WHEREAS, TennesseeCode Annotated §10-7-408permits counties to enact an archives andrecord managementfee to fImd county archives,and

WHEREAS, the Sullivan County Department of Archives and Tourism is in needof funding forrecords space,andpersonnelfor managing,scanning,andaccessingits archival records, and

WHEREAS, the Sullivan County Public Records Commission unanimously recommendsthecreation of an archivesandrecord managementfeefor Sullivan County.

NOW THEREFORE BE IT RESOLVED By The Board Of County Commissioners OfSullivan, TennesseeThat:

SECTION 1. In accordance with Tennessee Code Annotated § 10-7-408, which authorizescounties to establish an archives and record management fee, the county legislative herebycreatesan archivesandrecordmanagementfee in accordancewith thefollowing schedule:

A) Courts of General Sessions, Circuit, Criminal, Probate, andChancery:A fee of $5.00 for all public records filed with the clerks of court for the purpose of initiating alegal proceeding.

B) County Clerk:A fec of $5.00 for all marriage license applicationsA fee of $5.00 for all beer permit applicationsA fee of $5.00 for all notary public applicationsA fee of $5.00 for all vehicle titles, to include replacement titlesA fee of $5.00 for all businesslicenseapplications

C) Zoning Department:A fee of $5.00 for all building permit applicationsA fee of $5.00 for all rezoning requestsA fee of $5.00 for all variance applicationsA fee of $5.00 for all stormwater permits

10-7-408. Appropriation of funds Filing fees.

(a) The county legislative body of any county which creates a county records commission has the

power to appropriate such funds as may be required for the carrying out of the purposes of this

chapter including, but not limited to, the purchase or leasing of equipment, the equipping of an office

and the payment of the expenses thereof, the furnishing of secretaries and clerical help and the

employment of expert advice and assistance.

(b) In any county, if the county legislative body creates a county records commission, then the

county legislative body is authorized to:

(1) Appropriate such funds as may be required for carrying out of the purposes of this chapter,

inciuding, but not limited to, the purchase or leasing of equipment, the equipping of an office and the

payment of the expenses of the office, the furnishing of secretaries and clerical help, and the

employment of expert advice and assistance; and

(2) Establish and collect, through all entities creating public records, as defined in § 10-7-403, an

archives and record management fee not to exceed five dollars ($5.00) per document filed. Funds

collected through this fee must be designated exclusively for duplicating, storing, and maintaining any

records required by law to be permanently kept.

WHEREAS,this system will include infrastructure, such as towers with four (4) microwavedsimulcast repeater sights — being Hoiston Mountain, Bays Mountain, Downtown Bristol, andBlountville; and

WHEREAS,this system will include radios for the Sheriffs Department, EMS, EMA, andSullivan CountyVolunteer Departments; and

WHEREAS,this in cooperationwith the Stateof Tennessee,Kingsport, Bristol, and SullivanCounty;and

WHEREAS, the price for the P25 Upgrade is $6,249,000.00; the price for 1,210 radios withprogrammingandinstallationis $4,293,215.00—total being$10,542,215.00.This will be undera lease/purchaseagreementrunning for 10 years with an APRof 4.12% - making the annualpayment$1,361,411.00;and

WHEREAS, the first payment would be due in two (2) years following the date when thecontractis awarded;and

WHEREAS, a separatehandout includes the Interlocal Agreement,Contract with the State ofTennessee,andthe contractwith MotorolaCorporation.

NOW THEREFORE BE IT RESOLVED that the Board of County CommissionersofSullivan County, Tennessee,assembled in Regular Session hereby authorizes SullivanCounty to purchase an 800 MHz P25 Digital Radio Systemas describedin above details.

WHEREAS,a conflict of interest is a set of circumstancesthat createsa risk thatprofessionaljudgmentor actions regardinga primary interest will be unduly influenced by a secondaryinterest. WHEREAS, the Volunteer Fire Department (54310) requestedfor their 2014-2015budget atotal of $1,620,030andthe RescueSquad/LifeSavingCrew(54420)a totalof $330,596for their2014-2015budgetwhich is a total requestof $1,950,626of tax payerscontributions to non-profits; and

WHEREAS, the Sullivan County 2014-2015budgetrecommends$1,487,654be providedthenon-profit Volunteer Department(54310) and $294,823 be provided the RescueSquad/LifeSavingCrew(54420)for a total of$1,782,427tax payerscontributionsto thesenon-profits;and

WHEREAS, the representativesfor the Fire Department(54310)andRescueSquad/LifeSavingCrew (54420)in budgethearinginIbrmed the Commissionthirty percent(30%) of their budgetsgo to ever-increasinginsurancecosts that arenot bid out; and

RESOLUTION To Provide Funding For A Forty Hour Work Week For SchoolMaintenance Employees

WHEREAS, in order to balance the 2013-14 school budget without asking for additionalfunding, maintenancehourly wage earners work was reduced from a 40 hourwork weekto a 36hour work week without a reduction in job requirements; and

I~TITEREAS,this equatedto a 10% take homepayto thoseemployeescausingmuch financial

stresson their familiesandwell-being;and

WHEREAS, to fully fund the reinstatementof that forty hour work week it is estimatedat$440,000or at the rate of $351,769onepennycollection rate that equatesto $00125 addedtotheproposed2014-15tax rate,making it $2.3 179; and

NOW THEREFORElIE IT RESOLVED that the generalpurposeschool fund be set at1.3833andthe tax ratehe S2.3179for tue2014-15budgetyear.
