Minutes of Meeting held on 06.08.2015 for processing of Long Term Access & Medium Term Open Access applications received during the period of Jan’14-Dec’14 & and in Jun’15 (MTOA) as per the CERC directions vide Orders dated 16.02.2015 & 03.07.2015
1.0 The list of participants present in the meeting is enclosed at Annexure-I
2.0 COO (CTU-Plg & CE) welcomed the participants and informed that in
compliance with the directions issued by Hon’ble CERC vide its Orders dated
16.02.2015 & 03.07.2015, CTU is processing all the LTA & MTOA applications
received during the period Nov’13 to Dec’14 which are seeking power transfer
from NEW Grid to SR Grid sequentially on a monthly basis. The grant of LTA/
MTOA applications received in Nov’13 to Dec’13 were discussed in the LTA/
MTOA Meeting of SR & WR Constituents held on 15.07.2015 and the same has
been processed in-line with CERC Regulations.
3.0 Further, it was informed that Minutes of Meeting of SR & WR constituents held
on 15.07.2015 were issued vide CTU letter dated 20.07.2015. Subsequently,
one of the participants M/s Dhariwal Infrastructures Ltd informed through email
that the commissioning schedule of its generation plant has been inadvertently
mentioned as Aug’15 instead of Aug’14. The same is taken into cognizance.
As no further comments/observations have been received, accordingly the
minutes, as circulated were confirmed with the above modifications.
4.0 It was further informed that one of LTA applicants of Dec’13, M/s Ideal Energy
Projects Ltd was agreed for grant of LTA in the meeting held on 15.07.2015. In
this regard, CTU stated that IEPL in December, 2013 had applied for both LTA
& Connectivity. At the time of application, IEPL indicated that it was granted
Connectivity to STU network through LILO of Koradi - Wardha line of MSETCL
and also sought connectivity to ISTS grid. However, the connectivity application
to ISTS Grid made in December, 2013 could not be processed in absence of
consent (NoC) from MSETCL for disconnection from state network till date.
Further, IEPL vide its letter dated 11.05.2015 has sought permission to retain
connectivity with STU network whereby it becomes an embedded intra-state
entity making it necessary to obtain NoC from MSETCL for injection of power.
The issue was discussed in the 21st LTA meeting of WR held on 17.07.2015,

wherein, in the absence of NoC from MSETCL, the Connectivity & LTA
applications of IEPL received in Dec’13 were decided to be closed on account
of non-conformity with the Regulations. Accordingly, closure letter has been
issued to M/s Ideal Energy Projects Ltd.
5.0 Regarding available balance ATC for transfer of power under LTA/MTOA for
application’s Jan’14 onwards, following may be noted:
a) With effect from 1st June, 2014, 211 MW MTOA was expiring. Out of
which, while processing June, 2013 to Oct, 2013 MTOA applications as
per CERC directions in the above referred order, 100 MW has been
allocated to PTC for transfer of power from BALCO in Chattisgarh to
Kerala for the period from 1st March’ 2015 to 28th February, 2017.
b) GMR Emco has been granted LTA for (150 MW) for application in Dec’ 13
and MTOA (150 MW) for application in Nov’ 13, against the same PPA.
GMR EMCO has informed in the meeting held on 15-07-2015 that as and
when the LTA granted for the application made in Dec’13 operationalizes,
the MTOA shall be relinquished in line with CERC Regulations.
Accordingly, assumption has been made that MTOA would be surrendered
and hence access of only 150 MW shall be given to EMCO at any point of
time.
c) Based on the letter from IDEAL energy dated 11-05-2015 communicating
its intention of connecting to STU Grid (Maharashtra grid) and non-
availability of NOC from MSETCL even by date of LTA meeting of WR
constituents held on 17-07-2015, Dec’13 LTA application of Ideal Energy
(240MW) has been found to be not in conformity with the Regulations and
has been closed.
It was informed that after the allocation of LTA of 2198.5 MW (1208+990.5) and
MTOA of 475.2 MW (465.2+10.0) for Nov’13-Dec’13 applications, the
cumulative LTA & MTOA including those granted for power transfer from NEW
grid to SR would be 4089.5MW including 20 MW LTA for Solar allocation from
NR to SR from 01.06.2016 onwards and 1325.2 MW respectively, details given

at Annexure-II and the total ATC envisaged between NEW grid and SR grid is
5900 MW w.e.f 1st April, 2015.
Therefore, the balance notional ATC available for allocation w.e.f 1st April, 2015
is 505.3MW. The same is considered for processing of the applications from
Jan’14 to Dec’14. System Studies have been carried out for the same and
circulated as a part of the agenda for this meeting.
6.0 Representative of CTU explained the methodology being followed for grant of
LTA/MTOA applications received in the months of Jan’14 to Dec’ 14 in-line with
the guidelines prescribed in CERC Orders dated 16.02.2015 and the treatment
of MOP allocation & determination of ATC as per the Order dated 03.07.2015.
Further, the LTA/ MTOA applications as per the agenda were taken up for
discussion. The details of MTOA applications received from Jan’ 14 to Dec’ 14
are given at Annexure-III.
7.0 The representative of POSOCO stated that the TRM of 750 MW for NEW grid
to SR grid flow gate is as per the STOA regulations and it should be higher in
case of planning for processing of LTA/MTOA where uncertainties are much
more. He further stated that in the recent past the LTAs have been curtailed
due tolot of construction works of transmission lines and scheduled shutdown of
the critical transmission lines and therefore CTU should consider such
uncertainties which are happening in the real time operation.
The representative of TANGEDCO stated that CTU should consider the
contingencies as per the Transmission Planning Criteria and should determine
& allocate ATC accordingly. He further stated that keeping margins more than
that envisaged in planning criteria would lead to sub-optimal utilisation of
transmission capacity.
CTU clarified that for determination of TTC/ATC, the contingencies of N-1 have
been considered as per the Transmission Planning Criteria and wherever the
transmission system is planned as per N-1-1 criteria, same has been
considered. However under the conditions as stated by POSOCO, they may
take actions in-line with the CERC Regulations.

8.0 Applications received in Jan’14: As the LTA application (M/s Adhunik Power
& Natural Resources Ltd) submitted in January’14 is seeking power transfer of
100 MW from NEW Grid to SR grid against ATC of 505.3 MW, it was informed
that the LTA can be accommodated and hence notional LTA for the applied
quantum was agreed for grant from 01.04.2015.
9.0 Applications received in Feb’14: It was informed that no LTA application has
been received in the month of Feb’14. MTOA applications were submitted
however, the same cannot be processed as time period for which MTOA has
been sought had already elapsed as well as the ATC is available only after 1
year from the month in which application has been made. Accordingly, it was
agreed to close the MTOA applications.
10.0 Applications received in Mar’14: An application for LTA was submitted by
BESCOM for transfer of 450 MW from ER to SR. However the balance capacity
after granting LTA of 100 MW to Jan’14 application is 405.3 MW which is
inadequate to accommodate the LTA quantum of 450 MW. Further, ATC of 200
MW would be available w.e.f 01st Dec’15 as a result of expiry of MTOA granted
to Jindal Power for transfer of power from Chhattisgarh to Tamil Nadu thereby
resulting in ATC of 605.3 MW w.e.f 01.12.2015. Hence, it was agreed that LTA
for 450 MW may be granted to BESCOM from 01.12.2015, leaving a balance
ATC of 155.3 MW. For the MTOA applications received in this month, the
period for which MTOA has been sought has already elapsed, therefore, it was
agreed to close these applications.
11.0 Applications received in Apr’14: In the month of Apr’14, only one LTA
application (KSEB-233.75 MW) has been received. As per the agenda, it was
mentioned that the balance ATC of 155.3 MW between NEW grid and SR Grid
is not adequate for accommodating the LTA requirement of 233.75 MW.
Therefore, as per the directions of CERC, ATC of 155.3 MW between NEW
Grid and SR Grid shall be earmarked for grant of LTA, however, LTA shall be
granted when adequate ATC for accommodating full quantum of LTA shall be
available. Further, ATC of 200 MW would be available w.e.f 1st January, 2016
when MTOA of 200MW granted to Adani Power for transfer of power from their
generation project in Gujarat to TANGEDCO shall expire on 31st December,

2015. With this, the ATC available would be 355.3MW (155.3+200MW) from 1st
January’16 and accordingly LTA of 233.75 MW sought by KSEB for transfer of
power from DVC projects in ER can be accommodated.
Towards this, Representative of KSEB informed that it has requested CTU for
reduction of LTA quantum of the present application from 233.75 to 141.5 MW
vide its letter dated 05.08.2015 and the same has to be considered in the
treatment of its LTA application submitted in Apr’14. He further stated that as
the request for change in quantum is less than 100 MW, there is no need of
submission of a fresh application as per Clause 12 of the CERC Regulations.
As a result of reduction in required LTA quantum, the following were
deliberated:
a.) As per CERC Orders, the processing of LTA/ MTOA applications received
during the period Nov’13 to Dec’14 is being carried out as if were processed
in the past. Thus, whether to consider the request made by the applicant in
the present timeframe i.e., in Aug’15?
b.) In case the request is considered, can the quantum of 92.25 MW (233.75-
141.50 MW) be considered for allocation of ATC against the applications
received in the subsequent months i.e., from May’14 to Dec’14?
Accordingly, opinion of the participants was sought on the above issues.
The Representative of KSEB & Jindal Power Ltd opined that accommodating a
request for increase in quantum for less than 100 MW would have an impact on
the processing of subsequent applications and similarly, a request for decrease
in quantum for less than 100 MW also will have an impact on its following
applications. Hence, if the present request for decrease in quantum is
entertained, the released capacity may be considered for allocation of
LTA/MTOA for the months of May’14 to Dec’14.
Representative of TANGEDCO mentioned that as the applications are being
processed as if were processed in the past and request is made in the present,
there is no clear provision with respect to its treatment in the CERC Regulations
and Orders. Further, a change in request for decrease in quantum may be
accommodated as the released capacity can be utilized by other applicants.

However, a similar change for increase in quantum should not be accepted as it
results in impacting the subsequent applications. Therefore, the Representative
was of the view that the request of KSEB for reduction may be considered while
granting LTA, however the quantum available due to such reduction should be
considered as if it is known only in Aug’15. This way action will be in line with
the Regulatory point of view.
Representative of Jindal India Thermal Power Ltd mentioned that allowing such
a request for change in quantum at this stage would provide an opportunity for
other applicants to request for change in quantum for the applications made in
the past.
After due deliberations, CTU mentioned that such requests for change in
quantum can be accommodated as long as they are in the line with the CERC
Regulations. Further, it is informed that as per the Regulations, there is no need
of a fresh application for change in quantum for less than 100 MW and hence
the priority of the application remains the same even if the request for change is
made at a later date. Though the request has been made in Aug’15, the said
application is still in process and hence, the present request for reduction of
quantum can be accommodated as per CERC Regulations for grant. However,
this request for reduction of quantum could not have been visualized in the past
at the time of processing the applications of May’14 to Dec’14 and hence the
reduced quantum shall not be considered in the ATC available for allocation to
Jan’14-Dec’14 applications.
Accordingly, it was proposed that LTA of 141.5 MW may be granted to KSEB
with effective from 01st Jan’16.
All the Constituents and the applicants unanimously agreed for the above.
12.0 Applications from May’14 to Sep’14 – No LTA application has been received
during this period. MTOA applications were submitted, however, time period for
which MTOA has been sought has already elapsed. Accordingly, it was agreed
to close the MTOA applications.

13.0 Applications received in Oct’14: No LTA applications were submitted in the
month of Oct’14. However, there are 7 eligible MTOA applications as per the list
below:
As per the CERC directions, in cases where ATC is not adequate for grant of
LTA, the available ATC shall be earmarked and blocked for the LTA till the
adequate capacity is available for accommodating full quantum of LTA. This
ATC during the intervening period is to be used for grant of MTOA. In this
regard, as mentioned at para 10, ATC of 405.3 MW available from 01.04.2015
is less than LTA sought for 450 MW, similarly, as mentioned at para 11, ATC of
155.3 MW available from 1.12.2015 is less than the LTA sought for 233.75 MW.
The ATC so available for MTOA in the intervening period is summarized below:

MTOA applications of Oct’ 14 is before 31st May, 2016, therefore, this capacity
of 500 MW shall be not be available for Oct’14 MTOA applications.
In this regard, it was explained that ATC of 155.3 MW is not available for the
period beyond 31st December, 2015 for the reasons mentioned herein:
As mentioned in Para 11, the MTOA of 200 MW granted to Adani Enterprises is
expiring on 31st Dec, 2015. However, while processing Feb, 2015 MTOA
applications, MTOA was granted to KSEB for 140.5 MW for the period from 1st
Jan, 2016 to 31st May, 2018 & to Jindal Power for 59.5 MW for the period 1st
Jan, 2016 to 31st Aug, 2017. Subsequently, while processing the Dec, 2013
LTA application, KSEB was granted LTA in which the PPA enclosed was same
as that for the Feb, 2015 MTOA application. As the priority for operationalization
of Dec, 2013 LTA application shall be higher than the Feb, 2015 MTOA,
therefore, 140.5 MW ATC shall be available as considered above. Accordingly,
balance ATC beyond 1st January, 2016 shall be 62 MW (=121.55 – 59.5).
Amongst the Oct’14 applicants, the application at Sl. No (1) of M/s. Shree
Cements has the longest period thereby gets the highest priority. Therefore it
was agreed that M/s Shree cements may be granted MTOA as per the
following:

After allocating MTOA as per above, 105.3 MW of ATC shall be available from
1st Apr’ 15 to 30th Nov’ 15. The same is allocated to applicants with next longest
duration in proportion to the quantum they had applied for. Accordingly it is
mentioned that MTOA may be granted to the MTOA applications for the period
from 1st June’15 to 30th Nov’ 15 on pro-rata basis as below:
a.) GMR Energy Trading Limited (26 MW against request of 200 MW),
b.) Shree cements (7 MW against request of 50 MW),
c.) NTPC Vidyut Vyapar Nigam Limited(33 MW against request of 250 MW) and

d.) PTC India Ltd (39 MW against request of 300 MW).
The remaining applications of October’14 shall be closed on account of non-
availability of ATC.
The constituents agreed for the above.
14.0 Applications received in Nov’14: No application for LTA has been received in
the month of Nov’14. However, a total of three MTOA applications are found to
be eligible and the same are considered. The ATC from the period of 1st April,
2015 to 31st Dec, 2015 has been utilized for grant of MTOA applications of Oct’
2014. The next ATC would be available from 1st June, 2016, however this
capacity cannot be considered for allocation to the Nov’ 2014 MTOA
applications as per Regulation 19(2), since the ATC is getting available 12
months later from the month in which the MTOA applications has been made.
Hence, it was agreed that the above MTOA applications shall be closed on
account of non-availability of ATC.
15.0 Applications received in Dec’14: LTA applications for a total quantum of 727
MW have been received for transfer of power from NEW Grid to SR Grid
(Kerala). It was explained that the ATC available between NEW grid and SR
grid is 5900 MW against which 4873 MW LTA has been granted on firm basis
and 838 MW has been granted on target region basis, thereby, leaving balance
capacity of 189 MW. This capacity is not adequate to accommodate all the LTA
applications received in Dec, 2014. Therefore, it was informed that LTA to Dec,
2014 applicants can only be granted with the enhancement of ATC through
system augmentation which is already under construction.
Further, for the entire LTA of 727 MW, Kerala is the firm beneficiary. With the
proposed LTA of 727 MW, the cumulative grant/proposed grant of MTOA and
LTA to Kerala shall be about 3000 MW. There are constraints in the import
capability of Kerala & accordingly strengthening of transmission system and
augmentation of transformation capacity may be required.
Representative of KSEB stated that some of their MTOA shall be expiring in the
period 2017-18 and hence, the import requirement mentioned in the agenda
needs to be re-worked. CTU mentioned that the decision for Dec, 2014 LTA

shall have impact on June, 2015 applications which are required to be
processed by 10th August, 2015, therefore, the re-assessment of import
capability may be completed on that day (i.e., 06.08.15) itself. After
deliberations, it emerged that instead of taking any decision in haste, as a
special case the processing of MTOA application may be delayed by a week or
so. Accordingly, it was decided that a separate meeting may be convened at an
early date (on 13.08.2015) with constituents and Dec, 2014 applicants wherein
June, 2015 MTOA applications may also be processed.
As regards MTOA applications, it was mentioned that the entire available ATC
uptill May, 2016 has been allocated for MTOA and the next ATC shall be
available from 1st June, 2016 with the expiry of MTOA. This capacity cannot be
considered for allocation to the Dec’ 2014 MTOA applications as per Regulation
19(2), since the ATC is getting available 1 year later from the month in which
the MTOA applications have been made. Accordingly, it was agreed to close all
the MTOA applications of Dec’ 2014.
16.0 MTOA Applications received in Jun’15: As mentioned above, the processing
of LTA applications received in Dec’14 would have an impact on the processing
of MTOA applications received in Jun’15 and hence it was decided that the
Jun’15 applications will be considered at a later date along with the Dec’14
applications in the above scheduled meeting.
17.0 Conclusion: In line with the above, it was decided to grant notional LTA to
Jan’14-Nov’14 LTA applicants subject to availability of the dedicated
transmission system as well as identified common transmission system and
notional MTOA with the existing/under construction transmission system to the
applications received in the January-December, 2014 for transfer of power from
NEW to SR. Further the applicants are liable to pay relinquishment charges as
per the directions of Hon’ble CERC, wherever applicable and are also subject
to the establishment of necessary payment security mechanism.
It was informed that the intimations for grant of notional LTA/MTOA shall be
issued by CTU in terms of the CERC directions as per the details mentioned
below:
