PART 4 - UTILITY REQUIREMENTS

4-1 SCOPE

This Part 4 - Utility Requirements provides information on the Design-Builder's overall

responsibilities as they relate to existing and/or new utilities, the manner in which utilities are to

be protected, relocated, upgraded, constructed or incorporated into the construction, and who will

be responsible for the Work.

The Design-Builder's attention is directed to the fact that during the life of this Contract the owners

and operators of utilities may make changes to their facilities. These changes may be made by

the utility employees or by contract within the Project limits of, or adjacent to, this Contract and

may involve temporary and/or permanent Work(s).

Potential utility conflicts shall be identified by the Design-Builder and brought to the attention of

the Department and utility owners. Reference is made to the New York State Department of

Transportation Highway Design Manual, and NYSDOT Standard Specifications and Construction

Materials and all applicable NYSDOT Standards.

The Design-Builder shall abide by this Part 4. The Design-Builder shall also abide by and fulfill

the requirements related to utility facilities or systems included in other Contract Documents.

This Part 4 applies to existing and proposed underground and overhead utilities.

The Design-Builder shall be responsible to verify all utility information provided and to coordinate

with the utilities regarding any necessary modification to the Preliminary DB Utility Work

Agreements (if provided) based on any new information and any further utility work required

beyond that indicated in the Preliminary DB Utility Work Agreements (if provided).

If the Design-Builder’s design requires additional utility relocations beyond those identified in the

Preliminary DB Utility Work Agreements presented in Appendix C, it is the responsibility of the

Design-Builder to suggest revised Preliminary DB Utility Work Agreements in coordination with

the utility owners and submit the revised Preliminary DB Utility Work Agreements to the

Department for approval.

At points where the Design-Builder’s operations are adjacent to utilities, damage to which might

result in considerable expense, loss, or inconvenience, Work shall not begin until all arrangements

necessary for the protection thereof have been made by the Design-Builder and the utility owner.

The Design-Builder shall cooperate with all utility owners (including owners of underground or

overhead utility lines and owners of utilities attached to existing Department structures) in their

removal and rearrangement operations in order that these operations may progress in a

reasonable manner, that duplication of rearrangement Work may be reduced to a minimum, and

that services rendered by those parties will not be unnecessarily interrupted. See also DB §107-

07 addressing Work near underground facilities.





4-2 GENERAL

The Department’s interaction with Utilities located within the Highway Right Of Way (ROW) is

governed by 17 NYCRR (Official Compilation of Codes, Rules and Regulations of the State of

New York) Part 131.

The Department has notified all Utilities, pipeline owners, or other parties who seemingly are

affected by the proposed construction based on the preliminary design plans and endeavor to

have Preliminary DB Utility Work Agreements executed with potentially affected Utilities prior to

the Award of the Contract.

The Design-Builder, in coordination with the Department’s Project Manager (or his designee),

shall meet with all the affected Utility owners or operators for the purpose of discussing the effect

on the utility facilities and to agree on a plan to maintain, protect, relocate, reinstall, or other action

that may be necessary for the work to progress.

Reference is made to General Obligations Law §11-102 which concerns the liability of a Utility for

compensation for damages caused by interference with and/or delay of progress of work under a

State public construction contract.

4-2.1 Utility Coordination

The Design-Builder shall coordinate its design and construction efforts with utility owners as set

forth in Part 2 - General Provisions of the Contract. All design and construction work performed

by the Design-Builder shall be coordinated with the utility owners, and shall be subject to the

Preliminary DB Utility Work Agreements, utility standards and applicable provisions of the

Contract Documents.

The Design-Builder shall notify the Department at least five working days in advance of each

meeting with a utility owner's representative scheduled by the Design-Builder and shall allow the

Department the opportunity to participate in each meeting. The Design-Builder shall also provide

the Department with copies of all correspondence between the Design-Builder and any utility

owner, within seven days after receipt or sending, as applicable.

4-2.2 Utility Coordination Manager

The Design-Builder shall utilize a single dedicated person responsible for managing all utility

coordination. This person shall be referred to as the Utility Coordination Manager. The Design-

Builder’s Utility Coordination Manager shall be responsible for managing all utility coordination,

including, but not limited to, the following:

A) Ensuring that all utility coordination and activities are conducted in accordance with the

requirements of the Contract Documents;

B) Identifying all existing utilities and coordinating any new utility installations;





C) Reviewing Department prepared proposed utility permit application packages and

commenting on each permit application as related to the Design-Builder’s utility relocation

drawings;

D) Attending utility meetings, preparing and distributing minutes of all utility meetings, and

ensuring expedient follow-up on all unresolved issues;

E) Distributing all plans, conflict matrixes and changes that affect utility owners and making sure

this information is properly coordinated;

F) Coordinating the execution and performance of Work required for any utility Work needed

within the Project;

G) Preparing and coordinating the execution of Final DB Utility Work Agreements between the

Design-Builder, Department, and utility owners;

H) Assisting with the resolution of utility conflicts;

I) Providing periodic Project updates to the Department’s Project Manager as requested; and

J) Coordination with the Department on any issues that arise concerning reimbursement of

utility work costs.

4-2.3 Utility Relocation Design

The Responsibility for design of relocations covered by a DB Utility Work Agreement (DB-HC140)

shall be as set forth in each such DB Utility Work Agreement. The DB Utility Work Agreements

shall allocate responsibility for the design of utility relocations that are subject to such DB Utility

Work Agreements. The Design-Builder shall clearly indicate the allocation of responsibility for the

design of utility relocations on the Utility Relocation Plans.

4-2.4 Scheduling Utility Relocation Work

The Design-Builder shall allow in its Baseline Progress Schedule and monthly updates, the time

required for utility owners to accomplish the tasks and activities for which they are responsible,

as specified in the Preliminary DB Utility Work Agreements (if applicable), Relocation Plans, and

in this Part 4.

4-2.5 Utility Design and Construction Constraints

All utilities (whether designed and/or constructed by the Design-Builder or the utility owner) within

the Project Limits that are to be newly installed temporarily or permanently, relocated or upgraded

shall be placed in accordance with the NYSDOT's utility regulations and policies, unless otherwise

approved by the Department.





For each relocation, or installation, the Design-Builder, in coordination with the utility owner, shall

be responsible for verifying that the relocated utility, as designed and constructed, is compatible

with and interfaces properly with the Project. The Design-Builder shall be responsible for

protecting any and all utilities that must be protected in order to permit construction of the Project.

4-2.6 Standard of Care Applicable to Utility Work

The Design-Builder shall be responsible for complying with 16 NYCRR Part 753 ("Part 753"), and

requesting mark outs for utilities that are not members of the One Call System as defined in Part

753. A list of known utility operators that are not members of the One Call System with facilities

within the Project area is included in Appendix B. The Design-Builder shall carry out its work

carefully, and skillfully, and shall support and secure utilities so as to avoid damage and keep

them satisfactorily maintained and functional. The Design-Builder shall not move or remove any

utility without the utility owner's written consent unless otherwise directed by the Department.

The Design-Builder shall be responsible for the cost of repair of any utilities damaged by the

Design-Builder. In the event of any such damage, the Design-Builder shall notify the affected utility

owners and the Department, and shall enter into an agreement with such utility owner allocating

responsibility for design and construction of any such repairs, and the schedule for completing

the repairs. All such repairs made by the Design-Builder shall be performed in a good and

workmanlike manner. If the utility owner undertakes the repairs and the Design-Builder fails to

make any required payment within 30 days after the repairs have been completed and the Design-

Builder's receipt of the utility owner's invoice therefore, the Department will have the right to pay

the utility owner from the Department's funds and/or deduct an amount sufficient to cover the cost

from any moneys due or that may become due the Design-Builder under this Contract.

The Design-Builder shall include provisions for its obligations with respect to utilities in its Quality

Control Plan.

4-2.7 Coordination with Utility Owners

The Design-Builder shall make diligent effort to obtain the cooperation of each utility owner as

necessary for the project. If the Design-Builder becomes aware that a utility owner is not

cooperating in providing needed work or approvals, the Design-Builder shall notify the Department

immediately of such problem. After such notice, the Design-Builder shall continue to diligently

seek to obtain the utility owner's cooperation, and the Department and Design-Builder each shall

assist the other party as reasonably requested by such other party with regard to the problem.

4-3 AFFECTED UTILITIES

4-3.1 Design-Builder's Responsibilities

With respect to utilities for which the Department has identified a specific utility owner and conflict,

the Design-Builder's responsibilities shall include:





A) Verifying utility locations;

B) Identifying potential conflicts not previously identified;

C) Coordinating and/or designing/constructing utility relocations and/or new utilities and the

protection of existing utilities in accordance with this Part 4 and any additional requirements

of the utility owner(s) as set forth in the relevant Preliminary DB Utility Work Agreement(s)

included in Appendix C hereto; and

D) Preparing and coordinating the execution of Final DB Utility Work Agreements between the

Design-Builder, Department, and utility owners.

With respect to any unknown utilities that are subsequently identified by the Design-Builder, the

Design-Builder shall be responsible for identifying the ownership of each facility or line identified

which requires either relocation or protection, and for all those responsibilities set forth in A

through D, above; provided, however, that with respect to item C, the Design-Builder shall be

responsible for negotiating and entering into a DB Utility Work Agreement with the Department

and the Utility Owner for such previously unknown utilities and/or utilities for which no owner had

been previously identified, and the Design-Builder's responsibilities in item C shall apply with

respect to each such DB Utility Work Agreement.

4-4 COORDINATION REQUIREMENTS

The Design-Builder shall make diligent effort to obtain the cooperation of each utility owner as

necessary for the Project. If the Design-Builder becomes aware that a utility owner is not

cooperating in providing needed work or approvals, the Design-Builder shall notify the Department

immediately of such situation. After such notice, the Design-Builder shall continue to diligently

seek to obtain the utility owner's cooperation, and the Department and Design-Builder each shall

assist the other party as reasonably requested by such other party with regard to the situation.

The Design-Builder shall provide information as required and maintain close coordination with the

Department and utility owners to achieve timely relocations, new installations and new service

connections necessary as part of the Design-Builder's design and construction.

4-4.1 Prior Department Actions

The Department has coordinated its efforts with all known utility owners and has:

A) Developed a contact list;

B) Identified potential utility conflicts; and

C) Developed Preliminary DB Utility Work Agreements as set forth in Appendix C hereto.





4-4.2 Design Builder's Coordination Requirements

The Design-Builder shall be responsible for coordination with utility owners. It is important that

Utility Owners be kept informed of the Design-Builder's activities and schedule. In addition to

satisfying any requirements set forth in applicable Governmental Rules and Standards, including

but not limited to Part 753, the One-Call notification requirements referenced in DB § 107-07, and

in any DB Utility Work Agreements that may have been executed, the Design-Builder shall

undertake the following activities, which have been identified by the Department as important to

utility owners:

A) Keep utility owners well informed of construction schedules and notify the utility owners at

least twenty-four hours in advance of any work in the vicinity of the utility owners' facilities,

that will not impact service;

B) Keep utility owners well informed of changes that affect their facilities;

C) In addition to any required notice, give the utility owners a minimum of 48 hours notice of

potential impacts to service, unless longer notification times are specified elsewhere in this

Part 4 or any DB Utility Work Agreements that may have been executed;

D) Ensure utility owners are involved in making the decisions that affect their own facilities and

services;

E) Cooperate with the utility owners to solve relocation/installation issues to the extent that such

relocations/installations are consistent with the Design-Builder's Scope of Work as otherwise

set forth in the Contract Documents and without causing the Department to incur any

unnecessary expense to the Project, or causing the utility owners to incur unnecessary

expense;

F) Act diligently in continuing the positive relationship that the Department has developed with

the utility owners; and

G) Coordinate with those utility owners who perform their own work by scheduling adequate

time to accomplish their work.

In the event of interruption to utility services as a result of accidental breakage or as a result of

being exposed or unsupported, the Design-Builder shall promptly notify the proper authority

regarding the restoration of service. If any essential service (including water, gas, electric fiber-

optic, cable, telephone or other utility) is interrupted, the Design-Builder shall provide continuous

repair Work until the service is restored. No Work shall be undertaken around fire hydrants until

provision for service has been approved by the local fire authority.





4-4.3 Design Reviews

The Design-Builder shall invite affected utility owners to participate in all pertinent Design-

Builder's and Department's Design Reviews (see Part 3, Section 5).

Some utility owners may design and/or construct any required utility relocations and revisions for

their utilities. The Design-Builder shall be required to incorporate these utility designs into its own

design prior to the Design Review.

4-4.4 Meetings and Coordination

The Design-Builder shall schedule meetings with each utility owner, the Design-Builder and the

Department. These meetings are for the purpose of reviewing all items related to the utility Work,

including all items which affect the Baseline Progress Schedule, the time required to procure

construction material and the period of time utility service may be curtailed. These meetings will

also be used to reach concurrence on the number and extent of known affected utility lines or

issues, to discuss the possible elimination of conflicts, to establish the methods to be used at

each specific location and procedures for addressing conflicts discovered during design and/or

construction.

The Design-Builder shall jointly schedule at least monthly utility meetings with the Department or

their duly authorized representative to discuss project progress, issues, and planned work for all

phases of utility work including design and construction. These meetings shall include the Design-

Builder's and the Department's personnel with responsibilities for utilities. The Design-Builder and

the Department will jointly develop the agenda for these meetings. The Design-Builder shall be

responsible for providing meeting facilities unless otherwise agreed. The Design-Builder shall

keep minutes of the coordination meetings and distribute copies of the minutes to participants,

including representatives of utility owners (even if not present) who have facilities in the areas

reviewed, within five working days after the meeting date.

4-5 STANDARDS AND REFERENCES

The Design-Builder shall perform the utility work in accordance with the Contract Requirements,

including this Part 4, the applicable Standards, Codes and Manuals listed in Part 3 – Project

Requirements and the standards required by the various utility companies affected by the work.

The Design-Builder shall obtain clarification of any unresolved ambiguity prior to proceeding with

design or construction.

The Department will make available to the Design-Builder upon request all information obtained

from utilities, pipeline owners, and other parties that the Department has notified concerning the

proposed construction. Such information will be considered Reference Documents.





4-6 DESIGN BUILDER RESPONSIBILITIES

The Design-Builder shall be responsible for coordinating its design and construction work with

utility work as indicated herein, consistent with and subject to the terms and conditions set forth

in DB §104.

The Design-Builder shall identify and resolve all utility conflicts, and shall coordinate the

construction, relocation, removal and/or protection of each affected utility with the applicable utility

owner. If the Design-Builder discovers utilities not identified in Appendix A of this Part 4 that are

affected by the construction, the Design-Builder shall immediately suspend construction

operations at the site affected by such utility and shall notify the Department within 24 hours of

discovery of such previously unknown utilities. The Design-Builder and the Department shall

cooperate in identifying and notifying the utility owner.

4-6.1 Cost of Temporary Relocations

The Design-Builder shall be responsible for the cost of temporary utility relocations, including the

cost of obtaining temporary easements, necessary to accommodate its own construction

operations and/or methods, other than temporary relocations that are necessary for the

construction of the Project permanent works.

4-6.2 Relocation Permits

Where the Design-Builder is performing utility relocation construction Work, the Design-Builder

shall obtain utility permits, roadway permits and work permits and comply with all applicable utility

regulations. If the Design-Builder has reasonable cause to believe that a utility owner does not

have necessary approvals, or is in violation of the approvals, the Design-Builder shall notify the

Department immediately after discovery.

4-6.3 Point of Contact

The Design-Builder shall coordinate, cooperate and work with the contact person designated by

the utility owner. Table A-1 in Appendix A of this Part 4 presents contact details by utility owner.

4-6.4 Instructions and Authorizations

The Design-Builder shall be responsible for obtaining specific written instructions and

authorization from the utility owner, for any design or construction the Design-Builder performs on

behalf of the utility owner, and for verifying that they are consistent and compatible with the

Design-Builder's design.





4-6.5 Verification of Utility Locations and Marking of Locations in the Field

The Design-Builder shall be responsible for verifying the exact location of each affected utility on

the Project regardless of the information that has been provided by the Department or the utility

owner.

The Design-Builder shall comply with NYCRR 16 Part 753 to mark utility locations.

4-6.6 Components of Utilities

The Design-Builder shall consider necessary appurtenances to each utility facility (such as the

utility source, guide poles, feeder service lines, supports, etc.) as part of the utility.

4-6.7 Utility Owner's Right to Inspect

The utility owner has the right to inspect the work on its facilities that is to be performed by the

Design-Builder.

4-6.8 Design-Builder-Caused Changes to Utility Owner Work

If the utility owner maintains responsibility for the design and/or construction and the Design-

Builder revises the conditions, the Design-Builder shall be responsible for the costs and schedule

delays related to the change.

4-6.9 Abandoned Utilities

Unless otherwise directed by the Department, and the utility owners, the Design-Builder shall

remove abandoned utilities and utilities proposed for abandonment within the New York State

Department of Transportation's Right Of Way. Any work to remove or abandon in place any utilities

shall be considered “Incidental Utility Work” and subject to the provisions of DB §104-04.B.7(e).

4-6.10 Quality Control

The Design-Builder shall provide Quality Control for all the utility relocation work, performed by

the Design-Builder, in accordance with Part 3, Sections 5 and 6.

4-6.11 Changes to Design

All changes to designs that have received the Department's or utility owner's consultation and

written comment and/or utility owner’s approval shall be dealt with in accordance with Part 3,

Section 5, including obtaining the Department's and utility owner's consultation and written

comment and/or approval for the change.





4-6.12 Design-Builder Design and/or Construction

The Design-Builder shall be responsible for the utility relocation design and/or construction as

provided in Part 2 - General Provisions. The Utility Work set forth in Appendix A and the

Preliminary DB Utility Work Agreements set forth in Appendix C (if any) indicate the allocation of

responsibility between the Design-Builder and the identified utility owners for relocation design

and/or construction of the utility facilities. Subject to Part 2 - General Provisions, Design-Builder

is responsible for all relocation costs and the Contract Price includes the price for such Work.

4-6.13 Design Review

The Design-Builder shall submit its utility relocation plans to the Department's Design Quality

Assurance Engineer and to the utility owner for work performed by the Design-Builder, for

consultation and written comment. See also Part 3, Section 5.

4-6.14 Construction Record

The Design-Builder shall maintain a record of the design and construction activities of all utility

facilities that have been performed by the Design-Builder, and have been designed and released

for construction after Notice to Proceed. Individual files shall include a record of the following

information:

A) Design Plans that have been reviewed by the utility owner and received consultation and

written comment by the Department;

B) Notification of construction dates;

C) Record of meetings with utility owner;

D) Signature of utility owner inspector on Design Plans (optional);

E) Record of utility owner inspector present at any time;

F) Any revisions to the Design Plans;

G) Dates of construction completion;

H) All other as-built requirements stipulated in this Part 4;

I) Any executed Final DB Utility Work Agreements (three-party agreements).

4-6.15 Utility Damage Reports

In the event that the Design-Builder damages an existing utility, the Design-Builder shall complete

a utility damage report within 24 hours of damage and submit it to the Department. The Design-

Builder shall report any utility facilities damaged immediately to the utility owner and the





Department. The Design-Builder is responsible for developing a utility damage report form to use

in the event a utility is damaged. The report shall be submitted to the Department's Project

Manager. The following information shall be included:

A) Utility Damage Information

1. Exact location;

2. Date and time of incident;

3. Date and time reported;

4. The weather the day of incident;

5. Description of the incident;

6. Who the damage was reported to;

7. Who the damage was repaired by;

8. Representative digital color photographs.

B) Utility Owner Information

1. Utility owner;

2. Utility owner contact;

3. Time utility owner was contacted.

C) Locator Information

1. Locator service;

2. Date of locate request;

3. Locate expiration date;

4. Locate log number;

5. If damaged utility line was marked;

6. Distance from damage to mark.

D) Design-Builder Information

1. Name of supervisor;

2. Name of foreman;

3. Name of witness.

E) Signatures

1. Design-Builder's supervisor;

2. Utility owner;

3. Locator service.





4-6.16 Protection of Utility Facilities

The Design-Builder shall prepare a protection plan for all utility facilities to be left in place and

protected. The Design-Builder shall also obtain written approval of the plan from each utility owner

of the specific facility to be protected.

4-6.17 Utility Relocation Master Plan

The Design-Builder shall coordinate with the utilities to prepare a utility relocation master plan

after the Design Builder has advanced the Project design sufficiently to clearly define utility

impacts. The Design Builder shall update the plan at least quarterly throughout the duration of the

Contract. Updates shall be submitted to the Department for consultation and written comment.

4-6.18 Betterments

The Preliminary DB Utility Work Agreements set forth in Appendix C, if any, address any

Betterments that have been agreed to by the Department and utility owners whose facilities are

subject to a DB Utility Work Agreement.

If the Department agrees to the addition of any Betterments to the Work with respect to facilities

covered by the DB Utility Work Agreements, the Department will issue a Change Order pursuant

to DB §104-02 with respect thereto. The Design-Builder shall not be entitled to an increase in the

Contract Price with respect to any Betterments except as allowed under DB §104-04.B.3 and this

DB §104-04.B.4.

If any utility owners whose facilities are subject to a Preliminary DB Utility Work Agreement

request that the Design-Builder design or construct Betterments that are not addressed in the

relevant Preliminary DB Utility Work Agreement, the Design-Builder shall be solely responsible

for any Betterments that the Design-Builder agrees to provide that are not addressed in the

relevant Preliminary DB Utility Work Agreement. Some utility owners with whom the Design-

Builder and the Department will be entering into a DB Utility Work Agreement may request

Betterments to their facilities as a result of required relocations of their lines. The costs of any

such Betterments shall be resolved between the Department, the Design-Builder and the utility

owners in their respective DB Utility Work Agreements. The forms of DB Utility Work Agreements

attached hereto as Appendix C, if any, provide a template provision addressing agreed upon

Betterments. The Department shall have no responsibility, actual or implied, with respect to any

Betterments, and all Betterments shall be subject to the Department's permitting process.

4-7 DESIGN AND APPROVAL OF THE UTILITY RELOCATION PLANS

After the Design-Builder has advanced the Project design sufficiently to clearly define utility

impacts, the Utility Relocation Plans shall be prepared by the Design-Builder. If the utility owner

is preparing the design, the Design-Builder and the Department shall review the Utility Relocation

Plans to be sure that they are consistent with the Design-Builder's design. Upon review by the





utility owner and the Design-Builder, and consultation and written comment by the Department,

the utility relocations may be constructed. Any subsequent revisions to the Utility Relocation Plans

will require the review of the affected utility owner and the Department's consultation and written

comment.

4-8 SUBMITTALS

4-8.1 Design

All design work shall be coordinated between the utility owners and the Design Builder. If the

relocation plans are to be developed by the Design-Builder, the Design-Builder shall furnish to the

Department prior to the start of construction of each utility relocation, Utility Relocation Plans and

Project Specifications completed to the levels of design and stages of design development and

reviewed and certified per Part 3, Section 5.

Designs prepared by the utility owner shall be reviewed and approved by the Design-Builder and

receive the Department's consultation and written comment, for consistency and compatibility with

the Design-Builder's design. Prior to construction, the Department will review all designs, whether

by the Design-Builder or the utility owner.

4-8.2 Construction

The Design-Builder shall provide two sets of As-Built Utility Relocation Plans to the Department

and each utility owner for utility relocation work constructed by the Design-Builder. The Design-

Builder should also reflect in the As-Built plans any work that is performed by the utility companies

within the project limits. The As-Built Utility Relocation Plans shall comply with As-Built

requirements stipulated in the Department's Utility Standards and shall include any utilities

abandoned and not removed. The As-Built Utility Relocation Plans shall be part of the Project As-

Built Plans.

4-9 DB UTILITY WORK AGREEMENTS

4-9.1 General

If Preliminary DB Utility Work Agreements have been executed, they will be identified in Part 4 –

Utility Requirements.

Utilities which may be impacted by the Project have been identified in Part 4 – Utility

Requirements.

If Preliminary DB Utility Work Agreements have not been executed and included in the Contract

Documents, the Department, in conjunction with the Design-Builder, shall negotiate with each

affected utility for Relocation of the utility’s facilities after Award and enter into a DB Utility Work

Agreement. The Design-Builder agrees to cooperate as reasonably requested by the Department

in pursuing and executing DB Utility Work Agreements after Award, including attendance at





negotiation sessions and review of DB Utility Work Agreements. The Department and the Design-

Builder shall exercise due diligence and good faith efforts in coming to an agreement with each

affected utility. Each DB Utility Work Agreement shall be executed by the Department, the Design-

Builder and the Utility Owner. The Design-Builder shall remain responsible for the coordination

between itself and the utility owner after DB Utility Work Agreements have been executed in order

to maintain the Project schedule.

Issues to be addressed in the DB Utility Work Agreements may include the following:

A) Responsibility for design and/or construction of the relocations;

B) Design requirements and construction specifications;

C) Betterments, including the approach to determining whether an item is a betterment;

D) Notifications to the involved parties;

E) Review of designs and/or cost estimates by the Utility or the Design-Builder, including

timeliness;

F) Emergency response actions and timing;

G) Limitations on timing of construction or interruption of service;

H) Damage repair;

I) Inspections and testing by the Utility and/or Design-Builder;

J) Approvals (including provisions for early start of construction); and

K) Payment for relocation.

If a utility owner requests the Design-Builder to design and/or construct a Betterment, or advises

the Design-Builder that the utility owner intends to design and construct a Betterment, the Design-

Builder shall promptly analyze the impact of such Betterment on the Baseline Progress Schedule

and notify the Department if it appears the Betterment may affect the Critical Path. The Design-

Builder shall use its best efforts to negotiate arrangements with the utility owner that avoid

potential Critical Path impacts.

4-9.2 Utilities Not Covered by DB Utility Work Agreements

If public or private utility lines or pipelines or other appurtenances are encountered during the

course of the Work, which may be impacted by the Work, and which are not covered by an existing

DB Utility Work Agreement, the Design-Builder shall immediately suspend construction operations

at the site of the utility in question. The Design-Builder shall then provide the Department with a





written assessment of the potential impacts to the Utilities and Contract Work, including options,

time impacts, schedule impacts, and a proposed action plan. Construction Operations at the site

of the utility in question shall remain suspended until such time that the Department and utility

owner negotiate an agreement for the required action, or the Department provides written

authorization allowing work to proceed without such an agreement. Subject to DB §104-04.B.1,

the Design-Builder will not be allowed adjustments for delays or extra expense with respect to

any such suspension.

4-10 DELIVERABLES

Unless otherwise indicated, all deliverables shall be submitted in both electronic format and

hardcopy format. Acceptable electronic formats include Microsoft Word®, Microsoft Excel®,

Bentley MicroStation version V8, or searchable portable document format (PDF) files, unless

otherwise indicated.

At a minimum, the Design-Builder shall submit the items listed in Table 4.9-1 to the Department.

APPENDIX C PRELIMINARY DB UTILITY WORK AGREEMENTS

The work described in this Appendix C (if provided) includes known relocation(s) and other utility

work required to remove known interference(s) with Project elements. The Design-Builder shall

design, locate, and construct the Work in accordance with utility provider(s) details as detailed in

this Appendix C (if provided). The Design-Builder shall consider providing, where possible and if

applicable, a common trench in which to construct the utilities in accordance with the utility

providers' requirements. The Design-Builder shall determine the location of any and all

trenches relevant to the requirements of the Design-Builder's design, as applicable. The Design-

Builder shall include in its Baseline Project Schedule appropriate time as required for all utilities

work. The Design-Builder shall comply with the Work Zone Traffic Control requirements

contained in Part 3 of the Contract Documents at all times when performing the work described

herein.

Any Agreements provided in this Appendix are Preliminary and are between the Department and

utility owner(s). The Design-Builder is expected to coordinate with any and all affected utility

owner(s) and the Department to negotiate and execute 3-party Final Utility Work Agreements

necessitates the adjustment of utility facilities as hereinafter described (the “Project”), the owner, New York City Department of Environmental Protection, of said facilities herewith agrees with the State of New York acting through the Commissioner of Transportation that this agreement shall apply to the accommodation of these utility facilities. Any adjustment of said facilities will be accomplished under the terms of this agreement, in accordance with the Rules and Regulations Governing the Accommodation of Utilities within the State Highway Right-of-Way and in accordance with the contract plans, specifications, proposal, amendment(s) or change order(s). The work described herein is subject to change pending the design details and schedule developed by New York State Department of Transportation’s design-builder. • A 12” lined-cast iron pipe water main runs EW towards the north fascia of 94th Avenue & Atlantic Avenue bridge, between the east and west approaches the bridge

• To the west of the SB Service Road and Atlantic Avenue intersection, an 8” cast iron pipe water main runs EW along the north side of Atlantic Avenue.

• A 12” ductile iron pipe runs EW on the west approach of the 94th Avenue & Atlantic Avenue Bridge.

• On SB Service Road, A 12” ductile iron pipe runs NS along the west sidewalk, between 91st Avenue and Atlantic Avenue.

• A 12” lined-cylinder pipe water main runs NS along the west sidewalk of the SB Service Road, between 95th Avenue and Atlantic Avenue.





• To the east of NB Service Road and 94th Avenue intersection, an 8” cast iron pipe water main runs EW on the south side of 94th Avenue.

• A 12” cast iron pipe water main runs NS across 94th Avenue, between the NE and SE corners of the NB Service Road and 94th Avenue intersection.

• A 12” lined-cylinder pipe water main runs in the NS direction on the NB Service Road north of the NB Service Road and 94th Avenue intersection.

All New York City Department of Environmental Protection facilities listed above shall be supported, protected, maintained, and/or replaced as per the approval of New York City Department of Environmental Protection within the proposed work area by the NYSDOT Design-Builder.

NYSDOT Design-Builder Scope — Bridge Replacement:

a. The NYSDOT Design-Builder shall permanently install 12” steel pipe water main towards the north fascia of the new 94th Avenue & Atlantic Avenue Bridge superstructure. The alignment of the New York City Department of Environmental Protection facilities shall be coordinated with New York City Department of Environmental Protection and constructed in accordance with all applicable New York City Department of Environmental Protection standards BY THE NYSDOT DESIGN-BUILDER.

b. The NYSDOT Design-Builder shall permanently eliminate the existing 12” lined-

cylinder pipe water main located towards the south fascia of the 94th Avenue & Atlantic Avenue Bridge.

c. The NYSDOT Design-Builder shall install a new 12’’ valve in the intersection of

Atlantic Avenue and the Southbound Service Road. Northbound and Southbound Service Roads from Atlantic Ave to 91st Ave (Van Wyck Expressway (I-678) under Long Island Railroad Bridges) Existing Facilities:

• A 12” ductile iron pipe water main runs along the west sidewalk of the SB Service Road, in N-S direction between 91st Avenue and Atlantic Avenue. There are two hydrant connections to the 12’’ ductile iron water main between Atlantic Avenue and 91st Avenue.

• A 12” lined-cast iron pipe water main is located on the NB Service Road, running in the N-S direction between 94th Avenue and Archer Avenue.

o Additionally, this 12” pipe has two fire hydrant connections to water main on the east sidewalk of the NB Service Road.

All New York City Department of Environmental Protection facilities listed above shall be supported, protected, maintained, and/or replaced as per the approval of New York City Department of Environmental Protection within the proposed work area by the NYSDOT Design-Builder.





NYSDOT Design-Builder Scope:

a. The NYSDOT Design-Builder shall permanently install 12” ductile iron water main and associated appurtenances towards the west sidewalk of the SB Service Road. The alignment of the New York City Department of Environmental Protection facilities shall be coordinated with New York City Department of Environmental Protection and constructed in accordance with all applicable New York City Department of Environmental Protection standards BY THE NYSDOT DESIGN-BUILDER.

b. The NYSDOT Design-Builder shall permanently install 12” ductile iron pipe

water main towards the east end of the NB Service Road. The alignment of the New York City Department of Environmental Protection facilities shall be coordinated with New York City Department of Environmental Protection and constructed in accordance with all applicable New York City Department of Environmental Protection standards BY THE NYSDOT DESIGN-BUILDER.

c. The NYSDOT Design-Builder shall permanently remove existing 12” ductile iron pipe water main running along the west sidewalk of the SB Service Road.

d. The NYSDOT Design-Builder shall permanently remove existing 12” lined-cast iron water main running along NB Service Road.

e. The NYSDOT Design-Builder shall install a new fire hydrant and associated

appurtenances on the west sidewalk of the Southbound Service road just north of the proposed 94th Avenue & Atlantic Avenue Bridge, to replace the existing fire hydrant located on the west sidewalk of Southbound Service Road towards the just north of Atlantic Avenue.

f. The NYSDOT Design-Builder shall install a new fire hydrant and associated

appurtenances on the west sidewalk of the Southbound Service road to south of 91st Avenue, to replace the existing fire hydrant located on the west sidewalk of Southbound Service Road.

g. The NYSDOT Design-Builder shall install a new fire hydrant and associated

appurtenances on the east sidewalk of the Northbound Service road just north of the proposed 94th Avenue & Atlantic Avenue Bridge, to replace the existing fire hydrant located on the east sidewalk of Northbound Service Road towards the just north of 94th Avenue.

h. The NYSDOT Design-Builder shall install two new 12’’ valves at the intersection

of Archer Avenue and the Northbound Service Road.

i. The NYSDOT Design-Builder shall install one new 12’’ valve just north of Atlantic Avenue along the Southbound Service Road.





II. Financial Responsibility (check appropriate boxes):

The facilities to be adjusted under the terms of this agreement are subject to Section 52 of the State Highway Law, and the cost of this adjustment is the sole responsibility of the owner.

Subdivision 24 of Section 10 of the State Highway Law enables the Commissioner of

Transportation to provide at the expense of the State, for adjustment to a municipally owned utility when such work is necessary as a result of State highway work. (Municipal Agreement required.)

Subdivision 24-b of Section 10 of the State Highway Law enables the Commissioner of

Transportation to participate in the necessary expenses incurred for adjustment of privately, publicly or cooperatively owned facilities, municipal utility facilities, or facilities of a corporation organized pursuant to the State Transportation Corporations Law. (Privately Owned Property Agreement or Reimbursement Agreement required.)


Transportation upon the request of a municipality, to perform for and at the expense of such municipality specified work to be included within a State-let contract. (Betterment Resolution required.)


Transportation, upon the request of a public utility corporation, to perform for and at the expense of such public utility corporation specified work to be included within a State-let contract.


Transportation to enter into an agreement to reimburse with public funds the owner for necessary expenses incurred as a result of this adjustment, or to replace the facilities in kind.

The owner will not claim reimbursement for that betterment portion of the work but will duly account for it as required by applicable NYSDOT and FHWA procedures.

The owner agrees to comply with the requirements of the NYSDOT Utility Reimbursement

Procedure and FHWA Federal-Aid Policy Guide Part 645 with the respect to salvage and depreciation credits when applicable.

V. General Covenants

The owner hereby agrees to accept full title and responsibility for the adjusted facility in writing upon satisfactory completion of the work. Such acceptance will acknowledge the owner’s responsibility to maintain the facility in accordance with all applicable codes, standards and regulations, including his obligation, where applicable, to remove any or all of the facility from the highway at the order of the Commissioner of Transportation, all in accordance with the Rules and Regulations Governing the Accommodation of Utilities within the State Highway Right-of-Way. All compensable claims covered by this agreement will be included in one of the following:

A. Privately Owned Property Agreement executed prior to the performance of the work. B. Municipal Agreement executed prior to performance of the work.





C. Reimbursement Agreement executed prior to performance of the work. D. Such other agreement as approved by NYSDOT Office of Legal Affairs.

necessitates the adjustment of utility facilities as hereinafter described (the “Project”), the owner, New York City Department of Environmental Protection, of said facilities herewith agrees with the State of New York acting through the Commissioner of Transportation that this agreement shall apply to the accommodation of these utility facilities. Any adjustment of said facilities will be accomplished under the terms of this agreement, in accordance with the Rules and Regulations Governing the Accommodation of Utilities within the State Highway Right-of-Way and in accordance with the contract plans, specifications, proposal, amendment(s) or change order(s). The work described herein is subject to change pending the design details and schedule developed by New York State Department of Transportation’s Design-Builder. The said Design-Builder will coordinate with the owner in developing a Final Utility Work Agreement to be entered into by the owner, the Design-Builder and New York State Department of Transportation. I. Existing Facilities The existing New York City Department of Environmental Protection Sewer facilities presently located in Queens County, New York within the New York State Right of Way as shown on the plans for the proposed transportation project are to be adjusted as follows. Queens BIN 1055699 94th Avenue & Atlantic Avenue over Van Wyck Expressway (I-678)

• To the west of a manhole on the northern part of the SB Service Road and Atlantic Avenue intersection, a 12” concrete pipe sanitary sewer line runs in the WE direction along Atlantic Avenue.

o A 12” vitrified clay pipe storm sewer line runs in the NW-SE direction, between the same manhole and a catch basin on the north side of Atlantic Avenue.

o A 12” reinforced concrete pipe runs in the NE-SW direction between the same manhole and a catch basin on the eastern corner of Atlantic Avenue and the SB Service Road.

• To the west of a manhole in the middle of the SB Service Road and Atlantic Avenue intersection, A 12” vitrified clay pipe sanitary sewer line runs in the WE direction along Atlantic Avenue.

o A 12” vitrified clay pipe storm sewer line runs in the SW-NE direction between the same manhole and a catch basin on the south side of Atlantic Avenue.





• A 36” reinforced concrete pipe combined sewer overflow line running NS on the SB Service Road passes through the intersection.

• To the west of a manhole on the southern part of the NB Service Road and 94th Street intersection, a 15” unknown storm sewer line runs EW in the direction along 94th Street.

o A 15” vitrified clay pipe storm sewer line runs NS from the same manhole along the NB Service Road.

All New York City Department of Environmental Protection facilities listed above which are not affected by the replacement of 94th Avenue & Atlantic Avenue bridge shall be supported, protected and maintained within work area by NYSDOT Design-Builder. NYSDOT Design-Builder Scope:

a. The NYSDOT Design-Builder shall permanently relocate both of the existing 12” vitrified clay pipe storm sewer pipe located near the north side of the SB Service Road and Atlantic Avenue intersection and near the south side of the intersection. The NYSDOT Design-Builder shall replace existing drainage structures within pavement reconstruction limits in their entirety (new drainage structures, frames, grates, and storm pipe) and provide supplemental storm sewer facilities as required for proposed roadway/bridge work in accordance with the New York State Department of Transportation Highway Design Manual (NYSDOT HDM) Chapter 8 and New York State Department of Environmental Conservation (NYSDEC). The alignment of the New York City Department of Environmental Protection facilities shall be coordinated with New York City Department of Environmental Protection and constructed in accordance to all applicable New York City Department of Environmental Protection standards BY THE NYSDOT DESIGN-BUILDER.

b. The NYSDOT Design-Builder shall permanently relocat the existing 36” reinforced concrete sanitary sewer pipe west of the proposed abutment so that a minimum of 6’ clear horizontal space is provided between proposed structural features and the outside of the relocated reinforced concrete pipe. The alignment of the New York City Department of Environmental Protection facilities shall be coordinated with New York City Department of Environmental Protection and constructed in accordance to all applicable New York City Department of Environmental Protection standards BY THE NYSDOT DESIGN-BUILDER.

c. The NYSDOT Design-Builder shall clean and conduct a video inspection on the

existing underground storm sewer facilities within the pavement reconstruction limits and up to the nearest upstream and downstream manholes beyond the pavement reconstruction limits in accordance with all applicable New York City Department of Environmental Protection standards and specifications. The cleaning and video inspection shall be coordinated with New York City Department of Environmental Protection BY THE NYSDOT DESIGN-BUILDER.

d. The NYSDOT Design-Builder shall clean and conduct a video inspection on the

existing underground sanitary sewer facilities within the pavement reconstruction limits and up to the nearest upstream and downstream manholes beyond the pavement reconstruction limits in accordance with all applicable New York City





Department of Environmental Protection standards and specifications. The cleaning and video inspection shall be coordinated with New York City Department of Environmental Protection BY THE NYSDOT DESIGN-BUILDER.

Long Island Rail Road over Southbound Service Road

• A 24” reinforced concrete sanitary sewer pipe runs between three manholes north of the LIRR bridges in the NS direction of the South Service Road.

• A 36” reinforced concrete sanitary sewer pipe runs between the same manhole at the north end of the LIRR bridges between two manholes under the bridges and two more manholes south of the bridges in the NS direction of the South Service Road connecting up to the Atlantic Avenue intersection.

• Two 28” unknown storm sewer lines run from catch basins to a sanitary manhole under the center of the LIRR bridges in the NW-SE direction and the NE-SW direction respectively on the South Service Road.

• An 18” unknown storm sewer line runs in EW direction under the SB VWE lanes between a manhole on the SB Service road and a manhole under the SB VWE lanes.

o This 18” storm sewer lines connects to the 36” sanitary sewer pipe and the 54” unknown storm sewer pipe.

All New York City Department of Environmental Protection facilities listed above are unaffected by the replacement of LIRR bridges and shall be supported, protected and maintained within work area by NYSDOT Design-Builder. NYSDOT Design-Builder Scope:

a. The NYSDOT Design-Builder shall replace existing drainage structures within pavement reconstruction limits in their entirety (new drainage structures, frames, grates, and storm pipe) and provide supplemental storm sewer facilities as required for proposed roadway/bridge work in accordance with the New York State Department of Transportation Highway Design Manual (NYSDOT HDM) Chapter 8 and New York State Department of Environmental Conservation (NYSDEC). Type 3 Catch Basins shall be placed on the west side of the service road to the north and to the south of the proposed LIRR bridge footings and a Special Shallow Catch Basin shall be placed at the low point underneath of the bridges on the west side. Proposed storm sewer downspouts from the LIRR bridges shall be connected to the proposed storm sewer facilities within the service road. The alignment of the New York City Department of Environmental Protection facilities shall be coordinated with New York City Department of Environmental Protection and constructed in accordance to all applicable New York City Department of Environmental Protection standards BY THE NYSDOT DESIGN-BUILDER.

b. The NYSDOT Design-Builder shall permanently relocated the existing 24” and 36” reinforced concrete sanitary sewer pipes west of the proposed wall so that a minimum of 6’ clear horizontal space is provided between proposed structural features and the outside of the relocated reinforced concrete pipes. The alignment of the New York City Department of Environmental Protection facilities shall be coordinated with New York City Department of Environmental





Protection and constructed in accordance to all applicable New York City Department of Environmental Protection standards BY THE NYSDOT DESIGN-BUILDER.

c. The NYSDOT Design-Builder shall clean and conduct a video inspection on the existing underground storm sewer facilities within the pavement reconstruction limits and up to the nearest upstream and downstream manholes beyond the pavement reconstruction limits in accordance with all applicable New York City Department of Environmental Protection standards and specifications. The cleaning and video inspection shall be coordinated with New York City Department of Environmental Protection BY THE NYSDOT DESIGN-BUILDER.

d. The NYSDOT Design-Builder shall clean and conduct a video inspection on the

Long Island Rail Road over Northbound Service Road

• A 10” unknown storm sewer pipe runs between catch basins at the intersection of Archer Avenue and North Service Road in the NW-SE direction and connects to a manhole in the NE-SW direction.

o An 18” tile storm sewer pipe runs between a manhole north of the Archer Avenue intersection and the same manhole.

o An 18” unknown storm sewer pipe runs between the same manhole in the EW direction to a manhole in the main trunkline of the SB direction of the Van Wyck Expressway.

• A 12” unknown storm sewer pipe runs between two catch basins in the WE direction of the North Service Road.

o A 12” vitrified clay storm sewer pipe runs between the same catch basin and a manhole in the SN direction of the North Service Road.

o A 12” vitrified clay storm sewer pipe runs between the same manhole and the same manhole in the main trunkline on of the Van Wyck Expressway in the SE-NW direction.

All New York City Department of Environmental Protection facilities listed above are unaffected by the replacement of LIRR bridges and shall be supported, protected and maintained within work area by NYSDOT Design-Builder.






a. o Another 15” unknown storm sewer runs between a catch basin and the same manhole in the NW-SE direction of the SB side of the Van Wyck Expressway.

• To the south of the LIRR bridges a 15” reinforced concrete storm sewer pipe runs between three catch basins and a manhole in the EW direction of the Van Wyck Expressway connecting to the main trunkline in the center of the SB side of the expressway.

o A 15” reinforced concrete storm sewer pipe runs between a catch basin and the same manhole in the WE direction of the Van Wyck Expressway.





• A 54” unknown storm sewer pipe trunkline runs between five manholes under the LIRR bridges and the Atlantic Avenue bridge in the NS direction of the SB side of the Van Wyck Expressway.

• A 15” reinforced concrete pipe connects three catch basins in the EW direction of the NB side of the Van Wyck Expressway.

o A 15” reinforced concrete storm sewer pipe runs between the same catch basin and a manhole in the trunkline of the SB direction of the expressway in the SE-NW direction.

o A 15” reinforced concrete storm sewer pipe runs between a catch basin and the same manhole in the SW-NE direction.

• A 72” unknown storm sewer pipe runs between the same manhole and another further south of the Atlantic Avenue bridge in the NS direction of the Van Wyck Expressway.

All New York City Department of Environmental Protection facilities listed above are unaffected by the replacement of LIRR bridges and shall be supported, protected and maintained within work area by NYSDOT Design-Builder.

The NYSDOT Design-Builder shall replace existing drainage structures within the outside shoulders within pavement reconstruction limits in their entirety (new drainage structures, frames, grates, and storm pipe) and provide supplemental storm sewer facilities as required for proposed roadway/bridge work for the ultimate Contract 3 VWE configuration within the Contract 2 Project limits in accordance with the New York State Department of Transportation Highway Design Manual (NYSDOT HDM) Chapter 8 and New York State Department of Environmental Conservation (NYSDEC). The NYSDOT Design-Builder shall clean and conduct a video inspection on the existing underground storm sewer facilities within the Project limits limits and up to the nearest upstream and downstream manholes beyond the Project limits in accordance with all applicable New York City Department of Environmental Protection standards and specifications. necessitates the adjustment of utility facilities as hereinafter described (the “Project”), the owner, New York City Fire Department (“FDNY” or “Owner”), of said facilities herewith agrees with the State of New York acting through the Commissioner of Transportation that this agreement shall apply to the accommodation of these utility facilities. Any adjustment of said facilities will be accomplished under the terms of this agreement, in accordance with the Rules and Regulations Governing the Accommodation of Utilities within the State Highway Right-of-Way and in accordance with the contract plans, specifications, proposal, amendment(s) or change order(s). The work described herein is subject to change pending the design details and schedule developed by New York State Department of Transportation’s design-builder. The said Design-Builder will coordinate with the owner in developing a Final Utility Work Agreement to be entered by the owner, the Design-Builder and New York State Department of Transportation. The existing New York City Fire Department (FDNY) facilities are to be abandoned, removed, protected/supported or replaced as defined in this agreement. I. Existing Facilities The existing New York City Fire Department facilities presently located in Queens County; New York within the New York State Right of Way as shown on the plans for the proposed transportation project are to be adjusted as follows: Fire Department cables are installed in both Verizon’s and Fire Department’s conduit systems underground, and/or on the bridges, and/or some aerial facilities are present. These facilities must be supported and properly protected during construction. If this cannot be achieved, relocation must be performed prior to construction. FDNY is not a member of the one call system and will not be notified by them. To request street mark outs of fire communications underground facilities, the Design-Builder must contact Plant Operations Engineering at (718) 281-3846 or (718) 281-3933 at least one (1) month prior to commencement of work. For this agreement, the FDNY will sell the State’s Design-Builder the necessary materials to install the proposed FDNY utility. The State’s Design-Builder shall coordinate all material deliveries with the FDNY and shall schedule all necessary inspections during construction.





Queens BIN 1055699 94th Avenue & Atlantic Avenue over Van Wyck Expressway (I-678) Existing Facilities:

• A 3” wrought iron/galvanized steel FDNY conduit runs E-W towards the south fascia of the 94th Avenue & Atlantic Avenue Bridge.

• On the SB Service Road and Atlantic Avenue intersection, a 3” FDNY conduit runs east from an FDNY fire alarm post towards the west approach of the bridge.

All New York City Fire Department facilities listed above which are not affected by the replacement of 94th Avenue & Atlantic Avenue Bridge shall be supported, protected and maintained within the work area by the NYSDOT Design-Builder. FDNY Scope: The Fire Department shall de-energize the fire department cables before construction starts to allow the Design-Builder to remove the underground conduit and cable before demolition. FDNY shall transfer the fire alarm box from the existing post to the new post.


a. The NYSDOT Design-Builder shall permanently install FDNY type A manhole with frame and cover towards the southwest corner of the 94th Avenue and Southbound Van Wyck Service Road intersection, approximately 12’ to the west of an existing FDNY manhole at the intersection of Atlantic Avenue and SB Service Road. The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

b. The NYSDOT Design-Builder shall permanently install 1-4” galvanized steel

conduit and 1-4 pair fire alarm cable towards the south fascia of the new 94th Avenue & Atlantic Avenue Superstructure. The steel conduit can transition to schedule 40 U.L. 651 PVC conduit via couplings beyond the bridge abutments. The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

c. The NYSDOT Design-Builder shall leave 10 feet of slack of 4 pair cable in the newly installed Type A FDNY manhole towards the west abutment and the existing FDNY manhole towards the east abutment and hermetically seal the ends of cable for the FDNY Communication Electricians to make the final connection.

d. The NYSDOT Design-Builder shall permanently remove existing 3” wrought

iron/galvanized steel conduit towards the south fascia of the 94th Avenue & Atlantic Avenue Bridge.





e. The NYSDOT Design-Builder shall install a new fire alarm post & subbase, pedestal bumpers, and a 12 wire terminal box located toward the southwest corner of the 94th Avenue and the Southbound Van Wyck Service Road intersection, approximately 12’ west of the existing fire alarm box (where it shall be clear of proposed ADA crosswalks).The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

f. The NYSDOT Design-Builder shall install 1-4” dia. schedule 40 U.L. 651 PVC

conduit, and 1-4 pair fire alarm cable from the newly installed type A FDNY manhole located toward the southwest corner of the 94th Avenue and Southbound Van Wyck Service Road intersection to a new fire alarm post located toward the southwest corner of the 94th Avenue and Southbound Van Wyck Service Road intersection. The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

g. The NYSDOT Design-Builder shall leave 10 feet of slack of 4 pair cable in newly installed type A FDNY manhole and hermetically seal the end of cable for the FDNY Communication Electricians to make the final connection. The Design-Builder shall terminate the open end of the cable in the fire alarm post and terminate the cable with enough slack to make the final connections.

h. The NYSDOT Design-Builder shall remove the existing fire alarm post located toward the southwest corner of the 94th Avenue and the Southbound Van Wyck Service Road intersection.

i. The NYSDOT Design-Builder shall notify FDNY 7 days prior to any work being doing on their facilities.

Northbound Service Road from Atlantic Avenue to 91st Avenue (Van Wyck Expressway under Long Island Railroad Bridges (I-678)) Existing Facilities:

• On the NB Service Road, a 3” FDNY conduit runs N-S between 95th Avenue and Archer Ave. and passes through the NB Service Road and 94th Avenue intersection.

• A 3” FDNY conduit runs on the east sidewalk of the NB Service Road between 94th Avenue and Archer Avenue.

o A branch connects to an FDNY fire alarm post on the southeast corner of the NB Service Road and Archer Avenue intersection from a manhole in the intersection.

All New York City Fire Department facilities listed above which are not affected by the replacement of the LIRR Bridge substructures shall be supported, protected and maintained within the proposed work area of LIRR Bridges by the NYSDOT Design-Builder.






a. The NYSDOT Design-Builder shall permanently install FDNY type A manhole with

frame and cover on the Northbound Service Road east sidewalk, approximately 310’ to the north of existing FDNY manhole at the intersection of Atlantic Avenue and Northbound Service Road. The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

b. The NYSDOT Design-Builder shall permanently install 1-4” schedule 40 U.L. 651 PVC conduit, and 1-10 pair fire alarm cable between the existing manhole at the intersection of Atlantic Avenue and Northbound Service Road and the newly installed FDNY Type A manhole. The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

c. The NYSDOT Design-Builder shall leave 10 feet of slack of 10 pair cable in the

newly installed FDNY type A manhole and the existing FDNY manhole and hermetically seal the end of cable for the FDNY Communication Electricians to make the final connection.

d. The NYSDOT Design-Builder shall permanently install FDNY type A manhole with frame and cover at the middle of Archer Avenue Boulevard and Van Wyck Northbound Service Road intersection. The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

e. The NYSDOT Design-Builder shall permanently install 1-4” schedule 40 U.L. 651

g. The NYSDOT Design-Builder shall permanently install FDNY slotted type A

manhole with frame and cover on east sidewalk of the Northbound Service road, approximately 54’ to the north of newly installed FDNY type A manhole at the middle of Archer Avenue Boulevard and Van Wyck Northbound Service Road intersection. The alignment of the FDNY facilities shall be coordinated with FDNY





and constructed in accordance to all applicable New York City Fire Department standards.

h. j. The NYSDOT Design-Builder shall permanently remove existing FDNY 3” conduit and cables toward the east sidewalk of the NB Service Road between 94th Avenue and Archer Avenue.

k. The NYSDOT Design-Builder shall permanently remove existing FDNY manhole

toward the east sidewalk of the Northbound Service Road under the Atlantic 6 LIRR Bridge.

l. The NYSDOT Design-Builder shall permanently remove existing FDNY manhole

located at the middle of Archer Avenue Boulevard and Van Wyck Northbound Service Road intersection.

j. The NYSDOT Design-Builder shall install a new fire alarm post & subbase,

pedestal bumpers, and a 12 wire terminal box located toward the southeast corner of the Archer Avenue and the Northbound Van Wyck Service Road intersection, approximately 12’ east of the existing fire alarm box (where it shall be clear of proposed ADA crosswalks).The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

k. The NYSDOT Design-Builder shall install 1-4” dia. schedule 40 U.L. 651 PVC

conduit, and 1-4 pair fire alarm cable from the newly installed FDNY type A manhole located toward the middle of Archer Avenue Boulevard and Van Wyck Northbound Service Road intersection to a new fire alarm post located toward the southeast corner of the Archer Avenue and the Northbound Van Wyck Service Road intersection. The alignment of the FDNY facilities shall be coordinated with FDNY and constructed in accordance to all applicable New York City Fire Department standards.

l. The NYSDOT Design-Builder shall leave 10 feet of slack of 4 pair cable in newly installed Type A FDNY manhole and hermetically seal the end of cable for the





FDNY Communication Electricians to make the final connection. The Design-Builder shall terminate the open end of the cable in the fire alarm post and terminate the cable with enough slack to make the final connections.

m. The NYSDOT Design-Builder shall remove the existing fire alarm post located toward the southeast corner of the Archer Avenue and the Northbound Van Wyck Service Road intersection.

necessitates the adjustment of utility facilities as hereinafter described (the “Project”), the owner, Port Authority of New York and New Jersey (“Port Authority”), of said facilities herewith agrees with the State of New York acting through the Commissioner of Transportation that this agreement shall apply to the accommodation of these utility facilities. Any adjustment of said facilities will be accomplished under the terms of this agreement, in accordance with the Rules and Regulations Governing the Accommodation of Utilities within the State Highway Right-of-Way and in accordance with the contract plans, specifications, proposal, amendment(s) or change order(s). The work described herein is subject to change pending the design details and schedule developed by New York State Department of Transportation’s design-build contractor. The said design-build contractor will coordinate with the owner in developing a Final Utility Work Agreement to be entered into by the owner, the contractor and New York State Department of Transportation. I. Existing Facilities The existing Port Authority facilities presently located in Queens County; New York within the New York State Right of Way as shown on the plans for the proposed transportation project are to be adjusted as follows: The following requirements are preliminary and shall apply to the NYSDOT Design-Builder scope of work.

1. Provide a minimum of 1’-4’’ clearance from the existing utility backfill envelope to any new sheeting/shoring and subsurface concrete structures. Design-Builder shall reference the typical construction clearance drawing DWG. SK-CLEARANCE in the Reference Documents section of the RFP. The Design-Builder shall coordinate with the utility owner if new installations are proposed within the 1’-4’’ minimum clearance required.

2. There are no requirements for vibration limitations.

3. 3’’ dia. PVC conduits typically run with and just above or below the 138-kV pipe. The maximum unsupported length of these conduits during any open excavation operations is 6 feet. Reference the temporary support detail drawing DWG. SK-SUPPORT in the Reference Documents section of the RFP.

4. 8’’ dia. Schedule 40 steel pipe encases the 138-kV cable in a high-pressure gas filled envelope. This pipe has a protective exterior coating and includes cathodic protection. The maximum unsupported length of this pipe during any open excavation operations is 10 feet. Design-Builder shall reference the temporary support detail drawing DWG. SK-SUPPORT in the Reference Documents section of the RFP.

5. Provide a minimum of 1’-4’’ clearance from the existing utility backfill envelope to any new underground utility piping for gas, water, and sewer systems. Design-Builder shall reference the typical construction clearance drawing DWG. SK-CLEARANCE in the Reference Documents section of the RFP.

6. For steam mains/services six inches and over in size, duct bank systems of six ducts or more and all other pipe type feeders that are external heat sources provide a minimum face-to-face separation of not less than twelve feet for horizontal runs nor less than two feet for right-angle crossings.

7. For steam mains under six inches in size and for power duct bank systems of four ducts or less, the separation shall be not less than six feet in a horizontal direction and 1.5 feet in a vertical direction.

8. Limit loading to standard AASHTO H-20 loading conditions from existing surface without prior approval.

9. No specific utility shutdown requirements are identified at this time. This will be reviewed again, if required, when the final limits of all facility rework have been determined by the Design Builder.

10. Material lead time is anticipated to be 10-12 months, if required.

11. There is no potential slack in this system for the underground steel pipe. There is some flexibility to allow for deflection or offset of the 3’’ dia. PVC piping if there is a demonstrated need by the Design Builder.

12. Elevation changes are discouraged due to the amount of horizontal spacing required to accommodate the vertical differential. This will generally only be possible in new utility sections of sufficient length where changes in elevation can be incorporated in the design of the new underground section.

13. Conduits do not need to be protected from water within the trench during construction.

14. The conduits should be protected from sparks or other damaging byproducts of welding that must take place nearby.

15. There are no seasonal restrictions assuming that the line is not shut down at any point during construction.

16. There are no set monitoring criteria.

17. It is preferred that no debris be left below the conduits that will decay, such as wood that would be used to support the line(s) during construction.

18. When exposing the line(s), the existing coating will need to be protected and maintained. This coating is necessary to prevent corrosion of the cables. If the coating is damaged during construction, then the Design Builder s responsible for repairing the coating to the satisfaction of the Port Authority utilizing their coating repair criteria. Refer to the coating standards in the Reference Documents section of the RFP.

19. The backfill material shall meet the requirement provided by the owner and follow Con Edison Standards. See the requirements in the Reference Documents in the RFP.

20. The Design-Builder shall coordinate with Port Authority for the inspection of the existing 138kV Utility feature as well as the two existing PVC communication conduits prior to backfilling and post construction. The Design-Builder shall give Port Authority a notice 72 hours prior to backfilling the exposed utility features.

Queens At the Intersection of 94th Avenue/Atlantic Avenue and the Northbound Service Road Existing Facilities:

• 1-8” dia. HPP Steel pipe with 138k-V conductor (gas filled) and 2-3” dia. PVC conduits within the NB Service Road.

The Port Authority facility listed above shall be supported, protected and maintained within the proposed work area of 94th Avenue/Atlantic Avenue Bridge and the northbound service road intersection by the NYSDOT Design-Builder. The alignment of the Port Authority facilities shall remain unchanged. Northbound Service Road from Atlantic Avenue north to 91st Avenue under Long Island Railroad Bridges (I-678)) Existing Facilities:

• 1-8” dia. HPP Steel pipe with 138 kV conductor (gas filled) and 2-3” dia. PVC conduits run within the NB Service Road

The Port Authority facility listed above shall be supported, protected and maintained within the proposed work area under the existing Long Island Railroad Bridges by the NYSDOT Design-Builder. The alignment of the Port Authority facilities shall remain unchanged. The existing shallow cover protection which currently is installed over the existing Port Authority facility shall be maintained and protected. If the shallow cover protection needs to be removed and reinstalled under Contract 2, the Design Builder shall coordinate with representatives from Port Authority to determine the exact limits.

1/3 Bridge, down a riser and continues south along the west abutment wall of the LIRR Bridges, through a 4’’ EMT conduit and into a pull box just north of the existing Atlantic 6 LIRR Bridge.

The MCI Communications facilities listed above shall be supported, protected and maintained within the proposed work area of the Long Island Railroad Bridges by the NYSDOT Design-Builder.






a. The NYSDOT Design-Builder shall detach the existing MCI cable from existing Pole X, located in the LIRR property just south of the Staples store near the Southbound Service Road. The Design-Builder shall protect the MCI cable in a temporary trough or split duct in a temporary steel casing on the ground from the wingwall to Pole X; the full length of the exposed cable. The Design-Builder shall install a split duct riser pipe on Pole X and run the existing cable through. The type of temporary protection that is to be installed shall be coordinated with MCI Communications. NYSDOT Design-Builder shall be responsible for the materials required for the temporary protection.

b. Once the new LIRR Mainline 1/3 Bridge is installed, the Design-Builder shall remove the cable from the temporary steel casing and attach the cable back onto Pole X up a riser at an elevation where it was previously attached in existing conditions.

c. The NYSDOT Design-Builder shall notify MCI a minimum of three weeks in advance of the start of construction work.

Any adjustment of said facilities will be accomplished under the terms of this agreement, in accordance with the Rules and Regulations Governing the Accommodation of Utilities within the State Highway Right-of-Way and in accordance with the contract plans, specifications, proposal, amendment(s) or change order(s). The work described herein is subject to change pending the design details and schedule developed by New York State Department of Transportation’s design-builder. The said Design-Builder will coordinate with the owner in developing a Final Utility Work Agreement to be entered by the owner, the Design-Builder and New York State Department of Transportation. The existing Con Edison facilities are to be abandoned, removed, protected/supported or replaced as defined in this agreement. I. Existing Facilities The existing Con Edison Company facilities presently located in Queens County, New York within the New York State Right of Way as shown on the plans for the proposed transportation project are to be adjusted as follows for a fixed price lump sum: $ XXXXXXXXX The following requirements are preliminary and shall apply to the NYSDOT Design-Builder scope of work for this contract;

1. Design–Builder shall maintain and provide 24/7 access to all existing and proposed Con Edison Manholes to Con Edison personnel.

2. Vibration levels shall not exceed 0.5 in/sec. If maximum levels are approached construction activities shall be halted and means and methods shall be reevaluated.

3. The Design–Builder shall conduct their operations in such a manner as not to damage any buried utilities. This includes but is not limited to crane placements, material handling and excavation. In developing and executing their work plan, the Design–Builder shall insure that the surface





pressure within a lateral distance of 10 feet from the centerline of any buried utility does not exceed the limits specified:

a. Electric Ducts: 3.50ksf. b. 345Kv feeder and return lines: 3.50 ksf.

The following requirements are preliminary and shall apply to the NYSDOT Design-Builder scope of work at or near the existing Jamaica Substation located Archer Avenue, on the Northbound Service Road:

1. All Mobile Equipment used by the Design–Builder shall maintain a minimum 20’ clearance from the Jamaica Substation fence.

2. All other activities by Design–Builder shall maintain a minimum 15’ clearance from the Jamaica Substation fence.

3. No storage of Design–Builder’s materials or equipment is allowed within 5’ of the Jamaica Substation fence.

4. No picks or swings with large equipment should break the plane of the fence line, preferably should not break plane of curb line.

5. Design–Builder shall note that the existing fence has a security system, any vibration of fence will trip the alarm systems.

6. Design–Builder shall not block the existing rollup gate on Archer Ave between Van Wyck Expressway service road and 138th St, this gate requires 24/7 access.

7. Design-Builder shall maintain sidewalk access along Archer Ave in order to provide Con Edison personnel entry into Jamaica Substation building.

8. Design–Builder shall provide at least 2 weeks’ notice prior to Con Edison prior to any construction activities in the vicinity of the substation.

9. Design–Builder shall notify Con Edison and involve them in all meetings pertaining to work in the vicinity of the Jamaica Substation, including but not limited to meetings between different agencies, Mainline tracks roll-in and roll-out work, proposed Con Edison infrastructure.

Con Edison will not take electric line outages during summer peak load period, which is June 1st to September 15th Con Edison will furnish conductors, conduits, manholes, shallow cover protection steel plates, etc. Con Edison will remove all cable and equipment from manholes/boxes/conduits prior to removal/abandoning facilities.





NYSDOT Design-Builder Scope – Bridge Replacement:

a. The NYSDOT Design-Builder to relocate existing 2-4” fiber ducts from M-17273 to M-8291 by installing, rodding and roping 2-5” Precast Concrete ducts (PCD) between M-New5 and M-8291. Existing conduits to be removed/ abandoned as necessary. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

b. The NYSDOT Design-Builder to relocate existing 6-4” concrete duct 4-5” concrete

duct conduits from MH #M-17273 to MH #M-14180 by installing, rodding and roping 6-5” Precast Concrete ducts (PCD) between M-New 5 and M-New 6. Existing conduits to be removed/ abandoned as necessary. New conduit lane and manhole locations shall be coordinated with Con Edison and determined in the field.

c. The NYSDOT Design-Builder shall relocate existing M-14180 by installing new

manhole M-New6 and remove/abandon existing M-14180. New manhole shall be precast cable manhole – Type M 11-6, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.

d. The NYSDOT Design-Builder to relocate existing 4-4” concrete ducts from M-8292

to M-14180 by installing, rodding and roping 4-5” Precast Concrete ducts (PCD) between M-8292 and M-New6. Existing conduits to be removed/ abandoned as necessary. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

e. The NYSDOT Design-Builder to install, rod and rope 6-5” Precast Concrete ducts

(PCD) between M-8291 and M-New6. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field

f. The NYSDOT Design-Builder shall enlarge existing manhole M-8291. Existing

dimensions of manhole are 11’-6”X 4’-6”X 6’-6”. Enlarged manhole dimensions shall be 14’-0”X 4’-6”X6’-6” or as directed by Con Edison field representative in accordance to all applicable Con Edison standards and specifications.

g. The NYSDOT Design-Builder shall install, rod and rope 4-5” steel conduits on the

new 94th Ave. & Atlantic Ave. Superstructure towards the south fascia from MH #M-8292 to MH #M-11217. Steel conduits shall transition to precast concrete ducts (PCD) beyond the approach slab.

h. The NYSDOT Design-Builder shall install, rod and rope 6-5” steel conduits on the new 94th Ave. & Atlantic Ave. Superstructure towards the north fascia from MH #M-8291 to MH #M-8262. Steel conduits shall transition to precast concrete ducts (PCD) beyond the approach slab.

i. The NYSDOT Design-Builder shall permanently abate, remove and dispose of

existing 4-4” transite ducts located toward the north fascia and 4-4” transite ducts located toward the south fascia of the Atlantic Avenue Bridge Superstructure.





Transite conduit removal shall be coordinated with Con Edison and performed in accordance Con Edison standards for handling and abatement of ACM.

j. The alignment of the Con Edison facilities shall be coordinated with Con Edison and other proposed utilities and constructed in accordance to all applicable Con Edison standards and specifications. NYSDOT Design-Builder shall submit as-built drawings for all new ducts installed to Con Edison Field Representative, provide survey of location against new curb alignment and provide exact dimensions for rodding report.

k. The NYSDOT Design-Builder shall supply utility supports and appurtenances

necessary to attach the conduits to the bridge in accordance to all applicable Con Edison standards and specifications.

l. The NYSDOT Design-Builder shall furnish all materials that are not being

provided by Con Edison. m. The NYSDOT Design-Builder shall notify Con Edison of installation schedule at

least 30 days before materials are required on site.

Anticipated Timeframe for NYSDOT Design-Builder Scope:

Based on historic data for similar scope, it is anticipated the proposed work shall require the following:

a. Once the conduit is installed, rodded and roped by the NYSDOT Contactor and accepted by Con Edison.

i. Con Edison would require 4 weeks to pull a section of cable. ii. A section of cable is from manhole to manhole.

iii. The section can have one cable pull or multiple cable pulls, the timeframe would still be 4 weeks per section.

b. Once all the cable is pulled Con Edison would then require 4 weeks for each primary feeder outage. Since the feeders are all part of the same network only one feeder outage can be taken at a time for reliability concerns.

i. 94th Avenue & Atlantic Avenue shall have 3 primary feeders in proposed condition, time for feeder splicing, de-energizing, re-energizing, and testing shall be 12 weeks.

c. Con Edison requires a total of 16 weeks to complete the cable work at these locations.

New manhole shall be precast cable manhole – Type M 11-6, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.

c. The NYSDOT Design-Builder to relocate existing 6-4” Concrete ducts and 4-5” PVC ducts from M-14180 to M-14177 by installing, rodding and roping 10-5” Precast Concrete ducts (PCD) between M-New6 and M-New7. Existing conduits to be removed/ abandoned as necessary. Within the LIRR bridge area (approx. STA. SB 169+50 to SB 172+50) these PCD conduits shall have phenolic board and 3/8” steel plates installed between the proposed and existing conduit when separation is less than 10 feet. Phenolic board will be installed in 2 layers with a 3/8” steel plate in between and the phenolic board will be overlapped and staggered in order to minimize seams and shifting. The entire trench shall have horizontal steel plates installed in accordance to all applicable Con Edison standards and specifications. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

d. The NYSDOT Design-Builder to relocate existing 6-4” Concrete ducts from M-

14177 to M-8036 by installing, rodding and roping 4-5” Precast Concrete ducts (PCD) between M-New7 and M-8036. Existing conduits to be removed/ abandoned as necessary. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

e. The NYSDOT Design-Builder shall relocate existing M-17006 by installing new

manhole M-New8 south of the 91st Avenue and Southbound Service Road intersection and installing, rodding and roping 6-5” Precast Concrete Ducts (PCD) from M-279 to M-New 8 and remove/ abandon existing M-17006. New manhole shall be precast cable manhole – Type M 11-6, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.

f. The NYSDOT Design-Builder to relocate existing 4-4” Concrete ducts from M-

14177 to M-17006 by installing, rodding and roping 6-5” Precast Concrete ducts (PCD) between M-New7 and M-New8. Existing conduits to be removed/ abandoned as necessary. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

g. The NYSDOT Design-Builder to relocate existing 2-4” Concrete ducts from M-

17006 to VS-9104 and VS-8779 by installing, rodding and roping 2-5” Precast Concrete ducts (PCD) between M-New8 and VS-9104 and VS-8779 (1 conduit to each vault, common trench). Existing conduits to be removed/ abandoned as





necessary. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

h. Due to reduction of sidewalk, The NYSDOT Design-Builder shall relocate existing

Bus Compartment by installing new field constructed manhole M-New12 and remove/ abandon existing bus compartment. New manhole location shall be coordinated with Con Edison and determined in field.

i. The NYSDOT Design-Builder to relocate existing 8-4” Concrete ducts from M-142

to Bus Compartment by installing, rodding and roping 8-4” Precast Concrete ducts (PCD) between M-142 and M-New12. Existing conduits to be removed/ abandoned as necessary. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

j. The NYSDOT Design-Builder shall install new manhole M-New11. Manhole M-

New11 shall capture the conduit run from M-12947 to M-12948 to M-12949. The NYSDOT Design_Builder shall dig test pit to locate the existing 6-4” concrete conduit run from M-12948 to M-12947 and new manhole location shall capture these existing conduits. New manhole shall be field constructed cable manhole – Type M 11-6, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.

k. The NYSDOT Design-Builder shall install new manhole M-New9. Manhole M-New 9 shall capture the conduit run from M-20318 to M-12949. The NYSDOT Design-Builder shall dig test pit to locate the existing 4-4” fiber conduit run from M-12949 to M-20318 and new manhole location shall capture these existing conduits. New manhole shall be field constructed cable manhole – Type M 11-6, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.

l. The NYSDOT Design-Builder to relocate existing 6-4” Concrete ducts from M-12947 to M-12948 to M-12949 by installing, rodding and roping 8-5” Precast Concrete ducts (PCD) between M-New11 and M-New9. Existing conduits to be removed/ abandoned as necessary. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

m. The NYSDOT Design-Builder shall remove existing M-12948, due to proposed

retaining wall.

n. The NYSDOT Design-Builder shall relocate existing M-12949 by installing new manhole M-New10 and remove/ abandon existing M-12949. Manhole M-New10 shall capture the conduit run from M-8038. The NYSDOT Design-Builder shall dig test pit to locate the existing 4-4” fiber conduit run from M-12949 to M-8035 and new manhole location shall capture these existing conduits. New manhole shall be slotted precast cable manhole – Type M 11-6SL, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.





o. The NYSDOT Design-Builder shall install new manhole M-New14. New manhole shall be Precast cable manhole – Type M 11-6 with integral floor, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.

p. The NYSDOT Design-Builder shall install, rod and rope 6-5” Precast Concrete

ducts (PCD) between M-8262 (on 94th Avenue) and M-New14. These conduits shall bypass existing M-8327. Within the LIRR bridge area (approx. STA. NB 169+50 to NB 172+25) these PCD conduits shall have phenolic board and 3/8” steel plates installed between the proposed and existing conduit when separation is less than 10 feet. Phenolic board will be installed in 2 layers with a 3/8” steel plate in between and the phenolic board will be overlapped and staggered in order to minimize seams and shifting. The entire trench shall have horizontal steel plates installed in accordance to all applicable Con Edison standards and specifications. New conduit lane and manhole location shall be coordinated with Con Edison and determined in field.

q. The NYSDOT Design-Builder to relocate existing 8-4” Concrete ducts from M-

12948 to M-12949 by installing, rodding and roping 8-5” Precast Concrete ducts (PCD) between M-New 11 and M-New9. Existing conduits to be removed/ abandoned as necessary. Within the LIRR bridge area (approx. STA. NB 169+50 to NB 172+25) these PCD conduits shall have phenolic board and 3/8” steel plates installed between the proposed and existing conduit when separation is less than 10 feet. Within the LIRR bridge area these PCD conduits shall have phenolic board and 3/8” steel plates installed between the proposed and existing conduit when separation is less than 10 feet. Phenolic board will be installed in 2 layers with a 3/8” steel plate in between and the phenolic board will be overlapped and staggered in order to minimize seams and shifting. The entire trench shall have horizontal steel plates installed in accordance to all applicable Con Edison standards and specifications. #51318 to M-8327 by installing, rodding and roping 2-4” Precast Concrete ducts (PCD) to the east of the existing conduit run between Box #51318 and M-8327. Existing conduits to be removed/ abandoned as necessary. Within the LIRR bridge area these PCD conduits shall have phenolic board and 3/8” steel plates installed between the proposed and existing conduit when separation is less than

The NYSDOT Design-Builder shall dig test pit to locate the existing 9-4” fiber conduit run from M-652 to M-1427 and new manhole location shall capture these existing conduits. New manhole shall be field constructed cable manhole – Type M 11, with 11’-6” X 4’-6” X 6’-6” dimensions. New manhole location shall be coordinated with Con Edison and determined in field.

v. The NYSDOT Design-Builder shall install, rod and rope 6-5” Precast Concrete

ducts (PCD) between M-New14 and M-New13. New conduit lane and manhole locations shall be coordinated with Con Edison and determined in field.

necessitates the adjustment of utility facilities as hereinafter described (the “Project”), the owner, The Brooklyn Union Gas Company d/b/a National Grid NY (“National Grid” or “Owner”), of said facilities herewith agrees with the State of New York acting through the Commissioner of Transportation that this agreement shall apply to the accommodation of these utility facilities. Any adjustment of said facilities will be accomplished under the terms of this agreement, in accordance with the Rules and Regulations Governing the Accommodation of Utilities within the State Highway Right-of-Way and in accordance with the contract plans, specifications, proposal, amendment(s) or change order(s). The work described herein is subject to change pending the design details and schedule developed by New York State Department of Transportation’s design-builder. The said Design-Builder will coordinate with the owner in developing a Final Utility Work Agreement to be entered by the owner, the Design-Builder and New York State Department of Transportation. The existing National Grid facilities are to be abandoned, removed, protected/supported or replaced as defined in this agreement. I. Facilities The following requirements are preliminary and shall apply to the NYSDOT Design-Builder scope of work at all bridges

1. NYSDOT Design-Builder shall use extreme caution during its operation to avoid damaging any existing active gas facilities. The Design-Builder shall be financially responsible for any damage caused to National Grid facilities. National Grid retains the option to make repairs or to require the Design-Builder to make repairs to any damaged facility. All cost associated with such repairs shall be at the Design-Builder’s sole expense.

2. NYSDOT Design-Builder shall be responsible for the planning and provision of traffic control as required by National Grid to perform the gas installation until completion.

3. NYSDOT Design-Builder shall excavate and maintain main connection live gas openings (tie-in openings and cut & cap openings), and openings for welding at both ends of the bridge. The dimensions and locations for the openings shown in the attached drawings are approximate and shall be verified in the field by performing test holes as required by National Grid.

4. NYSDOT Design-Builder shall excavate and maintain main connection live gas openings (tie-in openings and cut & cap openings), and openings for welding for the proposed gas mains at the west service road under the LIRR bridges between 91st Avenue and Atlantic Avenue. The dimensions and locations for the openings shown in the attached sketch are approximate and shall be verified in the field by performing test holes as required by National Grid.

5. All excavated material shall become property of the NYSDOT Design-Builder and shall be disposed of in accordance with all applicable codes and standards.

6. NYSDOT Design-Builder shall sheet all excavations as per OSHA regulations. Design-Builder sheeting plans shall be approved and stamped by a P.E. licensed in the state of New York. Sheeting plans shall be submitted to National Grid for review and approval.

7. NYSDOT Design-Builder shall design, furnish and install all structural steel, including beams, channels, rods, hardware, etc. as required to support the new steel gas mains. Design drawings for structural steel





supports shall be approved and stamped by a P.E. licensed in the state of New York. Design drawings shall be submitted to National Grid for review and approval.

8. NYSDOT Design-Builder shall design, furnish and install temporary timber flooring at bays where gas mains are being installed. NYSDOT Design-Builder shall adjust roller supports as directed by National Grid to facilitate pipe push/pull across the bridge.

9. NYSDOT Design-Builder shall move road traffic plates over live gas openings as required by National Grid.

10. National Grid shall perform all gas work: gas pipe assembly, pipe welding, pipe connections, pipe pressure testing, radiographic testing and purging of existing and new pipe. Refer to attached National Grid drawings for schedule for estimated time required to perform each operation at each bridge.

11. NYSDOT Design-Builder shall provide backfill material approved by National Grid for openings and

trenches in accordance with National Grid standard CNST01003.

12. NYSDOT Design-Builder shall be responsible for cuts and removal of retired gas pipe when needed. National Grid will take custody of abandoned gas pipe upon removal. When present and if necessary, National Grid shall remove coal tar coating at areas prior to pipe cuts for removal.

13. NYSDOT Design-Builder shall restore roadway pavement and sidewalks in accordance with NYSDOT and NYCDOT standards.

14. NYSDOT Design-Builder shall install all valve manholes, Boston boxes, test boxes and hardware required

for cathodic protection. NYSDOT Design-Builder is responsible to install and set the top of the hardware boxes at the same elevation as the final top of pavement contracted grades. National Grid shall furnish all valve manholes, Boston boxes, test boxes and cathodic protection material.

15. To facilitate installation of new gas pipes on all bridges, National Grid requires installation of gas pipes after girders have been erected but before the abutment backwall concrete is placed to top of girders. Also, NYSDOT Design-Builder shall install bridge diaphragms so that they will allow for the erection of the steel gas pipes on the bridges.

16. NYSDOT Design-Builder shall provide as needed temporary supports approved for National Grid for welding of gas pipes on each bridge.

17. NYSDOT Design-Builder shall submit a work schedule prior to the start of gas work. NYSDOT Design-Builder is responsible for the coordination of all gas work. National Grid requires weekly meetings on site during the gas work operation.

18. NYSDOT Design-Builder shall provide National Grid with a 2 week notice prior to installation of new gas main. NYSDOT Design-Builder shall provide National Grid with a 6 months notice prior to installation of new 30” gas mains on the Southbound Service Road.

19. During bridge construction NYSDOT Design-Builder shall provide access to gas mains as required by

National Grid.





20. National Grid shall furnish all material required for the proposed gas main work i.e. pipes, fittings, and steel protection plates (if required) etc. NYSDOT Design-Builder shall provide material storage space for pipes, fittings, and steel protection plates (if required). The Design-Builder shall protect all material from damage and weather conditions.

21. Compensation to NYSDOT Design-Builder for all work performed under gas notes/provisions shall be

paid by the NYSDOT via a schedule of values requisition.

22. Any proposed modifications or deviations from the attached National Grid drawings, contract, and specifications shall be submitted in writing with appropriate details and back up to the resident engineer. All modifications must be reviewed and approved by National Grid.

23. NYSDOT Design-Builder shall supply National Grid with 3 copies of the final approved "as built" drawings in accordance with NYSDOT HDM Standards.

24. When cover on new gas main is less than 2 feet, NYSDOT Design-Builder shall install steel protection plates above the top of the main as required. National Grid shall supply steel protection plates.

25. NYSDOT Design-Builder shall obtain any required road use permits, disposal permits, storage permits, etc., as required for the performance of its work. National Grid shall obtain gas construction permits

26. All NYS, NYC, and Federal Codes pertaining to the work being performed by this specification, and on the drawings, are applicable.

27. Relevant National Grid plates showing all gas facilities near the bridges involved in this Project have been attached to this Agreement. Any conflicts with the gas facilities shown on the attached National Grid plates and NYSDOT drawings shall be brought to the attention of National Grid for resolution. NYSDOT Design-Builder shall be responsible for obtaining and using updated National Grid plates to locate all National Grid gas facilities before starting any excavation related with this project.

28. NYSDOT Design-Builder shall comply with New York State Code Rule 753. In addition, NYSDOT Design-Builder shall notify National Grid representative two weeks prior to digging.

29. National Grid representative shall have the right to inspect the NYSDOT Design-Builder’s work, material, and equipment when performing gas related work in accordance with this Agreement.

30. National Grid’s Inspection does not relieve the NYSDOT Design-Builder from the responsibility of performing work in accordance with the requirements of contract specifications and in accordance with the terms of this Agreement.

31. NYSDOT Design-Builder shall be responsible for the support and protection of all active National Grid facilities during the installation of other utilities. The associated cost for that work shall be funded by the utility whose facilities are being installed. If a utility or party other than National Grid requires work in connection with the Project and such work impacts National Grid’s facilities and requires work to be performed to National Grid’s facilities whether by National Grid or the NYSDOT Design-Builder, such utility or other party, not National Grid, shall be responsible and liable for any and all cost of the work to National Grid’s facilities.





32. National Grid Loading Requirement: The NYSDOT Design-Builder shall install all new gas mains at a minimum of 4 feet of cover for any main under the roadway in the area within 100 feet north of the LIRR Mainline 1/3 Bridge.

• An 8” wrapped steel pipe that runs towards the north fascia of the 94th Avenue & Atlantic Avenue Bridge. This 8” gas main services LIRR Jamaica yard.

• A 12” wrapped steel pipe runs west near the north fascia of the 94th Avenue and Atlantic Avenue Bridge from a gas valve in the 94th Avenue and NB Service Road intersection.





• At SB Service Road and Atlantic Avenue intersection, a 6” pipe runs E-W on Atlantic Avenue, to west of the west bridge approach

• On Atlantic Avenue an 8” plastic pipe runs along the south sidewalk and a 6” pipe runs along the north sidewalk.

• A 12” unknown medium density low pressure pipe runs N-S across the intersection of the SB Service Road and Atlantic Avenue.

• There are two set of gas mains running along the SB Service Road: o The first is a 30” cast iron pipe that connects to a 30” cast iron bell spigot (15 PSI) pipe. o The second is a 12” steel pipe which runs parallel to the 30” pipe, along the east side of

the SB Service Road.

• At the NB Service Road and 94th Avenue intersection, an 8” plastic gas pipe runs west on 94th Avenue on the north sidewalk to the northwest corner of the intersection.

• At the same intersection, on the south side of 94th Avenue, a retired 6” cast iron pipe running in the E-W direction connects to a retired 6” steel pipe which connects to a retired 6” cast iron pipe.

o This connects to a retired 12” steel pipe, which runs north from the intersection along the NB Service Road, which then connects to a retired 6” plastic pipe and then turns east into the entrance area of the train station platform and connects to a retired 6” PL pipe.

• Along NB Service road, an 8” steel pipe that runs north along the east sidewalk of the NB Service Road.

All National Grid facilities listed above which are not affected by the replacement of 94th Avenue & Atlantic Avenue bridge shall be supported, protected and maintained within work area by NYSDOT Design-Builder. National Grid Scope: National Grid shall perform all gas work: gas pipe assembly, pipe welding, pipe connections, pipe pressure testing, radiographic testing and purging of existing and new pipe. National Grid shall be responsible for checking the existing gas mains to be removed for ACM and perform abatement procedures if needed. National Grid shall cut and cap, flush, and clean the existing gas mains to be removed and be responsible for the hauling operations of these gas mains to the National Grid Greenpoint facility. National Grid will not take gas main outages during winter peak load period, which is a week after Thanksgiving, to April 1st. Any gas main outages during this period will need to be coordinated with National Grid on a case-by-case basis.

In case of an emergency, temporary gas stoppage for a few days may be allowed and shall be coordinated with National Grid. Anticipated Timeframe for National Grid Scope – Replacing Superstructure Steel: XX days.

NYSDOT Design-Builder Scope – Bridge Replacement:

a. NYSDOT Design-Builder shall excavate and sheet as necessary for the installation of a 12” steel pipe on the west side of the 94th Avenue & Atlantic Avenue Bridge.





b. NYSDOT Design-Builder shall excavate and sheet as necessary for the installation of a 12” steel pipe on the east side of the 94th Avenue & Atlantic Avenue Bridge.

c. NYSDOT Design-Builder shall be responsible for assisting National Grid with the structural lifting and erection of the proposed 12” steel pipe on the proposed bridge. NYSDOT Design-Builder shall install new steel supports and insulating rollers. National Grid shall provide insulating rollers.

d. NYSDOT Design-Builder shall excavate weld pits and tie-in pits at locations. Locations and dimensions are approximate and shall be verified in the field.

e. NYSDOT Design-Builder shall install pipe sleeves at abutment walls, pipe sleeves to be provided by National Grid.

f. The NYSDOT Design-Builder shall permanently remove the existing 12” wrapped steel pipe running toward the north fascia of the 94th Avenue & Atlantic Avenue Bridge.

g. NYSDOT Design-Builder shall excavate and sheet as necessary for the installation

of an 12” steel pipe on the west side of the 94th Avenue & Atlantic Avenue Bridge .

h. NYSDOT Design-Builder shall excavate and sheet as necessary for the installation of an 12” steel pipe on the east side of the 94th Avenue & Atlantic Avenue Bridge .

i. NYSDOT Design-Builder shall be responsible for assisting National Grid with the structural lifting and erection of the proposed 12” steel pipe on the proposed bridge. NYSDOT Design-Builder shall install new steel supports and insulating rollers. National Grid shall provide insulating rollers.

Southbound Service Roads from Atlantic Avenue to 91st Avenue (Van Wyck Expressway under Long Island Railroad Bridges (I-678)) Existing Facilities:





• On the west side of the SB Service Road a 30” steel (15 PSI) pipe runs NS between 91st Avenue and Atlantic Avenue.

• On the east side of the SB Service Road a 12” CI runs NS from 91st Avenue towards Atlantic Avenue and connects to a 12” steel pipe south of the LIRR bridges.

All National Grid facilities listed above shall be supported, protected and maintained within the proposed work area of LIRR Bridges by the NYSDOT Design-Builder. NYSDOT Design-Builder shall be responsible for obtaining and using updated National Grid plates to locate all National Grid gas facilities before starting any excavation related with this Project. NYSDOT Design-Builder shall perform test pits to verify existing facilities. Any existing cast iron gas mains which are exposed due to the proposed work will require replacement. National Grid Scope: National Grid shall perform all gas work: pipe installation, pipe welding, pipe connections, pipe pressure testing, radiographic testing and purging of existing and new pipe. National Grid shall be responsible for checking the existing gas mains to be removed for ACM and perform abatement procedures if needed. National Grid shall cut and cap, flush, and clean the existing gas mains to be removed and be responsible for the hauling operations of these gas mains to the National Grid Greenpoint facility. National Grid will not take gas main outages during winter peak load period, which is a week after Thanksgiving, to April 1st. Quantities shown below are based on preliminary NYSDOT scope of work and subject to change based on field conditions and final NYSDOT scope of work.

a. NYSDOT Design-Builder shall provide National Grid with a 4 month notice prior to the required installation of the new gas mains. National Grid will require special equipment and services that need to be scheduled in advance for the Installation of HP 30” steel gas mains.

b. NYSDOT Design-Builder shall excavate and sheet as necessary for the installation of 30” steel pipe on the west side of the Southbound Service Road.

c. NYSDOT Design-Builder shall excavate and sheet as necessary for the installation of 12” steel pipe on the west side of the Southbound Service Road.





d. NYSDOT Design-Builder shall excavate weld pits and tie-in pits at locations.

Locations and dimensions are approximate and shall be verified in the field.

e. For any existing gas main to be removed, NYSDOT Design-Builder shall be responsible for removing the decommissioned gas mains from the field and store them in the National Grid provided containers.
