673 CITY OF VANCOUVER RECULAR COUNCIL MEETING A Regular Meeting of the Council of the City of Vancouver was held on Tuesday, April 26, 1977, in the Council Chamber, City Hall commencing at 2:00 p.m. PRESENT: Mayor Volrich Aldermen Brown, Ford, Gerard, Gibson, Harcou rt, Kennedy, M arzari, Puil and Rankin. ABSENT: Alderman Bellamy PRAYER The proceedings in the Council Chamber were opened with prayer. ACKNOWLEDGMENT The Mayor acknowledged the presence in the Council Chamber of Grade 7 students from Grandview Elementary School, under the direction of their teacher, Mrs. Potts. 'IN CAMERA' MEETING The Council was advised that there were matters to be considered 'In Camera' later this day. ADOPTION OF MINUTES MOVED by Ald. Harcourt SECONDED by A ld . P u il THAT the minutes of the Regular Council Meeting of April 19, 1977, with the exception of the 'In Camera' portion, be adopted. - CARRIED UNANIMOUSLY COMMITTEE OF THE WHOLE MOVED by Ald. Harcourt SECONDED by A ld . Kennedy THAT this Council resolve its e lf into Committee of the Whole Mayor Volrich in the Chair. - CARRIED UNANIMOUSLY DELEGATIONS 1. Appeals - 1977 Social Service Grants. The Council received a delegation from Mr. T.W. Meredith representing the Vancouver Neurological Association, speaking in support of its grant request for $20,000. The Council noted that the Social Planning Department had recommended a grant of $17,280 and a motion to approve this amount was lost at the Council Meeting on March 8, 1977. Mr. Meredith, in a letter dated April 21, 1977, explained that the grant was for general operating purposes and gave some general details of the Centre's programmes. MOVED by A ld . Gibson, THAT a grant of $17,280 be approved to the Vancouver Neurological Centre. - CARRIED BY THE REQUIRED MAJORITY (Ald. P uil and the Mayor opposed)

The Director of Planning and City Engineer report as follows:

"On February 23, 1977 the Kitsilano Citizens Planning Committee recommended that N .I.P , funds be used to purchase and insta ll bicycle racks in commercial areas in Kitsilano.

The Committee noted that there are frequently many bicycles parked on the sidewalks in the Fourth Avenue and West Broadway Commercial D istric ts. The cyclists have complained about the lack of convenient places where bikes can be securely locked, and pedestrians and merchants have complained about bikes lying in the middle of the sidewalk and against plate glass windows. I t was also noted that bicycles are being chained to the trees on West Broadway with the result that the trees and small plants at the base of the trees are being damaged.

The Committee considered several d ifferent types of bicycle racks. I t was fin a lly decided that a simple tube 'protective barricade' (as shown in Appendix A) would provide the best solution. Such a rack is highly vis ib le and i t is easy to place a ll sizes and shapes of bikes against i t and to lock them securely.I t is also large enough not to be a hazard to pedestrians.

Twenty-nine locations (indicated on the map in Appendix A) have been chosen.In general racks are to be placed in the sidewalk areas of the street allowance and w ill be installed by and become the responsibility of the City Engineer. Maintenance costs are expected to be minimal.

In cases where the racks are proposed to be placed adjacent to stores, the merchants have been contacted and th e ir concurrences received.

The Engineering Department estimates that 1t w ill cost $5,500 to construct the racks, prepare signs to be attached, and insta ll them.

This report outlines the ways in which these allocations are intended to be spent, details the progress which has been made to date, and indicates the action which w ill be taken by the Planning Department and other civic departments where applicable.

(1) Community Health F ac ilities ($200,000)

Because of the large discrepancy between the community's need for improved health fa c ilit ie s and the amount of N .I.P . funding available to meet that need, i t is intended that this allocation be used as seed money, and that the senior levels of government be approached for additional funding commitments. Existing health fa c ilit ie s are inadequate, are unable to expand, and are lim ited to a one year renewable lease. Existing buildings, suitable for renovation, and meeting locational c r ite r ia , have been investigated with negative results. I t is , therefore, proposed that a s ite be acquired suitable for redevelopment to a new community health fa c il ity and incorporating the kind of residential units which are needed most and cannot be acquired through a rehabilitation program, eg. personal/extended and handicapped care. Several potential sites are under investigation.A study is also underway by the Health Department to determine future health needs in the community and how these needs can be met most e ffic ie n tly . The study w ill be used as a basis for discussion with the community and the City Health Department w ill then prepare a report for Council's Community Services Committee in June 1977. This report w ill detail both the preventative and direct health care needs in the community and make recommendations.

(2) Social, Recreational, Community F ac ilities ($130,000)

There are several options available for spending this allocation to meet the community's needs. Some of these options involve action by groups outside the community. This allocation is therefore the subject of a separate detailed report to Council which is expected to 90 to Council in May.

(3) Japanese/Community Facilities ($150,000)

In the Land Use Concept Plan Policy #12 states: "That encouragement be given to the Japanese community to preserve and expand their culture and fa c ilit ie s in the area".

The Japanese people have conducted an extensive survey of th e ir members to determine their p rio rity items. Since N .I.P . funding must be used for fa c ilit ie s which w ill be available to the whole community, a sub-committee (of the local planning committee) has been struck to work out how this can be accomplished while maintaining the essential Japanese character of the project(s). I t should be noted that the N .I.P . allocation in this case w ill again be used as seed money with extensive additional funding being contributed by the Japanese people. A report w ill be forwarded to Council, by September, for approval as soon as details have been worked out.

(4) Public Open Space ($95,000)

On December 7, 1976 Council approved that $75,000 be allocated as seed money for the upgrading of Oppenheimer Park with the balance to be paid from Parks Board budget. This major project is now almost completed.

The remaining $20,000 is intended for improved streetscape and pedestrian amenities. Possibilities are s t i l l being investigated.

(5) Projects Encouraging Employment ($5,000)

The intent of this allocation is to equip space within one of the major community projects for a fa c il i ty , eg. employment registry/workshop, etc. to encourage employment opportunities within the community. To date an Employment Steering Committee has been formed consisting of a local industrial owner (Chairman), prominent social service leaders, a construction contractor, planning s ta ff and several involved citizens. An application has been made for a Canada Works Program grant. In addition, the community has established an active registry of over 300 participants seeking employment and contact has been established with potential industrial and commercial employers with a view to lis tin g employment opportunities.

The proposed method o f operation o f a l l dances, in c lu d in g number o f chaperones and s e c u rity arrangem ents have been approved by the Vancouver P o lic e V ice Squad.The Commodore Ballroom and H o te l Vancouver request perm ission to extend th e irdances u n til 1:00 A .M .. This is n o t an unreasonable req u est, b u t w ill re q u irea bylaw amendment.

I t is noted th a t th is sectio n o f the License Bylaw has not been s t r ic t ly enforced fo r sev era l yea rs , during which tim e th ere were no rep o rted problem s. However e a rly th is year a high school Pre Grad Dance was h e ld in one o f th e h o te ls andth e p o lic e were c a lle d because o f seme disturbances and i t was found th a t liq u o rwas being consumed by same ju v e n ile s . There was no responsib le supervision o f th e a f fa ir on th is occasion.

As a re s u lt, a l l m ajor h o te ls and licen sed dance h a lls have been n o tifie d th a t s p e c ia l perm ission is req u ired from C ouncil to hold these fu n c tio n s . This gives the P o lice Departm ent an o p p o rtu n ity to examine th e method o f o p era tio n and s e c u rity arrangem ents, and be aware o f where and when th e dances are being h e ld . The Director of Finance reports as follows.

"After each election, the City Engineer removes posters and election signs from City property and telephone poles. His s ta ff keep track of the location and the number of signs, and forward to the Accounting Division, the total amount to be billed to each candidate. The Accounting Division then sends out the b ills to the candidates and seeks payment of the C ity 's costs involved in the removal of the signs.

For the 1976 election, the Engineering Department forwarded to the Accounting Division the following names and amounts. These persons were billed and in the five indicated cases, the b ills were paid. The follow-up notices have been sent, but further payments have not occurred.

CLASSIF IC ATIO N : CONSIDERATION

Council, on March 29, 1977, requested "an up-to-date status report on the Kitsilano Pool, including financial aspects and re lative information from a ll parties involved."

In view of Council's wish to proceed to a Public Hearing and the importance of health considerations as a basis of the proposal to replace the Pool, the following in­formation is provided by the Medical Health Officer:

'By le tte r of March 18, 1976 (copy to Mayor and Aldermen), I informed the Board of Parks and Public Recreation of the status of the Kitsilano Pool.Copies of that le t te r , together with a copy of the Regulations under the Health Act, are attached. The safety and health issues are detailed in this le tte r . (The conditions of the Pool are the same today as they were then.)

The Minister of Health, The Honourable R. H. McClelland, in a le tte r dated May 25, 1976, permitted the Pool to remain open for the summers of 1976 and 1977 provided:

"1. the safety and sanitary conditions in and around the Kitsilano Pool during the swimming seasons are satisfactory to Dr. Bonham;

2. a contract has been le t for an approved replacement fa c il i ty by May 1, 1977, with construction to commence following the 1977 swimming season; and

3. that no further requests for extensions w ill be made by the City of Vancouver."

These conditions were accepted by Mayor Phillips in a le tte r dated July 12,1976, and this acceptance was acknowledged by Mr. McClelland on July 21, 1976.

The current status of the Pool is that, unless a contract has been le t by May 1, 1977, for a replacement fa c il i ty , the Pool may not open for this summer season.

Council may wish to pursue this matter further with the Health Minister as my discretionary latitudes are now exhausted.

The Kitsilano tidal pool does not meet basic safety and water quality standards as reflected in the 1967 Swimming Pool Regulations (Health Act).

Prior to 1967, there was some upgrading of Second Beach and Lumberman's Arch Pools but, although they don't conform to current regulations, they were at least converted to recirculating pools. They lack many of the basic safety features of the Regulations and are therefore non-complying. In 1967, the worst pool operated by the Board of Parks and Public Recreation was New Brighton Pool. In this case, the pool water was obtained from a polluted Burrard In le t.This pool received f i r s t attention in the enforcement of the Swimming Pool Regulations, and was replaced by a modern (complying) pool.

I t is clear that Second Beach and Lumberman's Arch Pools w ill also have to be replaced, but Kitsilano Pool is the current p rio rity . In preparation for the public meeting held August 30, 1976, at the Vancouver Planetarium (meeting sponsored by the Kitsilano Community Forum), one of the participants ( I do not recall his name) researched the f ile s of the Vancouver Sun, and reported eleven deaths on record since the opening of the Pool in the 1930's. This information raised the question as to whether the City had any increased l ia b i l i t y in the event of being sued because the pool was knowingly being operated in a state of non-compliance with existing statutes. Mr. Fleming, Director of Legal Services, confirmed that in his opinion the City is more vulnerable in these circumstances.'

General Purposes Tax Levy

1. The tax ra te required to produce a balanced budget In 1977, a f t e r amending the Revenue and Expenditure Estimates fo r adjustments recommended by the Finance Committee, is 19-791 m i l l s . This is an increase of 0.791 mi l l s or approxim ately 4.16% over 1976.

2. The General Purposes tax ra te o f 19.791 mi l l s on the hypothetical average s in g le fa m ily residence amounts to $455 fo r an increase o f $18 over 1976.

3. A l i s t in g o f the tax increases fo r o ther tax ing J u r is d ic t io n s in Vancouver plus the impact on the average s in g le fa m ily residence is presented in the attached Schedule "B".

P rov inc ia l Government Grants

1. Municipal Grant in Aid

This grant remains a t $34 per c a p i ta , but the to t a l grant to be received by the C i t y w i l l d e c l in e .

- 1976 grant contained a "catch-up" provision re la te d to increased population from 1966- 71, which w i l l not be received in 1977 $107,991
