DEFINITIONS Applicant Refers to an Individual Applicant or a Consortium, Applicant as the case

may be. Application Application for qualification prepared in response to the RFP document

in the format given in Annex. 1 Bidder Shall have the meaning as ascribed to such item in Para 3 of section I. Company A Company registered under the Companies Act, 1956. Consortium A group of Organizations (as defined below) formed by a MoU undertake

the Project in connection with the Commonwealth Games, 2010 Village. Consortium Applicant

Financial Year

The 12-month period, in case of: a. Indian entity, commencing form the 1sr day of April of any Year and

ending on the 31st day of March of the following calendar year b. Foreign entity, which is its usual accounting period.

Individual Applicant

Shall have the meaning as ascribed to such term in Para 2 to Section - C

Lead Member

Such member of the Consortium which has been designated so by the other members of the Consortium and also authorized by them to represent each one of them and enter into contracts for and on their behalf

Net-worth Paid up share capital + Reserves and surpluses (Excluding Revaluation Reserves) – Preliminary and pre-operative expenditure and miscellaneous expenditure to the extent not written off, as per the annual report and as adjusted with any qualifications in the Auditors’ Report.

Organization A Company registered under the Companies Act 1956, or with respect to a Company incorporated outside India a Company which if incorporated in India would be a Company as defined by the Companies Act, 1956.

Organizing Committee

The body entrusted with the task of management of Commonwealth Games, 2010.

Project The three (3) Projects covered under the scope of this RFP document shall have the meaning as ascribed to such term in Section –B

Turnover The total amount of gross receipts, from activities in the normal course of business as per the annual report and as adjusted with any qualifications in the Auditors’ Report.

A DELHI DEVELOPMENT AUTHORITY 1. The Delhi Development Authority (DDA), the first development authority in India was

constituted in 1957 under the provision of the Delhi Development Act to promote and secure the development of Delhi, The DDA is an autonomous body under the Ministry of Urban Development, Government of India.

2. DDA, the planning, development and licensing authority for Delhi has played a pivotal role

in the development of the city of Delhi, which presently has a population of over 14 million. 3.For the planned development of Delhi, the DDA formulated the first Master Plan in 1962 for

the planned growth and development of Delhi. This Master Plan was extensively revised and a comprehensive Master Plan with perspective up to 2001 was adopted in 1990. The Master Plan for 2021 has been notified and has now been adopted

4. DDA has acquired 70,000 acres of land and developed it for residential, recreational,

industrial, commercial and institutional purposes. 5. The DDA also played a major role in the development of facilities for the Asian Games in

1982. Apart from the Games Village for this event, it developed many of the city’s present sports infrastructure including the Indira Gandhi Indoor Stadium, the Yamuna Velodrome and Karni Singh Shooting Range. The DDA has also created a network of sports facilities in the city with its 14 multidisciplinary sports complexes.

B PROJECT BACKGROUND (a) YAMUNA SPORTS COMPLEX

1.Yamuna Sports Complex developed over an area of approx. 28 ha. (70 acres) near Vivek

Vihar in East Delhi is popular multi-disciplinary sports facility developed by the DDA. 2. Competition venue Archery (to be developed on the existing cricket ground) The DDA is required to provide training venues at this complex for following events.

1. Aquatics (In Existing; Swimming pool) 2. Rhythmic Gymnastics (In Existing Gymnastic Hall) 3. Archery (In Football Ground) 4. Lawn bowls (In Hockey Ground)

(b) SIRI FORT SPORTS COMPLEX 1.The Siri Fort Sports Complex, developed over an area of approx. 14 ha.(35 acres) is Delhi’s most popular sports precinct located adjacent to the Siri Fort Institutional area in South Delhi. The Complex provides a wide range of sports facilities for the public The DDA is required to provide training venues at this complex for following events.

1. Aquatics (In Existing; Swimming pool) 2. Tennis (In Existing Tennis Ground) 3. Lawn Bowls (In Existing Lawn Bowls Grounds) 4. Archery (In Cricket Ground) 5. Badminton (In Existing Badminton Hall) 6. Squash (In Existing Squash Court)

(c) SAKET SPORTS COMPLEX 1.The Saket Sports Complex developed over an area of approx. 7 ha. (17.5 acres) at Saket in South Delhi in another popular multi-disciplinary sport facility developed by DDA The DDA is required to provide training venues at this complex for following events.

C ENGAGEMENT OF CONSULTANTS 1.The DDA proposes to engage Design Consultant for the construction of competition and

Refurbishment of training venues at Siri Fort, Saket and Yamuna Sports Complexes (henceforth called Design Consultants).

2.Proprietary firms, partnership firms, companies and corporations interested to work as

Consultants may apply either individually, or as joint venture, or as a consortium. The lead consultant shall be Indian firm. No party will, however, be permitted to apply in different capacities e.g., as a proprietor, or a partner of a firm, or a company in which the party is a Director, or is having a substantial interest, or as part of a joint venture or consortium. Similarly, no persons shall be permitted to be a partner of more than one firm, or Director in more than one company. If any firm, or their proprietors, or partners, company or their Directors, or shareholders having substantial interest, or Corporations have applied in their individual capacity as well as in other capacities, all the applications in which they have acted either as proprietor, partner, Director, shareholder having substantial interest would be cancelled. All the partners of a firm, all the parties to a joint venture or consortium will be jointly and severally liable for the performance of the whole contract.

D Scope of work

The scope of work for the Design Consultant would be as follows: 1. The consultant shall physically familiarize with the existing buildings and infrastructure availability which are listed in section-B. 2. The Consultant would be required to assist the DDA in evaluation concepts and designs for

Games competition and training venues as listed in section-B to be built by the DDA as per the advice of organizing committee and venue Brief provided by EKS and calculate construction costs through detailed quantity surveys. This would include venue designs and construction parameters, as per requirements of International Sports Federations (IFS), transportation and parking, assessing quantity of support services within the venues like athlete, media and administration facilities, sports technology and services including playing surfaces, field of play (FOP), sports lighting, audio-visual facilities, accessibility and sight-lines, Air Conditioning including up gradation of Electrical sub station, external lighting fire system, security system utility services and land scaping in compliance with CGF/IFS requirements, security, public domain planning, design for facilities for Elite Athletes with Disability (EAD) Programme and for differently abled individuals and spectators, first aid and medical facilities, assistance during and planning for trial events etc.

3.The Consultants would be required to prepare tender documents, tender evaluation

contractual structure, feasibility studies, quantity surveys, structural design, assessment of progress of work, site visits as and when required presentations before various Committees, organizing site visits and advice on all matters relating to the refurbishment of the training/competition venues, including obtaining clearances/endorsements/approval of proposals from all agencies including Delhi Urban Art Commission (DUAC), CGF/IFS, other local bodies such as Delhi Jal Board (DJB), Municipal Corporation of Delhi (MCD), Delhi Fire Services (DFS), police authorities for security, Traffic Management inside and out side and clearance from disaster Management Authority etc. whenever required. Any fees payable to concerned department will be borne by the DDA. Any formality required in this regard will also be provided by the DDA. The scope of work for the competition / Training venues will also include.

(i) Prepare an overall Project Brief setting out all the requirements of the project and the time lines for the planning, design, tendering and construction phases with appropriate techniques and programmes.

(ii) Preparation of tendering documents, BOQ with details of measurements and

specification of all items, feasibility studies, quantity surveys, including site visits and attending meetings as required by the DDA, presentations before various Committees and advise on all matters relating to the development of Games related works including clearance/endorsement of proposals from all agencies, CGF, Ifs ,etc.

(iii) Preparation of detailed Architectural, Structural, Services drawings including drawings showing details of all utilities and services, including electrical, mechanical, fire system, internal and external electrical system and incorporating all revisions that may be required to be done at the time of their approval including details of specifications of all items of work

(iv) Supply such further Architectural and Structural drawings, specifications required

for the refurbishment of existing facilities and development of new facilities at Siri Fort, Yamuna Sports Complex and Saket Sports Complex.

(v) Check and approve shop drawings submitted by the Contractors, if any

(vi) Give necessary periodic supervision and inspection as and when required by the

DDA to see that the works are being executed generally in accordance with the working drawings and as per Architectural concept.

(vii) The Consultant shall submit four sets of completion plans for all services i.e. civil

Electrical, Mechanical & fire system (hard & soft copies) including one reproducible in A 1 size. All these plan shall be submitted in AUTOCAD Drawing in CD form. These are in addition to drawings and details mentioned in other clauses.

4 .The Consultant will also be required to review all the existing services, such as internal roads, footpath, parking/circulation, drainage, water supply and sewerage system Electrical, Fire Street lighting, by making physical inspection and provide all details for the required augmentation/up gradation of these services and integrate the same with the peripheral services.

5. The consultant shall have to get the detailed soil investigation done from soil consultant as per approved list of DDA or any reputed soil consultant approved by Engineer incharge at his own cost for all structural design / drawing.

6. It is entirely the responsibility of the consultant to get the structural design approved and finalized within specified period. The decision for deciding the authority for approving above structural design from the govt. organization like IIT /CDO. CPWD / CBRI Roorkee etc. will rest with Engineer-in charge.

7. All design shall be based on the latest available relevant NBC, ECBC, IS codes if any such code is not available BIS, International, American code be followed.

6. SCHEDULE OF SERVICES (i) Preliminary Evaluation Stage

a) Study of broad design guidelines for the project area i.e local byelaws, acts and regulations etc.

b) Study of existing land and building uses of the project area.

c) Study of existing pattern of water supply, drainage, electrical, mechanical circulation pattern and parking.

d) Assessment of rough estimate of project cost based on concept design.

e) Furnish a site evaluation and analysis report with basic approach to circulation,

activity distribution and interaction and external linkages including rough project cost estimate.

(ii) Concept Design Stage

a) Preparation of concept scheme of the area showing circulation pattern, zoning

of various land uses, three dimensional form, schematic layout of utility services and relevant details.

b). Furnish approximate project cost based on concept design

c). Preparation of model showing the proposal and surrounding areas. d). Presentation of model and concept design to the DDA/statutory bodies for approval and carry out necessary changes as may be required

(iii) Detailed Design Stage

a) Preparation of layout drawings showing the common facilities for circulation, parking, open plaza, landscape, schematic network of services including section across the site, street furniture and graphic signage Electrical & Mechanical etc. complete as well as external architectural form, specifications and finishes.

b) Preparation of all necessary drawings showing full architectural, elevational

and other development controls and materials to be used.

c) Furnish modified estimate of project cost based on detailed designs including

cost of site development works.

d) Preparation of detailed design model. e) Designing of sewage treatment and water source development, including

Rainwater harvesting physical topographical survey, traffic surveys, preparation of publicity material / brochure, structural design work, detailed design of services and its approval from local authorities, electrical, plumbing, air-conditioning, heating, acoustic, telecommunication, security and Fire systems etc.

(iv) Implementation Stage

a) Site visits during structural finishing & service work as and when required, review and certification of detailed architectural designs of each of the constituent components for construction.

7. COMPREHENSIVE ARCHITECTURAL SERVICES Architectural services to be rendered are described as follows

a) Furnish a site evaluation and analysis report with basic approach to circulation, activity distribution and interaction and external linkages.

b) Prepare conceptual designs with references to requirements given and prepare approximate estimates of cost by cubic measurements, or on area basis.

c) Modify the conceptual designs incorporating required changes and prepare preliminary drawings and designs and study model for the client’s approval along with revised estimates of cost.

d) Approval of the scheme from DUAC, DJB, Civil Aviation, Fire Services police authorities (Security & Traffic) disaster management cell, ASI Organizing committee (OC) of commonwealth Games 2010 or any other agency if required.

e) Prepare drawings necessary for submission to statutory bodies for sanction. f) Prepare working drawings, specifications and schedule of quantities sufficient

to prepare estimates of cost. g) Preparing working drawings including large scale and full size details, detailed

specifications and BOQ sufficient to invite tenders. h) Prepare and submit complete working drawings and details sufficient to

commence works at the site and for the proper execution during construction. i) Visit the site of work as and when required by DDA to clarify and decide on

the interpretation of the drawings and specifications that may be necessary and attend conferences and meetings, to make presentations as and when required, and to ensure that the project proceeds generally in accordance with the conditions of contract.

j) On completion of the work, the consultant will prepare and submit four sets of as built drawings (one set on reproduction prints of the buildings and services)

SCOPE OF WORKS 1.The Consultant would need to make recommendations with a view to optimize the utilization

of the facilities for staging the Commonwealth Games, 2010 while at the same time providing for longer term events such as the Asian/Olympic Games in future as well as community legacy. The Consultant would require to prepare initial budget estimates/assessment for each facility, benchmarking both on other international comparable facilities and local expertise and costs. Emphasis should be on planning for developing/upgrading venues and venue related event infrastructure at a standard which is commensurate with generally accepted international standards for major events globally, benchmarking against the Commonwealth Games standards as the relevant references standards, while keeping in view future multidisciplinary international sports events like the Asian and the Olympic Games. Environmentally sustainable development methods should receive utmost consideration.

2. The Consultant shall initiate and actively pursue and involve themselves in all investigation,

enquiries, consultation, studies, collection and compliance with pertinent information and data, convening of and attendance at meetings, and in any other activities as are or may be necessary for producing the detailed specified requirements.

3. The Consultant should have sufficient number of technical and administrative employees for

the proper execution of the project. The consultant should submit a list of employees stating clearly how they would be involved in the project. The in house capability of the firm should be brought out clearly indicating the disciplines for which the firm will need to appoint sub-Consultants. The number of technical and administrative employees indicated in the application should not be reduced at the relevant stage of work of the project.

4.The Consultant would require to prepare documents on the basis of appropriate standards,

criteria and specifications. They would require liasioning with all concerned local authorities and private and government agencies and adhering to time lines set by the DDA. Implementation and progress of works should be prepared through CADD files, perspective sketches and 3D computer model renderings and design briefs should be described in words, diagrams and graphics.

5. The Consultant would require to work as an integral team with the DDA and with other

Consultants the DDA may engage for the project/projects to formulate the best possible development options. The Consultant would need to work with the DDA as and when required in the offices of the DDA for better coordination. The Consultants will be required to submit the designs and reports within the time frame as required by the DDA.

6. In case the DDA requires the Consultants to perform any other substantial additional

services, the Consultant should agree to perform such services on mutually agreed terms.

The Consultant, or their constituents would not be eligible to participate in any bid, tender etc. which they are supposed to evaluate on behalf of the DDA for the Commonwealth Games projects. The recommendations of the Consultant would be advisory and shall not be mandatory or binding on the DDA

E GENERAL 1. Letter of submission and Forms A to D are given at Annexure, which are to be submitted

along with the Request for Proposal (RFP). 2. All information called for in the enclosed forms should be furnished against the relevant

columns in the forms. If for any reason, information is furnished on a separate sheet, this needs to be mentioned against the relevant column. Even if no information is to be provided in a column, ‘nil’ or ‘no such case’ entry should be made in that column. If any particular query is not applicable it should be stated as ‘not applicable’. The applicants are cautioned that not giving complete information called for in the Application Forms, or not giving it in clear terms, or making any change in the prescribed forms, or deliberately suppressing the information shall summarily disqualify the applicant. Applications sent by telegram/telex, not enclosing prescribed fee and received after stipulated time shall be out rightly rejected.

3.The Application should be type written in English and the authorized signatory should sign

each page of the Application and sets/ certificates and enclosed documents showing such authority.

4.Overwriting should be avoided. Correction, if any should be made by neatly crossing out,

rewriting, signing and dating. Pages of the pre-qualification documents should be numbered. Additional sheets, if any, added by the applicant should also be numbered. They should be submitted as a package with the signed letter of submission.

5.References, information and certificates from the respective clients certifying suitability,

technical know how, or capability of the applicant should be signed by the authorized signatory of the firm.

6. The applicant may furnish any additional information with the RFP document, which he

thinks is necessary to establish his capability to successfully complete the envisaged project. He is, however, advised to furnish only relevant information. No information shall be entertained after submission of the Request for Proposal document unless it is called for by DDA. DDA, however, reserves the right to call for any clarification/ additional information on the bids.

7. Any information furnished by the applicant found to be incorrect at any stage would make

the applicant liable for such action as deemed fit by the DDA. 8. The Technical Bid shall not include any information about the financial bid.

F ELIGIBILITY CRITERIA 1.Financially sound Indian/International companies, proprietary/partnership firms,

corporations, partnership of firms/joint ventures/consortia may bid for engagement as Consultant.

2. A Group Comprising of a partnership of firms, joint venture or consortium may apply for the

Consultancy. In the case of applications from groups, a statement of participation for each group member shall be submitted to the effect that they are bonafide members of the group applying for pre-qualification and that, in the event of pre-qualification, they agree to be jointly and severally liable to the DDA under the contract which may be subsequently awarded to the group. True/Certified copy of the partnership deed, joint venture or consortium agreement as the case may be along with Memorandum of Undertaking (MOU), if any, signed by all participants and duly attested by a Public Notary shall have to be submitted. No party can, however, apply as an individual firm and at the same time as part of a group and no individual firm can be a member of more than one group.

3. The Design Consultant should have preferably prior expertise and involvement in

developing/ up gradation of Sports Competition/ Training Venue for such International Sports Events in the recent past.. The intending parties must demonstrate a detailed understanding of the operational and technical requirements of such International Sports events. Experience in previous Olympic/Commonwealth/Asian Games/ other such sports events where they have worked with the organizers/relevant Government Authorities in the identification of technical, construction and environmental issues, including identification of all the overlay requirements and associated infrastructure demands of the Sports Venue, Competition Training Venue will be given preference. For the Design Consultancy for the Games Competition and Training Venues, Consultant with prior experience in developing/planning/designing of international sports venues will be given preferences. The Consultant should have sufficient number of in-house technically qualified professionals such as planners, architects, engineers (civil, electrical, mechanical, electronic, acoustics, lighting, communication, structural, environmental), quantity surveyors, landscape architects, project managers, operations, maintenance and logistics specialists, schedulers and cost controllers, etc. Design Consultant should also have the following experience: Three completed works costing not less than Rs.10 crores each (USD 2.5 mi.) during the last five years.

Or Two completed works, costing not less than Rs.12.5 crores (USD 3.12 mi.) during the last five years.

Or One completed work costing not less than Rs.20crores (USD 5 mi.) during the last five years.

4.The Consultant should be well aware of current global trends and practices in their respective field. Experience of having undertaken such works in the past should be in the name of the intending firms/companies and not of individuals presently engaged/employed by these firms/companies. The companies/firms should have expertise in their respective fields of a minimum of 5 years. Intending parties should demonstrate their capabilities, by providing material based on their experience, past performance, their personnel, equipment and financial resources to carry out the works detailed in the scope of work, including:

(i) Capability to execute the project to the requisite standard and to monitor and control construction development.

(ii) Capability to programme and re-programme the work, monitor progress against

programme and to utilize computer programming and monitoring techniques.

(iii) Capability to manage, supervise and undertake the work in a manner and to a quality commensurate with that achievable in international circumstances.

The intending parties for the Design Consultancy should have an annual turnover of Rs. 1 crores during each of the last three financial years (corresponding period and turnover of approx (USD 0.25 mi. or equivalent, in case of foreign companies. In case of joint activities include work similar to the nature of works for which the Consultant is being engaged.

2. The lead Indian consultant in case of Joint venture or stand alone must have financial

turnover of Rs. 50 lacs (fifty lacs) in each year for the last three years.

I OPENING OF PROPOSALS & PROCEDURE FOR SELECTION OF CONSULTANTS.

1.The Committee nominated by the Vice Chairman, DDA will process the applications and finalize the selection of Consultant with the approval of the Vice Chairman, DDA.

2.Intending parties should submit their technical and financial bids in two separately sealed

envelops superscribed “ TECHNICAL RFP BID” and “ FINANCIAL RFP BID” In case both are submitted in a single envelope this will automatically disqualify the party concerned.

3.The Committee will open the tenders, the sequence of which shall be as follows: - a) Application fee and Earnest Money Deposit (EMD)

b) Technical Bids c) Financial Bids

First, the envelope containing Application fee, in case of RFP document downloaded from website, and Earnest Money Deposit will be opened and if the bidders have submitted them, then the envelope containing the Technical Bid would be opened. The Financial Bids of only those bidders who qualify the Technical Evaluation would be considered for further evaluation on the date as mentioned in the Schedule for Selection of Consultants.

4. The DDA would scrutinize all RFPs received up to the stipulated date and time for the receipt of RFPs and evaluate these on the basis of the eligibility criteria laid down in this document. Any bid received after the stipulated date and time will be rejected. Those parties which do not meet these criteria would be disqualified. Parties that meet the required criteria on the basis of the documents submitted by them with the RFP would be shortlisted. The DDA reserves the right to independently verify the genuineness of the documents submitted by the parties. Copies of all documents submitted should be signed on all pages by the authorized signatory / signatories of the intending firm/ joint venture / consortium. Unsigned documents will not be considered for evoluation. During verification, if any, submitted document is not found to be genuine or it is misleading in any way, the concerned party would be disqualified. The DDA reserves the right to restrict the list of shortlisted parties as deemed suitable by it and the right to decide on the shortlisting criteria.

5.Shorlisted parties would be intimated and they would be assigned a date and time for making

a power point presentation before a jury. The intending party should make the presentation with emphasis on their past experience in the field, technical manpower and specific projects handled in the recent past along with drawings, designs, layout plan, sketches, etc., of the proposed facility for which they are proposing to be engaged as Consultants (Proposed conceptual plans for Venues). Parties making the presentation would need to submit three hard copies of their power point presentation. The jury may also ask parties to provide clarifications on the documents submitted by them with the RFP.

6.Parties would be evaluated on the basis of the presentation made before the jury and the

documents submitted with the RFP. Parties that meet DDA’s criteria for selection would thereafter be shortlisted. The DDA reserves the right to decide the criteria for shortlisting,. Assessment would be made on all criteria and requirements mentioned in this document as well as financial standing, technical staff, experience of key staff, experience record

including length of time in business, work experience and major designing / development works in the relevant field.

7. The Financial Bid of shortlisted bidders shall be opened in the presence of one representative

each from the respective Bidders, who choose to attend. The name of the bidder, and the quoted fees shall be read aloud and recorded when the Financial Bids are opened. The bidder whose financial bid is found to be the lowest will be declared successful.

8.The DDA shall not be bound to accept the lowest financial bid. It is, however clarified that submission of application / making power point presentation / lowest financial bid of fulfillment of any eligibility criteria does not vest any right in any applicant for selection. DDA may appoint the next lowest bidder provided he agrees to bring down him rates to the L-1 level in case the negotiation with L-1 fails.

9.Intending parties are advised that selection of Consultant will be entirely at the discretion of DDA. Applicants will be deemed to have understood and agreed that no explanation or justification of any aspect of the pre-qualification / selection process will be given and that DDA’s decisions are final and binding and not open to any challenge in any proceedings

10.All costs incurred by an applicant for pre-qualification / selection shall be borne by the

applicant, and DDA, its agents, successors and assignees are entirely without liability for such costs.

11. DDA reserves the right to accept or reject any application and to annul the pre-qualification

/ selection process at any time without notice, liability or assigning any reason thereto. 12. The decision of the Vice Chairman, DDA in this regard shall be final. 13.DDA reserves the right to modify the evaluation process / relax any criteria of eligibility for

selection of Consultant laid down in the RFP documents, if felt necessary, without assigning any reason, whatsoever, and without any requirement of intimating the bidders of any such change.

J NEGOTIATIONS

1. Negotiations shall take place with the aim to reach an agreement in respect of financial offer and sign a contract.

2. Negotiations shall include detailed discussions on the proposed methodology / work plan,

staffing with a view to improve the Terms of Reference (TOR). The firm and the DDA will then work out the final TOR, staffing, bar charts, etc. This may also include variation in the quantities / jobs at the time of award.

3.The agreed work plan and final TOR shall be incorporated in the scope of the work, which

shall become part of the contract. The efforts during negotiations shall be to achieve maximum from the firm within the available budget and to clearly define the inputs required from the DDA in order to ensure satisfactory implementation of the project.

4. During negotiations, the DDA will not consider substitution of the key professional staff

proposed in the bid unless both parties agree to such a proposal. If this is not the case and it is established that the proposed key staff offered in the proposal was without confirming their availability, then the firm may be disqualified.

5. After the conclusion of the negotiations, contract agreement will be finalized.

K FEES AND PAYMENTS TERMS 1.In financial RFP bid the intending bidder should clearly specify that total amount of fees (in

Indian Rs.) payable by the DDA to the Consultants, inclusive of all levies and taxes as per the latest taxes and rules applicable for the entire work as detailed in this document, inclusive of fees payable to any other Sub-Consultants and Associate necessary deduction of levies, taxes etc. shall be done as applicable as per rule.

2 Income tax along with Surcharge, Service Tax and other taxes etc as applicable, will be deducted from the running and final payments NO SERVICE TAX SHALL BE PAID EXTRA.

3 The DDA shall pay expenditure on any outstation visits for the purpose of the project, so desired specifically by the DDA, which will be restricted to TA and DA as admissible to the officers of the DDA including travel by air, on production of TA bills

4.The Design Consultant for the competition, and refurbishment of training venues shall quote his total fees subdivided as under:

(i) Fees for Architectural detailed design, structural design for competition venue

(ii) Fees for Architectural details design, structural design for refurbishment of training

venue .

4.The amount of fees for the Design Consultant for the Detailed Architectural and Structural design & drawings for venues shall be paid in the following stages:

Stage I On submitting conceptual designs and Preliminary estimates of costs.

5% of total fees

Stage II On submitting final preliminary drawings/designs and estimates of cost.

15% of the total payable less payment already made.

Stage III On submitting preliminary drawings and obtaining approvals from statutory bodies. Working drawing stage.

25% of the total fees payable less payment already made.

Stage IV During preparation of basic working drawings and details sufficient for preparing item-wise estimates of costs.

45% of the total fees payable less payment already made.

Stage V On submitting detailed specifications, bills of quantities/ Tender documents detailed architectural working drawings (structural and services design) together with estimates of costs sufficient to invite tenders.

55% of total fees payable less payment already made.

Stage VI On submission of complete set of drawings and details sufficient for the work to commence at site.

70% of the total fees payable less payments already made.

Construction Stage Stage VII During the course of construction of work at site for Project Management, site visits etc.

Further 20% to be paid in installments consistent with the value of work from time to time at the interval of 6 month.

Stage VIII On completion of the work and submission of completion plans (to be paid within six months of completion of the work).

Balance payment making the total equivalent to 100% of fees payable.

Note: - 1. Intermediate payment shall be made in all of the above stages based on the quantum of work done in that stage as mutually agreed to by both parties 2. The Design Consultant should quote fees in a consolidated manner and the fees shall be paid as per K-5 above.

L EARNEST MONEY, SECURITY DEPOSIT & BID VALIDITY

1. The bidder will be required to deposit Rs. 2 lacs as earnest money by submitting a Demand Draft/Bankers’ Cheque payable at Delhi drawn in favour of “Sr. A.O., CAU (Commonwealth Games) DDA”, or in the shape of Bank guarantee in a separate envelope while submitting the bid. Those bids not accompanied by earnest money will not be opened. This earnest money will later on be adjusted in the Security Deposit

2. 5% of total amount payable to the Consultant shall be deducted progressively from each

bill towards Security Deposit and the same shall be refunded after 6 months of completion of work.

3. The bids shall remain valid for a period of 90 days from the last date of submission of bid.

N PRE-BID MEETING

1.Pre –bid meeting shall be held at the DDA Coordination office for the Commonwealth Games, Siri Fort Sports Complex, August Kranti Marg, New Delhi – 110 049 on the scheduled dates and time mentioned in the Schedule for Selection of Consultants. All bidders are requested to go through the bid document, visit the sites and submit the queries (if any) addressed to the Executive Engineer Commonwealth Games division-4, seed Bed Park, Shakarpur Delhi-110092 Fax No. 011-22483872 (through Fax or E mail) at least 2 days prior to the scheduled date of the pre-bid meeting. The DDA shall prepare minutes of the meeting and post the same on DDA’s website (www.dda.org.in). No separate information will be passed to individual bidders in this regard.

O AMENDMENT OF BID DOCUMENT

1. At any time, prior to the date of submission of Bids, the DDA may, for any reason whether at its own initiative, or in response to clarifications requested by a prospective Bidder during the Pre-bid meeting, modify bid documents by amendments.

2. The amendments will only be published on the website www.dda.org.in. and these

amendments shall be binding on all the bidders. 3. In order to give the Bidders a reasonable time to take the amendment into account in

preparing their bids, the DDA may, at its discretion extend the deadline for the submission of bids suitably, notice in this regard which will be posted on DDA’s website www.dda.org.in.

P ADDITIONS AND ALTERATIONS 1. The DDA shall have the right to ask in writing changes, additions, modifications or

deletions in the design and drawing of any part of the work and to request in writing additional work in connection therewith and the Consultant shall comply with such request. That if the DDA deviates substantially from the original scheme which involves for its proper execution, extra services, expenses and extra labour on the part of the Consultant for making changes and additions to the drawings, specifications or other documents due to rendering major part or the whole of their work infructuous, the Consultant may then be compensated for such extra services and expenses on quantum merit basis at percentage applicable under this agreement and to be determined mutually unless such changes, alterations are due to the Consultant own omission and/or discrepancies including changes required at the time of approval at various forums and due to changes required by the Consultant of all internal, external utilities and services. The decision of the DDA shall be final on whether the deviations and additions are substantial and require any compensation to be paid to the Consultant. However, for any modification or alteration which does not affect the entire design, planning etc. no amount will be payable.

2. The Consultant shall not make any deviations, alterations, additions to or omission from

the work shown/described and awarded to them except through and with the proper approval of the DDA.

Q PERFORMANCE, PERFORMANCE SECURITY & TERMINATION

1. The time allowed for carrying out the work as specified in Section-M. Above shall be

strictly by the Consultant and shall be deemed to be the essence of the contract on the part of the Consultant. The work shall throughout the stipulated period of the contract be processed with all diligence and in the event of failure of the Consultant to complete the work within the time schedule as specified above, or subsequently notified to him, then the Consultant shall pay to the DDA a sum equivalent to 0.5% of the value of the consultancy fees for every month of delay subject to a maximum of 5% of the total consultancy fees as liquidated damages for such default. The payment of such damages shall not relieve the Consultant from their obligation to complete the work, or from any other of their obligations and liabilities under the contract.

2. The selected Consultant shall submit a Performance Guarantee by way of a Bank

Guarantee from a scheduled commercial bank within a period of 15 days from the date of issue of letter of intent in the format approved by the said bank as well as the DDA for 5% of the agreed Consultancy fees to be refunded/released after successful completion of the project.

3. That if the Consultant abandons the work for any reason whatsoever, or becomes

incapacitated from acting as Consultant as aforesaid, or in the event of the contract being Determined or rescinded under provisions of any of the clauses/conditions of the agreement

the DDA may make full use of all or any of the drawings/details prepared by the Consultant and that the Consultant shall be liable to refund all the fees paid to him till then and in addition the performance guarantee shall stand forfeited in full and shall be absolutely at the disposal of DDA.

4.If the Consultant is unavoidably hindered in carrying out their work on account of delayed

decision or approval by the concerned authorities, which are necessary to carry out further work, they shall be allowed suitable extension of time by the DDA whose decision shall be final and binding on the Consultant. No claim of compensation of Consultant shall lie against DDA for such delayed approval/ decision by the concerned authorities, excepting suitable extension of time.

5. In case of any dispute regarding action of either party mentioned in the agreement, the

matter shall be referred to the Vice Chairman, DDA, who will have full authority to review the decision of either party and settle the matter.

6. The Consultant shall continue to perform their duties diligently notwithstanding the fact

that a dispute has arisen and shall be paid by the DDA progressively as per the terms of the contract for services rendered by them.

7. The Consultant shall indemnify and keep indemnified the DDA against any inaccuracy in

the Consultancy job provided by them and against such claim/cost and expenditure paid by the DDA in defending itself against such claims for which the Consultant will give a professional Indemnity Bond.

8.The copyright, ownership and property rights for all the data, drawings, reports and computer software, etc. developed by the Consultant under this agreement, shall rest with the DDA.

9.If at any time the execution of the agreement and commencement of work the DDA for any

reason whatsoever, does not require the whole or part of the scheme as specified in the agreement to be performed by the Consultant, the DDA shall give one month’s notice in writing to this effect to the Consultant, who shall thereupon have no claim to any payment or compensation, whatsoever, on account of any profit or advantage which they might have derived as a consequences of fulfillment of agreement in full, but which they did not derive as a consequences of the curtailment of work. The Consultant shall be entitled to payment on a pro rata basis, for work submitted by them up to the time of such notice, as decided by DDA and the decision of the Vice Chairman, DDA in the matter shall be final and binding. The Consultant shall return the balance amount to the DDA in case of any excess payment.

10.The DDA may without prejudice in its right against the Consultant in respect of any delay,

by notice in writing absolutely determine the contract in any of the following cases: - (i) If the Consultant being a firm is dissolved, or if it is a Company, passes a resolution, or

the court shall make any other order that the firm/company shall be wound up, or if a receiver or a Manager on behalf of the Creditors shall be appointed, or if circumstances arise which entitle the court or Creditors to appoint a receiver or a Manager or which entitles the court to make up a winding order.

(ii) If in the opinion of DDA the Consultant commits breach of any of the terms of the

agreement and does not rectify the breach within 10 days of notice given by the DDA to remedy the breach.

(iii) When the Consultant has made himself liable for action under any of the cases aforesaid

the DDA shall have powers: (a) To determine, or rescind the agreement. (b) To engage another Consultant to carry out the balance work and take action as per

provisions contained in para Q-3 above.

R NUMBER OF DRAWING SETS 1. All the estimates, bills of quantities with detailed measurements, detailed designs with

calculation reports and any other details envisaged under this agreement shall be supplied in four sets and all drawings would be supplied by the Consultant as required for submission to all the local bodies and other authorities plus sets required by the DDA itself, being not less than six sets of prints and one reproducible in A-1 or large size. If there is any revision of any detail in any drawing for any reason the same number of drawings shall be reissued without any extra charges. Four soft copies of all the above documents shall also be given.

S GUARANTEE 1. The Consultant shall re-design at his cost any portion, of his engineering and design work,

which due to his failure to use a reasonable degree of design skill shall be found defective within two years from the date of start of regular use of the portion of the work affected. An undertaking to that effect will have to be given by the Consultant.

2. The DDA may make good the loss by recovery from the Consultant in case of failure to

comply with above clause. 3.The Consultant shall be fully responsible for the technical soundness of the work including

those of specialists engaged if any, by them and also to supervise so that the work is carried out generally in accordance with drawings, specifications and conception.

4.The DDA will have the work of the Consultant and/or their Sub Consultant

supervised/inspected at any time by any officer nominated by the DDA who shall be at liberty to examine the records, check estimates and designs.

5. The engagement of DDA’s own supervisory staff if any, does not absolve the Consultant

of their responsibility for designs of structures and all provisions/services of the work entrusted to them so as to satisfy their requirement.

T JURISDICTION CLAUSE 1. If any doubt arises regarding interpretation of any clause of this RFP document, the

decision of the Vice Chairman, DDA will be final. 2. All disputes arising out of the contracts to be signed with the Consultant shall be subject to

the jurisdiction of Delhi Courts only.

U FORCE MAJEURE 1.War, invasion, revolution, riots, sabotage, lockouts, strikes, work shut-down imposed by

Government Acts or legislature or other authorities, stoppage in supply of materials, fuel or electricity, breakdowns of machinery, act of God, epidemics, fires, earthquakes, floods, explosions, accidents, sea navigation blockades or any other acts or events whatsoever which are beyond reasonable control and which shall directly or indirectly prevent completion of the project within the time specified in the agreement, will be considered Force Majeure. The Consultants shall be granted necessary extension of time to cover the delay as caused by Force Majeure without any financial repercussions.

2. Should one or both parties be prevented from fulfillment of the contractual obligations by

state of Force Majeure, the two parties shall consult each other and decide regarding the future execution of the contract.

No. 011– 22483872) from 10.00 a.m. to 5.00 p.m. on all working days on payment of Rs.5000/- by Demand Draft/Bankers’ Cheque drawn in favour of the Sr. A.O. / C.A.U. – Commonwealth Games D.D.A. Intending parties can also down load the RFP document from the website www.dda.org.in. X MODIFICATION AND WITHDRAWAL OF BIDS 1. The Bidder is allowed to modify or withdraw its submitted bid any time prior to the last

date and time prescribed for receipt of bids, by giving a written notice to the DDA. 2.Subsequent to the last date and time for receipt of bids, no modification of bids shall be

allowed. 3.The Bidders cannot withdraw the bid in the interval between the last date for receipt of bids

and the expiry of the bid validity period specified in the Bid. Such withdrawal will result in the forfeiture of its Earnest Money.

Y I. LOCAL CONDITIONS 1. Each Bidder is expected to fully get acquainted with the local conditions and factors, which

would have any effect on the performance of the contract and / or the cost. 2. The Bidder is expected to visit and examine the sites/locations of DDA and their

surroundings and obtain all information that may be necessary for preparing the bid of their own interest and cost.

3. The Bidder and any of their employees/agents on written request will be granted

permission by the DDA to enter upon its premises and lands for the purpose of such inspection, but only upon the express condition that the Bidder and any of their employees/agents will be responsible for any personal injury (whether fatal of otherwise), loss of or damage to life, property and other loss, damage, costs and expenses however caused, which but for the exercise of such permission would not have arisen.

4. The Bidder is expected to know all conditions and factors, which may have any effect on

the execution of the contract after signing the agreement. DDA shall not entertain any request for clarification from the Bidder regarding such local conditions.

5. It is the Bidder’s responsibility that such factors have properly been investigated and

considered while submitting the bid proposals and no claim whatsoever including those for financial adjustment to the contract awarded under the bidding documents will be entertained by the DDA. Neither any change in the time schedule of the contract nor any financial adjustments arising thereof shall be permitted by the DDA on account of failure of the Bidder to know the local laws/conditions.

Y II. CONTACTING THE DDA 1. No Bidder shall contact the DDA on any matter relating to its bid from the time of the bid

opening to the time the Contract is awarded. 2. However DDA may contact the Bidders during evaluation for seeking any clarifications. 3. Any such effort by a Bidder to influence the DDA’s bid evaluation, bid comparison, or

contract award decisions may result in the rejection of the bid.
