ADMINISTRATIVE LAW JUDGE’S RULING CLARIFYING PROCESS FOR THIRD PARTY ENERGY EFFICIENCY PROGRAM PROVIDERS TO SELECT

CONTRACTOR TO CARRY OUT EVALUATION, MEASUREMENT AND VERIFICATION OF 2004-05 LOCAL ENERGY EFFICIENCY PROGRAMS

Decision (D.) 03-12-060 delegated to the assigned Administrative Law Judge the authority to rule on the selection of Evaluation, Measurement and Verification (EM&V) contractors that would evaluate the performance of 2003-04 energy efficiency programs.

Table 1 attached to this ruling lists all EM&V contractors who are approved to perform EM&V work for each of the 2004-2005 Non-IOU, Local-IOU, and partnership programs. Energy Division staff must first approve the associated program’s proposed implementation plan and an executed contract with the administering utility. Contractors whose relationships to programs might compromise or appear to compromise an independent evaluation are not included on the list. Contractors not on the list may not assist listed contractors.

The objectives of EM&V are articulated in the Commission’s Energy Efficiency Policy Manual as follows:

“Measuring level of energy and peak demand savings achieved (except information-only);

“Measuring cost-effectiveness (except information-only);

“Providing up-front market assessments and baseline analysis, especially for new programs;

“Providing ongoing feedback, and corrective and constructive guidance regarding the implementation of programs;

“Measuring indicators of the effectiveness of specific programs, including testing of the assumptions that underlie the program theory and approach;

“Assessing the overall levels of performance and success of programs;

“Informing decisions regarding compensation and final payments (except information-only);

“Helping to assess whether there is a continuing need for the program;

“Not all of the objectives may be applicable to all programs. Implementers1 are free to propose an EM&V approach that is logical for their program. . . . For the M&V portion of the plan, implementers should adhere to the guidelines in the International Performance Measurement and Verification Protocol (IPMVP), available on the Internet at http://www.ipmvp.org.”

In addition, the Policy Manual lists the following components for an adequate EM&V plan:

“Baseline Information

“Determine whether or not baseline data exist upon which to base energy savings measurement.

Existing baseline studies can be found on the California Measurement Advisory Committee website ( http://www.calmac.org/) and/or the California Energy Commission website (http://www.energy.ca.gov/). Detailed sources of baseline data should be cited.“If baseline data do not exist, the implementer will need to conduct a baseline study (gather baseline energy and operating data) on the operation(s) to be affected by the energy efficiency measures proposed.“If the baseline data do not exist and the implementer can show that a baseline study is too difficult, expensive or otherwise impossible to carry out prior to program implementation, the contractor should then provide evidence that baseline data can be produced or acquired during the program implementation. This process should then be detailed in the EM&V plan.

“Energy Efficiency Measure Information

“Full description of energy efficiency measures included in the program, including assumptions about important variables and unknowns, especially those affecting energy savings.“Full description of the intended results of the measures.

“Measurement and Verification Approach

“Reference to appropriate IPMVP option.“Description of any deviation from IPMVP approach.“Schedule for acquiring project-specific data.

“Evaluation Approach

“A list of questions to be answered through the program evaluation.“A list of evaluation tasks/activities to be undertaken during the course of program implementation.“A description of how evaluation will be used to meet all of the Commission objectives described above.”

All EM&V contractors approved in this ruling and selected to conduct EM&V activities should perform the foregoing activities in a timely and thorough manner.

No later than June 30, 2004, each program implementer shall submit to the Commission’s Energy Division by e-mail to [email protected] and to the utility administering its program the name of the firm it has selected to perform EM&V work on its program. Unless Energy Division contacts the program implementer and objects to the selection on or before July 10, 2004, the program implementer may initiate work with the contractor on EM&V activities.

The selected EM&V contractor for each program shall submit its EM&V plan to the program implementer and to [email protected] no later than 30 days after EM&V contractor selection. On request, the program implementer shall forward the EM&V plan to the utility administering its program. The EM&V plan submitted to the Commission’s Energy Division will be reviewed and may be modified.

IT IS ORDERED that:1. A program provider may use more than one contractor to perform Evaluation, Measurement and Verification (EM&V) if both contractors are on their approved list.2. A list of approved EM&V contractors for each program is attached as Table 1 of this ruling. No contractor or individual may provide any EM&V work, including subcontracted work, for any energy efficiency program unless it is listed as an approved contractor or it receives approval in writing from the Commission’s Energy Division staff. 3. No later than June 30, 2004, each program implementer shall submit the name of the selected EM&V contractor to the Commission’s Energy Division by e-mail to [email protected] and to the utility administering its program.4. Unless it receives a negative response from the Commission’s Energy Division to its selection on or before July 10, 2004, the energy efficiency program sponsor may initiate EM&V work with the approved contractor.

5. The selected EM&V contractor for each program shall submit its EM&V plan to the program implementer and to [email protected] no later than 30 days after EM&V contractor selection. On request, the program implementer shall forward the EM&V plan to the utility administering its program.6. Any program for which no EM&V contractor is approved in this ruling shall be assigned an EM&V contractor by Energy Division staff if its program implementer does not identify acceptable EM&V contractors to the Energy Division staff by May 5, 2004.
