In exercise of the powers conferred by section 34(1) of theCOVID-19 (Temporary Measures) Act 2020, the Minister for Healthmakes the following Regulations:

PART 1

PRELIMINARY

Citation and period in force

1.—(1) These Regulations are the COVID-19 (TemporaryMeasures) (Control Order) Regulations 2020.

Definitions

2.—(1) In these Regulations, unless the context otherwiserequires —

“activity cohort” means a dining-in activity cohort, apersonalised service cohort or a sporting activity cohort;

“at work” includes to work, for the time being working, on abreak when working, or customarily working;

“authorised service” means —

(a) the provision of any goods or services by theGovernment or any public body in the exercise ofits public functions; or

(b) the provision of any goods or services specified —

(i) on the prescribed website; or

(ii) in a conditional permit mentioned inparagraph (c) of the definition of “permittedenterprise”;

“boarding premises” has the meaning given by section 2(1) ofthe Foreign Employee Dormitories Act 2015 (Act 3 of 2015);

“business” includes any business in Singapore, whether or notcarried on for profit;

“business event” and “major business event” have the meaningsgiven by regulation 3(1) of the COVID-19 (TemporaryMeasures) (Business Events — Control Order) Regulations2021 (G.N. No. S 278/2021);

“celebrant”, in relation to a marriage, means any of thefollowing individuals authorised under written law tosolemnize the marriage in Singapore:

(a) a person issued a licence to solemnize marriagesunder section 8 of the Women’s Charter (Cap. 353);

(b) the Registrar of Marriages or an Assistant Registrarof Marriages, appointed under section 26 of theWomen’s Charter;

(c) a person specified in section 95(1)(a), (b) or (c) of theAdministration of Muslim Law Act (Cap. 3);

“cleared status”, for an individual, has the meaning given by theInfectious Diseases (COVID-19 Access Restrictions andClearance) Regulations 2021 (G.N. No. S 273/2021);

“cohort” means a group of individuals with a common intentionto meet in person for the same purpose or similar purposes,the composition of which does not change in relation to thatpurpose or those purposes except by way of reduction innumbers;

“common property” has the meaning given by section 3(1) of theLand Titles (Strata) Act (Cap. 158);

“contractor”, “occupier” and “principal” have the meaningsgiven by section 4(1) of the Workplace Safety and Health Act(Cap. 354A);

“customer” includes a prospective customer and —

(a) in relation to the operator of a specified dormitory,includes a resident of that dormitory; or

(b) in relation to a management corporation constitutedfor a strata title plan or a managing agent appointedby a management corporation, includes anysubsidiary proprietor which makes up themanagement corporation, any mortgagee inpossession, lessee or occupier of a lot comprised inthe strata title plan, and any invitee of such asubsidiary proprietor;

“defined activity” means an activity for the purpose of —

(a) consuming food and drinks;

(b) receiving any personal appearance service orpersonal care service that requires taking off, or notwearing, one’s mask in order to receive the service; or

(c) engaging in any sporting activity as follows, in anindoor physical recreational facility and in the courseof receiving an authorised service consisting ofproviding lessons or coaching in, or forparticipation in, that sporting activity:

(i) any high-intensity physical exercise;

(ii) another sporting activity or physicalrecreational activity without wearing a mask;

“dining-in activity cohort” means a cohort for the purpose ofconsuming food or drink at a retail food and drinksestablishment or a place at which a retail liquor business isfor the time being carried on (where the First Schedule doesnot prohibit consumption of food or drink on those premises)and the composition of which is one of the following:

(a) for any retail food and drinks establishment — 5 orfewer individuals in total who are either —

(i) all uncleared juniors all from the samehousehold;

(ii) all individuals each with a cleared status; or

(iii) a mix of uncleared juniors (all from the samehousehold) and other individuals each with acleared status;

(b) for a place at which a retail liquor business is for thetime being carried on — 5 or fewer individuals intotal who are all individuals each with a clearedstatus;

“Director” has the meaning given by section 2 of the InfectiousDiseases Act (Cap. 137);

“early childhood development centre” has the meaning given bysection 2 of the Early Childhood Development CentresAct 2017 (Act 19 of 2017);

“education business” means providing, in the course of anybusiness and whether involving the provision of care orotherwise —

(a) lessons or coaching in, or for participation in, acultural, recreational activity or sporting activity butnot a sporting event;

(aa) lessons or teaching based wholly on a religiousbelief, religious opinion or religious affiliation, or acourse of instruction or training to become a memberof a religious order or in the duties of a minister ofreligion;

(b) private tutoring;

(c) full-time education for the purpose of preparingstudents for any examination that leads to aqualification awarded by any person other than theperson which provides the full-time education or thatentitles the students to be admitted to an educationinstitution;

(d) a course of instruction, training or teaching leading tothe award of a diploma, degree, certificate or otherqualification;

(e) post-secondary education and training which isdirected towards the development or upgrading ofskills and knowledge in relation to work in commerceor industry;

(f) a post-secondary education program that leads to thedevelopment of knowledge and skills that are notspecific to any particular occupation; or

(g) services and facilities for the organising and conductof —

(i) examinations or assessments for professionalor vocational training, testing, certification oraccreditation; or

(ii) tests, examinations or other methods ofassessing the level of proficiency, aptitude,skill, knowledge or understanding of anindividual in any subject matter;

Includes appointing of examiners, obtaining question papers andkeeping them in safe custody, ensuring the identity of candidatesundertaking the test, examination or assessment, timely supply ofquestion or test papers to those candidates, proper invigilation, safecustody of answer papers, tabulation of marks obtained by thosecandidates from the test, examination or assessment, and publishingthe results.

“elite sportsperson” means an individual who is on adevelopment pathway recognised by a public bodypromoting sporting activities to prepare sportspersons sothat the individual may derive a living from competing in thatsporting activity or take part in a national or an internationalsporting event in Singapore or elsewhere;

“employee” and “employer” have the meanings given bysection 6 of the Workplace Safety and Health Act;

“enforcement officer” means a person appointed undersection 35(1) of the Act;

“enhanced entry control” means as follows:

(a) for any restricted place that is a room or place where anuptial event takes place or is to take place — arequirement to establish and maintain, during therestricted period of the nuptial event, all reasonablypracticable procedures and protocols that ensure thatonly the following enter or remain within the room orplace during that restricted period:

(i) a guest with a cleared status;

(ii) a guest who is an uncleared junior;

(iii) an individual who is ordinarily resident in thatplace of residence and within the maximumpermissible group size for the nuptial event, but

only where the restricted place is within a placeof residence;

(iv) an individual who is expressly allowed underregulation 13 of the Infectious Diseases(COVID-19 Access Restrictions andClearance) Regulations 2021 to enter andremain in such a restricted place;

(b) for any permitted premises that is a restricted placewithin the meaning of the Infectious Diseases(COVID-19 Access Restrictions and Clearance)Regulations 2021 — a requirement under thoseRegulations, other Control Order Regulations orthese Regulations to establish and maintain, allreasonably practicable procedures and protocolsthat ensure that an individual who —

(i) does not have a cleared status; and

(ii) is not expressly allowed under regulation 13 ofthose Regulations to enter and remain in such arestricted place,

does not enter or remain within the restricted placeduring the restricted period applicable to thatrestricted place under the Infectious Diseases(COVID-19 Access Restrictions and Clearance)Regulations 2021;

“Enterprise Minister” means the Minister charged with theresponsibility for domestic business policies;

“event” includes a meeting or gathering of any nature;[S 428/2020 wef 02/06/2020]

“face shield” means any film made from plastic or othertransparent material designed or made to be worn like a visor,covering from the wearer’s forehead to below the chin areaand wrapping around the sides of the wearer’s face, toprovide the wearer protection against smoke, dust or liquidspatter;

“foreign employee” has the meaning given by section 2(1) of theForeign Employee Dormitories Act 2015;

“funeral event” means a funeral, funeral wake or funeralprocession held during or before the burial or cremation ofthe deceased;

“funerary memorial event” means a ritual, observance orceremony —

(a) the sole purpose of which is to commemorate orhonour any deceased according to any religiouspractice or the tenets of any religion or religiousdenomination or belief; and

(b) which is held not within a place of residence and isheld after the funeral event for the deceased,

but does not include such a ritual, observance or ceremonyfor a public holiday;

“gathering” includes an assembly consisting of more than onecohort of individuals;

“guest”, in relation to a nuptial event, means an individual whois invited to attend the nuptial event but excludes any of thefollowing:

(a) a party to the marriage;

(b) a celebrant by whom the marriage is or is to besolemnized;

(c) a permitted enterprise engaged to organise the nuptialevent, or to provide authorised services —

(i) for the conduct of proceedings in the nuptialevent; or

“harbour craft” means any vessel which is used in the port forany purpose but is not a pleasure craft;

“management corporation” has the meaning given bysection 3(1) of the Land Titles (Strata) Act;

“mask” means any paper, plastic or textile covering solelydesigned or made to be worn over the nose and mouth toprovide the wearer protection against infections or airpollution, but excludes a face shield;

“maximum permissible group size”, in relation to any organisedgathering on any premises and circumstances described in theThird Schedule, means the number of individuals specified inthat Schedule opposite the organised gathering in thosepremises and circumstances;

“movement control measure”, in relation to an individual, meansa requirement for the individual not to leave a place ofaccommodation because of —

(a) an order made under regulation 3(1) of the InfectiousDiseases (COVID-19 — Stay Orders)Regulations 2020 (G.N. No. S 182/2020); or

“nuptial event” means —

(a) a solemnization of a marriage; or

“operator”, in relation to a specified dormitory, has the meaninggiven by regulation 13(3);

“organiser” includes —

(a) for a solemnization of a marriage — any person(whether or not for reward and whether jointly orotherwise) who procures for, or supplies to, any partyto the marriage, the premises and any goods andservices for the arrangements in connection with theholding of the solemnization of the marriage;

(b) for a wedding relating to a marriage — any person(whether or not for reward and whether jointly orotherwise) who procures for, or supplies to, any partyto the marriage, the premises and any goods andservices for the celebration arrangements inconnection with the holding of the wedding; or

(c) for a funerary memorial event— any individual whohas charge over the conduct of any ritual, observance,rite, worship or ceremony at the event, and anyperson (whether or not for reward and whether jointlyor otherwise) who procures or supplies —

(i) the premises where the event is held; and

(ii) any religious furnishings, religious items orgoods, and other services or arrangements,required for the conduct of any ritual,observance, rite, worship or ceremony inconnection with the holding of the event;

. Illustrations

(a) A function room in a condominium is hired by the groom for thepurpose of a wedding reception. He engages a wedding planner to organise thewedding reception and plan the reception programme. With the authorisation ofthe groom, the wedding planner collects the keys to the function room and liaiseswith the managing agent of the condominium to ensure the room is cleaned andprovisioned with the necessary utilities and furniture to hold the reception, andcoordinates with the caterer, florists and photographers to secure their entry intothe condominium and the timely set up and arrival of the food, furniture anddecorations for the reception. The wedding planner is an organiser of the weddingfor the purposes of this definition.

(b) A hotel proprietor provides the ballroom, food and decorations for thesolemnization of a marriage followed immediately by a wedding reception to beheld on the hotel grounds. The hotel proprietor, and the bride and groom whocontracted with the hotel for their solemnization and reception, are each anorganiser of the wedding for the purposes of this definition.

(c) A merchant association makes arrangements for priests to performprayer services to commemorate deceased persons in a void deck. Theassociation books the void deck and engages the services of 2 priests toconduct the rites, and a supplier of the religious furniture and items for theceremony. The merchant association and the priests are each an organiser of thefunerary memorial event for the purposes of this definition.

“participant”, in relation to a funerary memorial event, means anindividual who attends the event for the purpose of takingpart in any ritual, observance, rite, worship or ceremonycommemorating or honouring any deceased, whether or notexpressly invited to attend the event, but excludes any of thefollowing:

(a) a permitted enterprise engaged to organise thefunerary memorial event, or to provide authorisedservices —

(i) for the conduct of religious rituals,observances, rites, worship or ceremonyduring the event; or

(ii) for religious furnishings, religious items orgoods, and other services or arrangements,required for the conduct of the event;

(b) a permitted enterprise worker of a permittedenterprise in paragraph (a) who is at work inrelation to the event;

“permitted enterprise” means —

(a) the Government or any public body;

(b) a person who provides any goods or servicesspecified on the prescribed website, in the courseof business; or

(c) a person who has a conditional permit from theEnterprise Minister authorising the person to providegoods or services in the course of business;

“permitted enterprise worker”, in relation to a permittedenterprise —

(a) means an employee of the permitted enterprisedesignated by his or her employer as a permittedenterprise worker; and

(b) where the permitted enterprise is a principal, includesany individual as follows who is designated by theprincipal as a permitted enterprise worker:

(i) an individual who is a contractor or asubcontractor of the permitted enterprise;

(ii) an employee of a contractor or subcontractor insub-paragraph (i),

where the contractor or subcontractor or employee(as the case may be) works under the direction of thepermitted enterprise as to the manner in which thework is carried out;

“permitted premises” means any premises (with a unique streetname and number or land parcel number), a motor vehicleused as a retail food and drinks establishment, or a vessel,where a permitted enterprise ordinarily carries on any

business, undertaking or work connected with providing itsauthorised service, but excludes any other vehicle or aircraft;

“personal appearance service” has the meaning given byregulation 13(3);

“personalised service cohort” means a cohort —

(a) for the purpose of receiving any personal appearanceservice or personal care service that requires takingoff, or not wearing, one’s mask in order to receive theservice; and

(b) that consists of 5 or fewer individuals in total who areeither —

“place of residence” means —

(a) in relation to a subdivided building, an apartment orunit or a flat or lot in that building that is used as acomplete and separate unit for the purpose ofhabitation or business;

(b) in relation to a boarding premises in Singapore, aroom comprised in the boarding premises for the

accommodation of one or more boarders or lodgers atthose premises, but not a room with shared facilitiessuch as a communal living room, bathroom, laundryor kitchen; and

(c) in relation to a building in Singapore used asspecified accommodation or a specified hostel, aroom in the building for the accommodation of one ormore guests or residents of the specifiedaccommodation or the specified hostel;

“pleasure craft” means any vessel that —

(a) is intended for use within the port exclusively forsport or pleasure purposes; and

(b) is licensed under the Maritime and Port Authority ofSingapore (Pleasure Craft) Regulations (Cap. 170A,Rg 6) for private use,

but does not include any craft which is used to carrypassengers on sightseeing tours within the port for whicheach such passenger is charged a separate and distinct fare;

“port” has the meaning given by the Maritime and PortAuthority of Singapore Act (Cap. 170A);

“prescribed website” means the Internet website of theGovernment athttps://covid.gobusiness.gov.sg/permittedlist/;

“public body” means a body corporate established by a publicAct for the purposes of a public function;

“public path” has the meaning given by section 2(1) of theActive Mobility Act 2017 (Act 3 of 2017);

“public speaking”means giving or engaging in any talk, addressor sermon by an individual in person;

“restricted period”, for a nuptial event, means the timeprescribed in item 1, 9 or 10 of Part 1 of the SecondSchedule to the Infectious Diseases (COVID-19 AccessRestrictions and Clearance) Regulations 2021 for that kind ofnuptial event;

“retail business” means a business the principal purpose ofwhich is —

(a) selling goods by retail;

(b) providing retail services; or

(c) hiring by retail, or displaying goods for the purposeof selling them by retail or hiring them out;

“retail food and drinks establishment” has the meaning given byregulation 13(3);

“retail liquor business” has the meaning given byregulation 13(3);

“retail market” is an assemblage of stalls, styled or described asa market or court, that —

(a) is predominantly used for retail businesses; and

(b) operate in a building or other permanent structure thesole or dominant use of which (or of the part in whichthe market operates) is the operation of the market orcourt;

“retail shop” means any premises or place used for retailbusiness, and includes a supermarket, department store, retailfood and drinks establishment and retail market, but does notinclude —

(a) a vending machine; and

“retail shopping centre”means a cluster of units in premises (notbeing the stalls in a market) that has all of the followingcharacteristics:

(a) at least 5 of the units in the premises are used whollyor predominantly for the carrying on of one or morelisted businesses as retail shops;

(b) the units —

(i) are all owned by the same person;

(ii) have (or would if leased have) the same lessoror the same head lessor; or

(iii) comprise lots within a single strata plan underthe Land Titles (Strata) Act;

(c) the units are located —

(i) in one building; or

(ii) in 2 or more buildings that are either adjoiningor separated only by common areas or otherareas owned by the person in paragraph (b)(i)or (ii);

(d) the cluster of units is promoted as, or generallyregarded as constituting, a shopping centre, shoppingmall, shopping court or shopping arcade;

“room” means any area within a building that is fully enclosedon all sides;

(ii) any stanchion with barrier rope or tape, screenor other similar physical barrier, that is at least2 metres away from the perimeter of anothersegregation zone;

(d) there are not more than 10 individuals (inclusive ofthe individual concerned) engaged in public speakingat the same time at the same event without wearing amask;

“visitor”, in relation to the permitted premises of a permittedenterprise, means an individual who has a lawful reason toenter or remain in those premises but is —

(2) In these Regulations, an individual may be regarded as amember of the same household of another individual if thefirstmentioned individual is any of the following ordinarily livingin the same place of residence as the other individual:

(a) a spouse of that other individual;

(b) a parent, a child or a sibling of that other individual;

(c) an individual with whom that other individual has anagreement or arrangement, whether oral or in writing andwhether express or implied, to live in the same place ofresidence.

(3) In these Regulations, a reference to a parent, grandparent, child,grandchild or sibling in relation to an individual includes a referenceto a step-parent, stepgrandparent, stepchild, stepgrandchild orstepsibling or a parent, grandparent, child, grandchild or sibling, byadoption, of that individual.

(5) To avoid doubt, the maximum permissible group size prescribedin these Regulations for any gathering in a room or place —

(a) does not affect the right of the owner or lessor of the roomor place to grant or withhold permission to enter or remainin the room or place; or

(b) if the room or place is on board or is a vessel, does notauthorise a number of individuals on board the vessel that

(6) In these Regulations, a solemnization with virtual participationis a solemnization that involves any individual performing any act, orwitnessing or attesting the doing of anything, for the purpose of anyof the following provisions through the use of a live video or livetelevision link approved under section 2(1)(a) or 3(1)(a) of theCOVID-19 (TemporaryMeasures for Solemnization and Registrationof Marriages) Act 2020 (Act 23 of 2020), in lieu of being present orappearing in person:

(a) section 22(2), 28(2)(b) or 29(1) or (3)(b) of the Women’sCharter;

(b) section 95(2)(b), 102(1)(a) or 103(1), (3) or (5) of theAdministration of Muslim Law Act.

(7) In these Regulations, for an individual who is attending anuptial event (whether as a guest, a celebrant or a party to themarriage) —

“approved antigen rapid test” means an antigen rapid testperformed in Singapore in relation to an individual using anyof the test products specified in the Schedule to the InfectiousDiseases (Antigen Rapid Test Providers) Regulations 2021(G.N. No. S 267/2021), the purpose of which is to test for thepresence of SARS-CoV-2 in that individual;

“approved supervisor” means the person having the charge,management or control of the room or place where the nuptialevent takes place or is to take place, either on the person’sown account or as agent of another person, during that period;

“enhanced cleared status” means that —

(a) he or she has a cleared status (general) that is currentunder the Infectious Diseases (COVID-19 AccessRestrictions and Clearance) Regulations 2021 and,within the period of 24 hours before the end of thenuptial event —

(i) he or she undergoes an approved test orapproved tests or a supervised self-administered antigen rapid test; and

(ii) his or her approved test result is treated underthose Regulations either as negative for SARS-CoV-2 or an atypical finding for SARS-CoV-2,or the result from the supervised self-administered antigen rapid test shows nopresence of SARS-CoV-2 in that individual; or

(b) he or she is an uncleared junior and, within the periodof 24 hours before the end of the nuptial event —

(i) he or she undergoes an approved test orapproved tests or a supervised self-administered antigen rapid test; and

(ii) his or her approved test result is treated underthose Regulations either as negative for SARS-CoV-2 or an atypical finding for SARS-CoV-2,or the result from the supervised self-administered antigen rapid test shows nopresence of SARS-CoV-2 in that unclearedjunior;

“supervised self-administered antigen rapid test” means —

(a) the individual removing a respiratory specimen fromthe lining of his or her oral or nasal passage under thesupervision of an approved supervisor for thepurpose of subjecting the respiratory specimen toan approved antigen rapid test under paragraph (b);

(b) the individual then subjecting, under the supervisionof an approved supervisor, the respiratory specimenremoved under paragraph (a) to an approved antigenrapid test for the purpose of testing for the presence ofSARS-CoV-2 in that individual; and

(c) the individual or approved supervisor thenascertaining the results of the approved antigen

rapid test and recording the results, even if uncertainor invalid.

(8) For the purposes of paragraph (7), an individual is treated asundergoing or having undergone an approved test in the same manneras under the Infectious Diseases (COVID-19 Access Restrictions andClearance) Regulations 2021.

Application

3.—(1) These Regulations do not apply in relation to —

(b) a specified school; or

(c) any early childhood development centre licensed under theEarly Childhood Development Centres Act 2017.

(2) These Regulations do not apply to prevent or restrict —

(a) the Government or any public body doing or omitting to doanything in the performance of any function, the exerciseof any power or the discharge of any duty of theGovernment or public body (as the case may be) underlaw; or

(b) any individual acting under the authority or direction of theGovernment or any public body in the performance of anyfunction, the exercise of any power or the discharge of anyduty of the Government or public body (as the case maybe) under law.

(3) Without limiting the meaning of “reasonable excuse” insection 34(7) of the Act, it is a reasonable excuse for a persondoing or omitting to do any act in contravention of any provision ofthese Regulations if the act is done or omitted to be done in good faithand for the purpose of complying with or giving effect to —

(a) any other written law; or

4.—(1) Nothing in this Part applies to authorise an individual whois subject to a movement control measure to contravene or not complywith a requirement by or under any other written law to not leave hisor her place of accommodation.

Prohibition on social gatherings

6.—(1) An individual must not arrange to meet, or organise orattend a gathering made up of, any other individual or individuals fora common purpose at any place outside of the firstmentionedindividual’s ordinary place of residence, except in a cohort —

(a) that is a solemnization special cohort or a cohort inregulation 7A(2A)(b)(ii), where the purpose of gathering isthe solemnization of a marriage;

(2) Without limiting the meaning of “reasonable excuse” insection 34(7) of the Act, a reasonable excuse for contravening thisregulation includes gathering in the following circumstances:

(i) the Government or a public body;

Individuals to keep safe distance

7.—(1) Every individual in any public place or common property ofany subdivided building must keep a distance of at least one metrefrom any other individual.

(2) However, paragraph (1) does not apply when the individual —

(a) is part of —

(i) a gathering that is a solemnization special cohort andthe other individual is also allocated to thatsolemnization special cohort;

(ii) an activity cohort and the other individual is part ofthat same activity cohort;

(a) sit on a fixed seat that is demarcated as not to be occupied;or

7A.—(1) A celebrant must postpone proceedings to solemnize amarriage under the Administration of Muslim Law Act or theWomen’s Charter if —

(a) any party to the intended marriage present is not wearing amask or face shield and the celebrant is not satisfied thatthe party has an enhanced cleared status; or

(2) An organiser of a solemnization of a marriage taking place inany room or place that is a place of residence must take (or cause to betaken) all reasonably practicable steps —

(a) to establish and apply appropriate procedures and controls(jointly with another or otherwise) during thesolemnization of the marriage that enable or facilitatecontact tracing of —

(i) every guest of the solemnization of the marriage whoenters the room or place; and

(ii) every permitted enterprise (and its permittedenterprise workers) engaged in providing at theroom or place authorised services for the conduct ofproceedings in the solemnization of the marriage;

(b) to ensure that the gathering of individuals attending thesolemnization of the marriage in the room or place does notduring the solemnization of the marriage exceed themaximum permissible group size for the solemnizationof the marriage in that room or place;

(ba) to ensure that during the solemnization of the marriage,every individual must be wearing a mask when in thatroom or place unless —

(i) the individual is allowed under regulation 3B(a), (b)or (d) to wear a face shield in lieu of a mask; or

(ii) the individual is a party to the marriage and has anenhanced cleared status;

(i) any variety act or singing or dancing in person or anyperformance of music in person by playing any windmusical instrument;

(ii) any performance of music in person by playing amusical instrument that is not a wind musicalinstrument otherwise than in a substantiallystationary position;

(iii) any organised competition of games of skill orchance; and

(d) to ensure that a party to the marriage maintains anappropriate longer distance than one metre from anyguest of the solemnization of the marriage, and any otherindividual, in the room or place when the bride or groom is,with reasonable excuse, not wearing a mask and face shieldduring the solemnization of the marriage.

(f) to ensure that regulations 10B(1)(k) and 12 are compliedwith during the solemnization of the marriage as if —

(i) the room or place were permitted premises, everyguest attending the solemnization of the marriagewere a customer and the organiser were a permittedenterprise;

(a) who is not in the solemnization special cohort at thatsolemnization, if the individual is allocated underregulation 7A(2A)(b)(i) to the solemnization specialcohort; or

(b) who is not in the same cohort that the guest is allocated tounder regulation 7A(2A)(b)(ii).

(2C) To avoid doubt —

(a) paragraph (1) applies with respect to proceedings tosolemnize a marriage under the Administration ofMuslim Law Act or the Women’s Charter even where —

(i) those proceedings take place concurrently with or ina manner indistinguishable from an organised

gathering made in connection with the celebration ofa marriage; or

(ii) those proceedings at any premises are followedimmediately or without a break by an organisedgathering made in connection with the celebration ofthe marriage at the same premises (whether or not inthe same room or place);

(b) an individual does not attend a solemnization of a marriageby reason only of being —

(i) engaged to organise the solemnization, or to provideauthorised services for the conduct of proceedings inthe solemnization of the marriage or for celebrationarrangements made in connection with the marriage;or

(ii) employed or engaged by a person insub-paragraph (i) and at work in relation to thesolemnization; and

(c) this regulation does not derogate from any otherrequirements in these Regulations applicable to anorganiser who is a permitted enterprise unless expresslystated.

8.—(1) An organiser of a wedding taking place in any room orplace must take (or cause to be taken) all reasonably practicablesteps —

(a) to ensure that the room or place is not —

(i) in a place of residence;

(ii) in a place at which a retail liquor business is for thetime being carried on; or

(iii) on board a vessel that is not a pleasure craft;

(b) to establish and apply appropriate procedures and controls(jointly with another or otherwise) during the wedding thatenable or facilitate contact tracing of —

(i) every guest of the wedding who enters the room orplace; and

(ii) every permitted enterprise (and its permittedenterprise workers) engaged in providing at theroom or place authorised services for celebrationarrangements made in connection with the wedding;

(c) where there are more than 98 guests attending thewedding —

(i) to establish one or more segregation zones in theroom or place, with each zone providing for not morethan 100 individuals (if they are guests or parties tothe marriage) to be seated within the segregationzone; or

(ii) to establish an attendance time for each guest of thewedding (excluding a member of the weddingspecial cohort) to attend in person at the wedding,with each attendance time providing for not morethan 100 individuals (if they are guests or parties tothe marriage) to attend the wedding during that time;

(d) to allocate guests of the wedding into the respectivesegregation zones or attendance times (where applicable)and then into either of the following cohorts, and to arrangefor them to be seated accordingly:

(i) the wedding special cohort at the wedding;

(ii) a cohort consisting of —

(A) 5 or fewer guests each with a cleared status;

(B) 5 or fewer guests who are uncleared juniors allfrom the same household; or

(C) 5 or fewer guests in total, consisting of one ormore uncleared juniors (all from the samehousehold) and other guests with a clearedstatus;

(e) to ensure that —

(i) any guest of the wedding (even if a member of thewedding special cohort) who is allocated a seat in asegregation zone (where applicable) does not, duringthe wedding, enter another segregation zone at thatsame wedding; and

(ii) any guest of the wedding who is allocated to attendthe wedding during an attendance time does notattend the wedding at a different time (whetherearlier or later) except to comply with a procedure orcontrol for the purposes of sub-paragraph (f)(iii);

(f) to establish and apply procedures or controls so as —

(i) to ensure that a guest allocated a seat in a segregationzone does not physically interact with another guestallocated a seat in another segregation zone when theguests enter or leave each guest’s allocatedsegregation zone;

(ii) to minimise the transmission of COVID-19 betweenguests in different segregation zones;

(iii) to prevent any guest of the wedding who is allocatedto attend the wedding during an attendance time fromentering the room or place where the wedding is heldunless 30 minutes or more have lapsed after allguests allocated to the earlier attendance time haveleft the room or place; and

(iv) to cause or enable any area, furniture, fittings,device, article or thing within the room or placethat is used by guests allocated to differentattendance times, or is used by guests to movethrough the room or place, to be cleaned anddisinfected before the start of each attendance time,so as to minimise the transmission of COVID-19from the use of the same area, furniture, fittings,device, article or thing by guests attending thewedding at different attendance times;

(g) to minimise physical interaction during the weddingbetween guests of the wedding unless they are —

(i) all from the same wedding special cohort at thewedding; or

(ii) all from the same cohort allocated undersub-paragraph (d)(ii);

(ii) by not more than 10 individuals in total at any timeduring the wedding;

(2) An organiser of a wedding taking place in any room or placemust take (or cause to be taken) all reasonably practicable steps toensure that any food or drinks (or both) for consumption at thewedding are not provided by way of a buffet.

(3) An individual who is a guest at a wedding taking place in anyroom or place must, during the wedding, minimise physicalinteraction with any other guest at the same wedding —

(a) who is not in the wedding special cohort at the wedding, ifthe individual is allocated under paragraph (1)(d)(i) to thewedding special cohort; or

(b) who is not in the same cohort that the individual isallocated to under paragraph (1)(d)(ii).

(4) An individual who is a guest at a wedding and has beenallocated a seat in a segregation zone under paragraph (1)(d) must notenter any other segregation zone at the same wedding.

(5) An individual who is a guest at a wedding and has beenallocated an attendance time for the wedding established underparagraph (1)(c)(ii) must not enter the room or place where thewedding is held at any other time except to comply with a procedureor control for the purposes of paragraph (1)(f)(iii).

(6) To avoid doubt —

(a) an individual does not attend a wedding connected with thecelebration of a marriage by reason only of being —

(i) engaged to organise the wedding, or to provideauthorised services for the conduct of proceedings inthe solemnization of the marriage or for celebrationarrangements made in connection with the wedding;or

(ii) employed or engaged by a person insub-paragraph (i) and at work in relation to thesolemnization or wedding; and

(b) this regulation does not derogate from any otherrequirements in these Regulations applicable to anorganiser who is a permitted enterprise unless expresslystated.

Closure of premises

9.—(1) Except as otherwise provided in these Regulations, anowner or occupier of any premises other than residential premisesmust ensure that the premises are closed to entry by any individual.

(1A) Paragraph (1) does not apply where an individual enters thepremises to carry out such works as are necessary to avoid anyimminent injury or damage to property within the premises.

10. Regulation 9 does not prevent a permitted enterprise carryingon business, an undertaking or work at any permitted premises of thepermitted enterprise without closing those permitted premises toentry by any individual —

(a) with the prior permission of the Enterprise Minister; and

(b) in accordance with the restrictions for that type of business,undertaking or work specified on the prescribed website orany conditions imposed in the permission mentioned inparagraph (a).

Requirements for funerary memorial events

10AA.—(1) An organiser of a funerary memorial event takingplace in any room or place must take (or cause to be taken) allreasonably practicable steps —

(a) to ensure that the participants attending the event in theroom or place do not at any time during the event exceedthe maximum permissible group size for the event in thatroom or place;

Division 1 — Safe management measures forcustomer operations

Limiting of capacity for retail floor area, etc.

10A.—(1) This regulation applies only to the following permittedpremises, which has more than 930 square metres of total floor areaattributable to retail shops:

(a) a retail shopping centre;

(b) a bulky retail shop or other retail shop that is the sole orpredominant occupier of a single building, or of 2 or more

buildings that are either adjoining or separated only bycommon areas or other areas owned by the same owner.

(2) Every relevant occupier of permitted premises mentioned inparagraph (1) must take all reasonable steps to ensure that the totalnumber of customers and visitors within the retail common area of thepermitted premises does not, at any time, exceed the prescribedthreshold for those permitted premises.

(3) The prescribed threshold for any permitted premises mentionedin paragraph (1) is the number (rounded up to the nearest wholenumber) resulting from dividing by 10, the total floor area of thepremises attributable to the retail shops.

(4) The floor area of the permitted premises attributable to the retailshops is —

(a) the total of all the lettable retail area in the permittedpremises, and the floor area of the retail common areas;less

(b) the floor area of all car parking and roof terraces within thepremises.

(5) In this regulation —

“bulky retail shop” means a retail shop handling —

(a) household appliances and fittings, furniture,homeware, office equipment, outdoor andrecreation equipment or party supplies;

(b) pets and pet supplies, plants, landscaping andgardening supplies and equipment;

(c) building and construction materials, hardware, walltiles or floor tiles or similar coverings, motorvehicles, boats, or motor vehicle or boat parts andaccessories; or

(d) other goods that are of a size, weight or quantitywhich require a large area for handling, display orstorage;

“floor area” has the meaning given by rule 2(1) of the Planning(Development Charges) Rules (Cap. 232, R 5);

“lettable retail area”, for any premises mentioned inparagraph (1), means the floor area of all of the followingin those premises:

(a) the area used, or intended for use, by the owners orlessees of retail shops in the permitted premises inrelation to the conduct of their retail businesses intheir retail shops in those premises, including anyarea that is part of common property which an owneror lessee of a retail shop has a right to the exclusiveuse of the area;

(b) so much of the area of the permitted premises as aredesigned and available for use in carrying on thebusiness that is, or will be, carried on at a retail shop;

“relevant occupier”, for any permitted premises mentioned inparagraph (1), means any of the following:

(a) where the permitted premises is a retail shoppingcentre, each of the following:

(i) the permitted enterprise that is the person inparagraph (b)(i) or (ii) of the definition of“retail shopping centre” in regulation 2(1), or amanagement corporation, having themanagement and control of the commonproperty of those premises;

(ii) a person managing or controlling, or apparentlymanaging or controlling, the common propertyof those premises in those premises;

(iii) an individual who is, or appears to be, theemployer or agent of any person insub-paragraph (i) or (ii) and at workmanaging and maintaining the commonproperty of those premises;

(b) in any other case, each of the following:

(i) the permitted enterprise entitled to occupythose premises;

(ii) a person managing or controlling, or apparentlymanaging or controlling, a business, anundertaking or work carried on in thosepremises;

(iii) a person who is, or appears to be, the employerof any individual at work in the businesscarried on in those premises;

“retail common areas”, for any permitted premises mentioned inparagraph (1), means such areas in the permitted premisesthat are used, or intended for use —

(a) by the public; or

(b) in common by the owners or lessees of retail shops inthe premises in relation to the conduct of their retailbusinesses in their retail shops in the premises,

but excludes any area designed and available for use, or usedor leased, for carrying on the business that is, or will be,carried on at a retail shop that is a unit, or a lot within a strataplan under the Land Titles (Strata) Act;

10B.—(1) A permitted enterprise occupying permitted premisesmust take the following measures when those premises are open toentry by customers or visitors of the permitted enterprise:

(a) as far as is reasonably practicable, allow natural ventilationof the permitted premises during working hours;

(b) where the permitted premises is, at any time it is open forbusiness, a restricted place within the meaning of theInfectious Diseases (COVID-19 Access Restrictions andClearance) Regulations 2021, take all reasonable steps tocomply with the enhanced entry control with respect toevery customer or visitor to the permitted premises;

(i) ensure that any common area, furniture or fittings withinthe permitted premises which is used by customers, visitorsor persons at work (or any of them in combination) in thosepremises, or is used by such individuals to move throughthe permitted premises (commonly called high-touchplaces and surfaces) —

(i) is periodically cleaned and disinfected within eachday, following appropriate procedures and at anappropriate frequency so as to minimise thetransmission of COVID-19 from the use of thesame area by several customers, visitors or permittedenterprise workers (or any combination of them) atthe same or different times;

12.—(1) A permitted enterprise must, in relation to its permittedpremises when not closed to entry to individuals, take all reasonablesteps —

(a) where seating at a table is provided for customers orvisitors —

(i) to ensure that the back of every chair, or the legs ofthe chair if there is no such back, for each table is atall times at least one metre away from any other chairfor another table; or

whether or not being part of a hotel, club or retail shoppingcentre, but not any part of the premises or place where a retailfood and drinks business is carried out;

(a) the prefabrication or testing of building elements atpermitted premises that is specially established forprefabrication and that is not a construction site;

(b) the preparation of concrete, sand or aggregate at aplace specially established for that purpose and that isnot a mine, quarry or construction site,

and includes any managerial or administrative work inconnection with building elements supply work butexcludes any special work;

“building elements supply worker”means a permitted enterpriseworker employed or engaged to perform building elementssupply work;

“construction site” means a work site at which constructionwork is performed;

“construction work” means any manual or mechanical workperformed in connection with the following:

(a) the erection, extension, alteration or repair of abuilding;

(b) the demolition of a building;

(c) the preparation for, and laying the foundation of, anintended building;

(d) the provision, extension or alteration of any air-conditioning service or ventilating system in or inconnection with a building;

(e) the excavation or site formation works connectedwith or carried out for the purpose of paragraph (a),(b) or (c);

(f) the assembly of prefabricated building elements toform a building, or the disassembly of prefabricatedbuilding elements that immediately before thedisassembly formed a building;

(g) the removal from the construction site of any productor waste resulting from the demolition or any work inparagraphs (a) to (f);

(h) the installation, testing, maintenance and repair workor insignificant building works performed inconnection with any work in paragraphs (a) to (f),

and includes any managerial or administrative work inconnection with construction work, but does not include —

(i) work consisting only of insignificant building works;

(j) minor testing or maintenance work in connectionwith a building;

(k) assembly or disassembly of fixed plant not requiringbuilding plans approval or a permit to carry outstructural works to be granted under the BuildingControl Act before starting;

(l) related work; or

(m) special work;

“construction worker” means a permitted enterprise workeremployed or engaged to perform construction work;

“function centre” means a premises or place used for theoperation or conduct of events, functions, ceremonies,conferences, exhibitions and the like, and includes afunction room, convention centre, exhibition centre andreception centre, but does not include an entertainmentfacility;

“high-intensity physical exercise”means engaging in or playinga game involving —

“liquor” has the meaning given by the Liquor Control (Supplyand Consumption) Act 2015 (Act 5 of 2015);

“operator”, in relation to a specified dormitory —

(a) means a person who is managing and maintaining, inthe course of a business, the specified dormitory(whether self-owned or under lease or otherwise) toprovide board and lodging for residents of thedormitory who may or may not be employees ofthat person; and

“outdoor physical recreational facility” means any enclosedpremises that is or may be made available in the course of anybusiness for use, or is otherwise operated, predominantly foroutdoor sporting activities and outdoor physical recreation,and includes —

(a) a golf course and an outdoor golf driving range;

(b) a water-ski centre;

(c) an equestrian centre;

(d) a skate-board ramp or go-kart track;

(e) a lawn bowling green;

(f) an outdoor climbing wall;

(g) an outdoor track, exercise park or hardcourt, such asfor playing of basketball or tennis outdoors;

(h) an outdoor rifle range; and

“permitted enterprise worker”, without limiting regulation 2(1),includes —

(a) the sole proprietor and every partner of a partnershipthat is a permitted enterprise, whether or not he or sheis also a visitor;

“process maintenance work” —

(a) means work in connection with the preventive,predictive and breakdown maintenance of plantequipment in the petroleum, petrochemicals orspecialty chemicals sector; and

(i) wiring work within a building for telecommunicationpurposes;

(j) insignificant building works that are not performedtogether with construction work or renovation work,

but excludes any construction work, building elementssupply work, special work and renovation work;

“related worker”means a permitted enterprise worker employedor engaged under a work pass for the Construction Sector, toperform related work;

“renovation work” means —

(a) joinery and other woodworks (including carpentry,laminated or parquet flooring);

(b) painting of a building;

(c) glass and glazing works (including mirror or showerscreen installation);

(d) laying and installation of a new floor, wall tiles,doors, windows, false ceilings or sanitary fittings; or

“responsible person”, in relation to a funeral event, means —

(a) the funeral director or any other person who isengaged to organise the funeral event; or

(b) where a person mentioned in paragraph (a) has notbeen engaged for the funeral event, the owner oroccupier of the premises in which the funeral event isheld;

“retail food and drinks business” means a business or anundertaking or activity at a premises or place that involves, inwhole or part, the preparation of food or drinks (or both)intended for sale predominantly for immediate consumption;

Application to sole proprietors, partners, etc.

13L. Where a permitted enterprise is a sole proprietor or apartnership, a corporation or an unincorporated association (otherthan a partnership), this Division and the Second Schedule apply,with the necessary modifications, to each of the following individualswhen at work, whether or not in the permitted premises of thepermitted enterprise, as if he or she were a permitted enterpriseworker of the permitted enterprise:

(a) the sole proprietor and every partner of the partnership,whether or not he or she is also a visitor;

(b) every director, partner, chief executive, manager, secretaryor other similar officer of the corporation, whether or nothe or she is also a visitor or permitted enterprise worker;

(c) the president, the secretary, or any member of thecommittee of the unincorporated association, whether ornot he or she is also a visitor or permitted enterpriseworker.

Compoundable offences

14.—(1) An offence under section 34(7) or 35(9) or (10) of the Actmay be compounded by any of the following persons, in accordancewith section 243(2), (4) and (5) of the Criminal Procedure Code(Cap. 68):

(a) the Director of Medical Services;

(b) the Director-General of Public Health appointed undersection 3(1) of the Environmental Public Health Act(Cap. 95);

7. Every individual who wishes to stay at the specified accommodation orspecified hostel must, before the individual is permitted to do so, provide thefollowing:

(a) a written declaration of the individual’s purpose in staying at thespecified accommodation or specified hostel;

(c) where the individual holds a work pass issued under section 7 of theEmployment of Foreign Manpower Act (Cap. 91A), the name of theemployer as specified in the work pass and the contact number or othercontact particular of the employer.

8. The records obtained under paragraph 7 must be kept for not less than 28 daysafter the end of each individual’s stay in the specified accommodation or specifiedhostel.

9. Every individual not subject to a movement control measure must not at anytime be allocated accommodation in or permitted to enter a room occupied by anindividual subject to a movement control measure, in the specifiedaccommodation or specified hostel, unless the firstmentioned individual is acaregiver for the other individual.

9A. Every guest subject to a movement control measure must be brought to hisor her allocated room in a manner that will ensure that the guest does not at alltimes come within one metre of any other guest or visitor in the specifiedaccommodation or specified hostel.

10. The person managing and maintaining the specified accommodation orspecified hostel, or an individual employed or otherwise engaged by that person, ispresent at the specified accommodation or specified hostel at all times to ensurethat the measures in this Schedule are implemented and complied with.

11. A visitor whom the person managing and maintaining the specifiedaccommodation or specified hostel knows or has reason to believe is subject toa movement control measure must be refused entry into the specifiedaccommodation or specified hostel.

12.—(1) Where the specified accommodation or specified hostel is or containsthe place of accommodation that any isolation subject is ordered to go to and notleave under the terms of the isolation subject’s movement control measure, theperson that manages and maintains, in the course of a business, the specifiedaccommodation or specified hostel must comply with the following in relation toevery isolation subject allocated a place of accommodation in the specifiedaccommodation or specified hostel:

(a) take all reasonably practicable steps to ensure that the isolationsubject —

(i) undertakes the supervised isolation in that place ofaccommodation in accordance with the terms of the isolationsubject’s movement control measure;

(ii) undergoes every medical examination specified in any ordergiven to the isolation subject under section 8 or 45A(1) of theInfectious Diseases Act (Cap. 137), or that is part of thesurveillance the isolation subject is ordered under section 16 ofthat Act to undergo; and

(iii) submits to a medical examination, have his or her blood orother body sample taken for examination or undergoes anytreatment that is specified in any written notice given to theisolation subject under section 55(1)(f) of the InfectiousDiseases Act;

(b) as far as is reasonably practicable cooperate with, and must notintentionally or negligently prevent, any isolation subject carrying outhis or her obligations under the isolation subject’s movement controlmeasure and any order or written notice mentioned insub-paragraph (a)(ii) or (iii);

(c) despite paragraph 15(a), keep and maintain daily records, for at least28 days after the day the record is made, containing the followinginformation about every guest of and every visitor to the specifiedaccommodation or specified hostel who physically meet in thespecified accommodation or specified hostel with any such isolationsubject:

(i) the particulars of identity, and the mobile telephone number orother contact detail, of each such guest or visitor;

(ii) the respective times of each such guest or visitor (as the casemay be) entering the specified accommodation or specifiedhostel to meet the isolation subject, and then leaving thespecified accommodation or specified hostel;

(iii) the purpose for, and the room in, which the guest or visitormeets or is to meet the isolation subject;

(iv) the body temperatures of each such guest or visitor taken whenentering the specified accommodation or specified hostel.

(2) In this paragraph, “isolation subject”means an individual who is subject to amovement control measure.

13. The specified accommodation or specified hostel must be kept andmaintained in a safe and sanitary condition.

(a) records must be kept of —

(i) the identity of each guest or visitor who enters or leaves thespecified hostel each day;

(ii) only one level of each bunk bed provided for occupation in aroom of the specified hostel may be permitted for occupation,and each occupied level of a bunk bed in such a room must notbe adjacent to an occupied level of an adjacent bunk bed;

(d) all events in a specified hostel involving its guests or its guests andvisitors must be disallowed, or stopped immediately if these happen;

PART 3

RETAIL FOOD AND DRINKS ESTABLISHMENT

1.—(1) A permitted enterprise carrying on a retail food and drinks business —

(a) must not sell or supply, or cause or allow to be sold or supplied, at itspermitted premises that is a retail food and drinks establishment anyfood or drink for immediate consumption on those premises; and

(b) must not allow any customer or visitor to consume any food or drink onthose premises,

if the customer or visitor does not have a cleared status and is not an unclearedjunior.

(2) To avoid doubt, this paragraph does not prohibit the entry into, and the saleor supply of any food or drink at, a retail food and drinks establishment by acustomer or visitor who does not have a cleared status if he or she —

(a) collects food or drink from the retail food and drinks establishment,being food or drink that has been pre-ordered by telephone (includingorders by text message), through a website, or otherwise by onlinecommunication; or

(b) collects the food or drink in a vehicle, and to whom the food or drink ispassed without the purchaser or any other individual leaving thevehicle.

2. Despite regulation 10B(1)(k)(i) and (n), but subject to regulation 6, thepermitted enterprise carrying on a retail food and drinks business must take, orcause to be taken, all reasonably practicable measures to ensure that, in respect ofits permitted premises which is a retail food and drinks establishment —

(a) any customer or visitor without a cleared status does not enter orremain within the permitted premises to consume any food or drink inthose premises unless the customer or visitor is an uncleared junior;

(b) every customer or visitor who consumes or intends to consume withinthose premises any food or drink supplied or provided at thosepremises, is doing so alone, or is allocated into and remains part of adining-in activity cohort applicable to the retail food and drinksestablishment; and

(c) there is a distance of at least one metre between every member of everysuch dining-in activity cohort within those permitted premises fromany of the following who consume or intend to consume, within thosepremises, any food or drink supplied or provided at those premises:

(i) any other lone customer or visitor who is not part of any dining-in activity cohort applicable to the retail food and drinksestablishment;

(ii) any other customer or visitor who is a member of anotherdining-in activity cohort applicable to the retail food and drinksestablishment.

2A. Where —

(a) any permitted premises of a permitted enterprise that is a retail foodand drinks establishment adjoin or abut onto the permitted premises ofanother permitted enterprise —

(i) which is another retail food and drinks establishment; or

(ii) where a retail liquor business is carried on; and

(b) the common boundary between those premises is —

(i) demarcated by plants or other vegetative barrier (potted orotherwise), a stanchion with a barrier rope or tape, a wire fence,a divider, furniture, or any other thing which is neither a partywall nor a floor-to-ceiling, non-porous partition; or

(ii) not demarcated in any way with any thing, such as a commonboundary in an outdoor dining space or a five-foot way orfootpath,

each permitted enterprise must take, or cause to be taken, all reasonablypracticable measures to ensure that no customer or visitor who consumes orintends to consume within its respective permitted premises any food or drink, is

allocated a seat or a standing space in its respective permitted premises which iswithin 0.5 metres of the common boundary.

3. The permitted enterprise must not provide on its permitted premises that is aretail food and drinks establishment any food or drinks (or both) for consumptionby way of a self-service buffet.

4.—(1) The permitted enterprise must, in respect of its permitted premises thatis a retail food and drinks establishment, cordon off and prevent the use of any partof the retail food and drinks establishment which is a part designed for theprincipal purpose of serving liquor for immediate consumption there (commonlycalled a bar), unless drinks (which may include liquor) and cooked food areserved, or allowed to be served, to any customer for consumption at the bar.

(2) In sub-paragraph (1), “cooked food” does not include pre-packed or ready-to-eat food that —

(a) does not necessarily require any further preparation or handling beforeconsumption; and

(b) can be stored at room or ambient temperature before its packaging isopened and, after the packaging is opened, may not requirerefrigeration.

5. Immediately after 10.30 p.m. every day a retail food and drinks establishmentis open for business, the permitted enterprise of that retail food and drinksestablishment must stop —

(a) the sale and serving of liquor for consumption on the retail food anddrinks establishment; and

(b) the consumption of liquor on the retail food and drinks establishment,

regardless of the trading hours specified in any licence granted under the LiquorControl (Supply and Consumption) Act 2015 or authorised under that Act inrelation to that retail food and drinks establishment.

6. Subject to paragraph 7, the permitted enterprise must not provide, or allow,any of the following to occur within its permitted premises that is a retail food anddrinks establishment when it is open for business:

(a) any live performance, exhibition or display of gymnastics oracrobatics, lecture, talk or address, whether by the customers orotherwise;

(b) any display or exhibition (whether on a television or other screen) tocustomers in or around the retail food and drinks establishment of —

(i) any film or video recording;

(ii) any television programme received from a free-to-airbroadcasting service (such as live sports events or news) or asubscription nationwide television service; or

(iii) any live performance, exhibition or display of gymnastics oracrobatics, lecture, talk or address happening elsewhere(whether in or outside Singapore and whether in a public orprivate place), using real-time transmission of the liveperformance, exhibition or display, lecture, talk or address;

(c) any playing of music, singing, lecture, talk or address or any othersound which is not pre-recorded and which is likely to be audible tocustomers in or around the retail food and drinks establishment;

(d) any playing of billiards, pool or other like games, or electronic ormechanical amusement devices, such as pinball machines, computer orvideo games and the like, for customers to play;

(e) any conduct of an organised competition of games of skill or chance;

(f) any verbal exhortation of goodwill or honour or about any other matter(whether or not auspicious or propitious) carried out by a customer orotherwise, accompanied by a ritual (like toasting) in which a drink orany food is offered, taken or handled.

Examples

A toast in acclamation to an individual at a dinner celebrating the individual’sbirthday.

Emphatic uttering of auspicious sayings during the traditional Chinese ritualknown as Lo-Hei is not allowed.

7.—(1) However, paragraphs 1, 2, 3, 4, 5 and 6 do not apply where a weddingconnected with the celebration of a marriage takes place in any permitted premisesthat is a retail food and drinks establishment.

(2) Where a wedding connected with the celebration of a marriage takes place inany permitted premises that is a retail food and drinks establishment, the permittedenterprise occupying the food and drinks establishment must take (or cause to betaken) all reasonably practicable steps to ensure that during the wedding —

(a) regulation 8 is complied with;

(b) any part of the retail food and drinks establishment which is a partdesigned for the principal purpose of serving liquor for immediateconsumption there (commonly called a bar) is cordoned off and

prevented from use unless drinks (which may include liquor) andcooked food are served, or allowed to be served, to any customer forconsumption at the bar;

(c) the following stop immediately after 10.30 p.m., regardless of thetrading hours specified in any licence granted under the Liquor Control(Supply and Consumption) Act 2015 or authorised under that Act inrelation to that retail food and drinks establishment:

(i) the sale and serving of liquor for consumption on the retail foodand drinks establishment;

(ii) the consumption of liquor on the retail food and drinksestablishment;

(d) any food or drinks (or both) for consumption on the retail food anddrinks establishment are not provided by way of a buffet;

(e) no organised competition of games of skill or chance is conducted onthe retail food and drinks establishment;

(f) the playing of billiards, pool or other like games, or of electronic ormechanical amusement devices (such as pinball machines, computeror video games and the like) does not take place on the retail food anddrinks establishment;

(g) any verbal exhortation of goodwill or honour or about any other matter(whether or not auspicious or propitious) carried out by a customer orotherwise, accompanied by a ritual (like toasting) in which a drink orany food is offered, taken or handled, does not take place on the retailfood and drinks establishment;

(h) no live performance, exhibition or display of gymnastics or acrobatics,lecture, talk or address (whether by the customers or otherwise) takesplace on the retail food and drinks establishment except a speech byany of the following who are within the retail food and drinksestablishment:

(i) a guest of the wedding;

(ii) a party to the marriage;

(iii) a celebrant or other person at work in relation to the wedding;

(i) any display or exhibition (whether on a television or other screen) tocustomers in or around the retail food and drinks establishment islimited to —

(i) a display or an exhibition (whether on a television or otherscreen) of any film or video recording that is about or relatingto the marriage or any party to the marriage; or

(ii) a speech using real-time transmission that is about or relating tothe marriage or any party to the marriage,

so long as it is only visible and audible mainly by guests of thewedding who are within the retail food and drinks establishment; and

(j) any music, singing, lecture, talk or address or any other sound islimited to public speaking, singing or dancing that is permissible underregulation 8 or the playing of pre-recorded music, pre-recordedsinging, a pre-recorded lecture, talk or address or any other pre-recorded content that —

(i) is about or relating to the marriage or any party to the marriage;and

(ii) is only audible mainly by guests of the wedding who are withinthe retail food and drinks establishment.

(3) In sub-paragraph (2)(b), “cooked food” does not include pre-packed orready-to-eat food that —

(a) does not necessarily require any further preparation or handling beforeconsumption; and

(b) can be stored at room or ambient temperature before its packaging isopened and, after the packaging is opened, may not requirerefrigeration.

8. To avoid doubt, a permitted enterprise carrying on a retail food and drinksbusiness is not prohibited from allowing a solemnization of a marriage to be heldon its permitted premises that is a retail food and drinks establishment where heldin accordance with regulation 7A.

SPORTS AND RECREATION BUSINESS AND OTHER RETAIL SERVICES

1.—(1) A permitted enterprise which provides an authorised service providinglessons or coaching in, or for participation in, a sporting activity or other physicalrecreational activity in an indoor physical recreational facility, or which owns, or

has charge, management or control of, an indoor physical recreational facility,must —

(a) ensure that any customer, visitor or permitted enterprise workerwho —


(ii) is not an uncleared junior,

does not enter or remain within the indoor physical recreational facilityto receive an authorised service consisting of engaging in any high-intensity physical exercise or any other sporting activity or physicalrecreational activity without wearing a mask;

(aa) ensure that any customer, visitor or permitted enterprise workerpresent within the indoor physical recreational facility to receive, orreceiving, the authorised service is doing so alone, or is allocated intoand remains part of —

(i) a sporting activity cohort each, if engaging in any high-intensity physical exercise or any other sporting activity orphysical recreational activity without wearing a mask; or

(ii) a cohort consisting of 5 individuals each,[S 715/2021 wef 27/09/2021]

(b) take (or cause to be taken) all reasonably practicable steps to ensurethat —

(ii) every customer, visitor or permitted enterprise worker whoenters the indoor physical recreational facility to carry on anyexercise, fitness activity or any fitness-related activity withinthat facility, does not remain within the facility for more than120 minutes after first entering;

(c) take (or cause to be taken) all reasonably practicable steps to ensurethat, when any exercise, fitness activity or fitness-related activityallowed under sub-paragraph (a) is carried on by any customer, visitoror permitted enterprise worker within the indoor physical recreationalfacility, there is maintained, regardless of regulation 10B(1)(k), adistance of —

(i) at least 2 metres between any 2 individuals (whethercustomers, visitors or permitted enterprise workers) engagingin any such exercise, fitness activity or fitness-related activity;and

(ii) at least 2 metres between every member of a cohort or sportingactivity cohort of customers or visitors or permitted enterpriseworkers (or combination thereof) engaging in any suchexercise, fitness activity or fitness-related activity from anyother individual who is alone, or any other individual who is amember of another cohort or sporting activity cohort, andengaging in such exercise, fitness activity or fitness-relatedactivity; and

(d) ensure that a reasonable period of time elapses (being at least 15minutes) since the end of an earlier class or session of its customers,visitors or permitted enterprise workers (as the case may be) to allowfor cleaning as described in regulation 10B(1)(i) or (ia) (or both) inbetween the earlier class or session and the start of the next class orsession.

(2) A permitted enterprise which provides an authorised service providinglessons or coaching in, or for participation in, a sporting activity or other physicalrecreational activity in an outdoor physical recreational facility, or which owns, orhas charge, management or control of, an outdoor physical recreational facility,must —

(a) take (or cause to be taken) all reasonably practicable steps to ensurethat, when any exercise, fitness activity or fitness-related activity iscarried on by any customer, visitor or permitted enterprise workerwithin the outdoor physical recreational facility, there is maintained,regardless of regulation 10B(1)(k), a distance of —

(i) at least 2 metres between any 2 individuals (whethercustomers, visitors or permitted enterprise workers) engagingin any such exercise, fitness activity or fitness-related activity;and

2.—(1) A permitted enterprise that operates an amusement centre in the courseof business must, in respect of its permitted premises that is an amusementcentre —

(a) take all reasonable steps to ensure that the total number of individualswithin the permitted premises does not, at any time, exceed theprescribed threshold for the premises;

(b) take all reasonably practicable measures to ensure that every customeror visitor taking part in an organised game or contest of paintball on thepremises maintains an appropriately longer distance from anothercustomer or visitor within the premises; and

(c) take all reasonably practicable measures to ensure that any cue stick orother like article used in playing billiards or pool on the premises is notshared among or used by more than one customer, visitor or permittedenterprise worker (or any of them in combination) in those premises.

(2) The prescribed threshold for any permitted premises that is an amusementcentre is —

(a) where used for individuals to play billiards or pool or to take part in anorganised game or contest of paintball, the lower of the following:

5.—(1) A permitted enterprise that is the management corporation constituted inrespect of a strata title plan for a subdivided building comprised in that strata titleplan must take (or cause to be taken) all reasonably practicable steps —

(a) to close, or make not accessible for use, by any individual every part ofthe common property comprised in the strata title plan that is arecreational barbecue or open-fire cooking facility; and

(b) to prevent the use of that recreational barbecue or open-fire cookingfacility by any customer, visitor or permitted enterprise worker of thepermitted enterprise.

EDUCATION AND CARE SERVICES

1. A permitted enterprise carrying on an education business, or the principalbusiness of which is providing after-school care for students (commonly called astudent care centre), must take (or cause to be taken) all reasonably practicablesteps to ensure that every class of its customers taking lessons, coaching orinstruction or receiving care in a room or place in its permitted premises does not,at any time during the conduct of lessons, coaching or instruction oradministration of care (as the case may be) exceed the maximum permissiblegroup size for that class.

(c) a combination of the activities in sub-paragraph (a) or (b),

(2) Despite paragraph 1, a permitted enterprise to which this paragraph appliesmust not provide, or cause or allow to be provided, in any room or place in itspermitted premises, any lessons or coaching in any of the activities mentioned insub-paragraph (1), whether alone or in combination with any other activitiesunless —

(a) every customer of the permitted enterprise and every visitor to thepermitted premises, at any time; and

(b) every permitted enterprise worker of the permitted enterprise who is atwork as a teacher or supervisor or an instructor conducting any of thoselessons or coaching without wearing a mask,

has a cleared status or is an uncleared junior.

(3) Despite paragraph 1, a permitted enterprise to which this paragraph appliesmust take (or cause to be taken) all reasonably practicable steps to ensure that, forevery class, or for each class in a course consisting of more than one class, of itscustomers taking any lessons or coaching, in any room or place in its permittedpremises, in any of the activities mentioned in sub-paragraph (1), there are presentin the room or place individuals not more than the maximum permissible groupsize for that class.

(4) In addition to sub-paragraphs (2) and (3), a permitted enterprise to which thisparagraph applies must take (or cause to be taken) all reasonably practicable stepsto ensure that for every class, or for each class in a course consisting of more thanone class, of its customers taking such lessons or coaching, in any room or place inits permitted premises —

(a) where none of the individuals in the room or place during the class(whether or not as a student, teacher, supervisor or an instructor of theclass) is an uncleared junior —

(i) there are present in the room or place —

(A) not more than 20 individuals who do not wear a mask;and

In a classroom of 36 adult students for musical drama lessons with aninstructor and accompanists on keyboard, guitar and saxophone, it is permissiblefor up to 20 fixed adults in the classroom to not wear a mask. Among that 20,there must not be more than ordinarily 20 fixed adults singing or playing windmusical instruments if everyone in the room has a cleared status. All otherindividuals in the classroom must not sing or play a wind musical instrument,even if wearing a mask.

2A.—(1) A permitted enterprise that carries on an education business providing,in the course of any business, lessons or coaching, in any room or place in itspermitted premises, any lessons or coaching in voice training or speech anddrama, whether alone or in combination with any other activities except thosementioned in paragraph 2(1), must take (or cause to be taken) all reasonablypracticable steps to ensure, for every class, or for each class in a course consistingof more than one class, of its customers taking such lessons or coaching, in anyroom or place in its permitted premises, that —

(a) there are present in the room or place individuals not more than themaximum permissible group size for that class;

(b) there are present in the room or place not more than 20 individuals whodo not wear a mask;

(d) any microphone, musical instrument or other like article on thepremises used in the conduct of those lessons or coaching is not sharedamong or used by more than one customer, visitor or permittedenterprise worker (or any of them in combination) in those premises;and

(e) not more than one class of customers taking lessons or coaching isallowed to occupy the same room on its permitted premises.

(2) Sub-paragraph (1) does not apply to the person who carries on an educationbusiness at the LASALLE College of the Arts or the Nanyang Academy of FineArts.

3. A permitted enterprise carrying on an education business must, whenproviding in the course of that business services and facilities for the organisingand conduct of —

(a) examinations or assessments for professional or vocational training,testing, certification or accreditation; or

(b) tests, examinations or other methods of assessing the level ofproficiency, aptitude, skill, knowledge or understanding of anindividual in any subject matter,

take (or cause to be taken) all reasonably practicable steps to ensure that everygroup of its customers undertaking as candidates any of those tests, examinationsor other assessments in a room or place in its permitted premises or elsewhere doesnot, at any time, exceed 50 individuals, counting the invigilators and assistants (ifany) appointed for the conduct of that test, examination or other assessment.

RETAIL LIQUOR ESTABLISHMENTS

2.—(1) The permitted enterprise must provide and maintain, in accordance withthis paragraph, in or on its permitted premises where it carries on a retail liquorbusiness, an electronic video surveillance system as to enable recording ofactivities taking place at the following parts of the permitted premises:

(a) any point of entry to and exit from the permitted premises, includingemergency exits;

(b) any part of the premises used permanently and primarily for theconsumption at tables of food or drink served otherwise than by self-service;

(c) any other part of the permitted premises where a customer or visitormay use to remain seated in or congregate in (even if standing), but isnot a toilet or bathing area;

(d) any part of the permitted premises where a customer or visitor may useto pass through the premises and is not expected to remain seated orcongregate in.

(2) The electronic video surveillance system mentioned in sub-paragraph (1)must —

(a) consist of an adequate number of closed-circuit television cameras orother electronic visual monitoring devices installed at suitablelocations in or on the permitted premises where the permittedenterprise carries on a retail liquor business, for the purpose insub-paragraph (1);

(b) be capable of recording colour images —

(i) at the resolution of HD 1080: 1920×1080 pixels or equivalent;

(ii) at 12 frames per second; and

(iii) under low lighting conditions; and

(c) be in good order and operational at all times when the permittedpremises are open for the retail liquor business.

(3) The permitted enterprise must —

(a) keep each recording made using the electronic video surveillancesystem required by this paragraph for a period of not less than 28 daysafter the date the recording is made; and

(b) display a sign at a prominent location within the permitted premises,stating that the premises are under CCTV surveillance.

3. The permitted enterprise carrying on a retail liquor business at its permittedpremises must take all reasonably practicable steps to ensure the following whenthe permitted premises are open for the retail liquor business:

(a) that every customer who enters and remains in its permitted premiseswears a mask at all times in accordance with regulation 3A;

(b) that every cohort of customers or visitors allowed to enter or remain inthe permitted premises consists of not more than the highest numberallowed for a dining-in activity cohort at any time, despiteregulation 10B(1)(n).

PART 1

BUILDING SECTOR

1. Daily records must be made, kept for 28 days and given on demand to theBuilding and Construction Authority, by the permitted enterprise about thefollowing so as to facilitate contact tracing measures:

(a) the identity of each building sector worker, permitted enterpriseworker and other visitor who enters or leaves each work site each day;

(b) the purpose for which the building sector worker, permitted enterpriseworker or other visitor is entering or leaving the work site;

(c) the respective times of entering and leaving the work site.

2. Despite the Workplace Safety and Health (COVID-19 Safe Workplace)Regulations 2021, the permitted enterprise workers who are construction workersor building elements supply workers must be grouped and deployed to work attheir work site in separate groups (called in this Part segregated teams) accordingto —

(a) trade;

(b) building operation or activity to be carried out; and

(c) place of residence,

so as to minimise physical interaction between the workers in the differentsegregated teams when they are at work.

4. In addition to the Workplace Safety and Health (COVID-19 Safe Workplace)Regulations 2021, adequate shared facilities (such as a canteen, toilet orbathroom) must be provided at the work site, and the use of these sharedfacilities must be controlled, so that physical interaction between the differentsegregated teams of construction workers and building elements supply workers,respectively, is minimised.

5. The permitted enterprise must —

(a) provide to each of its permitted enterprise workers who areconstruction workers or building elements supply workers suitableattire and other identifying article that may be worn when at work atthe work site so as to indicate their respective segregated team, such asa coloured vest, T-shirt, armband and stickers on a helmet; and

(b) require and ensure that such attire and article in sub-paragraph (a) isworn at all times by the construction worker or building elementssupply worker (as the case may be) when at the work site.

6. Despite the Workplace Safety and Health (COVID-19 Safe Workplace)Regulations 2021, the permitted enterprise must take all other reasonablypracticable steps to ensure that at the work site there is a distance of —

(a) at least 2 metres between any 2 of its construction workers or buildingelements supply workers if they belong to different segregated teams;

(b) at least one metre between any 2 construction workers or any 2building elements supply workers who are members of the samesegregated team; and

(c) at least one metre between a construction worker or building elementssupply worker and any other individual at the work site.

7. Where meals are provided to a construction worker or building elementssupply worker at a work site, the meals must be served in individually pre-packedform.

8.—(1) In addition to regulation 6 of the COVID-19 (Temporary Measures)(Foreign Employee Dormitories— Control Order) Regulations 2020, a permittedenterprise must provide or arrange to be provided private transport as described insub-paragraph (2) to convey its permitted enterprise workers who are buildingsector workers holding work passes —

(a) between the workers’ respective places of residence and the work sitewhere they are at work or to be at work; and

(2) The private transport required by sub-paragraph (1) must be a passengertransport service by any motor vehicle —

(a) on roads for journeys wholly within Singapore, with no stoppingpoints —

(ii) between the work sites where the building sector workerworks;

(b) carrying building sector workers holding work passes who are itspermitted enterprise workers, and no other passengers; and

10. There must be provided at least one separate area within the work site as asick bay that is fully enclosed for the isolation of permitted enterprise workers, orother individuals visiting the work site, who are unwell.

11. Any construction worker or building elements supply worker of a permittedenterprise, or an individual who has entered the work site, must, without delayafter he or she is known to be infected with COVID-19 —

(a) be isolated in a sick bay pending his or her receiving medicaltreatment; and

12. A permitted enterprise worker who is a construction worker or buildingelements supply worker and a resident of a specified dormitory must not beallowed to enter the work site if, in the period of 14 days before the intended entry,the permitted enterprise knows that one or more residents of that specifieddormitory have been made subject to a movement control measure.

13. Despite the Workplace Safety and Health (COVID-19 Safe Workplace)Regulations 2021, the permitted enterprise must have appropriate internal policiesand procedures and adequate controls —

(a) to monitor and ensure the compliance by the permitted enterprise andits permitted enterprise workers who are either construction workers orbuilding elements supply workers with the requirements in Part 3A andthis Schedule;

(b) to remedy without delay any instances of such non-compliance; and

(c) to conduct an adequate analysis of the risks of COVID-19 infectionsarising from the permitted enterprise’s business, undertaking or workand make recommendations to mitigate any risks identified to thepermitted enterprise,

including appointing at least one Safe Management Officer to effectively performthe duties mentioned in sub-paragraphs (a), (b) and (c) in respect of the work siteof the permitted enterprise, assisted by one or more Safe Distancing Officers forevery 50 permitted enterprise workers ordinarily present at the work site.

PROCESS CONSTRUCTION, PROCESS MAINTENANCEAND MARINE AND OFFSHORE MANUFACTURING

1. Daily records must be made, and kept for 28 days, by the permitted enterpriseabout the following so as to facilitate contact tracing measures:

(a) the identity of each permitted enterprise worker and other individualwho enters or leaves the work site each day;

(b) the purpose for which the permitted enterprise worker or otherindividual is entering or leaving the work site;

(c) the respective times of entering and leaving the work site.

2. Despite the Workplace Safety and Health (COVID-19 Safe Workplace)Regulations 2021, the permitted enterprise workers must, as far as is reasonablypracticable —

(a) be grouped and deployed to work at the work site;

(b) be transported to and from the work site; and

(c) be allowed to take breaks at or around the work site,

only in separate groups (called in this Part split teams) so as to minimise physicalinteraction between the workers in the different split teams when they are at workand during their permitted breaks at the work site.

(a) provide to each of its permitted enterprise workers suitable protectivegear to prevent transmission of COVID-19 where the nature of thework is identified as a risk;

(b) provide to each of its permitted enterprise workers attire and otheridentifying article that may be worn when at work at the work site so asto indicate their respective split teams, such as a coloured vest, T-shirt,armband and stickers on a helmet; and

(c) require and ensure that the gear, attire and article in sub-paragraphs (a)and (b) are properly used (including worn) at all times by the permittedenterprise worker when at the work site.

4. Where meals are provided to permitted enterprise workers at a shipyard, themeals must be served in individually pre-packed form.

5. There must be provided at least one separate area within the work site asfollows:

(a) a sick bay that is fully enclosed for the isolation of permitted enterpriseworkers, or other individuals visiting the work site, who are unwell;

(b) an area where visitors to, and permitted enterprise workers who do notordinarily work at, the work site may enter and wait;

(c) an office area for workers employed in a managerial, secretarial,clerical or other similar capacity in connection with the relevantspecial works performed at the work site.

6. Any permitted enterprise worker of the permitted enterprise or otherindividual entering the work site must, without delay after he or she is knownto be infected with COVID-19 —

(a) be isolated in a sick bay pending his or her receiving medicaltreatment; and

(b) be provided or caused to be provided medical treatment.[S 621/2021 wef 19/08/2021]

7. A permitted enterprise worker who is a resident of a specified dormitory mustnot be allowed to enter the work site if in the period of 14 days before the intendedentry, the permitted enterprise knows that one or more residents of the specifieddormitory have been made subject to a movement control measure.

8. Despite the Workplace Safety and Health (COVID-19 Safe Workplace)Regulations 2021, the permitted enterprise must have appropriate internal policiesand procedures and adequate controls —

(a) to monitor and ensure the compliance by the permitted enterprise andits permitted enterprise workers with the requirements in Part 3A andthis Schedule;

(b) to remedy without delay any instances of such non-compliance; and

(c) to conduct an adequate analysis of the risks of COVID-19 infectionsarising from the permitted enterprise’s business, undertaking or workand make recommendations to mitigate any risks identified to thepermitted enterprise,

including appointing at least one Safe Management Officer to effectively performthe duties mentioned in sub-paragraphs (a), (b) and (c) in respect of the work site,assisted by one or more Safe Distancing Officers for every 50 permitted enterpriseworkers ordinarily present at the work site.

PART 3

SHORE-BASED PERSONNEL

1. A permitted enterprise who is a shore-based personnel must properly wear, ormust ensure that its permitted enterprise worker who is a shore-based personnelproperly wears, an appropriate level of personal protection equipment when he orshe is carrying out his or her duties on board a vessel in the port.

2. A permitted enterprise who is a shore-based personnel must not, or mustensure that its permitted enterprise worker who is a shore-based personnel doesnot, do any of the following when on board a vessel in the port:

(a) remain on board for a longer period than necessary for his or her dutiesand does not, in any case, stay on board overnight;

(b) consume any food or drink from the ships’ stores;

(c) convene or take part in any gathering, or engage in physical interactionwith any passenger or crew of the vessel, when on board except wherenecessary or in the course of the performance of his or her work.

3. Without limiting the Workplace Safety and Health (COVID-19 SafeWorkplace) Regulations 2021, a permitted enterprise whose permitted premisesis a vessel in the port, being a vessel which another permitted enterprise or anypermitted enterprise worker who is a shore-based personnel enters and boards tocarry out work on board the vessel must provide, within the vessel, for theexclusive use of that other permitted enterprise or permitted enterprise workerwhen on board the vessel —

(a) at least one separate place that is fully enclosed as a rest area; and

4. A permitted enterprise who is a shore-based personnel undertaking work, orwhich employs or engages any permitted enterprise worker who is a shore-basedpersonnel to do work, on board any vessel in the port, must not board any harbourcraft within the port to work as a shore-based personnel if he or she has, at anytime during the period of 7 days before boarding that harbour craft, worked onboard a vessel that is used for sea voyages across oceans.

PART 4

SPECIFIED ACCOMMODATIONAND HOSTELS

1.—(1) Where a specified accommodation or specified hostel is or contains theplace of accommodation that any isolation subject is ordered to go to and not leaveunder the terms of the isolation subject’s movement control measure, the personthat manages and maintains, in the course of a business, the specifiedaccommodation or specified hostel must —

(a) provide to each of its permitted enterprise workers; and

(b) take all reasonably practicable steps to ensure that each of its permittedenterprise workers properly use (including wear),

an appropriate level of personal protection equipment or other suitable protectivegear to prevent transmission of COVID-19, when the permitted enterprise workeris carrying out duties which require physical interaction by the worker with —

(c) any isolation subject; or

(d) any utensil, appliance, furnishing, equipment or attire used or likely tobe used or have been used by any isolation subject.

(2) In this paragraph, “isolation subject”means an individual who is subject to amovement control measure.

(b) the maximum number ofindividuals which the room orplace where the solemnization istaking place may accommodate ifregulations 10B(1)(k) and 12 arecomplied with as if the room orplace were permitted premises,every guest of the solemnizationwere a customer and the organiserwere a permitted enterprise.

2. A gathering for asolemnization of amarriage in a room orplace within any place ofresidence, but not on boardany vessel.

The total of the following at any timeduring the solemnization:

(a) the higher of the following:

(i) 8 guests of the solemnization(who may or may not beordinarily resident in thatplace of residence) and theparties to the marriage;

(ii) 5 individuals who are notordinarily resident in thatplace of residence (who mayinclude any party to the

marriage) and any otherindividuals ordinarilyresident in that place;

(b) any celebrant by whom themarriage is or is to be solemnized;

(c) any permitted enterprise (and itspermitted enterprise workers)engaged in providing authorisedservices for arrangements made inconnection with the solemnization.

3. A gathering for asolemnization of amarriage on board apleasure craft.

The total of the following at any timeduring the solemnization:

(a) 8 guests of the solemnization andthe parties to the marriage;

(b) any celebrant by whom themarriage is or is to be solemnized;

(c) any permitted enterprise (and itspermitted enterprise workers)engaged in providing authorisedservices for arrangements made inconnection with the solemnization;

(d) a reasonable number of crewmembers to operate the pleasurecraft.

3A. A gathering for a weddingin celebration of a marriagein a room or place.

The lower of the following at any timeduring the wedding:

(a) the total of 248 guests of thewedding and the parties to themarriage each with a clearedstatus, and any celebrant of themarriage if the wedding involvesproceedings to solemnize themarriage;

(b) the maximum number ofindividuals which the room orplace where the wedding is takingplace may accommodate ifregulations 10B(1)(k) and 12 arecomplied with as if the room orplace were permitted premises,every guest of the wedding were acustomer and the organiser were apermitted enterprise.

4. A gathering for a funeralevent in a room or place.

The lower of the following:

(a) 30 individuals attending the funeralevent at any time on the day of theburial or cremation of the deceased,and 30 individuals attending thefuneral event at any time duringany other time of the funeral event;

(b) the maximum number ofindividuals which the room orplace may accommodate ifregulations 10B(1)(k) and 12 arecomplied with.

5. A gathering for a funerarymemorial event held orconducted other than by areligious body.

The lower of the following at any timeduring the funerary memorial event:

(a) 30 participants;

(b) the maximum number ofindividuals which the room orplace where the event is takingplace may accommodate ifregulations 10B(1)(k) and 12 arecomplied with as if the room orplace were permitted premises,every participant attending theevent were a customer and the

organiser were a permittedenterprise.

6. A gathering for a funerarymemorial event held orconducted in a place ofworship by a religious body.

The lower of the following at any timeduring the funerary memorial event:

(a) 30 participants;

(b) the maximum number ofindividuals which the room orplace where the event is takingplace may accommodate ifregulations 10B(1)(k) and 12 arecomplied with as if the room orplace were permitted premises,every participant attending theevent were a customer and theorganiser were a permittedenterprise.

7. A class of students or a slateof candidates undertakingan examination organisedby a permitted enterpriseproviding an educationservice in a room or place.

The lower of the following during theexamination:

(a) 50 individuals, comprising studentsor candidates, the invigilators andassistants (if any) appointed for theconduct of that test, examination orother assessment;


8. Subject to items 9, 10 and10A, a class of students —

(a) taking lessons,coaching orinstruction in a roomor place within the

9. A class of students takinglessons, coaching orinstruction in —

(a) any sporting activity;

(b) any physicalrecreation activity(like dance or yoga);or

(c) a combination of theactivities inparagraph (a) or (b),

from a permitted enterprisethat carries on an educationbusiness providing, in thecourse of any business, suchlessons, coaching orinstruction, whether alone

The lower of the following at any timeduring the class, whether or not as astudent, teacher, supervisor or an assistantor instructor of the class:

(a) either —

(i) 50 individuals unlesssub-paragraph (ii) or (iii)applies;

(ii) 30 individuals each with acleared status if the class isengaging in any high-intensity physical exercise,or any other sportingactivity or physicalrecreational activity withoutwearing a mask, within anindoor physical recreationalfacility; or

or in combination with anyother activities.

(iii) 5 individuals making up asporting activity cohort if theclass has any unclearedjunior engaging in any high-intensity physical exercise, orany other sporting activity orphysical recreational activitywithout wearing a mask,within an indoor physicalrecreational facility;

(b) the maximum number ofindividuals which the room orplace where the class is takingplace may accommodate ifregulations 10B(1)(k) and 12,paragraph 1 of Part 4 andparagraph 5 of Part 5 of the FirstSchedule are complied with.

10. A class of students takinglessons, coaching orinstruction in —

(a) singing;

(b) playing of any windmusical instrument;or

(c) a combination of theactivities inparagraph (a), or (b),

in a room or place within thepermitted premises of apermitted enterprise thatcarries on an educationbusiness providing, in thecourse of any business, suchlessons, coaching or
