1 IntroductionAll contract rates are ‘Commercial in Confidence’ and must not be disclosed to anyone outside the procurement process or government. Pricing information must not be released to other suppliers, tenderers, the general public or unauthorised personnel under any circumstance. Disclosure without authority may constitute a breach of the Code of Conduct for NTPS employees, resulting in disciplinary action.
The Office of the Commissioner for Public Employment (OCPE) is a central agency within the Northern Territory Public Sector (NTPS). OCPE recently decentralised the delivery of across government short course training and have established a panel contract (D13-0005) to provide NTPS agencies with a range of options when engaging training providers.
The panel contract features 33 providers who can develop training content and/or deliver training across 50 training topics (including cross-cultural training). A list of the providers and the topics they have been awarded is available at Clause 1.11.
1.1 Contract ManagerThe Contract is currently managed by the OCPE Strategic Workforce Planning and Development Unit (SWPD). SWPD are contactable on 08 8999 3708 or via email to [email protected]. Agencies seeking an interpretation and understanding of this contract are encouraged to contact the Contract Manager.
1.2 Accessing the ContractOCPE has granted a general approval for all NTPS agencies to utilise this contract, without the need to obtain separate approval for each engagement, subject to the following conditions:
The training requirement is within the scope of the contract; and The provider agrees to offer their services under the terms of the contract.
Agencies are required to complete the ‘Request to Use’ form (refer 1.9.2.1). The form asks for the following information:
Agency name; Name of the provider selected; Training category and topic/s under which the provider is being used; Program name; Estimated value of the work (inc. Travel); Proposed date/s and location/s of the services; Contact person and details within the agency; and A copy of the learning outcomes/objectives for the training are to be attached.
The requesting agency must issue a purchase order against the contract rates for each engagement.
1.3 Selecting ProvidersAgencies are encouraged to contact more than one provider about their proposed training as each will have different styles and expertise that will suit a variety of situations.

All providers were assessed against the following criteria during the tender process:
Price; Past Performance; Local Development and Value Adding; Referee Reports; Capacity; and Innovation.
When accessing the contract it is important to note that if a provider is not listed against the relevant training topic they cannot be utilised for that type of training under this panel contract. Should agencies wish to use a training provider against a training topic for which they have not been selected then the agency will need to ensure they have undertaken a separate procurement action in accordance with the NTG procurement framework.
1.4 Allocation of WorkAgencies are encouraged to make every effort to schedule work in advance with providers, enabling a training calendar to be published for each agency. Where possible, agencies should attempt to allocate work either for a 6 month or 12 month training period to allow sufficient programming and planning time for providers.
1.5 Contracted RatesPlease contact the SWPD Unit on 08 8999 3708 for all inquiries relating to the contracted rates.
1.6 Travel Related ExpensesIn accordance Clause 3.8.10 of the Request for Tender (RFT), all travel costs must be negotiated with and approved by the requesting agency prior to any bookings being made by the provider.
Travel costs including down time and lay over time, for training delivered out of the contractors business base, will be negotiated on a case by case basis between the requesting agency and the contractor.
1.7 InvoicingEach individual agency will be responsible for payment of services under this contract. Following completion of a project, payment should be made subject to the following conditions:
The project has been completed according to the Terms of Reference; and Within thirty (30) days following acceptance of a tax compliant invoice.
1.8 Performance ManagementTo ensure quality standards are maintained, an OCPE representative may seek feedback from agencies regarding the quality of the services received.
Where the performance of a provider is unsatisfactory the agency should arrange a feedback session with the provider as soon as possible after the event. The Director of the SWPD Unit should be notified of unsatisfactory performance of the provider.

1.9 ReportingRefer to Clause 3.10 of the RFT.
1.9.1 Service DeliveryTo monitor the quality of the services offered, agencies will provide OCPE with the following (also mentioned below):
Written feedback commenting on their collaboration with the contractor; and Evaluation reports where contractors have been engaged in training delivery
and/or content/curriculum development.
1.9.2 Contract UsageThe OCPE will monitor the usage of the panel contract through the following process:
Agencies interested in engaging a contractor will complete the ‘Request to Use’ form (refer 1.9.2.1) prior to the commencement of the training.
Further to the completion of the service, agencies will forward the OCPE evaluation summaries for the services provided and annual reports regarding the number of training workshops delivered, locations of delivery, participant information (e.g. numbers, hierarchical levels/classification level) and an analysis of the actual participation in comparison to the total workforce of the agency. Finally, agencies will update the OCPE on any key issues or emerging workforce issues and collaborate to build core capability within the NTPS.
This enables OCPE to keep records of total expenditure and agency usage of providers under the panel contract. This will allow for future planning and to determine the relevance of the panel contract in meeting the training and development requirements for the NTPS.
