Changes to Standard Operations

1. Reduced capacity

The pool facility, inclusive of the entire pool deck area and both pools, will initially open at a maximum capacity of 65 patrons. This represents slightly under 50% of the normal capacity limit of the main pool only. (The normal maximum capacity of the large activity pool is 132 patrons.)

Pool attendants will be directed to monitor and enforce the capacity limitation. If full capacity is reached (on a first come, first serve basis), the pool attendants will be directed to notify additional patrons that they cannot enter the pool area until others leave. Pool attendants will be encouraged to announce the capacity issue to the current patrons and to encourage anyone who has been present for more than 2 or 3 hours to consider leaving so that others may have an opportunity to use the facility.

The HOA Board of Directors may modify the capacity limitations during the pool season upon further review of pool usage and public health directives, guidelines, and recommendations. In addition, the HOA Board of Directors may consider implementing a reservation system if capacity proves to be a significant issue during initial operations.

2. Modified pool hours and pool staffing

Unlike in past years, the pools will only be open during the hours that the pool is staffed by an attendant or by a Board-authorized volunteer pool supervisor.

As a result of the need to staff the pools during all hours of operation and to allow for some dedicated cleaning time, hours of operation will be reduced in comparison to prior years (during which some unstaffed use of the pools was permitted early in the mornings and later in the evenings).

Beginning on the date the pools open for the season, the normal hours of operation will be as follows:

The pools and deck area will normally be OPEN to HOA members from 10:30 a.m. to 7:45 p.m. Exceptions include the following:

• On Mondays, Wednesdays, and Fridays, there will be a special opening time of 9:30 a.m. when access to the pool will be dedicated to seniors (age 60 and over) and for other persons who, for medical reasons, are considered particularly vulnerable to the coronavirus/COVID-19. The dedicated time connects to what is normally already a low-volume time of day in the late morning (i.e., even at 10:30 a.m. relatively few patrons have used the pools in prior years). Therefore, the intent is that seniors and any other COVID-vulnerable individuals will normally have more than one hour of use when the patron load is relatively low. Such individuals are not prohibited from using the pool at other times if they are comfortable doing so.

• If the pools are closed for weather-related or other reasons after 5:00 p.m., the normal rule will be that the pools will remain closed for the remainder of the

evening to facilitate staffing decisions. Authorized pool supervisors may elect to close the pools for the remainder of the day in other situations as well.

The pools and deck area will be CLOSED daily between 7:45 p.m. and the next day’s opening time, and also when otherwise posted or announced.

3. Entry/exit and check-in procedures upon arrival at the pool

Every household will be asked to “fob in” and “fob out” using their own household’s key fob at the pool gate. This will facilitate contact tracing, should it become necessary.

Every household will be asked to check in with the pool attendant during their use of the pool to have the visit recorded. This will be a secondary source of information for contact tracing, and at busy times will also help with enforcing capacity limitations.

4. Assumption of Risk and Personal Responsibility Statement

The HOA will institute a policy under which being present at the pool facility constitutes acceptance of the “Assumption of Risk and Personal Responsibility Statement.” (See Appendix A.)

Pool users will be informed of the Statement through prominent posting and signage. HOA residents will be further informed of the Statement via email and via the HOA website. Also, one of the requirements of the Personal Responsibility Statement is that a homeowner is expected to inform their invited guests (if guests are allowed at any point) of the Statement and of pool rules.

5. Guest policy (initially, no guests are permitted)

The HOA Board of Directors has determined that the initial guest policy will be as follows: Use of the pools will initially be limited to residents of Meadowbrook, and that guests (i.e., non-residents) will NOT be permitted to use the pool facility. The only allowance is that a homeowner may designate a babysitter/caregiver who is at least 16 years old (and who does not live in the neighborhood and who is not distancing from the children) to be at the pool as the supervisor of young child(ren) (under age 13) who DO live in the neighborhood. Such a caregiver may not bring any other person as a guest.

The reasons for this decision include the following:

• There is uncertainty regarding the demand for pool access by residents of the neighborhood. With the limitations on pool capacity, there is a desire to prioritize pool access first and foremost for homeowners/residents. With more individuals working from home, fewer programs/activities for children, and fewer families traveling, it is possible that interest in pool use may be substantially higher than in prior years.

• Particularly in the initial stages of the pool season, the Board desires for the pools to be used primarily by individuals who can be expected to be directly familiar with the special pool rules and expectations that apply this year.

• Dane County guidelines currently include an expectation that, at locations such as licensed pools, physical distancing practices should be observed except among

members of the same household. While it is possible for a homeowner/resident to practice physical distancing from their invited guest(s), it is not easy to do so on a consistent basis.

The Board may revisit its decision regarding guest access, particularly once there is some data available regarding actual pool usage.

6. Adjust target range for pool sanitizer (chlorine) levels

In addition to observing mandatory minimum and maximum chlorine levels for purposes of implementing pool closures, pool supervisors will make reasonable efforts to maintain chlorine levels above 3.0 ppm in both pools, even though a lower level in the large pool is permissible prior to closure under state regulations. To assist with this goal, the HOA will purchase new pH and ORP sensors for use with the Chemtrol units.

7. Reducing common touch points

The following steps will be taken to reduce the number of common touch points in the shared space of the pool facility:

● Pool deck chairs/furniture

○ The tables, chairs, and lounge chairs that are normally provided on the pool deck for common use will not be used this season, at least initially.

○ Families may bring and use their own folding lawn/camp chairs and similar small items. However, such items cannot be stored at the pool or in the building. Items such as large shade canopies will not be permitted in the pool area.

● Toys/games

○ There will be no containers of pool toys, goggles, noodles, etc. for common use.

○ Each family must bring (and take home) their own toys and similar equipment. Toys and other similar equipment cannot be stored at the pool or in the NCP building.

● Basketball hoops

The rims will be removed from the basketball backboards. Due to unpredictable bounces and the significant space demands, the use of the hoops would unreasonably interfere with patrons who are trying hard to maintain appropriate physical distance from others.

● Drinking fountains

The drinking fountains will remain operational and will be subject to regular cleaning. However, they will be clearly labeled as “Emergency Use Only” with instructions to notify the pool attendant if a drinking fountain is used so that it can be cleaned.

● Trash receptacles

The goal is to make trash receptacles more “touchless” for both patrons and staff.

○ The HOA will provide two medium-size bins (one for regular trash one for recyclable materials) in the pool area. The bins will not be closed with a lid during the pool day and will be lined with a plastic trash bag such that the attendants can remove the bags and place the bags directly in the large collector bins each evening (or as needed).

○ The plastic lids will also be removed from the trash cans in the downstairs bathrooms.

● Eliminate cash handling

○ The HOA will not sponsor the sale of popsicles for children as was the common practice in past years.

○ If guests are permitted at some point during the pool season, no guest fees will be charged or collected.

● Lost and found

○ Patrons are solely responsible for taking home all personal belongings after each visit to the pool. Pool staff will not maintain a season-long collection of lost-and-found items.

○ Pool staff may, but will not be required to, retain items that appear to be of potential value. Typical clothes, towels, pool toys, and water bottles that are left behind by patrons are unlikely to be collected or retained for any significant length of time.

● Food:

○ Bringing food to the pool is discouraged.

○ If a family brings food/snacks, the family should be careful to wash/sanitize hands before eating and is expected to dispose of their own garbage immediately.

● Limit Access to the Neighborhood Center:

○ Except in the case of emergency (e.g., as an emergency exit or if lower restroom is closed for some reason), pool users will avoid using of the upstairs floor of the Neighborhood Center. The stairway will be taped off to reinforce the closure.

○ There will be no entry to the pool through the upstairs of the Neighborhood Center building.

○ Pool users are also expected to limit use of the lower (basement) floor of the Neighborhood Center primarily to the restrooms/showers. The main room in the basement is not to be used as a location for pool users to eat, gather, etc. Emergency use (e.g., as a temporary storm shelter) is permitted.

8. The HOA will inform pool patrons of physical distancing expectations through

various methods.

As of initial pool opening and under the Dane County orders and guidelines for licensed pools, pool patrons are expected to practice physical distancing among households to the extent reasonably practical. The expectation will be reinforced through communications to HOA residents, through the Personal Responsibility Statement, and through prominent signage.

9. Hand washing and other sound practices by pool patrons.

Through signage and by having a highly visible station where hand sanitizer will be supplied for patron use, the HOA will encourage hand washing by all pool patrons. Signage will also reinforce practices such as “cover your cough/sneeze.”

The HOA will not require pool patrons to use face coverings, but information provided to HOA members may encourage people to use their own judgment regarding the potential benefits of voluntarily using a mask/face covering when a person is not actually in the pool.

10. Pool staff will perform an increased number of cleaning/disinfecting tasks

throughout the day.

Pool attendants will be supplied with a checklist in the form of a daily log (See Appendix B) that will identify specific cleaning tasks intended to regularly disinfect and sanitize “high touch” surfaces.

The HOA will supply both a diluted bleach solution and a non-bleach disinfecting cleaner for different purposes.

11. The HOA will follow a philosophy of “when in doubt, close the pools.”

Pool attendants, pool supervisors, and the members of the HOA Board of Directors are all empowered to close the pools any time they determine or suspect that there may have been a potential COVID-19 exposure or COVID-19 incident affecting the pool facility. If closed for any such reason, the pool facility will not be reopened for patron use access except with the permission of the HOA Board of Directors. Decisions about re-opening will be made in consultation with the most-current public health guidelines and by contacting public health agencies if necessary to obtain additional direction.

12. The HOA will have a zero-tolerance policy for unauthorized use of the pool

facility outside of operating hours.

The HOA may seek prosecution for trespassing and/or impose other consequences for any unauthorized presence at the pool facility during hours when the pool is closed, including after-hours trespassing by children of homeowners.

Employee & Volunteer Safety

1. Health Reporting Agreement

Employees will be required to sign a Health Reporting Agreement (See Appendix C) that informs them of the circumstances under which an employee may NOT report to work and must instead promptly contact a supervisor to make a confidential health report. The HOA Board designates the Board-approved volunteer pool supervisors and any HOA Board member to receive confidential health reports from any employee.

Additionally, at the start of each work shift, employees will confirm on their time sheets that, to the best of their knowledge, they are currently not experiencing symptoms of COVID-19. If any employee becomes ill during their work shift, they should immediately contact a supervisor, wash their hands at the sink in the attendant room, put on a disposable face covering, and temporarily isolate themselves in the main room of the basement level of the building near the door to the mechanical room. The employee should leave the facility as soon as a supervisor arrives to continue operations. The supervisor may make a decision to close the pools.

HOA members who volunteer as pool supervisors will be advised of the same conditions and asked to follow the same guidelines as apply to employees in terms of avoiding being present and reporting possible exposures that may have impacted the pool facility.

2. Employee absences due to illness or possible COVID-19 exposure, with

reasonable notice under the circumstances, shall not be penalized.

The HOA Board of Directors directs that there shall be no retaliation or threat of loss of an employee’s position or future work opportunities (once available and able to return to work) solely because an employee is absent due to illness or due to a confirmed or suspected COVID-19 exposure.

3. HOA will increase pool attendant training time dedicated to safety instruction

and safety procedures.

At least 2 hours of mandatory training prior to pool opening will be dedicated to safety training, including but not limited COVID-19 precautions and procedures.

4. The HOA will install a plexiglass barrier at the outdoor attendant station to

facilitate “check in” interactions with pool patrons.

5. The HOA will provide and maintain an adequate supply of disposable face

coverings, disposable gloves, hand sanitizer, soap, and tissues/paper

products for employees and those HOA members who serve as adult pool

volunteers.

6. Employee use of face-covering/mask.

• Employees are always permitted to wear a disposable mask or other face covering at any time while they are at the pool facility, with the exception that no face covering should be worn if an employee actually enters the large pool for any reason.

• Employees will not be required to wear a face mask while at the outdoor attendant station due to the presence of the plexiglass barrier.

• Employees are directed to wear a disposable mask or other face covering if they are providing direct service to or directly interacting with a pool patron (who is not from the employee’s own household) while within 6 feet of the patron and while away from the attendant station (e.g., helping a patron locate the first aid station in order to find a band-aid).

• It is recommended that employees wear a disposable mask or other face covering at other times when appropriate physical distancing (6 feet) is not feasible in the work environment.

7. Responding to a confirmed or suspected COVID-19 exposure at the pool

facility.

If an employee, adult volunteer, or pool patron is suspected or confirmed to have COVID-19 and the person has been present at the pool within the last 7 days, the HOA will close the pool to evaluate the ongoing risk, consult current public health guidance, conduct any mitigation steps (waiting at least 24 hours prior to starting disinfection procedure, to the extent feasible), and determine when it may be appropriate to reopen.

The WEDC provides the following example of potential mitigation measures: “Wait 24 hours before cleaning and disinfecting to minimize the potential exposure. If waiting 24 hours is not feasible, wait as long as possible. During this waiting period, open outside doors and windows to increase air circulation in these areas. Clean dirty surfaces with soap and water before disinfecting them. To disinfect surfaces, use products that meet EPA criteria for use against SARS-CoV-2 and are appropriate for the surface. Always wear gloves and protective clothing appropriate for the chemicals being used when you are cleaning and disinfecting.”

If the person’s most recent use of the facility was more than 7 days prior to the report of a confirmed or suspected COVID-19 exposure, the HOA may still elect to close the facility.

Sick employees (or adult volunteers) with a confirmed or suspected exposure to the virus will communicate with a supervisor regarding return to work options and expectations. In determining if and when a return to work is feasible, the HOA and employee will reference CDC criteria for discontinuing home isolation and consult with a health care provider and state or local health department.

If an employee, adult volunteer, or pool patron is suspected or confirmed to have COVID-19 and the person has been present at the pool, in addition to cleaning and disinfecting, the HOA will contact the local health department to discuss the appropriate management of potentially exposed employees, volunteers, and patrons.

• Minimally, while maintaining appropriate confidentiality with respect to the person(s) or households that are the source of the confirmed or suspected exposure, the HOA would expect to inform employees, volunteers, and HOA members of their possible exposure. Based on public health recommendations, the HOA will determine whether specific employees and volunteers will be recommended to follow a period of self/home isolation during which they may not be present at the facility, recommended to seek testing and a test result, or simply directed to continue to self-monitor for symptoms. As always, if an employee who is self-monitoring develops symptoms, they should notify their supervisor and stay home.

• The HOA will use key fob logs and the paper attendant records of patrons to assist with more direct contact tracing and notification if appropriate in the specific circumstances.

MeadowBrook HOA Pool Facility: Assumption of Risk and Personal Responsibility Statement Regarding COVID-19

NOTICE: If you are not willing to accept the terms outlined in this statement, then you are not authorized to be present at the Pool Facility and must leave immediately. Use of the facility is at your own risk.

By being present at the pool facility of the Meadowbrook Homeowners Association (“Pool Facility”), a person is

assuming the inherent risk of possible exposure to the novel coronavirus (“Virus”) and the COVID-19 infectious disease

(“COVID-19”) that is caused by the Virus. If a person allows their minor child or a minor for whom they are responsible

to be present at the Pool Facility, the person assumes the inherent risk of the minor’s possible exposure to the Virus and

COVID-19. Further, to the extent permitted by law, a minor child who is present at the Pool Facility also assumes

applicable inherent risks for themselves.

COVID-19 has been declared a pandemic, with widespread ongoing transmission having been documented in Wisconsin

and around the world. Numerous and very serious health consequences are associated with the Virus and COVID-19,

up to and including DEATH. Carriers of the Virus (with or without experiencing any symptoms of infection) can transmit

the Virus to others. The Virus spreads easily and sustainably between people. Transmission of the Virus can occur in

several different ways, including but not limited to person-to-person contact, via airborne respiratory droplets, and by

touching a surface that has the virus on it.

The Pool Facility is a shared facility, and it will be operated as a shared physical space that will be open to some

simultaneous use by groups of people from many different households. Based on public health guidelines and

recommendations, the HOA Board of Directors has instituted several precautions intended to reduce the relative risk of

exposure to and transmission of the Virus at the Pool Facility. However, such precautions in no way eliminate the risk.

A person incurs the inherent risk of exposure to/transmission of the Virus merely by being present at the Pool Facility.

PERSONAL RESPONSIBILITES RELATED TO COVID-19

By being present at the Pool Facility, or by allowing any minor for whom the person is responsible to be present, a

person AGREES that they are responsible for adhering to, and ensuring that such minors adhere to, all of the following:

1. No person may be present at the Pool Facility if they:

• Have any of the following symptoms: (1) fever of 100 degrees or higher; (2) chills; (3) shortness of breath or

difficulty breathing; (4) new loss of taste or smell; (5) nausea or vomiting; (6) diarrhea; (7) sore throat; or

(8) cough. Or, unless reasonably known to have been caused by something other than the Virus, any of the

following: (1) headache; (2) fatigue; (3) muscle or body aches; or (4) congestion or runny nose.

• Are infected with the Virus, seeking a diagnosis, or awaiting a COVID-19 test result, until such time as a

medical professional determines that they do not pose a risk of transmission of the Virus to others.

• Are in a period of mandatory or recommended quarantine or isolation related to the Virus, as advised by any

health provider or public health agency (e.g., following high-risk travel or a recent high-risk contact).

• Have been otherwise advised by a public health official or medical professional to seek a diagnosis and/or to

avoid being present at public locations similar to the Pool Facility due to individualized risk factors.

2. While present at the Pool Facility, to the extent reasonably practical, patrons will adhere to physical distancing

practices (i.e., allowing 6 feet between themselves and persons not from the same household), wash/sanitize hands

at appropriate times (e.g., after using the restroom, before/after eating a snack, etc.), and cover sneezes/coughs.

3. If a person subsequently becomes aware that they (or any other individual who they permitted to be present at the

Pool Facility) presented a material risk of transmission of the Virus when they were present at the Pool Facility, they

or a representative acting on their behalf shall contact a pool supervisor or a member of the HOA Board of Directors

to confidentially report the concern. (See website for contact info.)

4. If guests are allowed, the sponsoring HOA member shall inform any invited guest of this statement of Assumption

of Risk and Personal Responsibility. (Note: As of pool opening and until further notice, no guests are allowed.)

5. All persons present at the Pool Facility must follow other posted rules and any directives of pool supervisors/staff.

Employee Health Reporting Agreement (Pool Attendants)

People with COVID-19 have had a wide range of symptoms reported – ranging from mild symptoms to severe illness. Symptoms may appear 2-14 days after exposure to the virus.

Employees should self-monitor daily for these COVID-19 symptoms:

● Fever of 100 degrees F or higher ● Chills

● Shortness of breath or difficulty breathing ● Cough

● Sore throat ● New loss of taste or smell

● Vomiting/Diarrhea ● Runny nose/Nasal congestion (not including known allergies)

● Unexplained Muscle/Body Pain ● Unexplained Severe Fatigue/Exhaustion

YOUR AGREEMENT:

When signing in to work every day, you will be required to confirm on your time sheet that, to the best of your knowledge, you are not experiencing any of the symptoms listed above. If you ARE experiencing any of these symptoms, you agree to promptly (i.e., prior to the start of your shift, if practical) and confidentially contact a supervisor (starting with Dan Mallin and continuing through the list of supervisors until you reach someone) to obtain further direction regarding staying at home or reporting to work.

IN ADDITION, you agree to refrain from reporting to work (until receiving further supervisory direction) and to promptly and confidentially report any of the following situations to a supervisor or to a member of the HOA Board of Directors:

• A COVID-19 diagnosis for yourself, including (1) a positive lab test, or (2) a diagnosis from a health care provider (i.e., without lab testing).

• If you are living with a person who is diagnosed with COVID-19.

• You learn that you have had close contact with a person who has been diagnosed with COVID-19.

• You are placed in a period of mandatory or recommended quarantine or isolation related to the virus, as advised by any health provider or public health agency (e.g., following high-risk travel or a recent high-risk contact).

• You have been advised by a public health official or medical professional to seek a COVID-19 diagnosis and/or to avoid being present at public locations similar to the pool facility due to individualized risk factors for COVID-19.

CERTIFICATION AND AGREEMENT: I understand this Employee Health Reporting Agreement for COVID-19, and I agree to (1) self-monitor for symptoms prior to reporting to work each day; and (2) confidentially report symptoms, a positive diagnosis, a suspected exposure to COVID-19, etc., as listed above, to a Volunteer Pool Supervisor or to an HOA Board Member. I will follow the work-related exclusions and/or restrictions that may be required of me.
