Dear Members,
On behalf of Ahmedabad Medical Association we wishes you Happy New Year and wishes that Vikram Samwant 2073 brings health, wealth and happiness to all of you.
Schools have reopened after Diwali vaccation so children have again become busy with their school work.
As doctors, our knowledge, skills and expertise are a source of great benefit to society, but they can also breed arrogance and ego – an inner feeling that ‘I am better than others’.However, in the absence of humility, no amount of knowledge, skill or expertise will earn the respect of others.
The public look with respect at the medical profession. That is due to their dependence on doctors for assistance in overcoming their ailments. When such assistance is accompanied and overshadowed by arrogance and ego, patients will not be grateful and they will not feel respect from within for their doctor.
Every doctor, during training, has come across ‘toxic’ on ‘non-toxic’ professors. Which did you prefer? Which did you like? Which could you approach? And which category would you like to be placed in?
Thus, our arrogant and egoistic approach to medical practice often distances us from our family, colleagues, staff, patients, juniors and society in general, causing us both personal and professional problems.
We, ourselves, become the causalities of our own arrogance and ego, such that our inner peace is shattered.
So, what is the remedy for this? Answer is : to cultivate humility. Whatever our achievements, it is worth remembering these words of Ernest Hemingway, “We are all apprentices in a craft where no one ever becomes a master.”
So, while it is fine to take pride in one’s accomplishments, it is better to remain humble, respectful and approachable. This may not bring monetary returns, but will certainly result in more joy, satisfaction and inner peace.
Pramukh Swami Maharaj, the late spiritual guru of the BAPS Swaminarayan Sanstha, is widely praised for his outstanding spiritual and social achievements, but he is remembered most for his innate humility. He built over 1,100 mandirs, inspired millions to quit addictions, built many hospitals and schools, and helped in scores of natural disasters.
So, as we march forward in this Hindu New Year, may we all adorn our knowledge, skills and expertise with humility. That is the true trademark of a genuinely successful doctor and individual.
As per our tradition we have kept Dhanwantri Pujan at our premises of Ahmedabad Medical Association on 28-10-2016 on the auspicious day of Dhanteeres.
Since many years Ahmedabad Medical Association along with Family Physician Association has started a initiative called “Doctor’s on call” during the days of Diwali festival. This time also more than 100 members have given their services. To sensitise the print and electronic media we have done press conference for it so that they can pass the message to the society.
On 12-11-2016 we have scientific programme at our premises on “Resent trends in treatment of Diabetes”
On 13-11-2016 we have organised a walk to creat awareness regarding Diabetis which was followed by awareness lectures for common people and diagnostic camp was also organised for diabetis at our premises.
On 13-11-2016 we have celebrated “Diwali get Together”.
On the call of IMA HQ on 16 November we have arrange IMA Satyagrah. On the behalf of Ahmedabad Medical Association we are thankful to all of you for making it a success. Once again we have shown our strength and solidarity. We have submitted the Memorandum to Dr Kirit Solanki, Member of Parlament Ahmedabad East and to the collector of Ahmedabad.
Those members who’s children are studying in Medical College, University Exams are going to start. NEET PG is also starting from 5th December we wishes them Good luck.
Friends year 2016 is comming to an end. Ahmedabad Medical Association has done lot of activities in this year and we are commited to do more other activities in the comming year of 2017. On behalf of Ahmedabad Medical Association we are wishing Happy New Year 2017 to all.

Minor discrepancies in records maintained by medical professionals cannot invite prosecution by appropriate authority without prior investigation.
High Court of Bombay : While dealing with the question relating to the validity of a criminal complaint filed against the petitioner for violating Sections 4, 5, 6 and 29 of the Preconception & Prenatal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 (hereinafter to be referred as "Said PCPNDT Act") & and Rule 9, 10 (1A) and 18 of the Preconception and Prenatal Diagnostic Techniques (Prohibition of Sex Selection) Rules, 1996, the Division Bench comprising of A.V. Nirgude and V.L. Achliya, JJ. observed that minor procedural errors and inadvertent omissions in maintaining records under the PCPNDT Act & Rules cannot be regarded as a punishable violation on part of a person in the field of medial profession.
Further, the Court quashing the complaint field against the petitioner held that a casual approach adopted by the Authority to invariably file a complaint against the petitioner without proper inquiry, investigation & due application of mind leads to unnecessary humiliation and harassment of the person in the filed of medical profession hence, any legal action by the authority must follow based upon sufficient material to establish that there was a violation of provisions of PCPNDT Act and Rules thereunder.
The petitioner had installed a sonography machine at Suyog Hospital at Nanded, which is duly registered with the Health Department and the certificate of registration is valid up to November 2016. The regional vigilance squad inspected the centre and prepared a report and forwarded it to the advisory committee on the basis of which the advisory committee decided to suspend the registration of petitioner's sonography centre and initiate prosecution against her without even investigating the complaints made out in the report regarding the breach of provision of the PCPNDT Act and Rules thereunder. The Chief
Judicial Magistrate upheld the accusations of the authority, against the petitioner for initiating prosecution against her, which the petitioner seeks to be quashed and set aside.
The Court relying on the contentions of the petitioner held that the discrepancies mentioned in the report mainly refers to omission to mention full address, mobile number etc. of patients underwent sonography, difference in the signature of the Doctor & other inadvertent mistakes cannot be termed as discrepancy or act of inaccuracy amounting to violate the provisions of the said Act & Rules made thereunder.
The Court upholding the reply filed by petitioner that reflects the discrepancies noted by Committee in respect of maintenance of record were mistakes, omissions and lacunas and for which satisfactory explanation has been offered by the petitioner along with the undertaking that on such mistake will be committed in future accordingly, such errors were not made with ulterior motive to suppress certain information about the patients or misuse the ultrasonography machine for sex determination.
The Court criticizing the casual approach adopted by the authority in filing the complaint and initiating prosecution against the petitioner held that it was expected on the part of the Appropriate Authority to have investigated the information received in the form of inspection report from the Vigilance Squad as well as to look into explanation given by the petitioner and after giving her opportunity of personal hearing and then to find out there was any violation of provisions of PCPNDT Act on the part of the petitioner thus, the Appropriate Authority has failed to discharge its statutory obligations as contemplated under Section 17(4) of PCPNDT Act i.e. to investigate the report of inspection received from Vigilance Squad which restricts to noting of certain lacunae, omission and certain mistakes in maintenance of record which would help to remove the fear in the mind of medical professionals doing their work with utmost honesty, sincerity and due observance of medical ethics and code of conduct laid down under the PCPNDT Act of being subjected to face unnecessary humiliation, harassment and criminal prosecution. Doctors on call during Diwali festivalThis year also Ahmedabad Medical Association and Ahmedabad
Family Physician Association has jointly arranged for “Doctor's on call” during the festival of Diwali. Total 110 doctors have enrolled themselves and daily approximately 50-60 calls were received. This service was available from 30 October to 04 November.
Dhanvantri PoojaOn the auspicious day of Dhanteres 28-10-2016 as a part of Indian
Tradition Dhanvantri Pooja was organizes at the premises of Ahmedabad Medical Association at 10:00 AM. In which Pujya Rishikeshdas Swami and Pujya Naranprasaddas Swami of BAPS Swaminarayan Mandir were present and blessed the gathering.
Dr Sunil Borisa told about Lord Dhanvantri and PujyaRishikeshdas Swami told about relevance of Dhanvantri Puja in the recent era of modern medicine.

Medical Association from 08:30 PM onwards.
After delicious dinner it started.
Speaker was Dr Vivek Arya and he delivered a talk on Recent Trends in Treatment of Diabetes.
After the talk there was panel discussion on special aspects of diabetes in which Dr Vivek Arya, Dr Anant Yadav, Dr Gynendra Singh, Dr Milind Prakshakar and Dr Smitesh Dutt participated.
Report of "Diabetes walk"In reference to world diabetes day a walk was organized on 13
November 2016 by Ahmedabad Medical Association in collaboration with Dia plus - trends to create awareness among public.
It started at 06:30 AM from Mercedes Emerald Motors, parimal garden cross road and ended at Ahmedabad Medical Association. More than 250 members participated in it. A live music was given by music band.
At Ahmedabad Medical Association talk was given for the benefit of public and medical checkup camp was organized for the screening of diabetes.

delegation of Ahmedabad Medical Association to brief about the Gujarat Government’s inisitative of opening of the Medical Store for Generic Medicine.

KUMAR KUSHWAHA & 2 ORS.V/s.Dr. GOPAL NARAYAN AWTE & ors.
Facts in Nutshell…
1. The Complainant, the Son of Labourers fell sick and he was taken to
the Opponent Doctor (having only a certificate of Ayurveda Doctor
and not a BAMS degree) , where the practitioner diagnosed him as a
Malaria patient and he treated him with some allopathic medicines
and injections for a period of 15 days.
2. But as the condition of the patient worsened, he was taken to higher
center in a serious condition. It was informed that the patient had
Japanese Encephalitis for which treatment would continue life-
long. According to the complainant, due to wrong diagnosis and
wrong treatment of malaria, the mental condition of the patient
deteriorated and he has become mentally challenged. Thus, the
case for damages of Rs,19,90,000/- was filed.., but was only
awarded Rs.20,000/- by the State Commission. He then filed a
revision petition with the National Commission.
3. The Doctor denied all the charges and contended that the pathology
center is at fault and should suffer. Held : 1. The National
Commission, after going through the entire record held the Doctor
had no proper Degree and could not have prescribed allopathic
Medicines. 2. It was also brought on record that as per M.P. Medical
Council & Madhya Pradesh Ayurvigyan Council, the Opponent
Doctor was not authorised to prescribe Allopathic medicines. 3.
The commission referring to one of its own previous judgements
re-iterated
“The person who is authorized to practice under Indian Medicine
Central Council Act, 1970 is not at all entitled and authorized to
prescribe medicines under the Indian Medical Council Act, 1956.

We are of considered view that the doctor having studied one
particular system of medicine, cannot possibly, claim complete
knowledge about the drugs of the other system of medicine The
transgression into other branches of medicine would tantamount
to quackery.”
4. With regards to the current case, the hon'ble court observed
“Whenever an Allopathic medicine is to be given, it must be
sanctioned, verified and seconded by the Allopathic Doctor. The
Allopathic Doctor will always take care and will call for all the
medical tests.The mere signs of malaria are not enough. The main
disease of the patient could not be discovered by this quack.”
5. It was also observed that the practitioner unnecessary wasted time
in treating the patient, instead of referring him to proper Doctor.
Thus, he was held liable to pay damages to the tune of Rs.3 Lakhs.

I Eligibility of the members :
Any Life Member of A.M.A. and his/her spouse are eligible to become member of this
scheme,
Provided that :
(1) A member below the age of 55 years
(2) Life members of A.M.A. will be known as Member of the scheme and their Spouse
will be associate member of the scheme (The couple members will be considered
Members of the Scheme). Spouse cannot join alone.
II. Procedure For enrollment :
A. Member who want s to join the scheme has to apply in the prescribed application form
meant for the purpose along with necessary documents & scheduled fees.
B. Associate member who wants to join has to fill separate form, endorsed by his or her
spouse along with necessary documents & scheduled fees.
C. A member need to submit certified copy of (1) standard age proof (A) Driving
Licence, (B) School Leaving Certificate (C) Valid Passport (D) PAN Card (2) Life-
membership certificate of A.M.A. (3) Valid Photo I.D. (4) 2 Passport Size
Photographs along with application form.
In case of associate member: Additionally Marriage Certificate / Valid Passport /
Election Card is mandatory.
D. All eligible members mentioned above shall submit their application along with
admission fees as per age & AFC by D.D. or cheque in name of A.M.A., Family
Benefit Scheme, payable at Ahmedabad (no cash transaction).
E. Nominee : A member will have to give name of 2 nominees along with their
photograph and specimen signature.
III. Fee Schedule :
A. Any eligible member of A.M.A. willing to become member of this scheme can do so
on payment of admission fees as stated below
AFC : Advanced Fraternity Contribution
ADM : Admission Fee
B. Admission fee is Non-refundable.
C. Advanced Fraternity Contribution (AFC) will remain as security deposit against the death fraternity contribution payable by the member.
IV Benefits to Members :
1. Fraternity Benefits : Rs. 500/ member in event of death of member.
2. Permanent Disability Benefit :
In case of an unfortunate event if a member becomes permanently disabled, can claim Rs. 500/ member as benefit amount, after that he will be retired from the scheme and no longer will avail any benefit.
N.B. : > The disability must not be there at the time of membership and in the next one year after membership.
> In case of claim / dispute the expert panel will decide the admissibility of claim. The decision of executive committee in such case will be final.
> The conditions covered under permanent disability are as per the list mentioned :
1. Loss of both eyes 2. Loss of both either upper limb or lower limb 3. Irrversible Coma 4. Irreversible Hemiplegia 5. Irreversible Paraplegia
3. Voluntary Retirement Benefit :
A. Any member who has completed 21 years in scheme or 70 years of age, which ever is later can withdraw a sum of rupees Rs. 350/member any time after that, then he ceases to be a member of scheme.
B. Any member who has completed 25 years in scheme or 75 years of age whichever is later can withdraw a sum of rupees Rs. 450/member and he ceased to be member of the scheme.
C. Any member who has completed 15 years in scheme or 80 years of age, which ever is later can withdraw a sum of rupees Rs. 150/member any time after that, then he ceases to be a member of scheme.
The Fraternity benefits will be available to members as follows.
Any member who has completed 1 year in scheme will be eligible to make claim in the event of Death or Permanent Disability.
N.B. : In case of Accidental Death no restrictions apply.
V. Claim Procedure :
1. In the event of death of a member the nominee will inform the same to the secretary A.M.A., F.B.S. and will make a claim by submitting prescribed claim forms available with the office with the necessary documents.
2. The claim amount will be paid to first nominee only. In case of death of the first nominee the claim amount will be paid to the second nominee (submission of death certificate of first nominee mandatory)
3. Computation of Fraternity contribution Payment : The fraternity contribution is calculated according the membership strength of the last day of the previous month in which the event has occurred.
