Call to Order. With a quorum of the Council Members present, the Planning Workshop of the Rockport City Council was called to order by Mayor Wax at 9:02 a.m. on Tuesday, February 20, 2018, in the Training Room of the Rockport Service Center, 2751 State Highway 35 Bypass, Rockport, Texas. Mayor Wax stated this was going to be a difficult year. Mayor Wax said the City is pursuing every avenue possible to provide for loss of income due to the hurricane. Mayor Wax read a letter (below) from Terry Jones-Parrish. Mayor Wax said he has received a number of these over the last few months. Mayor Wax emphasized the City has a superb staff

who have worked tirelessly to provide services to the City. Mayor Wax extended his thanks to Council, City Manager Kevin Carruth and City staff, not only for a job well done, but for the job they continue to do.

Planning Workshop Agenda 2. Hear and deliberate on strategic planning items including administrative procedures, City ordinances, capital projects, level of service, development, and sesquicentennial celebration planning. City Manager Kevin Carruth said this year will be different from other years due to the hurricane. Mr. Carruth added the City continues to be focused on storm recovery. Mr. Carruth called the Council’s attention to a handout (below) listing the Planning Workshop Topics.

City Manager Kevin Carruth introduced William Whitson, Aransas County Long-Term Recovery Specialist. William Whitson, Aransas County Long-Term Recovery Specialist addressed the Council. Mr. Whitson stated there is a lot of money available for assistance, but there are strings attached to it. Mr. Whitson said there has been an application submitted for money for public assistance for damaged facilities and we are eligible for additional dollars based on the damage caused by the hurricane. Mr. Whitson added they have learned things from the storm and there are things not included in the Hazard Mitigation Plan that should have been and at this time they do not want to amend the Plan and propose things totally outside the original scope. Mr. Whitson informed everyone the Aransas County Navigation District was not included in the Plan and discussion had been held about doing an appendix to add the Navigation District, but they will have to go through

the public process required. Mr. Whitson informed the Council of funding for “opportunity zones” for low to moderate income areas. A copy of a portion of the Aransas County Multi-Jurisdictional Hazard Mitigation Action Plan was distributed (see below).

Discussion was held among Council and Mr. Whitson. Mayor Wax asked if the City’s Bayshore hazard mitigation project was included in the Plan. Community Planner Amanda Torres answered that everything listed in the Aransas County Coastal Resiliency Initiative is incorporated and Bayshore was put there.

Mayor Wax stated the Bayshore project should be put back on the City’s list. Council took a brief recess from 10:46 a.m. to 11:00 a.m. City Manager continued presentation of the planning workshop topics.

Council recessed from 11:55 a.m. to 12:18 p.m. for lunch. Discussion continued among Council and staff on the planning workshop topics.

Discussion was held among Council and Community Planner Amanda Torres in regard to comprehensive zoning changes to R-2M (Manufactured Housing District). Ms. Torres distributed

a copy of the Planning & Zoning Agenda cover sheet (see below) containing information on this subject.

Mayor Wax stated a developer has approached the City about the possibility of the City selling 200 feet of the Bent Oaks property fronting Business Highway 35 for the development of a new CVS Pharmacy. Mayor Wax said his response to the developer was that the City would be required to have a referendum election in order to sell park property. Mayor Wax added he did offer the developer an opportunity to come to City Council to describe the project, but he did not want to do that. It was the consensus of Council to place on the next Workshop Agenda discussion on the Sesquicentennial Celebration and the appointment of a Sesquicentennial Committee. After discussion on upgrading to new building codes and a new fee schedule, it was the consensus this should be adopted to become effective October 1, 2019; the beginning of the budget year. Mayor Wax requested Frank Truitt, the City’s Building Official, develop an information paper to be distributed a month prior to the effective date of the new codes and fees. 3. Adjournment. 9. Deliberate and act on a Resolution of the City of Rockport, Texas, authorizing the

Rockport Police Department to apply for and operate a Justice Assistance Grant administered by the Officer of Governor, Criminal Justice Grants Division, for Fiscal Year 2018-2019; and authorizing the Mayor to act as the Executive Officer and authorized representative in all matters pertaining to the participation in this grant program.

Mayor Wax called for requests to remove any item from the Consent Agenda for separate discussion. Mayor Wax stated Consent Agenda Item 6 will be pulled from the Agenda because it was a duplicate from the February 13, 2018, Agenda. Mayor Wax said Mr. Luis Purón, Executive Director of the Rockport Center for the Arts is present tonight to share some news with the City Council. MOTION: Council Member Villa moved to approve the Consent Agenda, minus Item 6, as presented. Council Member Gurtner seconded the motion. Motion carried unanimously. Luis Purón, Executive Director of The Rockport Center for the Arts addressed the Council. Mr. Purón said he wanted to share some great news with the City Council; the Rockport Center for the Arts has received notification they will be receiving $500,000 dedicated to the building of a new Center for the Arts. Mayor Wax commented the City looks forward to the ribbon cutting. Regular Agenda 10. Tabled – February 13, 2018: Deliberate and act on first reading of an Ordinance amending the official zoning map as stipulated under Article 4.1 of the City of Rockport Zoning Ordinance Number 1027 by changing the zoning of land from R-1 (1st Single Family Dwelling District) to R-2M (Manufactured Housing District) for property located at 124 Steward Lane; also known as Lot 11, Oak Bay Subdivision (1.243 acres), Rockport, Aransas County, Texas; repealing all ordinances in conflict therewith; providing for severability; and providing an effective date. MOTION: Mayor Wax moved to remove this item from the table. Council Member Villa seconded the motion. Motion carried unanimously. Mayor Wax stated this item requires further research by the Planning & Zoning Commission in order to make an informed decision. Mayor Wax added the Planning & Zoning Commission will be examining the entire area and determine if it is appropriate for a zoning change. Council Member J.D. Villa asked property owner Mr. Flores if he were on a timeline. Mr. Flores answered he was not on a timeline. MOTION: Mayor Wax moved to deny without prejudice the first reading of an Ordinance amending the official zoning map as stipulated under Article 4.1 of the City of Rockport Zoning Ordinance Number 1027 by changing the zoning of land from R-1 (1st Single Family Dwelling District) to R-2M (Manufactured Housing District) for property located at 124 Steward Lane; also known as Lot 11, Oak Bay Subdivision (1.243 acres), Rockport, Aransas County, Texas; repealing all ordinances in conflict therewith; providing for severability; and providing an effective date. Mayor Pro-Tem Rios seconded the motion. Motion carried unanimously.

Deliberate and act on first reading of an Ordinance amending the official zoning map as stipulated under Article 4.1 of the City of Rockport Zoning Ordinance Number 1027 by changing the zoning of land from R-1 (1st Single Family Dwelling District) to B-1 (General Business District) for property located at 971 State Highway 35 Bypass; also known as 2.715 acres out of the northwest part of Tract 32, Abernathy Tracts, Rockport, Aransas County, Texas, repealing all ordinances in conflict therewith; providing for severability; and providing an effective date. Community Planner Amanda Torres said this property was brought into the city limits by annexation last year and came in as R-1 (1st Single Family Dwelling District). Ms. Torres stated this property has been commercial and that is the appropriate zoning. MOTION: Council Member Villa moved to approve the first reading of an Ordinance amending the official zoning map as stipulated under Article 4.1 of the City of Rockport Zoning Ordinance Number 1027 by changing the zoning of land from R-1 (1st Single Family Dwelling District) to B-1 (General Business District) for property located at 971 State Highway 35 Bypass; also known as 2.715 acres out of the northwest part of Tract 32, Abernathy Tracts, Rockport, Aransas County, Texas, repealing all ordinances in conflict therewith; providing for severability; and providing an effective date. Deliberate and act on first reading of an Ordinance amending the official zoning map as stipulated under Article 4.1 of the City of Rockport Zoning Ordinance Number 1027 by changing the zoning of land from R-1 (1st Single Family Dwelling District) to R-2M (Manufactured Housing District) for property located at 1125, 1133, and 1141 Sixteenth Street, also known as Lots 70-B, 70-F, and 70-G, Block 256, Swickheimer Subdivision, Rockport, Aransas County, Texas, repealing all ordinances in conflict therewith; providing for severability; and providing an effective date. Community Planner Amanda Torres stated this property contains seven acres off of Sixteenth Street and the owners are wanting to place a manufactured home on the property. Ms. Torres said given this is a large tract of land, and next to it are eight or nine parcels that also contain manufactured homes, this would be considered similar land use and would not be considered spot zoning. Ms. Torres added the Planning & Zoning Commission recommended Council approve the rezone request. Ms. Torres stated the applicant is on a timeline. MOTION: Mayor Pro-Tem Rios moved to approve the first reading of an Ordinance amending the official zoning map as stipulated under Article 4.1 of the City of Rockport Zoning Ordinance Number 1027 by changing the zoning of land from R-1 (1st Single Family Dwelling District) to R-2M (Manufactured Housing District) for property located at 1125, 1133, and 1141 Sixteenth Street, also known as Lots 70-B, 70-F, and 70-G, Block 256, Swickheimer Subdivision, Rockport, Aransas County, Texas, repealing all ordinances in conflict therewith; providing for severability; and providing an effective date. Council Member Villa seconded the motion. Motion carried unanimously. 13. Deliberate and act on first reading of an Ordinance amending the official zoning map as stipulated under Article 4.1 of the City of Rockport Zoning Ordinance Number 1027 by changing the zoning of land from R-1 (1st Single Family Dwelling District) to R-6

(Hotel/Motel District) for property located at 2611 FM 3036; also known as Lot 1, Block 1, The Matthews Place, Rockport, Aransas County, Texas, repealing all ordinances in conflict therewith, providing for severability; and providing an effective date. John Matthews, owner of the property, addressed the Council. Mr. Matthews stated everything on FM 3036 is commercial and now there is a recommendation from the Planning and Zoning Commission to stop the commercial and deny his request. Mr. Matthews said he has nothing to do with Spanish Woods Subdivision and it is not right for those residents to tell him what not to do with his three acres. Mr. Matthews requested the Council get with Ms. Torres and get him out of this debacle and off Facebook from his neighbors comments, because the City is what got him into this situation, Mr. Matthews added he was at a loss; the City’s recommendation to rezone has cost him time and money. Nancy Hillary, 109 Spanish Woods Drive, addressed the Council. Ms. Hillary stated she has nothing personal against Mr. Matthews; this was purely a zoning issue. Ms. Hillary informed the Council there are 180 pieces of property in Spanish Woods and they are all single-family dwellings. Ms. Hillary said her property backs up to Mr. Matthews property. Ms. Hillary added Mr. Matthews purchased the property knowing his property was zoned residential. Ms. Hillary stated once property is zoned Hotel/Motel District it never reverts back to residential. Ms. Hillary commented this would be considered spot zoning. Community Planner Amanda Torres addressed the Council. Ms. Torres informed the Council the applicant came to the Rockport Service Center inquiring about placing two cottages on his property and he was told the proper zoning is Hotel/Motel District. Ms. Torres said other factors were discussed; this is a community corridor and this zoning is on the Future Land Use Plan although it is surrounded by residential properties. Ms. Torres explained because the landowners of more than 20% of the adjacent properties are opposed to the project, it will require a super majority from the City Council (4 out of 5) to approve the rezoning. Council Member Villa read into the record a letter (below) he had received from the Spanish Woods Homeowners Association opposing the rezone request.

Discussion was held among Council. Motion carried unanimously. 16. Hear and deliberate on update of Key Allegro bridge. Public Works Director Mike Donoho addressed the Council. Mr. Donoho stated prior to the hurricane the City had been finalizing the design and scope of work for the walkway and railing replacement on the Key Allegro Bridge. Mr. Donoho said it became apparent the cost of the project, TxDOT regulations, and the expected remaining life of the bridge made the project an imprudent use of funds. Mr. Donoho informed the Council TxDOT has diminished the load capacity on the bridge and it is anticipated it will be further diminished in the future. Mr. Donoho added TxDOT has the ability to mandate replacement of the bridge. City Manager Kevin Carruth called the Council’s attention to the Load Rating & Diminished Service Life of the Bridge (below) included in the Agenda packet. Mr. Carruth explained the reason the rating was lowered was because the City had not been able to locate the original bridge plans for inspection of the bridge so there had been a guess on the load capacity. Mr. Carruth said the original plans have been located and now they can calculate the capacity of the bridge. Mr. Carruth added the bridge is safe and this is a paper exercise only, but tells us the schedule for replacing the bridge will have to be moved up, and this keeps us from spending $300,000 on a bridge that will be replaced in the future. Discussion was held among Council, Mr. Carruth and Mr. Donoho.

17. Hear and deliberate on presentation of City of Rockport Police Department 2017 Annual Report. Police Chief Tim Jayroe stated the Police Department 2017 Annual Report had been included in the Agenda packet. Chief Jayroe said this year’s report was in a different format from previous years because there are certain requirements of the Texas Police Chiefs Association accreditation program. Chief Jayroe gave a brief review of the Report. Discussion was held among Council and Chief Jayroe. 18. Hear and deliberate on presentation of City of Rockport Police Department 2017 Bias Based Profiling Report. Police Chief Tim Jayroe stated profiling is intentionally looking for a certain race or ethnicity of individuals and is against the law. Chief Jayroe said the 2017 Bias Based Profiling Report is presented in compliance with Texas Code of Criminal Procedure Article2.134 related to Statutory Prohibition of Racial Profiling. Chief Jayroe called the Council’s attention to the Report included in the Agenda packet and asked if Council had any questions. Mayor Wax, on behalf of Council and the community, thanked Chief Jayroe and the Police Department for the work they do. Mayor Wax expressed the Council is very pleased with the performance of the Rockport Police Department.

19. Deliberate on department long-term recovery reports.

Police Chief Tim Jayroe provided the following long-term recovery report:

• Things are going just about as normal as they were before the storm. • Not having the number of burglaries as we were having before the hurricane. • Do still get calls about people rummaging around damaged areas.

Mayor Wax commented Dispatch may have come down to the normal amount of calls. Parks & Leisure Services Director Rick Martinez provided the following long-term recovery report:

• Continue to recover and rebuild. • Memorial Park – completed a light test on new lights Ameresco installed. Ameresco was

completing another test tonight. • Fencing work still continues. Fence on frontage of Memorial Park starts this week. • Other areas continue clean-up and repairs. • Co-partnering with Texas Forest Service who will be donating 10 fifteen-gallon live oak

or white oak trees to be planted at Spencer, Mathis and Zachary Taylor Parks. Planning on conducting a workshop that will be open to the public on planting trees.

• Staff is doing very well. Public Works Director Mike Donoho provided the following long-term recovery report:

• Beginning to receive a lot more work orders on sink holes and such.

• Water/Wastewater Department is doing well; first cycle for meter reading – right at 100%. • Construction projects: Sports complex lighting held a kick-off meeting today with

provider for auto meters. • Building & Development: Lots of activities. Receiving more complaints between

residents and contractors. Planning & Zoning Commission hearing more cases. • Employees have good positive attitude and working well together.

Mayor Wax asked how many contractors have been registered to date. Community Planner Amanda Torres answered there have been 1740 contractors registered.

City Secretary Teresa Valdez provided the following long-term recovery report: • Election in May: Application and petitions were verified for all persons filing for places

on the ballot. Two persons had filed for the position of Mayor – Mayor Pro-Tem Patrick Rios and Matthew Otero. City Charter requires a petition which contains signatures of qualified voters equal to number to 30% or 150, whichever is lesser, of those who voted in the last election for Mayor which was in 2008, so the number of signatures required was 150. Mr. Otero had submitted a petition with 228 signatures of which only 96 were verified as qualified voters for the City of Rockport. Mayor Pro-Tem Rios submitted a petition with 203 signatures of which 186 were verified as qualified voters for the City of Rockport. For Council Members the City Charter requires a petition containing signatures of qualified voters equal in number to 30% or 50, whichever is lesser, of those who voted in the last election for that office. For Ward 2 and Ward 4 the petitions required signatures of 50 qualified voters who reside in each of the respective Wards. Incumbent Council Member J.D. Villa filed for re-election to Ward 2 and his petition contained 50 verified signatures. Incumbent Council Member Barbara Gurtner filed for re-election to Ward 4 and her petition contained 50 verified signatures. Chris Crowley filed for election to Ward 4 and his petition also contained 50 verified signatures. This means there will only be one contested race on the May 5, 2018, General Election Ballot.

• Assistant City Secretary working on new hires and insurance claims. • Working on various open records requests.

City Manager Kevin Carruth provided the following long-term recovery report:

• Utility bills will be mailed on schedule and all regular due dates are in effect so late fees will be charged this cycle.

• Dispatch calls for service are almost back to where they were before the hurricane.

Mayor Wax stated Aransas County Judge, Town of Fulton Mayor and himself met and decided to recognize people who made a difference during Hurricane Harvey. Mayor Wax said there were way too many people to thank individually so instead a Joint Proclamation was created with an Appendix listing federal, state, municipal, individuals, groups, etc. Mayor Wax expressed the City of Rockport had received a Joint Proclamation to be displayed in City Hall. Mayor Wax presented to Mayor Pro-Tem Pat Rios the Joint Proclamation recognizing him for his personnel efforts during the hurricane. Mayor Pro-Tem Rios received a standing ovation. Council Member Day said he had received a request for the City to get involved with the restoration of the piece of art in front of Latitudes. Mayor Wax said the City will share the name of the company that restored the piece of art owned by the City in front of McDonalds. Mayor Wax stated the City does not own the art piece in front of Latitudes. Rockport Center for the Arts Executive Director Luis Purón stated the Center for the Arts utilizes a vendor out of Liberty, Texas. Mr. Purón commented the art pieces at Latitudes and the Daily Grind need restoration. Executive Session City Council will hold an executive session pursuant to the provisions of Chapter 551 of the Texas Government Code, in accordance with the authority contained in: 21. BACKGROUND: According to Texas Election Code § 2.052 & § 2.053, as soon as possible after the filing deadlines for placement on the ballot and if no candidate in the election is opposed on the ballot, the City Secretary must deliver to the City Council a certification that each candidate for office is unopposed. Upon receiving the certification, the City Council may declare the unopposed candidates elected to office, in which case the election is cancelled. Although the statute requires the City Secretary make the certification to City Council, the Council is given discretion in declaring unopposed candidates elected. City Council may hold the election regardless of the unopposed status of the candidates. If City Council determines not to hold the election, the order declaring the unopposed candidates elected must be posted on election day at each polling place that would have been used in the election [EC §2.053(b)]. The statute provides that a certificate of election is issued to each candidate who is declared elected, “in the same manner and at the same time as provided for candidate elected at the election” [EC §2.053(c)]. Candidates elected through cancellation must also qualify for office and take the oaths of office the same as candidates elected at an election.

§ 2.052 CERTIFICATION OF UNOPPOSED STATUS. (a) The authority responsible for having the official ballot

prepared shall certify in writing that a candidate is unopposed for election to an office if, were the election held, only the votes cast for that candidate in the election for that office may be counted.

(b) The certification shall be delivered to the governing body of the political subdivision as soon as possible after the filing deadlines for placement on the ballot and list of write-in candidates. § 2.053 ACTION ON CERTIFICATION. (a) On receipt of the certification, the governing body of the political subdivision by order or ordinance may declare each unopposed candidate elected to the office. If no election is to be held on election day by the political subdivision, a copy of the order or ordinance shall be posted on election day at each polling place used or that would have been used in the election.

(b) If a declaration is made under Subsection (a), the election is not held. (c) The ballots used at a separate election held at the same time as an election that would have been held if the candidates were not declared elected under this section shall include the offices and names of the candidates declared elected under this section listed separately after the measures or contested races in the separate election under the heading “Unopposed Candidates Declared Elected.” The candidates shall be grouped in the same relative order prescribed for the ballot generally. No votes are cast in connection with the candidates. (d) The secretary of state by rule may prescribe any additional procedures necessary to accommodate a particular voting system or ballot style and to facilitate the efficient and cost-effective implementation of this section. (e) A certificate of election shall be issued to each candidate in the same manner and at the same time as provided for a candidate elected at the election. The candidate must qualify for the office in the same manner as provided for a candidate elected at the election.

BACKGROUND: In a city in which any of the members of the city council are elected from single member district, a general or special election may be cancelled in a single member district if:

2. No proposition is to appear on the ballot [EC §20.051(b)]. The City Secretary has delivered to the City Council a Certification that the candidates for Mayor and City Council Ward 2 are unopposed. Upon receiving the certification, the City Council may declare the unopposed candidates elected to office, in which case the election is cancelled. webpage www.cityofrockport.com; and 18

WHEREAS, on January 15, 2018 notice was mailed to affected property owners within 200’ of 20

subject property; and 21

WHEREAS, on January 17, 2018 the City caused to be published “Notice of Joint Public 23

Hearing” in the official newspaper of the City notifying area residents and the 24

public in general to participate and make their views known regarding this 25

request; and 26

WHEREAS, on February 13, 2018 at 6:30 p.m., the Rockport City Council and the Planning & 28

Zoning Commission did hold a Joint Public Hearing; and 29

WHEREAS, on February 19, 2018 the Planning & Zoning Commission did meet and said 31

Commission voted to recommend to the City Council to accept and approve this 32

request to re-zone property, located at 1125, 1133 and 1141 Sixteenth Street from 33

R-1 (1st Single Family Dwelling District), to R-2M (Manufactured Housing 34

It is the intention of the City Council of the City of Rockport that if any phrase, sentence, section 54

or paragraph of this ordinance shall be declared unconstitutional or otherwise invalid by final 55

judgment of a court of competent jurisdiction such unconstitutionality or invalidity shall not 56

affect any of the remainder of this ordinance since the same would have been enacted by the City 57

Council without the incorporation of the unconstitutional or invalid phrase, sentence, section or 58

paragraph. 59

Article I. Zoning Ordinance*

Sec. 118-9. R-2M Manufactur ed Housing District.

9.1 Use Regulations. The purpose of this district is to provide residential zoning for both HUD-CodeManufactured Housing and site built homes while providing the same environment found in the 2ndSingle-Family Dwelling District. Land and premises may be used only for:

1. HUD-Code Manufactured Housing.

2. Use 1 in an R-2 district..

9.2 General Standards. HUD-Code Manufactured Homes shall comply with the standards of theUnited States Department of Housing and Urban Development and the Texas Manufactured HousingStandards Act concerning manufactured housing stock. Mobile Homes, as defined, are prohibited withinthis district unless such mobile home existed prior to annexation. Replacement of an existing mobilehome shall be with a HUD-Code Manufactured Home. Replacement of an existing HUD-CodeManufactured Home may be with a HUD-Code Manufactured Home of equal size (square footage) orgreater and be a newer model.*

* NOTE : Newer model means a manufactured home built and identified by the manufacturer asthe next years' model to the manufactured home being replaced.

9.3 R-2M Manufactured Housing District Specifications. The R-2M district shall consist of at least two(2) acres in size.

9.3.1 Development of the proposed district shall be in accordance with the city's platting andsubdivision regulations regarding manufactured housing subdivisions.

9.3.2 All manufactured homes in the district shall be installed on HUD approved foundations andshall be enclosed with approved skirting.

9.4 Area and Yard Regulations.

9.4.1 Area of the lot. The minimum area of the lot shall be five-thousand (5,000) square feet.

9.4.2 Width of the lot. The minimum width of the lot shall be fifty (50) feet.

9.4.3 Area of the Dwelling. The minimum living area of a site built dwelling shall be six hundred(600) square feet. The minimum living area of a manufactured home shall be in accordance with theTexas Manufactured Housing Standards Act (currently 320 sq. ft.).

9.4.4 Yard Areas and Building Setback. Shall be the same as the R-2 district.

9.4.5 Height of the Building. No building or structure shall exceed thirty-five (35) feet in height.

9.4.6 Parking Regulations . Parking regulations for permitted uses shall be the same as in the R-2district.

9.4.7 Auxiliary Use Regulations. Auxiliary uses, which are auxiliary or incidental to the primaryuse, shall be the same as in the R-2 district.

9.5 Auxiliary Use Regulations. Auxiliary uses which are auxiliary or incidental to the primary use of abuilding or premises, as contained in Article 22 [section 118-22].

Good Morning Cindy: Hopefully this finds you staying warm! I have checked withboth the City (you got annexed) and the County regarding the "area to stay natural"comments on the plat we have. The Buyer seems to be OK with the answers, whichis the good news. While visiting with Amanda Perez at the City Hall Annex (zoningdepartment) she noted that all newly annexed properties come into the City as R-1(residential), and then the Owner has to ask to have it re-zoned. While this soundscomplicated she agreed it is not normally complicated at all, just a procedure tofollow). I have the paperwork to start this process for you, if you like. I can representyou to the City. The re-zoning application carries a $150 (plus $10 per acre) filingfee, so roughly $180 total. Secondly, the plat we have was done prior to theimprovements being constructed. Our sales contract calls for a new survey showing

the improvements, which the re-zoning permit requires anyway. I can order thesurvey for you as well, just want to have your permission ahead of time. The bestnews is the Buyer is asking all the right questions: I am providing him an inventory(basically stating that the things permanently attached to the building convey with thesale). Article I. Zoning Ordinance*

Sec. 118­15.     B­1 General Business District.

15.1     Use Regulations. The purpose of this district is to provide suitable locations for a wide variety ofbusiness and mercantile uses. In addition to the previous listed uses in R­1 through R­7 districts, land andpremises may be used for:

1.     Restaurants, cafes, food catering services.

2.     Offices, banks, libraries, museums, etc.

3.     Service stations, car washes, laundromats.

4.     Malls, shopping centers, retail stores.

5.          Shops  (butcher  shops,  shoe  shops,  shell  shops,  etc.,  including  pawn  shops  that  have  beenlicensed  to  transact  business  by  the Consumer Credit  Commissioner  under Chapter  371, FinanceCode).

6.     Grocery stores, convenience stores, markets.

7.     Retail markets (seafood/meat) and bait stands.

8.     Entertainment facilities (theaters, bowling alleys, pool halls, clubs and lounges, etc.

9.          Sales,  service  and  repair  shops  (radio,  television,  shoe  repair,  tool  repair  and  rental,  lawnmower repair, auto and boat repair shops, etc).

10.     Personal service shops (beauty salons, barber shops, tailoring and dressmaking shops, etc).

11.     Storage buildings, auto storage yards.

12.     Animal hospitals, boarding kennels and grooming shops.

13.     Mortuaries and funeral homes.

14.     Agricultural services, greenhouses and landscaping services.

15.     Outdoor welding, fabricating operations, by CUP.

16.     Permanent or long term (more than 30 days) public entertainment facilities or uses, by CUP.Such  uses  may  include,  but  not  be  limited  to,  amusement  parks,  carnivals,  circuses,  marine  lifeshows, dance/theatrical productions and natatoriums.

17.     Fish houses, seafood processing plants, by CUP.

18.     Adult entertainment, by CUP.

15.2     Area and Yard Regulations.
