Considering :

a. that the procurement, circulation anduse of hazardous

materials is onthe risein tenns of types andquantities

andthe hazardous materials caneasily be found in the

market;

b. that the condition referred to in letter a caneasily trig­

ger abuse of hazardous materials that may cause dis­

turbance to health, security, human safety, animals,

plantsandthe environment;

c. that as part of efforts to intensively control abuse of

hazardous materials, it is necessary torestipulate poli­

cies related to the procurement, circulation, sales and

controlof locally-made and importedhazardous mate­

rials;

d. that based on the considerations in letter a, letter b

and letter c, it is necessary to stipulate RegulatiOn of

the Trade Minister;

referred to as PT-B2, is a company appointedby DT­

82 and securing a special 82 trade permit from the

Govenor in this case the Headof the Provincial Office

to sell82 toPA-82.

9. Hazardous materialend-user, hereinafter referredto

as PA-B2, is an industrial company using B2 as raw

materialS/auxiliary materialsprocessed chemically so

that theirphysical andchemical characteristics change

to gain added value, end a corporate body or institute

using B2asauxiliary materials according to their ap­

propriation by securing a permit from the authorized

agency.

10. Hazardous material trade permit, hereinafter referred

to as SIUP-B2/ is a permit to engage in special B2

tradeactivities.

11. Procurement of B2is the process/activity carried out

by P-B2, IP-B2 andIT-B2to provide62.

12. DistributIOn of 62 Isthe diStribUtiOn or circulation and

sales of B2from IT-B2and/or P-B2 to DT-B2, from DT­

B2 to PT-B2,from PT-B2to PA-B2, or IT-B2 and/or PB2

Article 2

(1) Thetypesof 62 subjectto importanddistribution regu­

lationsconsistof chemicals that endangerhealthand

destroythe environment asset forth in AttachmentI

andAttachment II to this Ministerial Regulation.

(2) The types of 62 referred to in paragraph(1) may be

subjectto reviewaccording to developments.

(3) Thetypes ofB2 referred to in paragraph(1) canonly

be used according to their appropriation.

(4) Thetypesof82 referredmin paragraph (1) are banned

from beingusedfor food, <XISI'Tletics and food-related

industries.

THE PROOJREMENTOF IMPORTED B2

ArtIde 3

(1) P-82 that will import 62 referred to in Article 2 para­

graph (1) shall secure IP-BZ recognition status from

the Ministerin this case Dirjen Daglu.

(2) Toobtain IP~B2 recognition status referred to in para­

graph (1) P-62 shall file a written application to the

Ministerin this case Dirjen Daglu, accompanied by :

a. a photocopy of industrial permit/industrialregistra­

tion cardor otherpermit from the technical agency;

b. a photocopy of producerimporter identity number

(API-P);

c. a photocopy of company registrationcard (TOP);

d. a photoropy of taxpayercodenumber(NPWP);

e. a photocopy of customs identitynumber(NIK);

f. a recommendation from authorized official-inthe

industrilll sector,for non pharmaceUtical industries;

and

g. a recommendatton from authorized official in

the field of drug and food control, for pharma­

ceutical, cosmetics; food and food packing in­

dustries.

(3) In ronnection with the written applicationreferredto

in paragraph(2), OirjenOaglu on behalfof the Minis­

tershall issue IP-B2 recognition statusno later than 5

(five) working daysafter the applicationhasbeenre­

ceived in a romplete and correct manner.

(4) 52-imported by IP-B2shall only be to meet the need

from productionprocessand shallnot be soJd, traded

or transferred to other party.

Article 4

(t) The company named IT-B2 forthe types of62 referred

to inArticle 2 paragraph (1) is PT(Persero) Perusahaan

Perdagangan Indonesia.

(2) Any import of 82 by the companyreferredto in para­

graph (1) shall secure import approval from Oirjen

Dagluafter obtaininga recommendation from the au­

thorized officel in the field of :

a. drugand foodcontrol, for pharmaceutical, cosmet­

ics, food and food packingindustries; or

b. industries, for I1Qn pharmaceutical industries.

Article 5

IP-B2 status or IT-B2 status is valid for 1

(one) year since the date of issuance and can be

extended.

CHAPTER IV

THE DISTRIBUTION OFHAZAROOUS MATERIAlS

Article 6

Thetransportation of B2from the destination port

to the IP-B2 or IT-B2warehouse shalf adhere to the proce­

duresandprovisions from the relevantagency, complete

with emergency transportguide.

Article7

(1) The types of 82 referred to in Article 2 can only be

distributed by P-B2, IT-B2, IP-B2, DT-B2, andPT-B2.

(2) In distributing 62 referred to in paragraph (1), P-B2.,

IT-B2, IP-B2, DT-B2, andPT-B2 shall meet the follow-

ing requirements:

a. IP-B2 distributes 82 onlyto meetthe need fromthe

production process of the relevantcompany;

b. IT-B2 can distributeB2to DT-B2, PT-B2 and/orPA­

82;

c. P-B2 candistribute82 to DT-B2, PT-B2 and/or PA­

82;

d. DT-B2 candistribute82 to PT-82 and/or PA-B2i

e. PT-B2 can onlydistributeB2to PA-62.

(3) IT-B2 or DT-B2 can distribute B2 through the branch

offices of their company.

Article8

(1) Thedistribution of B2by P-B2, IT-B2, DT-B2 shall be

eqUipped with LDK/SDS referred to tnAttachment ill

to thisMinisterial RegulatiOn.

(2) B2distributed asreferred to in paragraph (1) shall be

packed using packs acoording In the lawand theInter­

national Maritime Dangerous Goods Code (lMDG CcxJe/

United Nations Standards).

(3) The packs referred to in paragraph (2) shall have

labels containing the name/type of B2, name and

address of P--B2 or IT-B2 or DT-B2 repacking, net

wetght/volume, appropriation, pidd:ogram/dangersym­

bol,signal words, anddangerstatement based on the

general guidereferred to in Attachment IVto thiS Min­

isterial Regulation.

(I) Thetype of B2referred to in Article2 paragraph (1),

Attachment II to this Ministerial Regulation, shall be

distributed using packs of at least the same size re­

ferred to in theAttachment.

(2.) The type Ofrepacked 82 referred to Inparagraph (1)

shall meet the conditions referred to in Article 8 para­

graph (2).

(3) The repacking referredto in paragraph (2) canonly

be done by IT-B2 for the type of imported B2 and

DT-B2 for the type of locally-made and/or imported

Article10

(1) The authority to issue SIUP-B2 shall be in the hands of

the Minister.

(2) TheMinister shall delegate theauthorityreferred to in

paragraph (l}to:

a. DirjenPDN to issue SIUP~B2 to DT-B2i

b. the Governor in this case the Head of Provincial

Offtceto Issue SIUP-B2 to PT-B2.

(3) SIUP--B2 is valid for 3 (three) years and can be ex­

tended beforethe dateof expiry.

(4) The original OfSIUP-B2Issued by Dlrjen PDNreferred

to in paragraph (2) letter a, is sent to the company

with copies addressed to the Head of Provincial Office

andthe Head of Regency/Municipal Office.

(5) The original of SJUP-B2 issued by the Headof Provin­

cialOfficereferred to in paragraph (2) letter b is sent

to the company with copiesaddressed to Dirjen PDN

and the Headof Regency/Munidpal Offke,

Artide 11

(1) The application by DT-B2 for SIUp·B2 uses a form re­

ferredto in Attachment V to this Ministerial Regulation

and is filed to DirjenPDN by fulfiling the following re­

quirements:

a. being in the form of limited liabilitycompany, part­

nership or firm;

b. fulfilling.generalrequirements to engagein trade,

namelySIU~ TO~ Srru/Nuisance Act(HO), and

NPWP;

c. holding a letteror appointmentfrom P-B2, IT-B2or

the combination of the two;d. having an emergency response system and expert

in 62 management; and

e. having and/orcontrolling B2distribution fadlitiesin

the form of storage place, repacking place and

transportmeans that meetsecurity, safety, health

andenvironmental requirements, evidentfrom an

officialreporton physical inspection bythe provin­

cial inspection team.

(2) Theapplication by PT-B2 for SIUP-B2 uses a form re­

ferredto in Attachment V to ttus MinlStel1al RegulatIOn

and is filed to the Head of ProvlndalOfficeby fulfiUing

the following requirements:

a. being in the formof corporate body;

h, fulfilHnggeneral requirements to engage In trade.

namelySIUP, TOp, SITU/Nuisance 1d. (00), and

NPWP;

c. having storing facility that meetssecurity, safety,

health and environmental requirements, evident

from an officialreporton physical inspection by the

regency/municipal inspection team; and

d. holding a letter ofappointmentfrom DT-B2.

(3) If the applicationby DT-B2 for SIUP-B2 referred to in

paragraph (1) and that by PT-B2 for SIUP-B2 referred

to in paragraph (2) have met the requirements, Dirjen

PDN issues SIUP-B2 to DT-B2 and the Head of Provin­

cial OfFICe issues SIUP-B2 to DT-B2 nolaterthan5 (five)

working daysafter the application hasbeen received

in a complete and correct manner using a form re­

ferred to in AttachmentVI to this Ministerial Regula­

tion.

(4) Thedistribution facility-inspecting team referred to in

paragraph (1) letter e is formed by the Governor and

consists of elementsof provincial officeswhose tasks

ClInd responsibilities cover the fields of health, industry,

trade, manpower, agriculture, drug and foodcontrol,

and the environment, and/or experts and other tech­

nicalagencieS aa:ording to the need.

(5) The storage facility-inspecting teamreferred to inpara­

(1) The branches of the companyreferred to in Artide 7

(2) If th~ bll!lnches of the company referred to in para­

graph(1) do not distributeB2from the head officeof

the company they can functionasretailersto distrib­

ute 82 to PA-B2 by having to holdSIUP-B2 asPT-B2.

(3) In distrlbuting 82, the branches of the company re­

ferred to in paragraph (1) shaH meet the folloWing re­

quirements:

a. holding TOP, SITU/Nuisance Act (HO),andNPWP;

b. having anemergency response systemandexpert

In 62management; and

c. having and/orcontrolling B2distribution facilities in

the form ofstorageplace, repacking placeand trans­

port means that meet security, safety, health and

environmental requirements, evidentfromanoffi­

cial reporton physical inspection by the provtncial

inspection team.

(4) Thebranches of thecompany that meetrequirements

referred to in paragraph (3) shall notify their head

office's status orIT-B2or SIUP-.82 asDT-B2 to the Head

of Provincial Office.

(5) The Head of OffIce referred to in paragraph (4) shall

putsignature andstampon the front pageof the pho­

tocopyof their headoffice'sIT-82 or SIUP-82 certifl­

cate as DT-82 no later than 3 (three) working days

. after the noUfication has been rec8ved and the re­

quirements havebeenfulfilled.

(2) The report referred to in paragraph (1) shall besub­

mittednolaterthan 15 (fifteen)calendar days after62

has arrived at the portof unloading using the model of

reporton the import of IP-B2and IT-62 referred to in

Attachment VII to thisMinisterial Regulation.

(3) IP-B2 shall reportthe use of 82 to the Director General

of Agro Chemical Industry,IndustryMinisby, withcop­

iesaddressed to:

a. DirjenPDN; and

b. the deputy for foodand hazardous materialsecu­

rity supervision to the Head of the DrugandFood

Supervisory Agency.

(4) lT~B2 shall report the distributionof 82 among DT-B2,

PT-B2 and/or PA-B2 to Dirjen PON, with copies ad­

dressed to:

a. Dirjen Daglu;

b. the DirectorGeneral of AgroChemical Industry, In­

dustryMinistry; and

c. the deputyfor food and hazardous material secu­

rity supervision to the Head of the Drug andFood

Supervisory Agency.

(5) IfIT-52 referred to in paragraph (1) hasbranches dis­

bibuttng 82fro1'n the headoffice of the company, the

reportsubmitted shall indUdE! the distribution of B2by

its brancheS.

(7) If IT-B2 hasnot yet imported B2and distributed Im­

ported B2referredto in paragraph(1) and paragraph

(4), it shall remain obliged to submit a zero report.

Article 14

(1) DT-82 shall submit a report to Dirjen PDN on B2 ob­

tained from P-B2 and/or IT-B2 as well as on 82 dis­

tributed, using the model of report referred to in At­

tachmentIX to this Ministerial Regulation, with copies

addressed to:

a. the deputy for food and hazardous material secu­

rity supervision Lo the Head of the Drug and Food

Supervisory Agency;

b. the Director General of Agro Chemical Industry, In­

dustryMinistry; and

c. the Head of Provincial Office overseeing the area

wherethe company isdomiciled anddistributes 82.

(2) If DT-82 referred to in paragraph (1) has branches

distributing B2 from the head office of the company,

the report submitted shall includethe distribution of

B2 by its branches.

(3) PT-B2 shaU submita report on the distributionof 82 to

the Head of Provincial Office using the model of report

referred to in AttachmentXto this Ministerial Regula­

tion, with copies addressed to:

a. DirjenPDN;

b. the deputy for food and hazardous material secu­

rity supervision to the Headof the Drug and Food

SuperviSOry Agency;

c. the Director General of AgroChemical Industry,In­

dustryMinistry; and

d. the Headof Regency/Municipal Office overseeing

the areawherethe companyis domiciled.

(4) The Head of Provincial Office shall submit a recapitula-

tionof reports referred to inparagraph (3) to Dirjen PDN.

(5) PA-B2 shallsubmita report on B2 obtained to the Head

of Regency/Munidpal Officeusingthe model of report

referred to in Attachment XI to this Ministerial Regula­

tion, with copiesaddressed to:

a. DirjenPDN;

b. the deputy for food and hazardous materialsecu­

rity supervision to the Head of the Drugand Food

Supervisory Agency;

c. the DirectorGeneral of AgroChemical Industry,In­

dustry MiniStry; and

d. the Head of ProvindalOffice.

(6) The Head of Regency/Municipl'l Office shall submit a

recapitulationof reports referred to in paragraph (4)

to Dirjen PDN.

(7) The report referred to in paragraph (1), paragraph

(3), and paragraph (5) and Article 13 paragraph (6)

shallbe submittedevery quarter of the calendaryear

as follows:

- quarter I, on March 31.

- quarterII, onJune30.

- quarter III, on septernoer30.

~ quarter IV, on December 31.

(8) The obligation for PA-B2 to submit a report referred to

in paragraph (5) does not apply to industrial compa­

nies as IP-B2 using 82 as raw materials/auxiliary ma­

terials for their industrialactivities.

Article 15

The report on the distribution of 82 referred to in

Article 11, for.

a. DT-B2, shall at least contain:

1) name and addressof PT-B2and/or PA-B2;

2) type and CAS numberof 82;

3) net weight or volume of B2i

4) beginning stacksand endingstocks;

5) B2 .

5) B2sales time (date, month, year); and

6) name and address of P-62 and IT-B2 distributing

82.

b. PT-B2, shall at least contain:

1) name andaddress of PA-B2;

2} typeandCAS numberof B2;

3) net weightor volumeof B2;

4) 82 sales time (date, month,year); and

5) name and address of P-B2, IT-B2, and DT-B2 dis­

tributing 62.

c. PA-B2, shall at leastcontain:

1) typeandnetweightor volumeof B2boughtand its

appropriation;

2) begining stocks-and endingstocks;

3) B2purchase time (date, month,year); and

4) name andaddress of P-B2, IT-B2, DT-B2, and PT-B2

disbibuting B2.

Artide·16

(1) IfOT-B2, PT-B2, and PA-B2 cease their business activi­

ties, they shall report the position of B2stocksto :

a. Oirjen PON, for DT-B2;

b. the Governor in this case the Head of Provincial

Office, for PT-B2 and PA-B2 domiciledin the prov­

ince.

(2) Thereport referred to in paragraph (1) shall be sub­

mitted no later than 5 (fIVe) working daysafter the

business activitiesarestopped, evldentfrom a state­

mentofceased business activitiesfrom the party con­

cerned.

(3) In case of 52 reminders at the companies referred to in

paragraph (1), the82 remainders shall bereturned to;

concerned;

b. DT-B2,for B2originatingfrom PT-B2 and/or PA-B2

concerned; and

(1) IP-82 is prohibited to :

a. selland/or transfer B2to other party;

b. import goods/materials whose typeand/orvolume

do not match thosecontained in the certificate of

remgnitionasIP-B2;and

c. import goods/materials referred to in the certifi­

cateof recognition asIP-B2whosevalidity period

has expired.

(2) IT-B2 is prohibited to:

a. importgoods/materials whosetype and/orvolume

do notmatch those contained in the certificateof

recognitlon asIT-B2;

b. import goods/materials· referred to in the certifi­

cate of recognition as IT-B2whosevalidityperiod

has expired;and

Artide 19

The development of IP-B2, IT-B2, DT-B2, PT-B2in

distributing 82 andPA-82 in using 62 shallbe done by the

Trade Minister in coordination With the relevantministries/

agencies.

Article 20

(1) The control of the distribution, packingand labelling

62 coversaspects of licencing/legalityof companies,

distributionof 62 (type, distribution, andstock of 62),

distribution facility to ensure smooth disbibution d 62,

anemergency response systemand expert in 62 man­

agement, reportingof B2 distributed, labels and packs

of 62 andsafety data sheet (50S).

(2) The controlof PA-62 referred to in paragraph (1) cov­

ersaspectsof the useof 62 acoording to itsappropria­

tion.

Artide21

(1) The control referred to in ArtICle 20 can be done indi­

Vidually or jointly by the employeesjofficials of the Di­

rectorate General of Domestic Trade, employees/offi­

dais of the Provincial Office, Regt::ncy/Municipal Office

and/or alongwith relevanttechnical agencies.

(2) Thecontrol by the employees/officials referred to in

paragraph (1) shall be equipped with a letter of as­

signment issued by the authorizedofficials for a cer­

tain periodof time.

(3) The authorized officials referred to in paragraph (2)

shall be:

a. Dirjen PON, for employees/officials of the Director­

ate General of Domestic Trade;

b. the Governor in thiS case the Head of provincial

Office, for employees/officials of the Provincial Of­

fice;

gency/Municipal Office; and

d. the head of relevant agencyoverseeing employ­

eesjofflCials controllingB2.

(4) IP-B2,IT-B2,P-B2, DT-B2, PT-62, andPA-B2 shallgive

widest possible access on the truth of 62 distribution

to the employees/officials conductingthe control re­

ferredto in paragraph (1).

Article 22

(1) Theemployees/offICials referredto in Article21 para­

graph (2) shallsubmit the resultsof control to the of­

ficialassigning them.

(2) If preliminary evidenceof allegedcriminal offenceis

found in the executionof control, the employees/offi­

dais referred to in paragraph (1) shall immediately

hand the findingto the investigator of the Police of the

Republic of Indonesiaby shOWing a letter of introduc­

tion from the officialassigning them.

(1) IP-B2 violating provisions in Article 3 paragraph

(4), Article 6, Article 7 paragraph (2) letter a,

Article 13 paragraph (1) and paragraph (3), Ar­

tive sancticn by haVing its status as IP-e~ re­

voked.

liableto administrative sanction by havfng its srUP-B2

revoked.

(4) PT-B2 violating provisions in Article 7 paragraph (2)

letter e, Article14 paragraph (3) andArticle16para­

graph(1) is liable to administrative sanction byhaving

itsSIUP-B2 revoked.

(5) P-B2 violating provisions in Article7 paragraph (2) let­

ter c andArticle 8, Article9 paragraph (1) and para­

graph (2) is liable to sanction by having its technical

licence revoked by the authorized offICial.

(6) PA-B2 violatingprovisions in Article14 paragraph (5)

end Artide 16 pareqreph (1) is liable to sanction by

having itstechnical licencerevoked by theauthorized

official.

(7) If P-B2 and PA-B2 are liable to administrativesanc­

tions referredto in paragraph (5) and paragraph (6),

the Ministeror appointed official shall issue a recom­

mendation on the revocation of technical licenceS to

the relevant agency/authorized offidal.

Artide24

(1) Theadministrative sanctions referred to in Article 23

paragraph (3)1 paragraph (4)are imposed atterwrit­

tenwarnings have been issued 3 (three) timeswith an

intervalof 1 (one) month.

(2) Theformat of written warninganddecision onthe re­

vocation of SIUP-B2 follows Attachment XII and At­

tachmentXIII to this Ministerial Regulation.

Artide 25

(1) IP-62 VIOlating provisons In ArtiCle6, Article BandAr­

tide 17 paragraph (1) letter b and letter c, is liableto

sanction according to the law.

(2) IT-B2violating provisions in Article6, Article8 andAr­

tide 17 paragraph (2) letter a and letter b, is liable to

sanction according to the law.

(3) DT-B2 violating provisions in Article 8 and Artide 17

paragraph (1) andparagraph (3), is liableto sanction

according to the law.

(4) The branch of company violatingprovisions inArticle

12paragraph (2) is liableto sanction aa:ordingto the

law.

Artide26

Any indMctual or corporate body violatingprovi­

sions in Article 18 is liable to sanction according to the law.

Artide27

(1) The type of B2 that does not meet provisions in Ar­

tide 2 paragraph (4) shall be withdrawn from circu­

lation.

(2) The withdrawal of 82 from drculation referredto in

paragraph (l) shallbe ordered bythe authorized offi­

cialandthe withdrawalshallbeconducted bytherel­

evantcompany.

(3) Allexpenses arising from theWithdrawal of Breferred

to in paragraph (2)shall bebornebythe relevant com­

pany.
