It is common practice for many gemstones to be treated by a variety of methods to enhance their appearance and theinternational jewellery trade has generally accepted these methods. Although heat enhancement of colour is usuallypermanent, in some cases this could affect the durability of a gemstone. Oiled gemstones may need re-oiling after acertain period. If no gemmological report is published in the catalogue, prospective buyers should assume that thegemstones or pearls may have been enhanced by some method. Buyers should be aware that Matthew Barton Ltd’ssaleroom estimates assume that gemstones or pearls may have been subjected to such treatments.

Estimates are published as a guide only and are subject to review. The actual hammer price of a lot may well behigher or lower than the range of figures given and there are no fixed “starting prices”.

A Buyer’s premium of 20% is applicable to all lots in this sale. The Buyer’s Premium is subject to VAT at the standardrate (currently 20%). Unless otherwise indicated lots are offered for sale under the auctioneer's margin scheme andVAT on the Buyer’s Premium is payable by all buyers.

Lots marked with the symbol ‡ have been imported from outside the European Union (EU) to be sold at auctionunder Temporary Import Rules. When released to buyers within the EU, including the UK, the buyer will become theimporter and must pay VAT at the rate of 5% on the hammer price and 20% on the Buyer’s premium. Buyers outsidethe EU will normally be eligible to obtain a refund in respect of temporary import VAT, upon satisfactorydocumentary evidence of exportation. Further information on this matter is available on request.

Matthew Barton Ltd will be pleased to execute bids on behalf of those clients unable to attend the sale in person,subject to our Conditions of Business. The arms are those of Barton of Ireland together with the motto“Fide et Fortitudine”. Thomas Barton of Glendalough House,County Wicklow, settled in Bordeaux around 1725, and establishedhimself there as a wine shipper and merchant. The firm waspassed on from Thomas Barton to his grandson Hugh. Togetherwith his partner Daniel Guestier he founded one of the region’sbest known and long-lived merchant businesses, Barton &Guestier, a name still in existence today. Hugh fled back to Irelandduring the reign of terror and in his absence, the estate wasmanaged by Guestier. He bought the estate of Straffan in CountyKildare which remained in the family until after the Second WorldWar. The estates of Chateau Leoville-Barton and Chateau LangoaBarton are still run by the Barton family.

The engraver Johann Heinrich Giese was granted solemanufacturing rights of such stamped brass panels by Frederickthe Great in 1755 (later granted to a number of othermanufacturers). Iserlohn tobacco boxes were manufactured bothfor the local market (often decorated with celebrations of militaryvictories) as well as for the large Dutch market.

Christened ‘Le Café de l’Europe’ by the Holy Roman Emperor Joseph II after avisit in 1781, the summer season in the small Ardennes town of Spa throngedwith Kings, Princes, nobles and all who could afford it from across theContinent. The main source was named after Peter the Great, who visited in1721, and Europe’s first casino opened in 1761; the second casino andassembly halls of 1770 was named ‘Le Waux-Hall’ after London’s famouspleasure grounds. Naturally a trade in luxury goods, souvenirs and ‘les jolités’flourished, including the speciality ‘Bois de Spa’ (or sometimes ‘Boites deSpa’), lacquered boxes often painted with views of the town and surroundings.

Antoine Le Loup, a native of Spa and known for finely detailed monochromeviews, often on parchment mounted onto boxes, was the son of Remacle LeLoup, another landscape artist. His work also apparently featured on a Meissendinner service, to be found towards the end of the 18th century for sale at ashop in Spa under the sign of ‘Le Cavalier’(http://membres.multimania.fr/histoirespadoise/ceramiquespadois.html).

His neighbour, a priest, recorded that he was still at work painting when hedied alone at eight in the evening, isolated from friends and family, on 21stNovember 1802 (http://www.spahistoire.info/bredar.html, accessed 12.10.11).

The Polish-born sculptor Michal Golabek was born in Poznan in 1949.Between 1970 and 1975 he studied at the Poznan Academy of Fine Arts wherehe received his diploma in Professor Olgrierd Truszynski’s atelier of sculpture.He has exhibited extensively and his artistry has been acknowledged by anumber of awards, including the Gold Medal, 5th Winter Salon in Warsaw(1989) and the Bronze Medal, The Survey of Polish Sculpture of the Decade(1989). Among Golabek’s larger work is an imposing figure entitled ‘Jesus’and an abstract wood and bronze piece entitled ‘Windy everlasting.’ He nowlives and works in Chicago.

The edition of 650 chess sets was produced as the sole accreditedInternational Chess Federation commemorative set of the famousSpassky-Fischer World Championship Match held in Iceland in theJuly and August of 1972. Dubbed as the Match of the Century,Fisher’s win ended the twenty-four-year Soviet domination of thechampionship.

The film director and polymath, Cy Endfield (1914-95), designedand produced the chess set: according to The Times (whomarketed 200 of the sets) it was whilst on location making Zulu(1964) and frustrated by the travelling chess set he was using, that Endfield was inspired by the notion of pieces which wouldinterlock to form a cylinder.

The important firm of table silver manufacturers, Francis Higginsand Sons, had roots going back to 1782. Francis Higgins Junior,the director from 1880, was apparently punctilious about detail:‘Higgins is said to have carried a hammer about with him in theworkshop with which he would destroy any work not up to hisstandards. His principal was that if you are going to make a spoonyou are going to make a spoon strong and solid, adding somesuch comments as, “it should last more than a lifetime, boy”‘ (SeeJ. Thelatter, a tea equipage or tea machine, is from a catalogue of about1808, in the possession of Thomas Bradbury & Sons (then known asWatson & Bradbury), a firm well known in the trade at that time fortheir large export business to Europe and America.

The crest and coronet is that of Molyneux, Earls of Sefton, presumably forWilliam Philip Molyneux, 4th Earl of Sefton, who was born at Croxteth Hall,Lancashire, on 14 October 1835. Educated at Eton between 1848 and 1853, hejoined the Grenadier Guards in 1854 and served in the Crimea. He retired fromthe army in 1858 after which he became Lord Lieutenant of Lancashire, a posthe held until his death. He succeeded to the title upon the death of his fatherin 1855 and was married on 18 July 1866 at St. George’s, Hanover Square, toCecily Emily (1838-1899), 5th daughter of William, 1st Baron Hylton. He died atSefton House, Belgrave Square, on 27 July 1897 following a long illness.

The inscription reads: In Grateful remembrance of Dr Gully’s great kindness from D.P.

The inscription refers to Dr James Manby Gully (1808-1883), famous for his hydrotherapy cures.Together with his partner James Watson, he founded a clinic in Malvern, which treated many arenowned Victorian, including Tennyson, Darwin, Dickens and Florence Nightingale. Thetreatment started at five in the morning, when dressed in a wet sheet, the patient was doused inbuckets of cold water, followed by walks, plenty of water from the wells, a couple of dry biscuits,a variety of treatments in various baths and a dinner consisting always of either boiled mutton orfish, followed by a few hours in a dry bed; apparently the Spartan regime was beneficial to most.Dr Gully is also more infamously remembered for his involvement with Florence Ricardo. Theirextramarital affair was apparently over when she married the lawyer Charles Bravo in 1875.Several months later Charles Bravo was poisoned by antimony. Dr Gully testified at the inquest,but in spite of huge public interest, the case went unsolved and the murder remains an intriguingmystery to this day.

Joseph Cushelson, a working waterproofer in the Manchesterfabric industry, was born about 1886 in the Cheetham district ofManchester, Lancashire, one of the children of Cushel Cushelson(d. 1925), a commercial traveller, and his wife, Fanny (d. 1936),both of whom were natives of Russia.

He volunteered for service in April 1915 and two months laterwas drafted to the Western Front where he took part in the Battlesof the Somme and Arras. The 1901 Census records them living at 48Elizabeth Street, Cheetham, Manchester, together with their sons,Lay (21), Barnet (19) and Hyman (15) and daughters, Annie (13)and Lily (11). Mrs Weinberg died in 1906. Jacob Weinberg, who re-married in 1910, was the founder of J. Weinberg & Son, well-knownmanufacturers of waterproof garments, which, following his deathin 1925, was continued by his son, Hyman (Henry). provided by the Seller and MBL is unable to exercise exhaustivedue diligence on each lot. Each lot is available for examinationbefore sale. Bidders are responsible for carrying outexaminations and research before sale to satisfy themselvesover the condition of lots and accuracy of descriptions.

(b) All oral and/or written information provided to Bidders relatingto lots, including descriptions in the catalogue, conditionreports or elsewhere are statements of MBL’s opinion and notrepresentations of fact. Estimates may not be relied on as aprediction of the selling price or value of the lot and may berevised from time to time at MBL’s absolute discretion.

4. Exclusions and limitations of liability to Buyers (a) MBL shall refund the Purchase Price to the Buyer in

circumstances where it deems that the lot is a counterfeit,subject to the terms of MBL’s Authenticity Guarantee.

(b) Subject to Condition 4(a), neither MBL nor the Seller:- (i) is liable for any errors or omissions in any oral or written

information provided to Bidders by MBL, whether negligentor otherwise;

(ii) gives any guarantee or warranty to Bidders and any impliedwarranties and conditions are excluded (save in so far assuch obligations can not be excluded by English law), otherthan the express warranties given by the Seller to the Buyer(for which the Seller is solely responsible) under theConditions of Business for Sellers;

(iii) accepts responsibility to Bidders for acts or omissions(whether negligent or otherwise) by MBL in connectionwith the conduct of auctions or for any matter relating tothe sale of any lot.

(c) Without prejudice to Condition 4(b), any claim against MBLand/or the Seller by a Bidder is limited to the Purchase Price forthe relevant lot. Neither MBL nor the Seller shall be liable forany indirect or consequential losses.

(d) Nothing in Condition 4 shall exclude or limit the liability ofMBL or the Seller for death or personal injury caused by thenegligent acts or omissions of MBL or the Seller.

5. Bidding at Auction (a) MBL has absolute discretion to refuse admission to the auction.

Before sale, Bidders must complete a Registration Form andsupply such information and references as MBL requires.Bidders are personally liable for their bid and are jointly andseverally liable with their principal, if bidding as agent (in whichcase MBL’s prior and express consent must be obtained).

(b) MBL advises Bidders to attend the auction, but MBL willendeavour to execute absentee written bids provided thatthey are, in MBL’s opinion, received in sufficient time and inlegible form.

(c) When available, written and telephone bidding is offered as afree service at the Bidder’s risk and subject to MBL’s othercommitments; MBL is therefore not liable for failure to executesuch bids. Telephone bidding may be recorded.

6. Import, Export and Copyright Restrictions MBL and the Seller make no representations or warranties as to

whether any lot is subject to import, export or copyright restrictions.It is the Buyer’s sole responsibility to obtain any copyright clearanceor any necessary import, export or other licence required by law,including licenses required under the Convention on theInternational Trade in Endangered Species (CITES).

7. Conduct of the Auction (a) The auctioneer has discretion to refuse bids, withdraw or re-

offer lots for sale (including after the fall of the hammer) if (s)hebelieves that there may be an error or dispute, and may alsotake such other action as (s)he reasonably deems necessary.

(b) The auctioneer will commence and advance the bidding insuch increments as (s)he considers appropriate and is entitledto place bids on the Seller’s behalf up to the Reserve Price forthe lot, where applicable.

(c) Subject to Condition 7(a), the contract between the Buyer andthe Seller is concluded on the striking of the auctioneer’shammer.

(d) Any post-auction sale of lots shall incorporate theseConditions of Business.

8. Payment and Collection (a) Unless otherwise agreed in advance, payment of the Purchase

Price is due in pounds sterling immediately after the auction(the “Payment Date”).

(b) Title in a lot will not pass to the Buyer until MBL has receivedthe Purchase Price in cleared funds. MBL will generally notrelease a lot to a Buyer before payment. Earlier release shallnot affect passing of title or the Buyer’s obligation to pay thePurchase Price, as above.

(c) The refusal of any licence or permit required by law, asoutlined in Condition 6, shall not affect the Buyer’s obligationto pay for the lot, as per Condition 8(a).

(d) The buyer must arrange collection of lots within 10 workingdays of the auction. Purchased lots are at the Buyers risk fromthe earlier of (i) collection or (ii) 10 working days after theauction. Until risk passes, MBL will compensate the Buyer for any loss or damage to the lot up to a maximum of thePurchase Price actually paid by the Buyer. MBL’s assumption ofrisk is subjected to the exclusions detailed in Condition 5(d) ofthe Conditions of Business Sellers

(e) All packing and handling of lots is at the Buyer’s risk. MBL will not be liable for any acts or omissions of third partypackers or shippers.

9. Remedies for non-payment Without prejudice to any rights that the Seller may have, if the

Buyer without prior agreement fails to make payment for the lotwithin 5 working days of the auction, MBL may in its solediscretion exercise 1 or more of the following remedies:-

(a) store the lot at its premises or elsewhere at the Buyer’s solerisk and expense;

(b) Cancel the sale of the lot; (c) Set off any amounts owed to the Buyer by MBL against any

amounts owed to MBL by the Buyer for the lot; (d) Reject future bids from the Buyer; (e) Charge interest at 4% per annum above HSBC Bank Plc base

Rate from the Payment Date to the date that the Purchase Priceis received in cleared funds;

(f) Re-sell the lot by auction or privately, with estimates andreserves at MBL’s discretion, in which case the Buyer will beliable for any shortfall between the original Purchase Price andthe amount achieved on re-sale, including all costs incurred insuch re-sale;

(g) Exercise a lien over any Buyer’s Property in MBL’s possession,applying the sale proceeds to any amounts owed by the Buyerto MBL. MBL shall give the Buyer 14 days written notice beforeexercising such lien;

(h) Commence legal proceedings to recover the Purchase Price forthe lot, plus interest and legal costs;

(i) Disclose the Buyer’s details to the Seller to enable the Seller tocommence legal proceedings.

10. Failure to collect purchases (a) If the Buyer pays the Purchase Price but does not collect the lot

within 20 working days of the auction, the lot will be stored atthe buyer’s expense and risk at MBL’s premises or inindependent storage.

(b) If a lot is paid for but uncollected within 6 months of theauction, following 60 days written notice to the buyer, MBL willre-sell the lot by auction or privately, with estimates andreserves at MBL’s discretion. The sale proceeds, less all MBL’scosts, will be forfeited unless collected by the Buyer within 2years of the original auction.

11. Data Protection (a) MBL will use information supplied by bidders or otherwise

obtained lawfully by MBL for the provision of auction relatedservices, client administration, marketing and as otherwiserequired by law.

(b) By agreeing to these Conditions of Business, the Bidder agreesto the processing of their personal information and to thedisclosure of such information to third parties worldwide forthe purpose outlined in Condition 11(a) and to Sellers as perCondition 9(i)

12. Miscellaneous (a) All images of lots, catalogue descriptions and all other

materials produced by MBL are the copyright of MBL. (b) These Conditions of Business are not assignable by any Buyer

without MBL’s prior consent, but are binding on Bidders’successors, assignees and representatives.

(c) The materials listed in Condition 1(a) set out the entireagreement between the parties.

(d) If any part of these Conditions of Business be heldunenforceable, the remaining parts shall remain in full forceand effect.

(e) These Conditions of Business shall be interpreted inaccordance with English Law, under the exclusive jurisdictionof the English Courts, in favour of MBL.

Matthew Barton Ltd’s Authenticity Guarantee

If Matthew Barton Ltd sells an item of Property which is latershown to be a “counterfeit”, subject to the terms below MatthewBarton Ltd. will rescind the sale and return the Buyer the totalamount paid by the Buyer to Matthew Barton Ltd. for thatProperty, up to a maximum of the Purchase Price.

The guarantee lasts for one (1) year after the date of the relevantauction, is for the benefit of the Buyer only and is nontransferable.

“Counterfeit” means an item of Property that in Matthew Barton Ltd’sreasonable opinion is an imitation created with the intent to deceiveover the authorship, origin, date, age, period, culture or source, wherethe correct description of such matters is not included in the cataloguedescription for the Property.

Property shall not be considered Counterfeit solely because of anydamage and/or restoration and/or modification work (including, butnot limited to, recolouring, tooling or repatinating).

Please note that this guarantee does not apply if either:- (i) the catalogue description was in accordance with the generally

accepted opinions of scholars and experts at the date of thesale, or the catalogue description indicated that there was aconflict of such opinions;

(i) the only method of establishing at the date of the sale that theitem was a Counterfeit would have been by means of processesnot then generally available or accepted, unreasonablyexpensive or impractical; or likely to have caused damage to orloss in value to the Property (in Matthew Barton Ltd’sreasonable opinion); or

(i) there has been no material loss in value of the Property from itsvalue had it accorded with its catalogue description.

To claim under this guarantee the Buyer must:- (i) notify Matthew Barton Ltd in writing within one (1) month of

receiving any information that causes the Buyer to question theauthenticity or attribution of the Property, specifying the lotnumber, date of the auction at which it was purchased and thereasons why it is believed to be Counterfeit; and

(i) return the Property to Matthew Barton Ltd in the samecondition as at the date of sale and be able to transfer good titlein the Property, free from any third party claims arising after thedate of the sale.

Matthew Barton Ltd has discretion to waive any of the aboverequirements. Matthew Barton Ltd may require the Buyer to obtain atthe Buyer's cost the reports of two independent and recognisedexperts in the relevant field and acceptable to Matthew Barton LtdMatthew Barton Ltd shall not be bound by any reports produced bythe Buyer, and reserves the right to seek additional expert advice at itsown expense. In the event Matthew Barton Ltd decides to rescind thesale under this Guarantee, it may refund to the Buyer the reasonablecosts of up to two mutually approved independent expert reports,provided always that the costs of such reports have been approved inadvance and in writing by Matthew Barton Ltd.
