Board of Nursing February 8, 2017 Page 2 CALL TO ORDER Ms. Tyranski called the meeting to order at 9:01 a.m. The Board introduced themselves to the public. DISPOSITION OF MINUTES Meeting Minutes – January 11, 2017 The Board reviewed the minutes of the January 11, 2017 meeting. Ms. Bastholm moved, seconded by Mr. Brown, to approve the minutes as presented. The motion carried with Mr. Sanders abstaining. ADOPTION OF THE AGENDA Mr. Salati moved, seconded by Ms. Halpern, to accept the agenda as presented. The motion carried unanimously. ACTIVITIES REPORT Dr. Mack reported the number and types of active licenses as of February 5, 2017. RN = 18,589 (RN permits = 7) (GN permits = 1) LPN = 2,788 (LPN permits = 2) (GPN permits = 0) APRN = 1, 639 (APRN permits = 3) Advanced Practice Registered Nurses: NP = 1,045; CRNA = 361; CNS = 189; CNM = 44 Total permits = 13 Total Active Licenses = 23,016 UNFINISHED BUSINESS There was no unfinished business before the Board. COMMITTEE REPORTS APRN Committee Dr. Williams informed the Board that the Committee did not meet on January 23, 2017; the meeting was cancelled due to the weather and lack of a quorum. The next APRN Committee meeting is scheduled for February 20, 2017. The focus of the meeting will be reviewing the FAQs and forms associated with application for independent practice. Practice and Education Committee Ms. Bastholm advised the Board that the Committee met on January 27, 2017 to review the application for establishing a new education program and review of current procedures. The revisions to the general application and Phase I have been completed. The Committee will meet in February to revise Phase II and Phase III. The Committee recommended the appointment of Dr. Ann Krouse to the Practice and Education Committee. Motion unanimously carried.

Board of Nursing February 8, 2017 Page 3 PRESIDENT’S REPORT Ms. Tyranski will be attending NCSBN’s Midyear meeting in March in Salt Lake City, Utah. EXECUTIVE DIRECTOR’S REPORT Dr. Mack advised the Board that she will also be attending the Mid-Year meeting in Salt Lake City, Utah. Board members were provided a copy of the 2016 Annual NCLEX statistics, which will be made available online. Dr. Mack circulated a memorandum from Mr. Mangler regarding the removal of questions pertaining to criminal convictions and pending charges on applications for professions that require a mandatory criminal background check. Dr. Mack informed the Board that Ms. Singh has been connected with the NCSBN for model language for eNLC legislation. Ms. Singh advised the Board that the proposed eNLC bill has been drafted and submitted to the Division. Legislative Update Mr. Mangler advised the Board that the proposed eNLC legislation is at the top of his list for legislative priorities. Dr. Mack will circulate the proposed bill to Board members for review. Ms. Tyranski reported that she spoke with Margaret Rose Henry, who voiced her enthusiasm about potentially sponsoring the eNLC legislation. Mr. Mangler will provide regular updates to the Board regarding the status of the proposed legislation. NEW BUSINESS BEFORE THE BOARD Licensee Applicant Reviews Katrina Moore, RN – Endorsement The Board reviewed the application for Katrina Moore, RN. Ms. Moore graduated from the College of New Rochelle in May 2004. She answered “yes” to question #18, reporting that her Nursing license had been subjected to disciplinary action. Texas provided documentation relating to Ms. Moore’s disciplinary action. Ms. Udealer moved, seconded by Dr. Castaldo, to grant a waiver for licensure by endorsement. Motion unanimously carried. Barbara Kepner, RN – Reinstatement The Board reviewed the application for Barbara Kepner, RN. Ms. Kepner answered “yes” to question #18, reporting that she was convicted of a felony in 1999 and received a pardon for the conviction. She also answered “yes” to #20, noting that she has been in recovery since June 1999. According to the 1999 Consent Agreement, Ms. Kepner’s license was suspended indefinitely, and after a period of not less than three years of complete sobriety Ms. Kepner would be permitted to apply for reinstatement. The Consent Agreement states that upon receipt of Ms. Kepner’s reinstatement application, the Board will “conduct such investigation as deemed necessary and if warranted shall schedule and conduct a hearing upon application where Ms. Kepner may be afforded the opportunity to present evidence sufficient to convince the Board that she has indeed been completely sober for a period of not less than two years and that she is fully capable of practicing nursing with reasonable skill and

Ms. Kepner completed a refresher course within the two years preceding her application for reinstatement. Ms. Nellius moved, seconded by Ms. Lewis, to approve Ms. Kepner’s application contingent upon her consent to undergo an evaluation with the DPHMP, to provide sufficient evidence that she has been sober for a period of not less than two years. If the DPHMP evaluation results in a recommendation of continued substance use treatment and monitoring, Ms. Kepner will be required to comply with those recommendations. Motion unanimously carried. 11-19-16 Consideration of Consent Agreements Joanne Bogardus, RN (Case 11-95-16) The Board considered the Consent Agreement for Joanne Bogardus, RN. Mr. Salati moved, seconded by Mr. Brown to reject the Consent Agreement, as the Board felt that the disciplinary action was too lenient considering the aggregating factors. It was suggested that a 12-18 month period of suspension, enrollment in the DPHMP, and additional CEs be included in the Consent Agreement. Motion unanimously carried. Emma Lancaster, RN (Case 11-64-15) The Board considered the Consent Agreement for Emma Lancaster, RN. Dr. Williams moved, seconded by Dr. Castaldo, to accept the Consent Agreement. Motion carried with Ms. Bastholm recusing. Michael Rodriguez, LPN (Case 11-56-16) The Board considered the Consent Agreement for Michael Rodriguez, LPN. Board of Nursing February 8, 2017 Page 5 Review and Consideration of Hearing Officer Recommendations Jaime Abdullah, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Jaime Abdullah, LPN. Dr. Castaldo moved, seconded by Mr. Salati, to accept the conclusions of law and findings of fact. The recommended discipline was modified to reflect the following: Ms. Abdullah shall be issued a letter of reprimand; the seven continuing education contact hours earned after the renewal period shall be retroactively applied to the 2014-2016 renewal period; and Ms. Abdullah will be audited at the time of the next renewal in 2018. Motion unanimously carried. Hannah Bartley, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Hannah Bartley, LPN. Ms. Darling moved, seconded by Mr. Sanders, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Oran Brown, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Oran Brown, LPN. Mr. Brown moved, seconded by Ms. Halpern, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Claudia Cannon, APRN, RN (Case 11-38-16) The Board considered the recommendations of the Hearing Officer for Claudia Cannon, APRN, RN. Mr. Sanders moved, seconded by Dr. Castaldo, to accept the conclusions of law and findings of fact. The recommended discipline was modified to reflect the following: Ms. Cannon’s APRN and RN nursing licenses shall remain suspended pursuant to the January 25, 2016 Board Order until July 25, 2017. As of July 26, 2017, a second period of suspension will be stayed for probation contingent upon enrollment into DPHMP. If the evaluation results in a recommendation of substance abuse or mental health treatment or monitoring, Ms. Cannon must comply with the recommendations of the DPHMP. If Ms. Cannon fails to enroll by August 25, 2017, Ms. Cannon licenses will revert back to suspension. She must complete 15 continuing education contact hours, six in the area of nursing ethics or professional accountability/legal liability, six in the area of substance abuse, and three in the area of professional boundaries. Ms. Cannon’s prescriptive authority shall be suspended for a period of three years and she must petition the Board in order to have the prescriptive authority suspension lifted. Motion unanimously carried. Praveen Gill, RN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Praveen Gill, RN. Ms. Darling moved, seconded by Ms. Halpern, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Gina Guinan, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Gina Guinan, LPN. Mr. Salati moved, seconded by Ms. Darling, to accept the conclusions of law, findings of fact, and the recommended discipline. Ms. Guinan’s license will be suspended until the Board office receives documentary evidence that she has completed 24 continuing education contact hours, including three

Nancy Lohrfinck, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Nancy Lohrfinck, LPN. Mr. Brown moved, seconded by Ms. Lewis, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Lori Rawlins, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Lori Rawlins, LPN. Mr. Salati moved, seconded by Dr. Williams, to accept the conclusions of law and findings of fact. The recommended discipline was modified to reflect the following: Ms. Rawlins shall be issued a letter of reprimand; the 27.75 continuing education contact hours earned after the renewal period shall be retroactively applied to the 2014-2016 renewal period; and Ms. Rawlins will be audited at the time of the next renewal in 2018. Review and Consideration of Hearing Officer Recommendations Marian Koroma, RN (Case 11-74-15) This item was continued until the March 8, 2017 meeting. Natasha Rodriguez, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Natasha Rodriguez, LPN. Mr. Brown moved, seconded by Ms. Lewis, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Shira Sheppard, LPN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Shira Sheppard, LPN. The Board reviewed the letters of recommendation that were submitted on Ms. Sheppard’s behalf. Dr. Williams moved, seconded by Ms. Halpern, to accept the conclusions of law and findings of fact. The recommended discipline was modified to reflect the following: Ms. Sheppard shall be issued a letter of reprimand; and the twenty-one continuing education contact hours earned after the renewal period shall be retroactively applied to the 2014-2016 renewal period. Ms. Sheppard must complete three CEs in the

The Board considered the recommendations of the Hearing Officer for Mara Tolliver, RN. Dr. Williams moved, seconded by Mr. Salati, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Deborah Smith, RN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Deborah Smith, RN. Ms. Halpern moved, seconded by Ms. Darling, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Emilie Smith, RN (Case 11-70-16) The Board considered the recommendations of the Hearing Officer for Emilie Smith, RN. Ms. Darling moved, seconded by Ms. Udealer, to accept the conclusions of law and findings of fact. The recommended discipline was modified to reflect the following: Ms. Smith’s license shall be suspended indefinitely and shall not be lifted until she petitions the Board. The Board reserves the jurisdiction in connection with any further hearing, to determine whether any additional conditions or restrictions on Ms. Smith’s license are necessary to protect the public. Motion unanimously carried. Zachary Vogl, RN (Rule to Show Cause) The Board considered the recommendations of the Hearing Officer for Zachary Vogl, RN. Mr. Brown moved, seconded by Mr. Sanders, to accept the conclusions of law, findings of fact, and the recommended discipline. Motion unanimously carried. Review of Compliance Joycelyn Kelly, RN (Non-Compliant) Dr. Mack advised the Board that Ms. Kelly failed to maintain compliance with the March 9, 2016 Order. She reported to the Board that Ms. Kelly was substantially non-compliant with the DPHMP. Ms. Kelly’s license was suspended on January 20, 2017, due to non-compliance. Sandra Patterson, APRN, RN (Compliant) Dr. Mack advised the Board that Ms. Patterson satisfactorily complied with the November 4, 2016 Order. She advised the Board that the status of Ms. Patterson’s license was changed from probation to active. Paula Thompson, LPN (Compliant) Dr. Mack advised the Board that Ms. Thompson satisfactorily complied with the January 25, 2017 Order. She advised the Board that the status of Ms. Thompson’s license was changed from suspension to active.

The cases have been referred to the Investigative Unit. Practice Issues There were no practice issues. Educational Issues Three-Year CE Provider Renewal – DE Association for Home and Community Care Dr. Mack reported Delaware Association for Home and Community Care submitted their CE provider renewal application. Dr. Mack has reviewed the documentation and recommends that their CE provider status be renewed. Ms. Udealer moved, seconded by Mr. Salati, to renew the Delaware Association for Home and Community Care as a CE provider. Motion unanimously carried. 2016 Satisfactory Annual CE Reports Ms. Lane moved, seconded by Mr. Brown, to approve the 2016 Annual CE Reports for the CE providers noted below. Board of Nursing February 8, 2017 Page 9 OTHER BUSINESS Mr. Mangler advised the Board of new regulations for the safe prescribing of opiates, which will affect individuals who hold controlled substance regulations to prescribe in the State of Delaware. The regulations were published in the January 1, 2017 issue of the Register of Regulations, and will take effect on April 1, 2017. The regulations will set new requirements on prescribing opiates for acute episodes as well as for chronic, long-term pain management. Additional information regarding the new regulations is available on the Controlled Substances website. Review of Compliance Dr. Mack advised the Board that there are currently 48 licensees enrolled in the DPHMP and five nurses are in the process of enrolling. Licensure Issues There were no licensure issues. LICENSEE APPROVAL Ms. Halpern moved, seconded by Ms. Udealer, to ratify the licensee list (attached). Motion unanimously carried. NEXT MEETING The Board’s next meeting is scheduled for March 8, 2017, at 9:00 a.m., in Conference Room A, of the Cannon Bldg., 861 Silver Lake Blvd., Dover, Delaware. PUBLIC COMMENT There was no public comment. The Board observed a brief recess from 12:06 p.m. until 12:18 p.m. EXECUTIVE SESSION (CLOSED TO THE PUBLIC) Discussion of Ongoing Litigation with Leads School of Technology, dba Adoni At 12:06 p.m., Ms. Nellius moved, seconded by Ms. Darling, to enter into executive session to discuss the ongoing litigation with Leads School of Technology, dba Adoni. At 12:37 p.m., executive session adjourned. Ms. Udealer moved, seconded by Ms. Nellius, to continue with the withdrawal of Lead’s approval. Motion unanimously carried. Leads will be sent correspondence notifying them of the Board’s decision, and will have an opportunity to request a hearing before the Board. ADJOURNMENT The meeting adjourned at 12:37 p.m.

TIME STARTED: 11:00 a.m.

At 11:00 a.m., Ms. Tyranski called Sara White’s petition to lift suspension hearing to order. The Board introduced themselves for the record. Verbatim testimony was electronically recorded. Ms. White was present and verified she waived her right to be represented by counsel. Ms. Singh stated the purpose of the hearing. The following was marked as Board Exhibit 1: a copy of the June 12, 2015 Board Order, a copy of the letter notifying Ms. White of the hearing to consider her petition to lift suspension, and a copy of Ms. White’s petition to lift suspension, which included her written notice of waiving her rights of a 20-day notice to a hearing. The following documents were marked as Licensee Exhibit 1: certificate of completion from Thresholds and CE certificates. Ms. White was sworn in, presented her case, and responded to questions asked by Board members. Ms. White’s mother, Betsy Carmine, was sworn in and testified on Ms. White’s behalf. The Board entered into deliberations at 11:19 a.m., and concluded at 11:22 a.m. Ms. Halpern moved, seconded by Ms. Darling, to lift Ms. White’s suspension, and place her license on probation for three years, contingent upon her enrollment of the DPHMP. Motion unanimously carried. The hearing concluded at 11:24 a.m.
