Waste (England and Wales) Regulations 2011 From 29th March 2011 the above regulations apply and introduce two key requirements for businesses. 1 Requirement for businesses to implement the waste hierarchy.

The waste hierarchy (shown below) will need to be applied when transferring waste and confirm this on the waste transfer/consignment note. This will come into effect 6 months after the introduction of the regulations.

2 Introduces 2 types of carrier registration

The ppper tier of waste carrier registration is for businesses that carry, broker or deal waste on behalf of others. There is a fee payable to the EA and registration last for 3 years. Lower tier waste carrier registration is required for businesses that carry their own business waste (except for construction or demolition waste which needs upper tier registration) from the end of December 2013. This registration will be free of charge and be valid until revoked or cancelled. Lower tier registration also applies to organisations which are currently registered with the EA as professionally exempt. This includes waste authorities, charities and voluntary organizations. The regulations also introduce new rules involving excluded wastes, new hazardous waste properties and end of waste requirements.
