States develop and promulgate contingency plans for implementation in the event of disruption to ATS with the assistance of ICAO as necessary (Annex 11)

Coordination with IATA indicated that numerous NOTAMs were providing insufficient information on restrictions/reduction in ATS, or restrictions appeared overzealous

State Letter 20/47 issued highlighting obligations to Annex 9 and Annex 11 and for States to review restrictions and to consider the following operations:

o aircraft in a state of emergency;o overflights;o operations related to humanitarian aid, medical and relief flights;o alternate aerodromes identified in the flight plan (including those being used for extended diversion time operations (EDTOs);o technical landings where passengers do not disembark;o cargo flights; ando other safety-related operations.

HQs and Regional offices used this SL to reach out to individual States where relief appeared necessary.

Template NOTAM developed to assist States highlight exceptions to aerodrome restrictions

Guidance provided on matters to be considered if reducing services over oceanic areas.

Personnel LicensingStates have issued exemptions to ICAO PEL SARPS to support aviation industry

Main PEL concerns covered by these exemptions:

• Extension of the validity of:

o medical certificates due to lack of access to aeromedical doctors

o type ratings due to lack of access to Flight Simulation Training Devices (FSTDs) in other States

o category ratings for ATCOs due to the lack of practice

o aircraft maintenance personnel licences due to the lack of practice

o FSTD qualification certificates due to the lack of State’s oversight capabilities following travel restrictions

Aircraft Operations• Many States publishing alleviations/exemptions from the qualification and training requirements

in Annex 6

Airworthiness Annex 8, Part II Chapter 3 requires a Certificate of Airworthiness be issued, renewed or remain valid, subject

to the laws of the State of Registry.

o To maintain the validity of the C of A, during the COVID-19 period, many States have granted an exemption to extend the validity of the airworthiness review certificate.

o Some State that do not have an expiring C of A do not expect much disruption unless aircraft is affected by severe damage and cannot be maintained by an AMO.

o Many States have not granted automatic exemptions to maintenance requirements. If aircraft is in operations, it should be maintained in accordance with its airworthiness requirements.

Annex 8, Part II Chapter 2 and 6 require the approval of airworthiness organisations such as design, production and maintenance by a Contracting State.

o Some States have granted automatic extensions to AMO approvals.

o However, some states have not granted exemptions to other airworthiness organisations such as Design and Production due to the availability of alternative surveillance option such as a desktop audit.

Operators are still expected to maintain their aircraft if in storage, in accordance with aircraft specific storage requirements.

ICAO actions to facilitate operations during contingency

Several meetings were held with States and industry experts in different areas (PEL, OPS, AIR, ATM, AGA, SMS, AIG, CSS-DG, MED and RSOO/COSCAPS) resulting in a set of immediate proposed actions:

• Circulate a SL reminding States about obligations under Articles 38, 39 and 40 of the Chicago Conventions and the means to facilitate meeting those obligations.

• Create a website ( https://www.icao.int/safety/COVID-19OPS ) that would include:o all temporary differences caused by COVID-19

o indication of States on what COVID-19 related differences would recognize

o guidance developed by the Secretariat and State nominated SME’s

o risk analysis (link to SMI site)

• Inform States about the website and how States can submit any additional information

• Create a dedicated COVID-19 sub-system in the EFOD dashboard

Support to States

• Implementation support to States is mainly delivered through workshops or other face-2-face activities.

• Such activities being postponed due to COVID-19, new activity types need to be defined which are contact-less and respect social distancing such as webinars, online training or applications.

Technology can help deliver implementation support, but it’s availability on a global scale is challenging
