This statement of insurability shall be provided on company or brokerage firm letterhead (if it is no possible to receive one on the company or brokerage firm’s letterhead the statement of insurability must be in email form and must have the company or brokerage firm’s signature block within the email) shall confirm the respondent’s ability to obtain the following insurance policies: a) Commercial General Liability insurance with an insured limit of not less than five million dollars ($5,000,000) per occurrence covering bodily injury, death and damage to property, including loss of use thereof, and not less than five million dollars ($5,000,000) per occurrence and in the annual aggregate for products liability and completed operations, and including but not limited to the following coverage: i. premises, property and operations liability; ii. products liability and completed operations; iii. blanket contractual liability; iv. contingent employers’ liability; v. employer’s liability (Canada); vi. personal injury liability; vii. non-owned licensed motor vehicle (automobile) liability; viii. sudden and accidental pollution liability; ix. watercraft coverage (if applicable); and x. firefighting expense liability. b) This insurance shall be in the name of the Contractor, and name the Trust and Develop NS and their respective directors, officers and employees as an additional insured to the extent of the Contractor’s legal liability for claims for property damage, bodily injury, including death and personal injury, arising from the operations of the

Contractor, its’ employees, agents and contractors, and shall include both cross liability and severability of interest clauses.

Any and all statements of insurability shall be on terms and conditions acceptable to Develop NS Respondents will only be required to arrange for insurance coverages as part of future RFP’s.

2.0 This addendum WILL require a revision to the Closing Date and Time, or other dates given in the Request for Proposal document.

3.0 In accordance with Section B.6 of Appendix B of the Submission Form, the proponents are

deemed to have read and taken into account all addenda issued by Develop Nova Scotia.

ADDENDUM # 02 for DNS-1920-0037 Request for Proposals – Retail Opportunity on the Halifax Waterfront

The following Changes are to be noted in the document referenced above. 1.0 Changes

1.1 Subject Tender Closing Date has been extended to April 3rd, 2020 at 2:00 p.m. AST. 1.2 Effective immediately, all submissions are to be delivered electronically (by email) to

[email protected]. Hard copy submissions (mailed) or faxed copies will not be accepted. Submission/file details as follows: 1.2.1 Submission subject lines MUST read “DNS-1920-0037” only; 1.2.2 Submissions should be sent in one email, if possible, and be less than 100 mb in

size. Proponents whose submissions exceed their internet service delivery limits may send their emails in multiple parts. Proponents who split submissions into multiple emails should indicate this in the opening line of their email’s free text. For example, “Email 1 of 2” followed by “Email 2 of 2”. Proponents should make every effort to minimize submission file sizes;

1.2.3 Submissions must be in Adobe PDF, Microsoft Word and or Microsoft Excel format (unless a specific change is indicated and approved by the Tender process Point of Contact); and

1.2.4 Submissions may be Zipped.

2.0 Clarifications 2.1 Questions related to Develop Nova Scotia Tender processes must still be directed to the

Tender process Point of Contact (or alternative) as directed in Tender documents. Questions are not to be sent to the Tender submission email address;

2.2 Proponents will automatically receive notification of submission delivery – this will act as the proof of delivery. Proponents who do not receive this notification should seek clarification (please check your junk folder first); and

2.3 Proponents are responsible to ensure prescribed formats and submission protocols are strictly followed. Proponents who deviate from directions provided in Tender documents may be disqualified at Develop Nova Scotia’s sole discretion.

Develop Nova Scotia The following changes are to be noted in the document referenced above. 1. Cancelation of non-mandatory site visit:

The non-mandatory site visit is canceled in an attempt to help prevent the spread of COVID-19. The kiosk is visible on the waterfront and has doors and windows that can be used to view the interior of the kiosk. Otherwise, there is a description of the kiosk in APPENDIX D - RFP Particulars.

2. This addendum WILL NOT require a revision to the Closing Date and Time, or other dates given in

the Request for Proposal document.
