The Supreme Court (SC) recently issued its ruling over a 2002 case challenging the authority of the Palawan Council for Sustainable Development (PCSD) to implement its Administrative Order No. 5 regulating the reef-fish-for food (RFF) industry in the province.

‘PCSD’s authority to implement RFF policy within rule-making power’

In a letter dated October 12, the Office of the Solicitor General (OSG) informed the PCSD of SC’s favorable judgment on the case entitled, “Palawan Council for Sustainable Development, et al. vs. Bonanza Air Services.”

The ruling, issued on August 24, reversed the decision of the Court of Appeals (CA) on May 28, 2008 which declared the RFF policy and its succeeding revisions and other related circular order as “null and void.”

It can be noted that the case stemmed from the complaint filed

directly to CA by a certain Ejercito Lim, operator of Bonanza Air Services, a domestic air carrier transporting live fish from Palawan.

Lim assailed the PCSD AO5-2002 which, by virtue of Resolution No. 3-211, requires traders and carriers to secure accreditation from PCSD, and also the PCSD Memorandum Circular 2-2002 which provide penal clause for non-compliant business owners.

PCSD, however, maintained that the petition should have been dismissed because the RFF policy is in accordance with the mandate of the Philippine Constitution and of Republic Act No. 7611 or the Strategic Environmental Plan for Palawan Act, and that Lim was given notices of his continued non-compliance with the policy.

PCSD2 updatesThe Mount Mantalingahan Protected Landscape launched on October 7 in Manila the nation’s first conservation trust fund for a national protected area, a sustainable financing mechanism that will ensure the key biodiversity area is protected in perpetuity.

Established by Conservation International’s (CI) Global Conservation Fund (GCF), the fund ensures conservation efforts can continue across the 120,000-hectare landscape, Palawan’s largest terrestrial protected area.

Enrique Nunez, Executive Director of CI Philippines said, “This innovative fund will provide sustainable financing for the long term maintenance, protection and enrichment of the biodiversity within the protected area. Essentially, investing in this fund supports livelihood diversification for the indigenous Palawan people, improving their well-being, and ensures the watershed can continue to provide freshwater to all residents of southern Palawan.”

With over half its original

PCSDS holds workshop on the Sustainable Management Online Tool for mining with RTN, CBNC

SMOT is an online tool, created by the Biosphere Reserve of Manicouagan-Uapishka (RMBMU) in Canada, which evaluates the sustainability of mining activities in biosphere reserves (BRs).

The tool uses the 10 International Council on Mining and Metals’ (ICMM) 10 principles for sustainable development performance and its 46 corresponding objectives. These principles are categorized into four dimensions: Social, Economic, Environmental, and Governance. The objectives act as the questionnaires that the mining company will answer.

Prior to the hands-on workshop, an orientation about the tool was conducted last August 19, with the said two mining companies, as represented by its concerned staff from the Community

The workshop was attended by participants from local government unit, non-government organizations, indigenous peoples and other stakeholders. To give them a comprehensive knowledge on Republic Act 7611 or the Strategic Environmental Plan (SEP) for Palawan Act, Cherry Lyn Jalover, PCSDS Project Development Officer II, discussed the SEP’s brief history, as well as the Environmentally Critical Areas Network (ECAN) as its main strategy.

Jalover gave an emphasis on the importance of the ECAN in the planning process of all development

plans of the municipality. She also pointed out the relationship of ECAN zoning in formulating disaster risk reduction management plan as the ECAN Core Zones are indicative of geohazards in an area.

Mark Anthony Tabangay, PCSDS Planning Staff, presented the Ecological

Profile and Integrated Threats Analysis of the municipality. Key informants including LGU department heads were interviewed for the municipal situational threats analysis. Actions proposed by respondents in the municipality to address the pressures in each zone were also presented.

To give a clearer view of the municipality’s resources spatially, the result of the ECAN-based resource mapping conducted last September 12-13 in Sofronio Española was also presented highlighting the resources, opportunities, and threats in each zone.

During the action planning workshop, the participants were divided into three groups (Core zone group, Buffer zone group, and Multiple Use zone group), while the PCSDS acted as resource person and facilitator. In each group the participants were asked to select the pressures that they would like to prioritize and the proposed actions they would like to include to address the pressure.

The second day of the activity was devoted to reporting of workshop outputs and the ECAN Map validation and cultural mapping. The participants were divided into two clusters, constituting the northern and southern barangays of Sofronio Española. Members of each cluster were instructed to use the ECAN map in validating status of ECAN Zones. Both the area

The activity was a collaboration among Sofronio Espanola, ECAN Board, Municipal Government and PCSDS. The output of the said workshop will be used in the development of the town’s ECAN Zones Management Plan.

has been implemented within the boundaries of PCSD’s quasi-legislative function or rule-making power.

“Accordingly, the PCSD had the explicit authority to fill in the details as to how to carry out the objectives of R.A. No 7611 in protecting and enhancing Palawan’s natural resources consistent with the SEP,” clarified the SC decision.

“In that task, the PCSD could establish a methodology for the effective implementation of the SEP. Moreover, the PCSD was expressly given the authority to impose penalties and sanctions in relation to the implementation of the SEP and other provisions of R.A. No. 7611. As such,

the PCSD’s issuance of A.O. No. 05 and Resolution No. 03-211 was well within its statutory authority,” the ruling furthered.

The PCSDS welcomed the said ruling and assured the agency will continue to stand for what it deemed best for the RFF industry.

“This Supreme Court decision is just a timely reaffirmation of the PCSD’s authority to regulate the RFF policy, which is being challenged by some fisherfolks and traders,” said PCSDS Director for Operations, Atty. Adelina Villena.

The RFF policy was later amended in 2014 with the implementation of seasonal control, size catch limits, among other additional provisions aimed at ensuring the sustainability of the industry.

Department of Envionment and Natural Resources (DENR) upang maisama sa badyet nito sa taong 2017. Matatandaang tinukoy ng DENR ang Palawan bilang isa sa mga priority convergence sites nito sa bansa.

Ani Devanadera, inatasan si PCSD Chairman at Palawan Governor Jose Alvarez bilang convergence coordinator na pangunahan ang pagbuo ng isang plano na pagkakaisahan ng lahat ng sektor sa lalawigan.

Ito aniya ang nagtulak upang pangunahan ng Provincial Government ang pagsasagawa ng serye ng mga konsultasyon. Katuwang nito ang DENR, PCSDS, at ang iba’t ibang sektor sa Palawan, partikular ang mga non-government organizations, national government agencies, local government units, indigenous peoples at akademya.

Dagdag niya, ang mga suhestyon mula sa mga isinagawang konsultasyon ay titipunin at isasama sa isang integrated na plano para sa probinsya na ilalatag sa darating na Palawan Environmental Summit sa Nobyembre 16-17, kung saan panauhing pandangal si Sec. Lopez.

Sa isinagawang konsultasyon, nagsagawa ng sectoral workshop upang matukoy ang mga pangunahing isyu at suliraning pangkapaligiran at pangkabuhayan na kinakaharap ng Palawan, at ang mga posibleng solusyon at mga ahensya na dapat tutugon dito.

Pinasalamatan ni Atty Grizelda Mayo-Anda, Executive Director ng Environmental Legal Assistance Center, Inc. - ELAC, ang isa sa mga bibihirang pagkakataong tulad nito kung saan nagtipun-tipon ang iba’t ibang sektor upang pag-usapan ang mga isyung pangkalikasan at pangkabuhayan, at mapakinggan ang iba’t ibang perspektibo na dapat makonsidera sa paggawa ng plano.

Ani Anda, ang konsultasyong ito ay bahagi ng participatory process na dapat laging inklusibo, kung saan magkakaroon ng ugnayan at magkakarinigan ang gobyerno at iba pang sektor, partikular ang mga civil society organizations.

Naniniwala rin siya na sa isang konsultasyong tulad nito ay malaya ang lahat na mapayapang sumang-ayon o di sumang-ayon sa kung anumang mapag-uusapan. Dagdag niya na dapat maipaabot ang mga ito sa paparating na Environmental Summit.

Hinikayat naman ni Johnny Lilang, kinatawan ng Provincial Environment and Natural Resources Office (PENRO), sa isinasagawang konsultasyon ay nawa’y magkaroon ng respeto sa kanya-kanyang pananaw ang bawat isa.

Ipinaalala rin ni Lilang na sa usapin ng pagprotekta sa kalikasan, ang tungkulin ay nakaatang di lamang sa iisang grupo o ahensya, kundi sa lahat ng nakedepende rito.

Ang serye ng mga konsultasyon sa lalawigan ay hinati-hati sa limang clusters para sa Calamian, North, South at Central Palawan, at isa pang cluster para sa Cuyo, Agutaya at Magsaysay.

Nitong Oktubre 18 ay magkasabay na isinagawa ang konsultasyon sa Bayan ng Roxas para sa Northern Palawan Cluster, at sa Bayan ng Brooke’s Point para sa Southern Palawan Cluster. Nitong nakaraang linggo ay isinagawa ang para sa Cuyo, Agutaya at Magsaysay, habang nakatakda namang ganapin sa mga susunod na araw ang para sa Calamian Cluster.

The PCSD Staff welcomed them at the Palawan Sustainable Development Training Institute (PSDTI) in Bgy. Irawan, Puerto Princesa City, wherein they were given an overview of the Strategic Environmental Plan for Palawan Act (R.A. 7611). The students also grabbed the opportunity to visit the Zero Carbon

International students under the Nagoya University Global Environmental Leaders Program (NUGELP) of Nagoya University, Japan visited Palawan on October 24, as part of their 2016 NUGELP international tour in Palawan.

CI Philippines disbursed the grant of USD$1Million to the Philippine Tropical Forest Conservation Foundation, the endowment manager, as initial capital for the endowment today. The capitalization target is at least US$2.7M million so further investment is needed.

first step. Now the challenge to secure a better future for Mantalingahan and the people that depend on it rests on garnering further contributions to increase the endowment capital so that we can ensure this effort endures into the future.” said Nunez.

Dr. Theresa Mundita Lim, Director of the Biodiversity Management Bureau of the Department of Environment and Natural Resources said, “We welcome the creation of an endowment fund for

Mt.Mantalingahan. 60% of the budget for managing our protected areas comes from the national government which is certainly very limited. Additional funding from other sources can go a long way in protecting the last remaining biodiversity-rich areas in the country.”

problems from a global and holistic perspective, according to Tanawa.

To achieve this goal, Tanawa added, aside from learning gained from the university, domestic and international study tours are held every year to provide actual experiences and broad perspectives to the students.

During the Palawan study tour, the group went to the Puerto Princesa Underground River, as well as in two mining companies in Bgy. Rio Tuba, Bataraza town as part of their itinerary.

The PCSD was invited by the Conservation International (CI) to set up an exhibit, showcasing the Palawan Man and Biosphere Reserve, in its gallery during the launching of the Filipino version of “Nature is Speaking,”CI’s award-winning films highlighting the value of nature. Engr. Madrono Cabrestante Jr., head of the PCSDS - ECAN Knowledge Management Division and ECAN Monitoring and Evaluation Division, presented a re-cap of the previous orientation. He emphasized that this is the first time that the tool will be used in the country and how it is very applicable in Palawan considering its status as a UNESCO Man and Biosphere Reserve.

Kirsten Louise Sagun, PCSDS Sustainable Development Analyst, discussed a more detailed process of using the tool. One account for each of the two mining companies were provided by the RMBMU. Soon after the participants logged in to their respective accounts, Sagun, alongside with May Lacao, PCSDS Development Management V, assisted the participants in answering the tool.

The process of answering the tool involved a discussion between the PCSDS and the two companies, as moderated by Felomino Racuya, PCSDS Project Development Officer IV. They first identified the importance and performance (I&P) levels for each objective, then list down current activities, policies, programs and projects to justify the I&P.

For each I&P selected, a “Priority level” is generated.

The priority level is a suggestion on what should be the action towards the objective. The priority level suggestions ranges from “Not Applicable” to “Maintain and Consolidate.”

In the analysis of results, it was observed that the statistics of the assessment shows an almost perfect diamond indicating a good balance of the 4 sustainable development dimensions of the Sustainable Management Online tool.

RTN’s Community Relations Office, Ernesto Llacuna, in his closing remarks, said he was grateful to the PCSD staff for conducting the workshop. He also extended his gratitude to PCSDS Executive Director Nelson Devanadera, and also to PCSD Chairman Palawan Governor, Jose Chavez Alvarez for serving as instruments in ensuring the sustainable management of mining industry in Palawan.

Meanwhile, PCSDS noted a few suggestions and comments from the RTN and CBNC regarding the tool in hope of improving it and making it more suitable to Palawan’s unique nature.

The RTN and CBNC are enjoined to pass a final and complete output of their SMOT assessment to the PCSDS one week after the workshop for commenting and further evaluation by the PCSDS team. On one hand, validation of the SMOT

for the proposed municipal MPA and cultural areas of the indigenous cultural communities were asked to be identified. After the validation, the map was then presented in the plenary.

For the second workshop, participants recognized the importance of protecting their resources through the ECAN Zoning, hence majority of the identified conflict areas were proposed for upgrading to higher ECAN conservation zone subject to ground validation.

To conclude the result of the two-day activity, Engr. Ryan Fuentes, PCSDS Planning Officer Designate, reiterated that the plan will be used as

basis in formulating the ECANized Comprehensive Land Use Plan (CLUP) of the municipality and will serve as guide for the formulation of the municipal development plans and investment plans.

In behalf of the Municipal Mayor. Marsito Acoy, the Municipal Administrator Sem Tingson said that the local government supports and is grateful to all the participants in their involvement in the planning workshop. They expressed appreciation of the technical assistance of the PCSDS in formulating their Municipal ECAN Zones Management Plan and advocating sustainable development in the municipality.

Nagsagawa ng Deputation Training for Wildlife Enforcement Officers (WEO) ang Palawan Council for Sustainable Development Staff (PCSDS) sa New City Hall nitong Oktubre 10-14.

Ilan sa mga tinalakay ay ang Republic Act 7611 o ang Strategic Environmental Plan for Palawan Act, at ang mga batas at polisiyang pangkalikasang ipinatutupad sa lalawigan.

Ibinahagi rin sa 59 partisipante ang listahan ng mga nanganganib na buhay-ilang sa probinsya, at ang mga hayop na karaniwang biktima ng illegal wildlife trade. Kaugnay nito, tinuruan din sila ng ilang staff ng Palawan Wildlife Rescue and Conservation Center at Katala Foundation, Inc. ng tamang paghawak at pagbyahe ng wildlife matapos itong makumpiska.

Binigyan din ang mga kalahok ng mga lektyur patungkol sa mga alituntunin sang-ayon sa batas na kailangang sundin ng isang deputized WEO, gaya na lamang ng tamang pag-aresto, paghahalughog at paghuli, maging ang paghanda ng mga dokumento na kinakailangan sa paghain ng kaso sa korte at marami pang iba.

Bahagi rin ng pagsasanay ang field work kung saan sinubok ang kaalaman ng mga kalahok kung paano ang mga ito magsasagawa ng enforcement operation sa tunay na buhay.

Sa huling araw, sumailalim sa pagsusulit ang mga kalahok upang masukat ang kaalaman na nakuha nito mula sa limang araw na pagsasanay na bahagi ng deputation process. Kapag pumasa ito sa exam at maisumite ang mga kinakailangang dokumento ay maaaring i-deputize sila ng PCSD.
