National Defence Défense nationale Effective: 15 October 2010 DND is now implementing a program to replace the current DND 404 with a new, plastic based photo licence that will meet the Canadian Drivers Licencing Agreement security standard and be similar in type and quality as Provincial Driver’s Licences throughout Canada. The current paper licence will remain in effect until the new photo licence is in place. Initial issue of the new DND 404 driver’s licence is anticipated to begin spring 2011 and finish winter 2012. An updated fact sheet will be issued to all Provincial Transportation Ministries and their Law Enforcement agencies at that time. Ticketing When stopping a DND vehicle, law enforcement agents should request to see the driver’s DND 404, DND photo identification card and Trip Ticket authorizing the task or detail for which they are driving. The DND photo ID card includes the member’s full name, date of birth and service number. Additional information such as vehicle identification, contact numbers and mailing address required to complete a Police Investigation Report may be obtained by contacting the Dispatch Office at the member’s home base or unit, if necessary. Infractions should be issued against the member’s DND 404 and not their Provincial Driver’s Licence, as the member is licenced and insured under the Crown when operating a DND vehicle. CF members who have been ticketed against their DND 404 while driving a DND vehicle are to notify their chain of command. Supervisors will then take appropriate administrative or disciplinary action, which may include remedial driver training, temporary suspension or loss of the member’s DND 404. CF members who have had their Provincial Driver’s Licence suspended or revoked while off duty are also obligated to notify their chain of command, and will automatically lose their DND 404 for a period at least equal to the period of suspension imposed by provincial authorities. Law Enforcement Agents are asked to report any DND driving infractions through their Provincial Transportation Ministry to National Defence Headquarters, Director Transportation 2-5 at 1-877-363-8811 to ensure that appropriate remedial action is taken. DND 404 Driver’s Licence The Department of National Defence (DND) is the only Federal Department authorized to use its own driver licencing program under the provision of the National Defence Act. The DND licencing program ensures that all Canadian Forces (CF) members and DND employees operating DND vehicles or any other vehicles rented in support of their operations are properly trained and tested before being issued a DND 404 Driver’s licence. DND vehicles are defined as any military or civilian pattern vehicles with Canadian Forces Registration plates, and are covered under the Crown’s self-underwriting insurance policy. Provincial Highway Traffic Act Jurisdiction Although DND personnel operating DND vehicles are not subject to provincial or municipal regulations, it is DND policy to adhere to provincial transport regulations whenever possible, unless otherwise directed in support of operations. DND 404 Driver’s Licence The DND 404 is issued to military members, DND employees and contractors who have sucessfully completed DND driver training, and entitles the holder to drive DND vehicles for which they are qualified. The expiry date of the DND 404 shall be five years from the date of issue. Military members do not require a civilian driver’s licence to operate DND vehicles. DND employees and contractors, however, must have a valid unrestricted Provincial Driver’s Licence for a vehicle class equivalent to the DND vehicle being driven. All information contained on the licence is based on the driver’s Proficiency Record and is registered in the DND military Fleet Management System.

Entrée en vigueur : le 15 octobre 2010Le MDN s’affaire à mettre en œuvre un programme pour remplacer les actuels DND 404 par un nouveau permis de conduire plastifié et muni d’une photo qui satisfera aux normes de sécurité de l’Entente canadienne sur les permis de conduire (ECPC). Il ressemblera, par son format et sa qualité, aux permis de conduire provinciaux au Canada.

L’actuel permis de conduire sur support-papier restera en usage jusqu’à l’entrée en vigueur du nouveau permis avec photo. La délivrance de ces nouveaux DND 404 devrait commencer au printemps 2011 pour se terminer à l’hiver 2012. Une fois que le nouveau permis plastifié aura été approuvé, un feuillet contenant de l’information mise à jour sera envoyé à tous les ministères des transports provinciaux et à leurs organismes d’application de la loi.

ContraventionsLorsque des agents d’application de la loi arrêtent un véhicule du MDN, ils devraient demander à voir le DND 404 du conducteur, sa carte d’identité à photo du MDN et la feuille de route autorisant la tâche ou l’itinéraire du déplacement. La carte d’identité à photo du MDN comprend le nom complet du militaire, sa date de naissance, son numéro matricule ainsi qu’un numéro de série. Au besoin, le bureau de répartition de la base ou de l’unité d’attache du militaire peut fournir les informations supplémentaires nécessaires pour remplir un rapport d’enquête policière, comme l’immatriculation du véhicule, les numéros de téléphone et l’adresse postale.

Les constats d’infraction doivent être appliqués contre le DND 404 du conducteur et non contre son permis de conduire provincial étant donné que le permis de conduire et l’assurance d’une personne qui conduit un véhicule du MDN relèvent de la responsabilité de l’État.

Les militaires qui reçoivent un constat d’infraction appliqué contre leur DND 404 alors qu’ils conduisent un véhicule du MDN doivent en aviser leur chaîne de commandement. Leur superviseur prendra alors les mesures administratives ou disciplinaires appropriées qui peuvent comprendre un cours de conduite correctif, une suspension temporaire ou la perte du DND 404.

Les militaires dont le permis de conduire provincial fait l’objet d’une suspension ou est révoqué alors qu’ils ne sont pas en service ont aussi l’obligation d’en aviser leur chaîne de commandement, et dans le cas d’une suspension imposée par les autorités provinciales, ils perdront automatiquement leur DND 404 pour une période au moins égale à cette suspension.

Les agents d’application de la loi doivent soumettre toute infraction de conduite liée au MDN, par l’intermédiaire de leur ministère des transports provincial, au Quartier général de la Défense nationale, Directeur des transports 2-5, par téléphone au : 1-877-363-8811 afin que les mesures correctrices appropriées soient prises.

DND 404 Permis de conduireLe ministère de la Défense nationale (MDN) est le seul ministère fédéral autorisé à utiliser son propre programme de délivrance de permis de conduire en vertu de la Loi sur la défense nationale. Le programme de délivrance des permis du MDN garantit que tous les membres des Forces canadiennes (FC) et les employés du MDN qui conduisent des véhicules appartenant au MDN ou tout autre véhicule loué dans le cadre de leurs fonctions, sont formés et évalués adéquatement avant d’obtenir un permis de conduire DND 404.

Les véhicules du MDN sont définis comme tout véhicule de modèle civil ou militaire qui porte des plaques d’immatriculation des Forces canadiennes, et qui est couvert par la politique d’auto-assurance de véhicules de l’État.

Compétence du Code de la route d’une provinceBien que le personnel du MDN qui conduit des véhicules du MDN n’est pas soumis à la réglementation provinciale ou municipale, le MDN a comme politique de respecter autant que possible les règlements provinciaux en matière de transport, à moins d’indication contraire pour des raisons opérationnelles.

Permis de conduire DND 404 Le DND 404 est délivré aux militaires, aux employés du MDN et aux entrepreneurs qui ont réussi l’instruction de conducteur du MDN, et il autorise le titulaire à conduire les véhicules du MDN pour lesquels il est qualifié. Un DND 404 vient à échéance cinq ans après avoir été délivré.

Les militaires ne sont pas obligés de détenir un permis de conduire civil pour conduire les véhicules du MDN. Cependant, les employés du MDN et les entrepreneurs doivent posséder un permis de conduire provincial sans restriction et valide pour un véhicule de classe équivalant aux véhicules du MDN qu’ils conduisent.

Toute l’information contenue sur le permis de conduire est fondée sur la fiche de compétence du conducteur et est inscrite dans le Système de gestion du parc automobile militaire du MDN.
