BACKGROUND

• MOU with the DoDMV (SA Navy) to manage the DAFF fleet expired on 31 March 2013.

• 3 April 2013: contract signed with DAMEN Shipyards for repairs and maintenance to the DAFF fleet.

• 24 April 2013: Nautic South Africa (Pty) Ltd appointed to run Vessel Operations

• These are approximately 6 month contracts. Parallel to this, the tender process to outsource the management, maintenance and operations of the fleet has continued.

• Vessel Technical Advisor / Vessel Expert contracted to assist with the specifications and provide advice on the process.

• Specifications were developed and the tender was advertised, bids closing on 2 August 2013.

• Bids are being evaluated in the week of 12-15 August 2013.

• Engine service had been outstanding since April 2012 when vessel was

handed over to SA Navy.

• The SAN commenced with the engine service in January 2013.

• Awaiting overhauled engines to be delivered from MTU SA.

• This is a co-managed activity with SAN overseen by DAMEN and is experiencing delays.

• Target date for MTU engines to be installed: end August

• Target operational operational date: end September.

IPVs Ruth First and Victoria Mxenge • SAMSA pre-registration surveys completed.

• Annual survey will be carried out in Cape Town (1 day)

• Lloyd’s survey completed.

• Main engine service to be carried for both port and starboard engines.

• Registration on SA Ships Register completed.

• Final SAMSA surveys still outstanding (To be completed by 9 August

2013). Will take place in Cape Town once all the outstanding items are

closed out.

• Vessels sailed from Simon’s Town 12 July 2013 through to 13 July 2013

for workup training for crew and inspectors - arrived in Cape Town on 13

July 2013.

• FCOs have to do two new compulsory SAMSA courses before they can

put to sea: Proficiency Introduction to Survival Craft course and a Fast

Rescue Craft course from 5-15 August 2013.

• Estimated Operational Dates: 23 August 2013.

• Most underwater valves have been replaced; outstanding valves below the

waterline to be done in dry dock.

• Hull and ships sides to be painted in dry dock.

• Pre-registration surveys have been completed.

• Transferred to SA Ships Register.

• Estimated time in dry dock from commencement will be approximately 12

days.

• Estimated operational date: approximately end of September 2013

Chase Boat: Florence Mhkize

• DAMEN Shipyards moved her to their premises on 9 May 2013 to prepare

her for sea readiness

• Inspection carried out on boat and engines.

• Water in the fuel and oil has been detected so engines have not been started. Engines will be replaced with outboard engines.

• Two service providers have submitted refurbishment proposals and design concepts, including a cabin.

• Estimated operational date: uncertain, but probably by November.

• Clearing of Conditions of Class are in progress by DAMEN. There are no

major issues.

• Pre-registration surveys are being conducted by NAUTIC operational staff to prepare for the SAMSA safety certificate surveys.

• Plan to do safety certificate survey commencing week 19 August 2013.

• Estimated operational date: 23 August 2013

• DAFF research programme will be able to commence as scheduled (rock lobster, tuna, linefish research).

• Currently in dry-dock in Simon’s Town undergoing major essential repairs by

DAMEN, including repairs to engines, propellor, main prop-shaft, corrosion damage on decks, engine room and bilges, bow-thruster seal and many other issues.

• Estimated total costs are in the vicinity of R12 million, to be sourced from the current vessel operating costs

• The work has taken much longer than expected, because many new issues have arisen during the dry-docking and inspections.

• List of issues and costs have been submitted, the work approved and many have already been addressed.

CONTRACT WITH NAUTIC

• Nautic was appointed to deal with all logistic and HR issues and has

sourced crew and officers for all the vessels.

• ISM: Nautic has made strides in terms of documenting the Ship

Management System (SMS), an essential but complex requirement

for safety management of large vessels.

• Over and above the effort for preparing the vessels to be put back

into class and in accordance with SAMSA, a pragmatic SMS has

been developed within 3 months, and submitted to Lloyds Register

for review. The initial review has been completed and a number of

observations were made which now need to be addressed in terms

of technical management, crewing management and Designated

Person Ashore. These issues are being addressed.

CONTRACT WITH NAUTIC continued

• The SMS is being updated for planned re-review by Lloyds in the

week of 12-16 August. It is anticipated that Lloyds, with the

corrected updates, will issue an Interim Document of Compliance

during next week, thus enabling the Ellen Khuzwayo to sail. This is

in line with planned SAMSA activities and requirements.

• Even though the SMS is submitted for approval, Nautic have already

implemented the processes and procedures onboard all the vessels,

so that when the interim audit of Lloyds is conducted in three

months’ time, there will be an auditable process onboard.

The Fishing Rights Allocation Process: 2013

Background

During 2005/2006 the Department embarked on the Long-Term

Rights Allocation Management Process (LTRAMP). In preparation

for LTRAMP, the Department published a general policy as well as

sector specific policies for 20 commercial fishing sectors.

At the conclusion of the LTRAMP process, rights were granted in

terms of section 18 of the Marine Living Resources Act, 1998 (Act

No. 18 of 1998) (“the MLRA”) for periods ranging from 2 – 15 years

in the hake deep-sea trawl, hake long line, hake inshore trawl, hake

hand line, Patagonian tooth fish, south coast rock lobster, west

coast rock lobster (Offshore),

west coast rock lobster (Nearshore), small pelagic, horse mackerel,

KZN prawn trawl, demersal shark, squid, tuna pole, seaweed, white

mussels, KZN beach-seine, net-fish, traditional line fish and oyster

fishing sectors.

In addition to LTRAMP, fishing rights were granted in 2003 and 2005

in the abalone and large pelagics (tuna and swordfish) sectors, for ten

years respectively.

Fishing rights in the KZN prawn trawl, demersal shark, squid, tuna

pole, hake hand line, white mussels, traditional line fish and oyster

fishing sectors have been allocated for eight years and will expire on

31 December 2013.

General and Sector-Specific Policies

The Department published the revised General Policy and eight

sector specific policies on 15 April 2013 for public comment.

Consultative meetings were held at 14 venues along the coast line.

These meetings covered the geographical areas from Port Nolloth

to Richards Bay and were held from 11- 26 April 2013. Included in

these consultations were meetings with industry and small-scale

fisheries associations.

Consultative meetings were also held on the sector specific policies

at 20 venues along the coast. They took place from 8 - 20 May

2013.

General and Sector-Specific Policies

All the comments that the Department received by the due date,

14 June 2013, were considered.

The final General Policy comprising and the 8 sector-specific

policies were translated from English into the other three coastal

languages, namely, Afrikaans, isiXhosa and isiZulu.

The policies, simplified application forms with accompanying

explanatory notes and the distribution and receipting venues and

dates were published in Government Gazette No. 36675 of 17

July 2013.

Application Distribution Process

The application distribution process started on 22 July 2013 and will

close on 16 August 2013. Departmental officials will assist appliacnts

with understanding application forms and the process around the

allocations.

15 distribution centres situated in Port Nolloth, Hondeklipbaai,

Lamberts Bay, Elands Bay, Paternoster, Saldanha Bay, Cape Town,

Hermanus, Mossel Bay, Jeffrey’s Bay, Port Elizabeth, East London,

Port St Johns, Durban and Richards Bay are being be visited by

officials. Three additional centres in Struisbaai, Umtata and Port

Edward were opened for three days during the distribution process,

also a major milestone in this process.

Application Distribution Process (continue)

Although the application forms have been simplified, officials assist

applicants with questions relating to the application forms. Written

questions are responded to on a daily basis.

A helpline (021) 402 3576 has also been set-up to assist applicants.

To enable equitable participation, no application fee is required to

apply for fishing rights in any of the sectors.

Application Receipting Process

The application receipting process will open on 2 September

2013 and close on 13 September 2013.

All the distribution centres will also function as application

receipting centres manned by departmental officials on a full-

time basis from 2 – 13 September 2013.

Applicants will be able to submit their application forms at a

centre close to where they reside.

Equitable And Transparent Process

To ensure an equitable and transparent process, an

independent verification team (VT) is monitoring the distribution

and receipting processes.

The VT will also be responsible for verifying the accuracy of the

information submitted by applicants and for setting up and

handling an anonymous Tip-Off line.

The VT will also carry out detailed investigations of applicants

as necessary.

The Department will also be assisted by a qualified multi-

disciplinary (legal, administrative, and auditing, etc.) independent

assessment panel which will provide support and assistance in the

assessment and evaluation of applications for each of the eight

fishing sectors.

The delegated authority appointed by the Minister will be

responsible for taking final decisions in the allocation of fishing

rights. All fishing rights must be allocated by 31 December 2013.

Any appeal received will be processed and submitted to the

Minister for decision.

BACKGROUND & CURRENT STATUS

• The NDPW is the custodian of the fishing harbours and responsible for the

infrastructure maintenance and repairs in terms of the Government

Immovable Asset Management Act, 2007 (GIAMA).

• In terms of the MLRA, 1998, DAFF is responsible for the day-to-day

management of the fishing harbours in terms of Harbour Regulations

88-95.

• The 12 fishing harbours are located at :

West Coast – Saldanha, St Helena, Laaiplek and Lambertsbaai

Metro -- Houtbay, Kalkbay and Gordonsbay

South Coast – Hermanus, Gansbaai, Struisbaai, Arniston and Stilbaai

• In 2005, due to the fragmented management of the harbours, the Ministers

of NDPW and DEAT approached Cabinet to propose a new management

model for the 12 fishing harbors.

• It was also decided that to improve co-ordination, a Joint Harbour Steering

Committee (NDPW, DEAT, TREASURY) be established with DEAT (Now

DAFF) playing a leading role.

• Ernst & Young was appointed to conduct a feasibility study on fishing

harbours. The study was concluded in 2008 with recommendations.

• The Joint Harbour Steering Committee convenes monthly and is currently

still responsible for the interim management of the harbours.

CURRENT DEVELOPMENTS & THE WAY FORWARD

• Since the E&Y study numerous consultations have taken place with

relevant stakeholders (DPW, NT, WCPG, Cape Town Unicity, etc).

• To finalize the institutional arrangements for the fishing harbours the

following additional committees were established:

• An Inter Ministerial Committee (DAFF, DPW, NT) to provide guidance

and political leadership on this process.

• A Joint Working Committee with the NT as the driver to investigate the

most appropriate management model.

MAJOR OPERATIONAL & INFRASTRUCTURE CHALLENGES

• Lack of qualified harbour masters in all harbours

• Severe human resource shortage, resulting in crisis management

• Insufficient management/supervisory staff for effective service delivery

• Ageing workforce with no skills retention plan

• Inadequate and poor infrastructure repairs and maintenance by NDPW.

• Harbour infrastructure outdated as some harbours built in 1920’s

• Non compliance with the Occupational Health and Safety Act

• The DAFF is put at significant risk due to the above.

• Lack of security, resulting in criminal activities in the harbours ranging from:

• Vandalism and petty theft

• Organized crime (drug-trafficking, prostitution, etc)
