!~ i Cultural, Education and Scientific Agreement between Faculdades Catolicas, sponsor of Pontificia Universidade Catolica do Rio de Janeiro and Indian Institute of Technology Kanpur With' the objective of deepening the ties of cooperation between Brazil and India, Faculdades Cat6licas, a philanthropic association, declared of public utility by Federal Decree n. 43.454/58, recognized as a non-profit association by the Social Assistance National Council, sponsor of Pontiffcia Universidade Cat6lica do Rio de Janeiro, registered under the number 200812021626028, in January 9th, 2009, in the CNPJ/MF under the number 33.555.921/0001-70, state inscription number 10.005.205, municipal inscription number 00.819.271, located at Marques de Sao Vicente street, 225, hereinafter known as PUC-Rio, represented by its President, Father Josafa Carlos de Siqueira, SJ, ID number 28.659.444-5/ DETRAN-RJ, CIC056.010.531-20, and Indian Institute of Technology Kanpur, having expertise in the area of scientific and technological education and research and the application of scientific knowledge and technology to human advancement and social development, established under a special act o(Parliament of Republic of India, incorporated under the Institutes of Technology Act, 1961 having its office at Kanpur 208016, India hereinafter known as lIT Kanpur, do sign the present Cultural, Education and ScientificAgreement (hereinafter known as Agreement). The aforesaid institutionsare hereinafter referred to individuallyas Party and collectivelyasthe Parties. 1. SCOPE OF COOPERATION The areas of cooperationcovered by this Agreement includewhatever area of knowledge, faculty, center, department, institute, program or research considered to be of mutual interest and could contribute to the development and deepening of joint activities between the two Parties. 2. The aforesaid institutionsare hereinafter referred to individuallyas Party andcollectivelyas the Parties.

1. SCOPEOF COOPERATION

The areas of cooperationcovered by this Agreement includewhatever area ofknowledge, faculty, center, department, institute, program or researchconsidered to be of mutual interest and could contribute to the developmentand deepening of joint activities between the two Parties.

2. AREAS OF COOPERATION

There shall be promoted as a priority,subject to the availabilityof resources,the followingactivities:

a) The exchange of students at undergraduate and graduate levels;b) The collaborationbetween faculty, lecturers and researchers regarding

for Master and/or Doctoraldegrees, participationin examining boardsand commissions;and whateverother activityof an academiccharacter;

c) The exchange of bibliographicmaterial.

3. METHODOF ACHIEVEMENT

The conditionsconcerningthe 'developmentof joint activities, as well as theutilizationof the resulting production, shall be decided in common accord atthat pointof time and shall meritample internalpublicityin both Parties.

In accordance with the extension of each Program, project and/or activity, andwhen considered convenient, additional terms could be added to this contract.

4. FINANCES

Any financial proceeding must be agreed relatively to the particular activity towhich it applies and shall be subject to the availability of funds on the part ofboth Parties. Each Party reserves the right to seek supplementary funds alongwith funding agencies for any activity to be developed within the ambit of thisAgreement.

5. REPRESENTATION

The Parties indicate as responsible for the administration of the activitiescarriedout under this Agreement: .

A) For PUC-RIO, the Associate Vice-President for Academic Affairs -International Programs Central Coordination Office.

B) For Indian Institute of Technology Kanpur, the Dean, Resource Planning&Generation.

6. VALIDITY

This agreement shall be valid for three (3) years from the date of signing. Itcan be renewed with written consent of both the parties. It can be terminatedwith written notice of ninety (90) days.

Both Parties promise to promote and encourage exchange between theirstudents (hereinafter known as Program). The general principles of thisProgramare:

1. TERMINOLOGY

In this Agreement, the Party where the exchange student is regularly registeredas a degree-seekingstudent shall be knownas home institutionand the Partywhere the student stays temporarilyas a non degree-seeking student throughthe exchange program shall be known as host institution.The student whoparticipatesin the exchange programshall be knownas exchange student Thestudent sent by the home institutionon a fee paying basis shall be known asspecial student.

2. OBJEcrIVE

The objectiveof this Programis to promoteand makepossiblethe exchangeofundergraduateand graduatestudentsbetweenthe two Partieson an ongoingbasis.

3. SELEcrION OF PARTICIPATINGSTUDENTSAND PLACES

The following principals should be observed:

A) The institution of origin is in charge of selecting the participants of thisProgram, being at liberty to define internally the academic-administrativecriteria to be used as guidelines;B) Each one of the two Parties promise to, when in the condition of hostinstitution, respect the selection carried out by the institution of origin;C) The host institution reserves the right to make final decisions regardingadmission of exchange students based on academic preparation, availability ofplacesand/or supervisors for the areas of proposed study;D) Each Party shall provide for three (3) places per semester or six (6) placesper year for this Program;E) Both of the Parties promise to seek ways to maintain the balance in thenumber of exchanged students, on a basis of one-for-one.F) The balance of exchange students between the two Parties will be assessedannually. Whether there is inequality in the number of students exchanged, theParty that has the number exceeded will not be allowed to send studentsthrough the terms of this agreement. In this case, the Party can send studentsin the condition of SpecialStudents, i.e., tuition paying students. The tuitionreferent to the period of stay will not be waived.

4. GUIDELINES

The following guidelines should apply to the Program:

A) Eachexchange student can present him/herself as a candidate for whateverundergraduate or graduate course of the host institution.B) To be able to participate in the Program, the exchange student must havecompleted at least one year of regular study at the institution of origin;C) Each exchange student can stay a minimum of one (1) period of study(semester) and a maximum of two (2) periods of study at the host institution,except when participating in specific projects or in scientific events of a shorterduration;D) Each exchange student of lIT Kanpur shall have, at PUC-RIO,the status ofExchangeStudent in other words, a temporary non-degree seeking student,;E) Each exchange student of PUC-RIOshall have, at lIT Kanpur, the status ofExchangeStudent in other words, a temporary non-degree seeking student;F) All exchange students at PUC-Rio must take a Portuguese langu

G) The credits obtained by each exchanged student at the host institution canbe incorporated into his/her academic record in accordance with establishedinternal criteria/institute norms;H) Both Parties agree to accept the transcript submitted by the host institutionas the officialand final document for credits equivalency;I) After completion of the period of exchange, the exchange student mustreturn to his/her institution of origin. Any extension of time must be approvedpreviously in writing by both Parties;J) The host"institution will not accept: application for registration, transfer fromthe host institution or any other kind of registration that changes the exchangestudent status to regular student during or right after the exchange period.K)Allof the financial queries are covered by items 6 A)- F), below;L) All exchange students shall submit to the academic procedures and to therules and conduct regulations of the host institution, being subject to thesanctions foreseen therein.M) Each exchange student at both the Parties must prove to have aninternational health insurance prior to the departure from his/her home country.

S. RESPONSIBILmES

Both Parties commit themselves to:

A) Provide orientation to the future exchange student on how to obtain astudent's visa, essentialfor his/her participationin the Program;B) Providethe exchange student withadequate academicorientation;C) Provideadequate orientationto the exchange about student lodging,food,transportation,etc.;D) Assure the exchange student of access to all facilitiesoffered to regularstudents of the host institution,such as the use of computers, access to thelibrary,obtainingof a student's IDcard, etc.;E) Furnishthe exchange student, at the close of each study period, with anofficialacademic record or transcript that lists the courses attended and, foreach one, the respective total of class-hours, the number of correspondingacademiccreditsand the finalgrade obtained;F) Indicate an academic staff member that shall be responsible for thecooperation as the Coordinator of the Exchange Program PUC-RIO/IIT Kanpur.

6. FINANCIAL ARRANGEMENTS

The followingprocedures should be followed:

A) Duringthe period of exchange, each exchange student will pay tuition orother academic or administrativefees at the home institutionand will not beassessed additionaltuitionor other academicor administrativefees by the hostinstitution,except for fees communicatedin advance associated with specificclasses or specificorientation; ~ ...r\!:-tO-1

fee paying students, thus, the student will pay tuition fees at the hostinstitution during the months of stay;C) Whatever amount related to the participation of the student in the Programshall be stipulated and levied by the institution of origin;D) PUC-Rioshall charge all incoming exchange students an orientation/activitiesfee upon their arrival; students registered for a year or students who requestextension of the student exchange period from 6 months to 1 year, will pay therenewal of the orientation/activities fee charged during the deadline for theExchange Period Extension. lIT Kanpur will charge incidental fees for allincoming exchange students as per existing norms prevalent in the Institute.E) In case of any inequality in the number of exchanged students, students willbe enrolled as a Special Students, in such cases, the orientation/activities feecharged will be correspondent; students registered for a year or students whorequest extension of the student exchange period from 6 months to 1 year, willpay the renewalof the orientation/activitiesfee charged during the deadline forthe Exchange Period Extension.F) Payment for extension courses, extra classes, cultural activities and anyother activity that is not a regular course offered by the host institution in whichthe student is officiallyregistered shall not be covered by the items 6. A) and B)of this AdditionalTerm;G) Whatever course offered by the host institution at the request of theinstitution of origin and restricted to its students can be subject to extra fees;H) Each exchanged student shall be responsiblefor the costs of student visa,travel, lodging, food, local transportation, acquisition of study materials andwhatever personal expenses he/sHe perceives as being desirable or necessarythroughout the period of exchange;

7. VALIDITY

This AdditionalTerm shall be valid for the same period of the generalAgreement, and will be automaticallyrenewed for an equal period upon thegeneral Agreement'srenewal unless communicationfor termination is receivedby one of the institutes ninety(90) days before its expirationdate.
