at least as extensive as the confidentiality provisions of this Agreement; and (b) use such Confidential Information only for the purposes set forth in this Agreement. (b) Terms of This Agreement. Notwithstanding anything to the contrary in this Agreement, neither party shall disclose the terms of this Agreement (including the fees set forth herein) to any third party without the express prior written consent of the other party; provided, however, that either party may disclose the terms of this Agreement to its affiliates, attorneys and accountants, or to any potential investor or acquirer of a substantial part of such party’s business (whether by merger, sale of assets, sale of stock or otherwise), or as may be required by law. The vendor agrees that the Navy can initiate legal action for negligence or failure to abide by the terms and contract.

47. Other Conditions.

(a) Prices quoted by the firms should be precise and unambiguous. Rate per unit is to be quoted individually. Clarifications, if any, may be obtained from this office prior to submission of tender.

(b) Firms are to quote for all categories mentioned in the price bid (Enclosure 4). Any price column in price bid, if “left blank/ NA/ any figure other than amount in Rupees” may invite rejection of the quote. (c) The taxes as applicable have to be indicated for each. (d) The Oi/C MANAG may depute team to inspect Firm’s site to assess their Technical competency with respect to availability of infrastructure and resources for the conduct of IT Training.

Part V – Evaluation Criteria & Price Bid issues

Evaluation Criteria 48. The broad guidelines for evaluation of Bids will be as follows:

(a) Only those Bids will be evaluated which are found to be fulfilling all the eligibility and qualifying requirements of the tender Enquiry, both technically and commercially. The format for submission of Technical bid is placed at Enclosure 2.

(b) The Technical evaluation of only those firms would be carried out who qualify the Vendor Evaluation Compliance Matrix (placed at Enclosure 3). The board of officers evaluating the technical bids may call for additional documents, site visits, presentation etc. in support of the facts and figures provided by the firms in the technical bids. Firms not cooperating in the bid evaluation or failing to produce the additional documents etc. as required by the Technical committee will be rejected.

(c) The Technical Evaluation Committee report will be approved by the CFA post which the Price Bids of only those Firms will be opened who's Technical Bids would clear the technical evaluation.

(d) The Lowest Bid will be decided upon the lowest price quoted by the particular Bidder inclusive of all taxes (as per the prevalent Govt. policies).

(e) The Lowest Acceptable Bid will be considered further for placement of contract after complete clarification and price negotiations as decided by the BUYER.
