Provisions outlining over- time are covered under Article 13.0 of the collective agreement. Whenever an employee works hours in excess of their normal daily hours, or work a regular day off, or attend emergency calls, they receive over- time pay based on double the regular rate of pay. When overtime is worked, an employee has the option of taking the extra time as pay (this is the default op- tion), or requesting the time be banked at overtime rates. In essence, for every one overtime hour worked, the employee can request that two hours be banked for future use. In order to use this bank, or lieu time, both the em- ployee and the supervisor must mutually agree upon a time. Should there be no agreement on when to take the time off prior to December 31st, the accumulated bank of time will be paid out. The one exception is any overtime accumulated in December of that year can be carried forward in the bank for the following year. There is never a situation where an employee can lose their overtime. Either they receive the overtime as time-off or as a cash payment. It is also important to note that there is a cap of 160 hours on the amount of overtime hours to be banked. Should this cap be reached, then overtime is automatically paid out when worked. Finally, as noted above, the decision to bank overtime is the choice of the employee at the time they work the overtime. The default position is to receive appropri- ate pay. If you wish to bank the time, then you must clearly state that preference when the overtime is worked. Always remember, the employer cannot re- quire you to bank time. Lunch and Learn Sessions CUPE 38 is excited to announce our introductory Lunch and Learn sessions. The past year has been one of stress and challenge for all Albertans. While the economy appears to be rebounding, the ef- fects of stress continue to impact everyone. We have engaged Debra deWaal to offer a presentation on dealing with impacts of stress in the workplace. After serving as an of- ficer with Calgary Police Services for 10 years, Debra started her own company to provide personal and professional development services. She is a member of the Canadian Association of Profes- sional Speakers, and a Certified Performance Coach. Debra has presented on a wide variety of topics, including Mental Toughness, Resiliency in the Workplace, Be Safe Not Sorry, and Safely Manag- ing the Difficult Client. In order to reach out to a broad section of the membership, we are having two separate sessions --- the first by Enmax Place and the second in the northeast close to Zurich Court. At each session, we are inviting you to come out and enjoy the talk --- a small lunch is included! In order to ensure enough space, we are asking that people register in advance at www.cupe38.org

Human Rights --- The Canadian Influence

Human Rights Day is observed every year on De-cember 10. It commemorates the day in 1948, on which the United Nations General Assembly adopt-ed the Universal Declaration of Human Rights. In 1950, the Assembly passed a resolution inviting all to observe December 10 of each year as Human Rights Day. And it has a distinctly Canadian connec-tion.

In 1946 John Humphrey became director of the United Nations Division on Human Rights. He was a Canadian law professor and human rights advocate, and was tasked with creating the first draft of the Universal Declaration on Human Rights.

For two years, they collaborated in the creation of one of the modern world's great documents. Humphrey pored over every available source from around the world, compiling what the UN boasted was "the most exhaustive documentation on the subject of human rights ever assembled."

Harvard University professor of law Mary Ann Glen-don has written that the declaration "charted a bold new course for human rights by presenting a vision of freedom as linked to social security, balanced by responsibilities, grounded in respect for equal hu-man dignity, and guarded by the rule of law." It af-firms "that its rights belong to everybody, every-where."

December 6th National Day of Remembrance and Action

on Violence Against Women

On December 6, 1989, Marc Lepine entered the Ecole Poly-technique and murdered 14 female students in the engi-neering department. Later investigations found that Lepine specifically targeted the female students in his at-tempt at “fighting feminism”. This act shocked the nation, and in 1991, Parliament declared Dec. 6th as a National Day of Remembrance and Action on Violence Against Women.

Every year on this date, Canadians are encouraged to wear a white ribbon, and to observe a minute of silence to re-flect on the continuing issue of violence against women in our society.

This year, the Calgary and District Labour Council is hold-ing their second annual fundraiser to support the Bow Valley Women’s Shelter. The event will be held on Dec. 6 from 6:30—9:30 pm at the Palliser Hotel. Tickets are $80.
