DIRECTION GOVERNING ADMISSIONS AND EXAMINATIONS
LEADING TO THE AWARD OF DEGREE OF MASTER OF LAWS
(LL.M.)
[CHOICE BASED CREDIT SYSTEM] UNDER THE FACULTY OF
HUMANITIES.
[Direction issued by the Hon’ble Vice-Chancellor under Section 12(8) of the
Maharashtra Public Universities. Act, 2016]
WHEREAS The Maharashtra Public Universities Act No. 6 of 2016 ( Act VI of 2017) (
hereinafter referred as an Act ) has come into force with effect from 1st March, 2017;
AND
WHEREAS the University has been conferred with powers to introduce choice based credit
system courses;
AND
WHEREAS, the University has adopted Credit Based Semester pattern for Master of Laws
(LL.M) examination from the academic year 2012-13;
AND
WHEREAS, the Chairman of the University Grants Commission directed the Hon’ble
Vice-Chancellor to initiate steps for successful implementation of the Choice Based Credit
System (CBCS) from the academic session 2015-16 vide letter no. D.O.No. F-1-1/2015
(CM), dated 08/01/2015.
AND
WHEREAS the University Grants Commission has issued Guidelines on Adoption of Choice
Based Credit System in all the Universities.
AND
WHEREAS the choice based credit system was introduced in the LL.M. course from the
academic session 2016-17, vide Direction No. 61 of 2016
AND
WHEREAS certain errors and shortcomings, not affecting the scheme of the course in the
Direction 61 of 2016, were discovered during the implementation of the same and in the
meeting of the task force held on 13th
February 2017 it was decided to constitute a
subcommittee to study the Direction and to suggest suitable clarifications in it;
AND
WHEREAS the subcommittee of the Task Force constituted for proposing clarification in the
Direction no. 61of 2016 has submitted its report on 2nd March 2017 and the same was
unanimously accepted by the Task Force in its meeting held on 29th April 2017;
AND
WHEREAS the University has issued a common Direction i.e. Direction NO. 13 of 2017,
prescribing certain uniform norms for all the under graduate and post-graduate courses in all
the faculties of the University;
AND
WHEREAS it is necessary to incorporate the uniform norms under Direction No. 13 of 2017
with respect to LL.M. course and also to incorporate the changes/clarifications suggested by
the Task Force in law by issuing a new Direction;
Now, therefore, I, Dr. Siddharthavinayaka P. Kane, Vice-Chancellor, R.T.M. Nagpur
University, Nagpur in exercise of the powers vested in me under Section 12(8) of the
Maharashtra Universities Act, VI of 2017 do hereby issue the following Direction no 14. of
2017:
1. THE DIRECTION GOVERNING ADMISSIONS AND EXAMINATIONS
LEADING TO THE AWARD OF DEGREE OF MASTER OF LAWS (LL.M.)
[CHOICE BASED CREDIT SYSTEM]” IN THE FACULTY OF HUMANITIES,
R.T.M. NAGPUR UNIVERSITY, NAGPUR.
2. Commencement and applicability of the Direction: It shall come into force from
the date of its issuance and shall govern all the students who have taken admission in
the CBCS course in the academic year 2016-17 and also the students taking
admissions in the onward academic sessions.
3. Scope: This Direction shall apply to LL.M. Regular Course Students only.
4. Duration of the Programme: The duration of the LL.M programme shall be TWO
academic years spreading over FOUR semesters with the University Examinations at
the end of each Semester. Each Academic Year shall consist of Two Semesters. The
academic Session for the Odd Semesters i.e. 1st
& 3rd
Semester, will commence as far
as practicable from 1st of July every year and for the Even Semester i.e 2
nd & 4
th will
commence, as far as practicable, from 1st of January every year.
An examination for each of the semester shall be held twice in a year at such places
and on such dates as may be fixed by the University from time to time. The fees for
the examination also shall be prescribed by the University from time to time.
5. Interpretation Clause : Unless the context otherwise require, the following words
shall have the meaning as assigned to them in this clause.
(a) Academic Year: Two consecutive (one odd + one even) semesters constitute
one academic year.
(b) ATKT: means Allowed to Keep Term in Higher Semester as per the
provisions of this direction.
(c) "Choice Based Credit System (CBCS): Choice Based Credit System
provides Choice for students to select from the prescribed courses (core,
elective or minor Or soft skilled courses)"(See Appendix I attached with this
direction).”
(d) Course: It is equivalent to a paper/subject in a programme. It is a complete
unit of learning which will be taught and evaluated within a Semester. All
courses need not carry the same weight. A course may be designed to
comprise lecturing/tutorial/laboratory work/field work/outreach
activities/project
work/vocationaltraining/viva/seminars/termpapers/assignments/presentations/s
elf-study etc. or a combination of some of these.
(e) Credit : Credit means the unit by which the course work is measured. It is
measured in terms of weekly class hours assigned to a Course. One Credit is
equivalent to one hour of teaching work (Lecture or tutorial) or two hours of
practical work/field work per week.
(f) Credit Point (CP): It is the value obtained by multiplying the Grade Point by
the Credit i.e No. of Credits assigned for the course x Grade Points secured for
that course.
(g) Cumulative Grade Point Average (CGPA): CGPA means the value
obtained by dividing total number of credit points in all the semesters by the
total number of credits in all the semesters. It is a measure of overall
cumulative performance of a student over all semesters.
(h) Grade Letter : Grade Letter means an index to indicate the performance of a
student in a particular course/ Paper. It is the transformation of actual marks
secured by a student in a course/paper into a letter grade. There shall be a
range of marks for each Grade
(i) Grade Point : Grade Point means weightage allotted to each grade letter.
(j) Programme: It means the Two Year Post Graduate Programme of study and
examination spread over four semesters, the successful completion of which
would lead to the award of Master of Laws (LL.M.) degree.
(k) Semester Grade Point Average (SGPA): It means the value obtained by
dividing the total credit points earned by a student in all the courses of a given
semester by the total number of credits assigned to that semester. It is a
measure of performance of work done in a semester.
(l) Transcript or Grade Card or Certificate: Based on the grade earned, a
grade certificate shall be issued to all the registered students after every
semester. The grade certificate will display the course details (code, title,
number of credits, grade secured) along with SGPA of that semester and
CGPA earned till that semester.
6. ELIGIBILITY CRITERIA FOR ADMISSION: A student desiring to seek admission to
LL.M. Program, may either register himself/herself as a regular student in any of the
institution established, or affiliated to the Rashtrasant Tukdoji Maharaj Nagpur University,
Nagpur, where LL.M course is being administered.
An applicant for admission to LL. M. programme should have obtained Bachelors Degree in
Law (LL.B.) ( Three Years) or B.A; LL.B. (Five Years) any other equivalent qualification,
called by any name, which is recognized by the Rashtrasant Tukdoji Maharaj Nagpur
University, Nagpur.
7. MEDIUM OF INSTRUCTIONS AND EXAMINATION : The medium of instruction
and Examination for LL.M Course shall be English. An answer-book in the University
examination written in any language other than English, shall not be eligible for valuation. It
shall be deemed to be invalid for all practical purposes.
8. CHOICE BASED CREDIT COURSE:-
i). Every student taking admission as a regular student in the first semester of LL.M. course
shall have to opt for anyone of the seven specialization enumerated in Appendix-I and which
may be offered in the institution where the applicant student desire to take admission. The
student will not be allowed to change his choice of specialization. The detail of the course
content for each specialization shall be as per the various tables mentioned in the said
Appendix.
ii). Each student of LL.M. course has to select and study one elective core course paper in
third and fourth semester from the list of the electives provided for each semester or in the
alternative the student can choose any one foundational course from the list of 41
foundational courses excluding the foundational course in law. The chosen foundational
course will have one paper each in the third and fourth semester as shown in Appendix- II.
iii. The student opting for foundational course under sub-para ii will have to take admission
under the centralized admission process.
9. CRITERION FOR PASSING :- In order to be successful at the examination and to be
eligible for the Degree of Master of Laws under this Direction, an examinee shall obtain
minimum 40% marks in each paper ( comprising the University examination and internal
evaluation) and 50% marks in aggregate.
Therefore, where a student fails to pass the examination by securing minimum 50%
aggregate marks, for being eligible for exemption in a paper, the candidate should obtain
minimum 50% of marks in that paper/course.
10. ATKT Rules :- Notwithstanding anything to the contrary in this Direction or any other
statute or ordinance for the time being in force, the admission of students to the LL.M
course/program shall be on the yearly basis. Therefore, a student admitted to the FIRST
semester and who undergoes the regular course of study of FIRST semester, certified by the
head of the Institution where he/she is admitted, shall be allowed to be promoted to the
SECOND semester without any condition. In order, however, to be eligible to be admitted to
the THIRD semester, the student should have passed in at least 50% (Fifty Percent) of the
total number of Papers/subjects/courses of the First and the second semester taken together.
A student admitted to the THIRD semester and who undergoes the regular course of study of
third semester, certified by the head of the Institution where he/she is admitted, shall be
allowed to be promoted to the FOURTH semester without any condition.
11. Evaluation System on the basis of Credit based Award Pattern: The academic
performance of a student during a semester shall be graded on a Seven-point scale. The grade
awarded to a student shall depend on his/her performance in external and internal
examinations. The academic performance of a student during a semester and at the end of the
programme, shall be evaluated on the basis of:
(i) Grade Point (GP) obtained in each subject
(ii) Semester Grade Point Average (SGPA),
(iii) Cumulative Grade Point Average (CGPA)
At the end of each semester examination, a student shall be awarded a Semester Grade Point
Average (SGPA). A Cumulative Grade Point Average (CGPA) shall be awarded to each
student at the end of Final Semester of the Programme. The details regarding method of
calculating SGPA & CGPA is explained in para 10.
12. Award of Grade Letter, Grade Points, Credit Points, SGPA, CGPA:
(a) Award of Grade Letter and Grade Points:
Each course/paper shall be valued in a 10 point grading system. The letter grades and
their equivalent grade points are listed below.

(b) Calculation of Credit Points :-
Credit Points for the course = (No. of Credits assigned for the course x Grade Point secured
for that course.)
(c) Semester Grade Point Average (SGPA) :- SGPA indicates the performance of a
student in a given Semester. SGPA is based on the total credit points earned by the
student in all the courses and the total number of credits assigned to the
courses/papers in a Semester.

(d) Cumulative Grade Point Average (CGPA) : CGPA refers to the Cumulative Grade
Point Average weighted across all the semesters.

The SGPA and CGPA shall be rounded off to 2 decimal points and reported in the
transcripts.
13. Award of the Degree: A student will be eligible for the award of the Degree of Master of
Laws (LL.M) with his chosen specialization/s, after he has successfully completed all the four
semesters. The degree shall specify the division and CGPA of successful candidates as per the
following criterion :
i. First Division with Distinction: CGPA from 7.00 and above – A+
Grade
ii. First Division: CGPA from 6.00 to 6.99—A Grade
iii. Higher Second Division : CGPA from 5.50 to 5.99—B+ Grade
iv. Pass /Second Division: CGPA from 5.00 to 5.49—B Grade
14. ABSORPTION SCHEME: - The absorption of the students admitted to the old credit
based course and choice based course shall be as follows :-
1. All the students who had taken admission in the Choice Based Credit System under
Direction No. 61 of 2016 shall be absorbed in the Choice Based Credit Course under this
Direction 14/2017
2. The students who were admitted to the LL.M. credit course (CBS) during the 2015-16
session and also failure of the old batches shall continue to be governed by the old CBS
course and old pattern. However, such Students shall be required to complete their course
within the three consecutive sessions i.e. 2016-17, 2017-18 & 2018-19. As such these
students shall be getting 6 consecutive University examinations to complete their LL.M.
Course.
3. The students of the old CBS course who fail to complete their LL.M. course within the
time permissible under Para above shall be absorbed in the new choice based credit based,
letter grade pattern course (CBCS) and they will be granted exemption in the equivalent
COMPULSORY CORE AND OPTIONAL CORE COURSES papers respectively.
4. The presents absorption scheme shall be valid till a new absorption scheme is proposed in
future.
15 Repeal:- With the coming into force of this Direction the Direction No. 61 of 2016 shall
stand repealed. Notwithstanding repeal of the Direction No. 61 of 2016 all actions taken
under the said Direction shall remain valid for all practical purposes.

APPENDIX I
LL.M COURSE (CHOISE BASED CREDIT SYSTEM)
In LL.M course (choice based credit system), there are seven specialization groups, out of
which one group has to be opted by the students at the time of admission. they are:
1) GROUP A- INTERNATIONAL LAW
2) GROUP B- CONSTITUTIONAL LAW AND ADMINISTRATIVE LAW
3) GROUP C- INTELLECTUAL PROPERTY LAWS.
4) GROUP D- BUSINESS LAW
5) GROUP E- ENVIRONMENT AND LEGAL ORDER
6) GROUP F- LABOUR, CAPITAL AND LAW
7) GROUP G-CRIMINAL LAW
(In each of the group 25 students will be admitted on merit)
Each student taking admission to the LLM course has to study eight compulsory courses
irrespective of the specialization which he/she has chosen. Out of the eight compulsory
courses, two compulsory courses are prescribed for first semester, two compulsory courses
are prescribed for second semester, two compulsory courses are prescribed for third semester
and two compulsory courses are prescribed for fourth semester.
Further in each group of specialization, there are six optional core courses representing
specializations offered and which are required to be studied for that specializations. Apart
from the compulsory and the optional core course papers, the students have to select and
study one elective core course paper in third and fourth semester each to be selected from the
list of the electives provided for each semester or in the alternative the student can choose any
one foundational course from the list of 41 foundational courses excluding the foundational
course in law. The chosen foundational course will have one paper each in the third and
fourth semester as shown in Appendix II. (List of foundational courses is given in Appendix
II)
Therefore, any student pursuing LLM CBCS course will have to study eight compulsory
courses, six optional core courses and two elective core courses or in alternative, to the
elective core courses, two papers of the chosen foundational courses.
The candidates will have to prosecute regular full time course of study. All the courses
prescribed herein carries 100 marks each. However for every theory paper out the total 100
marks 20 marks shall be awarded for internal assessment and the remaining 80 marks shall be
for the university theory examination. The breakup of the 100 marks for other courses shall
be as shown against those courses in the table no. 17 and 27 herein.
In order to be successful at the examination and to be eligible for the degree of master of
laws, an examinee shall obtain a minimum of 40% marks in each paper/course and obtain
50% marks in aggregate to be declared successful. The required minimum passing marks for
each paper shall be calculated by combining the marks scored in the internal assessment with
the university theory examination marks. (i.e. to say passing marks(40%), exemption (50%)
= university theory + internal assessment). were a student's fails to pass the examination, for
being eligible for exemption in a paper, the candidate should obtain minimum 50% of marks
in that paper/course.
