I don’t know how it happened but it seems my costume has shrunk in the wash again this year. I mean, I specially went out and bought a new one last year around this time and when I tried it on the other day it just doesn’t fit anymore. I wonder how that happened?

Summer is now really here and an afternoon or early morning in the sun is a great way to get outdoors, have some fun and save money at the same time. So it’s off to the pool or beach I go.

Maybe in view of the tightness of the waist on my costume I might hit the gym first...or maybe not. Be sure to read our article ‘I Quit my Gym’. I think you will find it has some insights that will strike a cord. All I know is that exercise will make you feel better, help you sleep better and help you cope with stress better. If you have debt then no doubt you need help dealing with stress and everyone needs a good nights rest.

This issue we also look at that mystical beast the 13th queue and what to do with it this year if it miraculously does appear at the end of a

rainbow on your desk. Sure it’s unlikely in this economy but what if it does happen?

The year is drawing to a close but that doesn’t mean that your creditors have forgotten about you so be sure to read up on the dreaded ‘termination letter’ and what to do when you inevitably receive one. Forewarned is forearmed .

So go on, get out there and soak up some rays. Catch a tan (not in the middle of the day obviously). It’s time to enjoy summer and for goodness sake don’t miss any debt repayments at the end of the year or things will go bad real quick. Think about it just a few days until a new year of possibilities. Who knows, maybe by this time next year you could be debt free?

NEWS FLASHMinister of Finance and BASA joint statement makes DCs nervousThe recent joint press statement from BASA and the Minister of Finance seems to be yet another good publicity drive to say that the banks are good guys and will not make use of garnishee orders so much anymore (...maybe).

The Statement also made reference to BASA members reviewing consumers situations and possibly reducing payment obligations. This seems like a great idea since stats show that half of South African credit users are in real trouble, being in many cases months behind on payments (so they obviously need some relief). It is unclear how the banks intend to review these millions of cases in detail. If what has been seen in the hundreds of thousands of debt review cases holds true they do not have the capacity, software or inclination to do so. Debt Counsellors are very dubious about the banks doing more than a token gesture in this regard.

The Statement also seemingly made reference to the now dead (killed by the NCR) voluntary debt mediation process. It seems to lurk hidden in the phrasing of the statement. The NCR showed this process to be illegal and shut just such a bank run voluntary system down. It seems that BASA are hoping that amendments to the National Credit Act might allow for something like this. It is highly unlikely however. The statement does show that the banks are masters of empty promises and misdirection.

Rather they should have simply promised to cooperate with the already existing process of debt review and agreed to not fight lowering debt obligations to consumers who go through this process. Clearly actions speak louder than words. Sad really.

AllProDC AGMThe second oldest DC representative body (The Alliance of Professional Debt Counsellors) turned 1 year old at the end of Oct. As a result they held their first annual general meeting.

AllProDC have been in existence officially for 13 months and operate mainly in Cape Town, George, PE and KZN with a few members in other provinces. The alliance is well known for its online forum which features over 200 members (not all are members of the association).

Half of the paid up members of the association were in attendance along with representatives from In2insurance and Consumer Friend and Debtfree DIGI (of course).

One purpose of the AGM was to elect the National Executive Committee for the following 12 months. The previous committee had been in place as an interim committee making this the first official election for the NEC.

The voting process went smoothly with 7 members of the previous interim committee

The Treasurer reported that the association had turned a small profit of R4000 after expenses for the year.

A presentation by Consumer Friend’s Justin van der Linde was well received. Consumer Friend have added 2 new creditors to their portfolio namely Wonga and CAPFIN. Another presentation followed by In2Insurance. They highlighted the danger of not having cover especially in light of the CPA. A general discussion was conducted after a small lunch. All in all members seemed happy and the AGM ran smoothly.

BDCF making waves in GautengA new industry player has emerged in the form of the Black Debt Counsellors Forum (BDCF). They say that while the BDCF acknowledges the role played by the Debt Counsellors Association of South Africa (DCASA), the BDCF feel that DCASA has not done enough to promote and encourage black economic empowerment in the debt counselling field. “The BDCF is committed to encouraging black economic empowerment as per the NCA but

we are also a non-racial organisation and we welcome membership from all those debt counsellors who embrace the same ideals we do,”.

The BDCF aims to increase the number of DCs through intensive training efforts by introducing mentorship programmes with accredited and experienced Debt Counsellors.

Atlas Fake Garnishee Orders - BewareA recent Moneyweb expose revealed that numerous garnishee orders secured by debt collectors for debts owed to Atlas Finance, through the Krugersdorp Magistrate’s Court, appeared to be fraudulent.

Commonly called “garnishee orders” are court orders instructing employers to deduct amounts from the salaries of employees towards the repayment of debt. In the wake of several articles by Moneyweb the Krugersdorp’s Chief Magistrate has committed to take steps towards identifying the source of fraud relating to garnishee orders issued from her court.

In addition, the Krugersdorp Magistrate’s Court has instructed garnishee auditing firm Synrec to halt the payment of all Syndicated Debt Collectors’ garnishees on the grounds that they are all fraudulent.

This follows after the decision last week by Summit Garnishee Solutions to freeze all

garnishees attached to its clients’ employees, issued by Syndicated Debt Collectors and Draft Services.

Chief Magistrate Jacoba Visagie has said that while it appears as if court employees are not involved in the fraud, she is not ruling this out entirely. She says that it appeared as if the fraud took place at the debt collection agencies.

A Krugersdorp Clerk has stated that the particular signature on the fake orders was not one of those used by any of the three Krugersdorp clerks.

This would suggest that both the Draft and Syndicated garnishees were obtained through the same channel which might eventually lead back to Krugersdorp. Syndicated Debt Collectors is owned by Jack Halfon, who is also the major shareholder and founder of Atlas Finance.

The Hawks are now involved in investigating the apparent fraud.

Draft and Syndicated Debt Collectors have maintained their absolute innocence in the matter with Syndicated’s parent company saying that the Hawks’ investigation will totally exonerate them.

DCASA NEC ElectedDCASA – the Debt Counsellors Association of South Africa – have recently called for members to be elected to their National Executive Committee. Over the last few weeks nominations have been made. Less than 8 names have been put forward so the results

are in. DCASA explain it this way:

In terms of the DCASA constitution, Clause 4(b) of the voting process states the following:

“If there are less than eight (8) nominations there will be no vote and the persons nominated will be elected to the NEC unopposed”.

In terms of the DCASA Constitution & Voting procedures the following members are therefore elected unopposed to the DCASA NEC.

The members who therefore will be part of the NEC for the next 12 months are:

Cilliers, Eugene;Davis, Phillipa;De Broize, Joseph;Richards, Tony;Siljeur, Nathanael;Slot, Paul,Mauritz van den Heever

Bonus TimeCONSUMER

So it may seem unlikely that this year you will receive a bonus or 13th cheque but what if you do? What will you do with those extra funds?Well, you could keep very quiet about it and head off to the shops to pick up a few nice things for the end of the year. Maybe treat yourself a little. After all, you did work so hard this year and you deserve nice stuff don’t you? But would that be the best use of those funds?Ask yourself what is the largest source of stress in your life? What if you could reduce that stress? How much is that worth?One thing you could do, when you find out you are going to be receiving more funds at the end of the year, is talk to your Debt Counsellor about the matter. After all, your Debt Counsellor will provide you with a realistic, balanced view on how to get the best benefit out of your extra funds.You may even be surprised when your Debt Counsellor advises that you use some of the funds on much needed regular expenses. By doing this the Debt Counsellor will be helping you stay on track with your scheduled debt repayment plan as set before the courts (and by now hopefully in your debt restructuring Court Order). It may be that you have not been able to save to cover the added cost in January of school clothes and school books. Maybe you have not been able to save toward the cost of replacing the tyres on your car or renewing your car or TV licence. These items often slip our minds but not your Debt Counsellors. So, the first step would be to contact them and let

them know how much extra you are getting.Your Debt Counsellor can also advise you on the possibility of closing off one or two of your smaller debts. Possibly you faced some payment problems during the year and this is now an opportunity to catch up with the repayment plan. This will greatly please your creditors and show good faith on your part. Maybe you have had to fight off greedy creditors who wanted to make your life difficult by trying to “terminate” your debt review and take an asset. If you fought them it probably raised some legal costs which the extra funds can now cover.Whatever you do please exercise caution in simply walking into one of your creditors offices and saying: “ how much do I owe you?” and paying whatever they tell you. Almost every creditor out there is too lazy or too cheap to adjust their software to make sure that their system reflects what they have agreed to or been forced to do by the debt restructuring court order. If you just pay whatever they tell you, you will almost inevitably pay much more than you should. Rather ask your Debt Counsellor to assist you to deal with the creditor and let them check the balance they give against the figures shown by the PDA. It takes longer but saves you lots.So, if you are fortunate enough to get this elusive mysterious beast of a 13th cheque or end of year bonus be wise and reduce your stress, talk to your Debt Counsellor.

About 5 months ago my husband and I decided that the gym was not working out for us anymore. We were drifting apart for various reasons. We would make it to the gym I’d say minimum twice a month. The drive to the gym would take 5 minutes on a traffic free day. But with the construction of the my citi buses it seemed like we were spending more time in our car to and from the gym than actually enjoying a good workout so as to feel refreshed! After eventually finding parking at the gym we would rush to get in do the walk/run on the treadmill then decided to do some weight training. Again we would have to wait to use certain machines! The greedy gyms have become so overcrowded that even when you are inside this germ infested place you still seem to waste unnecessary time and money (on petrol and sugar filled smoothies which we thought we deserved)

This frustration led to our decision to cancel our gym membership. One of the best decisions this year. My husband and i have found that doing daily 15-20 minute training in the peaceful comfort of our two bedroom flat had contributed To our wellbeing. Not only have we saved money on petrol and gym fees but we also have more time to be more productive on physical exercise. It’s also made us conscious of being outside and finding activities or exercise outdoors ie. riding bicycles, walking down the road or even going to a run on our beautiful mountain or signal hill! These days when we feel lazy we find ourselves saying “ it’s only 15 minutes and we can do it right here” and immediately feel motivated! Now we use our time energy and money on things that bring us happiness rather than frustration!

Often consumers receive threatening and scary sms’ or emails or even letters from creditors saying that their debt review has been terminated. Simply put this is untrue. At a stretch it is only partially true.

It is impossible for one creditor to cancel or terminate a debt review of many different accounts. It is a common misuse of a term used in section 86(10) of the National Credit Act. In that section it says that if the consumer is in default and 60 days have gone by since applying for debt review then the creditor can “give notice to terminate the review”.

If you get one of these letters do not get confused and think your Debt Counsellor is not doing their part. The are. Creditors are allowed to give notice that they will terminate but they have to do this in the prescribed manner and they have to notify several parties (also in the prescribed manner).

Now it might seem weird to you that a creditor only has to wait 60 work days before they can try pull out of the process however this matter has gone to the highest courts and rulings have been made on the subject.

The courts ruled that the creditor can terminate their own participation and they can then go to another court to try get a judgment. The ruling also says that to balance this the consumer then can defend the matter and can raise the objection that the creditor has terminated in bad faith.

This would only be true where the consumer was actually paying as per the proposal made by the Debt Counsellor. If this is not the case then the Debt Counsellor will not help the consumer and the consumer would be in the wrong and would not be likely to defend the matter.

At first glance these rulings seem to benefit the creditor but in reality there is very little benefit to a creditor where the consumer is actually paying toward their debts via debt review each month. Lets explain:

Lets say the Debt Counsellor has set R300 a month aside for this particular account in the debt restructuring proposal to the Magistrates Court. If the account is removed from the debt review then the creditor can run to another court and try get a judgment

against the consumer. They then can try to get an attachment order against the consumers salary for funds. How much will they get? Well, since another court has already ruled on the consumers budget and debt obligations for the debt review they will only be able to get the amount that the Debt Counsellor suggested to the Magistrates Court in the Debt restructuring Court Order in the fist place. No other funds are available. All that will now happen is that they will have added legal costs and the interest will probably be set at 15.5%.The consumer can even go to the court (in terms of the MCA) and ask the court to make a debtor payment arrangement for the new judgement at the amount of R300 (after showing the figures in the debt restructuring proposal).

So why are all these creditors sending me these letters? It is for a variety of reasons. One is incompetence. Another is short sightedness. Some creditors just let their computers automatically generate these types of letters or sms’. Another is people in collections/ Legal departments trying to reach targets of amounts litigated each month. It is sad really and a real waste of both the consumer and the creditors funds. Sadly it is also a way for creditors to strip consumers of assets if they don’t defend the matter at High Court

Where the creditor terminates during the process and have not negotiated with the consumer they will not be successful in getting another court to grant a judgment because the consumer can simply oppose the matter and show how they refuse to negotiate or co operate with the debt review. Many consumers don’t want to defend the matter though because it is

stressful and it can be nerve-wracking to go to court and tell a judge how unfair the creditor is being.

Don’t be intimidated. Losing your asset will be far more stressful. Rather go to court and ask for a 86(11). Have the account re-included in debt review and ask the judge to make the creditor cover the legal bills (a costs order).

So in conclusion yes creditors can 86(10) “terminate” their participation in a debt review but they still need to go to the magistrates court to oppose the debt restructuring court order. If they take legal action against you, you can successfully defend the matter and make them pay. If they somehow win they will only get the amount your debt counsellor offered them in the first place.

It is important not to panic if you get a ‘termination’ letter but you should to inform your Debt Counsellor at once so they can help you deal with the greedy and short sighted creditor that sent it to you.

86(11) Taking you to High Court where you can’t afford to get legal help?

Reasons why a court might order a 86(11) - re inclusion of a “terminated” account back into the debt review:

Incorrect service procedureslocus standi issuesA reckless credit investigation is happeningAccount not in default at time of application for debt reviewThe creditor acted in “bad faith”

Bad Faith would include things like:

Not providing information to the Debt Counsellor within the time limits set out in the NCA.

Not responding to proposals

Unreasonable demands made in counter proposals

Stalling in Magistrates Court to try legal action elsewhere

Automatically terminating after 60 days

Failure to provide consumers with regular statements

Not allocating payments by the PDA to the consumers account in a timeous manner

Not terminating in the prescribed manner (there isn’t one in the Act)

Not supplying the Debt Counsellor with requested documentation ETC.

Another thing to consider is that your contract with the creditor might show that you have agreed to hear a matter in the Magistrates Court by agreement rather than the High Court. Be sure to check the wording of the original contract if you can get a copy. You might have to force them to do so. Talk to your attorney or Debt Counsellor about how to do so. Then show up at High Court yourself with the contract and show the Judge. Have your debt review Magistrates Court docs and your proof of payment for that account with you just in case. Ask the Court to make a 86(11) ruling to put the account back into debt review right there and then since the creditor is obviously being naughty.

During our years in the debt counselling industry, we got used to bad behavior from our major banks. Lack of co-operation, a disregard for consumers rights, unreasonable demands and many other problems were the norm.

One bank was a little different however. ABSA Bank really went out of their way to accommodate consumers under review. Debt counsellors were treated as partners and visited at their offices by a friendly Mr. Bonginkosi Radebe and problems ironed out while a good relationship was forged. The bank even created a special bank account for the consumer under review and many debt counsellors referred their clients to ABSA.

I personally made the statement to many consumers that ABSA Bank is the only Bank with a heart and that you need to be an ABSA client when you run into problems. While other banks just ignore the National

Credit Act, ABSA were fair and reasonable.

I feel like a fool today.

ABSA dramatically changed their behavior in recent months to become the worst Bank of all. Consumers are being harassed, summonses issued towards consumers with very reasonable offers in debt review, no participation in the debt review process, no communication or negotiation typifies ABSA at the moment.

I am personally dealing with a number of cases where ABSA, despite offers of up to 80% of the original installments and strict payments in this regard made, chooses to proceed with legal action and repossession.

This behavior is something we are used to by now, but not from ABSA.

The good news is that we have not lost one

of these cases thus far. We will obtain the

penalizing costs orders in court because

they are acting in bad faith. We will keep

on ensuring that our consumer’s rights

are respected and that the Bank adheres

to the requirement of reasonable and fair

participation in the process.

The bad news is that it upsets our

consumers. People are losing sleep

because ABSA is acting like a bully and are

in many cases getting away with it.

Beware consumers! ABSA do not care

about you and your families’ wellbeing.

Their slogan should be changed from

“Today, Tomorrow Together” to “We do

not care Forever”.

One year from now, when ABSA have paid

millions of Rands of their investors’ money

towards legal fees for being penalized for

their behavior in court, they will have no

choice but to start “caring” again. This

time however, we will not necessarily trust

them. We will warn every consumer of the

lack of integrity we are witnessing at the

moment.
