As a result, HSAS embarked on a newspaper ad campaign to inform the public in Yorkton what the issues were and to put them on notice that a withdrawal of services was a possibility. During this time, HSAS was working, to no avail, to effect a settlement through discussions with the owner of the

Yorkton HSAS Strike is Over In March 2003, the unorganized Emergency Medical Technicians employed by the privately owned Crestvue Ambulance Services Ltd. in Yorkton, chose HSAS to be their bargaining agent. Over the following year and a half, HSAS and the owner of Crestvue met to bargain a first collective agreement. The parties were successful in coming to an agreement on most items except for wages. Regarding wages, HSAS’s proposal was to establish a six step hourly wage grid ranging from $18.106/hr to $22.029/hr which is identical to that contained in our provincial HSAS/SAHO contract. ambulance service, government and the Sunrise Health Region. With no settlement in sight, HSAS conducted a strike vote March 29. Results of the vote were announced at a press conference in Yorkton, March 30. (100% of those voting vote for strike.) The strike was conducted from April 4, 2005 to May 19, 2005, nearly seven weeks, with essential services being provided by our striking members. Public support during our job action remained strong to the end. On May 20, 2005, our members returned to work after the employer agreed to a six step wage grid that is identical to the HSAS/SAHO provincial wage schedule. Congratulations to our HSAS members employed by Crestvue Ambulance Services Ltd. for achieving their First Collective Agreement and we thank them for demonstrating what solidarity and perseverance can accomplish.

I am grateful to be given the opportunity to congratulate the Emergency Medical Technicians, represented by HSAS and employed by Crestvue Ambulance Service in Yorkton, on the successful result of their lengthy job action. Lobbying of Government, support of the HSAS Executive Council, the hard work of staff, support of the community of Yorkton and other unionized workers (CUPE and SUN) and the firm resolve of the Crestvue Ambulance professionals resulted in a settlement that was ratified on May 26, 2005. This Agreement saw the implementation of the provincial HSAS 6 Step EMS Wage Schedule as well as Recognition of Previous Experience and placement on the appropriate Step for our dedicated and deserving HSAS EMS professionals in Yorkton. Once again our most hearty congratulations to all involved in this great victory. Greater challenges lie ahead as we continue our efforts to negotiate a fair Provincial Collective Agreement. The Government mandate of 0-1-1% for 2004-2005-2006 will not meet the needs of our membership or aid in the recruiting and retention of health care professionals in order to provide high quality health care to the residents of Saskatchewan. Your Executive Council, Bargaining Committee and staff are committed to the hard work which will be necessary to pressure Government and the Employer to respect our membership and the important role you play in health care in this province. I challenge you to exhibit your resolve and work with us to ensure that we present a united voice in securing a Collective Agreement which honors our collective vision and professionalism. - Chris Driol President of HSAS

Provincial HSAS / SAHO Bargaining

Some History • November/December 2003 - HSAS Bargaining Team sends bargaining survey to HSAS

members to determine what members want bargained. • January/February 2004 - HSAS Bargaining Team conducts 32 membership meetings

around the province to inform members of the survey results and to confirm that bargaining priorities as identified by the survey results are reflective of the membership.

• May 20, 2004 - HSAS Bargaining Team provides SAHO Bargaining Team proposals

identified by HSAS members as their priorities. • May 2004 to December 2004 - HSAS and SAHO Bargaining Teams meet for 18 days.

Although progress is made on non-monetary rights language, none of the HSAS priority proposals are achieved as SAHO refuses to move off of government’s mandate of 0% for 2004, 1% for 2005 and 1% for 2006.

• January 13, 2005 - The HSAS Executive Council unanimously passed a motion directing

the Bargaining Committee to conduct membership informational meetings throughout the province followed by a strike vote. The timing of the strike vote will be determined by Executive Council.

• April 4, 2005 to May 3, 2005 - HSAS Bargaining Team conducts 30 membership

meetings throughout the province explaining the need for a strong strike mandate from the membership if there is a desire to break the government’s 0%, 1%, 1% mandate.

Note: Several public sector settlements signed between September 2004 and May 2005 clearly exceeded the mandate (Teachers, SGI, SaskTel, SGEU public service). • May 12, 2005 - At their May 12, 2005 meeting, Executive Council directs a strike vote be

taken. • May 18, 2005 - Strike ballots, along with an explanatory memorandum are mailed to

each HSAS member’s home. Completed ballots are to be returned no later than June 9, 2005 to the Saskatoon HSAS office. Please visit our web site on June 10, 2005 to see the results. Provided we have a majority voting for strike we will also hold a press conference early in the week of July 13 to announce the results to the public.

Upcoming Events A. Meeting of Executive Council The next HSAS Executive Council meeting will be held Tuesday, June 14, 2005 in Davidson. B. HSAS Annual Convention The 34th HSAS Annual Convention will be held Saturday, November 19th at the Hotel Saskatchewan Radisson Plaza in Regina commencing 1:00 p.m. (a) Resolutions To Be Considered At The Annual Convention

In order for resolutions from the membership to be considered at the Annual Convention, the following conditions must be met:

(i) each resolution must be submitted by ten (10) active members of the union and (ii) each resolution must be received by the secretary of the union at the Saskatoon

HSAS office no later than September 15, 2005.

(b) Delegates To The Annual Convention

Any HSAS member may attend the Annual Convention but only elected delegates will be entitled to vote.

HSAS members in each Health Region can elect delegates to the Annual Convention based on one (1) delegate for every 100 members or portion thereof in their Health Region. Information on delegate nominations was mailed to each HSAS member’s home the week of May 9. Nominations were to be received in the Saskatoon HSAS office no later than May 26, 2005. Here is a breakdown on the number of delegates each Health region may send to the Annual Convention and who has been nominated.

Highlights of HSAS Executive Council Meetings

Since the last issue of Dispatches in February 2005, the Executive Council has met monthly. Due to poor weather conditions this winter, a few meetings were held by teleconference. Members of Council see this as a promising alternative to meeting in person during the winter months. Members of Council will explore the options of meeting using teleconference or videoconferencing as a way of saving time and money. More information on this in upcoming issues of Dispatches. Following elections in November, members of Executive Council were immediately put to work. Committees were struck and Executive Council set the course for the upcoming year. With contract negotiations virtually at a standstill, one of the important agenda items has been to work with the Negotiating Committee on a plan to better inform members of the contract talks and decide on the best strategy to ensure a fair contact with SAHO and government. Another important agenda item for Executive Council over the past few months has been to work with the LROs regarding the Crestvue Ambulance Negotiations in Yorkton. In accordance with these agenda items, a new Communications Committee has been struck. The mandate of the committee is to discuss ways to more effectively ensure that HSAS members are kept informed about union business and to increase public awareness of HSAS and the nature of the work done by members. The communication strategy has been developed in conjunction with communication plans of our sister unions in other provinces, as well as with the National Union of Public and General Employees. This has resulted in changes to the Website, increased

number of media releases and the running of television ads between May 9 and May 27 on CTV. Other highlights of Executive Council Meetings this year have been to determine the procedure for delegate selection for the Annual Convention, something which is new this year. The Executive Council has also been busy with regular union business such as supporting members who are filing grievances, providing increased educational funding opportunities for members, responding to requests for charitable donations and planning the annual convention. With the possibility of job action occurring, our summer may be busier than we thought.

Market Supplement Update

In October 2004 HSAS received reports from the SAHO Provincial Market Supplement Committee that concluded no additional market supplements were required for the following professions:

● Dental Therapists ● Emergency Medical Dispatchers ● Occupational Therapists ● Orthotists ● Paramedics ● Perfusionists ● Pharmacists ● Physical Therapists ● Prosthetists ● Respiratory Therapists

After discussions with each profession we filed appeals for those professions we thought had some chance of success, namely:

● Dental Therapists ● Occupational Therapists ● Orthotists ● Paramedics ● Pharmacists ● Physical Therapists ● Prosthetists

We argued our case at a hearing before the adjudicator - Beth Bilson on February 23, 2005 and she rendered her decision March 17th. The Adjudicator found in our favour, agreeing that Physical Therapists and Paramedics both require an increase to their market supplement. Unfortunately, the Adjudicator found against us in relation to our application for increased market supplements for Pharmacists, Occupational Therapists, Dental Therapists, Orthotists and Prosthetists. This decision can be found on the HSAS web page at: http://www.hsa-sk.com/market.php. Under the terms of our Collective Agreement the next step is to attempt to negotiate a new Market Supplement for the Physical Therapists and Paramedics. We are meeting with the SAHO Committee on June 20, 2005 for this purpose. If we are unable to reach agreement we can then go back before the Adjudicator and she will decide which rate will apply. Additionally, the SAHO Provincial Market Supplement committee issued reports in December 2004 which recommended no increase to market supplements for PhD Psychologists and Public Health Inspectors. However, SAHO did agree to a further market supplement for Infection

Grievance Corner

Article 4.01 Union Membership One Health Region has contracted an HSAS member working in a neighbouring Health Region to perform occasional work but refuses to consider him an HSAS employee and deduct dues. HSAS filed a grievance over the Health Region’s breach of Article 4.01 which requires all new employees to apply for and maintain membership in the union as a condition of employment. This grievance has been approved to proceed to arbitration with Dirk Silversides serving as the chairperson. Is there a right to have a union representative present at all meetings with my out-of-scope manager/supervisor? Article 8.03 of the HSAS collective agreement states the following:

“In all cases where the employer considers the employee’s conduct warrants disciplinary action, the employee will be afforded the opportunity of having a union representative in attendance.”

What this means, is that in situations where your out-of-scope manager/supervisor wants to meet with you to provide a periodic performance appraisal, coaching, direction or communicate work expectations, you are not entitled to be accompanied by a union representative. However, when a meeting with your out-of-scope manager deals with adverse consequences if your work performance isn’t altered in some way, then you do have a right to request a union representative be present. Additionally, if the written comments in a performance appraisal appear to threaten loss of employment or some negative sanction if performance does not improve, this too is deemed disciplinary and you have a right to union representation.

HSAS members employed at Royal University Hospital in Saskatoon who are interested in serving on their worksite joint union/management occupational health and safety committee are encouraged to contact Tim Slattery at 955-4560. As a member, you are entitled to attend committee meetings without loss of pay or benefits. Additionally, the employer is required by the Occupational Health and Safety Act to permit you to take up to five working days per year to attend occupational health and safety training programs, seminars or courses of instruction.

To recognize Roberta Ekberg’s contributions and commitment to Health Sciences Association of Saskatchewan, a yearly award of $500.00 was established at the 2003 HSAS Annual Convention. The $500.00 can be awarded to any HSAS member active in the union, HSAS staff or HSAS legal counsel who has demonstrated a commitment to furthering and promoting the goals and interests of HSAS. Any HSAS member interested in nominating a candidate must do so through their Executive Council member or Regional Council Chairperson no later than September 30, 2005. The HSAS Executive Committee (President, Treasurer, Vice-President, Secretary, Board of Governors and the Executive Director) will review the nominations and make a recommendation to Executive Council, who will make the final selection of the award recipient. The award will be presented at the 2005 HSAS Annual Convention to be held November 19, 2005 in Regina.

Purchasing Disability Income Plan Coverage While On A Leave of Absence Greater Than Thirty (30) Days The Union, through our membership, became aware that the length of leave available - up to 18 months for maternity leave - and the ability to purchase Disability Income Plan coverage - up to 12 months - was inconsistent. The Union sought to correct this. As such, the joint union/management Benefit Plans Committee approved the extension of disability coverage for up to 18 months for those members on a leave of absence. Should you be considering applying for disability income plan coverage during a leave of absence greater than thirty (30) days remember that the application must be made prior to the leave beginning and you are responsible for both the employee and employer premiums. Those members who are currently on leave and have maintained their disability coverage can choose to extend their coverage up to the 18 month limit. Contact the employer to make the necessary arrangements.

The Continuing Education Fund was established at the October 1990 Annual General Meeting with the purpose of promoting continuing education in areas directly related to one’s present position. A lottery system is used to select applicants with five (5) names drawn on October 1st and five names on May 15th of each year. Successful applicants are eligible for a maximum of $500.00. The HSAS Executive Council recently increased the number of names to be drawn to ten (10) in October and ten (10) in May. It is the position of HSAS that the responsibility for assuming costs associated with continuing job related education resides with the employer. To ensure our fund is not treated as a primary source, the Education Fund Committee requires members to apply to their employer or other sources prior to making application to the HSAS Education Fund. Continuing Education Fund

The 1997 Annual Convention established two (2) $500.00 scholarships to mark the 25th Anniversary of our union. The scholarships are awarded annually to a spouse or dependent of an HSAS member enrolled in full-time studies at a post-secondary educational institution leading to a degree, diploma or certificate in an area of study currently represented by HSAS. The HSAS Executive Council recently increased the number of scholarships available to six (6). Completed applications must be received in the Saskatoon HSAS office no later than August 15 each year. Note: Application forms for both the Continuing Education Fund and the 25th Silver Anniversary Scholarship Awards can be obtained from the Saskatoon HSAS office.

Upon approval of Executive Council the HSAS By-Laws provides for members in each Health Region to organize themselves into an HSAS Regional Council. HSAS Welcomes New Labour Relations Officer Greg Zaba was hired in May 2005 as a Labour Relations Officer to replace Al Shalansky, who will be retiring September 30, 2005. Greg will be working out of our Regina office until September, at which time he will move to the Saskatoon office. Greg is from Regina and brings 17 years of union experience and representation encompassing collective bargaining, grievance handling, arbitration and union organizing on a local and international level with the Iron Workers Union. As well as many other duties, Greg was also President of the Iron Workers District Council of Western Canada, which in all, covered approximately 6,700 members. He also has many years of experience representing injured workers before the Saskatchewan Workers’ Compensation Board. Greg and his wife Janis have three sons.

A young executive was leaving the office late one evening when he found the CEO standing in front of a shredder with a piece of paper in his hand. "Listen," said the CEO, "this is a very sensitive and important document here, and my secretary has gone for the night. Can you make this thing work for me?" "Certainly," said the young executive. He turned the machine on, inserted the paper, and pressed the start button. "Excellent, excellent!" said the CEO, as his paper disappeared inside the machine. "I just need one copy..."
