In most cases, the hardest part of
a DWI case is fighting the De-
partment of Revenue’s adminis-
trative suspension, revocation, or
disqualification of your client’s
driving privileges.
Except in rare circumstances,
simply submitting the case “on
the record” at the administrative
hearing is a big mistake and a
disservice to your client, especial-
ly when the client’s job requires a
valid driver’s license.

In Reece v. Dir. of
Revenue, the Eastern
District agreed with
Carl M. Ward and
found for his client...
As Mr. Ward points out, and this Court agrees,
“this case demonstrates the difficulties that can arise when the case is
submitted on the records and the evidence
conflicts. Caution should be exercised when a suspension case is
submitted on the records alone [as it] may pose some risks - including
the inability to explain discrepancies or to
rehabilitate witnesses.”
