"At the Association Attorneys' Seminar in Chicago, NAR General Counsel, Laurie Janik, ad-vised that in a short sale, the seller's lender should be apprised of any additional offers or perti-nent information regarding the property even after short sale approval, regardless of the provi-sions in the binding contract or the short sale addendum. Because of the position that the FBI is taking on "flops", NAR believes that the failure to notify the seller's lender that a higher offer has been received at any time until the closing is consummated could be considered bank fraud and actionable against the seller and the seller's agents and representatives. As such, even if the listing contract or the short sale addendum provide that no additional offers are to be pre-sented, that no further marketing will take place or that back up offers will not be accepted af-ter a binding contract and/or lender's short sale approval, should any offer be received (especially a higher one than the approved contract), it must be disclosed to the lender right up to the time of closing. Furthermore, if personal property is being sold by a separate contract in a short sale transaction, that contract and the terms must be disclosed to the seller's lender. The rule of thumb is that everything must be disclosed to the seller's lender in a short sale to avoid any hint of fraud against the lender approving the short sale. Freddie Mac Amends Short Sale Affidavit At NAR’s request, the affidavit that Freddie Mac requires servicers to ob-tain to help curb fraud in short sale transactions has been changed to re-duce practitioners’ unreasonable exposure to liability. NAR members had expressed concern that the original language left them open to liability for statements made by parties to the transaction over which they had no con-trol. Well Ladies and Gents it is hard to believe another year will soon be gone and a new one will start. I have noticed that you have all been paying attention, and behaving yourself out in the market place. I have heard from your local Association’s Executives and their complaint depart-ment has slowed down tremendously over the past year. That means you are listening and have learned what not to say or do that will or could get you into hot water. That is great news! I have enjoyed hearing from each and every one of you and I am confident that you will keep up the good work and remember to follow your code of ethics. After all, that is what separates us from all those real estate licensees in the world that have chosen not to become a part of our

wonderful organization. I was sitting around the fireplace just the other day remembering my younger days, when the world we lived in was different than it is now. We use to sit around the dinner table with our family or friends and discuss everything that happened to us during our work day, and believe it or not , we would come up with the solution to fix all our prob-lems. It was amazing what we can accomplish together. Christmas is my favorite time of year, it is the time when we try to be extra nice to everyone we meet. We go out of our way for strangers in hopes to make their Christmas special. I am from the old school, “if you didn’t notice”, where we still say Merry Christmas and don’t care if we are politically correct by doing so. The words ‘seasons greetings’ just can’t find a way to cross my lips. And there is another reason I love the holiday so much, it is a time for family and work just seems to take the back seat to family unlike at other times of the year. We will work extra hard just to get everything done so we have the time to sit around the fireplace and talk with our family and friends. We attend one party after another and enjoy all the company we get over the holidays. I want you to have the best holiday ever and remember it isn’t the gift you receive, it is the thought that went into it. Do this for me, thank all the people that have helped you throughout the year and only remember the good stuff. For some reason we always remember the bad stuff, things that someone might have done that we didn’t quite like. Dur-ing this month, thank everyone that has done something for you regardless of what it was. Make their Day! So every time someone does something nice for you, thank them. And do something good for someone else as often as you can — “they will pass it on” and after a while we will quit taking each other for granted, even it if is just for one month. My kids and friends have been telling me for years that I must get a life, and I have decided to do just that. I am going to do some traveling and see some of my old friends. I plan to be busy just enjoying myself and therefore won’t have all the free time on my hands to write you my stories each month. I will miss you! I wish all of you the Merriest Christmas and hope your future years are filled with happiness.
