1. RELEVANT PREVIOUS DECISIONS 1.1 Planning and Environment Committee (Ref: No. W00198AA/04). Consent for the

development was granted on 08 April 2005. Reserved matters application (ref: no. W00198AG/05) seeking approval for the design , external appearance and landscaping in relation to first phase of the development was granted on 22 June 2005.

2. CORPORATE PRIORITIES AND POLICY CONSIDERATIONS 2.1 The Council’s Corporate Plan 2008/09-2011/12 identifies as one of its priority

targets the need to ensure Barnet’s continued success as a suburb, based on the three strand approach of Protect, Enhance and Grow. The improvement of local infrastructure and in particular the borough’s road network, will contribute in improving the quality of life for everyone in Barnet and at the same time create conditions for a vibrant economy. Furthermore, the development in Beaufort Park supports and delivers housing growth in a sustainable way as well as contributes towards improving the public highway adjacent to the development.

2.2 The role of the Council is to create the conditions which maintain and enhance successful suburbs. These conditions will ensure that all our neighbourhoods are safe, clean and attractive green places to live as well as promote growth through successful regeneration and sustainable development.

3. RISK MANAGEMENT ISSUES 3.1 It is not considered that the issues involved in the report will raise significant levels

of public concern or give rise to policy issues. 4. EQUALITIES AND DIVERSITY ISSUES 4.1 Well maintained roads and pavements provide benefits to all sectors of the

community in removing barriers and assisting quick, efficient and safe movement across the borough.

4.2 The reconstruction of the footway and the localised widening of the carriageway in

Aerodrome Road, intends to enhance existing highway conditions and aim to increase road safety as well as to facilitate better accessibility and mobility to all sectors of the community, including people with special needs such as wheelchair users. This in turn will promote safety and encourage greater participation of all residents in public life. The above improvements will enhance Barnet’s reputation as a good place to live, improve confidence towards the Council’s functions and increase satisfaction among diverse communities.

5. USE OF RESOURCES IMPLICATIONS (Finance, Procurement, Performance &

Value for Money, Staffing, IT, Property, Sustainability) 5.1 The developer, St George Central London Limited, will meet the Council’s legal

costs in drawing up the Section 278 Agreement. The developer will also meet all costs associated with the proposed Section 278 highway improvement works in Aerodrome Road NW9, including technical approval and supervision of the works.

5.2 The proposed Highway works in Aerodrome Road NW9 will be carried out by the developer under the Council’s direct supervision. Since the developer will be using a non-standard material on the footway, an appropriate clause, with the heading “Commuted Sum”, will be inserted in the S278 agreement, in order to safeguard the Council against any extra maintenance costs involved. Other than this, there are no adverse or additional on going maintenance costs involved.

6. LEGAL ISSUES 6.1 None other than set out within the body of this report. 7. CONSTITUTIONAL POWERS 7.1 Constitution– Part 3– Responsibility for Functions-6- Powers Delegated to Officers-

General Power– Chief Officers can take decisions in consultation with the Cabinet member concerned in all matters where they have managerial or professional authority.

8. BACKGROUND INFORMATION 8.1 The developer, St George Central London Limited, applied to the Council under

planning application no. W00198AA/04 to develop the former RAF East Camp Site enclosed between Aerodrome Road and Grahame Park Way NW9.

8.2 The redevelopment of the site is comprised of 2800 residential units(Class C3), approximately 7850sqm of retail (class A1), financial and professional services (Class A2), food and drink (Class A3), Business (Class B1), leisure and community (Class D1 and D2) uses and driving centre (Sui generis) with associated landscaped open space, car parking and access arrangements. The first phase of the development, abutting Grahame Park Way on its north side and Aerodrome Road on its south side, is comprised of 191 residential units and 1696 sqm of non-residential uses pursuant to conditions 1 and 6 of the planning permission ref. no. W00198AA/04.

8.3 The attached copy of the drawing no. 3944/DR/19 rev G, illustrates the limits of the proposed highway works on the public highway. The works include the reconstruction of the footway along the north side of Aerodrome Road using a new paving material, (Steel reinforced pre-cast concrete slabs), together with the replacement of all existing pre-cast concrete kerbs with new granite kerbs, on both sides of Aerodrome Road. The proposed highway works will also include the widening of the existing carriageway at Aerodrome Road/Heritage Avenue junction, by approximately 1.50m (at its widest part), in order to facilitate a safer right hand turn into Heritage Avenue. The construction of the new access at the junction with Heritage Avenue, will also incorporates suitable crossing points for pedestrians, thus enabling full accessibility to all sectors of the community. Reinstatement of any damage occurred on the public highway during the construction of the development, will also be included in the works.

8.4 As part of the proposed improvement works, we have sought funding from the developer for the repositioning and relocation of street lighting columns affected by the works. These street lighting works will be undertaken by our term contractor. The street lighting on Aerodrome Road is earmarked for renewal under PFI and these will be undertaken as part of the wider improvements to Aerodrome Road.

10. CONSULTATION WITH CABINET MEMBER(S) 10.1 The Cabinet Member for Environment and Transport has been consulted and

gave his approval on 28 October 2008. 11. OFFICER’S DECISION I authorise the following action 11.1 That, subject to completion of all necessary legal and other documentation,

the Council enters into an Agreement with the owners of Beaufort Park Development, St George Central London Limited, under section 278 of the Highways Act 1980, allowing the owners of the development to carry out footway and carriageway works on the public highway in Aerodrome Road/Heritage Avenue Junction, under the direct supervision of the Council and in accordance with the attached drawings (or any minor subsequent revision, as deemed fit by the Director of Environment and Transport)
