Ordinance Fact Sheet

TO CITY COUNCIL DATE MAY 4, 2020

FROM: CITY ATTORNEY

SUBJECT AN ORDINANCE OF THE CITY OF PASADENA AMENDING THE LIGHT AND POWER RATE ORDINANCE, TITLE 13, CHAPTER 13 04 OF THE PASADENA MUNICIPAL CODE

TITLE OF PROPOSED ORDINANCE:

An Ordinance of the City of Pasadena Amending the Light and Power Rate Ordinance, Title 13, Chapter 13 04 of the Pasadena Municipal Code

PURPOSE OF THE ORDINANCE:

The Light and Power Rate Ordinance, Chapter 13 04 of the Pasadena Municipal Code, sets the rates and charges for electric system customers The purpose of this ordinance is to amend the Light and Power Rate Ordinance as directed by the City Council on April 20, 2020.

The amendments will revise the character of service criteria for residential and small commercial customers to eliminate inconsistencies or ambiguities, and make certain clarifications to the Green Power service as well as reduce the premium.

REASONS WHY LEGISLATION IS NEEDED:

Section 1403 of the City Charter requires that electrical energy rates be prescribed by ordinance.

PROGRAMS DEPARTMENTS OR GROUPS AFFECTED:

Light and Power customers of the W~ter and Power Department will pay the rates set forth in this ordinance. The Water and Power Department will be responsible for the administrative implementation of the new rates.

ENVIRONMENTAL DETERMINATION:

The recommended adjustments to the electric rate structure are exempt from the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines Section 15273 (Rates, Tolls, Fares, and Charges)

FISCAL IMPACT:

Staff anticipates a modest potential reduction in net income for the Light and Power Fund over the next six to twelve months. These revenue reductions are expected to be less than $100,000 per year, and are expected to be recovered once costs are reallocated to the appropriate customer classes in the next electric cost of service study and overall electric rate amendments. Assuming no change in Green power service participation, annual revenues will decrease by approximately $68,500; however, staff anticipates an increase in participation and overall Green power service revenues with a corresponding increase in renewable energy procurement costs, resulting in a negligible impact on net income.
