VSA & City of Merritt defendants in lawsuits The Ministry of Transportation, VSA Highway Maintenance Ltd., the City of Merritt and a company only identified as ABC company have all been named as de- fendants in individual lawsuits brought forward by several dozen passengers in- jured when their tour bus flipped into a ditch on the Coq in August 2014. The lawsuits allege that “the collision occurred when the driver of the bus lost control of the vehicle due to the slippery road conditions on the highway. Further or in the alternative, the colli- sion occurred when the driver of the bus lost control of the bus due to inade- quately marked pavement and/or poorly designed road.” according to the Vancouver Sun article. Particulars of the alleged negligence include “a failure to properly design, construct, mark, inspect or maintain the highway and a failure to conduct or rea- sonably conduct regular inspections of the highway.” At the time, word was (from Merrit- tonians overhearing victims’ conversa- tions while at the Kelowna hospital, for example) that the bus driver fell asleep at the wheel. And that was before Trans- portation Minister Todd Stone told a radio station that “mechanical failure had been eliminated as a factor following an inspection of the bus, and that driver fatigue potentially led to the crash.” The allegations have not been tested in court, and City of Merritt CAo Shawn Boven has stated: “the crashed occurred a good half hour outside of the city, so the city cannot be held responsible.” Rodeo/Fall Fair wknd Rodeo parade The parade starts from Voght Park at 11am.
