BOARD OF SUPERVISORS’ MEETING OF JANUARY 17, 2012 The regular monthly meeting at the Municipal Building on Tuesday, January 17, 2012, was called to order at 7:35 p.m. with the Pledge of Allegiance to the Flag. Those present were: Dean Casciola, Chairman (DC), Evan Midler, Vice Chairman (EM), Gary Stokum, Supervisor (GS), William Tohey, Code Enforcement Officer (WT), William Johnson, Solicitor (WJ), Rachel Warner Blosser, Township Manager (RB), Rob Gagliani, Roadmaster (RG) and 4 visitors. INTRODUCTIONS: NONE APPROVAL OF MINUTES: The minutes of the December 17, 2011 and January 3, 2012 township meetings were approved, upon motion by GS, seconded by EM, passed unanimously. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE: The Recorder of Deeds Report for the month of December listed 1 transaction for $2,695.00. Animal Control Report was received for the month of December. District Magistrate Violations for the month of December was received for $114.85. 2011 Lien Sheet was turned over to Tax Claim Bureau and a copy was received for our files from Rachel Warner Blosser, Tax Collector Office. The Township taxes liened were $5,268.61, an increase from last year’s $4,950.12. Request for Appointment of Municipal Emergency Management Coordinator, Rob Gagliani paperwork was completed and submitted to Washington County. Municipal office will be closed from February 23 and reopen March 5. SOLICITOR’S REPORT: NONE ROAD REPORT: RG reported the road crew has been busy with the snow storm, putting down antiskid and working on the new township buildings across the street. JOINT SEWER AUTHORITY: RG explained the extension to Strope Road is completed. They are doing camera inspection, flush text and tap-in paperwork will be sent out. CODE ENFORCEMENT OFFICER’S REPORT: WT has made contact with Chesapeake Energy about the Parker Road culvert pipe. Also he is meeting next week with Jim Northwood from Wheeling/Lake Erie Railroad Co. regarding clean up of old railroad ties. PARKS & RECREATION: NONE VOLUNTEER FIRE DEPARTMENT: RG explained proposed HB950 would provide grant moneys to fire departments. Avella VFD Fire chief Eric Temple stated they responded to 214 calls, 57 in Cross Creek Township. In addition, he provided the 2011 Profit and Loss Statement. UNFINISHED BUSINESS: NONE NEW BUSINESS: Upon motion by GS, seconded by EM and passed unanimously, the Resolution 1-12 was approved accepting the dedication of the extension to Wells Drive. WJ will record the Right-of-Ways at the Recorder of Deeds and file the Resolution at the Clerk of Courts. PUBLIC COMMENT: G. MacIntyre suggested not allowing anymore building of new homes, instead encourage existing house purchases and renovations, in the interest of the township remaining rural. APPROVAL OF BILLS: EM made the motion to authorized payment of invoices from period 01/04/12 – 01/17/12, seconded by GS and passed unanimously. The regular monthly meeting at the Municipal Building on Tuesday, February 21, 2012, was called to order at 7:35 p.m. with the Pledge of Allegiance to the Flag. Those present were: Dean Casciola, Chairman (DC), Evan Midler, Vice Chairman (EM), Gary Stokum, Supervisor (GS), William Tohey, Code Enforcement Officer (WT), Rachel Warner Blosser, Township Manager (RB), Rob Gagliani, Roadmaster (RG) and 9 visitors. INTRODUCTIONS: Lt. Doug Bartoe, PA State Police was on hand to answer any questions or concerns about State Police coverage of our township. Corey McConn invited the Board to the Library Open house March 3 from 1 to 3. A $22,000 donation was received to renovate the library. APPROVAL OF MINUTES: The minutes of the January 17, 2012 township meetings were approved, upon motion by GS, seconded by EM, passed unanimously. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• The Recorder of Deeds Report for the month of January listed 12+ transaction for $27,436.31.

• Animal Control Report was received for the month of January. • 4th Quarter 2011 Cable TV franchise fees were received from Blue Devil Cable for

$567.52 and HTC Communication for $618.11. • District Magistrate Violations for the month of January was received for $54.22. • Municipal Emergency Management Coordinator, Rob Gagliani was appointed by the

Governor. • WT and RB attended a Benefits of Codification webinar. The Board gave permission

to work with General Code to prepare an estimate. • Copies of the PSATS NewsBulletin pertaining to the Marcellus Shale Act 13 were

made available to visitors. SOLICITOR’S REPORT: NONE – not present ROAD REPORT: RG reported the road crew has been busy with the snow storm. Gas well traffic on Patterson, Cooke, Nickolay, and Cowden is taking its toll on the roads. The water leak was repaired and permission was granted to flush the sprinkler system. Per DC, Smith & Mt. Pleasant Townships will be ditching together with the Athey loader if we would like to participate. JOINT SEWER AUTHORITY: RG explained the tap-in to extended sewer line is ongoing. The next extension into the Village of Cross Creek is in design phase still. If successful, only gravity fed lines will be included in the extension by end of February we will be notified if we our request for extension is awarded. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 15 complaints, ie. 2 garbage, 4 amusement devices letters, and 9 tenant/landlord update requests. Also he issued 15 permits, ie. Mark West pipeline, 2 zoning permits, Red Oak office trailer, a razing, and a burning. Gagich District Magistrate hearing has been continued to April 12. PARKS & RECREATION: NONE VOLUNTEER FIRE DEPARTMENT: RG announced the fire department will be having a CashBash and Lenten fish fry. UNFINISHED BUSINESS: Upon motion by GS, second by EM and passed unanimously, the Ordinance 1-12 was approved amending Ordinance 2-07 regulating recreational vehicles.

NEW BUSINESS: Tom Jennings, Chairman of Independence Township, provided the DCED Letter of Intent to request assistance to review possibility of joint police force with us, Independence, Hopewell, and Jefferson was tabled to allow Johnson to review and make recommendation. EM will contact Ron Stern of DCED to get additional information. Repository Sale of Margaret Bertovich’s property to Heather Snyder was approved upon motion by EM, second by GS and passed unanimously. This action essential forgives all former tax liens on the property. PUBLIC COMMENT: L. Ragan expressed concern from the heavy truck traffic on Cooke Road and water running on Peterson Street from sewer causing icy conditions. RG has been working on both concerns. Reminder: Township office will be closed February 23 and reopen March 5. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• The Recorder of Deeds for the month of February listed 1 transaction for $88.83. • Sheriff’s Sale notice for 20 Quarry Lane on April 13, 2012. • Range Resources Permit; Kancel 1-8H Well Pad has been reviewed by the Bureau of

Historic Preservation, archaeological sites are located in or near; however, the nature of activity will be no effect on the property.

• Real Estate Value change for 2012 in the amount of 60,576 was received. • District Magistrate Violations for the month of February was received for $54.22. • A thank you from the Evelyn Casciola family for the funeral flowers.

SOLICITOR’S REPORT: NONE ROAD REPORT: RG explained, in preparation for the Patterson Bridge detour, Campbell and Paris Roads had been readied. On the schedule is working with Mt. Pleasant and Smith Townships ditching on Vance and Parker with the use of an athey loader. JOINT SEWER AUTHORITY: RG explained the extension of the H2O grant into the Village of Cross Creek was successful. The expansion of the treatment facility has begun. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 10 complaints, and he issued 10 permits. The Gagich District Magistrate hearing is on April 12. PARKS & RECREATION: Resolution 2-12 to support Phase 2 of Cedar Grove Park’s DCNR C2P2 grant application, with $10,000 worth of aggregate, 2-man crew and necessary equipment was approved, upon motion by GS, second by EM, passed unanimously. VOLUNTEER FIRE DEPARTMENT: RG announced the fire department bleachers have been returned from the Avella Community Association. UNFINISHED BUSINESS: NONE NEW BUSINESS: Jerry Stefkovich is requesting a modification of Subdivision Ordinance Regulation to allow 6 lots on private road for a major subdivision and extension of private drive length from 600 feet, contingent upon final review of plans, modification will be granted and an official decision will be sent, upon motion by GS, second by EM and passed unanimously. PUBLIC COMMENT: John Chechuck asked about the culvert on Parker Road near his driveway that crosses to his mailbox. RG will be ditching and will review the situation. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• The Recorder of Deeds for the month of March listed 10 transactions for $830.84. • Received Notice of Rule for Judicial Sale for 5 parcels with a deadline of June 14. • District Magistrate Violations for the month of March was received for $54.22. • Animal Control Services provided their March monthly report. • 2011 DCED Municipal Annual Audit and Financial Report was received from

Cypher and Cypher upon completion of the filing. SOLICITOR’S REPORT: NONE ROAD REPORT: RG explained, the unofficial detour of Campbell and Paris Roads for the Patterson Bridge closing, has been too dry to grade. Ditching has begun, and the rental of the athey loader is $400/day. The Region material bids are available; examples of price increase, asphalt increased $5.75/ton and cold patch increased $21.00/ton. Street sweeper repair will cost $11,500 and the cost can be split with co-owner, Mt. Pleasant Twp. The repair was approved, upon motion by EM, second by GS, passed unanimously. Tabled, for further discussion, was a possible sweeper buy-in by Independence Twp and McDonald Borough. JOINT SEWER AUTHORITY: RG explained the extension is still in the design phase, and then getting necessary easements are next. Monzo, the sewer contractor, will start lawn repair work next week. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 1 complaint, and he issued 4 permits. The Gagich’s District Magistrate hearing gave him 60 days to install driveway pipe. Wheeling Lake Erie Railroad hired a contractor to clean up the discarded railroad ties along the tracks in the next 3 weeks. PARKS & RECREATION: The DCNR grant application will files by deadline. The swing set was picked up from Carnegie. We are still waiting for mulch from the plant. VOLUNTEER FIRE DEPARTMENT: NONE UNFINISHED BUSINESS: Resolution 2-12 supporting the DCNR grant for Cedar Grove Park phase 2 was rescinded upon motion by GS, second by EM and passed unanimously. Resolution 3-12 agreeing to contribute $20,000 from the general fund if the DCNR park grant is successful was approved, upon motion by GS, second by EM and passed unanimously. NEW BUSINESS: Township office will be closed May 7 – 9, for the PSATS Conference. Spring Clean-up is scheduled for the week of May 14 and dumpsters will be placed at the PUBLIC COMMENT: Jocelyn Gagliani asked for clarification on burning ordinance.

Neal Donovall asked if Campbell/Paris detour could be tarred & chipped. RG explained it would take 100 tons/mile of stone and 3,000 gal oil for an estimated $13,500, just in material per mile. INTRODUCTIONS: NONE APPROVAL OF MINUTES: The minutes of the April 17, 2012 township meetings were approved, upon motion by EM, second by GS, passed unanimously. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• The Recorder of Deeds for the month of April listed 8 transactions for $1015.32. • District Magistrate Violations for the month of April was received for $45.89. • Animal Control Services provided their April monthly report. • Washington County Recycling Collections Calendar of Events will be posted at the

municipal office. • West Penn Power is implementing new phone numbers and processes to better serve

their customers. Power Outage 888-LIGHTSS, and internet links for streetlight outage and tree work.

• Board of Tax Assessment sent notices of Appeals for 3 Barbour parcels and John Cummins.

• 1st Quarter 2012 Cable TV franchise fees were received from Blue Devil Cable for $558.24 and HTC for $659.25.

• PennDOT 2012-2013 Winter Municipal Snow Agreement was received for $25,506.73, an increase from last year’s rate of $24,644.21.

• Washington County Tax Revenue Dept. collected $1.46 at a private tax sale in 2009. • Washington County Tax Claim Bureau collected $1570.25 in delinquent taxes.

SOLICITOR’S REPORT: NONE ROAD REPORT: RG explained spring cleanup is having difficulty getting dumpsters due to contractor equipment malfunction. 6 Watch Children signs were ordered, 2 for State roads and 1 for Township road. PennDOT gave approval, provided specifications and locations for signage. Rented athey loader is broke down and waiting on repair by 12th Congressional; therefore, ditching is incomplete. The road crew has been grading Campbell Drive. Upon motion by EM, second by GS and passed unanimously, Campbell Drive is to be tarred and chipped from Descutner’s to the top of the knob, approximately 460 feet. JOINT SEWER AUTHORITY: RG explained next Monday is the meeting. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 6 complaints, and he issued 6 permits. Also he issued 2 citations. PARKS & RECREATION: 60 trees, donated by MarkWest, were planted in the park by the Cross Creek Ag 4H group and several township residents. A thank you was sent to all participants.

Supporters attended the meeting to express their support of the Cedar Grove Park, including Father Pierre from St. Michael’s Church, who stated when Phase 2 is completed his parish would like to utilize the park for parish picnics. EM inquired if an Authority would better serve the needs of the park. Brief discussion followed. EM asked for a meeting to be scheduled with Commission Shober to see if gas well money from the County Park could be used to assist our municipal park. Those in attendance were asked to serve on the parks and recreation committee. Volunteers so denoted on the meeting sign-in sheet. Murder Mystery Dinner fundraiser is being planned for November, possible shows being considered includes Robin Hood, Charlie Brown and I Love Lucy. VOLUNTEER FIRE DEPARTMENT: NONE UNFINISHED BUSINESS: NONE NEW BUSINESS: Upon motion by GS, second by EM and passed unanimously, the garage door opening is to be made wider and a new door installed using Wise Garage Door $1,750 and MetalClad Inc. $1,500. PUBLIC COMMENT: Don King commented the Township is doing a good job. INTRODUCTIONS: NONE APPROVAL OF MINUTES: The minutes of the May 15, 2012 township meetings were approved, upon motion by EM, second by GS, passed unanimously. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• The Recorder of Deeds for the month of May listed 4 transactions for $254.82. • District Magistrate Violations for the month of May was received for $109.36. • Animal Control Services provided their May monthly report. • The PUC 2010 Municipality Approved Budget Report was filed. • The State Police fines in the amount of $1,316.13 were received. • Bankson Engineers notified of their NPDES permit modification and General Permit

for utility stream line crossing for the Independence-Cross Creek Joint Sewer Authority to extend to Cross Creek Village with Gravity Sewers.

SOLICITOR’S REPORT: NONE ROAD REPORT: RG explained they have been ditching, mowing, installed mirror and 6 Watch Children signs and blacktop begins tomorrow. The Ford tractor is broke down on Parker Road, due for repair tomorrow. Upon motion by EM, second by GS and passed unanimously, the dust suppressant is to be used Campbell Drive, instead of the original tarred and chipped. Upon motion by EM, second by GS and passed unanimously, the road crew start time will be 6:00 a.m. to 2:00 p.m. The motion reverses last month’s change to 7:00 a.m. to 3:00 p.m. JOINT SEWER AUTHORITY: RG explained the paperwork for the extension into Cross Creek Village is nearly complete. He reviewed the figures for the project. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 7 complaints, and he issued 7 permits. Also he issued 2 citations. We have received several complaints on Browntown area and others for dilapidated houses, approximately 6. The Board approved picking the worst one and starting the processes. Johnson explained process. DC asked about the Wheeling Lake Erie Railroad complaint regarding the old railroad ties that litters the line. The Railroad started picking them up and agreed to complete. PARKS & RECREATION: Heidi Cochran reported on 2 fundraisers, Purse Auction at Bullpen, August 25 and Murder Mystery Dinner at the Avella VFD in November, Charlie Brown Christmas theme. VOLUNTEER FIRE DEPARTMENT: NONE UNFINISHED BUSINESS: Upon motion by GS, second by EM and passed unanimously, new flooring for the office is to be ordered and the budget is $2,000 or less. NEW BUSINESS: Upon motion by DC, second by GS and passed unanimously, the delegate for the Washington County Tax Collection District will be Rachel W. Blosser only.

The loan payoff for the International dump truck was tabled to allow for comparison of the existing loan interest rate and current interest rates, to determine if it is more economical to buy the new tractor outright instead of financing. Range Resources announced they will no longer be paying for grading permits or gas well registration because of the gas well impact fee. WJ will research. He is also waiting to hear the outcome of the Act 13 court case before working on amending our ordinance. PUBLIC COMMENT: Bill Brown asked if the railroad company does not have to abide by the Township Ordinances. The regular monthly meeting at the Municipal Building on Tuesday, July 17, 2012, was called to order at 7:48 p.m. with the Pledge of Allegiance to the Flag. Those present were: Dean Casciola, Chairman (DC), Evan Midler, Vice Chairman (EM), Gary Stokum, Supervisor (GS), William Johnson, Solicitor (WJ), William Tohey, Code Enforcement Officer (WT), Rachel Warner Blosser, Township Manager (RB), Rob Gagliani, Roadmaster (RG) and 8 visitors. INTRODUCTIONS: NONE APPROVAL OF MINUTES: The minutes of the June 19, 2012 township meetings were approved, upon motion by EM, second by GS, passed unanimously. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• The Recorder of Deeds for the month of June listed 1 transaction for $121.50. • District Magistrate Violations for the month of June was received for $91.80. • Animal Control Services provided their June monthly report. • Hopewell reimbursed $240 for half the cost of sweeper bristles. • DCED closed out our final $5,000 grant for aggregates for Campbell Drive, from the

last road closing at Ortitay’s bridge. • Mount Pleasant reimbursed $303 for the street sweeper insurance premium. • Abitibi recycled $17.76 worth of paper, saving 3.24 cubic yards in landfill space. • Washington County Association of Township Officials 97th Annual Convention at the

DoubleTree by Hilton on September 13, from 4 to 9. The Board, Zoning Officer, Solicitor is invited, also Engineers and Auditors

SOLICITOR’S REPORT: Chesapeake’s agreement to repair Parker Road culvert is now void, since they transferred their local leases to Range Resources and moved out of the area. In a telephone conversation with Ken Komoroski, attorney for Range Resources, WJ explained our position to wait to issue any gas permits until the Act 13 appeal decision is reach, which he feels should be eminent. ROAD REPORT: RG explained they have paving with the Region and will be in Cross Creek Township in 2 or 3 weeks. Millings will be ordered for Campbell Drive to try to control the dust problem for the Descutners. Bridge work at Patterson and Cross Creek in nearing completion. Expected to be completed in August. JOINT SEWER AUTHORITY: RG explained a few people will not give the need right-of-ways. The Eminent Domain process has been started. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 3 complaints, and he issued 9 permits. MarkWest is willing to pay for the culvert pipe on Parker Road by Margaria’s Junkyard; if the Township handles installation. Bankson will prepare engineered plan and price. PARKS & RECREATION: A letter was prepared to the Washington County Commissioners seeking their assistance with funding for the park. Evelyn Holzer reported on the fundraisers: Bob Evans on July 28 will donate 15% of sales, Purse Auction at Bullpen, August 25 over 40 purses donated & tickets are now available for $10, Murder Mystery Dinner at the Avella VFD on November 17, Charlie Brown Christmas theme.

The Board of Supervisors made a cash donation towards the purse auction and Kitty Gardner did likewise. Next week, August 6 at 6pm at Rachel Blosser’s house on Parker Road. VOLUNTEER FIRE DEPARTMENT: They bought a new rescue truck. UNFINISHED BUSINESS: Upon motion by GS, second by EM and passed unanimously, new terrazzo flooring (epoxy on the concrete) for the office & shop bathroom is to be ordered and installed by Ketchel Contracting for $2,295. NEW BUSINESS: Upon motion by EM, second by GS and passed unanimously, to purchase a John Deere Tractor 5101 on the State contract for $42,634.24 and $19,024 for the mower and our existing Ford tractor will be traded in for $3,500. PUBLIC COMMENT: Donny King inquired what could be done about the vacant structure on Peterson with high grass. The Township had heard Gevenosky’s were interested in purchasing it to demolition the house. • The Recorder of Deeds for the month of July listed 17 transactions for $2,160.18. • District Magistrate Violations for the month of July was received for $98.81. • Animal Control Services provided their July monthly report. • Mt. Pleasant Township reimbursed the 2012 street sweeper premium $330. • WCTCD informed of CENTAX violation of Act 32 in Greene & Beaver County. • PA Liquor Control Board listed 5 licenses in our township for a fee of $700.00

annually. • 2nd Quarter 2012 Cable TV franchise fees were received from HTC Communication

for $662.45 and Blue Devil Cable for $527.46. • 2nd Quarter 2012 Gaming money was received in the amount of $17,945.00

($16,812.00 slots and $1,133.00 table games). • Public Employee Retirement Commission provided the Notice of 2012 Distress

determination and our score was 0. • PennDOT bridge project is in the design phase for Rt.50 near County Park Rd. • Columbia Gas Transmission has a pipeline project in Browntown. • 2011 Annual Financial Report was received from Cypher & Cypher & no township

meeting attendance necessary. • Repository Sale for Bertovich was approved unanimously to Ross Miller, Jr.

SOLICITOR’S REPORT: WJ is researching a gas well ordinance amendment to comply with Act 13, so as not to delay the impact fees. Brief discussion on gas well registration and grading permits as pertains to Range. EM recommended put fees in an escrow account. All Supervisors agreed, the Township gas well procedures stay in place. Also discussed, WJ wants the bonded roads videotaped. WT has necessary equipment and he will comply. In addition, we must work on the blanket road bond for Range. ROAD REPORT: RG explained they finished blacktopping nearly 681 tons. Tar and chip for Campbell Drive completed at a cost of $2,650.56. JOINT SEWER AUTHORITY: RG explained on Sept. 10 Monzo will be returning to repair driveways, yards work including removing rocks and reseeding. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 1 complaints, and he issued 3 permits. He attended 2 District Magistrate hearings (Debnar and Burlenski) both have been cleaned up. PARKS & RECREATION: Purse Auction at Bullpen, was well attended and nearly $9,000 was raised.

Murder Mystery Dinner at the Avella VFD on November 17, Christmas-theme “Slay Ride”. VOLUNTEER FIRE DEPARTMENT: RG the fire departments switching to high-band radios and installed new pagers to improve communications. UNFINISHED BUSINESS: NONE NEW BUSINESS: Upon motion by EM, second by GS and passed unanimously, the Washington Financial note modification was approved for a lower interest rate. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• The Recorder of Deeds for the month of August listed 13 transactions for $2,515.97. • Animal Control Services provided their August monthly report. • PennDot estimated our 2012 Liquid Fuels at $65,918.70, last year’s was $69,013.38. • The General Municipal Pension System State Aid was received in the amount of

$4,207.12, is a decrease from last year’s $6,462.07. The 2012 MMO is $4,283. • The Volunteer Fire Relief allocation of $8,070.19 (last year = $9,600) was received

and distributed on this meeting to the three fire departments. • Board of Assessment Appeals will hear the tax assessment appeal of Brian & Anissa

Conrad of Stolze Road on September 20 at 9:00 AM. • Bankson Engineers provided the cost estimate on the Parker Road culvert project.

The information is to be forwarded to MarkWest with WT. • 2012 Upset tax sale is scheduled for Sept. 25, 2012 and the unpaid taxes were

certified (21 parcels) to the Washington Cty Tax Revenue by Rachel Blosser, Tax Collector.

• Washington County Aging Services requested a donation. Upon motion by EM, second by GS and approved unanimously, a donation of $300 for the Cross Creek Valley Senior Center is to be sent.

SOLICITOR’S REPORT: Brief discussion on the Range Resources letter pertaining gas well registration and grading permits. They are willing to escrow the permit fees. Board agreed unanimously to lower gas well registration fee to $750 but grading permit fee is unchanged, upon motion by EM, second GS and approved. ROAD REPORT: RG explained they are getting Parker Road ready for tar and chip. They have been grading and clearing brush. JOINT SEWER AUTHORITY: RG explained Monzo will be returning to repair driveways, yards work including removing rocks and reseeding and then start the sewer line extension. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 3 complaints, and he issued 2 road opening permits, 2 access permits, 2 road use permits to MarkWest and received to 2 permits from WCSC for Range Resources. Brief discussion, about asking District Magistrate Havelka to consider making repeat offenders show their monthly garbage hauling receipts as proof they have garbage pick-up service. This could help get WT off the merry-go-round of citing, hearing, dismissing charges when they clean up. This costs unnecessary money and time of WT, the Township and the Magistrate. Both DC and WT stated they would speak to District Magistrate Havelka.

PARKS & RECREATION: Murder Mystery Dinner at the Avella VFD on November 17, Christmas-theme “Slay Ride”. Tickets $25. DC questioned if there will be a DJ. VOLUNTEER FIRE DEPARTMENT: NONE UNFINISHED BUSINESS: Bankson Engineers provided the cost estimate of the Parker Road culvert project. The Board would like Bankson to proceed with applying for the necessary permits and design but they are tabling selecting which design until WT can get learn MarkWest’s intent to contribute to project. NEW BUSINESS: Upon motion by GS, second by EM and passed unanimously (3-0), the Forney Subdivision was approved, contingent upon necessary corrections as required by the Subdivision Ordinance and the Planning Commission and contingent upon DEP approval. Terensky’s need a letter to FEMA accepting their engineers determination of base flood elevation. GS explained the request and motioned to approve, second EM and passed unanimously (3-0). Budget workshop will be held on October 1 at 4:00pm and will be advertised. • District Magistrate Violations for the month of September and October was received for $281.70 and $158.17 respectively.

• The 2012 PURTA distribution check for 2011 was received for $448.05, last year the amount was $401.21.

• Huntington prepared a Workers Compensation audit which resulted in a return of premium of $1,723.

• K2 Engineering mailed the final notice giving 10 days to Slomski’s to abate the violations on their property.

• Robert Donnan provide the Board with the information he presented to the Washington County Commissioners on Oct. 4 pertaining to Range Resources violations to the lease agreement by disposal of waste on the County Park.

• PA DEP informed the Township of the proper sewage procedure for campgrounds and recreational vehicle parks.

• Washington County Aging Services requested a donation. Upon motion by EM, second by GS and approved unanimously, a donation of $300 for the Cross Creek Valley Senior Center is to be sent to the Senior Center not to the County.

SOLICITOR’S REPORT: NONE ROAD REPORT: RG explained they attended flagger certification training. Completed tar and chipping. They have been brush cutting and preparing the trucks for winter. Purchase of a 500 gallon double-walled fuel tank for $3,079 was approved unanimously, upon motion by DC, second GS. Vince Ley, County Engineer discussed Clark Avenue bridge replacement, which currently has a NEW 28 ton weight limit. He is recommending we find a temporary egress and ingress for Cedar Grove before bridge repair project is decided. We will check on the old railroad bed, we believe it is owned by Foltz. JOINT SEWER AUTHORITY: RG explained Monzo returned to complete restoration from Clark to Strope. Material is being stockpiled for the sewer line extension to Cross Creek Village.

The tap-in fee has not yet been set. Supervisors inquired as to the letter of credit from Cross Creek to the Authority, and RG will research. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 4 complaints, and he issued 10 permits, 3 citations and 1 arrest warrant. PARKS & RECREATION: Halloween at the Park, October 31, 5:30 to 7PM. We will give out 200 treat bags, hot dogs and drinks. The Board was invited to attend. Tickets are available for the Murder Mystery Dinner at the Avella VFD on November 17, Christmas-theme “Slay Ride” for $25. VOLUNTEER FIRE DEPARTMENT: NONE UNFINISHED BUSINESS: NONE NEW BUSINESS: Upon motion by GS, second by EM and passed unanimously (3-0), the Independence-Cross Creek Joint Sewer Authority application for LSA grant money will be supported with a letter. RG needs an opportunity to compare the two John Deere front loader models with a broom attachment being considered, to replace the Michigan; therefore, it was tabled for November. PUBLIC COMMENT: Mr. Brown was following up on his previous inquiry about the railroad company returning to clean-up the railroad bed of discarded railroad ties, etc. Board would like to turn over to WJ. Mr. Donovall inquired as to the County Park gas well revenue and what’s being accomplished at the County Park. • The Recorder of Deeds for the month of October listed 22 transactions for $8,723.30. • 3rd Quarter 2012 Cable TV franchise fees were received from Blue Devil Cable for

$559.43 and HTC for $672.31. • PennDOT 2012-2013 winter snow maintenance funds in the amount of $25,506.73

were received. • 2011-2012 Procurement Card rebate results were received in the amount of $220.65. • The 2013 Assessed Value Certification was received from Tax Revenue Dept. in the

amount of 8,539,110, which is an increase of 105,181 from 2012. • District Magistrate Violations for the month of November was received for $61.48. • K2 Engineering invitation to a Holiday party, December 15. • PUC disbursement of Act 13 funds in the amount of $422,593.54 • PA Racing Horse Development and Gaming Act for the 3rd quarter 2012 $7,273.18. • Range Resources intends to submit to PADEP for E&S permit for Avella Land

Venture property gas well. • Cypher & Cypher audit letter was received and their fee will be $4,000 plus out-of-

pocket expenses. The letter was authorized and returned. • Road Use Agreement was signed for Enterprise Liquids Pipeline LLC.

SOLICITOR’S REPORT: NONE ROAD REPORT: RG explained they have been patching potholes. Mowing was halted for a couple weeks due to seismic testing wires. They are also preparing for winter. JOINT SEWER AUTHORITY: RG explained Monzo has begun the sewer line extension to Cross Creek Village from Strope Road with the installation of 700’ of line. A copy of the Sewer Authority’s approved Local Government Unit Debt Act package was received from Bankson Engineers. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 6 complaints, and he issued 5 permits, 10 letters to landlords for tenant registration. MarkWest will start road repair of crossings and the entire Y of Parker, Sugar and Nickolay. RG asked if Sugar Camp Road would have complete overlay because of the severity of the road damage from the heavy traffic and WT will make inquiry. Slomski house is being demolished. The Board wants K2 Engineering to start on the house on Peterson and Donahoe. Tohey asked if we can bill the property owner for the engineers fee, a question for WJ. Siget has been apprehended on a warrant for his multiple violations at 106 Gardner Street in the township.

PARKS & RECREATION: The Murder Mystery Dinner was well attended and a profit of over $7,000 was recorded. DCNR C2P2 grant of $91,200 was awarded for the Cedar Grove Park Phase 2. VOLUNTEER FIRE DEPARTMENT: The new fire truck is in Kentucky and expected delivery date is in 5 weeks. UNFINISHED BUSINESS: NONE NEW BUSINESS: Upon motion by EM, second by DC and passed unanimously (2-0), the Smitsky subdivision was approved following the recommendation of the Planning Commission. 2013 tentative budget with no tax increase is available for public inspection upon motion by EM, second by DC and passed unanimously (2-0). The PUC recommended we not budget for Act 13 money, they prefer we amend the budget when figures are available. Upon motion by EM, second by DC and passed unanimously (2-0), the John Deere 524K front loader models with a broom attachment, is to be purchased under PA State contract pricing $120,858 and $13,675 respectively from the General Fund. PUBLIC COMMENT: Mr. Lipa explained his concern about firearm discharge in the Village of Cross Creek by his neighbor. Mr. & Mrs. Lipa are willing to testify. INTRODUCTIONS: NONE APPROVAL OF MINUTES: The minutes of the November 20, 2012 township meeting were approved, upon motion by EM, second by DC, passed unanimously. TREASURER’S REPORT: The Treasurer’s Report was received and filed for audit. SECRETARY’S CORRESPONDENCE:

• District Magistrate Violations for the month of November was received for $229.02. • The Recorder of Deeds Report for the month of November listed 4 transactions for

$381.07. • State Police Fines was received $1461.94. • PUC explained the disbursement of Act 13 funds and explained the need to submit

the report on the use of funds by April 15. • Thank you for the Cross Creek Valley Senior Center for the donation. • Kim Burlenski emailed the Board on a property-line dispute and magistrate hearing. • PSATS’ 91st Annual Educational Conference and Trade Show will be April 21-24,

2013 in Hershey. • Invitation to the Public Official brunch at the PA State Farm Show in Harrisburg is on

January 10 at 11a.m. • DCNR will be contacting us to finalize the park grant agreement. • Beginning January 24, 2013 Act 108 is effective and electronic waste must be

removed from the normal waste stream. Local drop-off is Burgettstown Borough. • Reorganization meeting is scheduled for Monday, January 7, at 7:30PM.

SOLICITOR’S REPORT: NONE ROAD REPORT: RG explained they have been patching potholes on dirt roads. Will be purchase culvert pipe for 2 weather-permitting projects; Gardner St. and Parker Road by Chechuck, who agreed material could be stored on their property for the project. New John Deere tractor and mower arrived. Upon motion by EM, second by GS and passed unanimously, the front door hardware is to be replaced because it is malfunctioning and not longer up to code, contingent upon spending less than $1500. JOINT SEWER AUTHORITY: RG explained no tap-in fee has been set yet. Authority applied for LSA grant money. Joe Grubbs term is expiring and a replacement is needed. CODE ENFORCEMENT OFFICER’S REPORT: WT handled 3 complaints, and he issued 5 permits, and K2 sent out the 2 letters to the dilapidated property owners Year in review: 9 Citations, 73 permits, and 41 calls handled. MarkWest is hiring a contractor to pave Parker, Sugar Camp and Nickolay. And they have made no comments on financially assisting on the Parker Road culvert project. Tohey will make another inquiry.

PARKS & RECREATION: Blanc Printing (Karen Zatta-Martin) sponsored the raffle ticket for the month of March. It is a $10 ticket with 2 numbers. It will make a nice Christmas gift and be the first fundraiser for 2013. VOLUNTEER FIRE DEPARTMENT: NONE UNFINISHED BUSINESS: 2013 budget with no tax increase is approved following public inspection period, upon motion by GS, second by EM and passed unanimously (3-0). NEW BUSINESS: Upon motion by EM, second by GS and passed unanimously (3-0), the Buckles/Boni subdivision was approved following the recommendation of the Planning Commission. The Adamson Subdivision is still waiting for the Mounts Engineering correction. It is incomplete and could not be approved. REORGANIZATION MEETING JANUARY 3, 2012

The Cross Creek Township Board of Supervisors met for their reorganization meeting Tuesday, January 3, 2012 at 7:50 p.m. at the Municipal Building. Present were Supervisors Dean Casciola (DC), Evan Midler (EM) and Gary Stokum (GS), Roadmaster Rob Gagliani (RG) and Township Secretary Rachel Warner Blosser (RB) and 1 visitor. The meeting was called to order by Supervisor Casciola. INTRODUCTIONS: There were no introductions. APPOINTMENT OF TEMPORARY CHAIRMAN: EM acting as Temporary Chairman, opened the floor for nominations for Officers, upon motion by DC, second by GS and approved unanimously. ELECTION OF OFFICERS:

Upon motion by GS, seconded by EM and passed, the Officers will remain unchanged. DC was re-appointed Chairman, EM was re-appointed Vice-Chairman. RB was re-appointed Secretary -Treasurer and Township Manager, upon motion by GS, second by EM and passed and the Treasurer’s Bond was set at $200,000. SET MONTHLY MEETING: Upon motion by GS, seconded by EM and carried, the regular monthly meetings will be held on the third Tuesday of the month at 7:30 p.m. at the Municipal Building. SELECTION OF THE DEPOSITORY: Upon motion by GS, seconded by EM and carried, the depository will be Washington Financial Bank and PLGIT. PERSONNEL – APPOINTMENTS: Upon motion by GS, second by EM and passed, the following appointments were made: Roadmaster – RG, Equipment Operator – Kenneth McDougan, Alternate Roadmasters – the Supervisors, Township Manager – RB. WAGE – HOURLY RATE: Upon motion by GS, seconded by EM and passed, the wage scale for 2012 will be: Roadmaster - $18.00, Township Manager – $17.75, Full-time Equipment Operator - $15.00, Temporary Equipment Operator (with or without a CDL) - $12.75, Temporary Skilled Laborer - $10.00, and Temporary Clerk - $10.00. The above motion set a biweekly pay period, with payday on the following Wednesday. PERSONNEL MANUAL: NONE APPOINTMENTS: Approved upon motion by EM, second by GS and passed: Independent auditors for 2012 will be Cypher and Cypher. William A. Johnson, Esquire was retained as Solicitor. Bankson Engineers was approved as Township. Debra Bardella was approved as the Realty Transfer Tax Collector. Rob Gagliani was named Emergency Management Director, Evan Midler will serve as his assistant. Code Enforcement/Zoning Officer will be William Tohey, with a rate of $550.00/month including required meetings. Richard Lehman was appointed Vacancy Board Chairman.

Joint Sewer Authority no appointment needed for the 5-year term. J. Dowiak (2015), R. Gagliani (2014), & J. Grubbs (2013). Zoning Hearing Board, which is a 5-year term, reappointed Corey McConn (2016) to serve with V. Paris (2015), D. Lehman (2014), and R. Garlaus (2013). The three Supervisors, Township Manager and the Roadmaster will continue to serve on the Cross Creek Valley Regional Planning Commission, which is reorganizing on January 12 at 7:00pm. The Cross Creek Planning Commission reappointed for a 3-year term, D. Halmi, P. Midler (2015), K. Gardner & G. Stokum (2014), and M. Kancel (2013). R. Blosser was re-appointed to the Washington County Sewage Council. J. Faisant was reappointed to serve on the Joint UCC Appeals Board. Parks & Recreation Board for a 5-year term, R. Blosser & R. Grubbs (2017), J. Gagliani & D. Doaks (2016), P. Bongiorni (2013) & J. Scott (2014). The 3 supervisors, RG and RB will be our 2012 PSATS State Convention delegates. Reappointed to the Agriculture Security Area Committee were Dean Casciola (supervisor), John Chechuck (farmer), George (Hoss) Godwin, Jr., (farmer), Ray Margaria (farmer) and Warren Bedillion (citizen). Contracts with Avella VFD, Mount Pleasant VFD and Slovan VFD were approved. Upon motion by EM, second by GS and passed mileage reimbursement will be adopted at the IRS mileage rate. RECOMMENDATIONS TO THE AUDITORS: Supervisors will be paid the wage of Equipment Operator - Temporary $12.75/hour, in the event their services are needed. APPROVAL OF BILLS: EM made the motion to authorized payment of invoices, from period 12/21/11 – 01/03/12, second by GS and passed unanimously. ADDITIONAL APPOINTMENTS AND MOTIONS: Re-appointed Auditors, Deb Brown and Georgianne Griffith upon motion by EM, second by GS and passed unanimously. Archey Logging bonded Vance Drive for the logging operation. Work was completed, and road was inspected by the RG, upon motion by GS, second by EM and passed unanimously the road bond is released.
