NCR to investigate banks insurance products and charges

The Financial Services Board (FSB), the National Treasury and the National Credit Regulator are about to launch an investigation into credit life assurance in general, and the investigation will include the banks’ assurance products.

FAIS contravened by major banks?

Banks may be contravening the Financial Advisory and Intermediary Services (FAIS) Act by not ensuring that employees who issue personal loans and sell life assurance to cover debt are registered as representatives of financial services providers . When asked whether Nedbank was contravening the FAIS Act, Nedbank replied that the Act was “not applicable, as bankers and personal loan agents, who grant personal loans, are not registered under FAIS to provide advice”.Obviously this is the point so when pressed for more info Nedbank said:” due to the fact that personal loan consultants do not provide advice, and perform clerical and administrative services in a subordinate capacity which does not require judgment on the part of consultants, the consultants are not considered to be representatives in terms of FAIS, and accordingly are not required to be registered...We are compliant with the requirements of FAIS and are in line with the unsecured lending

industry and our competitors.”Gerry Anderson (the Financial Services Board’s deputy executive in charge of market conduct) says: “I have perused the response received by you from Nedbank. It is incorrect to state that an individual who is involved in the sale of an insurance product of any nature (including a bank employee) is not required to be FAIS-registered. The provision or not of advice in such cases is not the determining factor, as intermediary services (the other leg of FAIS) may be involved.”An investigation into this matter is being launched by the FSB.

Banks push short term unsecured loans

The Consumer Credit Market Report, recently released by the NCR, shows unsecured credit extended to consumers rose 12% to R21.21 billion in the third quarter of this year from R18.95 billion in the second quarter.At the end of September, unsecured credit accounted for about 8% (R101 billion) of the R1.27 trillion owed by South African borrowers. Which was twice as much as in the few months before. Banks can charge much higher interest rates (up to 32%) for these short term loans and thus they can be very profitable.

Standard Bank were lying about Credit Card charges but only because they did not know...

Standard Bank have been saying that petrol purchases made with their credit cards do not have a transaction fee and are interest free (as normal during the first so many days on a credit card transaction) attached. Investigation recently revealed that this was in fact not the case and that charges were being applied to consumers who were using their credit cards to buy fuel. Standard Bank have been charging a transaction fee of R3.85 and interest from the time the card was used to buy fuel.Sugendhree Reddy, the director of banking products at Standard Bank, says that “no one at the bank knew” that charges and interest apply to fuel purchases on the bank’s credit cards. We acknowledge that fuel purchases on a credit card are treated as a cash advance, meaning we charge a transaction fee and interest from the transaction date. But Standard Bank is reconsidering its position. Especially since the other major banks do not charge for these transactions. “We would have to make system changes, which take time, but by the end of January we would like to have rectified this,” Reddy says.

1000000 new credit Accounts in last Quarter.

The recent NCR Credit Bureau Statistics Report shows that over a million new credit accounts

were opened in the last quarter. With over 19 million South Africans having credit accounts. Over 16 million different accounts were reported as “impaired” or in trouble due to non payment or late payment during this time.

Dirty Fuel embarrasses banks

ABSA, Nedbank and Standard Bank were recently named (in a report from GroundWork & Earthlife Africa ) as major investors in Coal fuel projects which contribute to climate change and other ecological issues. Standard Bank had a reported total of more than R4,5 Billion tied up in project finance, investment banking, corporate loans and assets related to the coal-energy sector; Nedbank had a total of R1,2 Billion.

Late November 86(10) Spree by Banks

Many DC’s are reporting an increase in 86(10) notices. Particularly from ABSA, Standard Bank and Nedbank. Most DC’s feel these notices are unwarranted as consumers have been paying regularly. Consumers will now have to defend these matters using Section 86(11) of the NCA. Most will be successful however it will incur extra costs and delays.

Nedbank goes after Debt Review Consumer’s car because he was R41 behind on payments.

Port Elizabeth High Court judge, Judge Irma Schoeman has blasted an attempt by Nedbank to try to repossess a client’s R267 000 car after he fell behind on his restructured repayments by R41.Nedbank decided they wanted to terminate the consumers debt review (in the post Collett madness) and issued summons which the consumer decided to defend since he had been making repayments. Nedbank then proceeded to make a summary judgment application in order to repossess the Citroen. Unimpressed, Judge Irma Schoeman questioned the bank’s decision to bring the application, asking counsel if they were “really serious” about it. This application was one of several which have brought recently where banks are pushing courts to rule that consumers who did not follow their debt review agreements “to the letter” should not be entitled to the continuous protection of the National Credit Act.When the consumer applied for Debt Review a year ago he was around R30 000 in arrears. After entering debt review the bank kindly agreed to restructure his debt, which meant he could pay smaller installments. They later changed their minds after the Collett ruling because of some delays in certain payments.In Court, the consumer admitted he had not always been able to make his payments on the third day of the month, as stipulated, because of transaction limits on his account. He said

he paid the PDA before the seventh day of each month, except for a small miscalculation, which meant he owed the bank R41. He also pointed to the PDA’s role in distributing funds and his DC explained that the consumer then had no control over when the payments were made by the PDA themselves.The Advocate for Nedbank, argued, that “paying late and paying short” were the same thing. Judge Schoeman then asked: “Are you seriously applying for the summary judgment for R41″. The Advocate answered that the man owed the bank much more than R41 (talking about the over all balance of the account). Judge Schoeman then dismissed the application by the bank.

It is hoped that these sort of results will see the big banks, like Nedbank, reducing unnecessary legal action against debt review consumers who are paying regularly. It is also hoped that costs are always rewarded against the banks in cases like this. Legal costs in these matters cause payment terms to be prolonged if costs are not awarded to the consumer. However such silly and frivolous terminations are common even when consumers are paying regularly. It is hoped that the big banks find a way to reduce these matters and avoid these unnecessary costs and delays.

INDUSTRY CONSUMER

THE YEAR THAT WASThere is no doubt that it was a tough year legally speaking for consumers. The early “high” of Wesbank v Papier which said that Creditors should not issue Section 86(10) notices once a matter was set down to the “lows” of the Collett SCA decision - which allows for Creditors to try their luck in other courts even if the matter is set down at Magistrates Court. This is something that many bond and Vehicle finance Creditors then proceeded to do. The Collett judgment meant that consumers could then successfully defend matters (as long as they were regularly paying) but there were now extra costs involved. Many Consumers have racked up bills of around R18 000 defending homes meaning that homeloan repayments via debt review have to be put on hold while these costs are paid to attorneys. At the same time Banks are seeing their debts grow while these costs are paid and grow more frustrated. All in all the 86(10) process as laid out in Collett is costing both sides a lot of

money and mostly not accomplishing much good. If the cases where the bank gets leave to auction of properties or vehicles they are receiving poor recoveries and face decades long post debt review recovery attempts from consumers who will never use their services again. The section 129 ruling which allows for excluding accounts which have received these letters (unless the consumer responds in 10 days accepting the creditors proposal that they approach a DC - which then places them in legal doldrums and facing possible court action) Has also caused some concern and confusion as creditors struggle to decide whether to include or exclude these accounts. If excluded from debt review they face incredibly long recovery periods as DC could simply ignore these accounts allowing them to roll up to induplum figures for recovery after the review is complete.

There seems no good way to solve these matters unless some independent negotiating is done outside of the court application and allowed for in the consumers budget. All in all this has meant so much extra work that many DC’s have left the industry due to being over worked. This in turn has placed strain on the NCR as they try to keep track of which DC is handling matters. Some consumers have been left in the lurch and even the Creditors are struggling to keep up to date. The awaited for 17.7 has quietly stolen into the industry as a means of advising creditors of changes but it has not received widely acclaimed approval from the NCR . the NCR are also in the midst of leadership troubles and investigations which has made their effectiveness limited. With the appearance of new DC bodies (first the sadly short-lived SDC and now more promising AllProDC) and looming changes to the NCA and regulations there may be some help for DC’s coming but not very soon. Those who cannot adapt in this legalistic process are feeling the pinch as the number of people entering debt review has slowed in the face of public confusion as to whether it is worthwhile or not. African Bank

have been vocal in proclaiming their increased revenue recoveries via the debt review process but many of the other large banks seem intent on letting their debt review departments shrink while allowing their legal departments to handle these matters. This is no doubt a long term strategy mistake but seems to plug the short term accounting and workload issues they face. High level replacements have been called in and a total strategy rethink hopefully looms in 2012. There is no doubt that revenue recovery via debt review is much cheaper for creditors; more realistic and consistent than collections via attorneys and agents. There is also an increase in Debt Counsellor quality happening as the industry thins out. However the financial feasibility of running a debt counselling firm is still a “tight” thing. One can only hope that 2012 will see many of the legal bunglings of our courts put right and voluntary steps taken by creditors to smooth the process and some effective leadership making a difference to the various role players.

CONSUMER INDUSTRY

Many small businesses are scrambling to become compliant with the Promotion of Access to Information Act (PAIA) before the five year exemption to the Act expires at the end of December 2011. Many Business owners are not even aware of the Act and deadline.Small businesses and other private bodies are required to present information such as owner details etc in an electronic manual (for now) to the South African Human Rights Commission (SAHRC). PAIA aims to increase information flow, transparency and accountability in the public and private sector at a time when ironically there is a public uproar about government promoting what has been called a “Secrecy Act” in an effort to deny similar information to the public.The PAIA provision is in line with constitutional rights to access information in the public interest. This will provide individuals looking for information a clear idea of what is available if they can provide the necessary justification for wanting it. An application for information can be turned down with an explanation as to why the information will not be given. Such a response can also be appealed as well and can ultimately end up in a court battle for the information (It seems silly but it can and will happen. We saw what happened with the NCA)Back in 2005 the Department of Justice and Constitutional Development exempted small businesses (such as DC’s - who had not come into existence yet) recognising that compliance with such new and unexplored legislation could place a big administrative burden on

smaller businesses. Fortunately after 5 years there is now some clear guidance on what needs to form part of the Sect 51 Manual. For more advice on compiling your manual see our brief guideline in this issue. It is not as complicated as you may think to put a basic manual together. There is also no cost involved in submitting your version of the manual to the SAHRC.Chantal Kisoon (Head of the access to information unit at the SAHRC, ) said the SAHRC recognised the need to balance the purpose of the act with the needs of small businesses, which might not have the legal resources to comply. There are stiff penalties for noncompliance, for example: two years in prison for a business owner, or a fine, but so far these penalties have never been implemented. The commission had petitioned the Department of Justice to extend the exemption, but so far are still waiting for a response.If you run a small business you should try use the provided “guideline” in this issue or that provided on the SAHRC website at: http://www.sahrc.org.za/home/ and should send it through to them in a PDF or via post. If possible you should also then put it on your company website and make it available to visitors to your business along with an application form (called form c) for consumers to fill in to request information from your company. So don’t panic just take 20 min and fill in the needed info put it on your letterhead and away you go.

I am sure that all of us have once, or for the really big spenders, many times, applied for credit in some way, shape or form from various credit providers. Now over and above the fact that we, as consumers, can simply not contain our joy and eagerness to get our hands on what some people may perceive as a prize of some sorts, there is always the dreaded paper work!!

You would have noticed that a portion of this long-winded paper work includes an insurance of some sort which covers both you and the credit provider in the event of either, Death, Disability, Dread Disease and Retrenchment. Each credit provider however would use a different underwriter (insurer) for this cover.

I would like to take this opportunity to explain Credit Life in an easy understandable manner which would at the very least give, you the reader, a better understand of the benefits, costs and how to go about submitting a claim.

I did cover the rates per R 1000.00 in an earlier article so will not revisit the costs but your premium is often embedded in your finance agreement and forms part of your monthly payment so you may not even be aware of this cover. However it is directly linked to the outstanding balance on a specific account and should you die, become disabled or suffer a dread disease the insurer will settle your account with the credit provider. Retrenchment however works a little different, with your monthly payment on the account being paid for a period of 3 to 6 months in the event of retrenchment.

Now folks, how many people do you know that have been retrenched over the last 2 to 3 years as a result of the financial crisis?? How many of them were actually aware of this benefit and actually submitted a claim?? I would say as little as 15% - what do you think? Some may have been aware but did not know how to go about submitting a claim.

It is quite simple – you need to peruse your policy document (if you received one) which will provide you with all the info you require. The other alternative is to approach your credit providers which, let me add, should you have more than 5, can become quite a tedious and time consuming affair and each one may have a different process that needs to be followed.
