This Criminal Petition is filed under Section 438 ofCrP.C. to release the petitioner on bail in the event of hisarrest in Cr. No.80/12 of Banavara Police Station, HassanDistrict, for the offences punishable under Section 304(A) ofIPC and under Sections 3 and 5 of Explosive Substance Act,1903.
This Petition coming on for Orders this day, the Courtmade the following:
ORDER
The petitioner is accused No.1 in Crime No.80/2012
registered by Banavara police, Hassan District for the offence
punishable under Section 304A of IPC and Sections 3 and 5 of
Explosive Substances Act, 1908.
2. The allegation is that the deceased who went to keep
the explosives in the farm house of one Sridharmurthy, on
account of his negligence there was blast of explosive. He
sustained grievous injury and succumbed to the same in the
hospital.
3. Learned counsel for the petitioner submitted that the
petitioner’s name is revealed after three days. There is no
mention about the incident occurring in his house nor is he
connected. Accused No.2 has been granted bail by this Court
in Crl.P.No.2502/2012 dated 17.5.2012.

4. Having regard to the same, I find that the petitioner
could be enlarged on bail.
5. Accordingly, petition is allowed. Petitioner is
enlarged on bail subject to the following conditions:
(i) The petitioner shall execute a personal
bond for Rs.25,000/- with two solvent sureties for
the like sum to the satisfaction of the Trial Court.
(ii) The petitioner shall regularly attend the
Court on hearing dates.
(iii) The petitioner shall not tamper with the
prosecution witnesses.
