Conditional Use Permit Evidence

1. The proposal Is in compliance with the Comprehensive Plan.The property falls within the General Commercial Zone outlined by the City of Lincoln City.Under Code 17.32040 Conditional uses permitted, Emergency shelter is listed. Adjacent to theproperty are multiple social service agencies that all help to aim our most vulnerable communitymembers. Adding another social service agency to the area will not only increase access to moreservices, it will alleviate transportation needs for people seeking those services.

2. The site for the proposed use Is adequate in size and shape to accommodate said use and allyards, spaces, walls and fences, parking, loading, landscaping and other features required bythe zoning Ordinance.The building in total square footage is 6,600 square feet and we are proposing to use up to 946square feet for overnight accommodation ONLY during the warming shelter season which Is 14%of the building’s total square footage. The hours for the warming shelter are also 6pm to 8amwhich is after the day time operations close for the day and before the day time operationsopen for the day. Parking will remain adequate and the two operations will never overlap eachother.

This building has been used in previous years for various operations and the existingstreets are capable of accommodating our traffic.

The proposed use wIll have minimal adverse impact upon adjoining properties and theimprovements Theron..me adjacent tax lots to the east (Gmmllch & Solomon) and the south (DMV, Lincoln CountyPublic, Community & Mental Health, adult & Family Services) are both zoned GeneralCommercial just like the subject site and are both developed and in use as commercial sites. Theadjacent tax lot to the north (apartment complex) is zoned Residential, Multi-Family and isseparated by a vegetated hill that goes down approximately 10-20 feet.

• Farther east of the commercially zoned lot Is zoned Residential Single Family BUT Itsdeveloped as a golf course, and the portion immediately adjacent to that commercial lot isheavily vegetated. Additionally, commercial lot has approximately 70-foot-wide landscapedbuffer strip along Its east boundary which provides distance and screening to the golf course.Last, there are only 5 house lots in this golf course area and they are no more than 400 feet tothe east of the commercial lot’s east boundary line and are separated from the subject site bythe commercial lot’s landscape buffer and the heavily-vegetated portion of the golf course.

• The adjoining property to the west is NE Devils Lake Boulevard and farther west of that 15 along strip of General Commercial sites fronting Highway 101. North and west of NE Devils LakeBoulevard isa developed single-family subdivision, but it is separated from the site by NE DevilsLake Boulevard.

• Because the site is immediately adjacent to streets and two commercial lots 3 out of the 4sides of the site, and because traffic is limited for this particular use, there will be no adverseimpact to NE Devils Lake Boulevard, Highway 101, or the golf course. Because the adjacent eastand south properties are already developed and actively in use as commercial uses duringregular business hours, and because the uses proposed on the site during regular business hoursare similar to existing commercial uses, the proposal will not impact the east and south lotsduring regular business hours. During off business hours when the site will be used as anemergency shelter, the businesses on the east and south lots will be closed and thus will not feelany impacts from the occupants of the shelter. Security issues will be handled by videosurveillance inside and outside the building and a Security guard walking the perimeter of thebuilding during the hours that the warming shelter is open. Overnight, the volunteers will ensuresafety inside the building and we will continue our strong partnership with law enforcement byasking for more patrol in the neighborhood and call If a guest becomes uncontrollable.

Lincoln City Resource Center & Emergency Warming Shelter has merged with CHANCE Recoveryis relocating to 4488 NE Devils Lk Blvd, Lincoln City, Oregon. The entire square footage of thebuilding is 6,600 square feet We are proposing to use up to 946 square feet on the groundfloor for warming shelter use at night during the winter months when the night time lowtemperature reaches below 40 degrees. Day-time Operations;

Monday through Friday 9am to 5pm, the building will function as a Reipeer delivered services to individuals in crisis due to addiction, mental illas well as bask necessities such as shower, clothing, shoes, hot meal, internet access, resumebuilding and Navigation) Referral services to individuals seeking more wrap around services fortheir situation.

In addition to the services listed above, we are also in the process of coordinating with otherpartner agencies such as parole & probation to lease office space within our building in order toprovide agencies that do not currently have office space in North County a place to meet withtheir dients whom live in North County. We also have plans of coordinating with Supportgroups such as NA and AA to provide meeting scace so more support groups can be offered topeople who desperately need them In North County.

This location is also adjacent to several of our partner agencies who also provide social servicessuch as lincoln county Public Health, lincoln County Community Health, lincoln County MentalHealth, Adult and Family Services and the VA clinic on Fridays. Being right across the parking lotallows us to help create the “one-stop-shop” business model of wrap around social services inour community.

Wrap around Services: is a philosophy of care with defined planning processes used to buildconstructive relationships and support networks. It is community based, culturally relevant,individualized, strength based and family centered.

Night-time Operations:

The Warming Shelter season is from December l’ through February 28th and only opens whenthe night time temperature is projected to be below 40 degrees or gusts / sustained winds of50mph or higher. When the warming shelter is open, the hours are from 6pm to Sam which is14 hours open. If open, a hot dinner, pillow, blanket, cot, hot breakfast and dry scrubs (ifsomeone is wet) is provided to each homeless Individual at no cost to them. It takesapproximately 8-12 volunteers to operate the warming shelter for a full open night. Formultiple safety reasons, we have two overnight volunteers who stay awake the whole night.

The doors are locked at 10pm after which potential shelter guests cannot come in without apolice escort. Between the hours of 10pm and 6am, If shelter guests choose to leave, theycannot come back in until the following morning when the doors open at 6am and theovernight volunteers will notify the police that someone chose to leave.

Emergency Warming Shelter

Mitigation Plan

Chance Lincoln City turned in a conditional use permit application to operate a severe weathershelter from 4488 NE Devils Lake Blvd1 Lincoln City, Oregon from December V 2019 throughFebruary 2gth, 2020.

The shelter opens only on nights when temperatures are forecast to drop below 40 degrees. Inresponse to anticipated neighborhood concerns about the impact of homelessness, both thatuse our services and those who do not, we request increased patrol in the neighborhood onnights that the warming shelter is open.

We invite all members of the public to let us know about issues that are not addressed withinthis document as well as potential solutions. • SAFETY CONCERNS

WHAT WE DO: The daytime resource center strives to be a safe place for our guests as wellas our volunteers, many of whom are senior citizens. Guests are always under closesupervision (with staff even tracking and timing their bathroom visits). Safety is the priorityin everything we do.

While some of our guests are unkempt and can seem intimidating on first appearance, it isimportant to bear in mind that homeless people are much more likely to be the victims ofcrime than the perpetrators.

While we are confident of the measures in place to ensure safety within our building, weknow about the concern regarding individuals who are turned away from our doors. On therare occasion that we refuse entry to the resource center or overnight shelter; or whenevera guest leaves the overnight shelter partway through the night (guests do not have in-out

WHAT’S NEW:

Cameras: We have put in place a camera system that does live feed on the inside of thebuilding as well as on the outside of the building. There is a monitor at the front desk thatshows all cameras allowing access to security at anytime. This gives us the ability to addressany inappropriate behavior or rules being broken immediately.

Parole and Probation: We have formed a partnership with Lincoln County Parole andProbation to lease office space inside of our building. This gives us a law enforcementpresence inside the building.

Wandering through neighborhoods

WHAT WE KNOW: While wandering on public rights of way is a constitutionally protectedactivity, wandering on private property is a criminal act and should be reported to thepolice. Many of the trespassing complaints we have been made aware of relate to peopleraking through trash apparently searching for cans and battles to trade in for cash.

WHAT WE DO: If a formal police report has been made about one ofon private property, guests will be given one warning, and a seoffense.

• Urinating in Public

WHAT WE DO: Our daytime resource center and overnight sheItetjaa’eppie with littleexcuse for public urination or defecation at times when our facility is open. However, withthe city restroom facilities closed at sunset and our resource center closing at 5pm, somepeople have no access to restroom facilities at evenings and at nighttime.

WHAT’S NEW: Chinook Winds Casino is located 0.9 miles away and is open 24 hours a dayand 7 days a week providing a bathroom to those who may need it throughout the night.

• Increased number of people sleeping rough in 4488 NE Devils Lake Blvd neighborhood

WHAT WE DO: Our core mission is to reduce the amount of rough sleeping by offeringshelter on nights when temperatures are forecast to drop below 40 degrees. This does begthe question of where our clients sleep on nights when we are not open. A long term optionwould be to open every night through the year. This would require more paid staff andpermission to open every night. As such, it is not an option for this year at this point. Themost effective long-term solution is helping people out of homelessness through efforts like

our Resource Referral or Peer Delivered Services Programs, which found accommodationfor 49 out of 60 enrollees in its first year of operation.

• ALCOHOL

WHAT WE DO: Both daytime resource center and the overnight severe-weather shelterhave a zero-tolerance policy for alcohol use on the premises. The overnight shelter does notrequire guests to be sober in order to receive shelter, as people who are drunk are atgreater risk of hypothermia on cold nights. However, the shelter does not permit alcoholuse on the premises and requires that all guests refrain from disruptive behavior. ResourceCenter and overnight shelter users must submit to search every time they enter thepremises. Anyone found trying to sneak alcohol into the resource center or the overnightshelter receives a 7-day ban for the first offense and a season-long ban for the secondoffense.

• DRUG ACTIVITY

WHAT WE DO: Both the daytime resource center and the overnight severe-weather shelterhave a zero-tolerance policy for drug use on the premises. Guests at the resource centerand the overnight shelter must submit to searches every time they enter the premjjes. WHAT WE DO: Staff and volunteers keep a close eyj_on te Thelter prnmkn6 Is ... sureany trash issues are promptly dealt with. All shefter guests will be required to sign up for ajob in return for their night’s accommodation. One of these jobs will be neighborhood trashpickup.

• THEFT & MALICIOUS BEHAVIOR

WHAT WE DO: Our Manager checks the Lincoln County Jail roster daily, keeping an eye outfor any shelter clients who are booked for property theft or other antisocial criminalbehavior. We also have an arrangement with Lincoln City Police Department to fax a copy ofthe police log daily. Clients found to be engaging in criminal behavior will be denied serviceat the daytime resource center and overnight shelter.

• PANHANDLING

WHAT WE KNOW: Panhandling is not an activity that is confined solely to the homeless.Nevertheless, this activity is undesirable and efforts to reduce and eliminate it are to bewelcomed. The best way to eliminate panhandling is for people to stop giving money topanhandlers. If the activity ceases to be profitable, panhandlers will move elsewhere. Thecity has already passed an ordinance making it illegal for motorists to pass items from theircar to panhandlers while stopped at an intersection.

WHAT’S NEW: Our group has a suggestion to install signs at local intersections withaddresses and information of local charities who serve the homeless populationencouraging Good Samaritans to support local homeless charities rather than giving moneyto panhandlers.
